campaign triple header right here in "the situation room." i'll interview three republican presidential hopefuls today, mitt romney is on deck, rick santorum follows the next hour, right now the republican presidential can da aial candid. the former speaker of the house newt gingrich. spiker, thank you for coming in. eeveryone seems to agree that getting to the magic 344 for you right now before the convention isn't possible, do you agree with that. >> sure. look, i think the front-runner's clearly mitt romney. he's the weakest front runner in modern times, if he can get to 1144, he's the nominee. but if he can't get to 1144, on 26th of june. it will be a wide open primary at that point if romney can't clinch it, i think it becomes pretty wide open. >> so you have absolutely no intention of dropping out of this race any time between now and the end of june, is that right? i'm from atlanta, only 28 games to go, and the cardinals didn't quit. everybody wanted him to, but they just kept coming and they ended up winning. i think this is not over until it's over and obviously, if he does become the nominee, i will support him. beating barack obama is very, very important for this country. if he doesn't win the nomination, then it's going to be wide open and then we'll have a discussion for those 60 days for who ought to be the right person to beat barack obama. >> some of your supporters, they're not happy that you're emerging as almost a spoiler candidate. >> just because i'm a newt delegate does not mean that i'm not a realist. newt gingrich is going to have to step aside because he's average o average -- he's only won two contests. >> some other reporters have said to me, given the legacy, ginobili t given the history of what's been accomplished, they don't like this what they would see as demeaning of what they're doing right now to the bitter end. >> what do you say to these folks? >> i say to them the same thing that hillary clinton would have said in 2008 when she was taking on barack obama. that rang all the way to mid-june, and only when he had the votes did he have the votes. this was a contest, governor romney outspent the rest of us by huge margins, there is no obligation to concede it to him. june, july and august become very interesting months. >> but you will concede that rick santorum has a better chance than you do. >> but he doesn't have a guaranteed lock anymore you do or romney does. we have a whole new conversation if we end up on the 27th of june with no one having 1144 votes. >> are you at all worried about your legacy, your reputation. >> last june, as you remember well, wolf, when everybody in the media said i was dead. i represent a number of big ideas and america's energy policy, $2.50 or less for gasoline, personal social security savings accounts for young people. replacing the environmental protection agency, with a brand-new environmental agency. i'm in the position of reagan trying to develop big solutions that i think will really solve the country's problems and if you look at the president the last few weeks, we have done a pretty good job of getting him to answer me on energy. i'm going to continue toing after him on his energy party because it dramatically weakens his party and it dramatically weakens the u.s. the president in a very cynical way says to the russians, why don't you wait until i get re-elected before i sell out our missile defense program. i just need to get out of the election and then i have a lot more flexibility. how many other countries does the president promise he has mo doesn't have to -- the white house and the obama re-election campaign with these comments you made the other stay after the president himself showed some empathy for the trayvon martin family when he said that if he would have had a son, he probably would have looked a little bit like trayvon martin. this is what you said. listen to this. >> is the president suggesting that if it would have been a white that would have been shot that would be okay because it didn't look like him? this is dividing the country up, it's -- >> he responded to your comments with these. >> those two meacomments are rey irresponsible, i would consider them reprehensible. some of these comments were hard to stomach and trying to appeal to people's worst instincts. >> what was wrong with what the president actually said showing some empathy for that family. >> i think he should show empathy for that family. i think he should show empathy for every family that loses a child. every single american of every background is endowed by their creator with certain inalienable rights, the pursuit of life, liberty and the pursuit of happiness. we should be concerned about any young american of any background who ends up getting killed. i think all of us should reach out with our hearts to any american. i am concerned, you know, i visited a cancer ward in the children's hospital the other day. she was dealing with very young children. she came back and she described me 3-year-olds with leukemia. they were not children of a certain color, but they were children. we should be concerned about children of every background and all too often we're not. >> i'm concerned about the constitutionality of the health care law and the manage dates, if you remember, way back in the '90s, you supported the manage da mandates requiring people to buy health insurance was in fact constitutional. >> i always said there had to be a knockout clause for people who felt that it was inappropriate, that they had to have other ways of meeting their financial responsibilities and you could not require everyone, i always felt stronger that there had to be a libertarian opt out clause, there is no opt out clause, it is an effort to cover every single american. i think in that sense, my guess is they're going to find it unconstitutional and the only question will be if they recognize there's -- if the court holds to the strict ruling and they decide the mandate is unconstitutional, with