Her attackers and Rolling Stone put this apology on its website. In the face of new information, there now appear to be diskre potential fallout for the university and for women at that campus. Let me bring in sara. Our investigative correspondent and also brian stelter, host of cnns reliable sources. In reading when this came down minutes ago, i thought, okay, the magazine is apologizing because a number of major papers have begun to question the validity of the piece but when they talk about discrepancies in jackies story, and we know what they are. I just got off the phone with the attorney of this fraternity. He said, one, they went through email records and council records, a council at the school that regulates greek life. No party that night. The night she describes that she was brutally raped by seven men, there was no party. The guy they said orchestrated the whole thing and brought her to the party and lured her into the room, he was not a member of the fraternity. They identified him. Not a member. There was no side staircase which was a big detail how she was led up the staircase to it the room where she was attacked and she has dreams and flashbacks of that staircase. No staircase according to the lawyer. No pledges that time of year. No members that had nicknames, the nicknames she described in the story. Nobody existed at that frat with those nicknames. The final thing i just want to tell you, he said this to me. He said they spent 20,000 in the last couple days protecting the house thats been vandalized putting security and putting cameras up. He said, you know what . Its not part of our culture. Its just not true. We should add one other piece to this which is the other thing we learned is the Washington Post interviewed jackie, the woman at the center of this story. First time this woman has been interviewed since Rolling Stone article came out. Shes standing by her story. I have to add to that, i was on campus earlier this week and i talked to many of jackies friends and other survivors who know jackie. When i asked them privately, i said, you know, there have been some questions about the validity of this reporting and its an outrageous attack. They said two things. One, they believe jackie. They know jackie. They believed her story. They also said this. It was such a horrific attack detailed in such a way that they were afraid that rape would become defined by this brutal gang rape. Basically if youre a woman and youve been assaulted on campus, it wasnt legitimate unless you were assaulted by a member of greek life and that was a concern for them. Thats ridiculous by the way. A huge part of this story as a woman in reading all this is for all of the women in the future from this day forward who are sexually assaulted and raped, will it be taken as seriously as it should be . Thats one thing. Back to you, stelter. I take a deep breath as a journalist on this story. Rolling stone is a phenomenal magazine. They do a lot of great work. Wonderful work. Its either, you know, the journalists who wrote the piece on how they defend wanting to be gentle and sensitive to this alleged victim and presuming they are trying to talk to the alleged attackers and, two, that we read it and ingested it and didnt question it as much. We see this with cosbys accusers as well. An evolution over how victims of alleged Sexual Assault are treated by the media. We have moved in a better direction. We take claims more seriously and report on them more thoroughly. Rolling stone was asked by jackie not to contact the alleged attackers and they now say they regret that decision and they agreed not to contact them. Theres a point in every story where you have to call the person that might ruin your story might turn out to tell your story is wrong and tell your story obsolete but you have to make that call. Thats where this focus is now on the journalistic question why didnt Rolling Stone go ahead and make those calls and check with the alleged attackers and hear their side of the story. They could have still published a version of the story with jackies voice but the fact they didnt reach out to alleged attackers makes the difference. Their statement even says that they did reach out in some way to the local branch, the National Branch and this struck me, brooke. They said this is Rolling Stones statement, that the local branch and National Leadership responded that they couldnt confirm or deny her story, jackies story, but had concerns about the evidence. Thats where they didnt take that extra step. We should note, the best research on this topic show that 98 of rape and Sexual Assault claims are correct and not made up. There may be 2 that may not be accurate but vast majority are accurate. We cannot. You have a huge story coming up on sunday. Reliable sources, mr. Stelter. Thank you. I was in the thick of it for seven hours with hundreds and hundreds of people here in manhattan. And listen, this story isnt just a new york story. This is a dallas story. Its a chicago story. Boston, orlando, so many other cities. We walked at least with a number of people eight miles. The length of the Brooklyn Bridge here with all these protesters of different socioeconomic, ethnic backgrounds, ages and theres a moment here youre looking at it. This was the moment that just really makes you stop and think and it was incredibly poignant. Cardboard caskets and silence. Silence of the moment spoke volumes. Well play that for you coming up. That was in the middle of atlantic avenue there. You can see hundreds of people on the ground. All of this to express frustration after the grand jury