through indianapolis on august 13th as the country duo sugar land was about to perform. seven people died. dozens were injured and today's report should tell us who and what is to blame for that rigging to give way. we're also going to hear from the country stars. they will finally answer questions about that fateful day. we'll have a live report later in the hour. trayvon martin's mom is now calling what happened to her son an accident. listen to what she said on the "today" show. >> one of the things that i still believe in a person should apologize when they are actually remorseful for what they've done. i believe it was an accident. i believe that it just got out of control and he couldn't turn the clock back. >> and in just a couple of hour, george zimmerman will face a judge for killing trayvon martin, charged now with second degree murder. he turned himself in yesterday. after his first two lawyers quit, it's now up to this man. >> i did think that that was the certainly the highest charge i ever thought they would charge. it seemed like it might be a manslaughter, but again, i don't want to prejudge something. let that come out the way it's supposed to. >> zimmerman's hearing will take place at 1:30 eastern time. we'll bring you live coverage when it happens. an oil sheen ten miles long and a mile wide is floating in the gulf of mexico. it's situated about 130 miles southeast of new orleans between two of the royal dutch shells drilling rigs. the company says there's no indication either is responsible for that oil spill, so that leaves the question, who is? a special skimming vessel is on its way to set boons and start clegting that oil. the sort of scandal that ended john edwards' political career starts playing out in court today. jury selection is getting underway. he's facing six felony and misdemeanor counts relating to the alleged misuse of campaign cash during the 2008 presidential campaign. one issue sure to come up, whether money given to his mistress by edwards' supporters were considered donations. he could face up to 30 years in prison. hunter is expected to take the stand. connecticut will soon become the 17th state to abandon the delt penalty. state senate approved a measure last week. the governor, a democrat, said he'll sign the bill into law. he told me why he thinks it should be outlawed. >> there are in number of reason, not the least of which is research that demonstrates many people have been put to death improperly in the united states. and that there are distinlgt racial biases in the use of excuses. >> only one person has been executed in connecticut since 1976. all eyes on north korea as the first opportunity for pyonyang to launch its rocket. they're ready to shoot it down if it enters japanese air space. they say it's necessary to put a weather satellite in orbit, but the u.s. and other countries believe it's just a cover for a ballistic missile test. syrians woke up to a sound they haven't heard in a long time. silence, for the most part. the cease fire appears to be taking hold. he says he's encouraged. instead, you're going to find protests like this one, in which the people promised not the break the peace. the government reports a terrorist bomb that killed one person and wounded two dozen. a shil hit a market in homs. the condition of the cease fire in minutes, live update from ivan watson. >> she's being called argentina's miracle baby. she is now in stable condition in intensetive care, but when she was born three months premature, doctors pronounced her dead. her body was put in a coffin and sent to the morgue, but at night when the grief stricken mother went to take a look at her for the very last time, she says a miracle happened. she found her alive. >> she touched her little hand. she then uncovered her face and that's when we heard the first cry. >> unbelievable. her parents, of course, are naming her luz milagros. spanish for light and miracles. can fusion and panic, that's what you can hear in the newly released 911 tape from the night whitney houston died. the guard tells the dispatcher that another woman in the room called for help, but was quote, pretty much out of it. >> she was not breathing? >> now, it's up to this man to defend george zimmerman. straight to martin savidge who is outside the jail. what's expected to happen at today's hearing? >> reporter: this is what they call first appearance. a fairly routine kind of procedure. it will take place inside a classroom located in the corrections facility and zimmerman will be the first of a number of arraignments today. the judge is going to read the charge against him, which is second degree murder with a weapon and then on top of that, could get 25 years to life if he were to be found guilty. it's expected he's going to enter a plea of not guilty. the judge will be some place else. it will be a video link that links to two together. >> how difficult do you think this is going to be? as you talk to your sources and all the lawyers involved, you know, to prove second degree murder? >> reporter: it's going to be tough. many people were surprised first of all by the seriousness of the charge. i don't want to say it was overreaching, but some have mentioned that. manslaughter, we've discussed this before, was the one most thought was going to be the original charge, so this is a tougher charge. it's got a potentially tougher punishment as a result and proving it is going to be hard and we're a long away way from that. you're going to have to see if he comes out on bond, but then there is going to be whether there is a hearing that determined whether or not the stand your ground law applies. so, we're a long away way from this getting to a trial and there's a lot that could change it. >> what about security for zimmerman? there's been talk about him possibly being in an isolated area. >> right. his attorney said this morning he is isolated for the time being. whether it will continue to be that way, we don't know. the attorney wants to get him out on bond. one for his mental well being and two, i think he wants to start working on their defense. when he comes out, there is going to be the issue of safety, so will there be a protective custody? will he go into hiding? all of this is being talked about because there are real serious concerns for his safety. >> how is the community reacting? >> reporter: i'm sorry. repeat that one more time? >> how's the community reacting? protesters have been gathered outside the course, around the homes. what's the response be there to this? >> reporter: you know, it's kind of a muted response cht i mean, those that wanted to see and were demanding they see justice, an arrest, are pleased, but not celebrating. those that support zimmerman and believe he acted in self-defense are not pleased. overall in the community, i guess you could say there is a sigh of relief only because it is hope that as a result of the legal process now engaging, that a lot of the rhetoric and emotions will begin to dissipate somewhat. >> martin savidge in sanford, florida. thanks so much. so, in light of everything that's happened in just a past 24 hours and a lot has. let's get more perspective from paul. s he was charged with second degree murder. were you expecting this? >> no, i was surprised. i think most people have looked at this case thought that the prosecutor would charge manslaughter. the thought was this wasn't a planned or intentional murder, but the prosecutor has charged a subsection of murder that theer etically