Reporter this is going to be a long day on july 17th. Backtoback hearings, the House Judiciary Committee expected to go first followed by the House Intelligence Committee, then a closed session with the House Intelligence Committee and staff for Robert Mueller. So there will be a lot of questions asked. The question is how much will the special counsel ultimately be able to answer . Nevertheless, ive talked to a number of members on both sides this morning. Democrats have very high expectations, with many saying that perhaps this could change the dynamics and also strengthen the calls for an impeachment inquiry, including alexandria ocasiocortez, the congresswoman from new york who i just caught up with, who said pressure will go every day for impeachment and will grow even more after Robert Mueller makes his public comments. When jerry nadler came out and talked to reporters, i asked him directly that question. He would be in charge of launching an impeachment inquiry. Privately hes made the case. I asked him, will that change the dynamics for an impeachment inquiry . Some of your colleagues on your committee this morning believed that his testimony could change the dynamics for an impreachment inquiry. Do you think this would have such a profound impact that it could strengthen calls for an impeachment inquiry . The russians attacked our democracy. The Trump Campaign certainly welcomed that assistance. So i think its very important that the americAmerican People from mr. Mueller as to what he did find, what the results of that twoyear investigation were. And not have to rely on the misinformation spread by the attorney general. Reporter so not every democrat has the same view. Adam schiff, who will administer that second hearing on that same day, told me that democrats should have, quote, realistic expectations about what to expect from the mueller report. I asked him whether or not do you think it will change how people will view an impeachment inquiry proceeding. Schiff made it clear to have realistic expectations. On the other side, republicans are planning to ask aggressive questions to mueller about how the investigation was started. They believe it was not carried out properly. They side with the president s criticisms. So expect that to be echoed in that testimony. Doug collins, a Top Republican on the House Judiciary Committee, essentially made that case to me moments ago. So a lot of expectation for this highly anticipated testimony in just a matter of weeks. The question, of course, what will the special counsel say and how much will be revealed that we dont already know. That, no matter what you want and how good of reporting well doing, well have to wait and see. Thank you so much. Joining me now, cnn legal analyst elie honig. You say this is going to be a pivotal moment. If bob mueller sits before these committees and repeats what he wrote in the report, why is this so pivotal . Because the American People need to hear the truth, unvarnished, and Robert Mueller is the person best able to deliver it. The vast majority of the American Public and seemingly some members of Congress Still do not fully understand what Robert Mueller found in his investigation and whats in the report. And just seeing a person live on tv behind the microphone answering questions live will hit so much harder than tit eve could just in the written black and white. And you look at one passage and there have been, when you look at politicians, multiple interpretations of what he was actually meaning. What did he mean when he said x, y, and z . And that leads me to what do you think is the most important question he can be asked . The biggest question, really straight forward, is do you believe the president committed a crime . He will try to tap dance around that. He did this a little in the report by saying, well, we have this policy at doj that we dont indict a sitting president. Id like to see a little pushback from congress. You have this policy, but do you find probable cause that the president committed obstruction or any other crime . I dont know how he can dodge that. Probable cause is what you need in order to indict a case. Also, cant you just simply ask, what did you mean when you said this . Read him each line. If we thought we could clear him, we would have. What did you mean by that . I would like to see a little more straightforward, plain english. Hes a bit of a cipher in the report. It sounds like he may just say, i stand by my report. A couple things, first of all, thats not really technically okay to do. You dont have the option as someone whos been subpoenaed to say, ill answer this but not that. A subpoena is mandatory. You have to answer. This is not optional. He still may resist, but there are questions, specific questions he can be answered, even within his report. One example, mueller concludes in his report that the Trump Campaign expected to benefit from russian interference. Now, i would follow up on that. Who in the Trump Campaign . How did they expect to benefit . There are things, even within the four corners of his report, that he can explain further. So beyond the four corners, when intel chairman adam schiff said last night that there are many questions to ask beyond the four corners of the report, what does he mean . I think he means lets get real here to some extent, rather than all this legalese. Ill give you another example. We know that Robert Mueller put in a letter to bill barr that bill barr had misrepresented the nature, context, and substance of the report. And bill barr tried to explain this away. Yeah, so i would ask mueller n what specific ways . Weve been subjected to two months of spin from trump, from william barr, and mueller, whatever anyone may think of him, is nonpartisan. Does it have an impact or does it diminish the impact the fact that hes testifying after, you know, relatively so long in this world that we live in today . I do think it diminishes the impact. First impressions are so powerful. We know that. Weve been here for two months. Theres a narrative