We begin on storm watch as Tropical Storm ophelia brings Torrential Rain and fierce winds up and down the east coast. Coastal flooding is among the biggest concerns as Rain Bands Stretch Hundreds of miles north from the Storms Center which made landfall in North Carolina this morning. The sights and sounds of power lines exploding there in North Carolina. Allison chinchar is Tracking Ophelia from the cnn Weather Center for us. Polo sandoval is on the new jersey coast and brian todd is in alexandria, virginia. The big concern here is just how widespread the storm is in terms of impacts. When you look at it, the main center of the storm is still located over North Carolina, but these outer bands stretch well into the northeast. Youre talking rain in new york, pennsylvania, new jersey, even portions of massachusetts. Now, the center part of the system, we still have sustained winds of 50 Miles Per Hour with higher gusts. You can see rain bands occasionally making their way into connecticut, massachusetts and new jersey and delaware. The heaviest rain is still focused over virginia as well as North Carolina. Weve even had a couple of Tornado Warnings throughout the day in North Carolina. You have Flood Watches and several Flash Flood Warnings in raleigh and several counties to the east. The concern for these communities is theyve already had two and even three inches of rain fall. Now youre looking at an additional one to two inches on top of what theyve already had. By tonight the focus is over the mid atlantic. Then by Sunday Morning the focus takes shape over portions of the northeast. Thank you so much. How about brian todd in alexandria . Hes moving up river right now after rescuing a windsurfer as the tides get choppy here on the potomac. We havent had too much of an impact so far here in alexandria, virginia, but we know its coming here. A City Official is advising people to make sure everything in your patio is secured or taken inside because they expect the winds to pick up. Youve got Drainage Areas here that fill up, the sewers are kind of antiquated here. When it starts, this entire area is expected to be flooded. If high tide is at 3 00, its not really a concern. This area does have Drainage Problems and you do get flooding here. Whats that like when it does happen . Theyll walk the streets and tow the cars. The city would normally be out by now to put the barriers and start towing cars. Im not seeing anything happening really here. The river is going to start rising in about two hours with high tide. And high tide at 7 00 a. M. Tomorrow morning is another thing theyre concerned about. Drainage is a real issue. Today, though, for the most part you wont find a lot of folks. Thats mainly because a lot of these businesses are closed today because of the weather. The gates to the beach here on the jersey shore are closed up. There is some warnings there for folks not to make it to the other side of this. Th when you look off on the coast, you see just the coast and also the water. There was one gentleman that walked by here who told me this is something you dont see every day. It really speaks to the bulk of the concern here, which is really offshore. Those Dangerous Rip Currents have led officials to close beach access for the most part here in seaside heights. We have a break from the rain. Its more the flooding concern, especially as we get closer to high tide and most importantly offshore with those Dangerous Rip Currents, at least here in jersey. Thank you so much. Now to capitol hill, Where Budget Talks in congress are at a standstill as a federal Government Shutdown looms next weekend potentially. Moments ago, House Speaker Kevin Mccarthy addressed reporters admitting he still lacks support from a handful of republican hardliners, but added, quote, i think now some members are feeling the pressure of the timeline coming up, end quote. Preparations are being made to halt nonessential functions ahead of the September 30th deadline, including details on how many people will face a furlough and which employees will be deemed essential and asked to work without pay. Priscilla alvarez joins us now from the white house. What is the Biden Administration doing to prepare or perhaps even head off a Government Shutdown . Reporter well, theyre essentially telling the agencies to dust off their plans in preparation of a potential shutdown. So what that looks like is the Office Of Management And Budget formally initiated a process friday that would help prepare these agencies for a shutdown. That includes a number of things, including how many people get furloughed, who is considered essential and would have to work without pay. Then, two, what comes to a halt. There are, of course, Certain Services that the government provides that are going to continue, Border Protection, federal law enforcement, air traffic control. All of that will continue, but it continues without pay. That is a concern. We heard from the White House Press secretary this week, who said republicans have to get their act together. Take a listen. Republican shutdown does not have to happen. They can do their job and keep these vital programs continuing, keeping the government open. Our message is, this should not be happening. We should not be putting American Families lives in turmoil. Reporter the House Rules Committee is trying to move individual bills, lean e er bil through to try to avoid any of this happening. The question is whether there are even enough gop votes for those bills. And if there were, it would still be dead on arrival in the senate. The question is where were going to be a week from now when we hit that deadline. As the clock ticks on capitol hill toward a potential Government Shutdown, child care in america is also facing a similar crisis. At this end of this month, the 24 billion set aside during the pandemic era to help fund the nations child Care Industry is set to run out. An estimate by the Century Foundation says the loss of money could mean as many as 70,000 Child Care Centers across the country having to close, affecting about 3. 