this hour. this hour an american is free for the first time in five years. That in and of itself is good but there are serious questions about the cost to free Sergeant Bowe bergdahl and concern bordering on anger about how he ended up in taliban hands to begin with. Was he a deserter . Bergdahl is treated right now in germany. Special Operations Forces picked him up from the taliban on saturday after almost five years of captivity in afghanistan. He was in pakistan for a big chunk of that. In exchange, five taliban prisoners were released from guantanamo. Some suggest that is a price too high to pay especially given that some of his fellow troops say he deserted his post and that at least six soldiers were killed in searches for him. Some of those troops say he should be courtmartialed. Lets bring in our senior White House Correspondent joe johns. We should say, theres no publicly verified account of how Sergeant Bergdahl left his post but there are suggestions that he walked off. Theres another report that he was picked up while he was in the latrine. They need to talk to him personally to get the story but tell us about the backlash this morning. This has been out there for a long time for years and years. A question of whether Bowe Bergdahl actually deserted his post or whether he was kidnapped. Theres no conclusive evidence because at the end of the day hes going to be the arbiter of that when he sits down with pentagon officials and explains to them in his own words what happened. Nonetheless, there are colleagues of his who have said they believe he deserted. There are email trails. There are a lot of different pieces of information that suggest Bowe Bergdahl is no hero. Its talked about quite a bit on social media. Again though, the question is whether Bowe Bergdahl himself can confirm or deny some of these stories. At this stage, pentagon officials are keeping their powder dry on this. They say they want to talk to him. Their powder dry. Nonetheless, hes been promoted twice while he was in captivity. Hes about to be promoted again to staff sergeant. Does that indicate that this isnt a concern to the u. S. Military . What it indicates is they dont have any conclusive evidence that he deserted his post and is in fact a trader. This will all come down the road at some point. Its anybodys guess how it will turn out quite frankly. Its one of the things well talk to him about. They also want to learn a lot from him while they have him and treating him to figure out if u. S. Military can pick up any secrets about how americans are held in captivity in pakistan and afghanistan and any intelligence he may be able to give about his captors. Joe john in washington, thanks so much. There are so many questions surrounding this case. One of the big ones is did the white house break the law brokering this swap of Bowe Bergdahl for five taliban prisoners. The president s National Terrorism adviser says no. Listen to what susan rice told our Candy Crowley on state of the union. So there was a conscious decision to break the law as you know it dealing with the detainees and release of them . No. As i said earlier, the department of defense consulted with the department of justice and it is our view that it was appropriate and necessary to do this in order to bring Sergeant Bergdahl back safely. Lets bring in our political commentator. Margaret, let me start with you. You heard susan rice say the Defense Department consulted with the justice department. It was their sense that they could do this. They could broker this deal because they felt Sergeant Bergdahl was suffering from a serious enough medical problem that it had to be done immediately. Are you convinced . The law is that you have to inform congress within 30 days. They didnt do that. You can also understand why they didnt do that. Congress would have said no. They clearly went ahead and did it. They thought they had the authority to do it. The problem thats larger than this issue of legality which is an important one is the message it sends about americas strength abroad. For many, many years we had the precedent that we dont negotiate with terrorists. We do not negotiate for combatants that are illegal and by doing that, it demonstrates and continues to reiterate a narrative out there that america is not on the rise but on the decline. This is a message of lack of american strength abroad. Well talk to spider marks in a minute adamant on the subject of negotiating with terrorists and says frankly, we do. I ran contra. If it wasnt negotiating with terrorists, what was it . It was actually negotiating for terrorists and many on the right say it was wrong including the former u. N. Ambassador john bolton says reagan was wrong to negotiate for those hostages. We shouldnt do that. We dont do that. It suggests a lack of american strength. Shouldnt is different than we dont. I understand your point to be sure. Ellis, lets cover both points. Margaret talked about the fact that the Obama Administration went around congress because they knew congress would get in the way if they went through congress. I dont think the constitution has a stipulation that if congress is a pain in the neck, the president can go around them. Theres not much of an enforcement mechanism. Theyve done it. You can complain about it. Maybe the legal scholars can debate where those lines are. Highly sensitive thing. Genuine life at risk. Most americans would say, you know what . Under these circumstances do what you have to do. Theres always a life at risk when you have a prisoner of war. That is a life at risk. What about the future lives at risk . Margaret does a terrific job presenting the