Lifetime ban from the banking industry. It is now more than three months later, no information from mr. Kelly, were told that Political Leadership has been preventing him from speaking with us and if thats true, certainly disappointing. Two weeks ago you were interviewed on fox news by ed henry, he asked you several questions about mr. Kelly. In the interview, you said the details were private and that none of us really know what happened. My question is, if mr. Kelly is happy to share the details of his ban, is he not telling us the truth or are you stopping him from doing that . I think mr. Kelly, if hes willing to share that with you, he should do that. Terrific. And i would encourage him to do so. And because we do think it is important issue of transparency. Im glad to hear that. The fdic ban is not the only concern about mr. Kelly. It has been widely reported that his family abuts a Super Fund National priorities list site. Hes the head of the super fund program. Creating at least a perception of a conflict of interest and he might be favoring the site that is next to his property. Youve mentioned that one of your goals is one of your values is youre committed to good stewardship of taxpayer resources. Has this financial conflict been reviewed by epa ethics officials and if so were they provided with all of the necessary information to conduct that review . I dont have knowledge about that. If that happened or not. All right. Certainly we ask that that be done. When you came to testify before the subcommittee in december, you claimed you had to remove scientists from the Advisory Board because of the appearance of a lack of independence. Your deputy associate administrator for the office of Public Affairs is tasked with reviewing millions of dollars of grants for epa, likely including his priority clients from his republican affiliated consuling firm. Were whyyou aware he was workin for outside clients . Im aware that that was approved. Do you have an opinion about that . I dont know anything about the contract. I know the ethics officials approved that transaction. It seems to me if hes working for people outside the agency, with his fingers inside the agency, that could be a lack of independence and ill offer that as my own observation then. You brought in jeff sands, facing a very large fine from epa, for failing to protect its workers from a dangerous pesticide. Great job. Thank you very much. That was number one on our list, even though we had to approve a couple of things we werent happy with because of some folks that are not friendly to our military. 700 billion and 716 million, and 6 million for opioid. Were going to fight that opioid situation harder than anyone has fought it before. We have already begun. 6 billion for opioid and stopping that scourge and also for working with those that have unfortunately met with the opioids in a very bad fashion. So were going to spend a lot of time, a lot of effort and now we have the money. Thank you all. Thats great. Dan served as an infantry squad leader of Task Force Tacoma in iraq in 2004. While on combat mission, his vehicle was struck by a roadside bomb. Dan was severely injured, ultimately losing both legs. Through countless surgeries, dan refused to give in. He is a fighter and hes a champion. And the Wounded Warrior project was there to help dan along his difficult journey where hes had such tremendous success. Dan is now a nationally recognized motivational speaker and works to serve other veterans and their families. I also know from personal experience that dan is a great golfer. Mr. President , how much of your legal work was handled by Michael Cohen . Well, it is a percentage of my overall legal work. A tiny, taipei little fraction. But michael would represent me and represent me on some things. He represents me, like, with this crazy Stormy Daniels deal. He represented me. And, you know, from what i see, he did absolutely nothing wrong. So there is that. And there is already maybe possibly legal fallout from that interview that President Trump did just starting at 8 00 this morning with fox. Joining me now, cnns Brynn Gingras live outside the courthouse in new york. It is a wild morning, so what is happening there already . You took the words out of my mouth. A wild ride from 8 00 this morning to now. Let me tell your viewers, everyone was supposed to come into court, trumps organization, attorneys, cohens attorneys, the government. And the judge in this case wanted to know how cohens attorneys and the Trump Organization attorneys were going to filter through all the privileged documents that was taken from Michael Cohens home and his office and his hotel room earlier this month. That was a purpose of today. Then that fox interview happened where the president went on there and you heard it just now say that Michael Cohen did very little tiny fraction of legal work and that really just bolstered the governments argument that there really isnt much privilege documents here. So why are we even arguing, so they actually put a filing into court late this morning, ahead of this hearing, saying, you know what, were going to take back the fact that we didnt want a special master in this case, remember, special master is someone who is totally neutral with