Uk is where donald trump is headed. And upholding a challenge to president obamas immigration plan, nondecision decision that leaves as many as 5 million in limbo. A team of correspondents are on those stories, and our political analysts and experts. We begin with the court. Talk to us about the ruling, explain what it does, who it directly effects. Reporter it would give about 5 million to come out of the shadows and begin to apply to stay legally in the United States. A lower court judge issued injunction to stop the programs from going into effect, because the Supreme Court deadlocked 44, it means the Lower Court Ruling stays in effect, undocumented immigrants many brought to the u. S. Illegally stay in legal limbo until the end of Obama Administration. And the ruling is as much about president ial authority and executive action as about the specifics in the plan. Thats right, it is not about substance and the substance of the issue which is letting undocumented immigrants stay illegally. This is about the way president obama went about it unilaterally without congress. Not long after president obama issued the executive orders in 2014, a group of states, 25 led by texas challenged this in court, argued the president going alone is unconstitutional. They signed on to it, made the same argument, and the president then said wait a minute, im doing this because i am frustrated. To bypass Congress United republicans in opposition. Even those for Immigration Reform are applauding what the court did because again executive action the president used to do it. The reaction came swiftly from the president. Michelle kosinski is at the white house with more. Certainly a blow to the president , what he hoped would be a big part of his legacy. This was not good. The president s disappointment was palpable. He, himself conceded hes hit the limit in what he can do on immigration, through executive action. That said, his original executive action on immigration that effected many people who were brought here as kids, those policies remain in place, and the president insisted that enforcement priorities would remain in place, means many people that would have been effected had the court rules in his favor, by the expanded executive action, theyre not exactly by any means going to be top targets for deportation, and also remember the court didnt rule on whether the president had overstepped his legal bounds, even though they came close to doing so. For the president , it is not a complete loss. What he wants to do is hit republicans, blame them for this, and urge people that feel the same way he does to exercise their right to vote in november. Listen. Going to have to make a decision about whether we are a people who tolerate hypocrisy of the system where the workers that pick our fruit or make our beds never have the chance to get right with the law or whether were going to give them a chance just like our forebearers had a chance to take responsibility and give their kids a better future. We have to decide whether we are a people who accept the cruelty of ripping children from their parents arms or whether we value families. Reporter it is in the hands of the next Supreme Court justice, next congress. He made a thinly veiled reference to donald trump saying you cant pretend youre deporting 11 Million People, cant say youre building a wall. He called those fantasies. The president spoke about refusal of republicans to consider Supreme Court nominee merrick garland. Another opportunity to slam republicans. He didnt hold back on language. He said republicans were willfully preventing the Supreme Court from functioning the way the founders intended. He said theyre using partisan politics to jeopardize impartiality and integrity of the entire justice system. In his words, america should not let that stand. Interesting to hear from the press office, saying this is letting dysfunction in congress infect, not affect, but infect the judiciary. Michelle kosinski from the white house. Agree or disagree with how the justices voted, it is already a major voting issue this year, Hillary Clinton holds an edge with latino voters, donald trump made illegal immigration the centerpiece of his campaign. How did clinton respond . Reporter anderson, if the president walked around donald trump, Hillary Clinton addressed it head on here. This is what she said. Take a look. She said this decision is a stark reminder of the harm donald trump would do to our families, our communities and our country. He called mexican immigrants rapists and murderers, called for deportation to tear 11 million from their families and homes. Obviously donald trump may not have been the republican nominee but for the immigration issue being front and center. The Clinton Campaign believes they can use this to their political advantage. Also warnings from the republican side. The courts have essentially said the president overstepped his authority, so thats a warning to her. She wants to do even more than this president has done. As you said, shes hoping to use this to her advantage with hispanic voters. Without question. You look at the battleground states, looking at the pure raw politics, look at a state like nevada, colorado, like florida, key battleground states with the highest percentage of hispanic voters in battleground states. Clinton believes it is a winner for them