Yovanovitch from her position. It followed complaints from the president s personal attorney, Rudy Giuliani. And we now know he had the help of two associates with ties to ukraine. Two associates arrested and in court yesterday for Campaign Finance violations. Lets get to all of this. Let us start on capitol hill where the center of the universe is at the moment. Manu raju is there. So manu, the former ambassador is behind closed doors right now. What are you hearing . What is expected today . Well, there are going to be a lot of questions about the circumstances of her dismissal from her post earlier this spring. We do know that the president had bad mouthed her to the president of ukraine, zelensky in that rough transcript that was released by the white house criticizing her there. And we know also Rudy Giuliani was target or going after her. And we also know those two Rudy Giuliani associates who were arrested yesterday according to the indictment also had taken aim with her, even enlisted a u. S. Congressman at the time Pete Sessions of texas to go after her. And sessions had criticized her for alleged remarks she made against the president , something that will bound to come up today behind closed doors. Shell pea asked about all those matters. Shell pea asked about what she knew about the president s ask of the Ukrainian Government to investigate the bidens, what shy knew about the aid money that had been withheld and what she would told the administration and ukraine officials, now the question is how much does she ultimately reveal . We dont know that yet, what documents if any shes provided to this committee, and we also dont know the exact circumstances of why she decided to testify today. Ive heard she had wanted to tell her story but shes still a Current State Department employee, and that had been the big question because all along the administration had made clear they viewed this impeachment inquiry as invalid and illegitimate. She is still a state employee but has decided to cooperate, even coming through a Public Entrance at the capitol, so we saw her arrival but the question is what shell ultimately reveal. And kate volker was there when she testified. And also please remind everyone who else is supposed to be expected to testify in the coming week because a lots changed. We expect a full day testimony behind closed doors. We do expect a lot of closed door interviews in the week ahead especially next week when the house returns to session. Its going to begin on monday with the president s top former advisor about what she knew about the ukraine matters. But also a mix of current and former officials and one person in particular to look out for is whos coming at the moment on thursday. Thats gordon sondland. Hes the u. S. Ambassador to the European Union. Someone who did not appear voluntarily earlier this week after the white house directed the state department to prevent his testimony. But hes since been subpoenaed and according to his lawyers he does intend to come next week. The question is whether theyll allow the current top diplomat in ukraine bill taylor to come. Theres still questions but we expect a very busy next couple of weeks as democrats decide whether to impeach this president. Theres also some more breaking news involving capitol hill this morning that we do want to get to. President trump just lost a key Court Decision over his tax returns. An Appeals Court in washington, d. C. Ruled against the president s efforts. He was trying to block House Democrats from getting his finance records. This has been going on for quite some time, and this is key ruling to date. What does this all mean . Lets get the very latest from cnn justice correspondent jessica schneider. This is significant because this is the first Appeals Court has weighed in on this ongoing standoff being the president and congress. And in just the past few minutes the d. C. Appeals court has ruled in favor of the house over Sight Committee here saying the president and House Oversight must turn over tax documents. That doesnt mean the house overSight Committee will now automatically get those records because this will likely be appealed by trumps team to the u. S. Supreme court. Its important to remember this has also been a battle waging in the courts, this particular issue since april. This is after House Oversight heard from Michael Cohen in his testimony that the president changed the values on Financial Statements prepared by his Accounting Firm and thats when the committee said, look, we need these Financial Statements to further our investigation into government ethics laws. The president has long said that rationale was a rouse, there was no legitimate legislative purpose here. But the court today clearly saying otherwise. And heres how they put it in dismissing trumps lawyers arguments. They said uzjust as a Congressional Committee could not subpoena the transcripts and service into k through 12 education nor subpoena his medical records as part of the investigation into public health, it may not subpoena his Financial Information except and thats crucial to facilitate an investigation into president ial finances. It continues onto say that we conclude that in issuing the challenged subpoena the committee was engaged in a legitimate legislative investigation rather than an impermissible Law Enforcement inquiry. So that really slams the president s attorneys arguments here. And kate, you know, the Supreme Court it could go to them, and they have repeatedly upheld the prod powers of congress to investigate. So itll be curious to see if the high court takes this case, how it will all play out especially with that 54 conservative majority at the court. Two justices who have been appointed by President Trump. Absolutely. And jessica, thanks for laying it out. I really appreciate it. Joining me is former federal prosecutor and legal analyst. You do something i always hoped and wished to which was run a marathon and write a book and im very impressed. First to this breaking news about the financial records. How significant is it because the way the court one other line from the courts decision which is having considered the weighty interest and stake in this