Still some concern, its a secret proceeding until the state prosecutor makes an official announcement. It is considered a secret proceeding and that the concern, obviously, is it will leak prematurely. The charges under consideration if officer wilson is indicted. Take us through that. Theres a variety of charges including obviously murder and manslaughter. Thats the big discussion whether or not this grand jury having heard all of the evidence thats been presented and obviously all of the concern whether or not they will choose to do something perhaps on the lesser charge, theres a very high bar, don, as you know for some of these cases given the facts of the case we know publicly, a very high bar with Law Enforcement and police shootings. So the concern was, perhaps, you know, would you have a grand jury pressured into the lesser charges in order to placate the public. They know, as you said, what the media has been saying and all the public reaction to it. Stand by. I want to get you to weigh in. I want to bring in our legal analysts. Put the charges back up and ill go to lisa with these as we look at the charges up on the screen. Lisa, if there is an indictment, first degree murder, seconddegree murder, voluntary manslaughter, involuntary manslaughter. What do you think is the charge . We keep speculating. We know Darren Wilson got to testify and we believe he got to testify and gave his version of a selfdefense claim. If that in fact is true and this grand jury is maybe struggling with his culpability, responsibility, what the rest of the world is going to think, they may compromise and come back with that imperfect kind of selfdefense. We kind of believe it was selfdefense but he should have known better and it ends up being the lesser charge there which is involuntary manslaughter. We just dont know. We dont know how they are stacking up the forensic evidence against what Darren Wilson told this grand jury or all the other witnesses that came in to testify. How do they sync together here. Right. We dont know the evidence because, again, its not been released and we dont know the decision yet. The prosecutor has said, lisa, if theres not an indictment he was going to seek to release all of the evidence that was given in the case. But what guidance . Weve been saying the grand jurors have been able to watch the media coverage, whether they are doing it or not, what is the guidance given to the grand jury . Are they told to avoid all media . Its interesting. We know in a regular jury trial that there are specific jury instructions given to the jurors the minute they hit the courtroom in terms of look at outside media accounts, outside evidence ucant be an independent investigator. Grand juries vary. They are not sequestered. That outside influence may permeate their decision. They got to know whats going on in their community. They got to hear whats going on in church and their neighbors. They are not restricted like we could do in a jury trial so its really hard to know. I mean theseors are in a tough position in terms of martialing the evidence they hear in that jury room and try to keep it separate from what they are hearing in the public media. Lisa, i want to grab the paper here because i want to ask you a question about this. Who really holds the key here when it comes to is at any time judge overseeing this or the prosecutor . Because the judge says, the judge hasnt agreed to release the evidence and the prosecutor is saying were going ask that all of the evidence is going to be released. Hes under the assumption it is but the judge says you know what . Im not sure ill do that. Thats the front of the paper here. Judge hasnt agreed to release evidence, Court Official says. Thats the st. Louis postdispatch. Thats interesting. It seems theres a little bit of a miscommunication or something happened here and were not sure. The judge has the final say. The judge has the final say in every grand jury release of transcripts. Thats not unusual. The prosecution seeks permission from the judge and can i give this to defense counsel and regular proceeding . I have to get permission to do that. In this particular case i can release it out into the public venue. Thats very unusual. Okay. So, in your experience well so the judge has really the jurisdiction here to do whatever. So it doesnt matter if the prosecutor wants it all released at the end of the day if the judge says im not going to release any of it does it matter what the prosecutor says. Its not going to happen . He can go out to the public and say i tried. I tried to give you everything but the judge didnt allow me to do that. So, its why would he say that then why would he make the comment that it will all basically giving the assurance that all of the information would be released, all of the evidence would be released if the judge really thinks he has some power with the judge. Im sure the motion he makes to the court hell be explaining why that transparency is so crucial here so im assuming that he thinks, you know, the judge will follow our direction on this and it makes sense that its Public Policy and makes sense in terms of transparency and i dont know this judge and this