Two key questions you know theyre trying to get to the bottom of here. Also new today, a change. Org petition that urged authorities to release harris has been withdrawn now. A note posted on the site states that based on the recent developments, this petition is no longer relevant. Cooper harris will be buried in west alabama tomorrow, and that is where we sent our national reporter, nick valencia, to join us live. And also joining me, hlns, jane velezmitchell. Nick, first to you in tuscaloosa. We know this father is not allowed to leave jail, facing felony murder. To attend his sons service. We know the mother here has been silent, at least publicly, we know she has been talking to police. Youve been talking to family members and friends. What are they telling you . Reporter the overarching sentiment here, they dont want the media here. They dont like the attention and they dont like how ross harris is being portrayed by local Law Enforcement in georgia. I just came from the family home, ross harris home that he grew up in. His parents were there. They answered the door. They politely asked us to leave and said they simply have no comment. I asked them what they thought of how hes being characterized in the press. They said they just simply did not want to talk. Earlier today, though, i did speak to a family friend of the harris, a woman by the name of carol brown. She says she last spoke to ross harris when he was 17 years old. She says she does not remember him being this kind of person. The person thats being charged with murdering his 22monthold son. She did, however, say, brooke, she has the same questions as everyone else. Why did ross harris go back to that car in the middle of the day . How could he have not seen his toddler in that back car seat . She did, however, say, though, brooke, there should not be a rush to judgment. Its just hard to imagine that that could happen. That that could have really happened. It just seems out of character for ross. And i know people change. Its been 15 years or so since weve had contact in the church. So, you know, people change. But its just hard for me to imagine that that is the ross the sweet ross harris, the sweet little funny boy that we knew. Reporter and those we have spoken to off camera describe ross harris as a sweet and loving, godcentered man. They dont see how this matches up with the man they knew. Brooke . Thats the thing. You keep reading about this story and specifically their marriage, and ive seen nothing. Nothing, not a peep that would indicate that anything was going wrong. But listen, this is just the beginning, and who are we to know. A lot happens behind closed doors. Jane velezmitchell, let me bring you in, because to this internet search. I think its important that we are specific in saying that cobb county police, they will not say, you know, what they found on this particular computer. Is one of the reasons they arrested harris. But they said that it is the chain of events does not point towards simple negligence. What to you read there . Well, in fact, brooke, one officer went further, saying in my 34 years, what i know about this case shocks my conscience as a father, grandfather and Police Officer. So what was so shocking . Is it just this internet search . Allegedly found on one of his computers . How long does it take for an animal to die in a hot car. Okay, or is there something more . We already see indications that his story doesnt really add up, according to a lot of observers, for getting his child on this fiveminute drive from chickfila to the Office Coming out at lunch, and going into the car and not seeing his child. And then, of course, when he gets to the shopping center, one witness told our show that he said something to the effect of he thought his child had been choking, which didnt dovetail with how the child appeared. And that corresponds with First Responders saying that what he was saying didnt make sense. I think it has to be more than all of that. I think there has to be something that cops know. They say they have testimonial evidence. That means somebody told them something. Does this guy have a toxic secret . I wrote a book called secrets can be murder. People are very predictable. It usually is a handful of things that make people do the unthinkable. He doesnt have money problems. Thats usually one. Drug or alcohol addiction, no sign of that. I think its fair to ask, given that his wife has said absolutely nothing at this point, what was the state of their marriage . I thats exactly what im wondering. And in talking to multiple people this week, you bring up the wife. Generally, in each case obviously its different, but you have a family member, a representative from a family, coming forward and saying and at least we had some sound from nick valencia there in alabama, saying, defending this family. And i am a little surprised. Would i, having lost my it 22monthold want to talk to me . No. I dont think i would. You are surprised they havent. If you feel your husband is absolutely innocent, it would make sense to come forward and say that. Now, she has remained silent for perhaps many other reasons. We certainly cant prejudge her decisions. Police could be telling her not to talk to us. Right, in the obit written by the family, and i would assume, although they say never assume, the mother of this