Also learning much more about some of the people that the fbi says stormed the capitol two weeks ago, and that includes Riley June Williams from pennsylvania. A person who said they were a former romantic partner of williams, who identified her to the fbi in video inside the capitol building, and directing people upstairs to pelosis office according to an affidavit filed sunday supporting williams arrest. The tipster also claimed to have spoke ton friends of williams who showed the tipster, it was said video of williams taking a laptop or hard drive from speaker pelosis evidence. To be clear, no evidence a computer was taken from pelosis office. The fbi says it appears williams fled, deleted her social media accounts and not yet arrested. Then theres Robert Gieswein of colorado. Decked out in Tactical Gear during the riot, prosecutors say hes a member of the far right Militia Group the three percenters. Gieswein apparently runs his own private paramilitary Training Group and the fbi says photos show him carrying a baseball bas climbing through a shattered window into the capitol. But the three percenters were far from the only militant group at the capitol. Jon schaffer seen, front man for a heavy metal band called iced earth. The fbi says schaffer had bear spray used against Capitol Police. Cnn justice correspondent evan perez is here with more. Evan, new charges that just came down as well for two members of an ohio militia. What can you tell us about those . Reporter thats right, brianna. At this point now were getting into some of the antigovernment groups like the oath keepers. These selfstyled militias that have now been arrested and theyre, frankly, a higher priority for Law Enforcement because some of these people had paramilitary training and some appeared you could see them in videos, a coordinated effort to try to enter the capitol and in some cases violently. The two names we have that just got arrested Donovan Crowe and jessica watkins, said they were members of this group called the ohio state regular militia, and, again, this is a group that is tied to the oath keepers which is sort of a loose group, all over the country. Theyre generally antigovernment and, you know, according to the complaint, they entered the capitol, you can see them in some of these pictures. They are on video, on pictures wearing paramilitary gear, and, know, according to the fbi affidavit of their arrests, they say they went into the kapcapit peacefully but that is not the impression of Law Enforcement. They said they went into the capitol by force and so thats the reason why theyre facing these charges. Now, this is only the beginning. We expect were going to see dozens more of charges like this, because, again, there were a number of groups that are selfstyled Militia Groups that went into the capitol, and Law Enforcement and prosecutors believe they were responsible for coordination, command and control tactics weve seen isnt some of these videos. Evan, thank you for the update live in washington. Also we want to highlight a final suspect from the rye its, timothy Hale Cusanelli. An Army Reservist who also had a secret level security clearance. Prosecutors say he was encouraging other rioters during the siege in giving directions to people inside the capitol. One informant told the fbi Hale Cusanelli is an avowed white supremacist and nazi sympathizer. Its unclear if he has been arrested at this point. Bringing us to the work the fbi is doing today. Screening the thousands of National Guard members in d. C. For ly extremists. Heres what was said about this today. Theyre screened and repeatedly screened until they are actually put on the street. A regular background check is enhanced with more screening, more details, and its layered. So the fbi is part of it, the secret service is part of it and once they are certain that theres no insider threat, then that soldier, guardsman or airman is given a credential. White nationalism inside the military is not a new problem. My next guest told congress when he urged them this summer to remove the cancer from the ranks. Retired air force Lieutenant General Jack Weinstein joins us now to talk about this. Currently a professor a Boston University at interNational Security. January, thank you for being with us on this important topic. Tell us how big a problem this is in the military. A pleasure to be with you but i wish under other circumstances. I believe a problem in the militaire and a cancer that needs eradicated. I dont believe its something that infused all the different branches but i believe there are pockets. Weve seen people in charlottesville, members of the military obviously you reported on what was going on on january 6th. So this is something that the military needs to do. Now, the screening that is being done for the inauguration will be done extremely thoroughly. What really needs to happen, though, this screening needs to happen across the entire military, and we should be removing people that are members, even if they are not active members, because its really against their oath of office. You explain this as you have urged congress to take this on, that being in an extremist or White Nationalist group doesnt disqualify you from doesnt disqualify a person from serving in the military. Theres a distinction made between someone active, you put it, doing Something Like fundraiser. Explain this to us. Why are they not disqualified . So, brianna, ill explain how this came about. Doing a course and i had a student that did a tremendous study on white nationalism. They found out in her research that just being a member alone, not being active, was something that would not remove people from military service. When she discussed that with me, we realized that we had a bigger problem in the military, that people need to be removed that are members of these groups. If you try to create a military that represents all the people of this country, represents the diversity of this great nation, then you simply cant have somebody who is a White Nationalist and stay in the military. It is violating, as i said, the oath of office and these people need to be removed. To be clear, a lot of people do not go into the military, obviously, with these intentionses. Im a proud member myself of a military family and want to be clear about that. They go in to serve their country. Go in for the opportunities that it affords, but extremist groups actually encourage, you point out, their members to join the military and they like to recruit from the military. Tell us about this. Well, the reason they like to recruit the military is the military provides discipline. Military also provides, use a scary topic for this discussion, they provide weapons training. And these people get weapons training whether it has to do with explosive devices, or just simply how to use a machine gun. So they do actively promote trying to