argument and rhetoric around the idea of not dealing with terrorists or hostage takers in this way. However, the reality is that of course we do. We must. It would be irresponsible to have an absolute black and white policy in a case like this. You have to make judgments. All governments do it. Israelis not long ago traded 1,000 prisoners for one sergeant. You make these judgments based on reality of the situation. The reality of the situation we also know is we talk five of the worst guys we have in guantanamo and five of the worst taliban prisoners we have and sent them back to afghanistan. These people had all been working with al qaeda before 9 11. First of all, theyre not back in afghanistan. Theyre going to qatar for a year. You say five. So then is this an Exchange Rate problem . The u. S. Should have got a better deal . These were worse of worse. Theres a sliding scale of bad guys and guys we can afford to be rehabilitated. These guys were ranked as do not release ever because these guys are going to go back to the fight and try to take out more american lives. Ellis, if you are a bad operator in Northern Africa right now. If youre a bad operator in any part of the world right now, wouldnt you look at this and say, hey, this is a good deal . Thats one of the arguments against doing it. Theres another principle that we cant forget. Were america. We do not leave our wounded in the battle zone physically wounded, psychologically wounded, whether they made a bad judgment or crazy move across a line, this is the responsibility of sending these people to war is that we do everything and i mean just about everybody to get them home. Thats the right thing to do. Without endangering future soldiers and future diplomacy. Weve said that we have put a higher price on american lives because theres this precedent now of getting enemy combatants back. Its an important discussion to have. Its a very important discussion to have. Im glad were having it. I think we can be glad that this sergeant is coming home while we have this discussion and there may be disagreement about how it was done and why it was done. Stick around. Margaret, during the break here, this discussion ill call it an argument continued. You were vehement on this. You think this was a bad deal. I think this is a bad deal because partly because of who these five guys are. When i said five worst of the worst, ellis said im not sure if theyre worst of the worst. We know who they are. When you have the roster, lineup of who is at guantanamo bay, you have guys you can send back and guys you can maybe reform and then guys we say never release because these guys are very, very likely already respected in the hierarchy of taliban structure and connected with al qaeda. They have a very high chance if they have the opportunity of going straight back into the leadership of al qaeda. Two of them are wanted for war crimes at the u. N. One of them studied for someone responsible for killing 12 u. S. Marines. These are real fighters who want to do harm to the United States and the free world. Ill give you last word on this. Can you look us in the face and tell us theres zero threat these guys will cause harm to america . Of course not. Theres all kinds of threats. Thousands of others and them. Lets remember who they are. Theyre not boy scout leaders. They are people who we used to call them Freedom Fighters when they fought the russians. When we went to their country, our government did, when we went to their country, they fought us had horrible and fierce ways. No doubt about it. Prisoners of war eventually wars end. Wars end and prisoners of war go back home. This shall continue to be so. We dont have to like them but lets not go overboard and say we cant do anything to serve our own interests. Wars do end. Were winding down this war in afghanistan. They are not ending their side of the fight. Theres nothing to suggest that they are going to stop hating on america and go back to al qaeda and that afghanistan wont once again fall into the hands of people who want to attack the United States and its allies and plan and execute that. They and many, many others out there who hate us that we need to protect ourselves from but dont do things that harm us and our people and abandon our soldiers in the sense that everybody is horrible and we cant do anything ever. If they cause trouble in afghanistan, should that be a concern . We shouldnt go back to war in afghanistan. Nobody wanted to go to war in afghanistan in the first place. That was the good war. Not the bad war. That was not the war of choice. This is the war of necessity. No doubt that these and others are bad people and bad stuff may happen. We have to move forward. We cant have this war go on forever. We have to prevent stuff from happening. Ill put a button on this and argue again during the break. I want to ask one question about another story in the news. A new ebook about Hillary Clinton. Shes coming out with her book already sold 1 million copies before its release. A Republican Group is coming out with an ebook. A rebuttal. A response to it. Is this certain republicans saying, were just going to ignore that factor and were going to presume shes running and get out now. Shes reserved the right to run. We know the book tour well see where she goes. I imagine hell have great events in west des moines, iowa, and in concord, new hampshire, and in all of the relevant places you go in ordinarily primary states it Hillary Clinton may be running. A huge number of supporters want her to run and this is clearly a way to really see the ground on some of these controversial issues if she does choose to run. You cant