2 million children. With me now to discuss this is catherine creighton, the director for cornells school of industrial and Labor Relations buffalo colllcollab. Shes been studying funding and what kind of impact it has had on Child Care Providers. How concerned are you about the impact of the end of this funding and child care in america . Were extremely concerned about whats happening in child care. Our office has been studying the Child Care Issue and particularly the Child Care Nexus between how Child Care Works and provides a way for parents to go back to work after they have children, when they have children, and how that affects the business community. What we saw from the mid 2000s until right before the pandemic was that Child Care Providers were increasing in numbers and Child Care Workers were increasing in numbers. Then during the pandemic, of course, we had this terrible catastrophe in Child Care Work where many exited the Child Care Workforce. What happened then was that the funding excuse me. It happens. Somebodys come to visit. The funding really propped up and providing Stabilization Grants so that Child Care Providers could stay in business and Child Care Providers could keep working. That meant that parents could return to the workplace and that businesses had enough sufficient number of workers. That money is going to run out. The way that money was funneled down to the states, so that state money isnt going to be there to help parents or children. So then do you see that many Child Care Centers could face closing down without this kind of funding . Absolutely, yes. The way that the Child Care System runs currently is really a broken market. It relies upon public good, which is that our children should be cared for and keducatd in their early years and it makes parents pay for that cost. We already have a system thats not sustainable. The federal government and state governments have been adding assistance onto that and of course with that money gone were going to have a Domino Effect where Child Care Providers will not be in business, parents wont have places to send their children and then parents wont return to the workforce, the workforce will have employee shortages, et cetera. What is happening at the border . Specially with the numbers of migrants weve seen arriving over the last week or so, although the number has decreased slightly over the last 24 hours, and Texas Governor greg abbott has been railing against the Biden Administration, saying the federal government is not doing enough to curtail the wave of migrants coming to the border. Let me read what the governor said. He said until President Biden upholds his constitutional duty to secure americas southern border, texas will continue to deploy as many buses as needed to relieve the strain caused by the surge of illegal crossings. Of course, he is talking about the decision by his government to, again, bus migrants from two cities in particular, eagle pass and el paso, to other cities around the country mainly run by democrats. Im talking about places like new york, our nations capital, places where weve seen these buses from texas going there. There are thousands of migrants being bussed there since last year. We have nearly 12,000 in washington, d. C. Since last year, more than 14,000 in new york and other places around the country. So the governor says were doing this and were going to continue to do this for as long as theres the situation at the border. You mentioned it before that t mayorkas is going to meet the president of honduras in the next few hours. What could happen from that meeting . Whats the goal . The goal is to Work Together to try to stem the flow of so many migrants, but the reality is theyve tried in the past and they have failed. There are factors that are much bigger than any government that are pushing these migrants to come to the north. Now president castro has been the president of honduras since january last year and she is considered a leftist, but shes been working with the u. S. Government. Just to give you an idea how unstable the situation is in the country, the former president of honduras, her predecessor is in jail, extradited last year to the United States on charges of Drug Trafficking and is currently in jail. For this reason and others, the Security Situation in honduras is very, very dire. Parts of europe are also struggling with an escalating migrant crisis. Tens of thousands of migrants are fleeing parts of africa and looking for refuge. Earlier today during his trip to france, pope francis called for more openness in welcoming migrants and met with french president Emanuel Macron to discuss the crisis. Cnns ben wedeman has more from an italian island dealing with the obsersituation firsthand. [ speaking in a global language ] reporter from today, he say enough, shouts a resident of this small italian island closer to tunisia than the european mainland. This year it has been the destination of a dramatic influx of mostly subsaharan migrants crossing the mediterranean from tunisia, prompting European Commission president to fly there with the italian president to show europes support. But we will decide who comes to the European Union and under what circumstances, and not the smugglers and traffickers. Reporter the number of migrants reaching italy so far this year is twice as many as arrived by this time in 2022. In july, the eu and tunisia signed a Memorandum Of Understanding whereby the europeans promise nearly bankrupted tunisias Financial Support and tunisia promised to do more to stop unregulated migration. But they have yet to hand over the money and the migrants keep coming. Italian politicians, particularly those on the right, have seized on the flood of migrants reaching the tiny island of 6,000 souls, but the politicians need to keep it all in perspective, says flavio. This is not an emergency for italy, nor for europe. Reporter the migrants are quickly sent to Reception Centers on the italian mainland and the crisis eases. Europe desperately needs new blood, he says. For demographic reasons, europe will need migrants. Its needing migrants now. The most important thing is to manage this with longterm policies, not with shortsighted policy. This week President Biden will travel to michigan and walk the picket line with members of the United Autoworkers Union. It has now been nine days since the autoworkers began a massive strike against ford, General Motors and stellantis. But as negotiations with ford show signs of progress, the strike is spreading to more gm and stellantis facilities. Here is