child would have some input. It seems very supportive of him and saying essentially that he was protective of his child. So that would indicate that the mother is standing by her husband, the father of this child. But it is odd that she is not saying anything. And you really have to wonder, do police know something about a toxic secret . You have to ask yourself, brooke they have to. What in Human Behavior would trump the love of a child . Think about that. What dynamic in Human Behavior would trump the love of a child . Theres only a few things. I cant think of one. Showing Diane Stretton getting served papers to get out. Notice instead of walking out the door she is walking into her room. The family says that stretton started out as this awesome livein caregiver but stopped working for health reasons. Instead of cooking, the mom was preparing meals for the 64yearold woman. So not too long ago, june 6, stretton was fired. But as you see, this nanny isnt leaving and has threatened to sue the family if she is forced out of the familys home. And a judge just ruled in the nannys favor. This is all based on a technicality. She wouldnt do anything. She stayed in her room 90 of the day, so i really did try to work with her. And she just stayed in her room all day. So i told her, you know, either you perform or you have got to leave. If youre confused over this one, sara sidner is going to help us understand. She is live outside the family home there. We hope. In upland, california. Sarah, this is kind of nuts. How did the judge side with the nanny . Reporter heres the thing. There are rules here in california. And basically, what were seeing are tenant rules. When she got this job, she made their home her mommy. Her residence. And so now what the courts have basically said and what the Sheriffs Department has told the family, you have to go through legal proceedings. You have to go through the court to try and get her evicted. And sometimes thats a long process. This family is beside themselves. They are terrified about having this woman in their home who they have already fired, who they no longer want around their children. They even put a lock on their refrigerator door, turned off the internet, tried everything to try and get her to move out of this house. But so far, she is still living here. Let me let you hear what the family talked about after they were heard from Law Enforcement that they had to actually go to court. That firing her and telling her to leave was not enough. Because when i called the police, theyre telling me its now a civil matter and that i have to evict her. So this lady is welcome inside my house any time she wants, to eat my food any time she wants, and harass me, basically. Im now a victim in my own home, and its completely legal. Now this person is in our house, i have to go to work, my kids are still here, my wife is still here. She towers over my wife. And kids. And i know that there is nothing i can do about it. Reporter now heres a quick update, because we heard from the family and from neighbors. The nanny, diane stratton, has actually left the house. She left at 5 00 in the morning, and has not yet returned. They are fearful that she will return and try to claim back the room that she has been living in. Brooke . So im assuming they cant lock the door, because that would then be illegal. Can you answer that for me . And also im assuming this family is going to follow all the proper eviction procedures and go about this and get her out eventually. Reporter theyre doing what they need to do. They say theyre trying to do what they need to do to remove her from the home legally. Yeah, they cant just lock the door, because that goes against the rules. I want to mention one more thing that we think is pretty important here. We took a look at Diane Stretton and this particular list that exists here in california. She has been called a vexatious litigant. And what that basically means is that she files a lot of lawsuits that dont necessarily have a lot of merit. So the family is afraid that suddenly this woman could try to take their home or try to get money from them. And they are just trying to do everything they can to fight this. Remember, theyve got three little kids who are in the middle of this and they want to protect them as well, brooke. Vexatious litigant. Something to look up, i guess. Lesson to learn by. Aaron schwartz, co founder of reddit, according to his father a victim. Schwartz was adamant about one thing, making online content free to the public. Charged with wire and Computer Fraud. He was facing up to 35 years in prison when he hanged himself in his brooklyn apartment. Now his father is coming forward and speaking very candidly about this to cnn about his sons arrest, about his sons solitary confinement. And what he says led to his sons apparent suicide. Laurie segall had this exclusive interview and joins me now. And laurie, first remind us of the charges he was facing and tell us what the father told you about these alleged crimes. Reporter brooke, aaron allegedly downloaded millions of academic journals from m. I. T. s network. He believed that Academic Research shouldnt be hidden behind a pay wall. And his father said he believed he was innocent. But he did say to me, even if he wasnt inspenocent, the punishm of facing 35 years in prison did not match the crime. 