this whole thing, who looked through all the documents and siphoned through them, decided if any privileged documents that would sort of contradict or have any implication on Attorney Client privilege. So certainly we have 45 minutes until court starts. We dont know if anything else is quoing to happen. There is going to be a lot that is going to happen when it gets started at noon today. We know hes left his hotel room where hes been staying. He said he was feeling good. Well see if he shows up here. Well see what happens in a few more minutes. Great to see you. Thank you so much. Do we start with the legal or the political . Er that ail o theyre all one and the same. Give me your take. Does it surprise you the government has already taken what was said in a live interview and applied it in federal court now . Well, absolutely not. What the president said was essentially there is a tiny fraction of documents that may reside in the Cohen Law Office that relate to me. And so the government said, fine, if thats your position, then well take a special master, look at those tiny percentage of documents, and well put this thing to bed and move forward with our prosecution against investigation against Michael Cohen. So the president , again, shoots himself in the foot legally. And the government takes advantage of it. And this should wrap up much more quickly than we thought it might otherwise. Dana, thats one part of what the president said in this fox news interview. As it relates to his personal attorney Michael Cohen, the other tidbit that Stormy Daniels attorney is jumping all over, especially, is that donald trump says that when Michael Cohen represents him in a teeny in a few little things, but including that crazy Stormy Daniels thing, i have the sound bite, lets play it for our viewers, listen. As a percentage of my overall legal work, a tiny little fraction. Michael cohen said previously and hes been unequivocal about this, that the president knew nothing about it, that he did it on his own, that he went out and negotiated this agreement and paid the 130,000 without any involvement or knowledge by the president. And you cannot reconcile Michael Cohens statement with the air force one statement, with the statement today. You just cant. Thats the president and michael avenatti. What do you make of it. He represents me with this crazy Stormy Daniels deal. He represented me. Why is that so significant now . It is a gift to michael avenatti. You heard him make that very clear, that to hear the president of the United States during this sort of legal confrontation and these arguments back and forth about the about the contract and whether the contract is valid, but even more broadly about whether or not the president was aware of the fact that Michael Cohen made this deal. And paid her 130 grand in hush money. The president made pretty clear he knew about it. Now, he didnt say if he knew before or afterwards, but he knows about it. And more importantly he said he represented me. I will let the lawyers sort of add to this, but just from my initial reaction, since we have been talking about this for so long, if he admits that Michael Cohen helped him with the Stormy Daniels thing, hes admitting that Michael Cohen was his lawyer in the Stormy Daniels thing, which brings up a whole opens up a whole other can of worms politically and more importantly legally for Michael Cohen and the president on that particular mat, never mind what we dont even know about that the feds found in their search. There is a question, if what were hearing from the president this morning is contradictory to what we heard from the president on air force one. Asked about knowing about the payment to Stormy Daniels on air force one, the president said no. If is that necessarily contradictory . It sounds conflictually to me. Youre hearing he wasnt representing him, he was. Im interested in seeing what version of reality the attorneys go forward with in court next. The problem is i just dont know how you reconcile these different statements. That creates some problems for the cohen team because hes made certain representations to the court. Theyre going to have to sift through to see what can be specifically attributed to him and whether it is consistent with what his client is saying. Trumps not under oath when hes talking to fox news. He can take that back. That creates some political problems and his story keeps changing. Nia, just in general, the tone of the president this morning was something that is absolutely noteworthy. We can get into the other topics they took on. But just his tone. He seemed angry. Yelling into the phone at one point during the interview. Yeah. Listening to it here, the sound of all of the really disembodied voice. Coming through the television. Coming through the phone there, full of anger, full of rage, full of grievances, really. He saw this really as a way to make some political points, political points against the democrats in terms of jackson, political points in terms of where he wants to frame this whole Michael Cohen thing and distance himself. He made the case why he was such a hard client and why lawyers dont want to touch him. Hes damaged his case, it looks like, or Michael Cohens case, it doesnt look like