Scene. Impeachment on the minds of House Republicans, and House SpeakerKevin Mccarthy is about to speak and is he is going to endorsement an Impeachment Indictment against President Biden. And also, a possible autoworker strike. We dont want the strike, but you are leaving us no choice if you dont give us a fair contract. And failure the reach a deal could cost the u. S. Economy huge. We are following developing stories right here on cnn news central with sara sidner alongside kate bolduan and john berman. The Breaking News this morning is the convicted killer on the run in pennsylvania is armed. He stole a. 22 caliber gun with a scope and flashlight from a garage and the homeowner was in the garage and actually fired on cavalcante as he ran away. At 10 10 p. M. , a call was received from a resident on Coventry Road indicating a short hispanic male wears no shirt and dark pants entered the garage while the homeowner was in it, and he grabbed a. 22 rifle in the garage. The homeowner drew a pistol, and he fired at cavalcante while he grabbed a rifle, but we have no reason the believe he is injured in the shooting. So now, heavily armed vehicles and officers are going to the scene. The officers are warning residents to stay inside and lock the doors. We go to Danny Freeman who is on the ground in that part of pennsylvania where this search is really entering the new level, danny. That is absolutely right, john. To put a finer note on what you are describing, we are seeing this increased Police Presence all throughout the morning, and we are at the northeast edge of this new perimeter that the Law Enforcement officials have established overnights and this enormous push to flush out Danelo Cavalcante who is now armed and dangerous. We have seen the armed vehicles, and trailers with horses so that the officers can ride them into the challenging terrain to search for the suspect, and the Lieutenant Colonel for the Pennsylvania State police, colonel lieutenant bivens says more than 500 officers in the area trying the find this man right now, but i want to get to some other developments that we learned specifically from the Press Conference. And that 10 10 sighting where he stole that. 22 caliber gun is the second sighting. Because a woman said she thought she saw cavalcante crouched down on a road, and at that point, Police Responded and found muddy footprints and followed them, and ultimately found his discarded prison issued shoes and then word that the work boots had been stolen from that area. Then fast forward to 10 10 encounter about two hours later from that sighting. And so, there was a. 22 caliber rifle with a scope and flashlight on it, and the resident who owned the home was there in the garage, and fired at the suspect, but it appears at that point that cavalcante was not it in the gun fire, and actually, cavalcante telling cnn, excuse me, Colonel Bivens telling cnn that cavalcante did not leave any blood in that particular garage. So i wanted to play you a sound bite in that Press Conference of how the colonel lieutenant George Bivens is saying that he is presenting at this moment. He has killed two people previously, and i would suspect that he is desperate enough to use that weapon. We have considered him dangerous from the start. It changes nothing. We have considered him a risk, and now we absolutely know that he has a weapon. Again, you are seeing the reaction from getting the weapon here today, and another thing that i will note that we learned from the Press Conference that the Lieutenant Colonel says that cavalcante knows this area well. He know where is he is. There have been a question over the weekend when he ditched the van in this particular area of Chester County why, and it was a random spot, and no ther acquaintances that he was familiar with, but now we know that he has been in this area before, and he knows area, and The Big Question is what happens next . Obviously, he is very dangerous, and the police are preparing for any eventuality, and our colleague brian todd was down there at that Press Conference which is about 25 miles south of where we r and he asked Lieutenant ColonelGeorge Bivens if he would engage in death by cop, and listen to that sound bite. Are you concerned about what they call the suicide by cop, and if you close in on him, it is a violent ending, and he is not going to want to go back to prison . Well, it is a possibility. It is a possibility that he is going to attack the police to get away, and possibility suicide by cop, any scenarios are a possibility, and our people are trained to deal with him. Again, we have considered him dangerous right from the start. It does not change anything in terms of the tactics or anything that we are utilizing. Reporter the last thing to note is that Pennsylvania State police found themselves defending the manhunt over the last 13 days insisting that nothing has gone wrong, because they have spotted him, and they believe they know where he is, and 13 days into the manhunt, no capture, and cavalcante is now armed and dangerous. He knows where he is which presumably knows that he know where is to hide. Danny freeman, thank you for the report pg, and keep us posted. Kate and sara. And joining us is retired fbi special agent daniel brunner, and now that he is armed in fact he is more dangerous, but how does it change the whole situation in this moment, and the tone that we heard