believes applies. she's taking a tough, tough approach right out of the box in charging such a serious crime. >> do you think she overcharged zimmerman? >> you could argue she's made a difficult case for herself in front of a jury pause she has to prove that this wasn't negligent or wreckless killing, however, prosecutors do this all the time because sometimes, they think they're going to get a plea. if he's looking at life, if he goes to trial, maybe if he pleads to manslaughter, maybe he gets a lesser sentence. this is not unusual for a prosecutor to slightly overcharge a case nin order to try to get a plea. >> what do you think his strategy should be in the courtroom? >> he has been very timid almost in his approach. usually in these particularly the high profile cases, defense attorney comes out says my client is innocent. it's an outrage he's been charged. his press conference, he says i have great respect for the prosecutor, i don't know what the evidence is. maybe she had a good reason for char charging murder. this is an unusual approach. obviously, he's made a decision in which to bring the temperature down in the case and i think one of the things he's planning is to focus on what we call the immunity hearing or stand your grand hearing where he's going to convince a judge to toss the case on the grounds that zimmerman acted in sel self-defense. i think he's probably trying to stay in good with the judge by lowering the temperature. >> even listening to his interview, he said i've got a lot of things to go over. catch up on the evidence. how quickly, look at how much there is. facts and details. that has gotten international publicity. how fast can he move without missing any kind of important, you know, fact or detail? >> well, the one thing he has in hand is he's met with zimmerman and i would presume that if zimmerman acted in self-defense, that he knows it's going to be the defense in the case, so there's no mystery there, so i'm a little surprised he just didn't come out of the box and say this is a self-defense case and we're going to defend aggressively. however, with respect to your question, we don't know how extensive the prosecutor's investigation has been. how many people did she interview. what forensic evidence is there. for instance, i haven't seen anything about whether trayvon martin had powder burns on his shirt or chest if he was in close proximity in a fight, that would be there. that would be an important piece of evidence. that's the example of a piece of evidence we don't know anything about nor presumably does the defense attorney. there's a learning curve here and it's going to take a little while for him to get up to speed. >> thanks so much. only scattered gunfire reported today in syria. is the u.n. cease fire trying to take hold? ivan watson live from the board, next. the cease fire in syria appears to be holding, but it's a minute by minute situation. for example, this video coming in from homs shows a shell landing in a neighborhood just after stopping the violence cht it fits a familiar pattern. the government also reports a terrorist bombing that killed an officer and wounded 24 people. ivan watson is live in turkey. key player this this crisis. so explain where you are now. >> reporter: well, i'm in front of one of the refugee camps on the turkish, syrian border wrrks some of the 25,000 refugees who have fled to turkey to escape their own government are currently liveing in tents like this and just to give you a sense of location, right over here, almost more than a stone's throw away, there's a border fence there of barbed wire and that is the syrian border. people have climbed through that fence to escape their country. there's a little guard tower, a turkish border guard tower nearby and we've watched some refugees today just crawling through holes in the fence going back and forth to do things like forge for herbs for oregano in the hills right there and we know that some of the residents here are actually volunteer fighters who told us they've come from the ref gee camps. >> so, ivan, just to bring it back to al assad, how do you think this is all going to play out? we saw what happened with gadhafi. this is in many ways, very different dynamic. you know, can he top this out with his army? >> reporter: well, it is very difficult. different. because in the libyan case, you had a number of high ranking defections. you had the second largest city in the country fall into the opposition hands immediately. we don't have a major city like that that's gone into rebel hands. you don't have high level defections and you don't have western governments offering assistance in the form of a bombing campaign. instead, here, you've got desperate civilians who fled their country. they have maintained protests now for more than a year after the deaths of more than 9,000 people. they are increasingly trying to arm the opposition. today's peace plan and relative cease fire where we've seen the quietest day in syria in months, really, going from more than 100 people killed a day to now perhaps three to five people killed. that's a remarkable change. it is a big test on whether it's possible at all to hammer some kind of political transition in the future. i do know the opposition and many western governments do not trust that al assad and his government will stick with this cease fire plan. >> thanks. remember these chilling pictures of an irs building on fire after a plane flew directly into it? >> stories that were basically in the headlines, that the people knew about, like my relationships with my wife and my conviction, my upbringing, the death of my mother and my sister and just who i was as a child back then and who i am now. i thought that would be something awesome because it's just incredible once i see these pictures of me in the past and i was this fighter guy, this baddest man on the planet kid, whoever you said i was and the transformation to who i am now, that's pretty weird. i look at myself now and say, wow, i would be nervous to be in a room alone with that guy. >> what was the turning point for you? >> many calamities that make, well, listen, i had a 4-year-old daughter. all of a sudden, she dies without people can't explaining. the doctors can't explain it. some freak accident, right. >> something happened on a treadmill, right, mike? >> yeah. give me a break. 4 years old, what can happen on a treadmill. i left that alone because i didn't want to go to the really dark side of it. i just wanted to change my life, be the opposite of what i was before. just wanted to kill that life the best i can. >> you call your life sick. you say you're a sick guy and that you're still fighting demons. what demons are you fighting? >> just do the right things in life, you know, to be a good husband, a respectable father. it is just a struggle, but i'm willing to take on the struggle single handedly. >> what's your biggest regret? >> i don't know. too trustworthy and wondering -- i wasn't focused enough. >> why not? >> i don't know. i was too concerned with just life. i deprived myself of so many years to try to reach to this crescendo of success and it didn't turn out the way i wanted it to. >> do you miss boxing? >> no. >> really? >> i could never be a part of that world no more. burned too many bridges. the boxing world, you know, that i was a part of, they never really liked me, if i wasn't doing anything that really benefitted them. maybe the boxing fan, but the boxing fraternity, i don't think i'm