out there. The no obstruction, no collusion, total exoneration. I think muellers testimony is going to go a long ways towards correcting that misimpression. No collusion, not exactly what mueller found. No obstruction, not remotely what mueller found. And total exoneration, not remotely what mueller found. But yeah, there is this initial impression. Theres been a long process of educating the public. As we see members of congress slowly, one by one, come over towards the position that there needs to be an impeachment inquiry. Can the white house restrict his testimony in any way . Hes a private citizen. Hes no longer the special counsel. Hes no longer with the justice department. What can the white house do to restrict what he says . So the lawyer in me wants to say nothing because they have no legitimate legal basis. Is there something other than a lawyer in you . Yes, theres a realist in me which says of course theyll try. It wouldnt surprise me if they start lobbing letters the night before. Theyll come up with something. But all these objections that they put out there to block hope hicks and don mcgahn simply do not apply to Robert Mueller. Theres no privilege. Hes never been an adviser to the president. So this morning, the Immigration Crisis is no closer to being solved. Lets be obvious and honest about that. But there is something new. A disturbing and tragic symbol of the desperation and danger that is at the center of the immigration debate. This image that well show you, a father, Oscar Martinez, his 23yearold daughter, dead on the banks of the rio grande river, died trying to make it to the United States. Maybe you have seen it. Maybe you have not. Regardless, whenever it comes up on your screen, i know it is hard to look at. But please, do not look away. Please look at this. Let me go to ed lavandera. Hes in texas for us, covering all this. Ed, what more are you learning about this image and the story behind it . Reporter were trying to get the details of just why this family chose to cross in that particular area, in the river, in such a dangerous area. The reports are that the family had been trying to seek asylum, perhaps been turned away at the border entry. Remember, critics have been saying for months along the u. S. Southern border that the Trump Administrations crackdown on controlling the number of people who can seek asylum at legal ports of entry every day and essentially forcing these migrants to wait in mexico for their turn essentially to be able to request asylum, that the desperation in that, the dangerous situations on the mexican side of the border was forcing people to take more treacherous, more dangerous options, like crossing the river. So were seeing this now play out in a deadly way as people try to figure out the more specific details of why this family was brought to this particular area. Regardless, it is a very dangerous situation. That river might look peaceful at times and kind of slow moving, but the currents are unpredictable and very swift. Obviously you can see just how dangerous it can be for a father and his young daughter. Absolutely. And the reports that were seeing, of course were working to get more details on it. The reports are that the wife, the mother of the girl watched while this played out because thats what her husband was trying to do, get back across to help her come across the river when the 23yearold daughter went into the water and reached out to her father. Ed, thank you so much. Now, this isnt about right and left. This is about humanity. You look at that image one more time and you know this is hard breaking. Just think of what this family went through, what was going through their minds when they tried to cross the rio grande. And this baby did what any sweet baby does, running after, reaching after their parent when we put them down for even a second. It happens all the time. I put my daughter down even to cross the room, and she reaches out and comes after me. This image, this story, this should weigh on the president. This should weigh on the congress. This should weigh on everyone. Because there has to be a solution that can both keep the border secure and allow for a reasonable process when families present at the border looking for a better life. Its time for people to open their eyes, move past the stale and tired talking points, and actually do their jobs. Maybe, maybe one sign of hope today, im almost afraid to say it, but i will. Republican senator ron johnson visibly moved by this image, but the image of Oscar Martinez and angie valeriya and their tragedy, their tragic story, moved by this today. Watch this. So what are they going to do about it . To try to answer the question that ron johnson is presenting, well, the house passed emergency funding for the border last night. The senate is looking at a different version. The white house is threatening a veto. Let me bring in dana bash. Shes got much more on this. So dana, this isnt coming from congress at this moment. This isnt immigration reform. This is nowhere close to it. This is not a solution. But what is going to happen now that the house passed a bill last night, the senate is looking at a different bill . They are working, and theyre up against the clock. Theyre up against a clock that the congress, as they so often do, created themselves, which is to get out of town for july 4th recess. And when i say working, what the house and the senate have to do is reconcile different bills that passed each chamber, which is the way congress works. Its the way its supposed to work. They pass different bills, and they come together as well know for whats known as a conference committee. The issue right now is that tensions are so high, emotions are so raw that coming together to do that when the differences are such that you have the democrats, as we reported all day yesterday, changed their bill to make it more palatable to progressives who say they wanted to put more strings on the money to make sure that more care was given to these children and that more the administration