Beginning with what we know about brown, this notebook that investigators found with jihadist writings, tell me about that. He was arrested in the woods in a very wealthy area of west orange, new jersey, and with him was a notebook with jihadist writings. My big question is if he was on a jihadist terrorist spree, he had access to kill many, many, many more people and didnt. It seems like these were crimes of opportunity, robberies and carjackings and then once hes in custody he tries to give it a noble cause. Thats the question. What kind of connections . Why would he want to exact vengeance. What more do we know . The two of the men he killed in seattle were young gay men. One was a muslim. And he met them on a gay hookup website and shot them in cold blood in a car. The third seattle victim was shot ten times in a driveby. And another was shot on a messy, rainy night in a remote in a suburban area but not a well visited area. To imagine this guy was out there as part of some jihad terror spree standing in the rain for hours waiting for a male victim to drive by, just defies logic. Its not adding up. It doesnt add up to me. Once hes in custody, he wants to justify his actions and give them some noble cause. He was in a carjacking incident in point pleasant, new jersey, and he ran away because he couldnt drive a stick shift. This is what were dealing with. Im not sure theres any evil mind to it. Jeff toobin, throwing cold water on maybe some motives here. Cold water, yes. The jihad spirit is out there in the world. Individuals can do terrible things by themselves in the name of it. When i started following this story, i thought of the brothers in boston who at this point we dont think were connected to any larger terrorist group but they apparently they were inspired by events overseas. Right. And in almost a similar words talked about afghanistan and iraq and violence against muslims. And if they are guilty and certainly the evidence against them looks very strong, it was an independent terrorist act. This too could be an independent terrorist act. Evil people find motive where they want but it certainly doesnt suggest al qaeda as a group was involved. So far as far as charges go, murder. Right. Right. Murder. Basic run of the mill urban murder. Could they based on what we know of other examples, at what point would it get ratcheted up to domestic terror . There would have to be connections to someone else. Some other person involved in a network. If you are being charged with murder in new jersey, youre going to go away for a long time. As long as probably as long as if you were to call it terrorism. I think what people are obviously most concerned about is there a larger threat out there and i think this story indicates no. Eyewitnesses say he was on the run but according to the familys attorney, a private autopsy shows clear evidence against the police. Hunts family has ordered the procedure after two officers in Saratoga Springs, utah, killed the 22yearold man on wednesday. The familys Attorney Says the autopsy found police shot hunt six times from behind. The shot that killed him hit him right in the back. There is some question as to what he was doing, where he was going. Obviously he was running away at the time that he was shot and killed. If hes running from all of the eyewitnesses, why you had to put in more bullets . Moms questions here. Saratoga springs police say that he was wielding a sword and was lunging at the officers. With me now, sunny hostin and dan simon. Dan, to you first. Hearing from the mother, she believes race absolutely played into the death of her son. Tell me what shes saying. In her mind she thinks it has to be race because theres no other explanation for it in her mind especially in light of that autopsy that you just talked about. That independent autopsy which apparently shows that the shots were fired into the suspects back. Lets also talk about the fact that the mom is white. Perhaps that plays a little bit into the thinking in terms of this and Saratoga Springs is predominantly white. In terms of the sword, she says that this is a sword that wasnt dangerous. It was more like a toy or a souvenir she bought at an asian gift shop. The only reason her son was probably carrying it is because she thinks he was on his way to a Panda Express restaurant to apply for a job and perhaps by having that asian souvenir it may have impressed the people at Panda Express. Lets listen to the moms very powerful statements about why she thinks this was racially motivated. What does he look like . You know what they said to me . Hes brown. He has an afro. Really . But did he have on a redshirt . The implication here in that sound bite is that when police described the individual, they only talked about his racial makeup and not what he may have been wearing. Prosecutors we should point out once again emphatically denying that race played a role whatsoever. They put out a statement. It says there is currently no indication that race played any role in the confrontation. Police are saying that he had that sword. He was using it in a threatening manner. He lunged at them and thats the only reason why police say they shot him. Sunny, let me bring you into this. This brings up similar questions to what we saw in ferguson and other incidents in which according to certain autopsies the police were shooting this individual from behind. And as the mother of a brown boy, i really just empathize with this mom. No mom should have to deal with Something Like this. I think the questio is when is it okay for Police Officers to use excessive force, deadly force in shooting someone . There are only two instances when that is okay. Im looking at notes because i want to make it very clear. This has been an issue in the Michael Brown shooting. One is defense of life. In the Police Officers feel threatened themselves or that the public somehow is being threatened, if someone is lunging at them with some sort of weapon, yes, you can use deadly force. The only other time, second time, is this fleeing suspect rule. So if theres a suspect who committed a Violent Crime, a Violent Crime, and his escape or her escape would pose a serious threat to the officer or the public, then an officer can shoot. An officer cannot shoot. The Supreme Court made it clear. The constitution makes it very clear. An officer cannot shoot an unarmed nonviolent suspect who poses no risk. So when i see this fact pattern where someone may have been shot in the back, that someone must have been committing a Violent Crime and pose a threat to society, the public, for that officer to be justified in shooting the person. These cases are very case and fact specific but it