Warrant before searching the cell phone of a criminal suspect upon an arrest. Before this, police used great discretion to search cell phones without search warrants. In fact the two defendants in this case were convicted in part because of information taken from their cell phones without a search warrant. They argued that cell phones should be treated differently than other items on a person, such as a wallet or a purse, and today the justices in a 90 decision agreed with the defendants and heres what they said. Our answer to the question of what police must do before searching a cell phone seized incident to an arrest is accordingly simple. Get a warrant. The justice goes obto say justice roberts, modern cell phones as a category implicate privacy concerns far beyond those of a wallet or a purse. Of course, this brings into question the larger question of whats going to happen to all of those people behind bars right now that were convicted based on information taken from their cell phones without a search warrant. Thats a big question. I feel some appeals will be in the offing. Another ruling that we want to talk about, obviously, a big deal in our world here on television, one that certainly has tv broadcasters celebrating. Something to do with streaming. Talk to us about this. This is certainly a big win for broadcasters. This has to do with a Company Called aereo and this company essentially used these tiny dimesized atena in as to broadcast it to southbound scribe subscribers. The broadcasters said you are stealing our content. The justices disagreed with aereo and ruled in favor of the networks and said this was a violation of copyright law. New data released this morning says the economy shrank more than expected in the First Quarter, declining at an annual rate of 2. 9 . What all does this mean . Lets ask alison cost to crunch some numbers for us. Its actually a negative 2. 9 . It means the economy didnt grow in the First Quarter of the year. We knew it was lousy. You can blame the weather. The brutal winter in the beginning of the year that slowed shipments not just here but around the world as well. Its weather that kept consumers from going out of their homes and going shopping. It kept businesses from spending. It even kept people from spending money on health care and health care actually represents a sizeable portion of gdp. If you look deeper in this report, exports declined as well. It seems like the economy kind of came to a grinding halt during the first three months of this year. Michaela, john. Looking at this, alison, weve had bad weather before, 2. 9 is a big number, negative 2. 9, the worst numbers since really the recession, 20072008. What does it mean for the average person . If you ask two different people about how they feel about the economy, you are going to get two different answers because the reality is our economy is still recovering from the recession and it you are not feeling jazzed or feeling fantastic about how the economy is right now, this is why, because it is not growing in a robust fashion. Were in a recovery not necessarily operating on all cylinders. Theres a lot of inconsistencies with the day we get as to how things are going. That said, the fact that the economy didnt grow and contracted for the first three months, believe it or not it may be a one hit wonder because were already seeing the economy picking up steam in the second half of the year, whether its housing numbers, manufacturing, even jobs numbers. They are improving, what the thinking is at this point Going Forward the numbers are going to look a lot better, thats why you are not seeing the market rattled. You are seeing the dow up 62 points. The president has made no secret of using executive orders to bypass congress, including on issues, gun control, climate change, minimum wage, gay marng, power plants, health care, immigration. Ive got a pen and ive got a phone and i can use that pen to sign executive orders and take executive actions and administrative actions that move the ball forward. Now, the white house has not weighed in on the speakers threat to sue, but this morning nancy pelosi called the idea represent prehen cybill. Lets bring in our political commentators. Take a look at a chart, democrats would like you to look. At the last six president s, president obamas tally on executive orders is far smaller than the last democrat in the white house, bill clinton and he didnt hit the mark set by ronald reagan. Republicans say the type of orders that the president is doing much more significant than president s have done in the past and also how he interprets laws like choosing to forego the employer mandate for a year. Thats the type of action they are upset about also, isnt it . Right. The courts have traditionally taken a very dim view to use lawsuits to settle disagreements between branches the government. I think this is more an attempt by Speaker Boehner and others to sort of elevate this issue in the publics mind and so sort to sort of emphasize the extent to which the president has been claiming very sweeping executive powers on a range of issues. We see it in domestic issues and also foreign. On a series of very hot button issues in home, particularly immigration and Affordable Care act has been creatively enforced. I think republicans have a point that the president campaigned very strongly on the idea that president bush had overreached on executive power and now i think the things they are highlighting are arguably overreaches but i dont think the courts are going to handle the matter. What is your assessment behind all this . This what its come to. We vote the people in, to work things out, talk things out and certainly we havent seen a lot of that going on. To sue the president. First of all, i think its not only reprehensible as leader pelosi stated, its another distraction. This is 1 2, one third of a branch of government, and the truth is they simply dont want to want to do anything, we know based on what they have done already, they dont want to work with this president , ross understands and i agree with him, the courts will probably laugh this lawsuit out of the courtroom. This president has used his pen very judiciously. In fact, hes been more cautious than most president s. You have to go back to grover cleveland, thats before my time, to find a president who has used his pen less often than previous president s. I think the