For bringing on mueller and being from baltimore, maryland, where the president says very few republicans live. For the special council, bob mueller, the president had a warning, stay away from his Family Finances or else. As for the fired fbi director, the president leveled a new accusation against comey, saying he thinks he used a solation dossier. They discussed russian adoptions, which means they discussed sanctions, which is more than small talk. Lets get to it. Beginning with stunning comments about Jeff Sessions. Listen to this. Sessions should have never recused himself. If he was going to recuse himself, he should have told me before he took the job and i would have picked someone else. He gave you no indication . Zero. Jeff sessions takes the job, gets into the job, recuses himself. I then have which, frankly, i think is very unfair to the president. How do you take a job and recuse yourself . If he would have recused himself, i would have said thanks but im not going to take you. Lets get today that bash for more on this. Dana, theres a lot more on this. There she is. You are finally in my monitor. Sessions just responded, finally, to the president s criticism. Lets play the soundbyte, then i want to ask you. Listen. We, in this department of justice will continue every single day to work hard to serve the National Interest and we wholeheartedly join in the priorities of President Trump. I have the honor of serving as attorney general. Its something that goes beyond any thought that i would have had for myself. We love this job. We love this department. And i plan to continue to do so as long as that is appropriate. How long it is appropriate is a huge question right now. What do you make of this response . You know, i have to say that most people, many people, i should say, probably would say, im done. I am out of here. To have that kind of public slap across the face from not just your boss, but the president of the united states. Pretty intense. You know, when i say public, i chose that word for a reason. We have been reporting a lot of this realtime, that the president has been angry, furious, at Jeff Sessions since the day he recused himself and im told by people who talk to him frequently, anybody who is within five feet of him, that he believes that sessions recusing himself is an unforgivable act, not just because he was taken off guard, but also because, as the president said in the New York Times interview, all of the things that happened, the domino effect, as a result of the recusal. The Deputy Attorney general taking over. Him deciding to appoint a special council and so on and so on and so on. So, that anger has been not just simmering, it burst into the open by heeind closed doors man months ago, the fact he, the president , decided to do this in public is noteworthy. I think, look, he was with reporters. He was known for a long time, maggie, chief among them, and hes comfortable and he was sitting there without a camera and he felt like he was going to tell them on the record what he had said in private. Again, to have that kind of trash talk and anger in public and to have the attorney general stay in his job is very interesting and i think the way you came to me, kate, asking, okay, hes staying now, how long is that going to last is the key question. Absolutely is. Another big question this morning is simply, why did the president give this interview in the first place . I dont know the oanswer to that. He enjoys talking to the New York Times. Even though he calls them a failing newspaper and, you know, all the sort of look, im not criticizing, more interviews the better. Exactly. More interviews the better, absolutely, with anybody he wants to talk to, no question. With the New York Times in particular, hes a creature of new york. He grew up with in a place, in a town that revered and still reveres the New York Times. He has a relationship with some of the reporters that goes back many, many years. I think that is probably the answer. I think, what you are getting at is a very important notion, which is the president had a pretty good day yesterday. He came out with leadership, finally, on health care, politically and in terms of substance. He called all of the republican senators to the white house. He was both tough and kind of, you know, fun and irreverent and got them talking again on a major, major policy issue. Senators, because of that meeting were on capitol hill burning the midnight oil to find a deal. He take that is Steering Wheel that was going on the right, you know, on the right road and he turns it off, into, i wouldnt say a ditch, but definitely a side road that many people did not want him to go on. They wanted him to stay focused. It detoured, if you will. Perfect word. Thank you for finishing my metaphore. We love a metaphore, which i always butcher. Great to see you again. Thank you. Jeffrey toobin, what was your reaction when you read what the president said about Jeff Sessions . Part of it was, Jeff Sessions recusi recusi recusing himself was unfair to the president. Was it unfair . No, the right decision to make. But donald trump makes decisions based on how they affect him. Itis had negative implications for him. The problem is not with the procedure. The problem is with the fact his administration had all these connections, this campaign had all these connections with the russian government, russian businesses and then practically everyone in his administration has said false or misleading things about it since then, leading to the appointment of the special prosecutor. Thats not Jeff Sessions fault, its Donald Trumps fault. Trump never sees things as his fault. Sessions is a convenient target. Pam, the president makes clear publicly, he regrets putting Jeff Sessions as attorney general. Are you hearing anything from folks at justice about this today . Yeah. I think a lot of people are sort of shell shocked the president said this publicly. As dana reports, there have been