We really wanted to tell the story of the ocean shield as it moves out into the indian ocean. A special edition of newsroom starts now. Good morning. Im carol costello. Thanks so much for joining me. New this morning, a break through headline. All 227 passengers from Malaysia Flight 370 have been cleared of any wrongdoing. Thats according to the Malaysia Police chief. So far 170 people have been interviewed as part of their criminal investigation and more interviews are expected. Still, 26 days into the search there are no clear suspects. As we have sit here, only the passengers has been cleared. The rest, no. The focus of the investigation remains on those pilots and those who had access to flight 370 before it disappeared. Senior International CorrespondentNic Robertson joins us with more from kuala lumpur. Hi, nic. Reporter hi, carol. What were seeing is a correlation between the actions that have been taken by Malaysian Airlines to improve security on board their aircraft which is one of the key things that is when one of the two pilots leaves the cockpit, another Senior Member of staff must go into the cockpit to keep that remaining pilot company. A single pilot not allowed to be inside the cockpit. That comes as the police chief has said all 227 passengers have been ruled out of their four areas of investigation. Of course weve already been told that theyve checked all their backgrounds to see if theres any link to terrorism, that all passengers have been cleared of that. Now we know theyve been cleared of the four other areas of investigation being involved in the hijack, sabotage, having a personality issue on board the flight or psychological type of issue. So that just leaves the crew. The triangle of suspicion. The top are the captain and the bottom are the passengers. Theyve been removed. Now were seeing Malaysian Airlines focus very specifically increased security around the two pilots. We dont know more than that, but we certainly can make some very intelligent analysis of where this investigation is focusing right now. Carol. I understand family members met with malaysian investigators, australian investigators. Tell us more about that, nic. Reporter yeah, this is something that the family members have withbeen waiting ag time to get. Many came from beijing to malaysia. They got a highlevel delegation meeting today. They were told they would be given data, they would be shown information thats been collected, have it explained to them. They were told that this was complex information. They were able to ask questions. The head of Civil Aviation we have to stress this is a closed door meeting. The head of Civil Aviation said the families were able to ask all the questions they wanted. Well, guess what. When we talked to the families they said, yes, this was better. Yes, there was progress. Yes, we were able to ask some questions but the families still have more questions they want to ask. Theyre not entirely satisfied. They did say, you know, positively that this was an improvement, carol. Nic robertson reporting live from kuala lumpur. As nic mentioned, we also learned today that Malaysia Airlines is stepping up security to make sure that nothing like this ever happens again. A source telling cnn that new rules have been put in place making sure that no pilot or first captain is ever alone inside the cockpit. The airline is stepping up security measures surrounding that cockpit area, too. To talk about this im joined by cnn af reation and government regulation marsh and mary sciavo. Mary is an attorney who represents victims and families after airline disasters. Rene, i want to start with you. Tell us more about these new rules that malaysia is putting into place on its flights. Well, carol, under the new security measures, no pilot or first officer will be allowed to be alone in the cockpit for obvious reasons. You always want an able bodied person in the plane or as the pilot had sinister intentions, you wouldnt want that person in the cockpit and at the controls alone. So now if a Malaysia Airlines pilot leaves the cockpit, a senior cabin steward is to remain inside the cockpit until that pilot or first officer returns, carol. What are they talking about when they say added security around the cockpit . Well, also, you know, when this pilot is going to leave the cockp cockpit, they have to get clearance or visual clearance. They have to get visual clearance that theyre clear to leave, clear to come out of the cockpit. That may come by way of the stewardess. They want to make sure that not only the cockpit itself is secure, however, that area outside of the cockpit as well. So we do know when a pilot comes out of the cockpit, the door is locked, for example. Thats an example of around the cockpit. You want to make sure that entire area, there are no holes as far as security goes, carol. Gotcha. So, mary, it seems odd malaysia would suddenly come up with these new rules. Should we read anything into them as far as the investigation is concerned . Well, i think its precautionary on their part at this juncture in the investigation, and those rules, for example, u. S. Carriers already have those rules in place. They were contained in an operations specification, an ops spec back after 9 11 in the United States and explaining why, both for security and just for practical measures. If there is if one pilot steps out, the other is in the cockpit, various stages of the flight theyre required to have oxygen on. With locking cockpit doors, what are they supposed to do, get out of the pilots seat and let the other pilot in . A lot of this is common sense that was practiced by u. S. Carriers. However, i think theyre in the process of elimination. Its clear they dont have evidence of what occurred so theyre going through the best they can item by item and ruling it out. This he have no clear evidence of what happened. They can rule out what did not. I think thats what theyre doing. Trying to be very cautious. Rene, just so everybodys clear, can you take us through the rules in place when we fly on an americanbased airline . Right. Here in the United States a pilot is never left alone in the cockpit and before the pilot leaves the cockpit they must receive some sort of verification that its clear to come out. When they do come out, the cockpit doors are blocked. The pilot does make that visual contact, again, before opening the cockpit door. Pilots also here in the United States, they dont get served the same meal. In the event the food is tainted or food poisoning, something to that effect. So if one pilot gets beef, the other gets chicken. If theres a third in the cockpit, that one is going to get fish. Theyre all not going to get the same meal. That is a part of the program in the United States. Things have been pretty robust as it relates to security since 9 11. In addition to all of those cockpit procedures, you have additional procedures in which crew members, they receive selfdefense training. We also have whats called the federal flight deck officers which are essentially pilots which are armed. Its a voluntary program, but we also have that in place as well, carol. Lets talk a little bit more about that, mary. Trained pilots can take guns