hes done himself any good in any way with that interview. And just doesnt seem wise, certainly, legally maybe politically certainly, i think if youre a fox news viewer, youre probably going hallelujah and amen to what youre hearing. Even though in that interview, what was also interesting is that you saw steve ducey push back against the president and challenge him on some of the assertions he was making, particularly about the Justice Department. This is a republican led Justice Department, these are your people. What do you mean, there is a witchhunt going on, the Justice Department. Well see. Is this something that donald trump will continue to do . In this weird way hes someone we hear from a lot on twitter. But in terms of this kind of interview and 10 or 15 minute interview, on his favorite show, we dont really hear him answer questions and make his case in such a pointed and full of fury way that we did this morning. It felt like these the weekends tweets come alive is what it sounded like this morning. Michael, i want to talk about doj. Before we leave this issue of Michael Cohen and the case that is before him, and the president s reaction to all of this, michael avenatti, he said that this what donald trump said this morning adds momentum to them getting closer to deposing the president in their case because of the contradictory statements that they say are out there. Do you think thats true . Well, a couple of things. First, theyre moving to stay these proceedings altogether because of Michael Cohens assertion of his fifth amendment right that relate to the Southern District. The judge in california has to decide first whether hes going to let this case go forward while the Southern District is investigating cohen on criminal matters. Assuming it is something that goes forward. Then avenattis point is well taken because what hes going to say is there are contradictory statements from the president of the United States and the only way we can reconcile them is for me to take testimony from him in the form of a deposition. I think it adds fuel to what avenatti wants which is testimony from the president under oath. So, yes, it does. I get to say this again, and there is more. If you could all continue to roll with me, we have new information coming in, attorney general Jeff Sessions on the hill as well, speaking about being asked about this morning the Michael Cohen case. Attorney general Jeff Sessions in a house hearing just now was asked about his refusal to recuse himself from the Michael Cohen investigation. That happened yesterday. What he said. Today, listen to how he says it today. Attorney general sessions, you recused yourself from the russia investigation led by special counsel mueller. It is my understanding that this week you decided not to recuse yourself from the investigation of Michael Cohen. The investigation into mr. Cohen was opened in part on a referral from muellers team. In fact, Deputy Attorney general rosenstein approved an fbi raid of mr. Cohens home, office and row tell room. We know President Trump had a strong reaction to the raids, denouncing them, quote, on an attack on what we all stand for. He took that opportunity to reiterate what a terrible mistake it was for you to recuse yourself from the russia investigation. Im a little puzzled. Why have you decided not to recuse yourself from the cohen investigation when it appears to be so closely linked if not rooted in the Russian Investigation . Presumably you read that in the media somewhere. Media often not fox 5. It is often inaccurate. And much of what i see in the print is inaccurate. Let me just say this quite clearly to you, i will honor the commitment i made to recuse myself from matters that i should recuse myself from. And i intend to do that faithfully. I made that commitment and i have done so. I have not violated any commitment in that regard. Im not able to comment about any on going investigation or investigations certainly that are within the ambit of the special counsel. I appreciate your response. Ill assume that the news reports are not true and you have not recused yourself from this investigation and you have not decided that you will not recuse yourself from the investigation into President Trumps personal lawyer. But i will im just not able to discuss any of the details because of the policy of the department, i think, is correct. That when you Start Talking about matters detailed and talking about investigations and policy is not to discuss investigations until it is appropriate. That clear it all up . Let me bring back the panel now, walter, nia, dan and michael. Walter, let me ask you this is a key question, you heard what Jeff Sessions said there. Yesterday, in another hearing, Jeff Sessions was asked, would you recuse if the cohen investigation overlapped with the with the aemllegations o russian interference. He said yes. Today, he didnt want to say anything. Yeah. It is interesting that he now says that he cant comment publicly on recusals because he commented publicly on his recusal from the mueller investigation. He is right in one respect, if there is overlap, he has to recuse. The nature of the criminal conflict of interest statute, you have to recuse from the entire particular mat, not from part of