exchanges about the attorney general and president about the recusal. The president certainly expressed displeasure about that. Reporting at one point in the conversation, attorney sessions offered to resign. He said he was willing to. Obviously, that didnt happen. Now that the president made this public that essentially he does not want attorney general sessions in the job or he shouldnt have hired him, having known he was going to recuse himself, that changes things. I asked him about a criminal organization dismantling, i asked how he can effectively certain in his role as attorney general if he doesnt have the confidence in the president. He deflected a little bit. He said i feel like we can continue to run effectively here at the justice department. He said i will continue in my role as appropriate. The question is, what is appropriate, what would make it inappropriate now that the president said he wished he never hired him . Michael, exactly that point. From your perspective, michael, how long Jeff Sessions says, i plan to continue to do so as long as it is appropriate. Give me your guess, how long is that appropriate . As long as the president doesnt interfere with the department of justice. Is he doing that now . I dont think so. I think the department of justice is moving forward with his priorities, maximum sentencing priorities and bring the most serious charges and undermining medical and Legal Marijuana cases. I think they are moving along with their agenda and the president doesnt seem to be interfering with it. They are litigating all over the country as Supreme Court requires them to do. I guess what the president is going to say, he will do this periodically then calm down and move forward. I think thats what sessions probably has to be saying. But, if the president starts interfering with the new administration of justice, thats a dichfferent matter. Go ahead, gloria. Its not just Jeff Sessions. Its the entire infrastructure of the department of justice. In this interview with the New York Times, he complained ant sessions but also about Rod Rosenstein, Andrew Mccabe at the fbi and, of course, he complained about the special council, mueller, saying that, you know, he stabbed himself with a whole load of democrats and its unfair. If you look at every i mean, its all of them, not just Jeff Sessions. Now he is presiding over a team of people who have all been publicly criticized or their motives questioned by the sitting president of the united states. So, you know, i think the president has made it very difficult for Jeff Sessions and made it tough for everybody who serves with him and under him because the president has publicly come out and said, you know, you guys are not fair. Ken, as michael and gloria are pointing, you have impact of the attorney generals work on the russian stuff. It doesnt impact today, the attorney general doing work and announcing progress in their work. 99 exactly. The fact that the president is so upset with Jeff Sessions about the recusal, in that, is he in some way admitting he wants an attorney general to do something about this investigation . Well, this is certainly consistent with the frustration hes expressed over the Russian Investigation in general. I dont think its a change in that sense, in any way. It also suggests to me the president wasnt aware of the attorney generals contacts with the Russian Ambassador and what the then senator sessions said was his role as a senator. You know, i find that interesting as well. Thats somewhat to the president s defense, though its a defense of not knowing, not a defense of knowing and deciding. So, if you are Jeff Sessions and you already offered your resignation and it wasnt accepted, one of us, i forget who said, this is kind of what the president does. Every few weeks or months blows his top publicly. I dont think its okay. If you are Jeff Sessions, you left the senate and assumed the most extraordinary role a lawyer can have, attorney general. Once you offer that resignation, i think he stays there until the president asks him to leave. I dont see that coming. Chris i think thats right. Sorry, i just was agreeing with ken. I think hes going stay until he gets fired. Hes got this job he likes a lot, being attorney general. Its kind of embarrassing that the president attacked him. But the president hasnt stopped him from doing the work of being attorney general and hes going to continue doing it. So, its just, it is what it is. I guess thats where we are at this point. Thats all we can say. So, glory, as you laid out, its not just sessions but bob mueller, well get to him in a second and james comey. He has a new accusation in this interview, a new line of attack when comey, about comey and the dossier with the allegations and brought it to donald trump during the transition. We all know that happened. Trump says this, anyway, in my opinion, he shared it so i would think he had it out there. He asks as leverage and trump says, yeah, i think so, in retro spect . Why is he thinking so much about it . The Russian Investigation is high on his mind right now and hes clearly thinking about that a lot. If i recall, when james comey told the president that and pulled it aside, i think he was the one who drew the short straw and there may have been others in the National Security apparatus who knew about it and, i think it wauz topic of discussion and that comy was the one who told the president that. Why are you laughing . The drawing the short straw. Yeah, well, am i wrong . You can picture it. Fbi, maybe they play rock, paper, scissors. Maybe. Now his motive is being questioned. Mueller was looking at your finances and his finances unrelated to russia. Is that would that be a breach of his actual i would say yes. The panel is back with me. Jeffrey, how would the president know if this council is reaching beyond and what could he do . Well, he could know because witnesses could come forward and say i was subpoenaed to talk about finances or