In that interview with the daily caller President Trump was denouncing the presence of armored cars and claiming others objected to the methods saying im speaking for a lot of people that were very disappointed to see that go down that way. When asked whether he would review the use of these tactics in the future he said i think it is a good question. He argued that stone didnt pose a risk of harming the fbi agents who showed up at his house. Trump said he would allow the Justice Department to make the determination of whether special counsel Robert Muellers final report is made public t. Had been an open question as to whether the president s legal team would try to use executive privilege to keep that report from the public, trump suggesting he will allow the attorney general who will be the first one to receive muellers findings to decide whether the report should go to congress and the public. When might we see that report . Matthew whittaker suggested earlural this week that it could be soon. Trump says he hasnt discussed the conclusion of the russia probe with whittaker. Keep in mind trump is saying all of this about the russia investigation as we havent seen him speak publically in six days now. That is very true. Thank you so much. The special counsel is arguing in court that information they handed over to a Russian Company as part of the discovery process in their legal battle with them has somehow ended up on line pushed by a pro russia twitter account. Its more than 1,000 documents that we are talking about. Kara, these documents were also alterred. What are you hearing about this . All of this was revealed in a court filing yesterday against Concord Management known as putins chef because of his close ties to the kremlin. Special counsels office is saying nonSensitive Information that they shared with the defense team has ended up in russia online in a portal and alterred. What they have alleged is that there was a twitter account created in october. It was created in russia according to the special counsels office. They posted to an online portal saying here are documents relating to Robert Muellers investigation. It posted over 1,000 files, some of them were alterred. It was this batch of nonsensitive material. So the special counsels office is saying that now that is time to share the sensitive material in this case, they dont want the same thing to happen. They are asking the judge to make sure that this information is contained in the u. S. And if the defendants want to see it that they should come to the u. S. And look at it. They dont want it to end up in russia. Not just because of the documents being posted online now and in some alterred form to discredit the investigation. They said that there are identifications of individuals and entities that have not been charged in this case but at the u. S. Believes is continuing to try to interfere in u. S. Politics. Lets start with the president talking about the russia investigation. He said he is going to leave the decision about the final report up to the Justice Department if and when, if and how and when to release the mueller report. If he stays out of it, what then is there left for the Justice Department to consider on this . This is not some great concession by the president. The regulations say that it is up to the department of justice what to do with the report. The way it is supposed to work is mueller files his report with the attorney general whether it is Matthew Whittaker or william barr. Then the attorney general has a couple of important decision points about whether to release it, how much, whether to allow objections for executive privilege. The president is supposed to have no part in this. He says i could have shut it down, perhaps but only at his political and legal peril. Trump says he hasnt talked to Matt Whittaker about it. We know bill barr testified he hasnt spoken to trump about the mueller investigation. It is not like the president hasnt made clear over and over again his opinion about the whole thing. Speaking to them directly, does it mean much . Its good in the sense that you dont want the president to be directly leaning on them. We all know what he thinks. Barr knows what he thinks. At least he is not babying them and trying to interfere with them in person. At the end of the day they know what the commander in chief wants to happen here. We are relying on the integrity of bill barr to do the right thing to comply with the regulations and release as much as they possibly can. Stand by to stand by on that one. The president criticized as how the arrest of roger stone went down. When you look at the interview, he didnt raise it. He was asked about it. He was asked about the fbi and the conduct if you will thrks tactics by the reporter. He does say it is a good question about the tactics of whether the fbi tactics went too far. Is it a good question about the fbi tactics . Not in this case. Roger stone brought this on himself. You have two options as a prosecutor. You can allow them the courtesy of surrendering or you can do exactly what was done with roger stone. You knock on the door at 6 00 a. M. Roger stone is charged with strong counts of obstruction. He threatened to kidnap a witnesss dog. When you do that kind of thing you give away the right to the courtesy of surrender. Muellers team had a search warrant for their home. You cant tell someone we need you to surrender tomorrow at 11 00 a. M. At which point we will be searching your home. You need the element of the unknown. It would be nice. If and when im arrested i hope that is what they tell me. I want to talk about this. It might not be as remarkable. For a lay person, this is a remarkable turn of events with the special counsel and what they are arguing in court that the documents that they handed over as part of the discovery process in this legal fight with this Russian Company that they were published online and in an attempt to discredit the mueller investigation. How big of a breach is that . I think it is remarkable and it is highly unusual. It is uncommon to have a case in criminal court where your alleged criminals are not in the united