no severability clause, that would make the entire bill unconstitutional. that would truly be a historic decision. >> mr. speaker, as usual thanks very much for joining us. >> thank you. good to be with you. >> mitt romney is coming up next. i'll ask the republican front-runner to react to some of the criticism from newt gingrich. and we'll look at the president's caught on camera moment, lot to discuss with mitt romney. also i'll go one-on-one later with rick santorum, is he losing his cool right now, i'll ask him about cursing at a reporter, if he plans to apologize. we also have rare audio from the supreme court, history making news yesterday today and tomorrow as the supreme court takes up the president's health care law. ok, guys-- what's next ? >> i'm saying in terms of a geo political opponent, the nation which aligns with the world's famous actors. a nuclear north korea is already troubling enough, but when these terrible actors pursue their course in the world and we go to the united nations looking for ways to stop them, when assaad for instance is looking to murder husband own people. and who always stands up with the world's worst actors, it's always russia and china. as a massive nuclear power, russia is the geo political foe and the idea that our president is planning on doing something with them that he's not willing to tell the american people before the election is something i find very, very alarming. >> let's talk about the supreme court and the arguments being heard today on whether or not the health care law is in fact constitutional. your opponent, rick san sorry rum, he's really going after you big-time. over the weekend, he said this, listen to this quote. i'll read it to you because we don't have the actual sound bite. he says this, why would we put someone who is uniquely, pick any other republican in the country, he is the worst republican in the country to put up against barack obama, why would wisconsin want to vote for someone like that, he says because of your record in implementing health care reforms with state mandates in massachusetts, that whole issue is neutralized and in his words because of that you would be the worst republican in the country to put up against president obama. i'm going to give you a chance to respond to santorum. >> i'm not going to worry too much about what rick is saying these days. i know when you're following further and further behind, you get a little more animated. as you go across this country, you're seeing more and more enthusiasm thr the can -- and one big difference between the two of us is that if i'm elected president, i will repeal obama care, and i'll stop it in its tracks on day one, i believe its unconstitutional, i believe the court will find it unconstitutional and one more thing i'll tell you about it, we can't afford trillions of dollars of new spending, it's a power grabby the federal government, it violates the principles of economic freedom in this country, it's wrong, it needs to be repealed. >> why is it okay for states to have health insurance mandates but not the federal government. >> first of all, it's a matter of constitutional direction, states have the power to provide mandates if they wish to do so and the federal government does not. and number two, we're talking about trillions of dollars of federal spending. and we can't afford more spending in the case of obama care, he's put in place 500 -- a billion dollars of new taxes, $500 billion of medicare cuts and then of course he is planning on stepping in and telling people what kind of insurance they have to have. ultimately i believe he's going to insist upon telling people what kind of -- >> david plouffe, the president's senior advisor was on television yesterday and he said flatly, that you, mitt romney, you're the godfather of the president's health care plan, you want to respond to david plouffe? >> well, i think we said that he's the rumple stillskin of the new campaign. if he cares about the american people having health insurance, the way they went about it, trillions of dollars of new spending is absolutely wrong. the wrong course is for the federal government to take over health care from the states, from the positions, and from the people of america. >> i'll leave it with this little cute note, governor, your son matt tweeted this over the weekend, my dad's finally getting a little r & r over the weekend, pick here at the movies with me and my kids. you went to see the hunger games, how did you like that 234ri film. >> i read serious boorks but every now and then i read just for fun. that was weekend fund so it was nice to see a flick for the first time in a long time. >> it's pg-13, 1 it a little bit too violent for young kids? >> it was a legally dense issue, admittedly pretty dry, wolf. people were lining up outside trying to get some very limited -- attorney general elect holder as well as secretary cat lean seb beale you. this was the kickoff, but we're kind of talking about it as more of a dress rehearsarehearsal. the question from the justice today, they're taking a look at whether they should have been hearing this case now, before and that's because many of the main provisions of this law don't go into effect until 2014. what we're talking about is that individual mandate, requiring that most americans have health insurance by 2014 or pay a penalty. this was an issue that was brought up in the lower courts as it relates to a 19th century tax law and the justices felt obligated to address this issue, though they made pretty clear in signaling in the court that they didn't really buy into that argument, if you will. listen here to some rare audio that we were getting from the courtroom from justice briar and from justice scalia, who seem to reflect the majority of the justices that they're ready to move on to the big event tomorrow. >> congress has nowhere used the word tax, what it says is penalty. more over this is not in the internal revenue code, but for purposes of collection. and