would be able to spend the money in very specific ways, not more freely. The senate has more of a focus on some Border Protection issues. So they have to reconcile that, and they want to do it very soon. But kate, i can tell you that ive been talking to people on capitol hill this morning who are acknowledging the reality, which is theyre trying to get home for july 4th recess, to walk in parades, celebrating the freedom and independence of this country. And even they, who are in the middle of this political, you know, dynamic that theyre used to every day, understand the ridiculousness that that would be, to go and march in those parades and leave without passing this bill. Having said that, there is a loot of partisanship going on and a lot of emotions. You mentioned the republican ron johnson, whos been working on this for quite some time. Chuck schumer went to the senate floor also talking about that picture. President trump, i want you to look at this photo. These are not drug dealers or vagrants or criminals. They are people simply fleeing a horrible situation in their home country for a better life. How could President Trump look at this picture and not understand that these are human beings fleeing violence and persecution, willing to risk a perilous, sometimes failed journey in search of a better life. Theyre not coming these people are not coming here to sell drugs or commit crimes. Theyre coming here to escape brutality, starvation, threats of rape and murder in their home countries. Any normal person would flee. And the sad fact of the matter is we can do something about this. If the president would stop playing all the political game of blame, blame, blame. Now mitch mcconnell, the majority leader, he also went on the Senate Floor Today saying they are intending to get this done. Theyll figure out a way to reconcile their two bills. And of course, he said it was the democrats who were dragging their heels. Theres blame to go around on all sides on this. There are differences. Again, because of the politics, because of the emotions, its been very difficult, but you do have people i went down to the border in april. Youve had people screaming from the rooftops saying, congress, we need more money, we need to fix some of the issues making it difficult to deal with this humanitarian crisis, never mind as you said at the beginning immigration reform, which is so far down the road right now. Exactly. The simple fact, theres bipartisan support. Just ask ted cruz. One fix ive heard from multiple people, paying money to put more Immigration Judges at the border in order to have these asylum claims moved through the process and not clog up the system. It is mind boggling why that is not part of the conversation, even an emergency measure to get it through, get it done, and get things moving if they really want to get something done. As you said, lets see what happens with this step and if the white house accepts it. Its hard to imagine i might have egg on my face for saying this, but its hard to imagine the president not signing whatever bill he gets. The question is what and when will that be look like and when will it get there. I agree with you, im just questioning my own judgment on this one. Us you heard it here first yesterday. 100plus children who had been moved out of a clint, texas, government detention facility. Well, they were moved back in yesterday. This is a facility that a team of lawyers went in last week to observe the conditions and came out describing horrific circumstances. One quote, there is a stench, one person said. She also described the conditions as the worst she had seen in any facility in the 12 years she had been monitoring Migrant Children detained in government custody. The attorney who said that is the director of the immigrant rights clinic at Columbia Law School and joins me now. Thank you so much for being here. Thank you for having me. Theres actually a lot thats been happening this morning that i want to ask you about. You were there last week. You say after you left that you observed the worst conditions youve seen in your 12year career in going into these facilities. Then you hear 100plus of these children are then moved back into this facility. And you think what . I think that choice is inexplicable. I do not understand why this administration is moving children back into clint given what we uncovered last week. It is also my understanding that today a number of select journalists may have the opportunity to take a tour of clint. Im very interested to see what they learn. It is it is it has been a whirlwind of a few days. The Media Coverage has sparked an outrage in the American Public and internationally about the conditions that we observed last week and that we learned about from the children. We saw children who were dirty, who smelled because they hadnt had an opportunity to bathe, shower, or change their clothes since crossing the border. We saw children who were sick. We saw children who were scared, too scared to ask even for more food when they were hungry. And perhaps the children are being brought back in for this media tour. Its hard to know whats going on. I did want to ask, do you think they could have corrected the problems you saw in basically one day . Well, when we arrived last monday, there were more than 350 children detained in a facility that was designed for just over 100. I do not think its possible to change all of the problems that we saw in just one day. One of the most Serious Problems that we observed was that very young children, ages 1yearold, 2 years old, 3 years old, were being cared for by children just slightly older than them, ages 7, 8, 9 years old. The guards would bring in the very young babies and toddlers and say to the older children, you must take care of this child. I dont know how within one day that scope of problem can be changed at clint. So one important point here is at least to this point, journalists are not allowed into these places. You and a team of lawyers, youre allowed in to inspect these facilities