into the cockpit on american flights. Are malaysian pilots allowed to do the same . Not to my knowledge, and when that was put in place in the United States, there was a tremendous amount of debate either way. Right now i think the United States is cutting back on that program, but its certainly many pilots, i know many who did that training feel much better with the ability to defend themselves, but it was not without its criticism. Maybe a last question. Theres also talk of putting cameras in the cockpits. Rene, i know that some pilots are uncomfortable with that. Absolutely, because then it because the privacy issue and it just becomes an issue of continuously being watched. The big brother issue. There is push back on that. It becomes clear when we watch this issue following what happened here, if anyone wants to oppose it may change their mind. There definitely has been push back on that issue. Push back or not, mary, is it possible that well soon see cameras in all cockpits required . We can and we should. Look, every clerk at a 7eleven is scanned with cameras and they dont have 239 lives for which theyre responsible for. Under u. S. Law you dont have a privacy right in a flight deck. You have a privacy right in the bathroom but not in the flight deck. It is a disingenuous argument. There is a practical element in that airlines will never, ever do this notice the faa makes it mandatory for video or other monitoring in the cockpit. Most importantly for streaming data. Unless its the law or regulation, they will never do it. We have to put more pressure on our own government. Mary sciavo, pamela rene marsh, thank you very much. Chuck hagel will be asked for more military assets today. Hes in hawaii to host a meeting of Southeast Asian defense ministers. The group will look at how groups can better coordinate disaster responses or Search Missions like flight 370. Cnns Barbara Starr is at the pentagon with more on this. Good morning. Reporter good morning, carol. When the ministers meeting was originally scheduled months ago, nobody anticipated that this would be a major topic at this ministerial in hawaii. Secretary of defense chuck hagel arriving in hawaii overnight. The malaysian minister also there. He says he will ask the u. S. Secretary for more help in deep sea search and recovery. Its unclear what he plans to ask for. On the plane on the way over hagel met with reporters and talked about the neat to take a look at this entire situation. Like any of these tragedies, we dont yet know what happened. Theres always lessons to be learned. What could have been done, maybe what should have been done, what needs to be done better, but coordination is a key part of this. How do we bring all the compliment full assets of nations together to cooperate and connect when you have these disasters . Reporter the compliment of all nations assets. And in fact today we know that still more assets arriving in the region. British military submarine in the southern indian ocean doing what it can to help with the search. Its worth remembering, this region of asia just a few years ago saw the massive disaster from the tsunami. A lot of nations came together to help. Also nations coming together to help after that massive earthquake in japan, but still in this situation, a lot of discussion about what has not worked well and how to get better coordination. Barbara starr. Now to chile. Five people are dead after an earthquake struck last night. There was the warning. It sound the the 8. 2 quack triggered landslides, knocked out power and caused extensive damage. It also set up a tsunami warning. Seven foot waves crashing on to shore forcing massive evacuations. The epicenter of the 8. 2 magnitude quake was located off the northern coast of chile. 60 miles forth of iquique. Reporter the earthquake was blamed for at least three massive fires in iquique. People fleeing from coastal areas spent the night anywhere where they could find higher ground. Translator the country has been able to face these first few hours of emergency in a good way, and i would like to call on people who live in the affected regions to remain calm and to follow instructions by authorities so we can ensure their safety. Saturday as the planes black box batteries expire, they may have the best tools to locate those devices, the ocean shield is one day away from the target zone. Australias ocean shield is steaming toward the suspected debris field. The search zone shifted eastward toward the australian coast but it is still an 1100 mile journey. Have they been able at all to narrow the search zone to increase the effectiveness of this technology that they have on board . Reporter i know, we were hoping to hear more about that every day, unfortunately, carol, i asked for some clarification on that today. When the search zone moved closer to coast and a little bit further east. No, theyre refusing to say whether or not theyve been able to narrow it, but it certainly doesnt sound like they have. In fact, it said the search zone that they had originally outlined last week, they had searched it between march 28th and april 1st. They found nothing. And now they are in the waters adjoining that initial area. What does that mean, carol . They think theyve done a pretty good job exhausting that search in those areas. Theyre moving on hoping they find something. Paula newton reporting live from australia this morning. Still to come, mary barra faces day number two in the hot seat. That is right. Less than three months into her job at the helm of this huge american company, mary barra taking tough questions from the house yesterday. Today she faces the senate. Well be right back. n well return to our coverage of flight 370, but first i have a major recall to tell you about. This one has to do with chrysler. Chrysler will recall nearly 900,000 suvs including some models of the Jeep Grand Cherokee and Dodge Durango due to brake problems. They launched an investigation after customers complained about brake peddles being too firm. The automaker plans to install shields to protect those devices. Chrysler says it has a report of one account, no injuries linked to that brake problem. The ceo of General Motors back on capitol hill today. Just one hour from now mary barra will face a second round of questioning about why it took her company more than a decade to recall millions of cars over a deadly ignition design flaw. Yesterday barra held firm in her answers and offered apologies to the victims and their families. Todays gm will do the right thing. That begins with my sincere apologies to everyone who has been affected by this recall, especially the families and friends who lost their lives or were injured. I am deeply sorry. Barra also announced gm has announced ken feinberg to oversee the results. Hes best known for handling recovery payouts after disasters like 9 11 and the Boston Marathon bombings. Joining me is ken and jane reimer who lost their daughter. Welcome to both of you. Thank you. Jane, listening to yesterdays hearings, did you get any satisfaction at all . No, i did not. I felt that she was very scripted in what she was saying to us who had lost our children, and its under investigation. Weve