Geragos. Mark, are you surprised about the gender and racial makeup of the grand jury, supposed to be super secret, thats out . No, all they have to do is sit outside the grand jury and reporters do that with this kind of attention. Reporters, okay. Exactly. Theyll figure it out. What i think is very enlightening about this, because this case, like all cases in the criminal justice system, are going to be determined by race. This does not bode well for an indictment. So because the majority nine white people, three africanamericans. I think this is going to break along racial lines as it almost always does. Mel robbins, do you agree with mr. Geragos here . Not really. I was a former public defender in manhattan. And i found some of my toughest jurors, frankly, in the crimes where i was defending people were africanamerican women. So i dont know that you can just make a blanket statement that in a grand jury, that its going to go by race lines. Its a very low burden of proof. I personally think well be shocked if they return an indictment at all, but well see. Well, the standard for an indictment is the client breathing, is what i always say. It doesnt take much to get past probable cause. But there is its still a pretty split community there. Explain to me, mark, why its not a probable cause here. Why this has gone to grand jury. Because if in order to get to a probable cause hearing, somebody has got to file criminal charges. And this guy is not filing criminal charges at this point. For you could be cynical and say hes going to leave it up to the citizens to decide. And and if they dont return a indictment, he can say, look, it wasnt me. I put all the evidence in there. They decided not to indict. And there you go. Right. Mel, what about the issue of the dash cam . Here we know, at least from reports ive seen, the dash cams existed within the Ferguson Police department. They had just yet to install them, which could have been, you know, a gamechanger as far as pictures a lot of times dont lie. I know it depends on the angle of the video camera. But, you know, when you have all these different witness and eyewitness accounts, dash cam video sure would have been nice. Oh, it would have been fantastic. Mark will tell you that the worst kind of evidence is eyewitness evidence. And the Innocence Project recently did a study where they looked at almost 300 Death Penalty cases that were overturned. 73 of them the convictions hinged on an eyewitness. Their notoriously unreliable. And why is that . I heard this time and time again. Well, its mark, go first and then ill explain. So polite here. Go ahead. Thank you, mel. Look, what happens when you have eyewitness testimony, nobody when they start off looking at an event, unless youve been prewarned normally, an event just happens. Right. So the brain and the mind works in it may be attention to a gun. There may be attention to yelling. And then the mind starts to fill in the blanks later on, and then in this case, when you have a situation where theres so much kind of media attention, and you hear all the other stories and then youre influenced by the way that people think, and which side youre going to take, bias seeps in, and the next thing you know its not like it necessarily is conscience. It can be unconscious and in most cases it is, where your recollection just all of a sudden becomes fine tuned by things that have nothing to do with what you actually saw. You know, one person who we heard almost immediately was Dorian Johnson, right . He was the one, he was the eyewitness, he was with Michael Brown. And so whats been interesting, a. , hes gone away. I imagine his lawyer is saying, lets stop talking. But b. , also news of a previous arrest, previous criminal history. But do you think, mel, that is germane to this current case . Could that affect his credibility here in testifying about his friend, Michael Brown . Well, its not going to go before the grand jury. Could it affect a jury trial . It certainly could. I mean, whats going to happen is the prosecution hes their star witness. So if they know what theyre doing, theyre going to make sure he dresses up in a suit and tie and he starts off by explaining his past. So that its not coming out as a surprise later. But i think what youre going to see the defense do is theyre going to try to argue, not necessarily that hes just a liar, but that this is a young man that distrusts the police. And that in the past, he has filed a false Police Report. He distrusts the police, he lies to the police and he did the same thing in this case. So theyre going to go to motive for lying and using that. I dont know if theyre necessarily going to get it in. It is, you know the prior acts kind of evidence is very difficult to get in. So unless they catch him in a lie and they open up the door to be able to try to discredit him, im not sure it will come in. But if i were the prosecutor, i would have him explain it right to the jury from the getgo. And just quickly, why wouldnt he be testifying at the grand jury . His lawyer may say unless you give me immunity, im not going to testify and they may not want to give immunity. Its hard to see. This prosecutor has said hes going to put everything in front of the grand jury. Well wait and see. Mark geragos and mel robbins, quickly, whats your thought . I was just going to say, its that there is no crossexamination in front of a grand jury. People just talk and so hes not the criminal record is not coming in. Hell testify, but the criminal record is not coming in. Okay, mel, mark. Thank you both very much. And yes, some of the answers will come from witness accounts. Some will come from the trio of autopsies performed on browns body. Its the county and independent and federal level. One medical examiner will contain the most detail. So cnns senior medical correspondent, elizabeth cohen, reports on what