so why is this a tax? and i know you point to certain sentences that talk about taxes within the code. and this is not attached to a tax. it is attached to a health care requirement. >> if it's not jurisdictional, what's going to happen is you're going to have an intelligent federal court deciding whether you're going to make an exception. there will be no raid of marbles because no federal courts are intelligent. it seems to me it's a question you can't answer. >> as you can see there, the justice is addressing it in two different ways, but they're talking about the difference between a tax and a penalty. should they even be don't go into effect until 2014. i'm sure jeff will agree with me, the justices don't see any barriers to moving on to the big constitutional questions where all eyes are focused now on two hours of oral arguments tomorrow on the constitutionality of that individual mandate. >> they agree that jurisdiction is their right now than to hear about the mandate's arguments now than wednesday. thank you, very much, jeffrey toobin is our senior legal analyst. you listen to all these arguments, today a lot of procedural stuff, but it looks like they're going to accept the jurisdiction, they're not going to just punt right now and say you know what? we got to wait until the entire aspect of the reform law takes in effect in 2014. >> one possibility going into these arguments was the couwas going to kick the can down the road. i thought that all eight down the road that clarence thomgs didn't speak. but all eight who spoke gave a clear signal that they think this is a time to reach the case on the merits, that there's no reason to delay. >> did you get any other hichbts from these eight justices who did speak, where this is moving, where they stand and i know you ore sort of like criminologists looking for -- >> there are basically two justifications that the obama administration used. one is the commerce klaus, which is the part of the constitution that the government relies on to do most economic regulation. there was no discussion on that. >> but there will be tomorrow. >> there will be tomorrow a great deal. there's also the taxing power. and both justice briar, g ooigig and justice alito. i think the case is going date of birth very much focused on article 1 of the constitution, that's been the basic ground for most laws and since the new deal and that's what they'll really going to have to talk about tomorrow. >> when it was being fought in congress, the president insisted this was not a new tax, but later an administration in arguing, it is a new tax. so what is it. >> and al lito made the point that today you're arguing that this is not a tax. but tomorrow, you're going to argue that it is a tax. i mean the obama administration does have a problem, at least a public relations problem about whether this is a tax or not. and i think we're going to spend most of the tomorrow on the key issue of the commerce clause because that's really what this case has been about from the beginning. >> we'll see how it checks out. >> and the federal government is allowed to tax people. >> there are very few limits on the federal government's power to tax people. but as you point out, that's politically dicey to admit that, and this doesn't look like a tax, it's a 2,500 a month page bill. the penalties are only a small part of it. it's really about the commerce power, which is the power that underlies medicare, medicaid and all of the federal government's efforts. >> all of us will be in a better position wednesday after all the argument will be to give us a sense of where these justices sit. >> they don't play poker, they really let you know what they're thinking. >> is rick santorum losing his cool? i'll go one-on-one with the republican candidate. i'll ask him about some of the nasty language i'll use about the "new york times" reporter. and new details emerging right now about the trayvon martin case, and why he had been suspended from school at the time of his death. bl blrk. let's get right to our strategy session, joining us, the cnn contributor, and the republican strategist. mary, do you agree with rick santorum that mitt romney is uniquely disqualified to beat president obama because santorum says he supported the mandates for health care reform? >> you know, it's a concern among -- has been a concern among primary voters and that's good for santorum to keep pitching romney. he needs that pitch, and he needs to hit it. and every time he takes the pitch like he did with you, fortunately, he improves his performance on it. he gave you five great reasons right out of the box without hesitation, why his health care program in massachusetts was different from obama care, he repeated that he wanted to repeal it. and then he repeated the funny line about rumple stilz skin. >> i guess i have a right to -- i know how hard it is to run for president, but you would think at this point he want tots -- santorum is right, obama care was based on romney care a right wing think tank here in washington. if the mandate violates our economic freedom except when i did it in massachusetts. he's incoherent on it. he's just simply right. i don't think governor romney makes a lot of sense when he plays defense on romney care. >> romney says it's one thing for a state to impose a romney care. do you de-disagree that that's not a fair point that he's making? >> of course it's a distinction without a difference. governor romney called for a universal mandate. he's 4 a national mandate, he's for obama care, and when he session he's not, he's just doing that etch-a-sketch thing. i had vised the pro obama superpack and i had vised governor romney that we had a mandate on health care. and david plouffe, mary, the president's senior advisor, he basically said that romney is the godfather, he said it flatly, the godfather of the president's health care reform law. i guess he's already trying to neutralize this entire issue if in fact romney is the republican