heard that many, many times yesterday. We as family members felt that was very frustrating. Ken, what do you want to hear from her . What we want to hear from gm is take ownership of what happened. Whether its new gm, old gm, its still gm. We want this not to happen to anyone else, no one else gets hurt. Gm needs to say, man, we really messed up. This was our fault. Well fix everything that was out there and well take care of those that were hurt or injured and those that lost loved ones. It was our problem. It was our fault and we accept the ownership of that. In a scathing op ed that was published in the huffington post, documentary director michael moral wrote, quote, i am opposed to the Death Penalty but to every rule there is an exception. In this case, i hope the criminals at General Motors will be arrested and have to pay for the taking of human lives for a lousy ten bucks. Does he have a point . Yes, he does have a very valid point. Are the people who are responsible for this at gm, could they be considered criminals, ken . I dont know. We havent proposed any laws that say they were negligent. If they were, someone in corporate made the decision that it was better to put this part out, they were less involved with them financially or to put out the correct part or something that fell within their specifications. Negligence, yes. Criminal negligence . If people were hurt, injured, killed, it could be. Like i said, its a fine line were treading there. Hopefully knowing that someone did this, well find out who those people were. It involves more than one person. Jane, General Motors has hired ken feinberg who is best known for setting up Victims Compensation funds. Would that be something that victims and their families would be interested in . I do, but there is no amount of money that can replace our children or the ones that we have lost. Ken and jane, thank you for joining me. I do appreciate it. Thank you for telling our story. Absolutely. More on the gm hearings. I want to bring in poppy harlow. Welcome to both of you. Poppy, i want to start with you. Mary barra took questions from reporters after her testimony yesterday. She told you that General Motors is, quote, moving towards a culture that is focused on the consumer. Read between the lines here. What is she really saying . That wasnt the case before . Yes. So much of the hearing focused on cost culture versus consumer culture. Heres a quote from her during her house testimony yesterday. We, gm, moved from a cost culture to a customer culture. Shes talking about the quote, unquote, old gm pre2009. This is a decade ago. This is 2004 when the company knew there was this problem and it never was told to the public. It never theyre saying went up to the highest ranks at General Motors so why did it take a decade . She is talking about the difference in culture. The question is, this is also coming from a ceo who is not new to gm, carol. She has been there for decades. She was someone who worked leading product and development and leading engineering. A lot of people wanted to know, i walked down the hall talking to senator claire mccaskill, how could you not have known or had any indication . Youre not new to this company. They really want answers directly from her on that. And, rhonda, when you hire someone like ken feinberg like gm has, what does that tell you . Well, it tells you that the stakes are big. You know, this is someone who negotiated the payouts in the 9 11 settlement, the gulf of mexico spill. It shows that they are thinking theres going to be big money involved and theyre taking remuneration for the victims very seriously. I think one thing that will be interesting to see is whether or not you see payouts post bankruptcy which legally, unless its a krim call case, you wouldnt be forced to do. Yes. I think, carol, thats an important point. Technically because gm went bankrupt, they have no legal obligation to pay any Civil Penalties or fines out before that. Mary barra was asked in the questioning yesterday, will they . She didnt directly answer but she said they have moral and legal obligations. I think the fact that they brought on ken feinberg, this is what he does. He deals with victim compensation. Absolutely. All right. I think this is part of that Culture Shift that she wanted to engender at the company. She really wants to show that. Poppy, im curious about something. I dont know if you know the answer to me. It seems to me mary bar ra is new to the job as ceo. Why not call the last guy to testify, the guy that was there and in charge. Carol, you and i are on the same page on this one. That is the first question i had when i saw she was coming to the hill to testify. I was like, wait, what about rick wagner who was on the hill from 2000 to 2009. Mary barra is in charge. We want to hear from her on this. She didnt say they wanted to call any of the last four ceos. This is a company that has had five ceos in the last five years. So relatives of those messing on flight 370 have mourned their loved ones at candlelight vigils but the family of one of those passengers, a man who bored the plane with a stolen passport and came under suspicion in the days after the plane went missing has mourned in silence staying away from the daily briefingin insbr. Sarah sidner has more. Reporter of all the grieving families of missing flight mh370, the family of 18yearold mohamadi is grieving alone. He and his friend were two iranians on the flight. His family has stayed away from the epicenter of information. Not attending briefings or getting the counseling provided by Malaysian Airlines. In this case the airline says it has not been in contact with the families. Their case, it said, is in the hands of investigators. Normohamadi and reza boarded the flight with stolen pass porlpor. Able to pass through security without a problem. At first they came under suspicion but then they were cleared. On facebook his mother pours out her grief. From the moment i became a mother, she says, all i wanted and asked from god was to not see my children die before me, but of course that didnt happen. We tried to talk to his mother but she did not respond to our calls or email. We managed to get in touch with his friend who said goodbye to him at the kuala lumpur airport on march 8th. He refused to show his face for fear he will be harass the by authorities when he travels to and from iran. He says he and his friend reza are from christian families though he was not particularly religious. His facebook message four days before he got on that plane shows him standing below the iconic malaysian skyscraper with the words feeling excited. She was so sad. She was asking me when my son was there, he was happy, he was enjoyi enjoying, i said, yeah, as i see, he was happy, he was enjoying. He was okay. Then she just say thanks, god. Reporter he says he saw a plane ticket with another mans name on it and questioned him about it. Ultimately he would only say he was trying to leave iran forever to live with his mother in germany. He said, there is more freedom. There is more freedom there. Reporter instead he disappeared with the other 238 people aboard flight mh370. His mother left these words for her missing son. I