When you undermine the peoples right to free press and freedom of speech and expression, then you threaten the constitution and all for which it stands. Defenders are going to say the president is simply hitting back, but this isnt the first time the president had a controversy with a military commander or member. Thats right. It comes at an interesting time. Hes drawing criticism for skipping a trip to arlington Memorial Cemetery on veterans day. Hes known for fighting back against criticism, even when it comes from members of the military or military families. Heres a list of awkward moments hes had with military members or their families. During the 2016 campaign he drew criticism for referring to john mccain for not being a war hero because he was captured during the conflict. He also dismissed the kahn family after they spoke out against him at the Democratic National convention. He had a spat with another gold star family. Disagreed with him over the content of a phone call he had with johnsons widow. President trump has not made the customary trip to visit troops overseas battling in war zones, something which is a common practice, almost a basic requirement of being commander in chief. As for skipping the trip to Arlington National cemetery last week, President Trump told fox news thats something that he regrets. Listen to this. I should have done that. I was extremely busy on calls. We do a lot of calling. This was veterans day. I probably, you know, in retrospect i should have. And i did last year and i will virtually every year, but we had come in very late at night and i had just left literally the American Cemetery in paris, and i probably assumed that was fine and i was extremely busy because of affairs of state, doing other things. Now i reached out to the white house to find out if they had any additional insight or statements on this feud between President Trump and the admiral, no response from the white. Of course were all watching twitter to see if the president has anything more to say tonight. We have reached out to the white house for a statement. So while we wait, i want to get a military perspective with us. First, just your reaction to the president s remarks about mccraven. Its unfortunate that the president would say that. A lot of folks had the great honor to work with him. Hes a gifted leader and incredibly honorable guy. I can tell you in history, democratic republics dont collapse based on external threats. They collapse within. And they become higher and more mighty than they should be. Its important that we take a chill pill and breathe through our nose and open ourselves up for criticism and external voices. Its imperative that we do that. Thats my greatest concern. Cnn has called the oped in august that i referenced earlier a stunning rebuke. Trump has embarrassed us in the eyes of our children, humiliated us on the world stage. Frankly, nobody is at your size, you pick on somebody your own size. Youre the president of the United States, theres nobody else out there who is your own size and i would not offer a judgment of his exercise of free speech rights. Not at all. When you think about the nature of this criticism, it has to do with one of the most successful raids that our military ever put together. All of this has to come together. This is an amazingly precise, very tightly coordinated. He allowed these incredible men and women to exercise. We went after bin laden and he was killed. Thats if phenomenal. Why are we discussing that . I dont get it. Is he out of touch when it says it would have been nice if the u. S. Had gotten him sooner . Of course it would have been nice. But dont think for a second having been involved in the hunts for bin laden in terms of the intelligence building up to our comment, this is very tough, difficult, demanding work. The operational arms of the military and intelligence and held back in terms of going after bin laden. We didnt have the right intelligence at the right time. Were the forces ready . Absolutely. Did we have the right intelligence . We didnt. He has gone after gold star families and referred to the military as being in shambles at some point. Do you feel like this president supports the military . I would say he does support the military. Every time you embrace the military, theres ways to do it. You can do it very privately in personal moments, generally with grieving family members, you dont need to put a spotlight on that at all but theres some things that you can do that are easy wins and easy victories for the president to stand in front of the military in a very public arena and say thank you. He plans to submit his answers to muellers written questions this week and he claims getting through them was no big deal. Im preparing written answers. Im the one doing the answer. Theyre writing what i tell them to write. Are they going to be submitted . At some point very soon. I have completed them. So you are submitting. It wasnt a big deal. By the way, it wasnt a big deal. The questions were asked and answered. They acted like i had meetings, i got the questions, i responded. We wrote them out. I read them once. I read them a second time, we made some changes. Well, i dont believe him but not surprised that hed say that. I think these were difficult questions that required a lot of work by his attorneys over a long period of time to get to the point where they had a narrative that they felt comfortable with that they could write down and the president could atest to. Daniel, what do you know about the process that went