Pompeo initially indicated he knew nothing about the call. He is now facing a subpoena. Then there are Rudy Giuliani. The president s personal attorney is also facing a subpoena. The committee wants to see text messages, phone records, other communication related to his work with ukraine on behalf of the president. It is unclear if Rudy Giuliani will comply. And then theres the attorney general bill barr. A source tells cnn that the president petschle australian Prime Minister to help the ag into the origins of the russia probe. The Inspector General, he is now openly pushing back on the president s claim that the whistleblower lacked firsthand knowledge of the allegations in the complaint and more. Reporter suggesting that perhaps the state department does not want to comply under the termed laid out in the subpoena. I said to read you parts of the tweet from mike pompeo im concerned with aspects of the committees request that can be understood only as an attempt to intimidate distinguished officials of the department of state. And then he goes on to say let me be clear, i will not tolerate such tactics and use all means at my disposal to expose any attempts to intimidate the professionals i am proud to lead and serve beside. He also wrote a her to the chair, and he lays out a few of the concerns, among them the depositions who are being sought by House Democrats are not going to be allowed until the terms of the committee to bring a lawyer with they. House democrats said thats because they want to get candid testimony from these witnesses. Also secretary of state mike pompeo saying these witnesses wont have enough time to retain their own personality counsel under the deadline set up. This is all coming as sources tell c that pompeo was actually listening in on the now infamous phone call from President Trump and ukrainian president zelensky, this despite the fact that the two times pompeo has already been asked about the complaint, he feigned ignorance as if he didnt know what happened on that phone call. Well, its still unclear here on capitol hill whether or not Rudy Giuliani will actually comply with the request for documents by october 14th. Democrats gave them two weeks to turn over a range of documents stemming from the beginning of this administration up until now related to the giuliani efforts to urge Ukrainian Government to investigate the bidens, something he admitted to doing publicly. Giuliani did tweet signaling he may not comply with that. He raised what he calls a number of concerns. If you look at the way the administration has dealt with the congress this year, they fought virtually all requests. The pompeo request is the first indication that the Trump Administration will not cede any ground despite the inquiry, and democrats are expecting giuliani to fight this as well. Last night giuliani was asked if he were testified to come to capitol hill. He did not rule that out. Oh, i dont know. Eye weighs the alternate activity. Ill go through it, get all my evidence toes, get my charts. I dont know if they let me use videotapes, tape recordings that i have, if they let me get some of the evidence that i gathered. Its not entirely clear what he was referring to, and just to be clear, he has not been asked yet to come and testify that some of the democrats have not made a decision on. He still was not asked whether he would comply with the request here from the subpoena to turn over documents. If you didnt have the ukrainian situation, we probably would be looking at this very differently. Also New York Times i thinks its important to know that this was also something that was hid from normally where they would put this they also hid this conversation. It adds to the complexity. Ing that you and there are a lot, but one single fact, its important not to miss here, that the Inspector General, who first vetted this whistleblower complaint, an Inspector General appointed by President Trump, he just fact checked, refuted, slapped down the central case that the president and his al allies are making against the whistleblower, a case like well, heres some of t listen to this. I cant believe were talking about impeaching the president based on an accusation based on hears hearsay. When did they change the rules about a whistleblower, you can use hearsay when you could not weeks before the complaint. He had no firsthand knowledge. He heard something from someone who may have heard something from someone. His source were firsthand you know you do not need to have firsthand you dont know. You used to. They changed the firorm. Then the Inspector General put out a state, one, the whistleblower did have direct firsthand knowledge of certain allegations in the complaint, so not hearsay. Two, secondhand information is okay. That is allowed by law in whistleblower complaints. Three, no existing rules were changed or bent to allow secondhand information to be part of any complaint. It was clarifying information they put out. Shim shimon p shimon joins us. This is a trumpappointed Inspector General pushing back, and Lindsey Graham, who is the chairman of the house judiciary committee. All these conspiracy theories that are out there. This is probably the entire statement was the most Important Information that came out this gives more credibility to the whistleblower, gives more credibility to the investigation that the Inspector General here conducted, the people they interviewed. They clearly believe this is a problem. You dont see an Inspector General normally put on the this kind of statement. They need to do as much as they can to protect the system to allow the whistleblowers to come forward. To Lindsey Graham as argument are argument, hes a former jag attorney. Hi knows the law, so does any of the complaint fit the definition of hearsay. There are parts of the complaint that technically are hearsay, but what they are doing is a distraction message. Theyre attacking the message, because the message itself is so damaging. What the whistleblower is saying is technically hearsay, but who cares . We have the phone calls. So sure, the whistleblower can provide a guide, and hes corroborated. He describes that call dead on, and he knows about the storage of the call in the other server, dead on. This whistleblower is corroborationed, but on point what matters is the evidence itself. This is going to be an aggressive, offensive tactic by the president and his hopefully people wont Pay Attention to the actual i said. Abby, if the Inspector General literally refuse refuted this attack, where are the republicans to go then . You would almost think the lawmakers would have access to people on their staff, researchers who could help them look into the conspiracy theories before they made them on television. Now that the ig has said they have no basis in fact i think youre hearing and saying a lot of republicans shifting arguments by basically saying