dedicated my life to my son, she said, and all i wanted was for them to be happy in life. I wanted them to live a free life. Prayed i would see them again. We will see each other in eternity. As i told you at the top of the show, mooinl investigators have called the disappearance of flight 370 a, quote, criminal act. They also added z that they had cleared all 239 passengers aboard the plane. Theyre centering their investigation on the cockpit, on those two men at the controls. Dr. Marry ellen otoole is a former senior fbi profiler. She joins me live from washington. Welcome. Thank you. Does it seem unusual that malaysian investigators have managed to clear all 237 passengers on board in three weeks . Well, it depends on the amount of manpower that they had to conduct all the necessary investigations and how long it took for them to vet the information. So if they had enough investigators, which, you know, im sure that they did, then its certainly possible they could have done that. And theyre looking into the psychological backgrounds of all of these people so can you kind of take us through what they look at specifically . Sure. In terms of the psychological backgrounds, that would include Mental Health issues as well, theyd be looking for any kind of possible motive. I would break it down into four categories, political, religious, lone wolf, suicidal. They would be looking for information in each passengers background that would give them a sense as to whether or not a person had been generating some sort of ideation about Strong Political motives or thoughts, the same with religious thoughts, grievances, kind of a lone wolf philosophy. That would be apparent when they talked to people. That would be apparent when they would look at computers, journals, diaries, that sort of thing. Are they really committed to some kind of a cause. They feel theyve been mistreated, that sort of thing. Then theyre also looking for people that have been sort of considering a suicide or homicide. All of that comes with not just talking to people, it comes from looking at their computers, their writings, talking to friends, but getting into the nuances of whats going going on over the last 24, 36 hours, the last month or two months. Thats how they would vet those individuals. Right. So it seems as if investigators are focusing on who was in the cockpit. Theyre focusing on a person who would be expert at flying a 777, right . So they say that the plane did make that deliberate westward turn, right . And then it flew on for seven hours. We really dont know what happened, but lets assume that a person in the cockpit did this knowingly, planned it . Is there a profile of such a person . No. We cant profile an individual because of one particular criminal act. You have to go back and you have to look at, again, motivation and you break it into the category of political, religious, lone wolf, suicidal or homicidal. In that category, thats where we see a lot of the mass murderers today who feel that they have been wronged, treated poorly by maybe their employer, they have a view of the world where the world is against them and they decide to take some kind of action and they view other human beings as objects. So you look at it in terms of which one of those four categories is it most likely the person would fall into and then you go back in their background and you start looking for those themes. Well, the interesting thing, and mitchell and i were discusses this, is that these new rules, they may be new rules for Malaysian Airlines, but actually theyve been Standard Practice and procedure for a lot of domestic and International Carriers as far as making sure that the pilot or co pilcopilo never alone in the cockpit. Thats absolutely correct. How do they enforce it . As pilots we get together with the flight crew the cabin crew before the flight and we talk about all of those procedures. We make sure everybody is on the same page. Reporter the way it would work as far as if a pilot has to get up, use the restroom, wants to get a drink of some sort, then what would happen as is the case with Malaysian Airlines is senior Flight Attendant would step inside the cockpit to basically keep an eye on the other person there . Thats absolutely right. Reporter you want to make sure that they dont do any harm or do anything wrong while the other pilot is out of the cockpit. So thats step number one. The other steps that mitchell is referring to is that the whole crew is briefed on how to be secure. In other words, its not just up to the pilot and copilot. The whole crew works at protecting this very space, carol. But, still, once that cockpit door is closed, you know, and whoever is in there, the pilot, the copilot and somebody else, the people outside of that door still cant get in, right . Reporter right. Theres no question that the doors were heavily. It is impossible to get in if youre on the outside of that door. Is this an electronic lob or a physical system . Mechanical and electronical. Even with the door, there is backups, like Everything Else in the plane. You could, in essence, on the dash, there is an electronic switch to lock the door. There is also a bolting system as well. Once a person is in, any way to get them out. If he had some kind of explosive, destroy the door. It is a real problem, trying to preserve the cockpit from anyone coming from the outside in. If somebody is in there, it makes it very hard to get them out. Still to come from the newsroom, how do you haul plane wreckage from the ocean floor. Salvagers can bring up parts of flight 370. You are watching a salvage team recover a flight that went down in 1996. They are maneuvering among pieces of the twisted wreckage. The u. S. Navy has recovered an intact helicopter from 17,000 feet. They have the capability. They have done this before. Reporter retired navy captain, chip mccord, has been involved in at least 50 ocean salvage operations, including twa 100 and twit air, 111 which crashed in 1998 off the coast of nova scotia. They were both in water much shallower than the indian ocean. The navy has remote underwater vehicles designed for deep water salvage operations. They can go as deep as 20,000 feet. The deeper the recovery, the slower the process. It takes about an hour for every 1,000 feet that you need to descend. If you are going to 11,000 feet, you can count on 11 hours to get down. Reporter at those depths, it is pitch black. The underwater vehicles are equipped with lights and cameras. They are also outfitted with sonar to scout for debris. They are steer bid two operators on board the ship above who use instant feedback from the salvage vehicle cameras to direct the robotic arms. They can hover, move left, right, forward, and aft and go to where they need, very carefully carefully hover over a piece if they need to. Remember air France Flight 447, they found the debris field for the flight 13,000 feet beneeth the surface. The engines were pulled from the ocean floor. If flight 370 is found, Search Engine teams are prepared to do the same. If it is small, you can put it on a basket and rov can put it in the basket. Reporter they can only carry about 4,000 pounds. Anything heavier, like a large