And meanwhile, a man on the line is spoke with an unidentified man. Cnn cant independently confirm this is Donald Sterling but if it is it is the first weve heard from him since he was banned for life from nba. On the recording sterling says he is not a racist and seems to lament the fact that everybody jumped to conclusions about him. It breaks my heart that magic johnson, you know, a guy i that i respect so much wouldnt stand up and say well, lets get the facts. Lets get him and talk to him. Nobody tried. Nobody, from here on on Beverly Drive and sunset, across from the Beverly Hills hotel. You know . Donald, i think theyre probably trying to force you to sell it, that is the thing. You cant force somebody to sell property in america. By the way, weve offered Donald Sterling the opportunity to speak any time he wants. I met with him on friday. He has not spoken. Other people have met with him as well. The invitation still stands, mr. Sterling. As i said, Shelly Sterling says she wants to keep her stake in the team but her stance on her husband seems to be all over the place. So where does shelly stand on this issue . Stephanie elam has more. She is caught on tape appearing to defend her husband. People want to know mrs. Sterling, are you a racist . Are the accusations true . Forget it, it is not true. Yet, distancing herself from his comments, saying quote, i spoke with commissioner adam silver this week to tell him i fully supported his swift and decisive action. All the while she seemed to be positioning herself to keep the team. In fact she owns 50 with her husband, Donald Sterling, whose rant banned him for life from the nba. And now Shelly Sterling says she didnt understand the rant on the tape and says she has no plans to sell her portion of the team. In fact, since the rant went viral, her lawyers supported the ban on nbas sterling and the leagues decision to find a new ceo for the team. And now we know that shelly didnt have plans to sell her stake in the team, her lawyer says she is running without donald. They have been estranged for over a year, okay . And while they share Business Properties he is out of the team and has nothing to do with it. She is the owner in charge. In fact, nba commissioner adam silver, deliberately or t not, did leave the window open for shelly to make a play to keep the team, complicating the matter, the sterlings own the clippers through a family trust. Her lawyer says they are in talks with the nba. This ruling applies specifically for Donald Sterling and Donald Sterlings conduct only. And just to be clear when things settle down she sees her role as an owner but less involved day to day. A passive owner, not involved in management or deciding what the trades are. Just retaining for now, 50 , that she spent three decades working on, she was there in the dark days and is here now in the brighter days loving the team and hope they can win the next round in the playoffs. Fact is, you cant separate Donald Sterling from Shelly Sterling. Anything she earning from the clippers will go to Donald Sterling. Her behavior may also be a factor. In this video from a former tenant, Shelly Sterling is caught on video posing as a health inspector. And in a 2009 deposition, a former tenant of the sterlings testified that Shelly Sterling called him a black mf. Those were depositions, theyre onesided. Nobody has asked for her position. I will state it categorically. She has never, ever engaged in discrimination based on race, sex, orientation, anything like that. Number one, number two, mrs. Sterling and her husband were sued. They never have been found by a court to have engaged in discrimination with housing. Mrs. Sterling is a wonderful woman. But even though those cases are settled the court of Public Opinion may find her guilty by association and make her fight for the team even harder. Stephanie ela. And joining me now, sunny hostin and criminal defense attorney mark geragos. You think the contract with the nba doesnt appear to have much legal room, still . He is gone. I just dont think there is any chance in the world that he can hold onto this team. What about her . Well, that is a little more complicated. I had a conversation with pierce odonnell. It is quite clear she is throwing her husband under the bus. It is like fine, nba, take the franchise, but what did i do . Dont take the franchise from me. I still think she loses at the end of the day because their interests are so bound up together. And the sterling name is so toxic to the business of the nba that i think the nba would be within their rights in taking both o in forcing both of the to sell. But i do acknowledge her situation is a closer question. It is interesting, sunny, because she is saying well, look, he is my estranged husband. She is having dinner with the guy on sunday and yelling at the paparazzi, he is not a racist. There are a lot of people i spoke with, they say look if you allow her to maintain ownership Donald Sterling could still you know, exercise leadership over team or ownership of the team through her. Yeah, a lot of people are saying she is a straw person, she is making it loud and clear she is not. And im glad that Jeffrey Toobin admitted all along that Shelly Sterling is a real player. And the fact she is 50 owner is a big deal. I dont think the nba will just be able to rip the team away from Shelly Sterling. And i actually still disagree with jeff, and now that you know im right on one thing i think you will agree with me on this, that the nba doesnt have a clearcut way of ousting Donald Sterling. Mark what about that . You doubted that Shelly Sterling would be able to sell her stake in the team. There is no