that autopsy can tell officials and what it cant. Reporter there are dueling narratives about what happened between Michael Brown and Police Officer darren wilson. A friend of wilsons version goes like this. Michael just bum rushes and shoves him back into his car, punches him in the face. Reporter cnn has confirmed that account matches the one officer wilson told authorities. But lawyers for the brown family say his autopsy showed no signs of a struggle and that wilson is the one at fault. This officer should have been arrested. Reporter helping settle disputes like this is the job of forensic pathologists, like dr. Pat ross. This is her morgue in south carolina. She has performed more than 7,000 autopsies. So can you show me on our mannequin where would you look for these signs of struggle . Anywhere on the arm forearms, hands, fingers. Reporter and youre looking for bruises or scratches . Bruises, scratches, yes. Reporter dr. Ross says she checked browns knuckles, a bruise there might indicate he had thrown a punch. Would you definitely be able to see it in the knucklels, or would it have to be a pretty hard bunch . It would have to be pretty hard. Reporter how do you know if it was from that struggle or from before . Thats a good question. Because you really cant age a bruise exactly. You know, it may have happened two hours ago, or five days ago. Reporter another dispute, wilsons friend says brown rushed at the officer fullspeed. So wilson started shooting. But some witnesses say brown had had his hands up in the air in surrender. So Michael Brown had several Bullet Wounds here and here. If you were doing an autopsy and looking at the body, could you tell whether he was up like this, or whether he was charging at someone . Can you figure that out on an autopsy . No. Reporter and an autopsy might not help with this either. Why brown had a gunshot wound right at the top of his head. How would that happen . Very likely, the victim was bent over like this. Reporter and why would someone be bent over like that . Theyre either dodging or maybe trying to run. Reporter Michael Browns first autopsy was date of biron county. The second commissioned by his family. The third completed monday by the federal government. This is now the third autopsy thats been done. And it seems like a lot of people are putting hope that it will help answer some of these questions and solve some of these arguments. Do you think it will . No. It will be it may produce more questions. But i say unfortunately, things take time and people need to be patient. And let everybody get together and get all the facts together. Isis has stormed its way across parts of syria, and into iraq. But could it bring its brutality right here to america . Cnns brian todd takes a look. Reporter moments before beheading james foley, his executioner and isis terrorist warns of more attacks on americans. Any attempt by you, obama, to deny the muslims their rights of living in safety under the islamic caliphate will result in the bloodshed of your people. Reporter a u. S. Intelligence official tells cnn, they have indications of isis cells in europe, which could attack u. S. Embassies and other american interests. The official says its not clear if those terrorists were ordered by isis, or if they went on their own. An isis fighter threatened the west, telling reuters, quote, we have also penetrated them with those who look like them. Does isis have cells in america . Former cia officer, bob baer, believes they do. I have been told with no uncertainty there are isis sleeper cells in this country. Reporter but two u. S. Officials tell cnn, they have no indications of isis cells inside america right now. Still, they are very concerned that isis fighters with western passports could travel to the u. S. And launch attacks. Officials believe a handful of americans have fought with isis in iraq and syria. And cnns peter bergin says others have tried to help the group. Youve got three americans indicted for joining isis within the last year, including, by the way, a woman, which is quite unusual. Luckily, they were arrested before they could leave the country. But clearly, isis is sort of if youre interested in this ideology, thats the most exciting thing to join right now. Reporter and tracking americans who are part of isis is getting more difficult, especially on the ground in syria and iraq. A senior u. S. Intelligence official tells us, the footprint for american human intelligence in that area is not extensive. Analysts say the isis later al baghdadi has extra motivation to send his fighters to the u. S. Baghdadi, head of isis, is a narcissistic psychopath. He wants to be bigger than osama bin laden. And one of the ways he will measure that is how effective and how big the terrorist activities he can carry out in the west are compared to what bin laden was able to do. Reporter analysts say al baghdadi is also taking a page from bin ladens propaganda book. They say he gets shock value. He knows how chilling it is for westerners to hear someone with a western accent speaking to the camera and then carrying out a horrifying, barbaric act like the killing of james foley. Brian todd, cnn, washington. Lets talk more about what you just saw there in that piece. I know, josh rogan, cnn, senior political analyst and Senior Correspondent for the daily beast. We just heard its frightening, the assessment of the potential threat from isis to america. But just broadening out, im sure you were watching as we were live on cnn, ben rhodes, from the white house speaking from the vineyard, suggesting that even if isis were not to attack the u. S. Main land, it still poses this grave threat us here in the u. S. Sure. How, exactly . We have heard Administration Officials say for months that isis had aspirations to attack the homeland. Whats changed in the last few days, now we have general dempsey, the