only because of a Court Settlement from years ago. So youre really the only eyes and ears in there. I say that because now customs and Border Protection, theyre disputing what you saw. Let me play for you what just happened, actually, in a Senate Hearing with a customs and Border Protection official being questioned by a democratic senator. Watch this. Does cbp have an obligation to provide toothpaste and soap to children in your custody, yes or no . Were providing that in el paso. In clint station. Custody at very controversial facilities, including last july at ca casa padre in brownsville, texas, including this march in homestead, florida, and never before have i gone to the media with my concerns. I have been very concerned about the safety and wellbeing of the children in those two facilities, but what i saw last week at clint, what i smelled, what i heard left me shocked and appalled that this is what our government is doing in our name with our taxpayer dollars, and these are the most degrading and inhumane conditions that i have ever seen for children in federal immigration custody. What is the most important question that you want to ask him, do you think . Well, thats an interesting question, kate. Heres why i say that. I believe bob mueller, having watched him and known him for a long time, when he says that his testimony is his report. You should not expect, and nobody should expect that bob mueller is going to make any news in either of the testimonies he gives to the congress. Now, you might ask, whats the point . The reality is that very, very few americans have read the report. Very few americans are familiar with the conclusions of the report, in particular part two of the report where bob mueller elaborates on ten possible examples of obstruction of justice. I expect that he will be willing to discuss, using the words of the report, those examples, but of course, my colleagues are going to spend a day trying to get him to say things outside of the report. I think hes unlikely to do that. So wait, are you youre doing in not expecting to learn anything new . I would not expect to learn a lot new. Again, hes going to abide if you know bob mueller, you know that of all the tepeople in washington, this is a man who means what he says and says what he means. I would be shocked if he goes too far from the language of the report. That said, he may be able to he may be willing to answer factual questions that maybe arent directly in the report. What ill be interested to see i mean, here you have a guy ive just told you what i think about him who is universally respected in washington and has been for decades. Of course, the republicans are going to try to slander him. Theyre going to try to say you were biased. Theyre going to come up with notions that he couldnt have been a fair arbiter of this report. Its going to be interesting to see how he parries that. Bob mueller is concerned about his legacy. He doesnt want to get drawn into a partisan food fight. But hes going to stand up for his own integrity. That raises an interesting point. If these hearings become about how many members of bob muellers team are democrats or if this becomes about lisa page and peter strzok and why mueller when mueller pulled strzok off the case, do you consider that would you consider this kind of backfiring on all of you, calling him before you to answer questions . Well, again, i dont think its going to so much backfire. If you go into this believing what he has said, which is his report is his testimony, i think the only, you know, risk is that theres going to be a feeling of let down. Again, i dont think hes going to make a lot of news. The republicans, as you point out, are going to try to slooanr the guy. Theyre going to come up with absurd ideas, despite the fact already no facts out there. Theyre going to say, well, you had a guy on your team who was a registered democrat. The interesting question will be will bob mueller give the obvious response, which is, hey, everybody is registered in a party. That doesnt mean they cant do their job with objectivity. The cop that pulls you over for speeding is registered. Can you only pull someone over in your own party . I find your position on this fascinating because what we heard from jerry nadler, the chairman of the judiciary committee, we heard from him today. He said if mueller would just sit there basically and read from his report, that is worthwhile. Do you think thats the case . Well, i think were saying the same thing, right . What ive said twice now is that his testimony will be his report. Jerry nadler no, heres what i cant get. Jerry nadler thinks thats worthwhile. Im having a hard time understanding if you think this is worthwhile at all. I absolutely think its worthwhile. I know from my own constituents that a small minority of people out there have actually read an almost 500page report. I dont blame them for that. I read it. But an awful lot of people obviously watch live testimony when its heavily covered in the media. Again, i dont think the content is going to be any different than what was in the report, but the media by which it gets presented to the American People is going to be very, very different. I think very impactful. Do you think you are now into a place of supporting launching an impeachment inquiry into the president , but your reasons go beyond the russia investigation. Talk about faciliscinating, you a very long list outside the russia investigation why you think youre to a place of wanting to support an impeachment inquiry. With that in mind, after you hear from mueller, the definitive voice on this investigation, if you dont see a flood of democrats moving towards the position of saying now its time to launch an impeachment inquiry, is it fair to think the house is never going to get there . Well, i keep trying to sort of say this, but because the media is sort of fascinated with the notion of the number of democrats who support an impeachment inquiry. Speaker pelosi is going to listen to her caucus. Most of us acknowledge