it. He doesnt get to pick and choot parts that he thinks dont affect his interests. The question boils down to, is it the same investigation . And so if he does not recuse, it is a statement that the cohen matter is unrelated to the mueller investigation. But if it is related, he has to recuse and a failure to do so would be a violation of a criminal statute. Walter is so understandably looking at the rules and facts and sort of the protocols. Lets talk turkey here. The reason Jeff Sessions did not did not say, yes, he will recuse himself and the reason he twisted himself into a rhetorical pretzel there is because the president of the United States is still and always will be livid at him for recusing himself from the mueller probe, from russia, which then ended up in a special counsel and the name of robert mueller. Not just that, you talked earlier about the things the president said on fox this morning. One was going after his own Justice Department, that means Jeff Sessions, hes the attorney general, hes the head of it. And saying there are people there that shouldnt be there. I mean, doesnt take a lot to figure out who hes talking about. And that is Jeff Sessions who he said over and over again he would love to get rid of because hes so angry at him for the orblg nall original sin in all of this. Lets play what he said about the Justice Department. They have a witchhunt against the president of the United States going on. Ive taken the position and i dont have to take this position and maybe ill change that i will not be involved with the Justice Department. I will wait until this is over. It is a total it is theyre all lies and a horrible thing that is going on. Horrible thing. Im very disappointed in my Justice Department. But because of the fact that it is going on, and i think youll understand this, i have decided that i wont be involved. I may change my mind at some point because what is going on is a disgrace. It is an absolute disgrace. I might change my mind at some point with regard to getting involved with the Justice Department. What do you think hes threatening here . I mean, i think we know what hes threatening. In some ways what hes been threatening all along, to remove Jeff Sessions. And dana talks about this. This idea that he remains apr s apopleptic. We know hes been disparaging about Jeff Sessions both publicly in terms of what he said there in that interview, on twitter. Privately. Apparently calling him mr. Magoo also. There he was, again, full of anger at Jeff Sessions and i imagine dana is right, there was Jeff Sessions during that testimony saying not really wanting to comment on whether or not hes recused himself on that investigation. But you even wonder if that will satisfy the president because he seems so upstanding and wanting to follow regulations there and that is what has put him in hot water with this president. The president continuing to dangle this idea of removing Jeff Sessions. Essentially stay tuned. Hes been good so far. That might not continue because of what he says is this continuous witchhunt at his Justice Department. Stand by. Michael, hold on, well get in a quick break. Members of the House Committee grilling him on a long list of allegations that hes facing from first class travel to 24 hour security detail to huge raises for close aides. Thats just some of it. Hes facing in all ten investigations by the he is. I will say hes coming out swinging here. Were over an hour and a half into this hearing and the chairman of the subcommittee started out saying, look, these allegations, theyre disturbing, we wont ignore them, the democrats opened up saying we want you to resign. And pruitt opened up saying hes blaming the media and that these headlines are half truths. And it is only an effort to undermine the president s agenda. Keep in mind, this whole hearing is about the epas budget and theyre discussing this a bit. But a large portion of this is about those ethical questions. Those issues, those negative headlines facing scott pruitt. Everything from the sweetheart condo deal where he stayed at this condo that belonged to a lobbyist who also happened to be a friend, also about those pay raises for two epa employees which we have reporting that the white house was not on board with giving those employees raises, but pruitt or the epa gave them those raises any way. He was asked about that, again, remember in that fox news interview, he denied knowing anything about those raises. The issue came up today and it seemed like a slightly different story. He wouldnt go that far saying he didnt know about the raises, he only said today that he didnt know about the amounts. Take a listen. Did you, administrator, authorize mr. Jackson to sign the documents for you . Congressman, those were delegated to mr. Jackson and Inspector General did reference that in his management alert. So he you did authorize him to sign them . Those decisions that decision was made by yes or no . There are delegations given that authority . Thats a yes . The Inspector General recognized that, congressman. So you authorized mr. Jackson to sign those documents for you. An internal emails, sarah greenwalt, one aide who received a raise, said you were aware of and supported the raises. Was that true . I