politically speaking. They believe the next appointee to the Supreme Court who made decide Something Like this in the future and the white house are key to this year. The Clinton Campaign sees the only up side and republicans are admittedly worried about changing demographics in the country. Donald trump had less to say about it today, perhaps because he was getting ready to leave the country to go overseas. Jim acosta joins us from one of his golf resorts. Jim, why is trump making this trip, why making it now . Reporter it is a pretty unusual time, anderson, with donald trump sagging in the polls, lagging in fundraising, you would think he would be back in the United States, courting to those or tending to those demands. Instead, he is making what is essentially a business trip to come to the golf resort that he has refurbished behind me, trump turnberry. They pumped millions into the property to refurbish it. He is here tomorrow for Ribbon Cutting the family is attending, he will helicopter in, cut the ribbon with other notable vips, then take a few questions at a press conference, but this is a highly unusual move. He is not meeting with foreign leaders here, not meeting with british Prime Minister David Cameron or top government officials in scotland. As you know, the Prime Minister in the uk has been sharply critical for his proposal to ban muslims coming into the u. S. Temporarily. He said that is wrong, and donald trump responded perhaps the u. S. And uk wont have a special relationship like they had for decades now. In addition, he is headed to a separate Golf Property in aberdeen, scotland with a lot of controversy. He tried to use the scottish version of Eminent Domain to take property there, that didnt work out, he clashed with residents. Some of them raised mexican flags to protest his stance on immigration. As he stirs up controversy in the u. S. , he has done the same in the uk. Remarkable for a president ial candidate at this point in the campaign to take time off to pursue a Ribbon Cutting for business prospect. How is the campaign explaining this or spinning it, whatever verb you want to use. Right. I did talk to a trump source earlier today who said this is a property that donald trump has invested millions of dollars into. He does have a day job outside of running for president of the United States. Has his name on it, he wants to be sure the property is up to his standards. Cant hold it against him. Keep in mind, anderson, when politicians go overseas, theres a tendency to create gaps. Four years ago when mitt romney went overseas, went to the uk, poland, israel, was one gaffe after another. Trump can say the judicial process played out and democrats came out short. Sure. The Supreme Court gives obama a black eye, they give Hillary Clinton a bouquet of roses. Youre now going to have a very energized latino turnout. One thing, though, it is bad for the country overall because i think even if we disagree, we need to understand each other. People think the president was just kind of overreaching for his own sake. I think from the White House Point of view, they say listen we hurt the Latino Community, we flooded the border with agents and technology. Deported two Million People trying to show the republicans we were serious about Border Security to get a deal, then no deal was forthcoming. Having hurt the Latino Community with executive action, tried to do something to help them to repair some damage. This isnt somebody overreaching who is a dictator. He reached out to congress rst, he did a lot to lockdown the border. He did lock it down and got nothing for it. Kayleigh, is that how you see it . I dont see it that way. The fifth circuit said that the president s actions were manifestly contrary to the statute passed by congress. That is a huge deal. We have a president who didnt get his way with congress. His excuse is to use executive power to get his way. Thats completely outside the bounds of the constitution, unacceptable. If he denied himself this power 22 times. You cannot circumvent congress if youre constitution abiding president. I agree on the immigration issue, i worked on this on capitol hill, i worked for a member of congress for southern california. I have been to the border. You know, i helped save two border patrols being unjustly imprisoned under the Bush Administration for doing their jobs, i take issue of vans character station of what the administration that done with illegal immigration. It is a mess. They claim they have more deportations but thats because they cook the books, counting people turned away at the border as deportations. Thats never been done before. We have 39 in legal and illegal illegal immigration the last two years. Tens of thousands of kids flooding over the border who arent allowed to stay. I. C. E. Agents cant do their jobs. It is a nightmare, on top of what president obama has done with executive overreach because he had a temper tantrum because congress wouldnt give him what he wanted. We can go back and forth about this. There are things called facts. We have a net negative immigration from mexico now of over years past. We had the lowest immigration rate since the 1970s. The president has done a tremendous job. The reality is both sides do agree. We have to have a better system. And the senate, republicans in the senate and president and the American People