judge may be totally in step in believing that should happen. Again the judge has the final say. Okay. Stand by, lisa. I want to bring in mark omara and danny cevallos. Youve been listening to the conversation. And the judge overseeing this case. About the discrepancy on whether or not the information will be released. The judge really hasnt agreed to release forensic evidence the court but bob mccullen has been saying all along with the exception of redacting the names of the grand jurors. We know he wants to do it and to protect himself, the process and grand jury from their decision if its a no true bill. If its an indictment we wont see the discovery for a long, long time. What happened over the weekend the clerk said something she shouldnt have said. That the judge was okay with it. A motion wasnt presented to the judge. Hasnt heard the evidence. Hasnt stein evidence. Hasnt made any decisions. I think what happened was the judge sort of ratcheted things back and said ill wait until i gate motion from mccullen, look at the evidence and decide what to do. Having said that i think it makes sense for all of us that theres transparency and the judge will release the information once redabted. Okay. Danny, as we are getting close to a decision here should we read anything into the fact that, you know, as of late they said that 48 hour notice may not come in to play here, there could be an announcement there will be an announcement and the decision of what that announcement is could come soon after. Should we read anything into that . Well, they are dealing with two competing concerns, right. Theres always secrecy. They must preserve grand jury secrecy. The other problem is with each added hour you run the risk of leaks. Not intentional leaks but simple courthouse gossip and anybody who spends a lot of time in a courtroom knows there may be no greater power than the power of courthouse scuttlebutt. It just gets around. You cant help it. They have to realize they are operating under a limited amount of time no matter how secret they keep these proceedings. At the same time they want to time it in a way to best respond to any reaction. Okay. Evan perez our justice reporter is here. Evan, as you know, there have been a number of leaks in this particular case. Many have been reported by newspapers and some reported here on cnn about what the grand jurors may have testified to, what officer wilson may have testified to. So, you know, danny is right, the possibility of this staying secret for 48 hours is really pretty slim between slim and none. Right, exactly. The 48 hour notice was really to give Law Enforcement some advance notice just so that they can get people in place, they can bring, for example, the governor had declared he would declare a state of emergency and have the National Guard ready. The feds or fbi brought extra resources in to town to help the local authorities hand tell situation, don. I think what it is, given the fact that the plan was for the grand jury to make a fairly quick decision on friday and then announce it on sunday, i think the conversations that they have been having behindthescenes has been that for all intents and purposes everybody already has had the 48 hour notice. So they were ready once the grand jury made their final decision we were told by sources that when they came in on friday the reason why they didnt want to come back today was not because they wanted to hear more evidence is because they felt they needed a little more time to finish their discussion. Jeffrey toobin is joining us now as well. Jeffrey weve been talking about this every single gay in the situation room going over every single facet. This is about the 48 hour notice. As weve been reporting with on the situation room with wolf that 48 hour notice hey not stand because maybe for fear of leaks as i had been talking to danny and evan about. Thats right. Weve heard 48 hours then it shrunk to six hours, it might wind up being later. To the larger points you raised, don. Weve been talking about what we know about the case, and i suggest to you we dont know a lot. You know, this grand jury has been investigating, hearing witnesses, giving sworn testimony for months. Yes some of those witnesses have also given interviews to the news media, but we dont know all the evidence. We dont know all the witnesses. We have not seen all the scientific tapes, tests. So i expect to learn a lot if and when this material is made public and i think that makes it even more difficult to predict what the grand jury is going to do because we dont have that evidence in front of us. That was my next question. Well go the Police Department in a second. Jeffrey, quickly, should we thought that the decision, you know, many people thought the decision would happen fairly quickly because it had taken such a long time to hear the evidence and then for the grand jury went into deliberations that they appeared to be taking their time. Is there anything to be read into that to the possibility of an indictment or no true bill, not an indictment . No, i wouldnt read anything into it. In fact, i think this has been a pretty quick deliberation when you consider how many months