On capitol hill the January 6th Select Committee about to share striking never before seen testimony and evidence all with the Focus On Former President Trump and the central role the panel says he played in the attack on democracy. Welcome to cnns live coverage of the January 6th Hearings. Im anderson cooper. Im jake tapper. This is the final hearing. Committee members are promising to hammer home their urgent argument that donald j. Trump remains in their view a Clear And Present Danger to American Democracy as trump continues to push false claims about the 2020 election. Committee aides tell us the hearing today will zero in on trumps State Of Mind on and around january 6th. Were told well see and hear from Cabinet Officials, and other new witnesses who have recently been interviewed by the committee that could potentially include former Secretary Of State mike pompeo, former treasury secretary Steve Mnuchin and elaine chao. Some coming from the Secret Service. They have turned over more than a million emails and communications to the select committee and they could shed new light on trumps actions and intentions on january 6th, 2021. They could potentially corroborate some of the Bombshell Testimony from former white house aide Cassidy Hutchinson including her claims that trump knew supporters at his January 6th Rally were carrying weapons, were armed. Committee aides say the hearing will feature new Video Footage Showing Efforts to respond to the violence of january 6th as it was unfolding. Jamie raskin says all the new evidence will make the case that january 6th was premeditated and President Trump in his view was overwhelmingly culpable. Lets go right to capitol hill and our own manu raju. Tell us about what youre learning about the secret Service Communications that will be revealed in this hearing . Reporter yes, a source tells me the Committee Plans to show messages the Secret Service was aware of increased violent rhetoric that was on the social media site parlor. Rhetoric directed at Government Officials, in particular the day before the january 6th attack on january 5th, 2021, one agent reported that some of that violent rhetoric was directly squarely at then Vice President mike pence who, of course, donald trump wanted to overturn the Election Results while presides over the joint session of congress certifying the Election Results on january 6th, 2021. The Committee Also has messages showing how the Secret Service was aware of weapons on the crowd, in the crowd on january 6th of that rally that donald trump attended, the rally in which led preceded the riot at the capitol and aware of bear spray, riot shields and aware some people even had guns, im told the messages will reveal they were aware people had body armor, ballistic helmets, Radio Equipment, Military Grade Backpacks and some did not want to go through magnetometers to make sure they were not with weapons. The Secret Service was aware they did not want to get screened and recall that Cassidy Hutchinson testified that donald trump did not want these people to go through the magnetometers themselves and did not want them to get screened even though the Secret Service knew they had weapons and they have a email detailing Donald Trumps mindset in the aftermath of the Supreme Court rejecting the effort to try to overturn the Election Results in middecember, 2020, donald trump was, quote, pissed according to one of the messages we expect to be seen. A big part of todays testimony, jake. All these messages coming from the secret Service Aware of what donald trump was doing and aware what was happening on the rally that preceded the riot. We have learned from multiple sources exactly what this video is, weve never seen it before. It is video Behind The Scenes of top congressional leaders, nancy pelosi, Mitch Mcconnell, Kevin Mccarthy, Chuck Schuemer after theyre evacuated from the capitol taken to fort mcnair. I am told it is remarkable. It is compelling. That it shows the congressional Leadership Interacting on the phone with then Vice President mike pence, with other officials, trying to stop the riot, trying to do the right thing and that it is in sharp contrast to what, to donald trump, who for 187 minutes just sat there, this is something we have never seen before and im told its stunning. Trump aide Sarah Matthews said that because trump didnt do anything during that time thats why she resigned that very day. That will be one of the theme, dana bash how culpable donald trump is. What can you tell us. Thats right. Two sources familiar with the prep for todays hearing say thats really the most urgent, most overarching goal they have to refocus on donald trump himself, his, quote, action and inaction, thats how one of the sources i talked to put it and his central culpability in all of this and it is in part going to be demonstrated by what man new was talking about, all the information they got from the Secret Service and emphasis, of course, on what the goal and the mission of this committee is, which is the days leading up to, months leading up to january 6th and what happened on that day. But the Committee Members want to also make a very stark and clear point that the former president is a, quote, Clear And Present Danger in the future. Their audience, of course, the American People but also one source i talked to was very candid saying, its also the doj, the department of justice. I wonder if its the Justice Department even more than it is the American People at this point who probably largely made up their minds about how they feel. The Justice Department has its investigation ongoing. Members of the committee if we roll back the tape would have said what are they doing . I think