On this fourth of july eve as we all prepare to celebrate the birth of america, all of washington is scrambling to prepare for event the president promises to be the show of a lifetime. Designed to satisfy an audience of one. Armedered vehicles armorred vehicles being moved into place. White house aides working on the president s speech delivered from the Lincoln Memorial. There are rumblings tonight things may not turn out the way the president wants. A source telling cnn that military chiefs fear the whole thing will amount to a campaign event. With the armed forces front and center. The Washington Post reporting that there are worries that the crowd may not meet the president s expectations and we all know what happens when a crowd doesnt meet the president s expectations. This was the largest audience ever to witness an inauguration, period. Well, more on that in a moment. That comes as the president is offering pretty much the harshest defense imaginable for his policy that puts migrants, many of them children, in detention in deplorable conditions. The president tweeting, just tell them not to come and insisting that many of those migrants are living far better now. But there are new heartbreaking images of just how bad conditions are in those detention centers. Drawings made by three children ages 10 and 11 after they were released by cbp. Drawings that show children locked away under guard, lying on the floor, apparently under the foil blankets weve all seen in these photographs, though they almost look goathostly now. And this one showing sadlooking children behind bars not interacting with what looked like armed guards outside. A former president of the American Academy of pediatrics telling cnn, when a child draws this, its telling us that child felt like he or she was in jail. Ive said it before, but can anybody really look at pictures like those and say this is the way we want to treat people in america . Weve got more to come on all of that. And in another example of just how deep the dysfunction goes, the administrations being forced to do a 180, all because of a tweet from the president insisting hes absolutely moving forward with this plan to put a Citizenship Question on the 2020 census, even though the forms are already being printed without the question, and even though the Supreme Court last week just last week rejected the administrations rationale for adding that question. Joining me now to discuss, ellie ho honig, niamalika henderson and ryan lizza. A Perfect Panel for this discussion. Ill start with you, ellie. We already know how the cons went with this judge. We have a transcript of it. Look at this one, one of the doj attorneys admitting to the federal judge. The tweet this morning was the first i heard of the president s position on this issue. Just like the plaintiffs and your honor. And i do not have a deeper understanding of what that means at this juncture, other than thats what the president tweeted. Now, what kind of position now are the doj lawyers in . You and i are both doj lawyers, laura. I think weve had that feeling once in awhile of being out on a limb, but i dont think weve had the sensation of the president of the United States sawing it off while we were on it. Look, this case has been a series of embarrassments for the administration and for the department of justice. And we both know the most important things that the department of justice has is its credibility and its independence and it started last week when the Supreme Court said the reasons that you gave were pretextual. They were contrived. Which is really just lawyer talk for you lied. I call bs. Thats what it means. The Supreme Court called bs on the administration and then today they have this sudden 180 out of nowhere which makes it even worse. You and i know as doj lawyers, we speak on behalf as well as the administration, and even a judge points out the idea of all you got is your credibility in the end, ellie. They pointed out saying to the u. S. , judge george hazel said to the doj attorneys, if you were facebook and an attorney for facebook told me one thing and then i read a press release from Mark Zuckerberg telling me Something Else, id be demanding that Mark Zuckerberg appear in court with you the next time because id be saying i dont think you speak for your client anymore. So does this fatally undermine the credibility of the doj in front of this court or other courts . Its a great point by the judge and i think it does undermine the credibility. Look, doj already has a credibility problem here because the Supreme Court said we dont believe your reasoning, but the Supreme Court did leave the door open just a crack. Said if you can come back, administration, doj, and give us a legitimate reason, well reconsider, but its kind of hard to do that, right . Its like once a kid once your child lies to you and then comes back the second time, why are you going to believe them the second time . If you had a good reason the first time, youd be all set. It seems broken. Ryan, i want to bring you in here because in rejecting the administrations argument. They called it contrived, as we know. It was chief Justice Roberts who wrote genuine justifications for important decisions, reasons that can be scrutinized by courts and the interested public now, thats what he actually wanted to hear. Is ellie right, if the court wasnt buying the rationale before, tell me, whats it going to take to convince shes justices that theyre actually being truthful. I mean, their credibility is just shot in this case. You know, not just for the fact that the Justice Department and the president are not on the same