theyve been sitting. They started deliberating friday as we under it and we have a decision here on monday. Thats not a long deliberation. Keep in mind also that grand jurors, yes, as weve said many times it only takes three quarters of the 12 members to return an indictment or make a decision. Grand jurors like to be unanimous. They like to feel like they are operating as a group. So i wouldnt be at all surprised if some part of the deliberations was trying to get from nine to 12, even though legally it wasnt necessary, grand jurors like to speak with one voice and i wouldnt be at all surprised if some portion of fridays deliberations and today is to make the dissenting grand jurors as it were comfortable with the decision. That decision can come at any moment. Weve been told they are going announce a decision sometime this evening, specifically where we dont know. We hear the prosecutor here the st. Louis county prosecutor bob mccullen will make the announcement on whether not to indict Darren Wilson in the shooting death of teenager Michael Brown, unarmed teenager Michael Brown. It happened on august 9th of this year. Now want to get to the ferguson Police Department. Sara is there. Whats going on at the Police Department . Reporter you know, its interesting a few moments ago five people were out here protesting. It gives you a sense of exactly whats been going on every single day since about august, the first week of august. People have been here protesting. Its not always been crowds usually the in the daytime. Smaller crowds. Across the street is the Police Department. There are some things different for the Police Department. That boarded up area. People used to stand on top of this elevated platform to get video or look over police. They have made it not possible now with that new boarded building there. Weve also noticed some activity of Police Coming and going as they come in to the back there and fill up the parking lot. The protesters who are here on a daily basis have been waiting for this as has Michael Browns family and the wilsons. They have been waiting for this decision now for more than three months. And they have not miss ad day out here of protesting. I want to give you a little bit of an idea of what things look like. Sir, would you mind talking to me a little bit about what youre doing out here and whats your name. My name is byron. Tell me what your concerns are and why are you out here . Im just more or less as a resident of ferguson i think the residents now, i think we ready for this to be over with. Its been way too long. The people here are really tense. They agitated. Ive not seen a big change in the sound of ferguson. Would you say people are afraid of what may come as a response to this, or is it just the tension of waiting for a decision . Well, of course people yeah, of course, people are afraid. But more or less thing is, you know, people they just want it over with. They want it over with, okay. Theres two sides over tory story. Whatever happened, it happened between officer Darren Wilson and mike brown. Okay. We just ready for it to be over with. Lets get on with our lives. Im glad were able in this town to focus, the world is watching, well focus and were communicating and now peoples voices are being heard. It took Something Like this to, you know, to happen took something tragic to happen for people to talk and communicate, but once again as a resident of ferguson we want lets get it out there, get it over with, lets continue on with our lives, lets keep the communication, line of communication open and stuff and with the Police Department and with the residents of ferguson, you know, lets all just bridge this gap, come together and live as a Peaceful Community like we always have been and then let life go on. A lot of people talking about outside force coming in, a lot of protesters from outside coming in. There are residents who are out here as well. Weve talked to the mayor. Weve talked to a lot of the Business Owners here who are having the same sentiment, folks that live here want to see a resolution to this. They feel this town is on tender hooks on pins and needles waiting for the decision. Now that the decision has been made they want to know what it is and see what happens after that so that this town can try and heal and move on and tlfb meetings with the police, with the residents on how to kind of bridge that gap as you will so people can try and move forward and this town can thrive once again, don. Yeah. Youre hearing the same sentiments from that gentleman as weve been hearing as weve been on the ground. A woman last night said we just want peace regardless of the decision. Were raining for the safety of the officer. Were praying for the brown family and protesters as well that theres not any violence. So great interview. Thank you very much for that sara sidner. Cnn has reached out to the family of Michael Brown and their attorneys and reached out to the attorneys for the officer Darren Wilson. They are aware a decision is imminent and according to the attorney for the brown family they have not officially heard anything from officials yet about an announcement but were going to check