piece of the fuselage, will have to be attached to a cable and pulled to the surface by a crane on the ship. Keep in mind, this could be happening miles below the surface. An incredibly difficult task. Still, no doubt, salvage teams will keep their eyes peeled for the black box, hoping to get some muchneeded answers first. Randy kay, cnn, new york. We wanted to tell the story of the ocean shield as it moves out into the indian ocean. Good morning. Im carol costello. All 227 passengers on malaysian flight 370 have been cleared of any wrongdoing. Thats according to Malaysias Police chief. So far, 170 people have been interviewed as part of their criminal investigation, and more interviews are expected. There are still no clear suspects. Only the passengers have been cleared. The rest, no. The focus of the investigation remains on those pilots and those who had access to flight 370 before it disappeared. Our senior International Correspondent, Nic Robertson, joins us with more from kuala lumpur. Hi, nick. Reporter hi, carol. We are beginning to see a real focus on the crew, on the cockpit. New security rules issued by Malaysian Airlines states that the pilots cannot be left alone individually inside the cockpit. If one of them needs to leave the cockpit, they must be replaced by another senior crew member. Thats a new guideline. It shows that Malaysian Airlines is concerned about what happens, what the pilots do if left alone in the cockpit. We have heard that from the chief of police saying that all 227 passengers now cleared in this criminal investigation are describing it as a criminal investigation as it has been for a number of weeks. This is how he put it. This is a criminal investigation. It is on going. We have not gone there. We are still waiting for reports from exports overseas. So all 227 passengers cleared. We know they had been cleared previously for any connections with terrorist organizations. Now, he says they are cleared from all of them. Four areas of the investigation, from sabotage, hijacking, personal issue on the aircraft, psychological issues. It does bring the focus down. Although no one is joining the dots here, you can see it comes down on the air crew who were trained, on the captain, on the first officer, inside the cockpit here, carol. As far as we know, nothing overtly suspicious about either man. No. We heard the Inspector General of police when he was asked, well, we heard reports. Some of the reporters there questioning that. We heard reports that perhaps the captains wife and daughter have said that the marriage was in trouble. He had psychological issues, things like this. The Inspector General was very clear and relaxed about this. No, thats not the case. He said that things were fine. He is seemingly knocking that idea down. The focus for whatever is behind whatever the issues are behind the suspicion that seems to be focusing on the captain and the first officer. It doesnt seem to be at least the Inspector General is knocking down the idea of some kind of psychological issue. They have a lot more information than they are telling us. The Inspector General is saying, this is going to take a very line time. I cant tell you whats going on. One day, he said, this will end up in the court of law. There will be a prosecution. He didnt say who they were going to prosecute. It was interesting. We cant prejudice that case. Thats interesting. Nic robertson reporting live from kuala lumpur. Malaysia airlines stepping up security to make sure nothing like this happens again. They required no pie lot or fir captain is allowed to be alone inside the cockpit. They are stepping up security measures standing up the cockpit area. Renee marsh joins me from washington. Take us through the new rules. Carol, the first one you spoke about, no pilot or first officer is allowed to be alone in the cockpit. The reason behind that is, for example, if one pilot has a health issue, you always want someone who is ablebodied to be in the cockpit to fly the plane or if a pilot has sinister intentions, you wouldnt want it that person in the cockpit alone. Here in the United States, a pilot is never alone in the cockpit. Before they leave the cockpit, they have to receive verification that it is clear for them to come out. When they do come out, we know that the door is blocked. If someone is at the cockpit door, for example, and wants to get in, the pilot must make a visual contact through that little peep hole before opening the cockpit door. We also know that in the United States, pilots dont get served the same meal in the event, lets just say, the chicken thats being served is tainted. Each one is going to get a different meal if they are in the cockpit. Here in the United States, the Security Program is pretty robust. It has been since 9 11. We saw the hardened cockpit doors. As far as we know, they have never been breached. In addition to that, you have crew members that receive selfdefense training and there are thousands of federal flight deck officers which essentially are pilots that are armed. Thats a voluntary program. Add that to the federal martials that are also on board many flights. Carol . All of these rules went into place for American Airlines and other airlines after 9 11. The entire world was paying attention at that time. It makes you wonder why malaysia didnt institute these rules right after 9 11 happened. I was speaking to one pilot, former 777 pilot today. I wanted his perspective on this. I said the same thing. Although 9 11 didnt necessarily happy there in malaysia, it still happened. So it was very much a part of the history of aviation as far as incidents go. The only way to characterize this is simply it is disappointing that at this point, now, is when these rules are being put in place. These are rules that are very helpful, make a lot of sense but they are just happening now for Malaysia Airlines, carol. Renee marsh. It is disappointing. Renee marsh, reporting live from washington. The investigation into flight 370 has been filled with missteps, among them, the early briefing, who was in charge. The change in what we know now were the final words from the plane, good night, malaysia, 370, wasnt all right, good night and the delay in searching the southern indian ocean. Joining me now, tom fuentes. Welcome back. Good morning, carol. First of all, lets start with this. Malaysian investigators say all 270 passengers on the plane have been cleared. Are you surprised . Yes, a little bit. You are talking about investigation and working Different Countries where all different people were from and relying on their police to do the interviews and family members and everything from those countries. So i was a little bit surprised. But at least thats what they think. They said again they are focusing their investigation on the two men in the cockpit but as of yet, nothing overtly suspicious has turned up. Thats right. Nothing has turned up. Every rumor, as Nic Robertson said earlier, every rumor about the wife or children or other people saying things were false. They were not true reports in the first place. None of them have said anything negative yet to the police. You will notice in the report this morning, the Inspector