way that Shelly Sterling will be able to sell her stake in the team. She has Community Property interest. Theyre not going to be able to do it. That Community Property interest is already in several cases in the past couple of years, with fraud allegations and creditors, it withstood that. They are going to say she will be a passive owner of 50 . Theyre probably going to be able to trying to marginalize donald. My guess will be shortly you will see they filed for divorce. When that happens the Family Law Court will take jurisdiction over this. And whatever the nba thinks theyre going to do the Family Law Court, theyre going to have to drive through the Family Law Court judge. This idea that somehow jeff is wavering on, i dont know what he is wavering on, there will be a family law judge who drives this train. And at the end of the day what will end up happening my prediction is, the other 50 will be sold to some group that the nba approves of. They will put into place some kind of agreement where Shelly Sterling has nothing but a passive role as basically a silent investor. And that is how they will navigate this. And the nba will approve of whatever the control Ownership GroupShelly Sterling has been sort of distancing herself and Donald Sterlings daughters husband who works for the team. His soninlaw has been distancing himself. He works for the team and has been saying racism has no place in the nba. The comments are horrific. As is Donald Sterlings daughter, his wife. Which seems that all the other members of the family want to hold onto this thing. That is true, but i think what mark and sunny are neglecting is this is not just a dispute about whether or not the sterlings are good people. This is a contract. Can i finish . That give certain rights to the nba. That i think trumps their rights. That is right it doesnt trump the family law code sections in law here in california. Im not in california. But in california it doesnt trump it. And that is the problem you have got, jeff. They can take whatever action they want. And i agree with you. Donald sterling. It is not economically feasible. They can ground him into the dirt, and at a certain point they will tell him you have to remove yourself from this. And im telling you, they gave the path way the nba will take. Theyre going to get him out and brin bring in a new Ownership Group and she will be a passive owner we agree, mark geragos. He left the door open. He really did, everybody talked about how he was a decisive person and handled the situation correctly. But i said from the very beginning when i said this only applies to Donald Sterling i thought it was his major misstep. It will be interesting to see how the players react to this. A. , you die to get out of there. I got out of east l. A. I was the president of the high school there. I mean, and im a jew. And 50 of the people there were black and 40 were hispanic. I mean, how could you think im a racist . Knowing me all of these years . How can you be in this business and be racist . Do you think i tell the coach to get white players . Or to get the best player he can get . I spoke in an exclusive interview with a man who know how he ran his team. He alleges r alleged decades long racism. In your lawsuit you said he had a plantationlike mentality. Do you believe that . Of course. Do you believe he is a racist . Yeah, because he is holding onto that for some reason. You see, his exposure doesnt fit with what he is saying. He wants to feel he is holding onto the beliefs for some reason. I understand during the lawsuit you said he also liked the idea of having all black players and a white coach. A white coach, southern white coach. Explain what else did he say . He said he would like to have a southern white coach. And black players. He would have a southern why would he want that . Well, i guess they would be intimidated by the coach. When you told him you thought it was racist, what did he say . He said that is the way i feel. And each time i questioned him about it, he would say that is the way i feel. When you heard that the naacp i mean, i think your case was in 2008 and 2009. 2009. 2008, the naacp actually honored Donald Sterling that very year and they were going to do it again. Yes. What did you think about that . You know, i am not a vindict vindictive person or anything like that, but i just thought it was in very poor taste. And you know, i guess the money meant more than loyalty. I think Thurgood Marshal is spinning in his grave. It is shameful. Shameful . Shameful. Joining me now, New York Times oped, and sunny hostin. It is clearly we cant officially confirm it is sterling, but that sounds like sterling, i met with him on friday. It is interesting he said im not a racist. He said i wasnt hiring white players, i want the best player i i players. It is interesting when you hear elgin baylor saying he wanted to hire black players and a white coach. When you hear that what do you think about that . It is not at all odds for a persons own view of themselves not to line up with the broader cultures view, particularly when it comes to issues of race. So a person can say of course, i may have said this, but he said on the first tape it is just part of the culture im part of. Im bending myself to complete the culture. And it is not my fault. Im just kind of making myself fit in. And it is completely possible that he does not view himself as a racist. Although those comments on the first tape are unambiguously racist. But i think we end up trying to have a rational conversation about something that is inherently irrational. Racism is irrational. It is an affliction. You cant make it make sense, people try to have