does seem odd to me that if he was running away with this fake sword that deadly force would be appropriate. Unless the sword perhaps didnt look fake. Maybe the sword looked to be a real sword and was there a Violent Crime committed with that sword . You know Something Else in looking at this story and in other stories weve looked at before Michael Brown, the johnson death out of georgia in the last year. A lot of families are hiring these independent pathologist because theyre not Trusting Police or the county. What does that say to you . Thats fascinating. I think often times families do feel that Law Enforcement and the medical Examiners Office are working together. Theyre biassed. So we have seen this interested trend where they are hiring not only attorneys to represent them sort of like a Trayvon Martin case. That started at that trend. Now also these independent medical examiners. Like dr. Michael baden who is well known. Its coming from a place of this lack of trust for Law Enforcement. Its sad. It is. I know many people disagree with the way i disciplined my child. I also understand after bemeeti with the psychologist there are other ways to discipline my child. I believe i could have been one of those kids lost in the streets without the discipline instilled in me by my parents and other relatives. I have always believed that the way my parents disciplined me has a great deal to do with the success i have enjoyed as a man. I love my son. I will continue to become a better parent and learn from any mistakes i ever make. He goes on. I am not a perfect son. Im not a perfect husband. Im not a perfect parent. I am not a child abuser. I am someone that disciplined his child and did not intend to cause him injury. No one can understand the hurt i feel for my son and for the harm i caused him. My goal is always to teach my son right from wrong and thats what i tried to do that day. And finally in this final graph, he writes, i accept the fact that people feel very strongly about this issue and what they think about my conduct regardless of what others think, however, i love my son very much and i will continue to try to become a better father and person. Adrian peterson just released the statement. His arrest ignited this massive firestorm about parenting and spanking and really the thin line between discipline abuse and parental rights. Let have a big talk about this, shall we, with Harvard Medical School professor and a cnn digital correspondent and Kelly Wallace and sunny hostin we kept you here. We have you as well. So welcome to all of you. First, just, doctor, let me begin with you. Is it okay for parents to spank kids if that is what happened to them when they were growing up and what theyre familiar with . I think thats one of the reasons they raise the children the way they were raised and if they felt that spanking helped them when they were growing up, theyre likely to use it on their children. Thats one of the problems with using violence is you perpetuate the violence over generations. Many americans believe in spanking as part of raising children even though there is so much evidence in fact that its likely to be harmful rather than helpful in raising children and often leads to child abuse like in this situation right here that is once you start hitting your kid, and youre very angry and you lose control, thats when you create an injury. Cuts and bruises and thats when it crosses a line into child abuse that has to be turned over to child protective agencies. It doesnt matter what your intent is. It doesnt matter what your intent is. If you injure the child because you were disciplining him or her, then its going to be seen as child abuse and treated in that way and you suffer the consequences. And the child hopefully is helped because being cut and bruised if thats what has happened is certainly not in a childs interest in terms of changing his behavior or helping that child. In fact, youre damaging that child. Let me let these two mothers jump in on this. When you read Adrian Peterson statement, one line that jumped out at me is he feels like he would have been a lost kid in the streets had he not been disciplined as a child and hes this success in his eyes today so hes just continuing that cycle. Hes continuing the cycle of violence. I would suggest to adrian that he succeeded in spite of the beating not because of it. Thats the bottom line. We know so much more now about child rearing, about child abuse, and it is clear to me and i think to everyone hes saying hes not a child abuser, guess what . You are a child abuser. Whats striking to me having prosecuted so many of these cases is the notion that you can strike a child. You can assault a child. Spanking is assault. And that is not a criminal act yet if you did the same thing to an adult, an adult, that is considered an assault. Its considered an unwanted touching. So we need as a society to say even spanking is wrong. It is criminal. You can discipline your child in so many ways. So many ways. Even the American Academy of pediatrics said negative consequences. You do not spank. I was struck by that same line where he said that his success in a way he holds to the discipline he had. You hear a lot of big online reaction to the story. Tremendous number of people that say this is awful. A large number of people who say, you know what . This is the kind of discipline that kept me in line. The other thing he said that was interesting which was after meeting with the psychologist or talking to a psychologist, he has more awareness now about these other alternatives when it comes to disciplining his children and this is where awareness is key. We need to get more messaging out about how dangerous spanking can be and what are more effective ways to discipline your child. Ive heard different conversations about this today and its like an old conversation that brought to the light once again but whats been unique is that even Charles Barkley bringing in notion of black Community Saying if this was against the law in the black community, a lot of parents in the south would be in prison for doing this. That doesnt make it right. My father is from georgia. Hes a southern gentleman. He would tell me stories about having to be sent outside to get the switch and not a small one his mom would say. He feels that he succeeded because of that because she was a single mom but i wasnt spanked because my mom as a northeasterner as a woman, as a teacher, she knew that was a wrong way to go. I dont spank because of the child abuse cases that i have prosecuted. I am just i think it is something thats cultural. You see it in the africanamerican community. Ive heard people in my Community Say spare the scriptures. Spare the rod and spoil the child. If its okay with the bible, it must be okay. It really is so antiquated and its not okay. I dont even think you should spank for discipline. Doctor, i want to hear you back in on this. You know, listen, we all come from our different paths and lives and perspectives. Spanking is very embedded in america and its not just a black community. Its all of the communities in america including newcomers to america and i think were different in that way than many other countries. 