shes been doing this a lot longer and a lot better than most of us representing our individual constituency. I said in my statement supporting an inquiry, all i can do is tell you what my constituents want in southwestern connecticut. Speaker pelosi is thinking about the whole country, thinking about her legacy, thinking about the divisiveness of an impeachment. So shes factoring in a lot of things that some of us whose job it is to represent our constituent perhaps dont see. So again, i think, you know i dont know where Speaker Pelosi is going to wind up on this. Shes very, very attuned to popular will and to where we go in the coming months. We just learned that Senate Republican leaders are saying they have decided they will not negotiate over differences between the bill and the house and what theyre looking at in the senate, which now will force pelosis hand and all of a your hands, if you will, to take it or leave it because the president has indicated hes supportive of the senate bill. Just go through all of that parliamentary whatever. Im not surprised by that. Thats typical inside the capitol grand standing. If i heard you right, and ive not seen that right, you said the republican leader of the senate doesnt want to negotiate with the democratic house. The president s story, remember, including tweeting today, was that it is the democrats that are obstructing action objen th border. We passed a bill yesterday, and its apparently republican leader mcconnell and the president unwilling to negotiate. I think what youre seeing is grand standing. My guess is everybody around here understands that we need more resources on the border to take care of what is a moral abomination. Whatever you think about the wall, whatever you think about the future of our immigration system, children do not sleep on cold cement floors in the United States of america. I think people of both parties want to solve that. If the president says its my way or the highway, hell own that, as he does, but hell continue to own that. Im kidding. So, what are you watching in tonights debate . Well, listen, were about nine hours away. Having done many debates in my life, youve read the briefing books, done the mock debates. Youre ready to get at it. This will be like a heavyweight match. Top tier candidates theres less pressure on them. For those polling at 1 or 0 , this is their moment. Theyve got to break through, put a message out there. Theyve got to be authentic. They ought to have fun, doing the debate tonight. What they have to do is connect with the American People when theyre watching to say, you know what . He or she gets my problems. He or she is going to fight for me when theyre president of the United States. Youre only going to have about eight minutes total. Right. You really have to get out there and lay that marker down. And not stutter one second. Each candidate gets 60 seconds to answer a question, four seconds for rebuttal. It is a matter of minutes for each person to talk. What is your strategy to be successful tonight . Someone said maybe someone ought to just streak across the stage to get attention. I said i dont think thats a good idea, but whatever. Good for ratings, bad for your career. Yeah, not good. Not a good idea. You have to break through. First of all, they have to see you as being able to stand up to donald trump. Donald trump is a brawler. He loves these debates. He loves to go after folks. Yeah. Youve got to see you are strong, tough. You can stand up to this guy and give it back twice as hard as he gives it to you. Its a balance between how much you talk about donald trump and how much you talk your ideas in the four seconds you get to talk. Kate, youre right. My advice would be spend very little time on donald trump. Everybody gets it. Everybody understands the issues as it relates to donald trump. Every second you spend about trump is not talking about lowering Prescription Drug costs, dealing with the immigration issue. All these issues are in front of the American People today. You talk about trump, youre wasting your time. Lay out a positive agenda of where you want to take this nation. Have fun doing it. Be authentic and look at that camera and explain to the American Public who you are and where you want to take this nation. And, as i say, for many of these candidates, come september you have to double your numbers. So you have to get 130,000 donors. You have to be 2 . Youre not getting an opportunity youre going to have 10 Million People watching tonight. Youre not going to have another opportunity like this. July, the debate in are detroit and thats it. Then it will start whittling that field down. You have to get at it, differentiate yourself. In differentiating sometimes is whats the class between candidates . How do they take each other on . Im skeptical with so many people on the stage, so much to say, so little time to say it that there is going to be the fire works between candidates. Do you think the same or do you think thats what they need to do to have a breakout moment . I would be careful of fire works and going after fellow democrats. It may help you in the short term. It will hurt you in the long term. You know, attacking people want to know people are tired of the negative energy. Drawing contrast, i can tell you for the governors that are there, i can tell you, having almost run for president myself, the governors are going to say, you all talk about it in the senate, in the house. We actually do it as a governor. I can tell you right now thats what the governors senators will come out and say my plan is better than your plan. Theres not a lot of difference between the candidates as it relates to the polishes. Im telling you, kate, every Single Person has rehearsed one or two zipgers that theyre going to use, get in. Theyve got to get in some line that people are going to remember them. Every one of them has memorized a couple of lines and zingers tonight that people can take away from tonight and remember, that person said that. Is their timing right with that line .
