I think what you heard in public testimony was plenty to prompt that. You have two separate issues under investigation. The underlining conduct with whether there was collusion between anyone in the Trump Administration and the russian intelligence during the 2016 campaign to disrupt the campaign and hurt the Hillary Clinton campaign. Now the second issue of when the the president or Anyone Around him tried to obstruct the investigation into an aspect of that. In particular whether Michael Flynn made false statements to the fbi. Some of my friends, really friends and colleagues who are partisan democrats are trying so hard to find a crime, to stretch existing criminal law, maybe we can stretch it and apply it to donald trump. I think we need justice here that apply equally to democrats and republican and get partisanship out of the administration of justice. But would you advise the president to stop saying hes completely vindicated, that hes go on the record under oath to speak with bob mueller . First of all i think he has a great lawyer. Of course id tell him not to go under oath, i told bill clinton not to go under oath, i told him before it ever happened, you dont go under oath if youre the president. And if you are in a conflict he said he said, with comey whos one of the most credible people in america you just dont do that. You dont tweet all day and all night and you listen to your lawyers. But its very hard to get President Trump to listen to his lawyers. He got nominated because of his tweeting, he got elected because of his tweeting and hes not going to stop now. Any lawyer that represents him is beginning to have a real real challenge. In fact david to allans point, i wonder whether or not when the president said in that press conference that he would 100 give testimony under oath whether Marc Kasowitz says oh know please dont say that, or whether he said yes, this is our theory. Im hoping he said please dont say that. You dont have your witness put themselves in their position where a lie could be that which tips them toward statutory obstruction of justice which they might otherwise not been able to do had they just executed their Lawful Authority under the constitution as they did in the firing of director comey. And with director comey who in his testimony agreed with my point, he said the president had an absolute right to direct him to stop investigating flynn and he had the absolute right to fire him. I think it follows if you simply exercise your constructional right, dont lie, dont destroy evidence, dont bribe people, that pld be unconstitutional particularly in the ab sesence a real statute even if you disagree to the way he performed it which i do disagree with it. The other thing though allan, that i think we agree on, however is the combination of factors reach the level of abusive power, ir respective of whether the statute of aggregated and formed the basis for a referral to congress if mueller felt that that was appropriate. Michael, you worked with bob mueller and when the president says that, yeah ill go 100 and speak under oath, does bob mueller take that and say yeah i have to put him under under oath . No i dont think bob muellers the type of person who views these things as a dare. This isnt a macho fight. Hes a professional, hell put the president under oath if he feels he needs to in the continueuation of his investigation. Not for the sake of, well, you said that. I have the greatest respect for mueller and i had the greatest president for comey, he allowed his anger and pique, understandable, the way the president fired him was outrageous. I think it was very important that he said that the president had the constructionitutional p do what he did. I think we ought to be putting aside the issue of obstruction of justice and looking at the issue of impeachment. Raises one of the constitutional questions. Bribery, treegs and other high crimes of misdemeanors. What congress decides to impeachment a president in the absence of any of those elements, thats unconstitutional. Is there a judicial review, probably not. Its ironic that comey has the power to act unconstitutional. Therell be congress and senate that say no unless you show us bribery, treason and high crimes of misdemeanors. Allan, i think its pretty clear in federalist 65 from hamilton that if there is a sufficient number of factors that lead to an abusive office that fits definitionally the high crimes and misdemeanors i agree. So the answer to that might be if he decides he wants to prosecutor President Trump, that the only way he can prosecute him is if hes impeached he becomes a private citizen and then hes suggest to indictment because they probably cannot indict him as a sitting president.