think with respect to the raises was that true . Congressman i have five minutes, so i have to move along. Was that true . I was were you aware of the raises. I was not aware of the amount, nor was i aware of the bypassing or the ppo process not being respected. Okay. But he told fox news he didnt know about the raises at all. Didnt say that again today. Interesting to note, pruitt did not accept the help, he turned down the help of the white house to prep for this hearing. Were being told that it is because his team believes that there are members within the administration who are trying to essentially undermine him and get rid of him. I can tell you that at this point it is do or die most likely for pruitt as far as his performance in this hearing. It could determine what happens to him next. All right. Thats because he believes people in this administration are actively trying to push him out of his position at the epa and thats why they rejected those offers from the white house to prepare for this grilling, because they felt anything from that press release would leak. The white house was telling lawmakers on capitol hill they didnt have to defend him as adamantly as they had been. This all comes after scott pruitt lost the confidence of several people at the white house, including Jared Kushner and ivanka trump, also other senior staffers who do not believe these probes into his physical activities will exonerate him, kate. Walter, as you were watching scott pruitt on capitol hill in his Opening Statement and beyond, if his goal today was to set the record straight, as he said, say fiction is fiction, and say a lot of what was being said are halftruths or even worse, and to say that this isnt going to get in the way going forward, mission accomplished, do you think . I think hes actually come off kind of badly because he really dodged a lot of questions. In that excerpt that you played, you noticed the passage of the language, he was unaware of the bypassing of the ppo, they had requested promoting him. In fact, these raises were not really just raises, they were taking somebody off of one appointment authority, basically quitting one job and getting put in a new job that you could only get put in under special Legal Authority that required the administrator himself to approve it. Its possible that, as he says, he had delegated some authority to the chief of staff to do whatever the chief of staff wanted, but its just completely i implausible that anybody would think this action would have happened without his knowledge, particularly because he had been campaigning for raises at ppo. And i think he moved toward kind of admitting that, but the fact he did it in a squirrely way i think hurts him a little bit. That was true of a few answers. He did have some fans on his committee who tried to turn this essentially into a pep rally for deregulation. Which says if we like you, ethics dont matter. Thats a problem, because ethics should matter. One example i thought was interesting, i think it was joe barton, who asked, is flying first class illegal . He said, no, its not illegal. I think youre missing the point when facing an ethics question. Dana, i regress. Heres the key. Her sources are saying hes losing the confidence of key people in the white house, but it doesnt sound like hes lost confidence of the one person that matters in the white house, President Trump. Is that the only thing that really matters . Its absolutely the only thing that matters. If it were up to many, most of the senior people around donald trump, scott pruitt would have been gone long ago. Ten ig investigations . Ten . Its a big deal when theres one. Its pretty remarkable. Lets also look at the politics of this. The idea of somebody like this with all of these allegations, being in the president s cabinet and the president holding on for dear life to him, is not helpful, to say the least, to the republicans who are on the ballot in november. Especially when theyre facing voters, many of whom supported donald trump because he promised to drain the swamp. He promised things would be different. He promised he would be a disruptor. Even just one or two of the allegations against scott pruitt are classic washington is above it all. It is, right. I dont follow the rules. So it sort of adds to that atmosphere in that kind of sort of, are you kidding me factor that is really hard to explain to voters. And yes, as walter was saying, there are a lot of conservatives who want to look the other way because he is delivering on deregulation and on epa issues. But its a question of how far theyre willing to go. A lot of people will do that. Give me your take on it. Where do you think scott pruitt stands . Hes dodging some, hes answering others. What happens now . Well see, its all up to the president. We always talk about the audience and that is particularly true here. My tic is he seems to be doing pretty well. If youve been following this closely and youre walter, for instance, you know his answers are kind of squirrely, hes dodging questions, but he seems pretty confident, he seems to know what hes talking about. And i wonder if the president will look particularly at the republicans coming to his defense and say, look, hes got republicans who like him.