from the Lieutenant Colonel in that Press Conference was different today than what we have heard in the last 12, 13 days. Good morning, kate and sara. Absolutely. I think that for Law Enforcement, it is completely going to change the situation for the tactical teams as they are proceeding through the forpest, proceeding t i i i ing woods, because cavalcante knows land, and knows area. He was able to get from the prison to the house of an associate with expected no phone, no gps. He knows how the travel through the land, and how to get from point a to point b without the assistance of technology. He knows area, and with the help of the rifle, he can set up an ambush, and so he can be ready, and all of the officers have to be cautious when proceedings, and so with the heavy horses and the canines, it is going to be quite concerning. Daniel, let me ask you about something that the Lieutenant ColonelGeorge Bivens said, because he talked about one point about minutes of the time that he was shot at to when Law Enforcement got there, and we know that he has been seen on the doorbell, the ring device. He has also gone north and south, and he has changed directions, and so he is not going one way, and what does this tell you about his ability to evade Law Enforcement . It has been 13 days, and they have everything they have got looking for the guy . Well, like the Lieutenant Colonel said is absolutely perfect. It is a large area, and i have participated in the searches like this a number of years ago in pennsylvania. It is a large area, and as many Law Enforcement agencies, federal, state, local there, it is just not possible to search in a line pattern. It is not possible to search over every inch. He is at the advantage right now where he knows land. We are, and Law Enforcement is moving forward and containing area, and we will, you know, the best ability is to contain him in that area, and hopefully create the situation where he makes a mistake, where he trips up and able to be detected by the aircraft or infrared or a canine. So that is the situation is to push him to the limits to where he is making a mistake at which someone can move in. One of the most key things is that exactly is civilians. That triples, quadruples the eyes looking. The fact that he approached an open garage, and approached a vehicle that had the keys in it, it is clearly showing that he is looking for opportunities. If the people there in pennsylvania secure their homes and secure their cars and make sure that the keys are not there, and the Garage Door Openers are not in the cars to open the garage doors to get access, that is going to create more difficult situations for him, and that creates more opportunities for the Law Enforcement to move in and capture him. And daniel, john miller made the point earlier if the pattern continues that he hides out in the day and then makes move and travels to make the moves in the evening as the sun goes down, and i wonder now, as there is this kind of the new reality of th the. 22 caliber rifle that the community is locked down and ter roa terrorized by him . Well, the Community Needs to be aware and schools close and the Pennsylvania State police have a great structure there with the Law Enforcements and the fbi and the u. S. Marshals who are experienced in capturing a fugitive, and the best people are there. I am sure that there are assets provided to the community. He is looking for opportunities to enter a garage and opportunity to get into the vehicle. And there is absolutely no reason to believe that he wont conduct some violence towards a civilian. These people are, you know, this fugitive is definitely armed and extremely dangerous, and everything from a hostile encounter all of the way to the safe capture needs to be considered by Law Enforcement, and the Law Enforcement in the area is clearly moving forward and extremely on a new footing today, and the fact that he is armed. We have word that House SpeakerKevin Mccarthy is about to make a statement, and these are live pictures outside of the formal office outside of the capital and it is coming shortly as we learn this morning that the House Speaker is going to endorse an Impeachment Inquiry into President Biden, though the republicans have not presented any direct evidence that the president did Anything Wrong, and also as the House Speaker is facing challenges to his own speaker 1ship speakership. Lauren fox is there, and what are we expect hooger . Well, we are expecting that Kevin Mccarthy is coming out the give a brief statement, but as you noted, this is coming as some on the right flank are raising questions about the leadership. We expect in the noon hour, mate gates, a conservative who has sparred with the House Speaker in the past is going to be giving his own floor speech about the direction of the house and how it should go, and we should remind the viewers that any one House Speaker can bring a motion to oust the House Speaker, and that is looming over the House Speaker since he got that gavel in january after that hardfought battle for the speakers position. Now one thing to keep in mind that House Republicans are going to have to find a way to fund the government. These two issues while they are separate are very much intwined. One of the key things to remember here is that the House Republicans are still divided about how the fund the government. Mean while, the senate is