Up first, the Attorney General makes a Public Statement next hour, as questions mount about how he will handle a blossoming controversy involving his boss. Joe biden also had classified files in his delaware garage. This morning the president and his attorneys confirming the existence of a second batch of classified materials dating back to mr. Bidens time as Vice President. The search teams, were told, completed this review yesterday, Searching Biden Residences in wilmington and rehoboth beach, delaware. The documents were found in his Wilmington Garage and a neighboring room. The documents, were told, were mixed in with other papers. Lets get straight to our senior justice correspondent, evan perez. We will hear from the Attorney General next hour. Do we know it is about this . Reporter we anticipate that it is about this. The Justice Department is in a very tight spot here. Theyre in a very difficult position because, obviously, the president and his team did not tell the full story when they issued a statement on monday about finding a batch of documents, classified documents, they said at the time fewer than a dozen. What they didnt tell us was in a subsequent search that there were additional documents that were found, and the question is when did they have that information and why didnt they tell the world immediately . Because now theres a perception that has been created that theyre hiding something, and that has put the Attorney General now in a position where, you know, he might have to appoint a Special Counsel or at least open a fuller investigation of this matter. Just to catch people up, what the white house says happened is that they found a second set of documents, classified documents in a garage and in an adjacent room at the president s home in wilmington, delaware. They also did a search of his beach home in rahobeth. They are confirming the finding of the second set of documents. They arent saying when exactly they found the second set. Did they know this on monday and didnt tell the world . Thats a question we still have outstanding with the white house. So we expect the Attorney General will have to explain what course hes going to take now. Evan perez kicking us off. Theres a separate investigation of donald trump for similar, not exactly the same, but classified documents removed from government property. The president has sort of rolled his eyes at donald trump. If youre the Attorney General of the United States, do you have a choice now . The big question is when did they find these documents and what did the attorney in chicago know . Garland has taken the right first step. He has appointed someone to review the first documents that were found in a former office in d. C. The question is how much of these additional documents were known by how many were known by the u. S. Attorney . Perhaps they expand the review, reup up, because based on our sources that review was done earlier this week. Perhaps he has to expand it or extend it. If you have to tap a Special Counsel, theres a short list of people who are able and an even shorter list of people who are willing. Its very difficult and made further complicated by the fact that we dont have a lot of the facts here. Youve served inside the building. Justice is supposed to be blind. Vest investigation a doesnt have anything to do with investigation b. However, Merrick Garland lives in d. C. , he knows what republicans are saying and the former president of the United States is saying. Does he have a choice . Or is the best course legally and politically to say, maybe its a short list, maybe its hard to find somebody, but im going to find somebody who has the credentials, let them do an independent review, then they will speak . Its not just washington, d. C. , its not fantasy land, john. The simple fact is we live in a world where people ascribe political motivations to decisions all the time. Lets look at whats happening. What donald trump has right now is a legal problem based on that search warrant, based on everything else. What President Biden was is a pr problem. This is something that they have not managed effectively and not really managed well. The way around that is to sort of minimize some of the Political Considerations and probably to appoint a Special Counsel. As i told you months ago, i think the Justice Department is perfectly capable of investigating something in an apolitical way, but its how the public sees it. And i think the risk of appearing to be political, they probably dont have much of a choice here. Arlette, what has this done to the mood at the white house and the president . Remember, the first disclosure, the president was in mexico city at an Important International meeting. He finally talked about it but didnt want to. Today at the white house he wants to celebrate data that does Show Inflation is easing and thats an accomplishment for the American People but good news for the president of the United States. But he had to deal with this. This is the new nugget he gave us. People know i take classified documents and classified materials seriously. I also said were cooperating fully and completely with the Justice Departments review. They discovered a small number of documents of classified markings in Storage Areas and File Cabinets in my home and my personal library. The Department Of Justice was immediately notified and the lawyers