Described the crash. Well, at first i heard a big sputtering sound and usually you dont hear anything from living over here. You see planes go by. You only hear the normal and then its gone. This particular plane you heard like a sound going over the houses and then there was like sputtering. By that time me and my mom were concerned. We rushed over here and see the plane hit the side of the house and crashed right down there and it was a big explosion. So it was like a boom by then the flames were so high and then a big mushroom effect of smoke and it just bust into flames. My goodness. We are told all three victims were on board the plane, authorities are searching for more victims inside the home now. An faa spokesperson said the jet was on its way to a nearby airport. As you can see huge Massive Police presence on the scene. Investigators there as well. As soon as we get updates well bring them to you live here on cnn. Now nationwide calls to reform police. 14 days now, 14 since the Michael Brown decision, five detains since a grand jury did not indict the officer in the eric garner case. The protests against Police Violence persist nationwide. They were calm mostly peaceful but a few turned ugly in berkeley, california with looting and five arrests. As the protests grow, so does the list of people who demonstrators insist were wrongfully killed by police. Case in point, cleveland, ohio, this young man tamir rice. 12 years of age when a Cleveland Police officer shot and killed him back on november 22nd. At the time this young man had been holding a toy gun. His family has now filed a wrongful death suit. They just held a News Conference but his mother is to discussion on the criminal case. Im actually looking for a conviction. I really thought thieves playing like joking around. But i seen the seriousness in their face and it scared me. My child doesnt do things like that. I dont allow that type of toy in my house, around him. [ inaudible ] a friend. One of his Little Friends he played with. Let me bring in our senior legal analyst jeffrey toobin. Jeff toobin, we talked about the Michael Brown case, the eric garner case and now about this tamir rice case and the biggest difference as far as viewers are following it is the other two were grand juries. Shes filed this wrongful death lawsuit. Can you just explain the differences. There is also going to be a grand jury investigation in cleveland as well to see if there are criminal charges. The main difference between the two Legal Proceedings are a grand jury determines if there are going to be criminal charges against the officer who fired the shot or anyone else. Its not about money. Only about a criminal case. The wrongful death lawsuit is a civil case by tamirs family against the Cleveland Police department in an effort to be compensated for money. Jail is not part of that case. Now theres very likely to be similar civil cases in the Michael Brown case in missouri and the eric garner case in new york. But they just havent moved along yet. Got it. We also know the federal government a whole other layer of investigation. What about specifically, we heard the mother tamir rices mother saying police failed to perform cpr on this 12yearold and that was similar frustration from the eric Garner Family in staten island. Do you know what proper protocol is for police . They are supposed to save peoples lives if they can. Obviously i dont know what the circumstances were in cleveland. Right. But the duty of an officer to exercise care doesnt end with a gunshot. It ends they are required to behave responsibly, behave reasonably at all times. Now the question here, of course, is going to be was the shooting reasonable. Thats going to be the core of any criminal or civil case. Heres my question. There was an entire article and something we talked about whether special prosecutors should be called into cases like this. There was a New York Times piece headline was grand jury system with exceptions favors police and fatalities and cite this example of a case in charlotte, North Carolina in which a young man was shot and killed and the local prosecutor recused himself, brought in the state ag. They bring in a different grand jury and ultimately this Police Officer in North Carolina was indicted. And im wondering if just with your years of expertise if you think that it is time that it is mandatory that special prosecutors be brought in. Its an idea that may have come. People dont understand how closely police and prosecutors Work Together. Explain that to us. When i was an assistant u. S. Attorney. I couldnt do anything by myself. I couldnt investigate crimes. I needed partners in the fbi, dea. Thats how federal prosecutors work. You have a case agent. Youre peers. You are equals. You Work Together every day to build cases. Thats how prosecutors work. In new york city the d. A. S work with the new york city police. Thats a good thing. But when you have a possible situation of wrongdoing by the police it creates an inherent conflict of interest. Sometimes the evidence surmounts that conflict but you can see why people say it is just not something we should allow to have