case can we consider the subpoena issued by this committee is valid and enforceable. This is an important ruling and helps restore some balance of powers between the legislative and executive branch. Here the court made a clear statement. They say the congress has very broad, not quite unlimited but very Broad Authority to issue subpoenas. And they said also this is legitimate inquiry this congress is engaged in. And now were a halfinch away from Congress Getting the president s tax records. As jessica said theres potentially a last stop at the Supreme Court. But the Supreme Court does not have to take any case they dont want to take. They only take a small fraction, usually under 5 of the cases that come to them. And if they decline to take this, then its over and the tax returns go over to congress. And that would be the final say. So much more to come on that. Let me ask you about the other very big thing happening on capitol hill at this moment which is the former ucrepian ambassador Marie Yovanovitch, her testifying. And the white house has said theyre not going to cooperate with any investigation. That white house letter was clear in what they thought. But yet you have a state Department Employee on the hill testifying right now, and Current Administration employees like the Eu Ambassador planning to come back next week even though he was blocked from testifying this week. Im just curious what gives here . Is this a strategy . I dont know, what do you think . Well, i think theres a bunch of Different Things going on here. I mean, it is fascinating that the former ambassador Marie Yovanovitch is up there testifying. She obviously still works at the state department, but the state Department Last week stopped or earlier this week stopped an ambassador, gordon sondland, the ambassador to the European Union from going and testifying. And as you said the letter said full halt. It didnt say some people can go and some people cant. I think whats going on with ambassador sondland is that hes an ally of President Trump and there must be some sort of agreement or at least understanding. He said he wanted to testify earlier this week and they believe that testimony will be in the president s fab. I think its a very different situation with for instance kirk volker who resigned and testified last week and potentially the recalled ambassador and other people who are expecting to see people testify next week which is that theyre private citizens, some of them and they may say things that are not particularly advantageous to the president , but how far does the state department want to depot in forcing them not to comply . So far it looks like they havent done anything and well have to see what happens, what Marie Yovanovitch says and how the state Department Responds afterwards, but i think there are two Different Things going on here. That is actually going to pea an interesting wrinkle, what the reporting going out on what she does say and how the state department then responds. Michael, let me ask you about Rudy Giuliani. President trump yesterday, he was not exactly when asked kind of about this latest with the two associates of giuliani being arrested in court, he was not exactly coming to giulianis defense. Youre going to have to ask rudy about it, i dont know these guys. I know we have heard similar wording from the president in the past when hes trying to distance himself. Do you think this is showing cracks here between the trumpgiuliani kind of alliance . Do you see the president separating himself from giuliani in the midst of this . Well, i mean i think its impossible to really do in the end. Theres no doubt in anybodys mind how close giuliani and the president had been not only dating back decades but certainly in the last year and a half as the president has leaned on giuliani as kind of the public face of his legal problems. Put thats not to say the lack of logic notwithstanding, thats not to say the president wont try to do just that, because thats been the pattern that hes gone through all the time. And i think in some ways he believes that if he can simply over and over again state that he doesnt really know this person or september close to this person, that he somehow can kind of create a reality that doesnt exist. And in some ways that may work with his base, with the people he cares about the most, the folks that live in a kind of news bubble where they believe what the president , anything that the president says and he believes if he does that enough he can kind of create that raemty. The challenge is in this case not only do you have history running against that, but youre going to have a series of facts that are going to come out because of the investigation and pause of news reporting that are going to challenge that reality. Really quickly, how much legal exposure does giuliani have at this moment . The essence of this indictment we saw yesterday is these two guys were funneling hundreds of thousands of dollars illegally from foreign nationals into american politics. Rudy was closely intertwined with these guys. They were his contacts in ukraine. They paid him through this shell company, fraud guarantee, might want to rethink that name, but rudy needs to pea concerned. Especially if one of these guys flips. If one of them flip, then look out. Much more to this. Here with me now is one of the Washington Post reporters who broke this story, whos been on this from the very beginning. Thanks for coming on, greg. Sure. Your reporting that at least four National Security officials raised concerns about the reporting here and this is before the july 25th phone call at the center of the whistleblower report. What were they so concerned about and do you know what the response was when they raised it . I think thats an important question because a lot of people think this whistleblower report lands just after this troubling call and that call trump had with the leader of ukraine was perhaps a sort of isolated thing. But in fact it fits into a broader sequence or chain of events that was increasingly concerning to people inside the white house. Those things that happen in the months leading up to that include the removal of the u. S. Ambassador to