a mixed guy. i'm not really a big shot there. for political reason, i'm sure. >> interesting. you, this is such a different mike tyson than i've talked with. in the past. you talk about the death of your 4-year-old daughter. i can't even imagine going through the death of a child. but what else has happened that has made you i guess we should -- maybe is it okay to say a softer guy and why are you okay with that? >> i don't know, i'm just, just trying to figure my way out here in life. sometimes, you're lost in life and you have to find this kind of i don't know, paradigm shift. and you realize everything you learned in life, that was your survival mechanism, was pretty much a lie and you made it pretty much on luck alone, you know. >> wow. is there one person, one thing, that you would say has given you this strength? i mean, what is it inside you that is pushing those demons away and trying to maintain this new look, this new spirit, i guess? >> not really a look or spirit. it's just, you know, rationalization and knowing the boundary. i realized if you not humble in this world, this world will thrust humbleness upon you. >> let me ask you before i let you go because it really caught my attention. i'm hearing this side of you, yet i saw this tweet. you spoke out about trayvon martin and george zimmerman. it said it's a disgrace george zimmerman hasn't been shot yet. those are are pretty harsh words advocating murder for someone who's a bit of a changed man, it sounds like. >> no, i'm talking about people that, what he did wasn't right. you say you don't know what happened, this guy -- the police asked him to lay back, he disobeyed the order from a superior, went and killed this kid any way and you're going to say that's harsh. i'm only a human being, too. then he said this kid -- this kid was scared of his life. this is a child. a 17-year-old child. i don't care if he's black, white, candy striped. race is a big thing in this country, but that was just overtly wrong and then the slap to society in the black community in the face and then a slap in the human community saying that was self-defense. whatever your law, stand by your ground. he was on the run. this other guy stalked him, follows him. i don't have to be a rocket scientist to see what happened. we know what country we're in and this is what happened. we have evil people all over the world. this is what happened. this is the world we live in. >> mike tyson. the undisputed truth, the show opens at mgm tomorrow, correct? >> yes, yes. >> let's see how it goes. we'll be looking forward to see how you do. >> thank you so kindly, ma'am. >> you bet. parents of toddlers or infants could be putting their child in jeopardy every time they get in the car. how natura answers both at powerincooperation.com. time to go to stories making news at street level. columbia, south carolina where governor nikki hailey is facing an ethics inquiry. a democratic party employee complained her campaign incorrectly reported more than $1.3 million in con bugss and failed to list the occupations and addresses of some of the dono donors. the lawyer calls it a ree teen matter. she could face fines of up to $2,000 for each violation. michael bloomberg is blasting the national rifle association saying it's reasonable for the stand your ground laws. >> all americans already have a right to defend themselves with a measure of force, but these shoot first laws have nothing to do with that or with the exercise of second amendment rights. instead, they justify civilian gun play. >> he is starting a national campaign to repeal the laws, the nra has not responded. now to chicago where a new report shows homicides were up by 60% in the first three months of the year. police department stats showing nonfatal shootings are also up. according to the "chicago tribune," this started late last year. between january and april, 120 homicides were reported. up from the 75 reported cases in 2010 and 2011. plus, there were nearly 500 nonfatal shooting, up 37% from the year before. they say police are blaming the violence on gangs. let's head west to the university of california in davis. state officials now slamming the university for a pepper stray incident in november. campus police r were recorded on tape spraying pepper spray on a group of occupy protesters. police prayed them at point-blank range. they were criticized saying the police actions were objectively unreasonable and says the incident could have been prevented. you've heard of state s weighing in on same-sex marriages, but in maryland, the court is set to issue a ruling. jessica married her partner in 2008, when the state was issues marriage licenses. we, they filed for divorce two years later in maryland. at first, the judge said the state could in the recognize the divorce. last month, governor o'malley signed a law. this goes into effect january 2013. now to the university of michigan where a new study takes a look at the difficulty of installing child safety seats. the lax system of anchoring car seats was supposed to make it easy to install. by the way most cars are designed, it does the opposite. the insurance institute for highway safety conducted that study. in washington state, neighbors watched as house and its horrifying memories were demolished. josh powell blew up the house killing himself and his two sons. it's not known what happened to the property, but neighbors say they would like to make it into a private memorial. political fire storm brewing in the race for the white house and this time, it doesn't involve president obama or mitt romney. fair game is next. ♪ thanks, but no thanks, says axl rose. apparently bad blood among the bad is the reason he will not attend the band's induction into the rock 'n' roll hall of fame. in a lert he wrote the l.a. times, he said the ceremony isn't a venue he would be wanted at or respected, so says i strongly request i not be inducted. this decision is personal. his feud with other band members is well-known. slash even telling "rolling stone" magazine he hates my guts, but to snub one of the biggest honors a rocker could get? [ male announcer ] aarp is bringing the conversation on medicare and social security out from behind closed doors in washington. because you've earned a say. not quite knowing what the next phase was going to be, you know, because you been, you know, this is what you had been doing. you know, working, working, working, working, working, working. and now you're talking about, well you know, i won't be, and i get the chance to spend more time with my wife and my kids. it's my world. that's my world. ♪ the teacher that comes to mind for me is my high school math teacher, dr. gilmore. i mean he could teach. he was there for us, even if we needed him in college. you could call him, you had his phone number. he was just focused on making sure we were gonna be successful. he would never give up on any of us. well, mitt romney's wife has gotten pulled into a bit of a political skirmish and now is speaking out. also speaking out, rolen martin and chris mets lehr. okay, let's start off with what hilary rosen said about mitt romney's wife. >> his wife has actually never worked a day in with the kinds of economic issues that a majority of the women in this country are facing in terms of how do we feed our kids, how do we send them to school, and how do we -- and why do we worry about their future. >> this morning rosen returned to cnn and said this whole thing is about mitt romney, not his wife. >> this