page, but, look, whats the argument that they made repeatedly about why this had to be settled so quickly is that the census had to be published by the first of the month, right . They repeatedly made that case as it wound its way through the courts and now theyre saying, well, okay, that deadline was not a real deadline. So, look, you guys know this a lot better than i do. Credibility is everything before a federal court, and it has been shot. I mean, i feel like all of us who are who are asked to comment and interpret President Trump can relate to department of justice attorney Joshua Gardner tonight who said, you know, i just saw these tweets and i really dont know whats going on and im trying to figure it out. I mean, thats what he said to this judge george hazel. Ryan, can you imagine first of all, i cant comprehend having to go into a courtroom and having just last week a couple of days ago saying this is a final decision, were going to print it without it, weve all decided this, its going to happen, its going to the printers and all of a sudden having to say to the judge, oh, actually, was there a tweet this morning . My bad. Let me change the actual justification. Nia, it was more than saying the printing had to go to a different deadline. They were arguing which is shocking to a lawyer like myself. They had to have it on there because it was the only way you could pursue and prosecute Voting Rights infractions in this country. Not the case. House oversight chairman Elijah Cummings tweeted out the Supreme Court ruled that the Trump Administrations effort to add the Citizenship Question was based on a pretext that violated the law. The Trump Administration cant go back in time and claim it had some other valid and genuine reason to add the Citizenship Question after secretary ross, after ross testified under oath that he added it solely to enforce the Voting Rights act. Nia, look, is this really about just simply trying to undercount communities of color . Is thats whats happening . Yes, i mean, by all accounts thats whats thats what their goal is and that was a goal really before the administration ever even was sworn into office. You had wilbur ross there trying to concoct a kind of cover story that made this sound like it was something to do with the Voting Rights act. He suggested that it was really the doj that wanted to do this and come to find out this was something that was coming from wilbur ross and others outside of the administration with the goal of, as you said, undercounting folks in certain areas, immigrants, Illegal Immigrants as a way of advantaging republican districts. Of course the census has to do with, you know, designation of representation and representatives in congress. And so thats exactly what it was about. That memo, of course, was found after the case was argued, and i think it revealed what the real goal of this was. You heard the justices there essentially say that cover story was not true. And of course you wonder, of course its all about maybe diluting voting strength of a particular party, people who may want to vote for a certain party. It may also be about the idea of putting people back into the shadows. But also, niamalika, theyve also initially conceded defeat on that Citizenship Question and then all of a sudden there was a reaction from rightwing media that was very swift, that was very severe. In fact, conservative commentators like hugh hewitt who called it one of the biggest legal defeats of the trump presidency. So nia malia, is this the president s kneejerk to save face to a conservative critique . I think thats exactly right. Whether its foods, hugh hewitt, whether its rush limbaugh, so, yeah, you see him there reacting to what was seen as a real defeat. And it really was a defeat for wilbur ross of the doj to say we give this up, were going to concede this fight and go forward with the census form that doesnt include the Citizenship Question. I do wonder that even if the Citizenship Question doesnt end up on there, all of this kind of conversation around it could, in fact, do what they want to do, which is sort of depress the counting among folks who might be afraid of answering the census question. And you heard some of that kind of coming up in the back and forth between the lawyers today, the idea that, you know, Going Forward there has to be some clarity yeah. About this census and saying this is not you know, this Citizenship Question is not part of the census, it might end up the president s tweets the idea of Going Forward here is important. What happens next. And, of course, ryan, trumps path to winning in this case seems pretty narrow, but is he risking a more humiliating the way niamalika is talking about. Youve already conceded defeat. Youve already called uncle. So now what . Look, you cant eliminate the possibility that this was just a completely off the top of his head random tweet that will have absolutely no followup. Right . So the Supreme Court ruled one way. The Justice Department, which presumably consulted with the white house counsels office, you know, thats the way the process would normally work, right . They had to have gotten some kind of signoff from someone at the white house, unless this administration is even more dysfunctional than we imagine. And that the Justice Department and the department of commerce was Going Forward with a somewhat coordinated response, and trump either just was not aware of all that or had given his signoff and just decided, eh, im going to throw a tweet out contradicting all of that just to create a little chaos and remind People Mission accomplished in that respect, ryan. Mission accomplished. There is