states. They are in russia thmpt judge is in a tough spot in a way because if the defendants were here there is no question they would be subject to the courts jurisdiction. They are at a hard spot here because the defendants have a right to defend themselves. They have a right to see the discovery. They dont have a right to disclose it in public. I think they are going to end up with a middle ground here because the defends need to see some of this. I think they may require them to sign some nondisclosure agreement even if it is not enforceable. At the end of the day the Justice Department has a choice. If they refuse to come, you cant try someone without showing them what you have. Thats the fascinating legal conundrum of Counter Intelligence cases that we are talking about here thmpt material that is posted this time importantly was not Sensitive Information. They do have Sensitive Information that special counsel is trying to prevent from having to turn over as part of the discovery process. To your point, jennifer, a defend has a right to see what they have when they are trying to defend their case. Who has the better argument . Muellers response is you want to see the discovery come here to court. I wonder why trump is so angry. He gets the same intelligence you assume in his intel briefings every day. He does. I think there are two issues here. One is dan coats who actually is sort of the last survivor from the original part of the National Security team, everybody else has been fired. He is on his third National Security adviser, second secretary of state. I can run through the list. A former senator, former ambassador has been there throughout. Coats is also the sort of quiet understated representative of the establishment who you wouldnt expect would do that well with donald trump. He stayed out of the limelight by and large. The worldwide threat assessment forced him into public. He really had to go out and speak in public. We hadnt heard from him much since last summer when he admitted he hadnt been told much about the meeting by Vladimir Putin at helsinki. Coats gave the standard Intelligence Community assessment of where we were on north korea, on iran and isis. There was nothing in there that was surprising. But the president doesnt view the Intelligence Community as a group to give him objective advice. He wants to hear their public pronouncements in ways that would reinforce the decisions or world view that he has already taken or maintains. And on north korea that means it has to be great progress. When dan coats gets out there and says what he says which is they have not taken steps towards denuclearization or when he says isis still has thousands of fighters in 12 different divisions around the world, it directly contradicts what the president appears to say. When it comes to as you perfectly mentioned, coats is a former senator. He knows how these hearings go. He knows how it will play out. Of course, they need to give the senate the facts. Of course, they need to give the president the facts, the assessment as they see it. Do you think coats was make ag choice when he did so publically in the hearing this week . You know, i thought that the statements in the review were a little more forth right than i had expected them to be. They could have said in an unclassified version that while north korea has suspended its rocket launches and this and that, its hard to know what is happening behind the material. They could have fudged it. On isis they could have said they lost vast amounts of their territory but small elements of them remain. Instead, they were pretty straightforward. I are had members of the Administration Come to me since and say you guys are making more of a Division Within the administration than is really there. He was providing a straight on assessment and you guys have to view everything through Donald Trumps eyes. I think it is the reverse of that. I think Donald Trumps reaction to the public stuff was actually more telling than anything that intelligence agencies toeld us. In the end, dont take it from us that there was a division. Donald trump think tlz was a division in what was said by the intel leaders and what he said. I do wonder what you hearing about the letter from Chuck Schumer sent to dan coats. You cannot allow the president s illadvised and unwarranted comments to stand. I believe it is incumbent on you to insist on an immediate meeting with the president to educate him about the facts and raw intelligence underlying the Intelligence Community assessments. I mean, the fact that schumer released the letter in public tells you everything. They meet with the president at the intelligence briefing every day. They dont need to call for a separate meeting with the president. The president knows what this intelligence says. And probably in private he is perfectly happy to have the intelligence say what it says. The problem for him comes when it conflicts with his job as first salesman. So i have written stories, cnn has run stories that have said the North Koreans are continuing to build up their nuclear fuel stockpiles even though they are not conducting nuclear tests. The president will denounce those frequently as fake news. It does not come and help him a whole lot when his Intelligence Community comes to the exact same conclusion that you just heard on cnn or read on New York Times or wall street journal or other news organizations that have covered this. These are the underlying facts. You know, it tells you more about the way the president thinks about intelligence because the president could hear that intelligence and say that is fine. Im still right to pea doing what im doing in dealing with kim jongun directly. And the only way we will get this stopped is if he and i reach a deal together. He can take on board the intelligence and still ratify his approach. He doesnt choose to do it that way or view it that way. He views it all as personal criticism. That is a really important point. All the same, they are supposed to be meeting again at the end of sometime towards the end of february. Lets see what kind of progress they see. Well talk more later. Reporter significant statement there because Going Forward negotiators have been discussing how to resolve this Sticking Point that of course led to the Government Shutdown 35 days, the president s demand of 5. 