witnesses are free to talk about their interactions with a criminal investigation, even if mueller, himself, does not disclose it. He could fire mueller. I mean, he would have to tell the justice department, which would mean telling Rod Rosenstein because sessions recused. If rosenstein refused, he would move down the chain of command to get someone to fire him. Presumably, he would get someone to fire him. I dont think we could rule that out. I dont think it is out of the question that Robert Mueller will be fired. Donald trump fired the fbi director, why not mueller . On the premise of what he is talking about, he says dont go beyond dont get out of your lane. Isnt that by definition what happens . Ask bill clinton where these investigations go. Folks around the president , they know that. Absolutely. You know, i think mueller and ken star are two very different people, but its very clear to me and i agree with jeffrey, what the president was doing is essentially, what we call in politics a prebuttle, putting him on notice saying this isnt what you are supposed to do. You are supposed to cover the russian hack, you are not supposed to delve into my familys finances and he drew a line there. Then, at some point in the interview, he started talking ability, yeah, maybe i sold a condo or two to russia. He went off on this tangent. Its very clear to me, its on his mind right now and he was, he was telling mueller to be careful. Michael, cnns reporting is that investigators are looking into donald trump jr. s finances as part of their investigation. One democratic senator, richard blumenthal, a critic of the president ,ers specially all things russia, he said the president is offering more evidence of obstruction of justice. Do you see that, michael . Two things about this. First is whether mueller is investigating financial matters related to the trump ecosystem. I think the answer is most likely yes and that is already within his mandate. The mandate that rosenstein gave him on may 17th says all matters related to russia and anything that may arise out of it and whether or not the financial dealings provide motive why the russia trump team met is within his per view. He is not going to see that as a limitation. Secondly, whether or not this is an obstruction of justice, i dont think its obstruction of justice. I think were mueller to be fired, it would be an abuse of office, an abuse of power that would lead to consideration of article of impeachment. I dont think legal indictment before a grand jury says you are going to get obstruction of justice out of that. What is obstruction of justice or abuse of power is much the same. If someone you are looking at, investigating says, dont look at my finances, they are absolutely fine dont look under this rock. Theres no problem. What rational investigator wouldnt start looking at their finances . The thing about the president , like all the emotions are out there in front. You know, it can be a problem. Ken, what is your take on this one . First of all the president didnt, you know, make a threat as you characterized it. He answered a question. In and of itself, on paper, the question, the answer to the question were correct, accurate and appropriate. We dont have an independent council law because on a bipartisan basis, republicans and democrats thought these independent operating prosecutors went too far a field. That is the main concern that continues to exist, setting aside the constitutional concerns and that continues to this day, even though this is under a special Council Regulation of the department of justice. The same concern continues to exist. History has prooicven it a conc. Robert mueller will identify it himself whether he falls into the category or stays involved. Michael . I was going to say, the president said this would be a red line if he crossed it to look into Family Finances. Jeffrey is right the New York Times said it the New York Times said it, not the president. Red line is a serious phrase. The New York Times, not the president. They asked it as a question. Yes, they did. They asked him that question and he seemed to imply, yes, it would be a red line. That would be something that would be a bridge too far for him. But it is part of the mandate, as i read the mandate. The mandate says all matters that arise out of this investigation. Its hard to understand how the investigation of financial dealings with the same people that may be involved in the conspiracy or the collusion wouldnt be part of the mandate. I see it as something that is a misunderstanding on the president s part about what muellers mandate is. Mueller didnt pay much attention to it. He said no, ken defend the president very much but he said Family Finances. I agree with what michael said the question was, mueller was looking at your finances, your Family Finances unrelated to russia, is that a red line . Would that be a breach of charges. Unrelated to russia. I would say yes. I said unrelated to russia when i was talking ability it. Mueller will decide mueller will decide within his discretion whether it is related or unrelated. To decide, you have to look at it. You cannot determine its not related. You have to look into it and say this is unrelated and he can make a referral to investigate any criminal activities that may arise in that investigation unrelated to the mandate. Its all appropriate for mueller to do this. Its inappropriate for the president to threaten mueller, if you go there, you may be fired. That is abusive to me. The sad news that is still sinking in this morning, senator john mccain has been diagnosed with brain cancer. The doctors discovered it after he had surgery to remove a blood clot. He made his first remarks thanking everyone for their support and firy as always, telling congress hell be back soon. Dr. Sanjay gupta is joining us now. Sanjay, this came as a shock to everyone. Its wonderful to see he is a fighter just on twitter. You spoke with senator mccains doctors. What