no plan. There is actually no plan, which is what the Justice Department lawyers suggested when they went before that judge on that conference call. They didnt know what he was talking about. Well, well have to stay tuned to this story. Niamalika, briaryan, ellie, yo expertise is appreciated. The fourth of july is supposed to be a patriotic day that brings americans together, but is the president s planned event going to turn into a display of partisan politics . But cnn has learned that military chiefs are concerned the whole thing could turn into a partisan political event. Cnns Kaitlan Collins has more. Armored vehicles rolling into washington tonight as the city prepares for President Trumps Independence Day extravaganza, which will feature those tanks parked at the Lincoln Memorial, military flyovers and a vip section for his political allies, but there are concerns about the price tag. Trump tweeting, the cost of our great salute to america tomorrow will be very little compared to what it is worth. We own the planes. We have the pilots. The airport is right next door. All we need is the fuel. We own the tanks and all. But thats not so. The Washington Post reports the National Park service will divert 2. 5 million from entrance and recreation fees to cover a fraction of the cost. Money thats typically reserved for park improvement. And the administration is refusing to reveal how much this will cost taxpayers overall. Trumps claim that the equipment is right next door is also misleading. Sources tell cnn the aircraft he wants must be brought in from california, kentucky, missouri and florida. Trump is also facing criticism from democrats who say hes turning the patriotic holiday into a partisan one. Instead of addressing Something Like veteran homelessness, hes spending it on boosting his ego with a parade thats fundamentally about him and that getting tickets into the hands of wealthy donors for the republican party. What a waste of money. Reporter cnn has learned that leaders at the pentagon are also reluctant to put tanks and other Armored Vehicles on display. The truth is hes politicizing the armed forces when he does it this way. Its not a political event. Its an event that is supposed to bring the people of the country together. Reporter several top military chiefs wont attend the celebration thursday and are sending their deputies stead. Now, laura, as the president is defending his show of firepower, were told that behind the scenes white house officials are still scrambling to put the final touches on the president s event, including still handing out tickets and some of those are to that vip section. Laura . Thanks, kaitlan. I want to bring in rear admiral john kirby and frank bruni of the new york times. Frank, you heard it all in kaitlans report. Are we still saying happy fourth of july or Something Else . I think i sat down and said happy fourth of trump to you. Thats what hes turned this into. You can go back to recent administrations that proceed his. You cant find an antiseedaecer this. There has not been a partisan celebration in washington, d. C. Hes turned it into a great parade for his own ego. Hes bringing out tanks. Hes bringing out planes. Hes saying lets show how Great America is. Our military isnt what makes this country great, our values when we stand by them are what makes this country great. Our engagement with the world that is not militaristic. Our entrepreneurship. These are the things that make america great, but hes rolling out fighter jets and tanks because thats his idea of macho greatness. When theyre on display. Admiral kirby, you know, were seeing tanks displayed on the national mall. Talking about the president who is going to have each branch of the military be referenced or even there. You wrote this really wonderful piece on cnn. Com all about this. Does the president really understand the fourth of july is actually not a military holiday . And what kind of position does this put the military in to have them standing at what might be a political event in front of an apolitical armed forces . Great questions. First off, i dont think he understands that the fourth of july principally is not a veterans holiday. This is about the day we w it about the day we declared our independence. The Founding Fathers were adamant about not having a standing army. I think its a totally misplaced application of the military firepower that were going to see tomorrow. As for your second question, i think the chiefs are rightly concerned about the increasing pollicization of the military. Theyve been trying very, very hard to hold the line and stay nonpartisan and out of the politics, but the president keeps pulling them into very difficult situations. Every time he talks to a military audience, he rails against the democrats. He talks about taxes. He brings up domestic political issues that the troops have no business hearing and have no business being a part of and he makes it more difficult for them. And hes putting them, in my view, in a very difficult spot tomorrow. Because what i understand what hes going to do as each of the airplanes fly over, hes going to bring up the service chief responsible for that aircraft and sort of have them standing with him. In other words wrapping his arms around the military and making it about not just them but him, and i think thats totally inappropriate. Break it down for me, admiral kirby. I want to bring you in, frank. Why is this not right . Are there guidelines that say you cant be out there at a political rally or campaign event. What is the crux of this issue . There are strict do. O. D. Guidelines about partisan activities while youre