ukraine without really any legitimate explanation. Shes testifying on the hill even as we speak, i think. The activities of the president s lawyer, rudolf giuliani, who starts showing up on Cable Television talking about his plans to go to ukraine and his efforts to promote kind of conspiracy theories based in kiev. And then you have these two diplomats including ambassador sondland to the eu who now assert theyre in charge of this relationship and theyve been designated by the president to try to work with ucrepe. And we describe in our story a really disturbing meeting at the white house involving that ambassador sondland in july. And that was one of the most important moments when white house officials really, really got concerned that this relationship was being abused. I want to read one quote from the piece, and theres a lot in there but just one of course sticks out. When people were listening to this in realtime, the call there were significant concerns what was going on, alarm bells were sort of ringing. People were trying to figure out what to do, how to get a grasp of the situation. I found that striking because it goes directly against what the president has been saying, that the call was perfect and that this was as you mentioned was just one whistleblower with an axe to grind. Buy, theres no evidence that this person has a political axe to grind. But i just find that a very illuminate [important quotation. Exactly. Even before the call is over, you know, people are starting to almost panic. Im not sure thats too strong a word in this case. And as we say in our story today that those who are listening to the call come out of it and they immediately start looking for higher ranking officials in the white house to notify. I mean, that speaks to the level of discomfort with what had transpired on that call. And inside the white house there really isnt the equivalent of an inspector general, so some of them end up going to a lawyer whos the top lawyer for the National Security council. All of these alarms being brought to the attention of these lawyers inside the white house, what did they do about it with any of that information . Right. And thats why after reading your piece, dpreg, i was actually wondering does it now put a spotlight on the attorney for the National Security counsel, the Legal Advisor because these concerns were brought to him. Exactly. And, you know, there are people who defend isenburg but when the whesalblower complaint finally surfaces its weeks after hes notified, he doesnt appear to have taken any substantial steps, hes one of the lawyers who then argues with the Intelligence Community to try to prevent that whistleblower complaint from being shared with congress. So i mean it looks like, you know, hes also involved in the effort to move the transcript of that call into a highly classified computer system. So it looks like what we know now suggests they were more concerned about bottling this up than in addressing it and confronting it. Her testimony has been highly anticipated as shes become a key figure in the impeachment inquiry of the president. She was unexpectedly pushed out of her post in may following complaints from President Trumps personal attorney, Rudy Giuliani. She was also talked about on that july 25th call between trump and ukraines new president. Thats at the center of the whistleblower complaint. President trump saying this about yovanovitch. The former ambassador from the united states, the woman was bad news. And the people she was dealing with in the ukraine were bad news. So i just want to let you know that, said the president. Yet numerous normer state Department Officials say she was actually an outspoken outspoken in trying to root out corruption there or putting it another way, trying to do her job. So what could she say today . Joining me right now is another former ambassador to ukraine. Yovanovitch was his deputy during part of the time he was ambassador there. Thank you so much. You know ambassador yovanovitch. Is she as President Trump said, bad news . No, she was a topnotch diplomat, is a topnotch diplomat. Always defending american interests, and she was doing a great job in difficult circumstances in ukraine. Absolutely. And the reason the president gives for his focus broadly on ukraine now is that he says he wants to root out corruption. And obviously suggesting then in saying that that she is she was not doing that because then he pushed her out of the post. What do you say to that . Well, she was doing a great job dealing with corruption in ukraine. The problem was she criticized the top leadership and the prosecutor general for not going after corruption as hard as they should have. And they werent happy about that which is why he bad mouthed her, in fact making things up. What do you think shes going to be able to lay out today behind closed doors with house investigators . Well, i hesitate to speak for her. Shell speak for herself. But the key point is this, that when President Trump was elected i think the leaders of ukraine were hoping the u. S. Focus pie the u. S. Government was on corruption, but our policy remained the same. And ambassador yovanovitch was pushing them to make the right sorts of choices. And they wanted to get credit for reform when they werent doing everything necessary so they resented her efforts. And the irony here is that the people who are being quoted for example mayor giuliani, former prosecutor general shulkin and so their criticism of her was their desire to depot after someone who criticized their ability to deal with corruption. You have a unique perspective. At the center of all this is the president s pressure on ukraine to investigate joe pieden and his son, hunter biden. If biden had tried to push out a prosecutor in ukraine to protect his son. Theres no evidence i will say once again of any wrongdoing on their part but this is the president s focus. You testified before congress in 2016 about this same prosecutor and joe bidens role. Can you clear this up for folks . Its very simple. To put it diplomatically prosecutor general shulkin was not going after corruption. And in fact he was not going after the firm where Vice President bidens son was on