moving on a bipartisan basis to fund the government for a year, and there a discussion here of how to move forward on the Funding Mechanism of how to await this statement of how Kevin Mccarthy is going to face the Impeachment Inquiry against President Biden. So two big questions, the opening of an Impeachment Inquiry and how the fund the government by the end of the month. And the third subissue is if he will survive these issues. And the house has been out of session for six weeks. The conservative members have had six weeks at home, and to a certain extent, the anger and frustration has been boiling up to this point. And matt gaetz speaks at the top of the next hour at about 45 minutes from now, and is what we are about to see from Kevin Mccarthy, is this seen as trying to get out ahead of it . Is certainly one way to look at it, and the close confidents believe that once they got to washington, and get everybody on the same page, and have a regular Conference Meeting and sort out some of the family issues as they call them, but the bigger looming question is that they are going to have time for that given that matt gaetz is expected to go to the floor at noon, and Kevin Mccarthy is going to be getting ahead of what gates says at the 11 00 a. M. Statement, and we expect that Kevin Mccarthy could come out any moment, and he is to begin at 11 00 a. M. , and we are past that hour, and this is all moving quickly, and as i noted there because belief to get back to washington and settle some of the disputes and find a way nforward on the funding, but this is moving more quickly than anyone anticipated. Thank you, lauren fox, and you can stay there live as i bring in the political director david chalian, and lot going on all at once, but it is pointing to one thing, which is that there is a wing in the republican party, in the House Of Representatives that is pushing and pushing and pushing on Kevin Mccarthy, and it isnt clear that they are as concerned about the consequences as they are about making the points that they want to make. What do you think that we will see in the coming hours and days . Yeah. And just to remind everyone, john. Kevin mccarthy is dealing with such a narrow House Majority and that wing of the conference that you are talking about that is pushing perhaps simply to make a statement or take a Stand Irrespective of the political consequences is larger that and the narrow majority, and now, listening to laurens reporting that you are talking about, there is also a faction of republicans, 18 of whom sit in districts that joe biden won, and entering into the Election Season who are concerned that if indeed Kevin Mccarthy takes the full conference, and demands that desires of the far right wing met, that they are going to be met to walk the plank, and specifically on Something Like moving towards an Impeachment Inquiry, and they are, too, a large enough group to be larger than the narrow fiveseat majority, that Kevin Mccarthy has. So he has it coming from all sides here. Because of the way that, of course, as you know that he won the speakership, and this Third Undercurrent Besides Budget Battle to avoid the shutdown and whether or not to proceed with impeachment is mccarthys own survival, because it is one of the things to agree to is that one person can call to vacate the chair and put it up for a vote in the house. And stand by, david chalian, because we are waiting for a statement from Kevin Mccarthy, and the goal for him is to survive this week, and what he might discuss is the possible inquiry of President Biden and all right. Someone is coming out, and we have a twominute warning. Do you want to go to a quick break . All right. David, we have a twominute break for speaker Kevin Mccarthy, and he is going to come out the speak. So much on the president ial campaign, and donald trump out there speaking again, and he is an ally, and this a little separate of what is going on the president ial campaign trail, and how so . Well, it is separate, because you are dealing with the the internal House Republican conference politics, but john, this is going to spill out on to the campaign trail. As you know, we saw this in reverse when the democrats are all right. House speaker Kevin Mccarthy. You know the months that we were gone, and the weeks, House Republicans have uncovered serious and credible allegations into President Bidens conduct. Taken together these allegations paint a picture of a culture of corruption. Now, here is what we know so far. Through our investigations we have found that President Biden did lie to the American People about his own knowledge of his familys foreign dealings. Eyewitnesss have testified that the president joined on multiple phone calls and had multiple interactions, dinners resulted in cars and millions of dollars into his sons and his sons Business Partners. We know that Bank Records Show that nearly 20 million in payments were directed to the biden Family Members and associates through various shell companies. The Treasury Department alone has more than 150 transactions is involving the biden family and other Business Associates that were flagged as suspicious activity by u. S. Banks, and even is a trusted fbi informant has alleged a bribe to the biden family. Biden used his official office to coordinate with Hunter BidensBusiness Partners about hunters role in barisma, the ukrainian company, and also, the