in uniform. There are violation that you can be held accountable for if you participate in partisan activity. Now the president will bill this as a, you know, unifying event and nonpartisan. Well have to see what his speech is, but, laura, even if his speech is completely on script and he doesnt get into attacking democrats or the press is the enemy of the people, even then, hes still i think risking the further pollicization of the military by pulling them into this kind of event which is clearly, i think frank is right, is more about his ego and appropriating the popularity of the military for his own benefit. Speaking about ego and one thing that seems to be a lightning rod for the president , crowd size. Right. This is going to be the third event of the day in washington, d. C. Youve got the parade earlier in the day. You got the capitol fourth later in the evening that has the fireworks display for 39 years has been there. The president is now adding this, moving the fireworks, standing on the Lincoln Memorial steps, which we know is a very historical place for so many things, but yet were hearing there may not be ticket sales. Ticket giveaways are very hard to do. They still have a lot to give away. What is this going to mean . This is a prediction that is utterly, utterly safe, no matter how big the crowd is, the president will say its two or three times bigger than that, because thats what he does. He needs to believe the crowd is that big so you see him as large, but, remember, in terms of all of these blurred lines, in terms of using moments in context that no other president has or would to kind of prop up your own ego. Remember the day after his inauguration, he quibbled about the crowd size. He made sean spicer go out there and lie about the crowd size. The next day, we dont talk that much about that, he went to the cia, he stood in front of a wall of stars that symbolized people who had died in service to the nation and he talked about how often hed been on the cover of Time Magazine and mused aloud about whether anyone had been on the cover that often. Thats a moment to kind of stack up next to this one to understand for this president there are no boundaries when it comes to selfcongratulations. I forget about that. Well, while the president is celebrating the fourth of july, there is a growing crisis that deserves his attention, the crisis on the border. Ill make my case next. Thank you. vo parents have a way of imagining the worst. Especially when your easily distracted teenager has the car. A big grandstand right in front of the Lincoln Memorial. Its where hell deliver an Independence Day speech before an audience, including vips and political donors. Armored military vehicles on the streets of the Nations Capital and flyovers by military jets and other aircraft. The president tweeting it will be the show of a lifetime. Indeed, it will be a spectacle, but one that pales in comparison to the unconscionable spectacle that is the humanitarian crisis at our southern border. Human beings treated like animals because they have the audacity to seek a more dignified existence for themselves and their families. The nerve of it all. This is the spectacle im talking about. Photos of migrants inside detention centers, crammed into cages. A report by the Inspector General of the department of Homeland Security calling the situation urgent. Conditions dangerous requiring immediate attention and action. One veteran Border Patrol agent describes it this way. The holding facility, the cells, they are what i will say, filthy. We have a maintenance and cleaning crew that clean the general area, like the hallways. But i have never seen them cleaning counters or cleaning toilets in the cells. Or cleaning sinks in the cell. Sometimes if you go in a cell, there is trash everywhere. Trash everywhere. The spectacle of human beings being treated like garbage. President trump ignoring the conditions that migrants are living in, tweeting without one iota of empathy, if Illegal Immigrants are unhappy with the conditions in the quickly built or refitted detention centers, just tell them not to come. He even goes on to say that Border Patrol workers are not hospital workers and many of these illegal aliens are living far better than where they came from and in far safer conditions. So in other words, how dare you complain. The apathy is a spectacle in and of itself, but the way the president seems to view these migrants is nothing compared to how this treatment is making them view themselves. How do we know what they feel like . Three children told us. Not with words but with drawings. And these pictures are worth a thousand words. Today the American Academy of pediatrics, which has been working with customs and Border Protection officials, released these disturbing images drawn by Migrant Children who were separated from their parents while in detention. The recentlyreleased children were asked to draw their experiences while they were in Border Patrol custody. 