blame the attack people who dont want her to run or put holes in her story for trying to buttress that story ahead of time. This is politics. Margaret has a point given that the clinton team they are putting out this book as a team has brought on a former obama aide to help respond. Theyve got a whole war room to deal with the book now. Hillary bashing never takes a holiday. We all understand that. Theres no downtime for the people who are obsessed with Hillary Clinton. Im not too worried about this one. If it had been a real book if they thought it was good, coming out with an ebook against a book that will sell 1 million hard cover copies on day one, hillary is coming out on this okay. Youre missing the thought. The problem is were talking about an ebook. Its not irrelevant. It was published quicker and faster and cheaper. At this point malaysia flights 370 is the biggest mystery in the history of aviation. 87 days after it disappeared with 239 people onboard, we have no idea where it is or what happened to it. Now an Airline Group is hoping to stop it from happening again to improve the way aircraft across the world are tracked. Our aviation analyst and former transportation inspector joins us. Give us a sense of how this system would work. The system and there are several out there. The International Aviation transport association in conjunction with the group we heard about which is an offshoot of the united nations, they want to get together and make sure we get a system in place and that they recommend the same system or similar system around the world so all planes flying across the ocean can do it. Its like the immarsat system so the plane can transmit every ten minutes or every minute or every hour but if they put this in place and it would be through satellites and other systems, and with the new air Traffic Control system, we could do it. It would be very much like the data we heard from immarsat if thats the route they go. My reaction to this is obviously yes. Why arent we doing this already . Whats the barrier here . Well, you know, some people say the barrier is cost but that cant be in. 6,300 planes are equipped with equipment that would allow it to communicate with immarsat. Theres other companies. And only a little over 2,000 of them use them. The cost has come down so much because of the expansion and development of equipment that its only 50 cents a message. If your plane sends a message every ten minutes, thats 3 an hour per plane. Its very affordable if you buy the equipment. Is it a Privacy Concern among pilots . Is that the issue . They dont want prying eyes on them 24 hours a day . No. The issue has been two things. Issue is airlines say its costly to do and its a new system. We dont have a uniform system throughout the world. So nations have not adopted laws. In our country, airlines wont do things unless its federal aviation regulation unless its law. Its really good that they are getting together and going to recommend a system. And then every nation will have to adopt that in their air regulations and make it law. And then the airlines will have to do it and will have it. Finally, is this a system that cant be turned off . Do we know that its relatively speaking foolproof . No. Right now anything can be turned off because you can pull the fuses because they were worried about if a system catches on fire, you want to disable it. They are going to have to put the controls to that somewhere in the plane where it cant be turned off so were never without something as simple as a transponder so no plane flying across the ocean can be turned off. Since june 2009, 11 major planes have gone done over water and in 10 of the 11 crashes one black box could not be found. Were joined to discuss this by retired Major General james spider marks. You are the perfect person to be here. I have so many questions for you. I want to get through them in rapid succession here. Respond to the critics that say the United States does not negotiate with terrorists . We do and we do and its important to bound our engagements with individuals like this and terrorists organizations that are absolutely focused on destroying the United States and what we stand for. At the same time you have to work within those boundaries and sometimes you need to cross over them. In this particular case, the United States made a good call and was able to get this great young soldier back. Well figure out about his circumstances as we go forward. The cost is five guys who are admittedly and understandably very bad actors and have blood of the United States on their hands. So i think cutting to the chase on this, john, we have to make their lives in qatar in support of the government as miserable as possible. We need to be on them like white on rice so they understand that this is not a cakewalk and theyre not going to be able to disappear over the horizon. Is that going to be enough if they are treated harshly . Is that enough to silent the critics like mike rogers who says this simply sets a bat precedent. Lets listen to what he said on state of the union. The number one way al qaeda raises money is by ransom. Kidnapping and ransom. We have now set a price. We have a changing footprint in afghanistan which would put our soldiers at risk for this notion that if i can get one, i can get five taliban released. Spider, have we set a price . We have set a price. The issue again remains, the precedent can be broken and we can continue to work around there are other ways that we can stay inside their decision cycle to ensure that our greater interests are not lost here. Its an ongoing effort on our part. Our Intelligence Community