is not about ann romney. this is about the waitress in a diner in, you know, some place in nevada who has two kids whose daycare funding is being cut off because of the romney/ryan budget, and she doesn't know what to do. this isn't about whether ann romney or i or other women of, you know, some means can afford to make a choice to stay home and raise kids. >> then just last hour ann romney said this on fox news. >> my career choice was to be a mother, and i think all of us need to know that we need to respect choices that women make. other women make other choices, to have a career and raise family which i think hillary rosen has actually done herself. i respect that. that's wonderful. but, you know, there are other people that have a choice. we have to respect women in all those choices that they make. >> so, roland, let's start with you. hillary rosen has definitely managed to unit republicans and democrats. they all disagree with her. sproo s >> she screwed up. he's a lobbyist, this communications expert, she's supposed to be a pr guru, and she knows you never change a story. you don't give the opposition an in. so her comments allowed the gop to switch the conversation to make it about ann romney. she looks like the victim. mitt romney can come out and say don't attack my wife, and i guarantee you if a gop surrogate had made this kind of comment regarding a democrat, hillary rosen would be telling them the exact same strategy the republicans are using right now. she knows this game. this is a part of the game in politics. >> chris? >> well, yeah. roland is absolutely right. in addition to which i did not know that ann romney was actually on the ballot. i thought it was mitt, and i thought it was mitt romney that was going to be the nominee. look, in this particular case what has happened is she has turned around the phantom war on women that the democrats say republicans have. she's turned that around, and so now here is the opportunity to build a narrative that talks about that, in fact, many democratic women believe that you can be a woman so long as your like them. thanks, we appreciate it. >> first of all, there's no such thing as a phantom. the bottom line is when you look at some of the issues that are out there, if you're a women, trust me, the issue of contraception is really not in chris or my, frankly, right down our alley. but the bottom line is there are some critical issues here. you look at the polling data about the gap that xiss between president obama and mitt romney when it comes to female voters, that is critical. but, again, if you're the democrats, when you have your opposition on the ropes, you don't throw them a lifeline. hilary threw them a lifeline. >> you said she is not running for president, mitt romney is. but here is what's interesting. there's been so much criticism about mitt romney not being able to relate to people. where is that soft side of mitt romney? where is that side that i can relate to? that's what people are saying. so ann romney comes out and everybody says, wow, this woman, i can relate to this woman. listen to her speak. he brings her out at all his functions and says but first i'm going to have my wife kick off this event. so, chris, you know, she has become a very popular player in all of this, and people look to her. >> yeah. and she's actually an excellent surrogate. and, you know, pretty much what she said i think in this message is, look, i look at my own mother who was a stay at home mom and can you imagine raising me? that was difficult. so as a result of that, we now have someone -- >> think of roland's? that's a whole other issue. >> that's a whole other conversation. >> i tell you right now, my mom is retired and is loving living in my house, so she loved it. back to kyra. >> oh, boy. i'm going to be having a conversation with mom but that's a whole other story. >> i think what she's done as the surrogate is to say there's a softer side of mitt romney. he is actually a real person, and so this is really, really excellent because it gives us the chance to humanize him, and if you have noticed what he's done in terms of the gap that roland has been talking about. yeah, there is a gap between president obama and romney relative to women -- >> a huge gap. >> there is a gap, a huge gap, no question about that. what he's been doing if you notice at his speeches, et cetera, what you've got is a number of women now being present. this helps the narrative quite a bit. and we thank you, hilary. >> do you want one more thought? >> real simple. you never attack the person, you always go after the policies. that was the mistake. i think hilary understands that, and so frankly you move on. if i'm her, you get off the stage. let other people focus on the policies and you no longer become the lightning rod. that's what you do. >> allen west, you know, love him or hate him, you're usually going to get a headline when this florida congressman talks. one day he's being called a loose canon, the next day sarah palin is saying he should be the vp of this country. today i will just say he was loose canon day. a constituent asked him how many members of congress are, quote, card-carrying marxists. here is what he said. >> i believe there's about 78 to 81 members of the democratic party that are members of the communist party. >> okay. in case you couldn't read the next. he said i believe there's about 78 to 81 members of the democratic party that are members of the communist party. chris, you're there in d.c. have you seen any communists today? >> that's correct. >> can you get us into the room? >> we're going in now. >> can you get me into the room so i can try to give cpr instructions? >> no, because she kept hanging up on us. >> the autopsy report says houston's personal assistant found her facedown in a tub of extremely hot water. after returning from running errands. the report concluded houston died of accidental drowning with heart disease and cocaine use as contributing factors. we are monitoring a breaking news story. this is out of new york. nypd telling us that two world financial tower has been evacuated. a suspicious package near. i want to go a susan candiotti who is on the phone in new york. first of all, what two buildings? are they two buildings, one building that has been evacuated? what do we know so far? >> hi, kyra. yes, this morning -- this involves a building called 2 world financial center. it's one of the buildings down there in the construction area of the world trade center. this morning i am told by police they got a package that went through the mail room, typical inspection, and they picked up what they said a possible device, could be a hand grenade. they do not know at this time whether it's inert, whether it's active. for all they know they said it could be a paperweight. they immediately called in the bomb squad. building security decided immediately to evacuate the area. that decision was made within seven minutes of finding this package. right now the bomb squad is on the scene trying to determine whether this is a real explosive device or something else, and they'll take out x-rays, they will examine it, and then they'll decide what they have on their hands. but in the meantime there are hundreds of people literally outside the building who had been working inside 2 world financial center, and they have been told to evacuate to a safe area. everyone is remaining calm until they find out what the package is. >> are you close to the building, susan? >> we are