7 billion for his border wall. Pelosi at that point said no way she will give him any of that money. Today make tg clear that Going Forward also any agreement would not include money for the wall. So the president seems to acknowledge that in his tweet this morning suggesting that they are wasting time discussing it and he may be doing things on his own. Well see if the president decides to declare a national emergency. It doesnt look like he will get what he wants. Will they avoid a shutdown . I agree with her fully. She has been firm and effective. President trump has always wanted to run our government through executive fiat, some sort of fake announcement of a crisis that doesnt exist will be his approach. I hope we can avoid another shutdown and all the pain that it has cost and the Economic Growth that it has interfered with through the trump shutdown. A wall is just snot going to happen. I have heard some democrats who are on this negotiating committee who dont want to really have a bunch of money going to the wall saying that they are open to some wall money in order to dont let the perfect be the ending of the good. You clearly dont see it that way. There have long been some fences or barriers in urban areas, el paso for example for decades. If there is some repair or restructuring of those, yes. The idea of continuing to build a wall across the country with the president s only compromise being that he would do it with steel instead of concrete and call it a fence instead of a wall, that is not going to happen. I wonder even with what we hear from nancy pelosi that any repairs will be a part of that conversation in this legislation. I want to get to other news that has been going on. In other news, democrats right now are demanding information from treasury secretary Steve Mnuchin about a potential conflict of interest. This is a link between the secretary and russian billionaire who was the subject of sanctions. He is a putin ally. Hefty sanctions were slapped on countries. These are sanctions that mnuchin announced are being lifted despite some big pushback coming from congress. You think this link between the republican donor and the link to this Russian Oligarch presents at the very least a conflict of interest in that mnuchin should have recused himself from that decision. Have you heard back a reason why he did not . Well i think he should have at least sought ethics guidance from in the Treasury Department and further information is needed, the very information that my colleagues, the top democratic on the Senate Finance committee have requested from him. Those are the kinds of answers we needed long ago. As you know, this sanctions law was designed to change russian behavior. President trump fought adoption of the bill. He then tried to water it down. He then issued a signing statement to try to limit its effectiveness. It took months for them to put sanctions in place all designed to change russian behavior. We know that behavior has not changed. Even this mornings announcement from special counsel mueller of the Russian Disinformation Campaign on the investigation of collusion and obstruction that the russians are still actively involved. Their engagement abroad, they havent changed. All that has changed is that when the Treasury Department put a sanction in place, they were willing to come in on a sunday afternoon and ignore a vote in the house and senate and undo and lift that sanction. That is wrong and we do need to know whether mr. Mnuchin had some personal and family connections with someone who had something to gain out of this transaction. The Treasury Department spokesman spoke to the New York Times and said any allegation is absurd. Is this a phishing expedition . Its not like if mnuchin recused himself you would have supported that move anyway. Is this a phishing expedition . Let me make it clear. I certainly wouldnt have supported lifting the sanctions based on the information we have now. New information coming out again within the last 24 hours that the socalled independent party that they put in to change behavior here is not very independent of the russian thug who is a friend of putins. Its not a phishing expedition. I asked mr. Mnuchin this question. We sought additional time to try to get to the bottom of this and have it be an entirely nonpartisan investigation. Treasury would have no part of that after initially suggesting they were willing to meet with us. They have declined that. Mr. Mnuchin refused to appear in front of our ways and means committee. It is a sorted deal. If there werent a problem with this, he would have engaged i think in a very different approach thmpt bottom line for the American People though is they are willing to do extra things to make an a Russian Company an ally of mr. Putin get the special treatment. They are not willing to protect the American People. It will be interesting if and when mnuchin agrees to appear to answer questions thmpt chairman of your Committee Said he is looking to get Donald Trumps tax returns with the new democratic majority in the house. How are you going to do that . You know, i made six or seven motions to our committee that were obstructed by republicans during the last congress. And i support the chairmans effort fully to use an almost century old law that is on the books that does not require a subpoe subpoena in order to complete the work of our committee on the confidence in the tax system, on whether donald trump got special tax breaks that some have estimated may amount to over a billion dollars in the tax law that he signed. All it takes is the signature of the chair of our committee to make a request to the Internal Revenue service. I hope that can happen soon. I believe we should be thorough and careful and nonpartisan in our approach. We should also be timely. Its important that we get not only the personal returns, but these complex business transactions the president has been involved in, many limited