essentially partners investigating each other. Something i heard from protesters the other night and here in new york and family members of lost loved ones. I was curious your perspective. Something went horribly wrong as the team of 40 special forces were approaching after some six miles of hiking, a noise, were hearing from some maybe the barking of a dog that just totally gave them away. There was no fire fight. The two hostages died. But in a cruel and tragic twist were also now learning something the u. S. Said it didnt know at the time, the other hostage, South African teacher Pierre Korkie was mere hours away from being released after negotiation, this aid group out of south africa. Josh rogan is our political analyst in bloomberg view. He joins me from washington. Josh, nice to see you. Likewise. So the u. S. , the administration said they had no clue that Pierre Korkie was even there at this compound but even if they did and even if they knew this totally separate negotiation was under way to pay off, i think it was 200,000 would the u. S. Have gone in anyway . It seems that the u. S. Was not only unaware there was a negotiation going on but that South African hostage was to be released in a couple of hours. So the u. S. Had a deadline. There was a video that said that these hostages would be killed within three days. U. S. Military was working off that deadline. Had they known a couple of hours delay might have made a difference then they would have had a decision to make. They werent in contact with families or South African government or in contact this group that was doing the negotiations. They never had the opportunity to make that decision so therefore well never know if this life could have been saved. Weve talked with this about many hostages being killed the u. S. And other countries like south africa dont negotiate with terrorists, do not pay ransom. The u. S. Administration frouns upon separate entities trying to pay off these terrorist, correct . Exactly. We have two problems. One all of these families, families of james foley and other hostages that have been killed claimed they havent gotten cooperation from the Obama Administration, been discouraged about pursuing information about their loved ones on their own. The u. S. Has a very good reason to keep these operational details secret. On the other hand we have this dual policy where some countries pay for hostages and some countries dont. For u. S. Hostages thats the worst of all worlds. Theres an incentive to get hostages from western countries because you can sell most of them but the u. S. Hostages can never be sold. They are taken and never released. We heard from multiple families who have been very, very angry at the administration for not giving them, you know, the warning that the u. S. Would go and try to rescue a loved one. Do you think just with all your sources and conversations you have, josh rogan, do you think families should be told or no . My view on this is that families dont have to know the exact details of raids because that is very sensitive information, that places u. S. Servicemen at risk. What i do think the fbi and Obama Administration can do a better job not only keeping these families up to date what they are doing generally but taking information from families. Despite the warnings from the Administration Many of these families are doing a lot to find out information about these hostages and feel that information is not accepted or wanted by the Obama Administration, by the military or fbi. There should be more collaborati collaboration. They dont have to tell them when the raid will happen but they should tell them more. Coming up next, fraternities and sororities demanding an apology. They want an apology from their university and reinstatement of their social activities. Last month the University Administration shut down all greek operations in the wake of Rolling Stones explosive reporting. As we led the show friday with this news Rolling Stone apologized for their word discrepancies in that particular article. They then revised their apology saying the mistakes are on Rolling Stone not on the victim. Will is joining me from charlottesville. Will, welcome. Thank you for having me, brooke. I know youre in the thick of this. Youve been doing advocacy work for four years. Your reaction to Rolling Stone back pedalling on this story. I think it shows a lot about sort of the media and how to handle questions like this. And i think it really, for me, you know, put a damper on any positive spin that we were all taking out of this issue. Im still committed to working for it and i think a lot of people on our grounds are still committed to working for it. So, you could say that this could set your organizations efforts to stop sex assault, to stop the reporting of it, stop it drastically to encourage victims to speak up. Explain how this would potentially, my worry this Chilling Effect moving forward. Sure. And i think right now especially on grounds here were sort of, were at a precipice. Were at a turning point. We can go in one of two directions. I think that we can respond to a lot of the recent developments in a