want to go forward, and the republicans in the house wouldnt let anything happen. So the president took some steps. To be clear, some of those were left in place. Supreme court left in place a lot of work with dreamers and others, but got his hand spanked by the most conservative, fifth circuit. Thats the most conservative circuit, not the Supreme Court. Before we get to the immigration issue which we could spend hours or, are you concerned from a political standpoint for donald trump that this plays into democrats hands . And rally the base . Van said, talk about facts, talk about the constitution. Article two, section 3, president has to take care laws are faithfully executed. He was trying to usurp that power and give a class of people amnesty. You see two wonderful women to my right with differing views on donald trump and immigration. The Republican Party has different views. Some want all Illegal Immigrants deported, some want amnesty, path to citizenship. We all agree before that can happen, before congress can act, a wall or form of Border Security has to happen. This unites the republicans. So much is made by the left over how in disarray the republicans are. You dont think this hurts donald trump among latino voters in nevada, colorado . People that are latino, pew research did a study that said 45 of latinos thought illegal immigration was a positive thing for the country. It is not unanimous opinion amongst everyone. Not just donald trump talking illegal immigration, also deporting 11 million that are it is the way he is doing it. Ridiculous to think the border is secure, van. The border is not more secure under barack obama and most of that net negative may be from mexico, doesnt count guatemala, honduras, where bulk of the kids came from, different laws apply to them. As far as donald trump is concerned, if this is the issue that propelled him into popularity in the republican primary, it is an emotional issue. Needs to be fixed. The immigration system is a disaster. But his inflammatory way of going about it has hurt that effort on the part of republicans. Let me bring in gloria. This question of overreach, president ial overreach, republicans call the imperial presidency, thats a very potent issue. I think the problem donald trump has on this, theres a question of what his presidency would be like. Would he also want to overreach. This is an issue frankly that paul ryan, the republican speaker of the house has with donald trump and has spoken to donald trump about the separation of power. And what would you do, for example, with the temporary ban on muslims. How would you enact that. Would you try and do Something Like that through executive order . Executive action . For building a wall . Just i mean talk about overreach, building a wall, barring an entire class of people because of the religion they believe in, those are crazy ideas. And what this decision does, it helps keep front and center of the campaign the immigration issue. The interesting thing about this, this is a policy issue on which the democrats and republicans are in completely different extremes. We, the democratic party, Hillary Clinton, barack obama believe people who are here need a path to citizenship and that congress, yes, we would Like Congress to act, but i think the president only acted in this limited way, which the court did not overrule, just decided on a procedural issue today, that obama acted only in this limited way because congress had not acted, but clearly the democrats and republicans could not be further opposite. Congressional inaction is no excuse for flagrantly violating the constitution. Congressional action as president of the United States, you derive power from article two of the constitution, naturalization is not there, article one, congressional power or statute. Fifth circuit ruled, showed painstakingly this is contrary to the statute. Supreme court didnt say he flagrantly violated the constitution. What the Supreme Court did was nothing. But what the president did wasnt small. What the president tried to do is circumvent congress and give legal status to 5 Million People, Social Security numbers, being able to work, eligible for welfare benefits, earned income tax credit. He cant do that. All i would say is when Congress Fails to act repeatedly on such an important issue, the president must act. Thats not american policy. First of all, i think it is important to recognize exactly what gloria said, the Supreme Court basically did nothing, let stand the most conservative courts opinion on this. Congressman jolly, thanks for joining us. Now that the sitin is over, i wonder what, if anything, do you think it accomplished . Speaker ryan said it was based on publicity. Not sure it was the greatest tactic to accomplish real change this week, i understand the convictions of my friends on the democratic side. Look, i have questions with policies they have offered but i also have reservations about inaction on our side. Im somebody that thinks the house floor should be open. Members of congress should have opportunity to work the will of the American People, includes on issues of National Security and yes, on the Second Amendment and guns. I spent a lot of time on the house floor looking for opportunities, window of opportunity with my democratic colleagues to say how do we forge a consensus, accomplish no fly, no buy. And protect the Second Amendment and due process. We can do both. Talk about how to do that. Democrats want a vote on what prevents suspected terrorists from buying guns. Republicans and libertarians and others took issue with it because they thought it infringed on a persons due process rights. You had a compromise that seemed to address that. Mine says no fly, no buy. If you are turned down based on being a watch list, the government has to notify you of that and you have 30 days where the burden of proof is on the government by a preponderance evidence, 51, 49, the hearing is secret and all evidence has to be shown topetitioner. There was a proposal of 72 hours. 