chairman of the joint chiefs of staff, saying their an imminent threat to u. S. Interests. Ben rhodes saying we would go after them without regard for borders, inside syria. Chuck hagel, making very strong statements about the group. We have seen the huge change in rhetoric, which reflects recognition inside the administration this threat is real and growing and could be brought home soon. What we havent seen yet is what the change in policy will be. We have got very few details on how the administration actually intends to combat isis and destroy it. And then we have also got very few details about how this fits into a larger strategy to combat their ideology, to solve the overall problems in iraq and syria. So, yes, everyone now admits that this is a big problem that threatens us directly. But no one has told us what the u. S. Government will do to actually solve it. Well, let me just get to some more news. This is what were learning as were speaking. Were learning that isis fighters in the iraqi city of ji jillala are surrounded. Theyre there is same group that reclaimed the mosul dam after the u. S. Strike pushed micis out of there. U. S. Officials suggest this momentum we heard this the last couple days, as well, the momentum built up by isis, specifically by iraq, is losing steam. Do you think thats true, and how significant would that be . I dont think there has been a change in momentum on the ground that is significant, from what my sources on the ground are telling me in iraq. But especially inside syria. I spoke with a senior Fsa Free Syrian Army commander, fighting against isis only minutes ago. And he told me that in the last week, and this is breaking, this is first on cnn, that the u. S. Has contacted Syrian Rebels to help get them to help them fight isis, just the same they have done with the kurds in iraq. But that they havent actually seen increased support and they actually havent seen isis really change at all. So the strikes as they are are limited. They can push back isis in specific locations. But they are not actually combatting the overall strength and growth of the movement. They can use strikes to secure a dam here or there. But overall, were talking about 12,000 fighters, mostly in syria, who control cities, oil refineries, air bases, lots of equipment, billions of dollars. So these strikes are not meant to and so far have not changed any of those basic facts on the ground. Okay. And that is directly talking about the momentum, we heard from the pentagon yesterday saying yes, the moment it up has slowed. That is interesting what youre getting from your sources in syria. Then you have the beheading. Go ahead. Yeah, i mean, they can slow the momentum of any isis unit. We have enormous resources combined with the iraqis but not in the bigger picture, youre saying. Not only has there not been a change in the bigger picture, there hasnt been any change in our strategy to address the bigger picture. In other words, we can look at these piecemeal victories, but they dont change picture of us as an ideology, financing movement. This is what the administration is grappling with right now. They havent come up with a solution right at this moment. And to ben rhodes point. In terms of his answer was, listen, they have been in that part of the world for ten years, its going take a while to evict them. Josh it also takes yeah. It also takes a little while. All of them carry small but distinct differences. For one, Michael Browns friend, who was there, Dorian Johnson, he says after being chased, brown turned around with his hands up to tell the officer he was unarmed. There was another witness, tiffany mitchell, says officer wilson was shooting as soon as he got out of the car while chasing Michael Brown. Another woman took video of the aftermath from her apartment balco balcony. She says Michael Brown was running away while the officer continued firing at him. And finally, lets be crystalclear. This was not an eyewitness, but source close to the investigation, corroborated this was accurate, this woman josi called into a radio show and said brown shoved officer wilson back into the car, Michael Brown went for the gun. She says the Police Officer was acting in self defense, as he shoved him away and shot at the unarmed teen. Now, add to that another witness, coming forward. He talked to cnns chris cuomo. Chris . Reporter brooke, there are so many questions surrounding the investigation. And thats normal at this point. But we do know what the key moments are going to be in the analysis of the shooting. What happened at the car, what happened in the moments of pursuit of Michael Brown jr. And then ultimately, why did the officer decide to shoot Michael Brown jr. . Those are the three main components. Now there have been a lot of witnesses. The key will be Dorian Johnson there with Michael Brown jr. Mi Michael Brady has come forward as a very strong witness. He saw almost the entire incident. Now, a lot of people have been talking about what he knows and does not know. Much of it has not come from him. We tested his story, step by step. Heres what he had to say. Mike brown. He takes off running more in a straight direction. Yeah, more in a straight direction. And and what is the officer doing . The officer, hes out of his vehicle. Hes most likely now past his own vehicle. So he is also running. Hes basically taking large steps, not running. Is the weapon out . Yeah, as the weapon is drawn of. Reporter so he has his weapon out as mike brown is definitely running away. With his back turned, yes. Reporter is he talking . Is he yelling . Thats what i dont remember. If he was yelling out, stop, or anything. Reporter but you remember this, and mike brown is faced the other way. And theres this. Yes. And hes like i said, 20 feet down already. You know. So a taser wouldnt have even touched him. Reporter then what happens . Hes away from his own police cruiser. And i noticed that he walked past the friend that ran reporter doesnt even look at him. He doesnt even look at him. So when i get outside, mike brown, he definitely hit already, now hes facing the officer. Reporter lets stop right there. You saw the officer taking large steps, you saw the officer with a weapon drawn. He did not fire. He fired. Reporter okay. Thats important. He definitely fired. He definitely fired. Reporter so mike brown is running away. Yes. Reporter the officer is out of the car. Yes. Reporter the weapon is drawn, and you see and hear him fire at mike brown while he is running away. Yep, uhhuh. Reporter absolutely. Absolutely. Reporter the interesting thing is that while Michael Brady saw so much and can provide so much value, the one moment that he didnt see for himself will probably be the most critical one. What made Michael Brown jr. Go from running away to turning and facing the officer . Was it a charge . Or was it a surrender with hands up . Their versions on both will be the key moment, brooke. But in the wake of the killing of Michael Brown, a lot of people are questioning if police are really adhering to that duty. Just the other day here with me at cnn, atlantabased rapper and activist, killer mike, gave me his take on that. He would know, his own father was a Police Officer. Mike told me in the wake of the shooting in ferguson, he believes americans need to be more vigilant about the people they pay protecting to serve them. Here he was. I hold police in a high and honorable, you know position. Yeah. It is. Because its so difficult to be most policemen are workingclass guys. Lets be honest. Most policemen come from the salt of the earth in america. Most of them are ex soldiers or from the communities they police, ideally. So shouldnt they know the issues and know the people in their communities . They should and they used to. What changed . The culture of policing is changing. Its becoming more militarized. They are getting old military weapons, using kids fresh out of the military and using military it tactics. We have essentially gone from being communities that were missed by people from the communities to being communities that are missed by strangers, and thats no longer a community. Its a community under siege. So let me just bring in the National Chair of the National Black police association. Mr. Aziz, welcome and thank you so much for coming on. You heard mike talking about how his own dad didnt want his kids to be Police Officers. Yes. Thank you for having me. I heard that, and i caught most of his interview yesterday. And thats not uncommon that most wouldnt want their children going into law enforcement. I think i think when they do make that decision though, Police Officer, parents they usually support their children going into the field. But that doesnt necessarily say they dont want them to be Police Officers at all. And we should point out, there are amazing, amazing, amazing Police Officers out there. Ive had one in my family, but at the same time, you know, you talk to a number of black people as we have on the show and some folks dont necessarily trust police. They think police are out to get them, especially when were watching whats been happening in ferguson. This is something youre working on. How do you build or rebuild that trust that is so shattered between community and police . Well, historically, Police Departments have been distrustful in the communities in which theyve served. Historically speaking. The National Black police association, we serve to bridge that gap in between policing and the community. Weve always believe that police exist in order to serve the community. I heard the rapper say about Police Officers coming from. The community, we believe that. Yes. There is no such thing as a Police Officer who is not the fabric of the community. He needs a vested interest in the community in which he serves in the place that he wants to protect and the places that he lives and, would and he plays. So i see the nbpa being very silths in that fight before 1972, but in 1972, we espoused ideas of police residency. We have always supported Police Officers living in the neighborhood. And its not uncommon for people like me and people who i know to have grown up in the neighborhoods that they serve. Maybe thats what we need more. We need more of you. We need more of you out there. Then you have the criticism that not as many youre trying to become a Police Officer not as many people have to have any kind i have College Degree or even a fraction of that. A lot of folks come from a military background, maybe mental issues. How do we hire good smart, intelligent, wanting to serve and protect men and women . Well, first, you have to make the Police Officer profession really attractive to in order to gain a diverse following. Many departments they seem to rely on excuses and not going out into the plays that they need to be to recruit. There are thousands of officers who look just like me who want thousands of people who look just like me who want to be officers in the places where they live or another city which they would like to stay. What happens, the challenges that theyve given that have been presented in front of us many Police Departments have failed to rise to that challenge and meet the great obstacle. What they need to do is to go out into places where we frequent and make the Police Profession attractive. They, a lot of times its been less attractive when you see police pru at that time or you see a lack of Community Policing. When you see Police Officers who seemingly dont care about the neighborhoods in which theyre in. The best departments vrp intertwined that Community Policing aspect and have been able to gain trust inside the neighborhoods in which they serve and theyve also built very useful Youth Programs too, brooke.