arranged for the Department Of Justice to take possession of the documents. So were going to see all of this unfold. I get it, it is very sensitive and the president is trying to say i wish i could tell you more, but i have to wait. Are they done . Are they sure they have searched now everywhere where there might be documents and theres not going to be a third day . We dont exactly know if thats the answer. We know he has that home in wilmington, and then at the beach and he had been working out of the penn biden center. The president has been very limited in what he can say, his lawyers have been limited in what they can say. There are so many answers they still need to discuss. He suggests the review is complete soon, hell have more to share. But theres questions about how did documents how did they handle documents when they left the vps office during the transition period as he was setting up those various offices, who would have been responsible for packing up some of these documents, could some of these documents have been holdovers that he had taken to his home in wilmington on a weekend, for instance. So theres so many issues that are at hand right now, this is a political headache thats turning into a lingering migraine. But it gives republicans such an opening to be able to criticize biden on this at a time when the Biden Administration is trying to make distinctions about the way the former President Donald Trump handled it and the way hes handled it. And to that point, lets segue to politics in the sense that if republicans say democrats in the senate, the bipartisan Intelligence Committee says she want answers, in the House Republicans say they believe they should have hearings. It is worth noting at home, they dont say President Biden and President Trump. The republicans are ignoring President Trump and based on everything we know, President Biden has a problem, President Trump has a bigger problem, based on everything we know to date. Listen to House Speaker Kevin Mccarthy saying, ahha. Not once, but now were finding in two different locations Classified Information just out there in the open. I think congress has to investigate this. Here is an individual thats been in office for more than 40 years, here is an individual that sat on 60 minutes that was so concerned about Donald Trumps documents and now we find it just as a Vice President keeping it for years out in the open in different locations. Again, no mention that why dont we investigate trump and biden at the same time and look into the issue of the security of classified documents. People at home can make political judgments on that. But this is tball for the republicans because biden did say what donald trump did was reckless and irresponsible. Hes really given them an opening. And we know voters, if they feel like theyre not getting all the information, the white house is making a strategic decision to allow these details to leak out through the media, and what we saw with the Hillary Clinton email investigation, if voters feel like theyre not getting details or theres a, quote, unquote, coverup, this can metastasize into a serious political liability. But i do have to fact check the differences between the cases. We have classified documents found in multiple locations. But when it comes to the volume of material and cooperation, completely different based on what the biden team is telling us so far. The former president is under investigation for Obstruction Of Justice and other crimes because on the way he and his attorneys have handled that matter. But this biden matter still relatively new to us. The other one has been going on for a lot longer. Elliot, whether its the investigation about former President Trump or joe biden, you take into consideration, was this done deliberately, did you forget to return them. Help they understand in the digital age, when you check a bag on a plane, by the time you get to the seat you get a text that your bag has been loaded on the plane. Why cant we keep better track of classified documents and where we are so the archives knows at any given moment or the Intelligence Community knows this document is not where its supposed to be . I think part of the issue is that adding in any new technology is itself a potential vulnerability. If you start adding in bar codes and scanning and screening, you might invite more abilities for hacking. The big picture is we have a problem if and, frankly, this is far beyond trump and biden. Every president has slipped up in some way. What this comes down to is the word intent. Can prosecutors prove that someone willfully or knowingly got documents. That is not president today in the President Biden investigation in a way that with former President Trump, youre just seeing intent and possible obstruction from the former president. So its just a little tricky to compare the two. I get your point about you add more technology, you add more risk. But we have two Different Cases that need to be sorted through. There should be a serious conversation. Im not smart enough to know how, but can we do a better job of deciding this is not where its supposed to be. Reporter more lies and he has admitted to a lot of those lies and could be facing potential Fraud Charges in brazil, all raising questions about whether he can effectively serve this district. In talking to a number of new york republicans, the