in Staten Island did not indict that Police Officer who put eric garner in a choke hold back in july. 43yearold father of six died and his mother told cnn she cannot forgive officer daniel pantaleo. My son was no threat at that time. If you look at the video, hes talking to them. He has his hands up at all times. They know that he wasnt going to try to attack them or anything. He wanted to be a hero. He went behind him and put him in a choke hold and brought him down and then he wouldnt let him go. As my son begged for his life. He still held on. So it was like a thrill kill. Eric garners mom there on new day. Here is alexandra field out in new yorks times square. The protests began wednesday night. They were even bigger and more massive last night. What are plans for this evening . Reporter we know that theres a large demonstration planned down in Lower Manhattan around 5 30 today and another demonstration planned at 5 00. Weve seen this thing grow and pick up steam over the last couple days spreading to different parts of the city and to different cities around the country. The first night, 83 arrests were made. The second night 219 arrests were made. That makes sense when you consider the fact that there were so many more people filling these streets and crowding into times square on the Brooklyn Bridge and in Staten Island and Lower Manhattan. Protesting and demonstrating and making themselves heard last night. So, look, two nights does not equal a trend. We cant say that the third night is necessarily bigger than the second or the first. We do know this. The people that believe so passionately in this cause and getting this message out have had more time to organize and to coordinate with one another. We knew that when this decision came from the grand jury if there was not an indictment of the officer involved in the death of eric garner last july that we would see protests and demonstrations and as soon as we heard there was not an indictment, people got on social media and they started to organize but as this has gained traction and gained so much attention there are more organized events taking shape and thats how we know to expect something, for instance, at 5 00 or 5 30 today here. Just to stress, being out with these people for seven hours last night entirely peaceful up until the very end when i saw about two dozen people become arrested because they wouldnt get out of the middle of the manhattan bridge. Eric garners daughter said it was less about race and more about use of power and police brutality. Do you agree with that . I look at the history of this country and i look at the pattern and obviously its a repeat pattern. I think a lot of it has to do with the dehumanization of black men in this country. I think that can be largely contributed to social engineering as well as negative media propaganda. You know, unfortunately when obama was elected, i think two things happen in this country. I think, one, black people felt as though we made it and i think a lot of white people felt as though we just lost our country. So i think those two things together kind of created a recipe for disaster. And there was never this empathy or any type of sympathy for black men in america and i think a lot of that is do to what we see in the media. I think listen, you can say the media. Its also pop culture, movies, and also from what i can understand because you talk about this stereotype that black men are perceived by some, not all, but its the superhuman monsters is something i read that you said. Where do you think that comes from . Well, i mean, look, if obama looked like sam jackson, i dont think he would have ever made it into office. How do you mean . I think theres a certain fear thats associated with our image and a lot of it is due to when i say media, its also television and film. For example, when you see stories that are told about black people for example like in the american gangster movie, you take a guy like frank lucas who we see this film about a guy who is hell bent on destroying his own community and selling heroin and pumping drugs into the black community but there was never any context or back story to actually understand the circumstances that gave birth to this type of mentality. You dont have any type of empathy for him as a human being. You dont know anything about him growing up in the south and witnessing his family members getting his head blown off by the ku klux klan. We start with a place of theme being demonized or black men being vicious. When you listen to most of the zimmerman and the Police Officer that killed mike brown, you see theres a pattern. People are saying that they feared for their lives and they see these people as demons and gave an example of hulk hogan. Theres definitely a perception of black men in this country that is feared. So with this perception and with this stereotype in terms of deconstructing the stereotype, i had a phenomenal conversation with this rapper from atlanta who said something to me that really has just stuck. It will stick for a long time because i said so now what . What would one solution be . He said, brooke, we have to be, you know im a black rapper from atlanta. Ive been a democrat, but i have a lot of White Conservative friends. I invite anyone who doesnt look like me to come to my church. We all have to get out there and mix with others who dont look and sound like us. It sounds like you agree with that. We need to broaden our perspectives. I think its more than that. I think we also have to create content that, you know, that actually gives different perspectives of the black