in on the other side of this break with ben crump the attorney for Michael Browns family and hell give us insight on that. I want to ask you about this, about the timing, evan. Do we know anything about the timing, when the announcement will be made and tinting point here im sure that you can speak to the difference will be finding out if the officer has been told to surrender. That will give us an indication of what the decision might be. Right. Exactly. Thats the big question. I think were reaching out to his representatives to find out because obviously if theres an indictment he would have to be notified, he would have to be told to surrender and that would have to happen in the next few hours. Were told an announcement is coming later this evening. We know officials are preparing to, obviously, deal with whatever the public reaction will be, don, and obviously this is something that they prepared a lot for and were ready to do this on sunday but we know everybody is getting ready to make those announcements later today. Also the other thing thats in the plan as part of the plan is to release some of the documents, some of the information that the grand jury has been considering. The prosecutor said he wanted to release everything. Well the problem is theres still an wrong going federal investigation into this case and usually, you know, you dont see the evidence before everything is finished, everything is wrapped up. So it will be interesting to see whether the federal government has a view of whether the evidence in this case should be released immediately which is what the prosecutor would like, you know. His reaction, the reason why he wants that to be done is because he feels it will give the public some reassurance, some confidence they did everything, he did a proper investigation and this case was properly investigated before this grand jury made this call. As weve been hearing from our legal analysts the judge overseeing this has the discretion on whether that will happen or not. Thank you very much evan perez. Before i get back to my panel i want to go to sunny hostin. I understand you have been speaking to the attorney for Michael Browns family and just recently reached out to his office and they said they had not been officially notified. I dont know if thats changed just within the last couple of minutes. Thats right, don. Im actually in ferguson. Im with ben crump. I just met with him for about 30 minutes and interviewed him. He says that no one has notified him, no one has notified the family, no one has notified his cocounsel anthony gray about a decision. The first they learned about the possibility of a decision was from cnn and was from me. He said that the family is very upset. They are distraught that no one from the Prosecutors Office has reached out to them. They are offended and they had an agreement in place whereby the Prosecutors Office was going to give them some notice. Ben tells me, Benjamin Crump tells me at one point it was about six hours notice and that then changed to some notice, but at this time, no one from the Prosecutors Office has reached out to the family. So, sunny, again, remember we were talking about that 48 hour notice. Thats not going to happen. Youre saying there was supposedly, as a courtesy, a six hour notice, but nothing yet. And has the family really been in contact or the attorneys with Law Enforcement or with the prosecutor, with officials in this case . Yes. I did ask him that question. He told me that the Prosecutors Office was in contact with someone from their team last week, thats the last they had heard from the Prosecutors Office. Okay. All right. Cnn legal analyst sunny hostin speaking with Benjamin Crump the attorney for Michael Browns family. Thank you very much. If you get any more are information get fwux. I want to get our legal panel. First to you, lisa. In this case weve heard from Benjamin Crump the brown family attorney, hes saying they havent heard any notice. There was supposed to be a six hour courtesy according to Benjamin Crump. Whats going on here. Is that just a courtesy, its not mandatory that they reach out to the family of a victim. You know if there are promises made you hope those promises would stay in place. I think that this is such an unusual situation, don, that, you know, there are going to be missteps here. I think thats a huge misstep. This doesnt come from being a legal analyst. I just feel badly for the family if they are sitting there and they dont have notice and everybody else does. So, it doesnt seem to be, you know, one of those things that has a lot of integrity in term of the communications here. But we dont know. Maybe it was leaked and they werent aware that the leak was out there and now they need to rectify that quickly. Its hard to explain whats going on here. Yeah. Mark omara, the officer and his representatives will know pretty much what the decision is if hes asked to surrender, then we can garner from that that there is an indictment, if hes not, then probably a no true bill, correct . Well, if theres an indictment, then they will either tell him he has to surrender. He has some time after the indictment is read to surrender. Its