nominee. and mitt romney cleverly called him rumple stillskin. he is very cler a that's a giant between the reach of the federal government and what states are allowed to do and when we're in the fall campaign, they didn't put it in their state of the union except for 30 worst, he'll do fine on it. he'll be able to speak from a fountain of experience and information and wisdom because he. >> there was an awkward moment for the president of the united states in south korea today meeting with the russian leader, caught on mike saying, basically the president saying to the russian leader, just bear with me, because if i'm re-elected i'm not going to have to worry about running again and i'm going to be able to do things differently after the election. how awkward of a moment was that? >> ronald reagan in his first term -- negotiated a zeal to eliminate all of ours and the soviet union's ground based nuclear missiles, second term -- governor romney who had several hours to prepare for his interview with. said russia is without question, our number one political foe. wait a minute, time out, what about north korea, what about iran. governor romney's foreign policy romney did a particularly good job on those security and diplomatic issues, and what he said clearly in context, paul, when we have been facing these issues, whether it be iran's nuclear capacity, or syria, on the council, they sit on the council and they vote against our interests. the president doesn't want to reveal, hide and seek, he does not want to tell the voters what his missile defense policies are, when he said he was going to reset this was the etch-a-sketch moment. >> we'll leave it on that note. thanks very much mary and paul for joining us. rick santorum is taking heat for lashing out at a reporter. he said mitt romney said that line in the reporters in my interview. plus new details about the shooting death of trayvon martin. what caused him to get suspended from school. new details emerging about the slain florida teenager trayvon martin. he had been suspended from his high school was marijuana residue had been found in his book bag and now it's reported that trayvon may have initiated the violence. david mattingly is on the scene for us in sanford. what's going on down there, david? >> reporter: well, wolf, the city of sanford is confirming to us that it was trayvon martin who started the violent encounter by punching george zimmerman in the face, knocking him down, jumping on top of him and then banging his head on the sidewalk. that's what police in an unauthorized police gave the orlando sentinel today and the city not happy saying they're launching an investigation as well, and the person who told the newspaper that just might get fired because of it. but when we approached trayvon martin's family, they felt like it was an attempt to perhaps demonize trayvon martin. if you listen to the 911 tapes, and you pay attention to the phone call, that trayvon martin was engaged to at the time that the teenaged -- trayvon was not the aggressor, not only are they saying it's inaccurate, they're saying it's irrelevant right now because of the way this whole case started. >> it's absolutely inaccurate, based on the 911 tapes, he's chasing trayvon. their phone call is 712. that's when the incoming call came in. we gave you the phone records. and it clearly says she called him at 7:12, she talks four minutes, at 7:17, the police get there, trayvon is shot and kimmed on the ground. she connects the dots after what happened. she hears the encounter between trayvon and zimmerman. she's the last one to hear trayvon martin alive and she connects the dots. >> wolfe, we have known for weeks now that trayvon martin was staying here in sanford with his father's girlfriend because he had been suspended from classes, we didn't know exactly the reason why. today the family confirmed that he was suspended because they searched one of his bags and found an empty plastic bag with marijuana residue inside it. they said they didn't go public with that information because they felt that wass eirrelevanto what was going on here. they believe the true person who needs to be attacked here was george zimmerman. but a lot of information coming out that casts a different light on how that violent confrontation may have actually happened. >> i understand there's going to be a public meeting coming up very soon, are amount of people expected to attend? >> that's right, for about the last 15 minutes in the road beside me, we were talking shoulder to shoulder, the civics center, only about 500 people could get inside earlier today, three hours before this was supposed to take place, there were people lining up, there were hundreds of people that were lined up to get out offense that meeting. they will gather in a nearby park for an overfloe crowd where they will watch that meeting take place on some large television screens. be this was all about giving the public an opportunity to vent what was on their mind. this resonatings with so many people on a personal level, city officials are going to be hearing a lot and it's going to be emotional. >> meanwhile, the united states supreme court is set to decide the future of our nation's health care, not everyone is necessarily looking forward to the outcome. >> are you worried about what the supreme court might do. >> i'm really scared. very scared. like i can't sleep scared. >> why is that mother so scared? the u.s. supreme court is hearing arguments over the constitutionality of president obama's health care law. one family waits in fear for the ruling. senior medical correspondent elizabeth cohen has the story. >> these nine supreme court justices will for everybody effect the life of 3-year-old violent mcmanis. >> are you worried about what the supreme court might do? that's what he said, listen to his words. what speech did you listen to? i was talking about obama care, listen to his words, and i said, what speech did you listen to? i was talking about