all of these kind of defenses, things that they think immunize themselves, they say i grew up with them. I am part of a group, i cant be a part of grieving another group. None of that is true. Anyone can have bias. Any of us can have biases. Everybody has biases. And how do you deal with it . Can you understand it and recognize it within yourself and deal with those biases . And if he cant recognize what he said on the first tape is racist remarks, that is a problem. A sickness, if that is him on the second tape, him saying you know me, you know im not that guy even though you heard what i said on the first tape that is a problem. But anderson, i remember when we did the racist and Justice Panel after the Trayvon Martin case. You have interviewed people from the kkk, and nobody says theyre a racist. I have interviewed people that are kkk, or skin heads, none of them say theyre a racist. To your point, what is so fascinating is he probably doesnt recognize his views are so akew. That he is a racist, he probably feels it is cultural. But also the very meaning of the word is dying. That our discussions about it have become so heated, so bitter, so entangled that the meaning of the word racist is dying because no one can agree on what it means anymore. Now if you bring up the idea that race is part of a discussion then you become the racist for bringing it up. Which is what im always called on twitter. It is a strange place in society that we cant even discuss this issue that touches so many of our lives. You become a racebaiter, which is fascinating. It is also interesting we have not heard any public form of apology well, he has not disavowed what he said. Because i really believe, so many people do not believe that their views are racist. And i really believe he probably truly believes he is not a racist. I think he would actually do himself a favor by speaking publicly and just talking about his thought process or whatever it is. Rather than have this drip and drip and drip of tapes coming out and you know, this woman v. Stiviano out there talking about him. She says he is just from another generation that he is not racist. When you hear somebody say im just from a different generation, what do you think . I think that is a sorry excuse, and that im just from that generation, and racism is something of the past. And the new generations dont have the same types of stereotypes. That is just not true. And recently when you have the affirmative action stricken from the supreme court. The Justice Sotomayor and her comments. And he is allowing v. Stiviano to be his voice of the world. Allowing her to make these comments and him not saying anything . Well, i think that might be a sort of generational that he is not quite getting. The generational part becomes a poisonous thing. I have heard so many people come out saying at thanksgiving, uncle, or grandfather, or whatever, somebody said something off color, and everybody cringed. Nobody said anything. There is new information that sparked congressional investigations. Cnns investigation found as many as 40 veterans died at a phoenix v. A. Hospital according to a doctor who used to work there. And according to sources many of the veterans were on secret waiting lists to hide the real amount of medical care. Drew griffin joins me now, so drew, youre in texas working the story tonight. There was a lot of action in washington today. What happened . Reporter two big movements, the first one, the house as fairs Veterans Committee voted that basically they have had enough waiting on the secret list out in phoenix. Anderson. They have subpoenaed all emails and communications between the veterans secretary Eric Shinseki and his staff, confirming that list. He has until may 19th to produce those documents to the house. Seconds later at the moment the vote was taking place Eric Shinseki ordered a National Review of all facilities nationwide to determine in face to face audits just how long these vets are waiting and to see what the problems are. So two big developments there in washington, anderson. As we mentioned, youre in texas tonight. And i understand you talked to somebody that has other troubling details about another hospital. Reporter yeah, and we can report tonight there is a brandnew investigation at yet another v. A. Hospital and this again involves cooking the books. Allegations of cooking the books and making vets wait for care. San antonio texas is the latest location where investigators from the v. A. s office of the Inspector General are on the ground, trying to determine if managers at this sprawling v. A. Hospital made veterans wait months to get care and if any vets died as a result. The allegations came from this clerk who works in the hospitals medical Administrative Services and is speaking publicly for the first time. Brian turner says his job is to help veterans secure appointments. He says he was told to fudge the numbers. He was to meet the v. A. s own National Timeline goal for setting appointments. That goal, no more than 14 days from what a veteran wants an appointment, called the desired date. The problem, he says, the appointment deadlines cannot be met so he says he was simply instructed to schedule the appointment months and months in advance while making the note that this is the veterans desired date. What theyre saying and what we were instructed was that the theyre not saying fudge, there is no secret wait list. But what they have done is just come out and say searzero out t date. There was a report the following day, if somebody had a wait period that was longer than 14 days. The standard is one to 14 days within the time line of a desired date. Regardless