not mandatory to come in prenotice. It makes sense as a courtesy to the Darren Wilson group to tell him to come on in, to be safe, to get in ahead of the response and then deal with it that way. On the other hand, if they tell him we dont need to see you or nothing is going to happen or dont get a call to bring him in then certainly from that we can garner there was a no true bill. Danny cevallos, it has been said that this grand jury, that the way this grand jury took place or the way bob mccullen handled it, the convening of this grand jury has been unusual. Now Jeffrey Toobin said really this has been a quick process but many think its been quite a lengthy process and an unusual process and i know that our sunny hostin is one of them. Do you agree with that . Certainly longer than many grand jury processes. But they can vary in length. The important thing is that what added time on to this process was that the prosecution appeared to err on the side of providing all of the information a jury could possibly look at. Remember the rules of evidence are very relaxed in grand jury proceedings. And commentators thought look if they wanted an indictment the way they typically will do it prosecutors is put on just enough evidence to get over that burden of probable cause and no more. So as not to show their hand. So in a way people, critics have said by showing all this evidence to the grand jury the prosecution can then say it was not us that chose not to indict it was this grand jury and we gave them all the information we could. But as a postscript for people that demanded a grand jury be transparent, understand that a grand jury is designed to be the opposite of transparent. For a number of good Public Policy reasons. But the idea behind grand jury proceedings is and always will be secrecy. If youre looking for answers a grand jury is not the place. Don, can i just add one thing there . Yeah. Absolutely. Go ahead, jeffrey. I didnt say that i thought this process was short. I thought the deliberations were short. The actual investigation since august has gone on for months and is very unusual, very long, and looks to many people and i certainly include myself among it that it really looked like the prosecutor, mr. Mccullen was sort of passing the buck. Was looking for cover from the grand jury rather than trying to bring a case, which is certainly an unusual setting for a prosecutor. The only thing in this process thats been quick has been the actual deliberations by the grand jury, two days given a many months long investigation is not, in my opinion, a very long deliberation. Jeffrey, but also remember we talked about the grand jury started to ask questions and they wanted more evidence and they brought in another Expert Witness when, you know, as mark geragos was saying, usually in his estimation grand jurors or grand juries are usually the hand maiden of the prosecution. Or the prosecutor. But if they are starting to ask questions and develop their own mind and want to hear other things that may not be so. This may be a grand jury thats going to make up their own mind regardless of what bob mccullen may want or what the prosecutor may want. Thats true. It is possible that this could be an aggressive grand jury. I think one thing people who are not familiar with the legal system dont know is how grand juries work. Everybody seen on tv millions of times trials with a judge, prosecutor, a defense laufr and jury. Thats not how grand juries work. Grand juries are more like a classroom where theres a prosecutor, theres a witness, and the grand jurors sit classroom style and depending on the custom they can just raise their hand and ask questions. They can write notes to the prosecutor and say why dont you ask about this. I mean, it is a process that allows grand jurors to do some of their own questioning and even investigating. And that sometimes gives prosecutors that gives grand jurors a much bigger role than the passive role we usually associate with jurors. But also we thought that there was, the judge thats overseeing the case because everybody thinks in a grand jury process theres not a judge. I dont know how active the judge is. In a normal jury case is judge is active. The judge who is overseeing the grand jury is not even present in the grand jury room. The person in charge of the grand jury is the prosecutor. The judge only comes in if theres some sort of legal dispute, very, very rarely. This is a this is a process grand juries run by prosecutors. Yeah. If we can get theres a full screen of the make up of the jury the racial make up of the jury and you guys have said they need twothirds. I think they need nine out of the 12 to come some sort of consensus about the three quarters. So they need nine out of 12. Nine white, three black. Mark, your dealt with the zimmerman case, the zimmerman trial. What should we think . What should we make of this . Well, you know, theres no question that race is one of the biggest issues in this case from day one and its going to be a consideration that the grand jury has to look at. Im certainly hopeful the grand jurors are looking at it in a way that doesnt consider tissue of race in determining