obama care and romney care and that governor romney's uniquely disqualified to make the case. because he wrote the blueprint for obama care. this is the kind of stuff that we have been seeing from the romney spin machine, their press secretary was out at the back of the room, feeding lies to the national press. i repeatedly battened it down. >> and you did say in the context of health care, you did say that one line he is the worth republican in the country to put up against barack obama. >> yon this issue. >> you didn't say on this issue. >> he asked you to clarify that and you ros it. >> it was the third time i was asked to clarify, it was the third time in a matter of two minutes and in this case, he said midromney is the worst republican in the country, he stopped there, he didn't say on this issue and, again, at first it was he was the worst republican to run oochbd and then he took it one step further. and i thought, if this is the kind of spin, and by the way, this is the spin that's been going on out there. taking comments that i have made completely out of the con thaex i made them. this is what they make a living on, inge stead of covering the context, which is what i discussed at the supreme court today. mitt romney cannot run this case on obama care. >> as you say, the romney folks came out quickly raising statements about your temperament. >> any good conservative that hasn't -- i don't know. >> he's not like a hacker. here's the statement they put out. in the final stages of his campaign, rick santorum is lashing out withes c desperate flailing attempts. >> after i won louisiana by 23 points. look, if this is all the romney campaign can do is send people to my speeches, take comments out of context. >> he's going to be covering you for a long time. >> just so you understand, they sent a romney person to our speech, he fed the line to all the reporters and he saw it happening, and every man in that room, they say oh, yeah, we understand what you meant. but the romney people said this to us and you understand what happened. i understand the game, but you talk about desperate and pathetic, mitt romney can't run on his record. here we have the whole world watching, what's going on here in washington, the supreme court argument. mitt romney is 3,000 miles away, this is an issue that barack obama is running, he's 7,000 miles away, he doesn't want anything to do with obama care. he celebrated his birthday last week, nothing, no comment. if you want obama care repealed as a conservative, 75% of americans want it revealed because of the individual mandate, then you're going to have to have a campaign about repealing it and why it needs to be repealed and the person who passed the blueprint and advocated that blueprint to be -- uniquely disqualified to make that argument. >> so what do you say to a jeb bush or an eric shaner or a chris christie who say you know what? ho's the% person to challenge mitt romney in the nomination. >> look, i'm talking about what is objectively the case, what is objectively the case is that he had a government mandated health care program in massachusetts, it required everybody to have it. fine if you don't. it put limits on the kinds of policies you could have. they put up insurance exchanging mandate bid the government they employed medicaid, this is exactly the model of obama care. >> if he is the republican nominee, you'll vote for him. >> i start every speech, wolf, by saying, this is the most important election of our lifetime, but the reason i said i'm in this race and i believe that that's the case is obama care and if we don't have a candidate who's 3,000 miles away because he doesn't want to talk about the issue, because he can't on substance disagree with the polities of this administration, other than the fact that it's the federal level, as opposed to the state level. we are in desperate shape to run a campaign to convince the american public to not only elect a republican, but elect a republican to make the chains that are necessary. >> if the supreme court upholds the law, what's your strategy. >> full force. this is bad for our country. it will rob us of our freedom. >> we'll continue to make the case of the american public, that barack obama has to be defeated otherwise barack obama is going to be implemented. it's going to take our freedom away, it's going to destroy the economy of this country, it's going to raise unemployment rates, and it's going to dramatically increase the deficit. this is a loser on every single front. >> let's talk about your strategy for a moment. all of the math that we have done suggests that you don't have a realistic chance of getting to 1144. romfully does, but you might be able to prevent him from reaching that. is it your goal just to have a debate on the conference floor. >> with all due preponderarespe don't agree with your numbers at all. we think we can get there and we think the likelihood, i think the likelihood that neither of us can get there, but i think we can still get there, our numbers are very different than yours, you have some calculators. so those will be apportioned at the convention. so you're going to see a lot of changes when the reality sets in that this race is in all likelihood going to go to the convention. and there may be someone with what they say are enough delegates, but as you also know, wolf, a huge number of delegates are uncommitted. they may be for me or they may be for mitt, but they're technically uncommitted and therefore you can't put them your column. >> let's talk about the president of the united states. >> you used some pretty harsh rhetoric in going after him. i'll play a little clip of something you have said repeatedly, looking at this. >> i'm going to ask each and every one of you that-that your freedom is at stake. >> it sounds like there's going to be a totalitarian regime or our freedom is going to be taken away from us. >> as i just talked about. you now have the government telling you that you will buy what