partnerships that he is a part of that may have had significant foreign money involved. We need that in order to do the work of our committee. What are the chances you will get the tax returns . Do you put it at anything better than 50 50 right now . I think the law is very clear that were entitled to get those returns. If the treasury secretary the same mr. Mnuchin that ducked and dodged on the Russian Oligarchs refuses to do it then we will have to take some court action to get the documents. President trump of course the first president , president ial candidate in recent memory to not follow through on his initial promise to disclose his returns he clearly has something to hide or he would be engaged with the American People and with our committee and it wouldnt be necessary to make the request. American people without the tax returns pointing out he would be the first that did not release the returns did not think it was any reason to not put him in office at that time. Its not just the company, but the family behind that company that is part of the lawsuit. Their attorneys are saying if these documents that they want released that they dont want released are released it could expose trade secrets. Cnns Miguel Marquez has more. The allegations are pretty astonishing in how the company, the family knew the problems of the drug and still were aggressively marketing. This is the claim in many lawsuits that the family and the company are now facing and that is why the Company Wants to keep all of these documents under wrap. The family owns Purdue Pharma and estimated worth of 13 billion. In 2017 there are more than 47,000 opioid linked drug fatalities in the u. S. Members of the Sackler Family were paid more than 4 billion between 2008 and 2016. The other piece of the story says the journal saw unredacted documents in the case is that sales as they slumped Purdue Pharma looked for new ways to make money. Purdue fapharma considered branching into the treatment business as the company was under fire for the contribution to the Opioid Crisis itself. The lawsuit names eight members of the Sackler Family as well as the company and current and former executives. The family did not respond to the wall street journal but purdue did by taking out of context snippets from tens of millions of documents. The complaint filed by the Massachusetts Attorney general is riddled with inaccurate allegations. 36 states in more than 1,500 cities and counties around the country have sued Purdue Pharma. One multistate federal lawsuit in 2007 settled for 600 million as part of the plea deal. Purdue was accused of misleading and defrauding physicians and consumers with regards to how addictive it is. The Sackler Family made its fortune from Purdue Pharma. It wasnt until the 1990s in its production of oxyconton that the family made billions. The state of massachusetts wants these unredacted documents released. Purdue fighting it. Mass appellate judge could decide as early as today. Certainly by tomorrow we will know whether the documents are out there and have a much better sense of how this travesty just happened and destroyed parts of the country. With more democrats jumping on the medicare for all train in the race for 2020, senator warren is pushing a wealth tax. Some in party are sounding the alarm, including one of the longest serving governors of New Hampshire, john lynch. He told the New York Times if the democrats want to beat President Trump, their best bet is electing somebody in the middle. So move away toward progressive policies, move towards the center. Thats from somebody who had more than a few president ial hopefuls in his state. Governor lynch joins me now. Governor, thank you for being here. Why do you think in this moment of democrats taking on trump in 2020, its time to go to the center . I think most voters in this country are in the middle. We hear a lot from people on the far left, a lot from people on the far right, but i think most of the voters are moderate, and thats why i think we have a better opportunity of defeating President Trump. You mentioned biden, you mentioned bloomberg in talking about this. But you say there is also only room, really, for one. Which one should it be . You know, as former governor, im talking with everybody. And i will talk with anybody who wants to meet with me and discuss New Hampshire and our way of life here in New Hampshire. So its not clear to me how its all going to shake out. I think over the next several months, some people will enter, some people will drop out. It always happens that way, so we just have to see what the final list looks like in the end. Yeah. There is one person who is thinking about running, talking about running who calls himself exactly kind of what youre calling for, howard schultz. Hes a centrist independent is what hes going for. Hes thinking of running as an independent. What do you think about that . Well, i have respect for howard schultz. I actually teach the starbucks case at Tufts Business School where im currently on the faculty. He has done a great job of dealing with his people. But i go back to 2000 here in New Hampshire. Gore lost by 7,000 votes. Ralph nader got 22,000 votes. If gore had won New Hampshire, little New Hampshire with our four electoral votes, he would have been elected president of the united states. So i think we have to be very conscio cautious as we think about independent candidates. He says if he gets in the race, hopefuls will vote for donald trump, not democrats. But first he has to get in the race, so well see. There was a National Poll this week that found one in three republicans would like to see donald trump primaried. 65 said they wanted him to be the nominee, but regardless, New Hampshire was the state that trump first won in the republican primary in 2016. Where do you think New Hampshire republicans are now . I think theyre split. I think some are very much opposed to donald trump, but i also think he has a base here. And i think it would be hard for somebody in a primary to beat donald trump, even in New Hampshire. Yeah. Well, the incumbent always has a leg up, thats for sure. Lets see how it plays out.