whether or not the crime existed or that there was a justifiable use of deadly force. But in our Justice System there are these subtleties with race that happen in the criminal Justice System and it will be spoken about and openly addressed in the grand jury process. Yeah. Okay. Stand by, everyone. I want to get to sara sidner. Sara is outside of the ferguson Police Department and been speaking to people there, residents about whats going on and how they feel about this process. Sara, take it away. Look, you know, ive been out here now for two months on a daily basis we come by here this area. Sometimes its one or two people. Sometimes there are dozens of people. Weve been here when there are a couple hundred people right across the street from the Police Department. I can tell you that on most days its a small group out here during the day and most of the folks that are here are from either ferguson some of the surrounding cities that are very close, a five minute drive away. I want to talk a little bit from rick who is from normandy, the district where Michael Brown ended up going high school and hes out here and got his sign. Why do you come out on a regular basis out here to stand out in the elements, out in front of the Police Department . Well i come out here, my main reason, we want justice. Not only for mike browns family but we want to make a statement for all the citizens around this area because we have witnessed injustice that we go through day in and day out with the Police Department, the profiling, the harassment and we just want to speak out and protest because we want our voices to be heard. Let me ask you about the other side of the coin where people are saying well the Justice System is there, theres a grand jury looking at all this, they are looking at all the evidence and can we just let the process happen and let them decide what justice is . Well, we have seen and weve heard from the witnesses about mike brown, his hands were up in the air and to put that many bullets in that young man, to let him lie in the street for that long, you know, thats not justice. Where is the justice in all that . You know, he laid in the street for four and a half hours. His mother there was. They wouldnt let his mother go near him. What more could she do. He was already dead. All she wanted to do was hold her child. Wheres the justice. Why did it take to long. If mike brown shot Darren Wilson would we wait this long. Do you feel this has changed from a case of people being angry to what happened here in ferguson to something much bigger, to a movement as far as africanamerican males in particular are treated by police. I hear that a lot from folks out here. As an africanamerican male yes i do believe so. We see it day in and day out. Not just ferguson. Its all the municipalities that we see the same thing day in and day out of being harassed, being pulled over. We see the same thing every month in the municipalities surrounding ferguson. You go to the court on the first of the month and you see africanamerican men and women lined up on the street, you know, and some of us, you know, we wound paying, you know, 300 to 400. Were not middle class. Were not middle class people. Were poor working People Living from pay dhoek paycheck. Let me ask you about that from the police side they say if youre breaking the law, ran a stop sign, did something that got us to pull you over were just doing our jobs. What do you say that to them. They may be just doing their jobs but a lot of things we see that take place in our communities, when we go out into the richer neighborhoods we dont see the same thing. You feel like youve been treated differently. Yes, we do. Yes, we do. Of course, we do. What are your concerns. You live close to ferguson. Youve been out here for a while. What is your concern when we find out the decision. We may be wrong but for most offous Peaceful Protesters that are here weve seen the Justice System to work and we dont have much faith in it. We dont believe hell be indicted. If he is indicted do you think all this will stop and people will go away . It cannot stop because this is just the first step. He needs to be brought to trial and be held accountable for murdering mike brown. What do you say to folks who say hey youre innocent until youre Proven Guilty and why cant everyone sit back and watch that process happen. Weve seen the Justice System work before and we just dont have faith in it. Again, ill say if it had been the other way around, if mike brown had shot Darren Wilson this would have been over long before now. Thank you so much, sir, for talking to me. We appreciate your time. We want to tell you whats been going on here on the ground. I want to talk to you about Michael Browns family. About two weeks ago, cnns Ashleigh Banfield spoke to Michael Browns mother. Once again we just want peaceful protest and if thats what they are out there for, only positive things, pause, plan and prepare. We dont want anybody acting irrational or acting before thinking because it wouldnt be serving us any purpose or do us any good. Were trying to get a message across and thats part of the reason why were in the u. N. Again, as we wait