30 days seems to be a compromise. It is. Understand this protects Law Enforcement interests as well. If youre on a watch list, it doesnt notify you youre on the watch list. If you go to purchase a firearm, Second Amendment privilege protected, i believe they owe you a due process hearing if they do deny you. I circled this to colleagues, said help me make it better. We can accomplish no fly, no buy and due process. Help me make it better. If the fbi was investigating somebody like omar mateen, closed the investigation, they later purchase a firearm, notify the fbi that perhaps the individual should be looked at again. Thats now in the legislation as well. The house expected to reconvene july 5th. What needs to happen to get a vote on the bill. Im from florida. Left orlando shortly after the attack, left a state unified in mourning, a nation resolved to face this evil and insecurity we face. Congress is bitterly divided. It is wrong. Every vote counts, it is a referendum, literally every vote counts. I was working in france yesterday, there were british citizens around me who made sure to vote before they left in order to get their vote because it is that close. Christiane, the Obama Administration clearly wants uk to stay in the eu. Talk about why this matters for the United States. Is it economic, security related, all of the above . I think it is all of the above, economics, security, political, cultural. The basic bottom line, the United States and britain stood shoulder to shoulder, special relationship as the cliche goes, but it is true, and worked together for most of the last century, decades and decades, particularly to keep the peace in europe and to join in the liberal economic and cultural and political project for the world. Britain obviously stands as americas bridge to the rest of europe, the u. S. Biggest trading partner. In that regard very important. Britain is along with the u. S. A member of the security council, nato. All of the Big International groupings. Britain is front and center, one of the leaders of europe and such a close friend of the United States. So whether it is imposing sanctions on russia or iran, whatever it is, britain can be depended onto help the u. S. But of course britains weight is much magnified, throw weight is much magnified being part of this big union. On its own, it is a little less obvious how much of a benefit it is for the u. S. And how much britains voice will get heard beyond the United States. So it is a very delicate situation now, anderson. The question is if britain leaves, do other countries now in the European Union start to leave . Do the danes, norwegians, do others get shaky . Reporter thats the fear across europe. Many of the leaders, germany, netherlands, france, very worried it could be a psychological run on the bank. Britain leaves, then the others might. There are significant minorities in a lot of the countries that want to leave in terms of numbers. Minority of numbers which want to leave. The unfortunate thing, anderson, this is where it gets really tricky and really ugly, a lot of the leave movements are led by the hard right, very xenophobic, antiimmigrant, pop list, nationalist, white identity politics. Theyre the leaders who are pushing in momentum, including here in britain. The antiimmigrant leader of the party that forced Prime Minister cameron to hold this referendum. Many say cameron inflicted a wound on himself if they break it and on britain and europe. It is a very bitter, very close race. We will continue to watch. Christiane amanpour, appreciate it. In baltimore, another Police Officer acquitted in the death of freddie gray, this time the van driver, accused of giving gray a rough ride and causing a fatal spinal injury last year. The judge said the evidence didnt prove it. Officer Caesar Goodson was found not guilty of seven charges, including the most serious, Second Degree murder. The second acquitted. The first ended in mistrial. Should prosecutors reevaluate the remaining cases, what does freddie grays family think of the decision. Joining me, attorney for the family, billy murphy. The family is very, very frustrated about the uncertainty of the process and they continue to take their previous position, what they want is justice, whatever that is. Guilty or not guilty in front of it. Every time theres a trial, the family suffers. The judge ruled the state failed to meet the burden showing the officers actions rose above civil negligence. This was supposedly the case, if any of the Police Officers were to be found guilty, this was a lot of legal experts pointed to this one as perhaps the states best case. Well, anderson, i have been a criminal defense lawyer