positive way that still affirms, supports survivors and keep moving forward with a lot of the good things that were put in place after this article initially came out or we can sort of turn back into, you know, a culture of for lack of a better term apathy and a culture that doesnt believe or support survivors. If survivors feel like they wont be believed or be supported then they frankly are not going to report and anything we do institutionally will not have as great as effect as we want it to. I hope i want goes the first way that you outlined. I have the exact same thought. A lot of good has come out of this. Uva has this zero tolerance policy. No longer the status quo is acceptable. I talked to catherine valentine. She brings up this great point. Lining, cheating and stealing on ground of uva you are guilty you are out. But according to this dean in this interview you say yes i committed sex assault you can still walk among other students on grounds. Youre not kicked out. I come back to this question, will these individuals be forced to leave or is this acceptable behavior . Well, to answer the last part of your question first, no it is not acceptable behavior. And i think that what were at a point right now where i think the vast majority of students on the grounds are and everyone on the grounds views this rightly so as abhorrent behavior. And so i think that really trying to get to a point where the Community Feels like it has the potential to actually follow through with these prosecutions, is a very important point. But, i think sort of the adjudication process of the Sexual Misconduct board is something that really needs to be looked at, but i think that it needs be looked at as the complicated issue that it is and sort of removed from our existing honor system which itself is facing a lot of pressures. Weve had some changes even since the time ive been here. Hold those Administration Officials feet to fire and keep asking tough questions. Thank you so much. I appreciate it. What in the world is in this Senate Report on post9 11 interrogations that prompted the pentagon to warn its commanders around the world that there might be trouble and to review base security and let me take this a step farther why would the u. S. Secretary of state john kerry phone Intel Committee chair Diane Feinstein and ask her to bear in mind the timing of the impending reports release. Is there even a bomb shell that is left in all of this . Well, perhaps there is. The report is due for imminent release. Mike baker is with me now a former cia operative and with me here in new york is jeff toobin our cnn senior legal analyst. Mike baker let me begin with you. Your thoughts on this and what kind of, if any, what kind of bomb shell might be in this carefully worded report . I dont think its a bomb shell in this report. The warnings that went out to our facilities overseas, military embassies and others overseas in part setting the table for releasing this summary. I dont believe its innocently a bomb shell but i think they are being cautious. Thats a smart thing to do. Look, its a very emotional subject. Everybody has a take on this. Weve been debating this for years. My take is frankly this is as far away from unbiassed objective investigation as you can possibly ask. What they did five years and some 40 million ago is that they decided heres a thesis. Our thesis is bush is bad and torture and thats awful now lets write a report around it. So its not an investigation where you start out you interview everybody. You collect all your evidence and facts and create an objective finding. They created a finding that they believed in and wrote their report to match it. Huh. Jeff toobin you agree they had this thesis ahead of time . I dont know. I havent read it. I dont think this gentleman has read it either. Its a little premature to be denouncing a report that hasnt been made public. Look the question here is the Intelligence Community genuinely worried about whats, you know, the implications of this report they are on high alert. Or are they simply trying to divert attention from their misdeeds which will come out in this report. I dont know. It does seem to me i would argue i dont know that the other gentleman i dont know the other gentleman knows about the misdeeds coming out in this report. My point about this is again one side of this argument, the left did very good job years ago in seizing this, the high ground on this. You either are talking and engaging in chat with the high value detainee or the tar get youre dealing with or its all torture. Nothing in between. They did a very good job of framing it youre talking about the left. You talked about john mccain who talked about water boarding being torture. I said one part of this. Okay. I dont think this is a purely partisan issue that, you know, left versus right. I think this is a very important chapter in American History, the treatment of the detainees post9 11. A lot has been known. A lot, i guess, based on this report is not yet known. But its an important chapter of American History and unless theres an awfully, awfully good reason it seems like the American Public is