the government says you have to buy, whether it's what you want or not, whether it's how much you want to pay or not, a private citizen on a condition of living in america is going to be forced to do something that never before a government has him posed upon and as we have seen with these regulations, even if it violates your deeply held religious convictions, the government is going to -- religious freedoms being taken away by a government. >> you also have a brand-new web ad that paints an apocalyptic image of what's going to happen in the country if president obama is re-elected. i'll play you a little clip of that. >> imagine a small american town two years from now, if obama is re-elected. small businesses are struggling and families are worried got their jobs and their future. >> just to be fair to the president of the united states, when he talk office, the country was near a recession. a great recession. losing 700,000 jobs a month, now gaining 200,000 jobs a month. the stock market was what around 7,000, now it's over 13,000. it doesn't look like -- and the economic indicators are moving in the right direction as opposed to in the wrong direction. >> this has been the most anemic recovery in our nation's history. >> it's been a recovery. this president has exploded the credit card, $5 trillion added to the national debt. that's going to come across for the american people, we'll either do it by having huge amounts of debt payments we'll have to pay, or huge tax increases are going to be put in effect. the price of energy is driving up gas prices. >> the country is clearly on the wrong track since 2008. for almost four years, 24 president has -- >> people in your home state r they better off today than they were four years ago? >> right now, wolf, they're very much downplaying this saying it's not surprising that president obama would acknowledge election year politics, election year politics as well as russia, but the rnc has already put out a web video on this and the question is republicans really asking is if the president has a different agenda as they put it after the election, what other things might he be planning if he isn't responsible to the electorate. and any time you have president obama or a president that is caught on an open mike and we have seen this before, it very much becomes news and at the very least, the acknowledgement of election year politics might knock some of that presidential luster off of president obama in this election year as he's still waiting to really campaign in full force. >> i know you're getting ready to head up to the dmz, brianna, we'll stay in close touch, it's already tuesday morning in seoul, south korea, have a safe trip, we'll speak to you later. of course this isn't the first time the president has said something he would prefer to keep quiet. the former presidential advisor david gergen. how much of a problem david is this for the president right now. >> this is a serious matter, wolf, because it's not just a question of changing your position on some future campaign issue, this is really a question of whether the president's going to change his policy with regard to missile defense. as you know, from long years stretching all the way back to ronald reagan, missile defense has been an enormously controversial idea with american politics and the republicans have been worried all along that president obama would essentially bargain away our missile defense ideas and what he said in effect to the russian was i'm going to have to stand tough during the election year, but after the elections over, i have more flexibility. tell mr. putin i have more flexibility in my negotiations. that plays exactly into what republicans have feared all along. >> already a lot of republicans are saying, if the president is re-elected, if he's outrun again, he only has two terms in the white house, he can do anything he wants over the next four years shall we say and the american public wouldn't be able to do much about that, how does the white house counter that argument based on this hot open microphone incident today. >> well, i think they have to be very clear about what the president's plans are for a second term, especially with regard to national security. but, you know, it's worth understanding here, it was only last week, we had etch a sketch from the romney campaign suggesting that his campaign rhetoric isn't going to be adjusted as the year goes on. so i think in effect the president has given the republic as a gift, he's leveled the playing field on that issue. but still, from the voters point of view, how can you not believe, neither one of these guys is telling the truth about what he stands for. >> it's one thing to be overheard telling the russian president, there's a new president going to be taking office. it's one thing to be overheard basically saying just give me time after the election, i'll have more i'll share your points with him. it's a very awkward moment i should say for this president of the united states. >> i sure is. >> this is serious because it goes to national security. missile defense has been -- it's turned out that having the very forms of missile defense are pretty important for the security, let's say right now of israel, as you know, the capacity to knock down incoming weapons is very, very important in israel and we're going to find it increasingly important in the united states especially as other nation. missile defense may be the only way to defend yourself, if you're israel or others. this is a serious matter, and i think the president does need to clean it up. but i would just come back to this, the republicans have got their own problems in this area with etch-a-sketch. we need to hear from all the candidates what they would do. >> we also have new tweets about the investigation of the american soldiers charged with slaughters afghan civilians, one official said robert bale told other soldiers he had killed some afghan men. too old for a heart transplant?