the committee has come to understand Behind The Scenes the Justice Department is doing considerable work, bit of a timeout about being public because we have an election in 26 days but so theres a debate in the Committee Still about do you have a direct referral and do you lay out we believe donald trump broke law a, b, c, and d and the shift seems to be against that but in the report what they did, we have a proxy debate going on. They want to make the case against donald trump. He cannot be on the ballot again till 2024. There is an election on 26 days. The legacy of january 6th lives in races all around this country. Some candidates on the republican ticket who were here, here on january 6th at the capitol in the crowd. Some who helped donald trump try to overturn the elections including the man running for the governor of your home state, pennsylvania. Others who are running, saying that the legislature should be able to come together if we dont like the way the people voted we should be able to overturn results. Its interesting as the Committee Makes the argument against trump 204, the roots of this are getting deeper and deeper into american politics and into the republican bloodstream and make an argue about 2024. 27, 28, 29 days we will look at the results and maybe seeing the cancer has spread pretty significantly. I think thats a big fear and abby, we have seen conservatives, Adam Kinzinger and liz cheney of wyoming actually going and endorsing democrats even though these are especially liz cheney dyedinthewool conservatives endorsing democrats in places like arizona because these Election Liars who are theyre running on a platform of i will not count the votes in democratic leading counties are on the ballot and could win. Yeah, i mean country over party. I mean, imagine such a thing. It seems farfetched but i think they understand you cant even get to partisan differences if you dont even believe in the fundamental issue of democracy in the first place and for that, Adam Kinzinger and liz cheney have essentially been become estranged from their own political party, both of them implying they dont have a home among republicans right now, or until they fully the party fully rejects donald trump. I think one other thing about Adam Kinzinger and liz cheney and their effect on the committees work, they understand that the power of the evidence really matters, because theyre not just speaking to democrats and people who already believe in them. They also want to talk to their fellow republicans and i think todays hearing in which were going to hear a lot from a kind of almost like third party, the Secret Service and things that were happening contemporaneously, i think it has the effect of basically saying, like, these are people who dont really have a skin in the game. And heres what they were saying at the time and i think thats a really powerful source of information at this particular stage in the hearings. Yeah, factually, legally, morally, politically, all comes down to donald trump. Donald trump was the person who set this all in motion by the big law, he was the person who for whom this all was beneficial. He was the one trying to stop the peaceful transition of power by whatever means possible. Legal, illegal, violence, lies, and it all comes back all the audiences, this connects to all the audiences including the doj because the two statutes involved are 18 usc 371 to defraud the United States which requires deceit and lies in trying to obstruct a lawful function of government and 1512, the Obstruction Institute which says that if you corruptly, again, that could be through lies or violence or anything else, to obstruct an official proceeding which this absolutely was of the United States government, you go to jail. And it all dove tails. I guess well see if were a nation of laws in the coming days as theyre beginning to get ready for the hearing. We learned itll feature but dramatic never before seen video of congressional leaders after they were evacuated from the Capitol On January 6th and expect new evidence from Hundreds Of Thousands Communications turned over by the Secret Service. As the hearing plays out the committee is Still Deciding whether to send criminal referrals to the Justice Department. Sarah, what are you learning about that . This is not something they have to do or necessarily may want to do. No, its not something they have to do. One of the things that we know is the committee is going to highlight evidence they believe could be of use to prosecutors who are Going Forward with these criminal investigations. You know, we dont expect to see the criminal referral today. The committee is still figuring out the timing, if they actually want to do it but know the Justice Department probe is moving forward and there is a criminal investigation going on in georgia and want to make sure they are putting front and Center Information they think could be helpful to those prosecutors. One sort of more Minor Example of that they sent a letter to Newt Gingrich asking him hto coe in for a voluntary interview. Prosecutors in georgia moved quickly after that letter to subpoena him. Sara murray, appreciate it. From a legal standpoint, is there any reason for them not to send a criminal referral or to send some sort of referral . Criminal referral meaningless as a legal marrit. Its important symbolically but prosecutors get referrals all day every day. Any of us could pick up the main dane of doj they dont need a criminal referral from the committee. And doesnt force them to do anything. That said i think the evidence that the january 6th committee uncovered is the thing and we will hear a prosecutorial style Closing Argument because, lets