understands this and will probably in my mind establish a very precise and robust operation to ensure that we can stay on top of these folks while they have their stay in qatar. Another very controversial part of this, spider, the circumstances surrounding how Bowe Bergdahl was captured. There were reports he walked off the base in afghanistan. We dont know for sure but that notion is out there. Do you think these circumstances of how he came into taliban hands, do you think that should factor in the decision to make the trade that the u. S. Made . John, not at all. These are two entirely separate issues. Not cojoined at all. The nature of his capture, how that happened, the details, well figure that out. Thats a separate issue. The United States army will get to the bottom of that and figure that out. We want him back. We have him back and well figure this moving forward to our advantage. He needs to be debriefed. Hes in possession of a lot of good intelligence. We need to extract that. The other side is what do we do with five taliban leaders in t qat qatar . The conditions of his capture are not relevant to the greater issue which is how do we handle the next 365 days with these folks in qatar and how do they reintegrate back into the taliban . Will we see them again down the road . Spider, you have served with a lot of good soldiers over the years. There are a lot who are ticked off this morning about this deal and about the alleged circumstances of how bergdahl was captured. They say that people risk their lives to rescue this man who very well could have deserted. The statement of the United States will not leave one of its fallen comrades behind is absolutely a fundamental value to our army and our military. We get this in spades. The circumstances of this particular soldier and how he ended up in the enemys hands well figure out. The argument certainly is he could have left his comrades behind when he walked off the operating base where he specifically was deployed in afghanistan and ended up in the enemys hands. So clearly were on a very, very thin line if you will in terms of trying to establish the nature of his capture and what were going to do with this young man going forward. We have to separate that right now. Its very difficult to. We have to separate it from the situation with the five taliban. There may be a lot to learn from his time in captivity that will be of value to the u. S. Military going forward. Great to have you with us. Really appreciate it. Thank you, john. The president feels so strongly that hes not appearing in public to announce it and then hes leaving to europe for four days. If you were a democrat in kentucky right now, montana, west virginia, not to mention arkansas and north carolina, what are you thinking . You got to put distance between yourself and that decision. Didnt you just hear what he said about the children and the future of the earth and that was pretty powerful stuff, wasnt it . It was a taped message on friday. I wonder why hes not embracing this proposal today. Heres the political reality of it. There are candidates in states where barack obama is not very popular who are running essentially local campaigns. If youre in kentucky, thats a good example. There are others. If you run for office right now, you have to put distance between you. Obamacare is one issue. This is another one. Playbook is there. They know how to do it. It will have some impact but not a lot. Margaret hoover, speak for all republicans right now. Theres a lack of republican cohesion on this issue. Some do not believe that humans are contributing to global warming. There are some who do. If you do, isnt there Something Like this . Arent there proposals like this that need to take place to try to slow it down . So i will speak for myself. The majority of republicans. Most republicans actually do believe that there is such a thing as Climate Change. We republicans have been caricatured as those who are antiscience and dont think humans can contribute to the earths changing temperatures. But many of us do think that. The issue is what to do about it. And certainly the u. S. Can curtail Greenhouse Gas emissions and they have actually gone down over the last several years. Because . For a couple of reasons. One because the economy has slowed down but thats not the only reason. A lot more natural gas. Because of fracking. A lot more natural gas and more coming. Couldnt they use more natural gas and less coal . And nuclear. You can do tracking. You can do nuclear. No silver bullet. A lot of different ways. Republicans that run for president the last two cycles had alternative solutions for energy proposals. You cant eliminate coal immediately without putting a massive tax on the american people. Energy costs go up and who does that hurt . That hurts the middle class which is already struggling. So between healthcare costs and energy costs, the middle class in this country are in a crunch. We know that. This wont help that. This is a weird political ploy for the president s legacy that frankly nobody could be more excited about than republicans running in coal states like mitch mcconnell. When you say its a political ploy, hes following up on something he promised a long time ago. Margaret makes the point that this will cost u. S. Jobs. Now, is it worth u. S. Jobs if china, if india, arent going to do a thing about this and theyre the ones polluting more than us . Why should the u. S. Do this unilaterally at a cost to our own jobs . Hold on about dooms day numbers. We understand industry. They always complain about regulation when laws say you cant dump chemicals in the river, they complain.