General of police did not clear the crew. You do have still Flight Attendants and crew members that they are still looking at. They did not clear ground personnel that touched that airplane and serviced it, handled the luggage, cleaned the airplane, all the other people. Clearing the passengers is one thing. They havent cleared anybody else. What goes into clearing someone in a possible crime like this one. What we are used to here in my experience is you would be cautious about the term, clearing someone. There have been incidents where a perfectly normal person had some type of a mental attack and did something bad, either made a threat to the airplane or caused the pilots to land immediately because he told the Flight Attendant he had a bomb or was threatening other passengers. We have had cases where passengers have attacked a pilot or a copilot with a hammer in one case killing him and then killing themselves. In those cases, there wasnt a prior episode of Mental Illness to make you think that person was going to do that. To clear everybody, you could say that we just have yet to find anything negative and the passengers, same thing, nothing negative. Actually, to clear them is a pretty strong term to use this early in the case. We have a graphic of the missteps that malaysian investigators have made through this whole thing. Chaos in the early briefings, holding out hope of survival that maybe somewhere the plane landed and passengers survived. They have just said that yesterday. Changing the final words from the pilots, that last transmission between air Traffic Control and the pilots. Confusion over who spoke those final words. We dont know if the pilot or the copilot said, good night, malaysia 370. And the search zone switches. They were depending on satellite information and they switched over to radar and found out it is the southern route, and not the northern route and they are searching in the southern ocean. What was the misstep . From the beginning, the misstep was with the malaysian officials running this case. You have the police on one hand. You have the Civil Aviation authorities in malaysia. You have the Defense Ministry in malaysia and then the neighbors countries and their radars and their systems and the satellite company. You have many things going on at one time and it is being run by really at the top a group of individuals without the experience. What we have found in these kind of cases is that you need to train your executives in the first place how to handle a crisis, how to set up a command post and almost equally as importantly how to convey the progress in your case to the public. The Media Management of it. From the beginning, when they decided they are not going to reveal information until it is confirmed, nothing is confirmed. 26 days later, there is nothing confirmed. Holding out until confirmation means no information. It creates a vacuum and an added mystery. There is already enough mystery. It created the aura of confusion. Where information is done diligently, it would not appear to the public. When you are trying to bring in different experts, including the United States and the british and the french and chinese and others, it adds to the need to try to coordinate something from a group of people that have not had the experience or training to do it. You are welcome, carol. General motors, ceo, mary barra, facing a separate day in the hot seat. Trying to explain why her company waited more than a decade to recall cars it knew had been linked to deadly crashes. We will see the subcommittee coming together. Joining me to discuss it right now, cnn Global Economic analyst, ronna faruhar. General motors may have known about this defect as early as 2001. Barra didnt explain how that could have happened when she testified yesterday. Why . I think she is telling the truth when she says she doesnt know. The most explosive part of yesterdays testimony was the email from 2005 where an engineer basically admitted there was a problem with the ignition switch. But it could cost 90 cents a switch and 400,000 to put in a production line. Skin crawls when you hear there is a mon i tie zation of human life like that. She didnt know but how high up did this decisionmaking process go. It is mindboggling to me. Mary barra has been in place for three months. Why not call someone who has been involved longer, the old ceo, dan acreson or engineers that worked on the cars. I couldnt agree more. I think you may get to that stage. We are just at the beginning of all of this. This is a g. M. Problem but this bean counting and sort of management but numbers is something that has been within the Auto Industry for decades. You can look back to robert mcnm mcnamara, who was a wiz kid and bean counting and cutting back on quality. This is an issue that has plagued the Auto Industry. Mary barra is trying to say, we are the new g. M. It is going to take time, regardless. Things are looking pretty grim for General Motors. Millions of cars can be recalled, which could cost the company more than 1 billion to handle. Just left government ownership. Could this whole scandal break the company . If you look back at history, companies do a lot of recalls. What happens is, you need to do them all at once and you need to get out in front of it. If you let things go in drips and drabs and do recalls over the course of a year or two as toyota did, thats when you start to lose and see a more severe impact longer term for the company. One thing thats interesting, after mary barra testified on the hill, the stock price went up. The markets are confident in here. How confident they will be in g. M. After all the facts come out remains to be seen. They are going to swear the witne witnesses and make their opening statements. Ran na far rue har, thanks for your insight. First, breaking news out off the u. S. Supreme court. A 54 ruling, the court struck down current limits on the total amount individual individuals can make to Political Campaigns. This decision may have an Immediate Impact on novembers congressional midterm election. It is a blow to federal election laws. Our senior analyst, jeffrey toobin, is here to explain. Hi. Explain this ruling and why the Supreme Court justice has decided this way. This is part of a series of decisions that the Supreme Court has engaged in about the First Amendment rights to give money to Political Campaigns. The most famous of these decisions in 2010 was the citizen united case. This expands the case. It says that individuals have a First Amendment right to give as many different Political Campaigns as they want the maximum amount of money. There used to be an overall limit of how much money you could give to individuals, to individual campaigns. Now, there are limits you can give to one campaign. You can give to as many campaigns as you like. Doesnt that give wealthy donors a big advantage . Yeah, thats exactly right. Thats why wealthy donors were behind this case. What the Supreme Court has said is that the First Amendment protects the right to give Campaign Contributions as a form of speech. The heart of all these decisions, like Citizens United or the mccutchen case, which is what the name of this case is, is