close to it, but i'm not on site just yet, almost there. >> okay. do we know what time the suspicious package was discovered? >> yes. they discovered this at about 11:00 -- or just before 11:00 this morning, about 10:53 to be precise. that's when they discovered it, determined there was something not quite right about it, suspicious, and the building security people decided to evacuate the area, and that's when that happened, about seven minutes later at 11:00 people started peeling out of the building. they were notified they should leave. i don't know the exact manner in which people were alerted to that, whether alarms were set off or how an announcement was made, but, in fact, everyone was told to get out of the building, and that's what they've done. >> do we know where the suspicious package was in relation to the building that's been evacuated? was it outside the building? was it inside the building? >> reporter: it was in the mail room. that's where it was discovered, and they have normal procedures where they do examine all packages that come into the building. i'll try to find out whether the package itself was addressed to an individual or to one of the companies that's located at the financial center. police say they don't have that information yet. hope to as this investigation continues. >> do we know why they thought the package was suspicious in the first place? >> reporter: they put it through a screening process that involves x-rays, among other things, and that's when they determined that there was something inside of it that they described as possibly an explosive device and possibly -- they actually use the word hand grenade. the question is whether if, in fact, it is a hand grenade, whether it's live or inert or it could simply be, you know, sometimes people buy things that look like grenades, it could be a paperweight, but, of course, to be safe, it's what they have to do, they decided to take it aside, call the police, alert the bomb squad, and they were rushed over to the scene to try to determine what it is. now, as we're approaching the area now, there are police, clearly more than are usually out visible and standing around at intersections. traffic is still flowing past the construction of the new world trade center and in the area where these office buildings are located around this construction area. traffic is flowing normally. there's just more of a police presence right now. >> have they removed the package from the mail room? have they taken it outside of the building or is it still inside the building in the mail room? >> reporter: i don't know yet because i'm not on the scene, but that's information we'll try to determine. often times what the bomb squad does is she sometimes will look at the device right there where it is. and other times they will regardless suit up, pick it up. sometimes on their own, sometimes they bring in a robot to pick it up and remove it to what they consider to be a safe area, possibly outside the building. i'm not sure whether the mail room is on the ground floor or in the basement area. they'll get it to as safe an area as is possible and then get a look at it. try to x-ray it. they can either do that with a robotic device or they can bring it to a separate truck that they have set up with all kinds of equipment which they can take a closer look at it. >> we are looking at pictures, susan, first, of people who are outside in the courtyard. it looks like a courtyard area outside of the building there. it looks very calm. it looks like they're just milling around, standing about waiting to see what happens next. can you tell us a little bit about who would be inside of that building, the 2 world financial center? we've lost susan candiotti. i want to just summarize quickly here. we're following a breaking news story out of new york. this is the 2 world financial center building that was evacuated. it started when somebody in the mail room discovered what they believed was a suspicious package at about 10:53 this morning. they called in authorities, fire, emergency workers, bomb squad seven minute later arriving on the scene according to susan candiotti at 11:00 is when they evacuated the building. and they said that they thought this package was suspicious because it went through a process of x-rays and screening process and that in looking inside of this package, they saw what they believed possibly some sort of material, explosive material, potentially an explosive device that they had identified. so they have called in the authorities to look at that package. susan candiotti is on the way. we know that they have evacuated the building. it looks like people from what we can see, our vantage point, and it's an aerial shot we're looking at, that people are outside it seems relatively calm. we know that there are security procedures since september 11th, the attacks there that hit in that area, that the security has been beefed up tremendously. there is a process by which all of these packages go through the mail room, are screened and x-rayed, and this one in particular has alerted authorities. they have called in a bomb squad to deal with this, and as we are seeing now from these shots at least that one building has been evacuated. when we get more -- i do believe we have susan back on the line. sus susan, it's suzanne. can you hear me? suzanne, can you tell us where you are? >> reporter: i'm right in front of the world financial center building that has been evacuated. we're seeing a lot of police officers directing traffic to keep on moving on the road that goes alongside it down to lower manhattan. it's still called the west side highway. you might be able to hear the background, they're waving us, keep going, keep going, keep going. off to the right along the hudson river, that is where it appears a lot of the people who were inside the building are located. so there are a lot of police cars in the area where people have been asked to leave that building, but other than that traffic is flowing around the rest of the area. i have not caught sight yet of where the bomb squad is located right now and where they might be examining the package. >> describe for me the scene around you. are people relatively calm? do they seem concerned? i mean, clearly this is a place where the 9/11 attacks created quite a bit of trauma for people where you are. >> reporter: again, yes, everyone seems to be walking about as though they're conducting normal business. people are crossing the street, no one is running, everyone is calm. i can't tell exactly whether this is a normal ebb and flow or whether these are some of the people who were evacuated from the building. as soon as we get to a spot, we're going to jump out of the car and walk toward the river where a lot of people may be evacuated. you know, this is happening in the lunch hour. it could very well be that a lot of these people had moved out of the building and are going to take advantage of this and get something to eat while this package is being investigated. again, we're going to try to find out where they're looking -- taking a look at this so we can get additional nfths abo -- in fact about that. they're keeping cars going north and south without stopping or making any right-hand turns toward this office building. >> susan, do we know if this is the only building that has been evacuated or are there other buildings around that seem to be on a higher state of alert? >> reporter: it's my understanding this is the only one that