answer is they believe he cannot serve effectively and more and more republicans are calling for his resignation. Hes lost the confidence of people in his own community, so i think he needs to seriously consider whether or not he can actually do his job effectively, and right now its pretty clear he cant. I dont think theres any way he could possibly perform his duty. Are you saying he should resign . Theres no way i believe he can fulfill his responsibilities. Reporter he does have some critical support from Kevin Mccarthy, the House Speaker, who does not call for him to resign. He says its up to the voters to decide, he says this will go through the House Ethics Committee and they will decide what to do. I asked mccarthy if hes comfortable, if he trusts George Santos getting access to Classified Information and he suggested that he said he would not give Classified Information, but he will as a member of congress have access to the same kind of briefings as any member of congress. He also will get Committee Assignments next week. Mccarthy says he will be held to the same standards other members of congress, if they are charged they would lose Committee Assignments and other actions could be taken. But the only other action if he does not resign is to expel him from the house, which requires a twothirds majority and that is not there with the support of Kevin Mccarthy, who needs that seat. If it were to open up, it could be a big democratic Pickup Opportunity in that district. Important developments on the hill. Thank you so much. Lets bring the conversation in the room. Michael, lets listen to the speaker. Manu raju just mentioned Kevin Mccarthy. Republicans always say defer to local people. Thats our philosophy, get your information. The local Republican Party says hes got to go. The fellow new york freshmen say hes got to go. Kevin mccarthy needs that vote, says not so fast. Hes got a Long Way To Go to earn trust. But the one thing i know is you apply the constitution equal to all americans. The voters of his district have elected him. He is seated. He is part of the republican conference. There are concerns, so he will go before ethics. If anything is found to be wrong, he will be held accountable. A quick hypocrisy point. The voters of america voted for joe biden and even Kevin Mccarthy tried to block his transition to the white house. This is different because its about Kevin Mccarthy and his power. Thats right, hes going to hold onto that vote as long as he can. Its not a Long Way To Go. The clock is ticking. At most, its two years. Santos Talking Point is 142,000 people elected me. Those people are not going to be there if the whole republican establishment is not with him. So hes not going to win reelection, plus he has several investigations, and the biggest questions outstanding are where did the 700,000 loan that he made to his Campaign Come from, he didnt have that real income. And theres also questions being raised about a separate fundraising effort, a donor saying i gave 25,000 to the super pac but i dont know what happened to the money. When you come to issues like Straw Donations and things like that, those are real crimes that the federal government will go after. Crimes that take months and months to document and prove and then, if there are charges, administrative charges, there are appeals processes. This can go on for months and months. Is that mccarthys end goal . If he survives two years, they will run a primary campaign against him to try to keep the seat. Is that mccarthys goal, i need to keep this guy around, as much as it stinks . Its sure what it looks like. At the end of the day, santos has proven to be a reliable mccarthy vote. He voted for mccarthy for 15 rounds during the speakership race. I think mccarthy is kind of keeping santos loyal by saying these things about representative santos. At the end of the day, if santos resigns, there would probably be a special election that democrats would try really hard to pick up that seat. So the political upsides are for mccarthy to keep santos there, but maybe keep him at arms length, keep him in a bubble, so to speak. Thats just the politics of the situation. Power over principle. Not the first time weve said that. And democrats, i assume at the white house they feel this way, democrats certainly love it. This is ted lu. Article 1, section 5 explicitly authorizes congress to expel a member with a twothirds vote. Allow a floor vote on whether to expel George Santos. That would be a rich moment early in the new republican majority. Number one, they think the facts are on their side, but that would be a rich political moment. And really this is all creating so much of a distraction for what republicans are actually trying to do as they take over control of the house when it comes to investigations into the Biden Administration or other fights theyve been teeing up. Now theres so much energy and the George Santos story is sucking all the oxygen out of the room. Well see if that will eventually have an influence on Kevin Mccarthy. But i think has everyone has said, he wants to keep control and that new york seat is going to be incredibly important. It seems like hes going to side with santos. So you look at this and listen to rankandfile republicans and they think this is horrible, were embracing a liar. In the age of trump, maybe thats less of an issue than i think it is, history might think it is. The New York Times obtained George Santos resume and im going to go through two pages. You can find this online. Theres a whole bunch in here where he said he worked for companies that never happened. He didnt work there. But the rich part here, i was joking with these guys before we came on the air, we went around the table and asked everyone their gpa. George santos claimed he had a 3. 