11 of the 13 charges aaron faced were violations of the Computer Fraud and abuse act. That has to be changed. If you believe that there are problems with the criminal Justice System, which obviously you have said, do you believe that if the criminal Justice System hadnt failed aaron, do you believe he would be alive today . Reporter brooke, i met aarons father about a year ago, and we were sitting in a cafeteria here in cnn and new york and he said i was on my way over and i picked up my phone to call my son and then it hit me. And you can see that he still has questions, and hes obviously defeated by this. But hes fighting. Hes fighting. Hes talking to you about it. You even talked to him about the day his son was arrested. What did he share with you . Reporter you know, its heartbreaking. He talks about how he and is his son went to m. I. T. To treat his bicycle and helmet from the officer after he was arrested. The officer said this is now in the hands of secret service. And they were just devastated. But he got into more detail. And he said that how they treated him after that, it essentially broke him. Listen to this. They went into his apartment, went through all of his personal effects. After he surrendered, voluntarily, they arrested him, they strip searched him and left him in solitary confinement for hours. And after he met his bond, they kept him in solitary confinement for three or four hours with absolutely no explanation. All with the goal of attempting to break him. Reporter and, you know, he did we should say, aaron did battle. As he was battling the courts, he was battling with depression. And his father really believes that had it not been for the charges and the extent of these charges, his son would still be alive today, brooke. 35 years. And it was supposed to be her year. So she wanted to keep it quiet. Apparently there were some talks about maybe getting a new contract. But both sides were far apart. And im told that sherri actually is excited about this next chapter in her life. She is going through a lot in her personal life right now. So what i think she wants to do is kind of take a step back, take a deep breath and see what happens next. As for jenny, she was added last year after elisabeth left. And i have to tell you, though, not sure if the audience really warmed up to her. And if you remember, i thought this was an interesting pick. Because if you remember, back when she before she was added as a co host, she had been a guest a couple times on the view. And there was some really awkward interactions between her and barbara. So when she was named co host, i thought that was, you know, really interesting. And im not sure if Jenny Mccarthy actually works in daytime. I think she may be better as a nighttime personality. So well have to see where it goes from here. They may add a man, were hearing. Really . A stream of men come through as guest co hosts. Weve seen jesse palmer, Ross Matthews this week. Its interesting, the one host left, goldberg, the one host who has spoken out and said shes not sure she wants a man on the panel. That will be interesting behind closed doors. Jobs up for grabs on the view. Lets talk about shia labeouf arrested at this broadway show, puffing away at cigarettes, grabbing some actors rear ends. Whats going on with him . If i knew, brooke, you and i could be rich people. Because i would charge for that information. You know, this broke late last night, this information he was arrested and taken out of a performance of cabaret. And i just got the criminal complaint. And i will let you know a little of what this says. This says that during the performance, he stood up in the theater and started yelling out loud at the actors during the performance. Apparently a Security Guard came over, asked him to leave. He would not leave. And thats when he was escorted out. Now, there were a lot of people at this performance last night. And we actually caught up with a couple people who were in the audience and they said, yeah, things were definitely weird. Listen to them. We didnt know if he was drunk, if i thought he was working on a role or something. Because it was obviously him. And he was quite a mess. He had a torn shirt. He had a cigarette. He was blending into the crowd, trying to, and chasing bums and craziness. Reporter now, when he was being escorted out, we are also told he was dropping the fbomb repeatedly and also doing that thing that celebrities do when they get in trouble, saying do you know who i am. And once he got to the police station, this is where it gets really disgusting. He apparently spit in the direction or spit at an officer when he was being arrested. And part of it, she writes this. A few nights ago, my 8yearold woke up in the middle of the night screaming no dont kill him, youre hurting my brother, dont kill him. Who was her daughter afraid of . The police. Specifically the s. W. A. T. Team whose raid left her baby brother. And this is a tough picture to show. Not this one, but we have others here. This is booboo, the nickname after a raid by Cornelia Police by deputies in georgia on may 28th. His mothers article this week for salon is called a s. W. A. T. Team blew a hole in my 2yearold son. Here he is in the hospital. A flash bang grenade that officers threw landed in this babys crib. They were looking for a