an announcement here were expecting that announcement will be a decision on an indictment but, again, we will see when that happens later on this evening. I want to get to at the if a any elam. You heard from Michael Browns mother and shes there asking for calm from the protesters. Youve been out among the protesters and speaking to them in the last couple of days, last couple of hours. What are you hearing . Well, when you talk to the protesters, don, its very clear that no matter what the decision is, whatever happens to officer wilson that they plan to be out here and have their voices heard. They said that they have been planning for this for weeks to be ready for when this day came, when the decision actually came here. What they are saying is no matter what the decision is, they need to be out here demonstrating and protest because what is important they say is that theres a change between the way Law Enforcement interacts with young black men and saying its not just problem in missouri its a problem nationwide and that they plan to be out here to have their voices heard. On that issue of violence, keep in mind that in the most recent weeks since the death of mike brown it has gotten much calmer. There have not been very violent protests. People who have been unlawfully assembling but not violent clashes. So when i talked to the protesters their concern is something small escalates and becomes Something Big with Police Officers and thats what they are wanting to avoid. If you remember back in august when we were here before there was that water bottle incident, a water bottle thrown and that toledo a big clash. They are afraid of that happening again. Police say they wont overreact, let people have their chance to do what they want to do and march and protest and demonstrate. But to try to avoid that violence and thats what the goal really has been and you hear from a lot of people saying thats the focus, don. Stephanie, its not perfect, its not a perfect world, not a Perfect Community but there have been talks, communication with the protesters, with Law Enforcement to try to come to a consensus on whats allowed, whats not allowed and as you said its been just mostly a handful of people who have been instigating this. By and large the people of ferguson deserve much more credit than many people are giving them that it has been fairly peaceful. It has been peaceful. Ive been out there. Ive been out there at night and during the day. You see a few people protesting. Its not violent. People may be blocking the street for a while in the evening. There were small arrests. No arrests last night. Thats not the focus, the violence is not the focus. Being heard has between focus. When you talk to residents who live in ferguson they are nervous about how things are going to do down because of what happened in august. At the same time a few people both black and white do believe both sides love their town and want to get past this and ready to move forward and a huge part of that is finding out what this decision is today, don. Were waiting for an announcement from the prosecutor. The grand jury has reached a decision and will make an announcement this evening. Were expecting what that announcement will be whether or not to indict the officer in this case, Darren Wilson. Im joined here by my colleagues. One of my colleagues on the scene is justice reporter evan perez. Evan, we have been here following this case. You got the information regarding the announcement as we have been saying were expecting the announcement will be an indictment or a no true bill nonindictment. Exactly. Officials are getting ready. We know this from officials from out of town are coming back in, making sure now they can put in place the plan that they were preparing for when this decision was made, you know. They know there will be a public reaction to this. Don you and i were talking about that, despite the pictures that people saw back in august of some of the unrest, some of the protests. Really its not representative of the vast majority of what we see here. I mean were talking about a relatively small area, even downtown ferguson itself which is just like half a mile away from the canfield apartments, even that it feels like a world away. Here in clayton, missouri, which is down the road from ferguson, you can see, you know, some businesses have boarded up. You can tell people are getting ready for the same thing because they are very concerned. Some of the businesses as were standing here arent open today because they dont know what will happen and they dont want to take the chance. Its unfortunate. As were getting close to the holidays this is when people make a lot of their money, shop keepers, Business Owners make a lot of their revenue. Im told from some of the conversations that weve had that some of the merchants in town met with state officials and voiced that concern. A lot of them, don, already have their inventory for, you know, black friday, for the day after thanksgiving which is one of the biggest weekends of shopping weekends in america. So they were, you know, very concerned that theres looting. Obviously also if they have big protests that affect