biden family was offered treatment by the administration that was treatment not related to the president. These were allegations of abuse of power, obstruction and corruption, and they warrant further investigation by the House Of Representatives. That is why today, i am directing our House Committee to open a formal Impeachment Inquiry into President Joe Biden. This logical next step is going to give our committees full power to gather all of the facts and answers for the american public. That is what we want to know, and i believe that the president will want to answer these allegations as well. This is going to be led by james comer of the committee of oversight with coordination of james jordan of the Oversight Committee and james smith of the Ways And Means. Now i do not make this decision lightly. Regardless of the party or who you voted for, these facts should concern all americans. The American People deserve to know that the public offices are not for sale, and that the federal government is not being used to coverup the actions of a politically associated family. Now, i would encourage the president and his team to fully cooperate with this investigation and the interest of transparency. We are committed to getting the answers for the american public, nothing more or less, and wed will go wherever the evidence takes us. Thank you. All right. Kevin mccarthy is making a statement to endorsing an Impeachment Inquiry be launched into President Biden and obviously in light of the investigations into hunter biden, his son. This is a big moment as john, you were talking about with lauren fox and david chalian, about what this is now really kick starting which is a little bit of the unclear process of where this is going at the moment. To be clear, Kevin Mccarthy at this point believed that a vote was necessary on the house floor to launch an Impeachment Inquiry, and i did not hear him say that he would call for a vote to begin the Impeachment Inquiry, and he said he is directing the inquiry to begin, and we will get more details there if we heard it right, but this is kicking off presumably a process here. It does. Here that is going to be very political, and that up until now we have not been presented with any evidence directly that President Biden himself did Anything Wrong here, but that is the key part of this, the investigations have been going on through a couple of the commit tease and he mentioned judiciary and the Ways And Means will be a part of this, but what is even despite what the speaker said right there, there has been no direct evidence that joe biden, himself, is personally profited off of his son Hunter Bidens foreign work. That is what is the direct evidence of that connection, and that is the question that kind of theres a big gap for them to present in this inquiry. There is a big gap of evidence, and you heard him lay out, biden talking about accusing him of lying to the American People, and that is difference of evidence of malfeasance going on between him and hunter and hunters Business Partners. Manu is always there right on time, and what is your takeaway. He did not say that there is going to be a vote to open up the Impeachment Inquiry. And on september 1st, that is when Kevin Mccarthy told Breitbart News that there would be a vote on the house floor to open up a formal Impeachment Inquiry, and he did not say that just now, but he said that he is directing key oversight House Committee to open up that Impeachment Inquiry, and one reason that the speak seer to O Up The Inquiry is because he does not have enough votes, and that because there are a number of republicans in Swing Districts and some conservatives like ken buck of colorado who are skeptical of moving forward with that Impeachment Inquiry, and so if there were a vote to open up the probe at the moment, he would not have 218 votes, because the democrats would vote against it, and more than four republicans would vote against it as well, so he is telling house Oversight Committee to move forward and one of the reasons that there is not support is because they have yet to figure out, and come up with the definitive proof or evidence to suggest that joe biden took official evidence that he had this pay to play scheme, which they have not proven yet, anded there are a number of members skeptical not only in the house, but Senate Republicans as well, so mccarthy is taking a very significant step by opening up an impeachment probe. If joe biden is in fact impeached, he would be the fourth president in American History to be charged with high crimes and misdemeanors and donald trump of course was impeached twice over two separate issues, but that a ways away, and we are going into the part of the Impeachment Investigation to continue to get evidence to build the case against President Joe Biden and charge him with high crimes and misdemeanors and get the votes to do so, and this is a very, very heavy lift for Kevin Mccarthy, but this action today in some ways being pushed by the far right of his conference which has been very vocal at this moment for the speaker to move ahead on this issue. The speaker aligning himself with that faction in his conference to move ahead with this Impeachment Inquiry, and now the question is what evidence will they gather . Will they have a vote to for mallize the Inquirefor Formallize the Impeachment Inquiry and get the votes to do so. And