what the president did or said was not against the law, not against 9 sort of letter of the law. They are challenging adam schiff and nancy pelosi to name the part of the u. S. Code that corresponds to what the president did. But, you know, honestly that is really a sign of how difficult this has become for them. They are not even necessarily trying to defend the president s comments. President many of the president s allies are not necessarily arguing it was proper, and Lindsey Graham of all people show know that may not fly. He, many years ago during the clinton impeachment, argued himself that impeachable conduct does not have to be illegal. This is a really tough spot theyre in. It has become even more challenging, as elie pointed out, the whistleblower complaint is corroborated by actual evidence that the white house has released themselves. This will only guess harter to defend this isnt just a complained that he saw and handed on. Here are the two parts. In short, the icig, the Inspector General, did not find of complainant could provide nothing more than a secondhand or unsubstantiated assertions, which would have made it much harder, and significantly less likely, for the Inspector General to determine in a 14day calendar. It was provided as well as other information gathered, and determined the complaint was both urgent and that it appeared credible. Guys, what does this tell you about what the ig did. It sounds michael atkinson, it sounds when you read this, they were very thorough. He had to have been known the seriousness keep in mind the department of justice did not do any kind of investigation. There was a review. The review was based solely on the transcript of the conversation. Outside of that, the department of justice, from everything we know, did nothing else to try to investigate this. What the ig is saying is i was able to corroborate this whistleblower to confirm he was credible and it was pretty easy. I think thats what hes saying between the lines. It only took me two weeks to lets not forget the department of justice, bill barrs department of justice didnt even open an investigation. They killed it before it even got off the ground. All you need is a kernel of potential criminality in order to open an investigation. The fact theyre not even willing to take a look into this says something about the partiality of bill barrs department. Dont believe it, this is dont believe it. Dont believe it. So i think mvp mcconnell is an institutionalist, he warrants the house to know that. I think he ace trying to help bowlser the president and those in the house of representatives still message testing, trying to find a way to message the Republican Base to consolidate their support. It looks like what theyre trying to do is it make this a shirts versus skins, republican versus democratic issue, so you have to get on side and theyre trying to whip republicans in line. What you see with the president being a messenger on this is theyre trying to find the right line to convey to the country and to the independents that you mentioned that this matter is not of high consequence deserving of impeachment. It reminds me of the clinton impeachment when they came up with a very simple what i to minimize on denigrate the charges, when he lied about sex, as if to say thats happened, this is a small issue not worthy of impeachment. So i think thats what the republicans are trying to do on the hill, which is to try and say you have not met the bar of a high crime or misdemeanor. Theyre definitely hoping that. You just added another word. No. I would like you to do a favor, though . Yes, its in the transcript. It goes on from there. Brendan, honestly would you ever let ryan or boehner do this interview . Its Kevin Mccarthy helping the republican cause ought all, to try to find a way to defend this . I think as a leader he had no choice, but to michaels point, the comparison to the clinton situation is a good one. The contrast is actually important. In the 9 ons bill clinton understood democrats needed to go out and say bill clinton did something wrong. I dont think it rises to the level of impeachment, but what he did was wrong. Here we have a president that i dont think would tolerate that from republicans in congress. If republicans went out and said bronc it is impeachable, but what the president did is wrong, he wouldnt understand the joke. Instead he would probably lash out. Thats the dynamic. But at this point thats the only play they can go, or they can say they dont think he did anything wrong. The defense thats being put out is its hearsay, and they broke the rules, but none of that is true. And i think it is straining credibility. I think the right thing to say, if you dont think that this rises to the level of impeachment is the president should not have done that. This is on its face obviously inappropriate conduct. The unwillingness for republicans to say that is what leads you to these situations where you have interviews with people all over the place. At this point the republicans are not only not willing to say its bad. Some are saying its it didnt eastern happen in the first place. There is a great deal of emotion in this case. The families for amber had started arguing because she had walked into that apartment thir thinking someone was in the apartment, and clearly the jury did not believe her and convicted her of murder. And keep in mind, since thc is legal in many states, there might be many more people who used it but wont admit it. Science says whats in that liquid isnt necessarily the same concentration thats in the vapor. Julie is part of a team focused on the chemical and physical reactions when people vape. There are Chemical Solutions happening even after heating. They call them generally regarded as safe, but that designation is for eating, ingestion, not for inhalation, breathing them into your lungs. You sort of super heat these chemicals with these heavy metal coils. You atomize these coils. They get back into your lungs. They reaccumulate or recongeal. I dont know what that does to the body. Just like they didnt know what cigarettes did to the body when they first came out. Does that part worry you . It worries me for sure because we dont know the longterm effects. If you cant determine what is safe right now, would the cdc recommend people just not do it . What we would recommend is if youre concerned about your health risks in light of this investigation that you consider not using cigarettes or vaping products until we know more. You heard some of these. Should they be banning flavorings . What about vaping itself . Then these products, the thc and cbd products, if they are not regulated, how do you know what to trust . I mean, one Health Director out of kansas said to me recently in an interview, sanjay, you wouldnt walk around, see a pill on the ground, not know what it is and put it in your mouth.