how people can get about and maybe do their shopping. The reason im looking here is what were seeing is reflected on the front of the local newspaper here today and it says that everyone basically the sentiment is that everyone here is aprehence jennifer, living among apprehension. The stores are boarded up in the areas. Then youll see again, it says an undercurrent of unease spread as life goes on. Thats at that really good way of putting it rather than the streets of ferguson are on fire. Everyone is on edge on pins and needles. Its not quite that but there is a feeling of we dont know whats going to happen. They dont know. Yet as a resident the person that lives here told sara sidner we want to get this over with. We want it to be better and want to move on with our lives. This has gone on for a long time. We know that the economy of the region is already getting affected. You know that there are big meetings being cancelled. People who are afraid to come to town because they dont know what to expect and thats unfortunate because, you know, in some ways, you know, i met with Michael Brown sr. Earlier in the week when he was shooting a Public Service announcement trying to urge public calm and one of the things he was very concerned about is the idea that this has ceased being about his son and it stopped being about Michael Brown. Its becoming about agendas, peoples personal agendas. I saw some breaking news that we havent reported here on cnn that i got from one of the sources close to officer Darren Wilson is that Darren Wilson and his fiancee married a week ago friday. They got married. And she is an officer who also works for the ferguson Police Department. So, officer Darren Wilson has not been seen in public, has not been heard from. We heard from a couple of friends and associates but havent heard from the officer. Again now were learning they filed for the marriage license back on october 24th and then a week ago friday i believe it was the 14th that they did get married and shes an officer with the department as well. I want to go now, evan, to our colleague donna brazil in washington. Donna, we heard the president as well urge calm, saying listen everyone has a right to protest, that is your right, but he wants to urge calm. What do you think the president should be doing as we wait for this announcement . Well, theres no question that the president has designated attorney general eric holder to be the one thats in touch not only state and local officials, the Police Department and others. They have been providing assistance. They have been providing training. They have been providing resources. Of course, eric holder has been a steady hand in making sure all the parties are communicating so that people and the public know that the Justice Department is also monitoring this situation. So, the president has designated not just eric holder, Valerie Jarrett and im sure they are in touch with governor nixon. The president talked to him a few weeks ago. Well learn more once this announcement is made. Donna, i probably wasnt as articulate as i could have been when i spoke with my panel regarding the racial makeup. Race has been the overriding factor in this case at least in the mind of the public. And seven are men, five are women as you see. Three black, nine white and they need nine really to come to a consensus about indictment. My question is, as we know in this country many times africanamericans and whites see race dirfferently in this county and i find i want interesting the racial make up of this grand jury may in some way be a deciding factor. Well, i hope its not. I hope whats a deciding factor is the fairness that they looked at all of the evidence and come to the right conclusion based on the evidence. Ive learned that much from listening to Jeffrey Toobin. With that said, africanamericans and whites share many of the same values and same beliefs in terms of what it means to liver in a society like ours where we want to do right thing. We want the best for children. Africanamericans have a unique experience, however, with say the Police Department, the Justice Department, and in many ways weve expressed that and throughout the long months since Michael Brown was murdered. We talked about, you know, what it takes in this society to have accountability, transparency, but also sensitivity training of these Police Departments. So im hoping that this episode will soon bring us to a different level of conversation not only about Race Relations but really how we work with the Police Department. All policemen are not bad. All police women are not bad. I have several relatives that serve in the Police Department and currently serve in the Police Department. The majority are good people. And also the protesters. Not all protesters are out there to destroy their community or riot as some would have us believe. But this has been a very painful chapter, again, another episode where were talking about, you know, race relation. Were talking about police brutality. Were talking about the excessive use of force, militarized in our community. We should talk about what we can do as a community, as a country to bring about reconciliation