10 and 11yearold children drew themselves behind bars and in cages. One pediatrician described what she witnessed while touring facilities just last week. When i opened the door, the first thing that we that we that hit us was a smell. It was a smell of sweat. Urine and feces. And i heard crinkling to my left and i looked over there and there was a sea of silver. I describe them almost like dog cages with people in each of them. And the silence were just hard to watch hard to see. The stench. Hard to watch. Hard to see. And all on the eve of the president s show of a lifetime. Well, weve seen another show, and its been in our lifetime, and it was through the eyes of children. When the Supreme Court was deliberating brown versus board of education, they considered the psychological impact on black children being treated as if they were subhuman. Unworthy of a desk beside their white counterparts, unworthy americans. Black and white children were asked to look at black and white dolls and describe their feelings about each. Black and white children thought the black dolls were bad, ugly, unworthy. The white dolls were perfection. The Supreme Court took note of this and the Lasting Impact of allowing the government to enact policies that subjugate children of color. And not only because it hurt the black children, it hurt all of americas children. So perhaps the spectacle is in not recognizing that how we treat one child in america impacts the treatment of all of americas children. And perhaps fireworks are a good distraction from the real bomb bursting in air. Americas moral conviction. Ill talk to a child psychologist about all of this next. The American Academy of pediatrics releasing disturbing images drawn by Migrant Children after they were released from customs and Border Protection custody. The children, aging the child, ages 10 and 11, were asked to depict their time in cbp custody. As you can see, they drew people behind bars and in cages. Joining me now, dr. Cohen a child psychiatrist and trauma expert who worked with children in Migrant Centers at the border including the facility where the pictures were drawn. Welcome, dr. Cohen. Im so glad that youre here. This is heart wrenching and heartbreaking and really hard to see. As a mother and human being im really just outraged by what youre seeing and what were all seeing. Tell me i want to walk through the pictures. A lot of people look at it as a background. A wall paper. Walk us through what they mean. Were first told, of course, these are conditions, theyre smacked in the face by the swell of sweat and urine and feces, and this seems torturous to me. What is your take . I think that many of the conditions and experiencing and experiences that we are subjecting these children to. And we have to remember that these are children who come from terrible conditions, often traumatized when they originally get here, so theyre already highly Vulnerable Children and the conditions that we are subjecting them to really do represent i think fairly are represented by the word torture. Starting with separation from the people who care for them and love them and really anchor them to a sense of safety. We know that ana provide, for examp example, in her study of children in world war ii and children air lifted from germany, separation of a trusted adult, parent or guardian, was experienced as a more severe trauma to children than actually being out in the country where bombs were falling. That war was a less serious trauma experience as a less traumatic experience. What the impact is on with a child. Particularly these are drawn by children ages 10 and 11. In this first one were looking at, i see children appearing to be lying down with their eyes open. What does this say to you . These are very disturbing drawings, and what all of the drawings say, and ill address this one in a moment, is how extraordinarily frightened and alone and helpless these children feel. This is a deeply disturbing drawing, because as you say, youre seeing children lined up next to each other, lying under blankets all in the same position. The blankets arent even fully covering them. Their feet are sticking out. There arms are sticking out. Their faces have really no features. Their hands, their feet have no real detail to them, which is very unusual for drawings of children this age these ages of 10 and 11. So what were seeing is that these children basically disappear within this environment. And experience themselves as an entirely dominated by fear. If you go back to the drawing that you just showed me, theres a tower which is described by some of the children with a guard at the top of that tower, and that guard is the one who is clothed. And that guard appears to be really terrorizing these children into lying still. Theyre clearly not sleeping. And staying where they are. You might notice that they also have no mattresses, they have no pillows, they have no matts. Dr. Cohen, i look at this photo and say to myself i look at the way its drawn, i cant help but think this is one of the three that were seeing. There is a second drawing that you see people inside of a cage and people on the outside. What are they trying to convey here . And, of course, its important to note thought contextually you normally would have the child describe why they drew a picture a certain way, but what is this telling you . There are some really important things about this pcture, and i think in many respects this is the most telling picture. First of all, as you say, these are children who are in cages and its clear that whoever drew this is the person who is inside the cage. And you have to ask yourself for children who is inside a cage, well, generally animals who need to be controlled are inside cages. Animals who are out of control are inside cages. Who are in jails . Who are in prisons . People who do bad things are in jails and in prisons. These people inside the cage who clearly represent the children have no hands, they have no feet and they barely have any features. They have no agency it seems in many ways. No control. The last drawing we come across, dr. Cohen, it shows no one in this cage, an empty cage. Correct. And jail cell. Why is this is poignant . This is so poignant because it would appear that the child who drew this couldnt bear to draw