that giving money to a Political Campaign is an act of speech, which the government can regulate in only very limited circumstances. Obviously, a lot of people disagree. Money, they say, is not speech. Money is a lot different. Money is money but the Supreme Court of these five justices, a 54 decision saying that money is speech and thus cant be regulated, at least very much. These rulings continue to surprise me, only because so Many Americans are concerned about the money factor with who gets elected to public office. They think it is a real problem. These kind of rulings seem to only exacerbate those problems. Chief justice john roberts, who wrote todays opinion, you could see particularly at the beginning of the opinion addressed those concerns. He said, a lot of people are unhappy about all the money in campaigns. We have a First Amendment. That trumps any other kind of law. We give freedom of speech to people that engage in hateful speech. We have to give freedom of speech to people who want to give to Political Campaigns. Now, before the setting justices led by Justice Steven briar said in effect that is all a bunch of nonsense. Speech is not money. That is not speech. This should be regulated. But, they only have four votes. Thats us. Now, we know corporations are people and money is people too. Money is speech. Thats the heart of this opinion. Corporations are people of Citizens United. The heart of todays opinion is that giving money to a candidate is like speech. A lot of people disagree with it. At least five people are dead after an earthquake, a big one, struck off the coast of chile last night. This was an 8. 2 magnitude quake. It triggered landslides, knocked out power and caused extensive damage. It also set off a tsunami sending sevenfoot waves crashing on to shore. It could have been a lot worse if the quake had struck on land. It would likely have been devastating. I am joined by kate hutton. Welcome. An 8. 2 quake, you cant get much stronger than that, right . Well, actually, chile has the record for the largest earthquake since the size mom ter was invented, which is 9. 5, which is quite a lot bigger than 8. 2. Still, 8. 2 can be a very damaging earthquake. Fortunately, in one way, it was offshore the so no one was sitting right on top of it. The other side of that is that offshore quakes cause tsunamis. So thats a concern. What if the earthquake had struck land . The ground shaking would have been stronger. More buildings would have been damaged and there probably would have been more loss of life and property damage. I was stunned myself. The chileans were pretty calm throug all of this. There was no panic. If you look at the map behind me, you will see all the magnitude 8 plus earth quakes that have occurred in the last 140 years. They are very used to these earth quakes there. They do i a lot of drill activity and panic is not on the list. Why so many earthquakes there . It is because two very quicklymoving plates, in other words, up to five inches a year, which is fast for a tech tonic plate, are converging. The naska plate is underneath the south america plate. Because it is so high, they have earthquakes so often. We have just had several quakes in california. Now, this big one in chile. There was an earthquake in yellow stone. Is it just coincidence or is this something you expect as a scientist . Well, if it is not coincidence, it is very low in the noise. The most obvious aspect of earthquake activity is that it is random, if you look at the longterm. If you have a magnitude earthquake somewhere and you look around, there are magnitude fours and fives all the time. This happens to be in a populated area. It is armed with the u. S. Navy ping locator and an underwater robot. Paula newton is tracking the journey of ocean shield she joins us now. Hi, paula. Reporter hello, carol. That ocean shield is supposed to be on the scene in the search air why in less than 24 hours. The problem is that search zone has not been narrowed. A british submarine, the hms tireless is close to the scene as well. The planes have returned from tonight. We expect them up in the air for the next few who are. They had changed the search zone. It is closer to shore and further to the east. This has a lot of people questioning about whether or not they have already completed the other search zone. What that means for the likelihood of them finding something any time soon. I was just going to ask you if there is any way to narrow that search zone any more. Any new information coming by, a satellite or radar . Reporter we did try to ask them or see if they had any new information. They did not say they were able to narrow that search zone but to say from march 28th to april 1st, they had basically completed the search area. They had done an exhaustive search and hadnt found much that was of interest. You wonder now where this search is going. We hope to hear more in the next few hours. The malaysian Prime Minister is here on the ground in the next couple of hours. He has a tour of this base and oneonone talks about the Prime Minister of australia and the people running this search. We hope in the next few hours, we will have a little more clarity about where they are searching and why. Paula newton reporting live. Malaysia is reaching out for more u. S. Military assets in the search for that plane. Their quest is coming on the sidelines of a meeting of south asian defense ministers in hawaii. Defense secretary, chuck hagel, is hosting that meeting. The malaysian minister, even before he left for hawaii, said he was going to ask chuck hagel for more military equipment for deep sea search and salvage. Not clear what he this is thinks he is going to be asking for. Hagel said he will consider any request. The problem remains getting the debris field narrowed down before any of this can be used. When they scheduled this, nobody could expect this would be a major topic. On the way over to hawaii, hagel talked to reporters on the plane about exactly what he thinks needs to be talked about here. Like any of these tragedies, we dont yet know what happened. There are always lessons to be learned, what could have been done, what should have been done, what needs to be done better. Coordination is a key part of this. Supreme court struck down the limits on how much an individual can donate to a Political Campaign. Our chief congressional correspondent, dana bash, is on capitol hill with reaction. First of all, explain this ruling to our viewers. Right now, there is a limit on how much an individual can give across the board in a campaign cycle. Right now, the limit is 123,200 for this election cycle. The Supreme Court reading of this is that that limit is no longer. So if john smith out there wants to give more than that and wants to give to candidates across the country, he is able to do that, because it will likely bust through that cap. That cap no longer exists. However, there is still a cap, it seems, on how much john smith can give to a single candidate. So if john smith wants to give to a president ial candidate, he is Still Limited in how much. If john smith wants to give to a congressional candidate, there is still a limit. What is not limited anymore, thanks