89 gpa at a college he didnt attend. The resume leaves out that he was a star volleyball striker, which also wasnt true, which he told somebody at a party. Its, i think, pathological what were looking at. Its not just someone who embellished their resume. This is someone who has lived their life sort of as a conman and finally got the brass ring. Is there a Tipping Point for mccarthy . I get the raw politics of this, i get the narrow margin. I get the math of why Kevin Mccarthy would want to keep George Santos around as long as he can. He made a whole lot of concessions saying, we have a big tent, were going to listen to everybody. Does this get to a point where if enough rankandfile say we cant do this . I think the Tipping Point usually comes from the people, when the voters at home start leaning on the elected officials and saying youre supporting a guy who is a liar and a fraud and we dont like it, and then those elected officials start leaning on Kevin Mccarthy to say, hey, were going back home and were getting yelled at in the Grocery Store and our people are saying, what are you guys doing In Washington . The president this morning saying the United States continues to head in the right direction. When i came to Office Almost two years ago, the economy was flat on its back. Cnns matt egan joins us live. Walk through these new inflation numbers. Is it all good news or is there anything in there to worry about . John, we know that momentum can be a powerful thing. We see that in sports, politics, and i think were seeing it now in the economy. It finally feels like the fed has the upper hand here in putting this Inflation Fire out. So Consumer Prices were up by 6. 5 yearoveryear in december. Thats not good but moving in the right direction. Its the sixth straight month of improvement. Monthovermonth prices declined. We havent seen that at all during the inflation crisis. Lets look where prices are cooling off. We saw price declines yearoveryear for gasoline. Thats a big deal. Used cars down almost 9 . Television. Clearly supply is catching up to demand. The cost of living does remain problematic elsewhere. Inflation is still the biggest problem in this economy, but it is getting better. Kevin mccarthy, very happy to finally be in the speakers office, and now were beginning to get more of the details of those side deals he cut to get the final votes, side deals with the holdouts who were keeping him from being speaker. Lets walk through some of this. Back when we were electing a speaker, there were 20 republicans initially who said either never kevin or not yet kevin until we get something out of this deal. Here are the 20 who at one point were not prepared to make mccarthy speaker. Obviously, most came around in the end and we know among the holdouts, three are on the very important House Appropriations committee. How are your tax dollars spent . Three of them getting seats on the House Appropriations committee. Three more getting seats on the powerful House Financial Services committee. This part of mccarthys negotiating, critics say just to add idealogical, geographical diversity to them. If you want to walk it through all the way and look at Freedom Caucus members, some were mccarthy supporters, many were among the holdouts. Now these important committees, some of them were already on these committees. These are not all new members. Freedom caucus members have more power on appropriations, more power on financial services, more power on energy and commerce. David schweikert was already on this committee. Lets bring in melanie zanona. The speaker says the holdouts are a good thing, it allows more diversity, idealogical, geographical, generational. Some say it puts people who like to cause trouble in important places. Its funny that instead of being punished, theyre being rewarded. One of the concessions Kevin Mccarthy made was agreeing to put more conservative hardliners on key committees and sources told me that at least six of the holdouts are now assigned to top tier Committee Assignments. That does make for a total of 16 house Freedom Caucus members on these key top tier socalled alist committees, and it is going to change the dynamics of how these committees operate, especially as they are approaching decisions about spending, government funding, the debt ceiling, something that is looming and will probably have to be dealt with later this year. But i will tell you that mccarthy allies are trying to spin this in a positive way and say theyre going to sort out all the potential issues before they get to the floor. The idea is when you come out of appropriations or Ways And Means with the debt limit, whatever key piece of legislation, every group has already had their fingerprint on it and it should help us get it through. Reporter there are more Committee Assignments to come, including house judiciary, oversight, rules, arms and services, and we are expecting those decision to say be made by next week.