35 countries ban Corporal Punishment in the world. One of them is not america. And the other thing is we have kind of institutionalized Corporal Punishment by permitting it in schools. There are 19 states that permit paddling of schoolchildren for discipline. And could you imagine that they beat the children to not learning or doing whatever reason left to the judgment of the teacher or the principal. If this is in our nations dna, how does it stop . It stops because you keep trying and trying to educate. I spent a lot of my career around trying to prevent Corporal Punishment. I go to certain communities and they attack you with arguments that youve been bringing up. Its good for them. It will turn them it will build their character. You even have some people and you get this in Domestic Violence cases saying i really dont love my children. I really dont love my my wife if i dont beat her. That gets to be bizarre. I have heard that type of talk as well as if violence itself is soething very positive when its something very, very negative and these children i think theyre much more likely to become antisocial. They are more likely to be angry. More likely to distrust authority and more likely to suffer from depression and anxiety because of being socalled whipped or beaten by their parents and anyone else and its also leading to fatalities. Lets not forget that. Its not just abuse and bruises but some of these children actually kill because of the abuse. You are the professional, sir. Thank you so much. This is your area of expertise. President obama insists isis pose as threat to the United States and its allies in the region and he has vowed multiple times now to degrade and to destroy the terrorist group. Even as the u. S. Ramps up its military commitment over there, some especially certain republicans on capitol hill say that isnt enough. This is a turning point in the war on terror. This president needs to rise to the occasion before we all get killed back here at home. We are hearing more of that. A poll this month found 90 of respondents think isis pose as threat to the u. S. Heres the catch. At the same time officials from the pentagon to the fbi to the state department all say isis doesnt actually have the capacity to pose an imminent threat to the u. S. Homeland. Many republicans are actually not skeptical of this plan, this strategy. Why arent they . I think congress and the American People and our International Allies have been far ahead of the president on the threat of isis. We were shown just how potent the threat of isis was in these beheadings and weve seen them attacki ining since january so people were worried about isis a lot earlier than obama was. Obama has come to the table and now i think frankly a number of us are just kind of breathing a sigh of relief hoping finally were going to do something about this. On the left you have to wonder, you know, just where are they on this but where have they been . Whether its drone strike or judicial killing or spying program, a lot of dovish elements of the liberal movement in the Democratic Party have been silent on president obamas incoherent Foreign Policy over the last six years and you wonder where are they on this. Let me respond to your colleagues question that republicans have been far ahead on this. I think on matters of war the Republican Party is more hawkish or tends to be more hawkish. Any opportunity to criticize the president theyve taken it. Its hard for president s to get countries whipped up for war. Fdr was under pressure to do something under world war ii. Not even unt there have been threats growing in the middle east for a long time. Its not surprising that it took a beheading of an american to get the country to move forward and give the president that space. I also want to say that one reason you dont see a lot of people going nuts about this is because its such a measured and appropriate response. Hes saying we are going to engage militarily but well build a Global Coalition and be appropriate. He reminds he of george h. W. Bush able to bring the country together. I do think others want him to go faster. I think hes moving at the appropriate speed and his tactics are appropriate. But then we are hearing the words destroy and degrade coming from president obama and others within his cabinet when you brought up 9 11 when the fact remains u. S. Is fighting al qaeda still 13 years later after trying and continuing to try to destroy it. We are in a long and probably from a Military Point of view unwinnable war against these extremists. What we have not talked about enough yet is what would it take to get a generation of young muslims to turn away from these nut cases and be a part of the World Community moving forward. You have almost half a billion young people in the world right now who dont have jobs, who dont have a future. Young people need something to believe in and something to do. If we dont start leaning in with these young muslims, these terrorists will take up that space. America should be the light of the world to these young people and not these butchers and we should talk more about that. Were treating from the middle east pulling troops out of iraq and afghanistan avoiding the syria situation for two plus years. Did not get us the kind of peace that we wanted. Did not rid the world of terrorism. Just saying that al qaeda has been decimated doesnt make it so. So we need to take these actors and these bad actors all over the world very seriously and act quickly and i think what youre seeing from the American Public also voices in the media and the left is that doing it president obamas way for the past six years has not taken us to where we want to be. So i think people are a little bit more openminded. They are skeptical. They are not as hawkish as some of my colleagues are. But they are more willing to go in seriously because they have seen that isolationist approach or at least an incoherent Foreign Policy doesnt get us to where we need to be. Stay with me. There was a port that had visitors from the Defense Intelligence agency, a very secret organization and those members, the 21 people who visited from the d. I.