the board. And he was being criticized for that by the ambassador at the time. And biden had a very strong interest in reform in ukraine. And he used the influence he had to help remove shulkin. But it wasnt just biden who wanted shulkin out. The eu wanted him out. All the reformers in ukraine wanted him out. So what biden did was commendable. He was pursuing our policy going after corruption in ukraine and seeking the removal of the prosecutor general who was not going after corruption. Obviously im going to put it undiplomatically, what the president is saying is wrong, is completely counter to what you know and lived. Thats correct. And let me give you a little bit of color on this. Theyve been quoting the prosecutor general who Vice President biden helped remove shortly. And mayor giuliani was waving around this affidavit that shulkin had produced which he criticized Vice President biden. But the odd thing is which undermines shulkin, he produces that affidavit in support of one of ukraines most notorious oligarchs whos under indictment in the united states. I want to make sure everyone realizes this is not the ambassador saying this today. You said this in 2016 testimony before congress. Im looking back at your testimony that was brought forth reminding us of this great reporting and you talk about this, that the u. S. Vice President Joe Biden spoke publicly about this before and during his december visit to kieve but mr. Shulkin remained in place. You added Vice President joe biden has been a great advocate in reform for ukraine. With all of this we also have cnns kylie atwood shes reporting Michael Mckinley resigned pause of the silence coming from the top ranks of the state department not defending Marie Yovanovitch in what shes experienced and the tarnish to her reputation that was attempted by those around President Trump. What do you think of that, the fact this top advisor mike pompeo is resigning over this . Well, i have a slightly different take. Certainly ambassador yovanovitch was smeared, a great diplomat who should not have gone through this. And hopefully her reputation will return among those who have been subject to these smear efforts. But pompeo where believe was trying to defend her. And i think had he not spoken up internally on her behalf, she may well have been fired summarily and kicked out of the state department. The fact she remains in the state department reflected his efforts. And i think its important there be people in the government who are able to push one way or the other President Trump in the right direction. Fascinating. Ambassador, thank you so much for coming on. But the question is is it appropriate for a president look, i think we are going to have an investigation its a nonpartisan investigation. Its a nonpartisan investigation. Its an answer that you get from a very serious investigation. But would you be okay with it if it a democrat asking a Foreign Government they jump to a very partisan, very partisan serious use of a tool in the constitution. Well, kate, you know what often happens in these gaggles is reporters will jump around to different topics, different angles which allows every politician to avoid having to give a direct answer to a direct question. But all that i have seen so far is a partisan exercise of a constitutional tool and thats very frustrating. Did you take him seriously, though, on his suggestion . Theres an investigation. This is an investigation. Im not going to Start Talking before i have all the facts, all the information. So gardner went on to say democrats have been dead set on impeaching this president for years, and it is part of their campaign plan. Its so awkward to watch that play out over and over again. Gardner is in one of the toughest reelection races in the country. What are the dynamics on the ground right now so folks understand, other than that he is one of the most vulnerable republicans out there . Yeah, so you can imagine the calculation that perhaps gardners campaign is doing. If he goes out and condemns the president s actions on ukraine to for too forcefully, he risks the ire of the white house and alienating his own supporters. If he brushes the president s actions as no big deal, he risks losing moderate voters and in colorado, there are a heck of a lot of them. This is a purple state, one that seems to be getting bluer and bluer by the day. Gardners likely opponent is John Hickenlooper who dropped out of the president ial race to try to flip gardners seat. Hickenlooper sent out a fundraising email to capitalize on gardeners nonanswer. Putting politics aside, when he says that hes waiting for all the facts to come out, i dont know what more facts that you need other than the president saying to the camera multiple times, i think ukraine and china should investigate joe biden. Iran state media says an oil tanker was possibly hit by two missiles near the saudi port of jeta. They claim the explosions caused oil to start leaking into the red sea. What is going on and what is the fallout going to be. Cnn International Diplomatic editor Nic Robertson is joining me now with more on this. What are you learning. Reporter i think there were several headlines here. One of those headlines is we havent yet seen pictures of the damage, what the iranians say the National Oil Company running the tanker say in the early hours of the day, two missiles hit or two rockets hit the ship, that it punched holes about a meter and a half in diameter. We havent seen evidence of that so far. They do say that there was an oil spill. We havent seen evidence of that. There was talk of fire. We havent seen evidence of that. Although now they say there is no fire. None of the crew were injured. Saudi officials have not said anything about this. Of course it comes at a very very tense time. The incident took place about 60 miles, were told, off the saudi port city of jeta in the red sea. The ship, however, has continued to move during this period, which gives you a clear understanding that it is not heavily damaged but of course this comes so soon after the attacks on the saudi oil facilities, the saudis were blaming essentially on ien ran, tensions rising and with it again today the price of oil.