standby, manu raju. David chalian is standing by, and he says that he is directing the Impeachment Inquiry which is different than saying that he wants a vote of an Impeachment Inquiry, and what are the politics of this for President Biden in which there is a Impeachment Inquiry, and also for Kevin Mccarthy, because clearly both are at play at this moment. No doubt about that, john. The white house has been girding for this as you know, and they have stepped up around this notion, and telegraphed for quite some time that mccarthy was moving in this direction. So, they are prepared for what are uncertain politics. Right . As we saw with bill clinton and donald trump when they were impeached and we watched that process go forward, at times it helped them politically and rallying support to their side to the house Impeachment Process, and we have no idea if it is going to get to that point, and to manus point of the reason he said this he is directing committee to launch an inquiry, and not here is a vote that is scheduled to go to the floor is because immediately, he does not have that political support, so he has to deal with that own sort of very fast approaching internal house conference for him which is that he doesnt have a unanimity of support for this effort, clearly, or he would not be going this route. And then, the politics of how do you move through this that does not necessarily blow up in your face given that we have not seen any evidence, hard evidence directly connecting wrongdoing on the part of then vice President Biden and now vice President Biden, and Hunter BidensBusiness Dealing or the ongoing hunter biden investigation. Now, now, i want to add one thing, and what Kevin Mccarthy has in this moment on his side is public opinion. We just released a poll last week, and we saw that despite that lack of evidence having been presented, a majority of americans believe something afoot here. 55 in our poll said that they think that President Biden has acted inappropriately in the course of the investigation while he has been president. North of 6 in 10 americans think that either biden did something illegally or acted immorally or in bad faith or something wrong here when it is coming to the Business Dealings when joe biden was vice president. So there is a Perception Issue that the white house has to battle, and the issue that the House Republicans will need to lean into, and that is going to be to make the final case to the American People going forward. And manu, jumping back in with us, and a question, and there are a lot, a lot of steps before we would get tot the end of this, but do you foresee a situation where Kevin Mccarthy gives power to james comer and others to launch, to continue to have an inquiry looking into President Biden and hunter biden and this does not end up with them saying that they have seen enough that they want to impeach President Biden . It seems almost certain that they have to go that route. If you are looking at the sheer politic of this, and when talking to republicans, the reason they were nervous about going down that is politically speaking if the republicans decided not to go forward with a high crimes around misdemeanors, then it would look like the republicans cleared him, and give him a boost ahead of the pivotal campaign, and so the betting is that they would go forward with charging the president with high crimes or misdemeanors despite not proving any wrongdoing with the president taking official action to help his son with allegations all year, and yet the investigations to prove that point, but it is back to the central question if they feel they have to, they still need the votes at the end of the day that. Going to take a long time to get there. As we are closer and closer to the Election Year, things will get harder and harder. And nancy pelosi launched that inquiry, and looking to president trumps action to call for the election of the bidens and holding by the end of the december that year, because and a drag into the Election Year could actually boost president trump, and that one of the calculations that they will have to make as well as they move down the truitt. And we are seeing the numbers for the former president , and the same thing could happen for george who we have heard from the president a number of times. And so, now, the government job that congress has to do for the American People . Well, if you are talking to the republican on capitol hill, and the way they think it is going to play is that maybe, they will be with the very need of members he neats to get on board with the government officials. Manu made a smart comparison going back to 2019 when nancy pelosi and the House Democrats launched the initial impeachment, and one thing that is fascinating about the politics internally, and nancy pelosi did that when some of her moderate front line members sort of flipped and decided that they had been so reluctant about moving ahead with the impeachment, and those with national and they got on board with that, and that is when nancy pelosi here, and those front line members of Kevin Mccarthy have not been fully on board with this. So, it is a difference of the internal politics in each of the way that the speakers handled it. And guys, step back to look, and did our founders envision impeachment . High crimes and dimisdemeanors, and did they see this as a quadrennial tool as a way of