of when the appointment took place . Correct. So it could be three months and look like 14 days . It could look like no dates so fudging the books i would call it that, you would call it that, the v. A. Doesnt call it that. They call it zeroing out. Zeroing out. In a statement to cnn the v. A. S Public Affairs office says that turners allegations were investigated and that based on our internal factfinding conducted april 25th through april 28th, we found these claims by this employee were not substantiated. But turner questions just how much fact finding went on. He says no one asked him about his allegations and in fact, he says when he began emailing his concerns to other Staff Members he was told to stop it. They set me up the very next day. The very next day. The very next morning i was called into an office and told not the email another person. Turner, an army vet himself has asked for whistleblower protection and has become part of the investigation himself, the investigation focusing on delayed care, alleged falsification of records, and medical harm to the vets of san antonio, v. A. Hospital. It is worth mentioning, drew, nobody at the Senior Leadership at the v. A. Has been held accountable for this, or the stories you uncovered. Plus they will not even talk to you after six months of a request, i think i know the answer but any luck on that front today . No, again, no response to our requests. A new request this morning, no response as of yet. The fudging of numbers, and again, that is our term. It sounds so similar to what i mean, the v. A. Is doing their own internal review of this. You have been bringing story after story to life for six months, now, do we know why it is taking them so long . You know, the question number one, if i could interview Eric Shinseki or anybody else at the v. A. , this has been going on internal aly for years, the governor has been reporting for years they have a problem. The Inspector Generals office, in the texas area found them cooking the books. I dont understand why suddenly now there is going to be a view other than to say this is some kind of cover for the fact he is now going to have to be brought in, he, meaning shinseki are going to have to be brought into the House Affairs committee by subpoena. Also, you reported earlier today that the v. A. In washington now is asking for a nationwide review of wait times. That is not something that is just done in realtime always, like the v. A. In washington doesnt know where the wait times are in various states. You would think that is something they could just have easy access to. Well, as we reported a couple of nights ago on your show, anderson, where the gal report says the data is so unreliable that nobody in the v. A. Could possibly know what these wait times are. And you have all of these different offices around the country in the v. A. Trying to make this 14day appointment scheduling, which is impossible we are told. You would get a lot of creative accounti in accounting. It is plain old cooking the books. And the report is with shinseki . One spokesperson says he stands by full faith and confidence that Eric Shinseki is doing the job. What is amazing, the guy, shinseki is a long, distinguished military career, he is ducking and weaving from sitting down with you and having an interview. He has done interviews with others who have not done as much on the story as you have. Why dont they just sit down and be as transparent as possible . It is amazing to me. A deadly mystery reveals itself after the remains of a top tennis player is found, and the authorities trying to find information. Police found four bodies in the ashes after the flames died down. Tonight, randi kaye reports. Reporter an explosion before dawn and then a call to 911 at 5 45 a. M. Oh, my god, the flames are so bad. I was walking my dogs and the house just exploded. Calm down and take a deep breath. It was just horrible. A 6,000 square foot mansion burning to the ground, owned by one of the top tennis players in the world, james blake. Okay, do you see flames . The house is filled with flames, maam. It would be hours before the firefighters can put the flames out. And investigators can get inside. We have discovered two males and two females in the residence. However, we have not been able to positively identify the bodies. Reporter a family of four. Renting the home from james blake for the last two years. The parents are found in their bedroom. The teenage children in their own rooms. The victims are believed to be darren campbell, his wife, kim, their teenage daughter, megan, and their son, colin. A horrific scene. What i can confirm to you is all four individuals were shot. Reporter late today, investigators also reveal this. A firearm was recovered in the residence that was registered to mr. Campbell. Reporter but that raises more questions about the victims cause of death. Were the victims already dead before the fire . And what about the fireworks found throughout the home. The Sheriffs Department says the fire was intentionally set. So were the fireworks used to start it . And if so what accelerant . This is video believed to be of blakes tenant, campbell, purchasing fireworks in tampa on sunday. The Sheriffs Office says he bought a very large amount of fireworks just days before the fire. Also, that same day he purchased several gas cans at a Home Improvement store. Those who knew the family are distraught, including one teen who was with them the night before the fire. I was really good friends with his son. He doesnt do anything wrong, ever. And the daughter is just beautiful. The parents were great people. Just so bad that this happened.