get ex military people or people serving in the military to be in these groups. Which is an an titithesis why people should be joining the military. I want to bring up sorry. I want to bring up one additional point, though. For all of us including you and everybody else in your audience that has served in the military, all of us, a large percentage of us, have done it for patriotism and support of country. It really is an insult that these people are tarnishing the good names of all those who came before us and all those people today whether active duty, reserve or guard serving in the military. Theyre tarnishing the good image of the United States military and more importantly from a National Security perspective, as our adversaries look at the u. S. Military, we really need to start to define National Security differently. National security and the strength of the United States isnt simply the amount of weapons we have or amount of ships we have or airplanes we have. Its the individual sailor, soldier, airman, marine and now space individual that are serving the nation, and having these people that are disparaging and that a White Nationalists are going against the constitution becomes a National Security concern as our allies look at the United States and what we represent. Awaiting more details, if more comes from that and whether or not the president will speak at the airport before he actually gets on air force one for the last time as president. We are expecting in the next 48 hours at some point to see as many as 100 pardons come down from the president , and this is something that typically all president s do in their final hours, but no one has ever abused the pardon power as much as President Trump has. So everyones waiting with bated breath to see who ends up on that list in these next few hours. Yeah. He loves the pardon. Thats sort of unilateral aspect of just being able to decide what it is that he wants. When he is out of office, were now hearing from congressman adam schiff and senator angus king that trump should not get classified intel briefings once gone. What king said on state of the union. Theres a grave danger of him inadvertently or willfully revealing classified information that would compromise sources and methods and theres no upside, no reason that he needs to have this information. Its a courtesy thats been passed on from president to president. But theres no legal requirement, and i think given his past history of being fast and loose with intelligence data, it ought to be, that ought to be an easy decision for the incoming president. So ultimately, garrett, it is going to be up to joe biden, but has a new president ever withheld these briefings from a former president before . Well, you have to understand what the tradition of sharing classified intelligence usually relates to. Shes gotten a fair amount of attention as one of the members who tried to challenge results of the elections, and she also saw controversy over the last several days, or a staff shakeup when her Communications Director quit because of her role trying to challenge election results. She got into controversy, too, because she bragged about carrying firearms around capitol hill. She got into a standoff with Capitol Police after they put on metal detectors to get into the house chambers. Nevertheless, on this issue she denies having inny role and theres an Ongoing Investigation and see if anything emerges. Shes saying no evidence points to her role in any of this. Now, i assume the lawyers and the people who are peddling their access or claiming its with their personal time and theres nothing improper going on, but i think the spectacle which is fairly consistent with whats happened in the Trump Administration monetizing indeed another portion of our government, which is the president s pardon power is hardly surprising and really should be condemned. When it comes to pardons so far President Trump has given clemency to far fewer than president obama and several other president s. Take us through it the 48 hours of the pardoning process and what typically goes on behind the scenes at the white house and in the oval office, at the justice department. Sure. We had a very different process than what youre seeing or were hearing about here. You know, president obama decided and made it clear to me that he was going to use his constitutional power, pardon power, for social justice and social good. That is the clemency that he decided to grant to a lot of people who were serving life sentencing and significantly long sentences for their involvement in nonviolent and many of them relatively trivial drug crimes mostly from the 1990s. Thats really what we were working on. And as i say, he really wanted to focus his power on giving new lives to people who were incarcerated, and thats whale we were about. This frantically running around finding which supporters can bring him a new person to benefit, thats just not the way we went about it, and president obama made it very clear that in a short time and scarce resource world thats not where he wanted to focus his attention. Thats not at all what happened at the end of the obama administration. Right now it appears the president is now leaning away from something that he had asked about, which was pardoning himself. That he is now leaning away from pardoning his family members, or some close associates. If that changes, though, do you see do you see that changing . And if it does, will that hold up to legal challenges . Well, i i mean, its my view, theres been debate, legal debate about this. Although i think its actually fairly clear that a president cannot pardon himself. I think if you think about it, thats the ultimate free pass that places the president of the United States above the law, and i think its pretty clear our framers who just came out of a monarchy had no sense the right way to go is to let the president of the United States place himself above the law. Thats not at all what they were thinking and i think most originalists would agree with me on that. I think that would not be recognized and not lawful if he attempted it. Obviously a number of trump supporters, neil, are facing charges. We know that from the siege on the capitol. What are the implications, what would they be, of the president deciding to pardon some of those folks who stormed the capitol . This would really be sort of the crowning blow, if you will. I mean, the president was involved, i believe, in calling on his supporters to attack another branch of government. Article 2 until our constitution, and the so sorry. I have to pause this conversation and go to the Vice President elect speaking in washin washington. You know, when i knew i was going to be able to interview you on this historic day, i thought about a moment that weve seen in some new video of the capitol, and i wanted to get your perspective on it.