experience. We can tell stories that do show a side of black people that dont necessarily hinge on the fact that theyre black. You understand what im saying . Theres plenty of layers to what the solution is but i would say most importantly, i think we have to be a lot more proactive in creating our own controlled media. If we agree theres a lot of negative propaganda out there, we always have the ability with iphones and our own cameras to go out there and cover stories and actually show other sides to whats happening. And i dont want to get too winded, if you look at whats happening right now in the media like where we see so much footage of the rioters and the people that are breaking into stores and destroying their communities, its hard for you to have sympathy for the victim because subconsciously you draw a parallel between the victim and those people who are behaving like animals. Therefore you dont i see what youre saying but let me come back with this. I was out with incredibly peaceful marchers last night. I was walking with them across the Brooklyn Bridge and back into manhattan for seven hours. And never once did i see smashing windows, tossing over cans, lighting any cars on fire. So i do think that we are showing were spotlighting that peace, the call for change, thats what i saw with my own eyes last night. And to be fair, there is some coverage of that. I think there could be more. Im not putting that responsibility on cnn. Im saying this is our responsibility to bring these things to the forefront. I understand. I was just there and forgive me if i got a little this is what i saw. I appreciate it. I appreciate your perspective. The Police Killing of an unarmed man in phoenix, arizona, brought protesters out to the street. Demonstrators marched to Police Headquarters to protest the death of a man who was shot while struggling with an officer investigating a tip about an alleged drug deal. Police say the officer thought he was clutching a gun in his pocket. That turned out to be a pill bottle. Tell me more. We dont want to try to group all of these shooting deaths or deaths of unarmed africanamericans together because each case is unique. Let me tell you about what we learned in this particular case. According to police, they had two separate witnesses who said there was some drug dealing happening from a black cadillac suv. They responded. An officer was sent to the scene and encountered the man inside a vehicle that matched the description of this vehicle that witnesses had reported. He apparently took off as an officer encountered him and fled to a nearby apartment, which we know was his girlfriends apartment. The officers followed suit. There was a physical struggle inside that apartment and at some point the man reached inside a pocket. An officer tried to grab that hand reaching in the pocket and thought he felt the butt of a gun. Thats when he used his gun, the officers gun, and fired two shots into the torso of the man dying there on scene. We did hear from his mother who says her son was not perfect. She admits he had a criminal record, dui and drug possession but she said he didnt deserve to die. Telling you this is not about race. Its about a young man gone too soon. This is about the Police Department who are untrained and who need proper training. He was somebody important. He was just not one thug out there on the street. He was somebody important. And he made a difference in everybodys life that he touched. The police chief telling africanamerican leaders in that community he pledged a full investigation and the attorney is looking into whether the use of force was justified in this case. We do know it was a pill bottle now that was in his pocket and not a gun although police say there was a gun found in that vehicle that officers were suspicious about. I want to point out that comment about race made by the mother because she says she knows there is a heightened awareness about the conversation regarding other controversial cases, Police Encounters between Law Enforcement and africanamerican men. She doesnt believe that her son was killed because he was black. She believes the greater issue is that in this case the Police Officer used lethal force too quickly. He was too trigger happy and that is what took her sons life. Brooke . Thank you so much. Charles barkley went public about his thoughts about the unrest in ferguson first on a radio show and then i sat down with him for about half an hour earlier this week. I asked him to respond to his comments calling these people who were breaking the law in ferguson and looting and rioting and torching cars and called them scumbags and Police Officers are not out to kill and target black people. That same day, his colleague kenny smith, penned an open letter in usa today. He told chuck about it ahead of time heavily criticizing and challenging Charles Barkley. The letter stirred a social media frenzy and then Flash Forward to last night live on tnt for ten plus minutes, the lifelong friends addressed it on live tv. We as black people need cops in our community. Theyre not there just to kill black men. Theyre there to protect us. We as black people have to develop a relationship with sth them. We have to acknowledge theres a disparagement between poor people and africanamerican people in the law. At first it was on purpose and then civil rights has come, which is only 50 years or so behind. Its not like my parents were part of that. So you have to understand that its still fresh in the africanamerican household. Maybe i shouldnt have used the term scumbags. Its irrelevant. Theres no