president has made it very clear to mr. Boehner and others that he wants to get something done on immigration reform, on raising the minimum wage, on insuring that theres no discrimination of anybody in our society. And extending Unemployment Insurance for those who are still out there looking for work and closing Corporate Tax loopholes. I can actually write the agenda if mr. Boehner needs some help. Ill do it for free. Republicans want a poll larizing and paralyzed environment, this allows them to go out and rev up their base. What it all mean, thad cochran has been in office a long time, he put together the first of its Kind Coalition in mississippi. He got out as many votes he needed to win and he did it by telling people this is what ive done for you in washington, d. C. I dont represent just, you know, conservative republicans. I represent the entire state of mississippi, perhaps more politicians should be reminded that they represent the entire state when they are United States senators. He won last night, but i think hes going to have a hard time this fall because theres a conservative democrat who will also go back to those same voters and say, guess what, ive done more for you on voting rights, education and others things than thad cochran so were going to have another interesting race. Ross. I think it will be a cake walk for cochran in the fall although its possible there will be lingering bad feelings over this result and he will have trouble turning out his base. Part of the reason i think he was able to pull this off was democrats knew they probably couldnt win in november. There would have been a weaker nominee. This happens on both sides. This is politics, donna. If you hold your nose for mcdaniels, you might lose your entire face. Its politics. Remember, we do have conservative democrats. We have not run them out of the party. In fact, we embrace a very diverse parties with conservatives, moderates and liberals, but the truth is mcdaniels ran a campaign that was so obnoxious to democrats and independents, it was really a 72 hour campaign, lets go ahead and get the republican some credit, they found their soul going door to door. Is against in western iraq. What does that do . This really complicates the situation. Because iraq irairspace is not that big. Now youve got syrian armed fighters and bombers dropping bombs in that same area. Pretty soon youre going to have a airspace issue, you are going to have arm aircraft flying over. The individualers have been very well briefed in the situation, all the players. This probably was on their radar to some extent but its really on their radar now. This is a new development and were seeing other things happen out there in the west. Were seeing a the merging of the onsura front with isis. When they were in syria fighting, they were fighting each other, because they are rival groups. Isis split from al qaeda. They were fighting each other, in addition to fighting the syrian government, they did that for a while too, so everybody is fighting each other. Now they have joined forces together. That makes them a very formidable force. Even worse than isis by itself. Now weve got these radical jihadis moving down to the Syrian Border as well. With that kind of privilege comes a great amount of responsibility, so i felt like it was time for me to do something that i never wanted to do which is as a journalist were supposed to tell other peoples stories. Were not supposed to tell our own story, but i decided three years ago that it was either someone was going to tell my story or i was going to tell it. Get ahead of it yeah. It kind of felt like this was it was a kind of situation that i couldnt keep lying to people, much less to myself, right . So somehow i needed to stop, and i decided three years ago before i turned 30 that it was time to stop. So i did. And so now ive done about, i dont know, 250 events in 40 states in three years. You know, insisting that we as a country look at immigration outside of this u. S. Mexico border, latino issue. We dont even talk about the fact that there are half a million undocumented immigrants in the city of new york alone, undocumented caribbeans, canadians, koreans. We never consider that. Its such an interesting thing, because there is such a face put on the idea of undocumented person. Who are supposed to be. And who they are supposed to be. To that end, you probably have a very specific reaction to the story that were seeing going on right now with these children flooding into the country without any without adult supervision, and weve seen the state they are being kept in. We see whats going on with them there. What is your reaction to that . What do you think needs to happen . My reaction is were that far away from ellis island. Were only a few miles away. Were not too far away from the lower east side, where a lot of immigrant jews, italians and irish germans came back decades, decades, decades ago, right. So i think its really important that we remember history. When we talk about this humanitarian crisis happening, right, whats happening with the 11 million undocumented people in this country is also a humanitarian crisis, and i think too often we failed to kind of connect the dots. Like why are people coming here . Let me ask you. Do you think people coming here because they see you very publicly undocumented, living this successful life and do you think no. Not you particularly, but people like you. They see this life that they can have even if it is against the law, per se. Well, they are coming here because in some stances because their parents are here, they are looking for their parents, and in some cases they are here because of the Gang Violence thats happening in their countries, and some cases they are here because the United States, were there. Thats why they are here. Right. What does u. S. Foreign policy and u. S. Trade agreements have to do with migration patterns . You just played the few sentences of the film thats going to air on sunday. The first two sentences growing up in the philippines, i always knew i was going to america. America was inevitable that was my own way of talking about, u. S. Foreign policy and the fact that the philippines was the first iraq. We were the first occupied territory. Yet, we dont know about that. We dont know about the history of the United States as it pertains to all these other countries. We could talk to you all day.