cnn correspondent van van vane vanessa. Reporter you have more members on the picket line after president fain of the uaw announced he would be targeting more facilities at gm and stellantis across kcross 20 sta sending an additional 5600 members out to the picket line, because he said gm and stellantis needed a strong push to come with a better offer. If you notice, ford was not noted in those additional targeted strikes, president fain saying Real Progress was made with ford. Here are some details. According to the union, fords latest offer reinstated cost of living adjustments, which was something many of these workers gave up in 2009. Theyre now offering more profit sharing, and temporary workers can now become fulltime workers in 90 days. And theres additional job security, which means if a Ford Employee is laid off, they will receive two years of income and benefits. Notably missing from the announcement on friday was where things stood with wages. We know that the union has been asking for a 40 wage increase over four years. The last public offer from the three companies was around 20 . Ford and the uaw saying that while they have come to terms with some of these other demands, theres still a big gap on the wage issue. These new targeted strikes will certainly have an economic impact. This is going to impact dealerships, because dealerships will not be able to get parts from specifically gm and stellantis and this will trickle down to the consumer looking to bring their car in for a repair. Potentially those parts will not be available. We have recent economic recording that says just in the first eight days of this strike with just the three plants, we have seen a 1. 6 billion economic impact. A North Carolina woman is suing google for the death of her husband, claiming the companys Maps Application Led him to drive off a collapsed bridge and drown. Last september, Phillip Paxton was following google maps directions while driving home late at night in hickory, North Carolina, when the Navigation System directed him to go over an unmarked and Unbarricaded Bridge that had collapsed years prior. Paxton drove off the edge of the bridge and drowned, according to the lawsuit. Neighbors expressed concerns that google maps had led other drivers over the bridge, which allegedly has not been repaired since its partial collapse back in 2013. In a statement, google said we have the deepest sympathies for the family. Our goal is to provide accurate Routing Information in maps, and we are reviewing this lawsuit. Defense attorney misty maris joining me from new york. This is a very sad situation. Your initial thoughts on this case . What a tragic case, absolutely. Fred, you said it. This bridge had collapsed back in 2013. So were talking about ten years later without any signage, barricades or anything to warn that this bridge was in disrepair. There are several issues here, because theres multiple defendants. One, of course, is google and why these directions were given knowing that this bridge was collapsed. They acknowledged they had received a complaint about it back in 2020. Then others responsible for the party, so multiple parties here as this lawsuit proceeds. If the family or attorneys are able to prove there is precedent on other drivers being misdirected on this road and the complaints were documented, in your view, would this establish a case of negligence as well . So its interesting, because thats going to be critical. Negligence is always based on whether or not there was a notice of a dangerous condition. That has to be established in order for the lawsuit to be successful. Were in North Carolina here. Its important to understand the laws of the jurisdiction. North carolina is one of four states that has whats called no comparative negligence, which means that if the driver in this case is even found to be 1 responsible for the accident, they recover nothing. So it is a very, very big legal hurdle, which can be established. My thought is because of the time frame, its not impossible, but its certainly a tougher case in this jurisdiction than it would be in other jurisdictions like new york. So its going to be something that needs to be established. They not only have to prove negligence, they have to prove a willful and wanton disregard for human life, so a higher legal standard. Ive got to tell you. Im a trial lawyer. You do not want this poor widow and her children on the stand before a jury, because that Sympathy Factor. This is a tragic case. I think we see a settlement at some point down the road. You see a settlement involving all of these defendants, whether its google, whether it is the jurisdictions that would be charged with taking care of this road, whether it was in disrepair, collapsed or otherwise . Correct. I think you see a pool being put together from these defendants. You have multiple defendants, which means theres more resources to put together a settlement here. In a case like this, a wrongful death case, the damages largely relate to the financials. So this gentleman was 47 years old. He has at least 20 years left of working. What were those financials . Was there pain and suffering . Of course its called a loss of consortium and Services Claim that relates to the loss of having this individual in the lives of his wife and children. Its a hefty package, but as a trial law youve got to settle this case. The Sympathy Factor is too high. Even along the way before that juncture of settlement or otherwise, how is it established what roads are viable . Where does the responsibility lie with any Navigation System to be so updated to know or have communications with various jurisdictions to know about the wellness of a road, bridge or Transit Location . Absolutely. That is a great point. It goes back to what we were speak about, that notice factor. So whether or not google maps became aware of this dangerous condition is the critical factor. Think about it. Every time youre driving in your car, theres a mechanism to hit a button and say theres a barricade here, theres a blockade here. In this particular case, its been reported that this dangerous condition was notified to google maps. At that point, theres an obligation to at least conduct an investigation as to whether or not there is a hazard and update that map. So thats where that obligation comes in.