did they say . How is he doing . Hes recovering extraordinarily well. He had brain surgery last friday, hes 80 years old, he had general anesthesia. Doctors told me as soon as he woke up he was cracking jokes and doing well. He spent the night in the intensive care unit last friday, but was discharged to home saturday, which is speedy by any account, especially given the fact hes 80 years old. Hes recovering well. What happens, typically, it takes a few days to be certain from the pathologist exactly what caused this bleeding and they found out over the last day or so, in fact, it was this brain cancer, as you mentioned, a type of cancer known as glioblastoma. Its a tumor that bled. Thats what caused the bleeding. Its a brain cancer meaning it comes from the brain itself as opposed to elsewhere in the body and spreading to the brain. That was a surprise, i think to everyone. The doctors i spoke to, they thought it might be a blood collection from a trauma or blood collection from melanoma spreading to his brain. This was a surprise. Now, they are basically in discussions of what to do next, how to proceed. This is about as serious as z it gets. What are the options the mccain family is kweighing right now . This is an aggressive brain cancer. You know, if you look at the literature, kate, the data, the stats, which everyone is reluctant to do because everyone is different. If you look at the average or median survivals around 1414 1 2 months. 10 of the people who have this live five years or more. He has shown he is able to fight and overcome cancer in the past. But the options to your question, now that hes had the operation are really around chemotherapy and radiation, basically what we call additional therapies. The indications are he is going to proceed with that. You need to wait a little bit of time before starting those therapies to let him recover completely from the operation. The incision, which is in the eyebrow on the left, you have to let that incision heal. Probably a few weeks from now. In the interim, you have heard, kate, you have been saying, hes been up and about. Hes firy on twitter. Hes been making lot of calls. He had a quick recovery after the operation. We can only wish he continues to recover and get back to work, what he loves. Thank you for laying it out. I appreciate it. This morning, senator Lindsey Graham says his longtime friend is trying to figure out the next steps, that includes when mccain could return to work in washington. Itis moments like these that remind us how many close friend this is one man, this senator has on both sides of the aisle on capitol hill. You remember, of course, this moment about friendship during a cnn town hall. Congressman graham with the most solemn occasion said, you know where i come from, any man calling a woman at 2 00 a. M. Is up to no good. I knew then Lindsey Graham was a man i wanted to spend time with. Because hes entertaining. Hes dedicated and, by the way, his beginnings were rather humble as many of you may not know, including the fact he raise zed his sister after his parents died. Its quite a quite a Great American success story. He is loyal to his friends. He loves his country. If he has to standup to his party for his country, so be it. He would die for this country. Hes 80 years old, but he hasnt gotten the memo yet that he is 80 years old. He has boundless energy. He traveled like the energizer bunny. I was talking to Lindsey Graham. John mccain is older than lindsay, older than i am and he would tire us out. He is in physical pain never day. He cant bend his knees or bend his arms over his shoulder because of the broken bones suffered in vietnam. I have never heard john mccain complain once or not reach for his own bag, carry his own bag, be his own staffer. For everybody who is part of the extended mccain family as i am, he is so much more than senator mccain. He is a friend. He is a mentor. He is a buddy. He is an adviser. He is a confidant, a critiquer. He is honest. He is blunt. He will open doors for you and tell you when you are making a mistake. Im honored and proud to be part of that extended mccain family. I have so much faith in john. If theres one word he stands for, its fight. He has never given up in his life. He has seen death in the eye so many times. I know john mccain is not afraid of death. You know . His mom, i was thinking last night, when he was running for president in 2008, there was a big question of should he only commit to running for one term because of his age. You know, i thought what a ridiculous question that was then. His mom is 105 years old and until recently was so vibrant and such a spark plug herself. What do i think . I think john mccain is going to fight till his last breath. None of us know when we may go. We are all a phone call away from bad news. This should be a reminder about how fleeting life is and how important it is to work as hard as we all can, to be happy, to make a difference, to make this a better world and leave it a better world. John mccain has already made this a better world. He has served this country in a way that none of us can express gratitude for. I am so grateful for being part of his life. Well said, anna. Im struck in these moments after 2008, he came back to capitol hill. Every one of us were struck by he didnt have a single aide walking with him. No detail, no nothing. He had gone through a gruelling campaign. He is a worldwide figure. John mccain walking through the halls. When he had to get when he became the nominee and was forced to get secret service, it was a big todo. It was a big fight. He did not want secret service. He drives around like hell on wheels, but he drives himself around. Cindy had to talk to him about the need for secret service, which he obviously needed. He is such a selfsufficient guy. Hes a guy that likes to be surrounded by his friends. He likes to fight. You dont have to agree with john mccain on everything, maybe not on anything to be his friend.