entitled to know. Let me jump in and play some sound. This is the late journalist for vanity fair. All right. Are you breathing . One of you mentioned water boarding a moment ago. One of the things people will bring up when it comes to this report is that so many innocent lives were taken on 9 11 and jeff toobin do you think that, you know, should the public know the ins and the outs of what happened to fight this war on terror . Whats been done in the name of the American People should almost always be public. Obviously if you can point to specific facts that in specific negative implications then you have to take a second look. But by and large i think the rule should be full disclosure. What about the balance. Youve been in the field, mike, for years and years, the balance of, you know, security folks there on the ground and this right to know. Yeah. You got to find a point on spectrum. We do this all the time. We have this calculation the moving of the pendulum between privacy reits and liberties and then security. The president at one point in time said look thats a false choice you dont have to give up one of course you do. He came back around and said yes, you do. I understand why this is such an emotive issue but i have a number of problems with this particular way of approaching it. Look, the senator feinstein and some of the other senators on the Intel Committee seem to be practicing selective memory. Theres a well worn path between langley and capitol hill. Its not as if these folks were not briefed. I suspect and i know, again, jumping ahead of this before the report is released but i suspect theres an element here where some people are trying to recreate or rewrite history in a sense to distance themselves from actions that now they feel are long time from 9 11 werent appropriate. Thats a good point. That, you know, should the senate be shocked shocked to discover things they were told about at the time. I hope thats part of the report. But i guess well see tomorrow. What do they know about preparing a fossil or packing it or anything. The lar sons were trying to do a little bit negotiating, puts you under lock and key at our place to prevent damage. I said, you just tell me and that fossil wont go anywhere. Its not like its going to disappear in a brief case. That request was denied. I mean crime scene tape around a trex discovery. Have you ever . The ten year long dispute went to trial resulting in jail time for one of the paleontologists and sue was auctioned off for 8 million and is on display in chicago. Joining me now to talk about this fascinating story, the senior paleontologists with the u. S. Bureau of Land Management. Scott, welcome. Hi, brooke. Nice to meet you. When you watch this film two story lines diverge. You have the discovery of this trex and then the fall out. Let me begin at the top with the discovery. Put this in perspective for all of us who love going to museums. How significant is this trex discovery in all of history . As far as dinosaurs go this is one of the most amazing fossil ever found. Its an amazing discovery. I think that starts to distract from other parts of the story too where we talk about how it ended up in a criminal trial. But in fact that criminal trial wasnt for the dinosaur. Okay. Youre getting ahead of me. Im just trying to wrap my head around. First this crazy discovery. Then you watch this this is south dakota. I couldnt help but wonder. I guess, you know, in googling lots of fossils are found in the west. But was finding this in south dakota, how much of a shock was that . Its not so much a shock to find a dinosaur in south dakota. Theres northern south dakota, western south dakota the hell creek formation and theres a lot of fossils are found there. So the finding of a fossil isnt so unusual, its how complete that fossil was. It was really unprecedented. Just amazing dinosaur. So here this was and this was federal land. And so im wondering with you, scott, stand on this issue. Do you think paleontologists should be able and allowed to go into federal land to dig, for these amazing discoveries. This fossil was found on a ranchers land, it was private land but Indian Trust Land which got into a long protracted case over the ownership of the dinosaur. Now wthe bureau of Land Management fossils that are found on Public Lands Bureau of Land Management, u. S. Forest service lands, National Park service lands, those fossils can only be collected with a permit an then once someone clebts that fossil it has to go a Public Museum where it remains in trust for the American Public. This fossil was on a ranchers land but under an Indian Trust Land. Here you are. Lets take this group and its your first day at work with the federal government happens to be the day that sue, this trex is confiscated. Do you think the raid went a tad too far . Well, i wasnt part of the investigation. My first day of work was may 14th, 1992. Its a day that, you know, its a big day in palenotology. I was told by my supervisor check out the news tonight and wow what a day that was. So the federal government, though, was asked to step in. Ive heard they found it. The government took it.