justification for what they did. Weve all been angry or upset in emotional environments and they may have done things out of character. When you dont have a voice, sometimes this leads to that. Figure out a way, a solution, to give people a voice so they feel they can be heard other than burning down things and looting things. As a black man, if i came out and said all of the cops suck, all black people say i love that damn Charles Barkley. You are always in an awkward situation. As my grandmother said. Im going to judge everybody by their own merits. Black or white. Ill be fair. And some people are going to agree with me and some people are going to kiss my [ bleep ]. I think one thing is interesting watching this whole thing. We have talked a lot on your show about charles comments with me. I think its first interesting saying scumbags referring specifically to the people who were breaking the windows and torching the police cars. You were there in ferguson. You saw it with your own eyes. He said im sorry. I shouldnt use that word. That is one of kenny smiths points. In some of these communities, a lot of these people feel like theyre on an island. You have flowers and you have weeds. Theres a lot in there. I really i am not laughing at them but laughing with them in a good way. Im glad they had that conversation. It takes a big man to say maybe i shouldnt have done this. Im sorry. That also goes to credibility and honesty. He may not say it perfectly. May not like what he says. He says it like he means it. Thats what i love about him. I dont always agree with him. The conversation they were having, i had these conversations with my colleagues here. I had the same conversation, quite frankly, with spike lee in the green room. With Michaela Angela davis in the green room and about me and how we cover news stories. I think that thats a conversation of privilege. You dont often see people of color, especially minorities, disagreeing with each other. In the minority, there is diversity inside of that and thats what people are seeing playing out. Its a good thing that this is happening because that means we are progressing as a society. People who are in a minority can disagree with each other and agree to disagree. I thought it was a great conversation and we need to do more of it. Chelsey, jump in. Do you agree with don . We should keep talking about this . I think that the conversations were having are very valuable. When i read mr. Smiths letter, the first thing that popped out to me was his first three paragraphs he was praising Charles Barkley for all that hes done in the nba but then he went onto discuss, you know, maybe hes not as credible as someone like al sharpton. I took issue with that. Al sharpton is a civil rights leader for hire and hes around giving speeches in front of the camera but hes doing it so he can pay off his 400 million tax bill so i think that when we look at these conversations thats not fair. Thats not fair. The basics is that there is reverend al sharpton has a 4 million tax bill. When riots were happening in ferguson, al sharpton wasnt there. We have to get back to communities taking control. Elected people who represent them. Being responsible in knowing who to vote for because when we think about police and we think about all of these issues that are taking place right now, its a local issue. Police officers are local. Voters, residents, Community Members can go to the ballot box every four years to vote for judges and district attorneys and thats what we need to talk about. We need to talk about solutions to these problems and how we move forward with these conversations. Brooke, can i jump in . Do you mind . So heres the thing. The reverend al sharpton and i have a very similar relationship as charles and steve. We have a very as Charles Barkley and his colleague. We have a very similar sort of relationship. I dont always agree with ref andref reverend al sharpton and he doesnt always agree with me. I rode the plane back with reverend sharpton from ferguson. I dont have to defend him because hes not on the network. He is an activist. Thats his role. Thats his lane. We can criticize him. I dont think we should unfairly bring in a tax bill or anything like that. I agree with you. We do need to talk about those issues but i dont think we should demonize each other just because we disagree with each other. That was Charles Barkleys whole point with me. When i talked to him earlier this week, he said why is it, brooke, that i cant agree to disagree with some of the people who look like me without being called names. I totally agree. Ive been really disgusted in Roger Goodell and smith from the nfl. This thing could have been handled right away. If you hit a woman one time, youre going to get suspended for six games and if you do it let the Legal Process play out like it did with ray mcdonald in san francisco. The second time you hit a woman, youll never play pro sports again. For them to put off this conduct policy has been atrocious. You cant have men hitting women period. Should Roger Goodell still have his job . Im not an advocate of people losing their job. For them two guys not to get together, me and my dogs in five minutes could solve that issue. You cant hit women. Youll get suspended for six games. After the Legal Process play out, second time you hit a woman, youre suspended for life. Forever. You cant play in the nfl. A bronx grand jury did vote to indict the white Police Officer but that indictment was thrown out on a technicality so the mother told me shes simply waiting to see the department of justice will take their case.