has been evacuated. in fact, i'm seeing people walking right by the buildings on either side of it. >> what kind of presence, police presence, fire department, what kind of presence are you seeing on the ground there? is there a bomb squad on sight? >> reporter: unfortunately, not able to hear you terrifically well, but we just got out of the car now, walking toward where a lot of people were asked to get out of the building, and so i plan on talking to some of them to find out whether they work inside or what they think about what's going on. >> susan, we appreciate you actually if you can grab some folks and see what they've learned or if they were part of that group, that crowd inside the building that was evacuated. just to remind our viewers what you're watching here, this is an aerial view. this is 2 world financial center. it is at the site of the september 11th attacks, so clearly there is a lot of security in that area. this is one of those buildings in the area. it was discovered about 10:53, a suspicious package inside of the mail room of that building. seven minutes later, we are told, the building was evacuated. that was at 11:00. people started to file out of the building into the courtyard that you can see right outside. it looked like it was a relatively calm situation as people were walking towards some of the surrounding buildings. we are told that the package was deemed suspicious because of something that was potentially detected inside of it through an x-ray screening process, possibly some sort of explosive material, perhaps even a hand grenade. that say cording to susan candiotti who is our reporter who is on the ground. we're going it try to get some more information on this breaking news story. we'll take a quick break and then we'll get right back. [ laughs ] [ male announcer ] ask your doctor if chantix is right for you. following a breaking news story out of new york. we're taking a look at some live pictures here. these are aerial pictures at the site here. this is the 2 world financial center. that is what the building is called across from the world trade center. earlier this morning there was a suspicious package that was found inside of the building in the mail room. we are learning from the police department spokesperson that a package was screened, x-ray screening process and alerted authorities something that they thought could be an explosive device, even potentially a hand grenade. that's when seven minutes afterwards they evacuated the people from the building at about 11:00 or so. we are getting some pictures and some reports that perhaps they are going back into the building. we're not exactly sure, so we're going to stay with this for a while. if they are being let back into the building, that would suggest that perhaps they've deemed this package is safe, that it's not a threat, but we don't know that for sure. we do have a reporter who is on the ground who is asking people what they know about the situation so far, but from what we can tell, this is something that is still ongoing and people seem to be relatively calm there outside of the building. they're simply waiting for instructions. we know that there are firefighters and police on the scene. we are now just learning that there is an all clear at this building, at the 2 world financial center, an all clear now. that means that the people who are working there can go back to work inside of the building. we're assuming that that certainly means that whatever that device is that was suspicious, that that has been rendered safe, that that is no longer a danger. as you can imagine, situations like these happening at that location, at the very place of the 9/11 attacks, there is a lot of concern about security, a lot of anxiety, and so every suspicious package is checked out. we are being told now that it was -- what they're calling a novelty grenade. i don't know exactly what that means. we're going to try to find out what kind of grenade that is and whether or not it was a live one. i'm now being told it was a toy grenade. so people are now milling back into the building after this alert. this is something that has lasted just a little bit more than 90 minutes or so. susan candiotti, who is on the ground there at the site, what have you learned? susan, it's suzanne, can you hear me? she just -- our signal just dropped. i understand that there are a lot of people who are trying to get through and make phone calls, and it is a very difficult thing to get through. so her call just dropped. we're going to try to get back to her, but we're told that the workers now have gotten the all clear, they can go back inside of this building, that this was a toy grenade, but this toy grenade certainly set some alarms here and created quite a scene, but it does look like it is getting the a-okay at this point. let's take a quick break. let's see if we can get susan back on the line and we can get some more information. great shot. how did the nba become the hottest league on the planet? by building on the cisco intelligent network they're able to serve up live video, and instant replays, creating fans from berlin to beijing. what can we help you build? nice shot kid. the nba around the world built by the only company that could. cisco. following this breaking news story out of new york, this is the 2 toward trade center building. it was earlier this morning about an hour -- a little more than an hour ago there was a suspicious package discovered in the mail room. they suspected that it was some sort of hand grenade or explosive device. they found out it was a toy grenade that was in this package. they had evacuated the building. we are now getting the all clear. people are going back into the building. it's just a toy grenade. you can imagine the anxiety. this is the site of the september 11th attacks, and there is a high level of security in that area, but the workers there now getting the all clear. want to get back to the trayvon martin case. the shooter, george zimmerman, has his first court appearance next hour. he is accused of second-degree murder. prosecutor angela corey says that public outrage over the killing of this unarmed teenager did not factor in her decision. >> let me emphasize that we do not prosecute by public pressure or by petition. we prosecute based on the facts of any given case as well as the laws of the state of florida. >> martin savidge has been covering this and he's in sanford, florida. wr he actual are we actually going to see george zimmerman in court today? >> reporter: i believe we are. the way it's been set up, inside of the krektsal facility behind me, which is where george zimmerman is being held, is apparently a courtroom, and he will appear inside of that courtroom as part of his first appearance, the arraignment. charges will be read against him by the judge. the judge actually will be in another building, and the two will be connected by a television set. we know it's segd murdcond-degr murder. we expect to hear a plea of not guilty coming from george zimmerman. the other question to be answered is what about the issue of bond. his attorney, mark o'mara, says it could become complicated, so it may not be dealt with immediately at this first appearance. it could require another hearing. we'll have to wait and see. >> and this first appearance does not involve the martin family, is that correct? >> reporter: no, no, it doesn't. and, in fact, it's a very limited number of people that will be allowed. the media will