drug suspect who was later found at a different location. Booboo has been in a medically induced coma and just this week allowed to wake up and head to a new facility to recover. Obviously, its a long road ahead. And not just for him, but his Three Sisters and the two people who now are sitting next to me. Baby booboos parents. And also here marcus coleman, the family spokesperson. Thank you all for taking a minute away from the hospital. I see elisia, you have the hospital bracelet and dad does too, because i imagine youre by his side a lot. So let me just begin with for background for people watching, you all lived in wisconsin. Your home burned down in wisconsin, so you came to stay with a family friend here in georgia. Take me back. It was the middle of the night. What happened . Well, we were all sleeping. It was about 3 00 in the morning. And we heard a very loud noise. Which woke us up. And then we heard more loud like bangs and a bright light flash. And then everybody myself, my husband, my kids, we were just shocked. We didnt know what was going on. One of the officers came in and pinned my husband down and tore his rotator cuff in the process of having him pinned down. My girls were freaking out. And then i heard my son start screaming and crying. And when i went to go pick him up, another officer grabbed him first. And i kept asking that officer, you know, give me my son, hes scared, hes crying, just let me have him. Give him to me. And when i went to grab him, the officer told me he stopped you. Yes, he told me to shut up and go sit down. So you couldnt even see what happened. You were seeing smoke . And you saw this bang, and it literally landed in his crib. Yep. We didnt know yet. We didnt have time. They tried to hide it from us. And then they pinned me down for a while and i told them, i couldnt breathe. I couldnt breathe. And he still pinned me down and sounded like he asked somebody, can you let me up. The other guy said no, not yet. So he still kept pinning me down and i couldnt breathe. So i just turned my head, wiggled my head around, opened my mouth and try to breathe so i dont pass out. And when they got me up, they had two officers standing and blocking the view of the crib. He walked me around the crib and took me outside. All the while, what is the s. W. A. T. Team saying to you as far as any kind of explanation as to why theyre in the house . Not yet during that time. Until they they came and got one of them came and got me and untied me and cut off the zip tie. And then walked me out to the back room. And then he tells me why he was here. And stuff like that. Let me just get this in. This is a sound bite from the sheriff, reacting to what they say happened. There was no clothes, there was no toys, there was nothing to indicate there was children present in the home. If there had been, we would have done something different. Youre shaking your head. Why . That picture that they just showed of the side of the house, you can clearly see the pack and play. Not only not even two feet from the door they entered in at and threw that grenade in. It was clear. You say it was clear there were kids in the house. Right there. The pack and play. Right there, next to the door. As a mother, youre not allowed to even see what has happened to your 2yearold. Right. Were you allowed to ride along in the ambulance to the hospital . Nope. We had no idea of anything that had happened with our son. They kept telling us hes fine, he has not sustained any serious injury. He was missing a tooth. Yep, he was missing a tooth. Thats what they finally started telling us after we wanted an explanation, we wanted to know why there was blood on the concrete. My husband and i were there. Were not hurt. Our other girls are not hurt. Nobody else in the family got hurt. So where did that blood come from . Look at the play pen. What happened to our son . Why is there so much blood on the concrete . Tell me about the moment that you realized where the blood came from. When did you first see your son . When we got to grady. To the hospital. Yes. And what did you see . I saw my baby boy lying there. His face is blew open. And his nose wasnt even attached to his face. It was horrifying. Nobody wants to see their little kid like that. How is he doing now . Hes come a long way. But hes got a very long way to go. He has permanently lost his left nipple when the explosion happened. My husband has got to see the hole in his chest. I have i have not been able to i didnt want to look at it at first. Until three days back when they changed the padding. I looked at it. Its still open this big. You could see ribs. Yep. It was a hole in his chest. Marcus. I just want to make sure that were clear here. I mean, any Due Diligence of good policing would have prevented the injuries of this young boy. Georgia has a dirty history when it comes to overpolicing and not doing their Due Diligence. Whether it is having a face blown open on a botched drug raid all in the name of the war on drugs. Whether it is Kendrick Johnson with a botched investigation resulting in a murder mystery. I would just love to take this opportunity to send a message to governor diehl and kennedy carter. We have a rare opportunity here in georgia to set the tone across the nation to implement some Public Policies that put morality and human life and good