to this ruling is the overall amount he can spend. He can spend money on congressional races all across the country, where as before he couldnt do that. Political ramifications. What are people saying on the hill about this . We already have reaction from the Top Republican on capitol hill, the house speaker, john boehner. He is very happy about this. Republicans for the most part have thought that limits really stifles free speech, which is what the justices that voted for this agreed with. Here is what the speaker said about it. What i think this means is that freedom of speech is being upheld. You have the freedom to wrigte what you want to write, to give what you want to give. We have not heard officially from democrats on capitol hill but by and large, their point of view has been that there should be limits because the flood of money into campaigns is a detriment. That is why there was a bipartisan push. Mostly on the democratic side to do the mccain, fine Gold Campaign and finance law, which this Supreme Court ruling strikes down another part of it today. Also, just kind of, you asked about the political ramifications, bigger picture. You have seen after the Citizens United ruling a few yearsing ag which allowed a flood of money which spawned these superpacs, unlimited money, millions and millions of dollars into outside groups. There has been a lot of frustrations among candidates, because they have felt that they certainly. When the money is coming their way. It tends to help them. There is also a limit in how much they can control their own message and campaign, because they cant get on the air waves with their own things they want to say, because these outside groups are coming in and blanketing the air waves with things that take them off course. This ruling might add to that. It puts more money into the Campaign Year but it is a little bit different because there still is that limit on individual campaigns and individual candidates. We were talking about these new rules and what we were discussing is the fact that Malaysian Airlines has been a bit behind the curve when it comes to these practices. Other carriers do it, right . Ever since september 11th, they have been doing this. The idea is that so one copilot is never alone in the cockpit, because we have seen in previous incidents where it is possible that somebody could do a great deal of harm by themselves. They wait for that opportunity where they are alone and they do whatever they want. We wanted to point out something thats on this particular aircraft, carolyn and located in the cockpit. It might be just out of view. It is actually a locking mechanism here. It is simulated but it essentially is the control for automatically locking and unlocking that door. Thats correct. We have an electronic key pad and the crew dials in a code and we get time in the cockpit an after a certain amount of time, a certain amount of seconds, if we dont do anything about access or deny access, the door will automatically open. So, in other words, the pilot, who may be in here with a Flight Attendant or a senior flight crew member, could hear someone coming back in. If for any reason they suspect that person coming in now doesnt have a good intent, then they can actually deny. They can lock the door and lock someone out. So its a very complicated system and there are many other security measures we wont go into that are done to protect the cockpit from those inside and those trying to get in from the outside. Im going to ask you this question. If a pilot really wanted to sabotage the plane, is there really anything that could stop him or her. If it was the pilot, at that point, if they are in the cockpit and the door is locked, they have the ability to lock the door, sadly, though. There really is not much. There are selfdefense tactics that are taught to crew members so the copilot, of course, you would expect a struggle. If that copilot has been incapacitated, carol, you are right. It is a real problem once there is only one person now at the controls and the door is securely locked. This is why you do strong background checks and Mental Health background checks. Thats right. Investigators in malaysia came out and said they have cleared all 237 passengers on board that plane. Does that surprise you . Well, no. It takes a long time to do that many people. Clear that many persons and do their backgrounds and check all sorts of things out about them but if they have been working diligently, thats good. That was a lot of work. Its good that was done. What remains to be done is to clear the pilots and the crew. The investigators said, we are going over every little thing. Please dont hurry us. Were working. Do you believe him . I do. I think they got off tie very slow start. But there have been little clues that have come out here and there. Some things are just contradictions. For example, at first, we heard on the transcript they had originally said it was the copilots voice. Now, they say they are not sure. Thats a pretty easy thing to check. You just find people that know their voices and work with the pilot at 18,000 hours. He must have worked with a lot of people. For that to still be a mystery is rather odd. You can tell they are looking at things and reexamining things, thats good. The problem is, by ruling everything out, no evidence doesnt mean you have evidence of a crime. So they are going to have to keep looking until they can find a motive and find a crime. Right now, they dont have one. Lets go back to those new rules that malaysia put into place regarding the cockpit, that the pilot and copilot can never be left alone in that cockpit. Somebody has to be in there until the other pilot returns. Should we read anything into that beyond their just improving their Safety Measures . I think the most important thing to read into it is they are playing a little bit of catchup. While they are not federal regulations, they are guidelines, rules followed by most of the airlines in this country. It has several reasons for it, not just for security reasons that if somebody is bent on illwill, bent on criminal activity in the cockpit, you have a second person there. There is also a practical reason. There have been questions where one is out or in and others have been taken ill, in couple cases, a pilot has died in flight. Recently, we had cases where a pilot locked himself out of a cockpit. It is kind of important. We have the twoperson cockpit rule. Two people in the cockpit at all time. It makes sense. It is common sense, Good Practice and good security. I think malaysia air is catching up with some of the worlds airlines. So you have been following this case closer than anyone, i would guess. Do you have any theories at this point as to what happened . Oh, well, sure. There is no shortage of theories. I try to look at whats most likely. What do the previous accidents tell me . What do the facts and statistics tell me. The facts and statistics tell me most of the time what you find is there is some sort of a mechanical problem, a failure, a catastrophic event. Quite often, what the ntsb says, is that the pilots have not been trained to adequately respond to that event. I suspect thats it.