gain access. actually there will be a television camera that will be allowed to peer into the courtroom where george zimmerman is. there will also be someone from still photography and one reporter, i believe, again allowed to watch from a specially built viewing room. >> martin, do you know anything about his first night in custody? >> reporter: well, you know, he had to be transported from jacksonville. it was the jacksonville area where he turned himself in when he understood that there was charges filed against him. that would have been about a three-hour drive when he showed up here at the corrections facility. there was quite a gathering of journalists that were waiting to catch a glimpse as he went inside. after that then you have a lot of office work that has to be done, photograph that was taken, the mug shot. then there's a medical exam, a mental exam that's done determining how you're going to house him. we understand that he is being held in isolated confinement, and that his attorney got to meet with him for at least an hour, and he described that george zimmerman appeared to be very tired and very stressed, and that's one of the reasons he wants to get him out on bond as soon as possible to help him in that regard and begin building the case. >> is it possible he could be released today, if he makes bond? >> i'm not an expert on that, but i have read a lot of material, and there seems to be the issue that it's complicated because right now he doesn't have a bond. and so the attorney is going to ask that there will be a bond. he'll say, look, he's not a risk for flight. he turned himself in voluntarily so those are all good points in his favor. however, the judge, you know, if they haven't worked it out ahead of time may require a separate hearing and that could take some time. we also though could learn perhaps a bit of insight into what evidence the state has against him because that would be part of the testimony required for a bond hearing. >> all right. martin savidge, thank you. i want to bring in our legal analyst sunny hostin joining us from new york. we just talked to martin about what we can expect. we know we will see george zimmerman before the judge here. is it possible that if he gets bond that he could actually walk today or is it likely that he's going to be back in jail? >> i think that's unlikely, and that's because he's been charged with second-degree murder, and that's a nonbondable offense, and that's because second-degree murder exposes him to a maximum penalty of life in prison. so unless the prosecutor and the defense team have agreed on a bond package, they would have to have a hearing called an arthur hearing to determine whether or not bond is appropriate, and at that hearing the government would have to show that bond isn't appropriate and the defense would have the opportunity to go over several things like whether george zimmerman has ties to the community. we know he does. whether or not he is a flight risk. he did turn himself in, i think that's helpful. and whether or not he's a danger to the community and so i suspect, suzanne, that all of that won't happen today. if the prosecutor, again, and the defense team have not agreed on a bond, and this is a very high-profile case and very serious charges, they will have to deal with all of those issues at a separate hearing. so i suspect today perhaps what we will hear is the judge read the charges to george zimmerman. he will not enter a plea. that's for an arraignment which will happen a couple weeks later -- >> right. >> and then we may discuss bond. >> is it possible you think, sunny, in light of the fact that so many people have heard this case, it seems so polarizing, that they will be able to get an objective jury? >> i do believe that. you know, and so many people have been asking me that question not only in this case but in a lot of high-profile cases, and the bottom line is you're not going to find someone that hasn't heard about this case, i think, especially in florida. this is an international -- this is part of our international discourse at this point, but i don't know, suzanne, that you want someone that hasn't heard about this case. someone that's been living under a rock. you want someone that perhaps knows a bit about the case but can still willing to be fair and impartial. i believe in our jury system and if this goes to trial, they will be able to find six jurors because in florida it's six, not 12 on this count that can be fair and impartial. >> i have to ask you this because it really was quite interesting what happened this morning here. we saw trayvon martin'sbrina fu television that she believes her son's killing was an accident and she said it just got out of control here. does that actually help george zimmerman's case, that he acted in self-defense? >> look, i don't think it helps his case. i don't think it hurts his case. i have met sabrina fulton. she's everything that you see on television. she's elegant. she's lovely, but she's also a mother who is grieving. what mother wants to believe that someone killed their son with ill will, with ill intent? of course she believes it's an accident, but she's not a lawyer. she doesn't -- she's not privy to all the evidence that this government has against george zimmerman, so i think we should just take her words at face value. she's a grieving mother. it's her take on it. she perhaps wants to believe that this was an accident. that's not a legal term. >> right. >> and, again, she's a lovely, lovely woman. >> i guess i'm wondering though if zimmerman's attorneys, can they use that to their advantage, the fact that she sees it or hopes that it's an accident? >> i don't think so. i mean, she's not a witness in this case. she wasn't there on february 26th when her son was murdered. and so i don't think they can use that. of course, you know, often times victims are consulted by the prosecution in terms of how they feel about a case, how they would feel about bond, but it's the government that tries this case and makes the decision. >> all right, sunny. thank you very much. she is a lovely woman. we've spoken to her a couple times on the show. >> she really is. >> obviously it's a very, very stressful time for that family and they simply want to see justice done. we'll see how this plays out. thank you, sunny. appreciate it. all right. stay at home moms versus moms who work outside the house. the battle for the female vote and it's adding up to a political firestorm. democratic strategist finds herself in the middle of it all. a heated debate raises an issue we want you to weigh in on and carol costello with today's talk back question. it's got a lot of us -- everybody is talking about this. >> seems like we've been talking about this issue for, who, 30 or 40 years now? and it's back. >> it's not going away. >> we're we go again. the old culture war between working moms and stay at home mothers. >> what you have is mitt romney running around the country saying, well, you know, my wife tells me that what women really care about are economic issues and when i listen to my wife that's what i'm hearing. guess what? his wife has actually never worked a day in her life. she's never really dealt with the kinds of economic issues that a majority of the women in this country are facing in terms of how do we feed our kids, how do we send them to school and how do we -- and why do we worry about their future. >> conservative critics pounced, and it wasn't long before ann romney appeared on fox