the people inside it. Its difficult to know exactly without talking with a child, but to have drawn only the cage and none of the people, again speaks to the degree to which children themselves disappear inside this environment. They have no agency. They have no control. They are entirely controlled and dominated by their environment, which is a frightening and disturbing environment, and by the people who are by the adults who are there not to nurture them, not to care for them but to frighten them into doing what theyre told to do. Dr. Cohen, we see them, even if they havent drawn themselves there and we have to keep an eye on this. Thank you for illuminating it and letting us see what the experience is like through these drawings. Its really its difficult to maintain your composure when you see that this is what the experience of children are, 10yearolds and 11yearolds. Well be right back. Please sir. Did she go too far . I dont think so. Look, i think she represents a swath of america that has now heard well over 15 accusations of sexually predatory behavior against donald trump ranging from anywhere as bad as rape to assault. We have heard him in his own voice bragging about sexually predatory behavior. So no, i dont think this is too far. Its also i think one of the great appeals of Kamala Harris. For me, the idea of kamala, a black woman prosecutor confronting a racist, misogynist lawbreaker is what makes her so appealing to so many people, and why people are showing a newfound interest in here. Well, you know, alice, its about two weeks ago, its already been two weeks and it hasnt really been the biggest mainstream story, but there is a writer, e. Jean carroll who accused the president of Sexual Assault, as ana just mentioned. She one of more than a dozen women who accuse the president of sexual misconduct. Does that now put harris attack in an even different light here . Unfortunately, it puts it in a light of a bunch of white noise because there have been so many accusations of this nature. And look, he will be the first one to say that this president has made many inappropriate comments, and has made many inappropriate actions. And he certainly is an adulterer. But predator is a completely different league. I think thats not the correct word to use here. And she is clearly, really appealing to the democrat base, and certainly women who do not like this president. Look, i think a lot of his behavior, the access Hollywood Tape is a perfect example of his disgusting behavior towards women. But at the end of the day, republicans like myself, and many of those who have supported this president have done so because of his policies, and certainly not of his character and personality. But we did not vote for him to be our pastor or heaven forbid our president or our husband. We voted for him to be our president. We support his policies, but not certainly his character. Ana, are you comfortable with this is so interesting, laura. Are you comfortable with the idea this has been a cost benefit analysis in the presidency by the American People . What youre saying, essentially, alice is look, ill have to forgive everything because at the end of the day, youre doing what i want. That the right approach to have in the republican party, ana . I dont think so. I dont think so. Im a lifelong republican who has voted for republican candidates until now, and i made a decision not to support a man who i think is morally and financially and frankly even substantially bankrupt. I dont even agree with his policies. I think caging children is immoral. I think coddling dictators is immoral. I think looking the other way as russia interferes in elections is immoral. I think palling around with a guy who beheaded a Washington Post journalist is immoral. So for me its not a cost benefit. I find him morally unacceptable. I find him unfit, unqualified to be president. But one of the things why i think this is different coming from kamala is because, look, in 2016, we heard all these accusations against donald trump, but democrats had nominated probably the only candidate who really couldnt take it to him on this issue, because fairly or unfairly, she was bearing the baggage of bill clinton. Kamala harris does not have that problem, and she comes at this as a prosecutor and somebody who has prosecuted Sexual Assault and sexual predator cases. So its an entirely different picture, and i dont think that in the hands of Kamala Harris in a debate it would end up being white noise much less ignored. Well, alice, speaking of the idea of pictures, youve already seen the devastating photos from inside the migrant detention facilities and the drawings as well a part of it. The president made that tweet talking about well, look, all problems would be basically solved. Just dont come. What is your reaction to that and the idea that ana is saying that that in conjunction with other things makes this president disqualified from continuing to be the president of the United States . Look, i think those pictures are extremely disturbing, especially when we look at the very last image that we just showed on the screen that you highlighted a few moments ago where we see a childs image of the cages with the black square as representative of where they are. These kids are looking out from what they see as a black hole. And this cannot happen. And this is not just the president , but its all of congress that needs to get together. And let me just highlight one really quick thing that a very wise woman just said. Perhaps the fireworks we see tomorrow are a goodies extraction from the real bombs bursting in midair that is americas moral conviction.