for 30 of the 46 years i have been practicing. I always had fun dismantling very strong cases brought by prosecutors because the defense has the advantage of the element of surprise, and also has the advantage of an enormously high burden of proof, the highest known in any civilization in the world, thats near certitude, the prosecutions shoulders in cases. Also a rule of law meant to dismantle cases that look strong but turn out not to be. That is in a circumstantial case like this largely was, the prosecution has to prove not only that there is enormous evidence but they have to dismantle every reasonable hypothesis of innocence. So if the prosecution comes up with one hypothesis, the judge is obliged to acquit. Even tougher in police cases because of normal reluctance of people to discredit the police. So what happens to the other cases . Thats up to marilyn. And i dont like to speculate, especially in cases as serious as this. But i will say this, the community is very, very much on edge about this, enormously frustrated, some are very angry. Part of that anger is because our court system is behind the times in the sense that we dont permit video cameras in the courtroom to cover the entire trial. People react as much to innuendo, talking heads, rumors, gossip as much as they react to reality. If only 150 people out of 600,000 in baltimore and millions around the world can see this trial, it is essentially a secret proceeding where people cant really have their own reaction to the evidence, they have to react to the reactors, the media, the talking heads. And thats just not satisfactory in modern age where technology easily can cover all of these trials of tremendous public importance. But jeff and i were starting to see a lot of these people involved in the insurgency, they brought in a guy, Nasir Hussein who breaks and laid out the inner circle for saddam. Kh Khalil Ibrahim all from this al musli family. Im thinking who is running this insurgency . I started to realize it was all connected to this family, these al muslits. If we find anybody who is related, married to an al muslit, anything, thats where we started focusing our time. Were al muslit focused. Were bringing in all these people and jeff and i figured out a very clear way to get these prisoners to open up and start providing us information. Were really running. Fascinating. Declassified declassified. So many fictional shows on that focus on this exact type of espionage. True heroes, true fighters behind them. Thats what i think makes the series so great, anderson. The compelling part of it is the people themselves. These are the people who lived it. So the two gentlemen you just saw in the clip were trained interrogators, who were their whole mission was to try to find Saddam Hussein. At least in this particular case. And so what they were doing is trying to put this very complicated puzzle in a war zone with people that they didnt have complete control of the neighborhoods of which they were operating. And you could imagine just how difficult and complicated. And it really came down to small details. A cook and a fish at the end of the day helped solve this riddle. And the viewers are going to get to be part of this as they see this thing unfold and all the tension and problems. And interrogators almost left the country. They had their mission was up. Very, very close. The drama it reads like a novel. But its real life and its cold through the folks who actually lived it. You also look at migs all the way from the cold war era, moscow to modern day iran. It covers the gamut. What we were hoping to do with this is try to bring in all of the agencies doing the work that they do. Everything from a very long, embedded some 17 years, cuban spy, in the very high echelons of the Defense Intelligence agency to rescue attempt in afghanistan. The hunt for zarqawi that was even different than the saddam episode. A guy who was a espionage agent operating out of the los angeles area, stealing sensitive Radar Technology he was taking back to the Chinese Military and would have caused huge harm to Americans National defense. It talks through the fbi agents who worked the case. The compelling part of this, anderson, are the people who live these cases. Youll get a sense of their highs and their lows. All the twists. All the intrigue that you see on the nonfiction and fiction portion of those other shows. Right. Youll see the reallife episodes here. Zero dark thirtiy i watched again recently. So much focus on who pulled the trigger to kill bin laden but you dont think about the hundreds or thousands of people working for more than a decade to get those s. E. A. L. S into that location that they could actually then carry out the mission. Absolutely. And thats what we try to focus on. Youre exactly right. The sheer number of people that touched that case of ubl was astonish iing and Little Things that flipped over that allowed them to get close to the courier, who actually took them to the facility, thats the kind of story thats fascinating. Thats why people in steer dark thirtiy as you said you focused on the end point. Thats exciting certainly and it was dangerous for the people, special operators involved. But the real story of that happened in that long, logistical tale of espionage, detective work. Its real life. And all the ups and downs of that is pretty sxieing.