news. >> my career choice was to be a mother, and i think all of us need to know that we need to respect choices that women make. other women make other choices, to have a career and raise family, with i i think hilary rosen has actually done herself. i respect that. that's wonderful. but, you know, there are other people who have a choice. >> rosen told me earlier she has no problem with stay at home moms, but with romney's quote woeful record on women's issues. >> the issue here that i'm focusing on that i encourage other people to focus on is does mitt romney have a vision for bringing women up economically and can he himself stop referring to his wife as his economic surrogate. >> keep in mind according to the bureau of labor statistics, nearly 71% of mothers either work or are looking for work. but still, why are we still talking about this? his wife has actually never worked a day in her life. she's never really dealt with the kinds of economic issues that a majority of the women in this country are facing in terms of how do we feed our kids, how do we send them to school, and how do -- and why do we worry about their future. >> in her debut twitter post ann romney had this response. i made a choice to stay home and raise five boys. believe me, it was hard work. rosen sent this tweet, when i said ann romney never worked, i meant she never had to care for her kids and earn a paycheck like most american women. you can hear what they are saying today but first i want to introduce our political panel to talk about this. jamal simmons and crystal wright of black chick.com. so this is all the talk here, guys. get ready. here is what hilary said this morning. >> this is not about ann romney. this is about the waitress at a diner in some place in nevada who has two kids whose daycare funding is being cut off because of the romney/ryan budget, and she doesn't know what to do. this isn't about whether ann romney or i or other women of, you know, some means can afford to make a choice to stay home and raise kids. most women in america, let's face it, don't have that choice. they have to be working moms and home moms, and that's the piece that i am not hearing from the romney camp. instead, everybody is attacking me. that's fine, attack me, but it does not erase his woeful record on this issue. >> here is what ann romney said on fox news. >> look, i know what it's like to struggle, and if maybe i haven't struggled as much financially as some people have, i can tell you and promise you that i have had struggles in my life, and i would love to have people understand that mitt and i have compassion for people that are struggling, and that's why we're running. we care about those people that are struggling, and we also recognize that this economic recovery has been very weak. we also recognize that the debt burdens we're facing in this country are huge and they're going to be a huge problem for our children. that's what i'm hearing when i go out there. >> i want our viewers to know, first of all, that we have reached out to ann romney. we were told that she's out campaigning the rest of the day. she's only -- she's not available to do any more interviews. she just did that one interview earlier today. crystal, why do you suppose this has touched such a nerve 1234. >> because stay at home moms have real jobs, and i think hilary rosen, maybe she needs to spend some time at home being a mom full time so she can recognize that moms are ceos of the household. they're paying bills. they are worried about how to send the kids to college, and they're driving kids to and from school, buying groceries, and they know more about the economic issues of the household than any other woman. so i think what she did was stick her foot in her mouth big time and hilary rosen just proved that she's a spoke person for the democrat party and barack obama and this is what they really think about women. >> jamal, i want you to jump in here because the obama administration has distanced themselves from her comments here. why do you suppose that's true? is this something that is considered damaging to them or why would they be distancing themselves? >> it's not helpful for the obama campaign. this is not a good way to talk about these issues. i think you have to separate them -- the two tracks. the first track is hilary rosen talking about ann romney, and i think that's a bad idea. anytime you bring up spouses, it never goes well. the republicans tried to do it to hillary clinton, to michelle obama. i was against it in both of those cases. i'm against it now when you criticize a republican spouse. the second track, which is the mitt romney track. on the mitt romney track he's got to figure out a way to talk to most of the women in the country, many of whom don't have the choices that he and ann romney had, and those women do have to work, and there are lots of women who would like to stay home, but they have to work. lots of women who would like to work but they can't find a job. so there's lots of issue that is women are dealing with. i think we have to deal with that. four to five american households have women who contribute financially. in 38% of those households those women make more money than their husbands. our economy is built on women contributing financially. if we didn't wage stagnation would mean our host nest holds wou would be a lot poorer. >> this is a tweet from the first lady. it says every mother works hard and every woman deserves to be respected and it's signed m.o., michelle obama. do you think this is going to have legs, crystal? do you think this is going to be something that plays out in the months to come or are we looking at sl here that is more of a 24 or 4-hour news cycle controversy? >> you know, no, suzanne. you said it, ann romney said it. women want to have choices in life. some choose to stay at home and raise their kids if they can. others choose to go to work. and i think this is going to have a lot of backlash because women, no matter what political stripe they are, don't like to be told how to live their lives and what to do. so i think that you're going to see damage to the woman vote that has been following barack obama and democrats and what you're going to see is mitt romney pick up even more support from women. i think it's reprehensible what hilary said to ann romney and that's why women are so offended, and it's not just republican women that are offended by it. it's democrat women as well. i think jamal points out a lot of women would probably like to stay at home and raise their kids, but, i mean, to attack a woman and say that she never worked because she decides to stay at home like ann did and raise five boys and be the ceo of her household, i think it's just offensive. i'm not a mother, but i'm a product of a stay at home mom who raised three great human beings, and stay at home moms vote at thesuzanne. i think this is going to be an awful thing for obama to shake. >> i want to move on to another topic because we're seeing jury selection beginning in the trial of the former presidential candidate john edwards. he's facing felony charges accused of using campaign money to hide his affair and the child he had with his mistress. you remember this very well. we were both covering the 2008 campaign. is this a story with all this money in the campaign, some isolated incident here, or are we going to see more trouble when you talk about the dollars, the millions and millions of dollars that are floating around this time around?