into answering the questions . We dont know everything inside the room, but we can assume that the lawyers writing the answers with the president , that they were going over them with a fine toothed comb and trying to answer them so they wouldnt get follow ups and that muellers team would not dismiss the answers as not really answering the question and they might have to subpoena him. This has been such a long process in terms of trump wanting to talk to mueller and yet his lawyer is saying if he did he would get in a perjury trap. That it would be very hard for him to tell the truth. In may, the president said he would love to sit down with mueller, but in this new fox interview he said hes finished. There wont be a sit down. Do you think mueller will be satisfied with written answers . Its a good question and i dont know the answers. What we see is a president thats finally listening to his attorneys who have advised him not to do this. Whether or not mueller accepts the representation by his lawyers that any questions that involve the transition period or post inauguration or executive privilege and therefore the president has a right not to answer them, that if he wants an answer, he should subpoena them and theyll fight it out in court. But the president is trying to stand on executive privilege and put it to mueller to say i dare you, in a sense, to seek a subpoena against me and well see whether acting attorney general whitaker approves it. Right because the president hand picked. He appointed this acting attorney general and he talked about him in his interview this morning as well. Did you know before you appointed him that he had that record and was so critical of Robert Mueller . I did not know that. I did not know that he took views on the Mueller Investigation as such. He didnt even know the acting ag. So this is a guy that trump hs s enjoyed watching on fox before he was in doj as chief of staff for jeff sessions. He enjoyed watching him defend himself and don brought him in for a Job Interview to be part of the defense team in the white house to defend the president. And for trump to say its up to whitaker. Trump has tried to interfere in the investigation in the past and considered firing mueller, so that may not be accurate either. Do you trust whitaker to let mueller do his job . Well, Matt Whitaker made a lot of statements saying he thinks the Mueller Investigation has gone too far and that a subpoena isnt warranted and he made all the of these statements when he didnt have full transparency into the evidence. Whether he changes his legal mind about it, well have to see. But i do think that the appointment was, at least a bad decision politically. And rosenstein should have been appointed after he fired sessions. We have to give matt a chance. If he doesnt do it, theres a sense that he hasnt done that, when the democrats take over the house judiciary committee, you can be assured that he will be there under oath testifying about this. So theres a lot of traps here for whitaker if he doesnt play it correct legally. And then into the 90s with an increase of drought and temperature, 160 on average. Between 2000 and 2012, were up to 250. With the heat continuing to build, with the drought continuing to build, i wouldnt be surprised if this number is over 300 or 340. Theres a direct correlation between the number of large fires and the increase in the temperatures outwest and in california. A report coming out, of course on Climate Change in california said by the end of the century if we do nothing with our green house gases, we could see a 77 increase of scorched land. Just this year alone, and well go back a couple, four of the last five summers were the hottest on record in california. 4 to 6 inch deficit right now. Scott won the race by a little more than 10,000 votes. Senator nelson acknowledged defeat and took a swipe at President Trump without naming h him directly. We have to move beyond a politics that aims not just to defeat, but to destroy, where truth is treated as disposable. And free press assaults the enemy of the people. To california in an area that Ronald Reagan often said was where good republicans go to die. Orange county. Democrats have now run the table there. Having captured every congressional seat in what had been the last reliably red state. Why is this erosion of gop support in Orange County so striking . Its just stunning. You think of Orange County as being the place that launched Ronald Reagans career, political career. It was also the birth of the conservative movement that really began in Orange County with the John Burch Society and conservative activists that drove antitax measures and antiimmigration measures. So this is a stunning transformation. A lot of democrats said that they hoped if there was a blue wave in california, or in america, this year, that it would have started in california. And indeed, they managed to flip all of those seats by very close margins. Those were the races being counted to the very end along with florida and a really chilling day for republicans over to blue territory. Past election day and as the focus of the country has really been on the florida race recently and a lot of complaints of how long it was taking. Weve been watching the numbers trickle in from california. Why does it take so long for the races to be called in those districts . Basically, we did have a lot more voters coming out for the midterms this year as we saw all over the country. A lot of College Educated voters turning out, that they were angry about