policing at the top of the list. There is so much overpolicing taking sweeping across this nation. So thankful to the aclus completion of their report that statistically documents that as a fact. This week they mentioned the aclu here, the American Civil Liberties union came out with this report called the excessive militarization of policing and found this one statistic for you. Just under 80 of s. W. A. T. Raids were to serve a search warrant, usually in drug cases. That means it wasnt for an active School Shooting or a hostage situation. But most of the raids the aclu looked at were focused on suspicion of a crime. Joining me now, chris gephardt, a 15year police veteran and threetime s. W. A. T. Commander in utah. Chris, thank you so much for coming on, because i want to hear your side of this. You sat, you listened to this familys horrible story. Whats your reaction to that . Thanks for having me. I wish it was under better circumstances. You know, what happens to elise i cant and her baby should never happen anywhere in the united states, anywhere in the world. It not knowing the full investigation into what occurred, my initial gut reaction tells me there was a training issue. During training for deployment of a noise flash device, flash bang grenade. The officers are taught to look where theyre going to deploy that device. We can assume no officer wants to do damage or hurt or injure a child. Obviously, there is something wrong. I understand there are hardened criminals and i want them like im sure they would want them behind bars. Why in so many of these instances, at least the ones we keep seeing over and over in the headlines are s. W. A. T. Teams, you know, resulting in unnecessary violence . You know, there is a misconception that s. W. A. T. Teams are used on drug warrants. The warrant for drugs is not what justifies the use of the team. Theres extenuating circumstances, such as there are known to have weapons in the house, known to possess weapons. And the aclu accurately points out in their report that over half americans have a firearm in their house. But i think s. W. A. T. Teams need to start looking beyond that point and say is the person prone to use that firearm in an offensive manner against Law Enforcement, or do they just have a firearm . I have a firearm in my house. A Police Officer comes to my house, im not going to use the firearm against them. Quickly, what are your rights . Like in this case, this family, the s. W. A. T. Team looking for someone who didnt even live in that home . What are this familys rights, what are anyones rights if a s. W. A. T. Team comes banging in . You know, its a very good question. Because its presents a scary environment. You want to defend your house, you want to defend your family. I know if i heard a bump in the night, i would be grabbing for my firearm and trying to find out what is going on. Unfortunately, when its the Police Officers coming in, were supposed to be yelling and screaming, right, police, police, police, search warrant, search warrant, to let the homeowners know this is a government intrusion that, has been signed off on by a judge. But its that split second of interaction between the homeowner and the Police Officer in a stairway, in a dark stairway, that decides the fate of either that officer or that homeowner. Yeah just into cnn, word that a Mexican Police helicopter has now fired shots near american Border Control agents. Lets go straight to pamela brown with more. Pamela, what do you know . Reporter heres what were learning, brooke. A u. S. Law enforcement official telling cnn, a mexican Law Enforcement helicopter crossed about 100 yards over the u. S. Mexican border south of tucson, arizona, very early yesterday morning. And this chopper fired two shots very near some u. S. Border agents who were right there on the ground, according to this official we spoke with. But none of those agents were hit. No one was injured in this incident. Now the Law Enforcement official tells us, brooke, the Mexican Police chopper immediately stopped shooting and turned right back around into mexico. And soon after that, mexican authorities called u. S. Authorities and acknowledged the incident and said it was a mistake. And we are told the Mexican Police were conducting a drug operation right near the border there when they fired those two shots. But brooke, at this point, we dont know if the mexican chopper was following drug suspects and tlibt recrossed the border as part of this mission or inadvertently strayed into u. S. Territory. But at this point, all indications are pointing to this being an accident. Okay. As soon as you get more information, obviously, let us know. Pamela brown, thank you for that. And it is exactly now one year to the at a after the Senate Passed that bipartisan Immigration Reform bill, and in the years since that senate bill was passed, what has Congress Done on Immigration Reform . Zip. Nothing. As congress dawdles on this issue, this is a humanitarian crisis, a steady stream of children. We have talked about this here a lot recently, most from central america, crossing the border. In fact, 400 coming into texas each and every day, not with their families or even a single parent. Folks, these young ones are coming all alone. Now the Obama Administration is struggling to feed and to care for this influx of