life. I have been covering American Politics for nearly four decades, and this is the fourth president ial Impeachment Process kicked off, and it had been a long time prior to that, and nixon obviously didnt move forward to the formal impeachment charge, but this is the way of the american political life, and it is not a healthy thing for our system. Thank you, david chalian, and manu raju, and one more thing about the politics, the Senate Number two, the whip, john thune said that it would not be advantageous for the senate of course it wouldnt for the senate to have of course it wouldnt but it is not a universal Senate Movement here, and it is drif ven by the house of Representative S who are i did not mean to explode, but this is a quintessential encapsulation of what is going on in the house is very different than the dynamics in the bipartisan work that is under way in the senate on certain, in certain aspects, and so what is happening in the house is just if this is going down that road, i venture to guess that there are a lot of senators who dont want this anywhere near them right now. We will see. And between mcconnell and thune. And the politics are complicated to say the least. Shes asking prosecutors to weigh in by thursday what that think. Lets weigh in on what the trump team is thinking. Theyre previously pulling previous comments that the judge made, suggesting this means shes biased towards donald trump, the defendant in the January 6th Interference case. They point out comments she made at a Sentencing Hearing where she says the people who mob that capitol where theyre in fealty and loyalty to one man, not to a constitution. And shes certainly sharptonged in a number of her decisions and number of her rulings, but this is going to be an uphill battle to get her recused from the case. The issue is whether or not the judge is impartial or not i mean, ultimately it is. But whether theres a reasonable perception that he or she might be impartial. Not might be impartial, seem impartial, it seems to be a reasonable standard here not just what you sant to say in social media, in big old letters that the judge is biased. There has to be a factual basis. And those statements that are cited in the filing, does that rise to that level . For someone who may not be aware of it, and to think of it, it seems pretty bad but also said in the context of a proceeding. In the context of a proceeding, the courts say thats okay, were not talking ex parte or something that the judge would benefit from. Weve heard that in other cases like with oath keepers where the judge did mention, you know, there was fealty somewhere else, not necessarily to the American Democratic way. It wasnt on an island. All sort of tied together, too. Right. Who makes the call, you said it has to do with perception . Not the facts. Who makes the call . Its a difficult thing to do, because youre asking the judge, hey, judge, i dont think youre fair, but dont take it out on my client later on. Thats somebody that makes the decision. Ultimately, the judge makes the decision. Is that a sort of appeal . Not necessarily out of the gates. The judge is going to rule, move quickly and move this thing forward. I was going to ask you about that, is this part of the trump team, finally, everything they can, as often as they can these filings slow things down or will judge chutkan get on this so quickly it wont get in the way . Collectively, they can, this is going to be moving forward. Theres no reason to get stuck here. Its going to need to get processed and go. Its not something that is going to take a long time. Donald trump is asking for his case to get dismissed in georgia. In georgia, isnt that doing what a defendant would do, just in every case ive seen, theres a motion to dismiss, just a hope that it might be dismissed . Absolutely. Its important for people to understand youre not challenging the facts in that motion to dismiss. Thats for a judge or jury to decide later. Youre saying even though the facts are true is it legally sufficient to uphold the law. Not whether its true or not, but seemingly sufficient. But hes saying that chesebro used when he was trying to get the case thrown out. Oh, fake electors, anything having to do with elects is federal law. So you cant charge me in the state court. The federal law supersedes this entirely. Any merit to that . And any way that meadows has this sent to court . Youre having multiple issues. Make it perfect. Ill do my best to make it perfect. And the answer is, some of this is beyond the scope of this court. Meaning there are arguments that are not going to hold water. Theyre not going to be sustained. You have to make these arguments. Right. Because every reasonable argument you can make, you lose an opportunity to argue it later and you lose an opportunity potentially on appeal. Right. Hes going to make those arguments, mark meadows is an entirely different animal, it does not mean that case cannot be moved, certainly, theres an exodus, and two separate issues, i would conflate them because theyre a separate issue. The only reason i was conflating them, the idea state law and federal law. The idea that state law pertains is what matters here. There has been a ruling on where this should all happen. So in a way, does that color the idea that the electors is a federal issue and not a state issue . Not necessarily, it can be a state issue, too.