donald trump, but many of those people cast their ballots by mail and, you know, often turn them in right at the last minute. So the counting took a long time and the margins were so close that many news organizations, including cnn were very cautious right up until the end in calling these races. So but a big day for democrats and republicans believe that had donald trump not be in the white house, they would have done a lot better in Orange County, and they still have a glimmer of hope Going Forward that they might be able to recapture some of those seats if more of the moderate republican wing is able to rise in reaction to donald trump. I want to take a look at the bigger picture. Democrats have now picked up 37 seats in the house. Theres still three house races left to be called, but what is this going to mean for the democrats ability to push forward their agenda . Well, they have a very a difficult hand to play here in the sense that yes, they have now taken the majority in the house, but obviously, the senate is still very divided. The country is very divided. So you have seen the democrats including nancy pelosi, say theyre going to push forward with the investigations that they wanted to do once they were in the majority, but also, try to reach across the aisle because 2020 is knocking on the door. Its not as far away as everyone thinks. They will have to bring in moderates and independents if they hope to retake the white house. So well have to see how carefully they play that hand. Youre not hearing the word impeachment a lot. I think its more republicans that were talking about. He was definitely trying to distance himself and his party from that word impeach. Thank you. It would eliminate a regulation triggering sentences for firearms related crimes and address disparities between crack and powder cocaine convictions among other things. Now the house overwhelmingly passed a narrower version of the bill in may, but it still faces a tougher road in the senate. One of the most vocal critics is also one of the president s allies. He says this is a misguided effort to let serious felons out of prison early even calling it a jailbreak that would endanger communities. The president supports this. He wants to work across the aisle on this. Whats your reaction . Well, his support is a positive step. We have a mass incarceration epidemic in the United States of america. Today theres 2. 2 million. We encars rate more people than any other country in the world. Its a stain on our society and time to do something about it and in a bipartisan way. You said this bill will transform lives. Its an end to the beginning. It will do two things. One, theres the Prison Reform aspect of it that was initially passed in may by a strong bipartisan majority of the house of representatives, and thats designed to make sure that we can successfully reenter currently incarcerated individuals into society with the skills, the training, the education, with the vocational support, with the Substance Abuse treatment necessary to make sure that when they are released back into society they can become productive citizens and save taxpayer dollars. Then theres the sentencing reform aspect of the revised First Step Act as being would reduce some of the harsh unnecessarily punitive mandatory minimums and lock them up, throw away the key, type of sentencing provisions that have gotten us into the overcriminalization mess were in right now. Mitch mcconnell is telling the president they may not have time to bring this bill up for a vote this year. What is your take on that . Is gridlock going to get in the way. Its a very unfortunate statement by mitch mcconnell. The only person in washington d. C. Right now that believes theres not enough time to deal with this criminal Justice Reform bill is mitch mcconnell. The chairman of the House Senate Judiciary committee believes theres more than enough time. Speaker ryan agrees theres more than enough time for us to address it. We should find the time to begin to break the back of the Prison Industrial Complex in america. This could be a break through bipartisan moment. Even the president is supporting this. As you point out, other republicans have come on board, but there is what we heard from senator tom cotton. He even wrote in a tweet, if its finalized and ready for a vote, why offer to keep changing it . You also have democrats urging more changes saying it doesnt go far enough. How do you reconcile that . We think the bill is in a sweet spot and that brings together a substantial number of democrats and republicans, progressives and conservatives. People on the left and the right. Advocacy groups in the Civil Rights Community as well as the coke brothers and the heritage foundation, theyre all supporting the need for criminal Justice Reform and in the process save taxpayer dollars. Do you think you could get your democrats on board, then . Those that want to see more changes . Do you think theyre willing to compromise . Absolutely. I had very productive conversations with my democratic colleagues. When we passed the First Step Act in may in the house, 70 of the House Democratic caucus including all the leadership, the chairman of the cbc, the chairman of the congressional hispanic caucus, very important progressives along with more moderate members of the House Democratic caucus all supported the bill. So we have a Great Foundation and now that its being strengthened in the senate in the bipartisan way im confident that the overwhelming majority of democrats will support that version.