kids. Some will be sent back to central america. Others will wait for years for a court hearing. And many will blend in and become a generation of undocumented students and workers and parents. So on this issue of immigration, let me bring in Pulitzer Prize winning journalist, antone owe vargas, and despite his work and success, remains undocumented because of what he calls and so many call our broken system. Jose, were going to talk in just a minute. And thank you so much for joining me. I watched your film last night. Heres a clip, a tease for what we all get to watch sunday night on cnn. Roll it. I have become kind of a walking uncomfortable conversation. I get asked questions like why dont you just make yourself legal . And i think its really important that we actually go through an application process to become a citizen so that you understand where the problem lies. Right . So here is a worksheet from the website of the u. S. Citizenship and immigration services. Right . And it asks questions like, number one, i am at least 18 years old. Yes. Number two, i am a permanent resident of the united states, and i have been issued a permanent resident card. No. So i cant even make it past line two. That is a clip. Here he is, jose. I know the frustration. I can see it in your face, just looking at this again. Hang on, let me just step two steps back. For people who do not know your story. So you wrote this, this pretty stunning piece in the New York Times magazine a couple years ago called outlaw. So here in this piece, you publish your fake documents, you put your family at risk and in part of it you say im done running, im exhausted. And not to top writing it in the New York Times you now come out with this film, jose, so publicly, saying hello, im undocumented. Arent you still afraid . No. Im not. I once i let go of the fear, i spent all of my 20s and my teenage years being afraid of this country that i call my home and pledging allegiance to this flag that assistant belong to me. But once i let go of the fear, look, im in an incredibly privileged position to be doing what im doing. Right . People like me are detained and deported every day, and what do i do . I make a film. So with great privilege, i think comes great responsibility. So thats what im trying to do. And by the way, my expression that you see on my face is im so glad you played that clip. Because that clip really underscores just the level of misunderstanding and misperception. Not only, by the way, among politicians, but even among journalists. About this issue. And about the fact that no matter how many times people say, get legal, in the back of the line, there is no line. Thats so much of the issue in this film. People say, okay, try to become a citizen and get in line. You meet the couple who their daughterinlaw from britain took ten years. It takes years and years, and your whole point is, where is the line . Where is the line . And to me, i mean, immigration is the most controversial, yet least understood issue in america. And i think what we really lack is a sense of honesty. Right . Intellectual honesty and moral honesty. Thats when people ask me. I mean, lawyers told me i was crazy to come out in the way i it. And to admit to everything i had to do to survive. I thought what i needed to do was say, look, here, america, this is what i have to do. Paying taxes, social security, working here, going to school here. I think whats still lacking from our leaders is honesty, right . And i dont think were having a real conversation about this issue at all. Well, i hope that by airing this film, at least it educates and we can have that honest conversation. And speaking of honesty, i mean, this your film gets very real. And especially the narrative and that involves your mother. And how you have not seen her since you came to the states in 1993. And just to end this, because here you have, jose, these tens of thousands of kids being, as we mentioned, in these detention centers, coming alone from central america. Here you were, you came from a little farther away. But, you know, with smugglers, you know, wanting this new sense of home. Let me play this quick sound bite, because i really want your opinion. George stephanopoulos talked to president obama about this pressing issue. Here is the president s response. Oh, our message, absolutely, is dont send your children unaccompanied on trains or through a bunch of smugglers. That is our direct message to the families in central america. Do not send your children to the borders. If they do make it, theyll get sent back. More importantly, they may not make it. You were the child with the smuggler. How should the Administration Handle this . I have to say, i understand and i respect the fact that a country like ours needs to protect and secure its borders. I get that. Right . And what the president gave is a political answer to a political situation. Well, lets talk about morality. And lets talk about what being an american is. So i was one of these kids that was smuggled. The person that brought me here, i thought he was my uncle, but he wasnt. I was smuggled to be here. I could be one of those kids. What if you know, and sometimes ive been listening to the president , and this sound bite all day. And what if that was your kid . What if thats your mom . Who is waiting for one of those kids