remember how much new information, crucial new information weve gotten from the january 6th carman. We didnt know who cassidy was in the days and weeks following january 6th. We hadnt seen the texts from mark meadows and what you can see here, the committee is leading the way and doj is following. But there are some members who say its not their job to do that. Thats not the job of congress. And more than one member of the Committee Said the only way we would do this if it were unanimous. What about a final report being issued. Thats going to be very crucial but, remember, talking about theyve used this medium of television and have been intentional in doing so to have the broadest ausdz, the idea of listening or reading through the congressional report, probably not going to be the most enticing thing for people to see, however, the job today will be of a trial attorney. They have to have the summation and want to tell you its been months since ive seen you. New people are here. I would revisit this moment. The big picture here is i told you what i was going to tell you, there was a connection to the white house, that there is democracy on the ballot, here is why its still important. But the way they do it today will be the most crucial. If they find themselves in the minutia of trying to corroborate i think they will lose the audience of the electorate as opposed to here is why this is still crucial. Thats a difficult thing for them to do. Yes, the Justice Department does not need their criminal referrals but it has been interesting to see what the Justice Department has done in this period since we last saw this committee come together. Two thing, also, you know, the fbi search of maralago had not happened when we were at the last hearing. The other thing weve seen that i am told is the most concerning to trumps attorneys right now is the grand jury investigation happening in washington into the fake elector scheme. They have asked the doj asked the january 6th committee for information related to that and im told thats where theyve made a lot of progress. Theyve issued dozens of subpoenas and seized cell phones of some of these people and gone to fake or the grand jury in washington so, yes, some trump allies will say these January 6th Hearings dont mean anything, but they are kind of providing a road map that clearly the Justice Department is looking at very closely. Interesting youre hearing its the investigation to the electors of such concern. Thats where they i dont necessarily know or have reporting that thats going to result in any trouble for donald trump, per se, maybe it does on the sidelines but im told that is what they are most concerned with and where they think the most movement is going to happen. Of what theyve thats so important for this committee. Yeah. Because this committee has been talking about the fake electors and theyll make the case today, i believe, when they say why should we care about this now . The reason theyre going to say to the American Public because its going on now. What happened before is happening again. Only with more emphasis and more backing so if they show you the fake elector issue they can take you to the present where you see whats going on around the country. By the way, i mean, one person theyve spoken to since last we spoke was ginni thomas, the idea of Election Denialism still going on. She still stands by it. And she still also is the wife of a Supreme Court justice who is the gatekeeper in some respects to the maralago notions of the Document Review and whats going on from there. We cant look at these things in a vacuum. Their job today will help the American Public understand there are all these different Vantage Points youve seen, Secret Services vantage point, those in the inner office and oval office, the president not so much but everyone around, the Oath Keepers Trial still going on, et cetera but the real notion to your point you mean to tell me there is a Supreme Court justice whose wife has engaged in Election Denialism and testified before the committee. There is this ongoing thing with maralago . I mean they will have to connect the dots to make it real. It isnt in the rearview mirror. The tag line weve been hearing previewing todays Clear And Present Danger, they say donald trump remains a Clear And Present Danger to democracy. I think thats a sort of catchy phrase but think thats a call up the block to doj, because they understand the hearings work will be over after today. Yes, they will issue a report that will be important but for people thinking about consequences beyond a report which you can buy in a book store and read and will be importantly historically, that will fall to the United States department of justice, i think the committee understands todays hearing is really a moment of torch passing really from congress over to doj. How might the evidence presented today influence the investigation by the Justice Department . Well, andy, every single one of these hearings has helped the Justice Department make the case certainly that they need to get some of the same testimony that this committee has been able to get and, you know, playing out right across the way from the capitol at the u. S. Courthouse is a fight thats been going on over privilege, whether the former president has been arguing some of his closest aides, some of his top people in the administration arent allowed to provide testimony to the Justice Departments investigation, which is looking at not just january 6th, obviously, the effort also to impede the transfer of power. Today, just today we saw marc short, who was former aide to the Vice President pence, kash patel, former National Security aide to the former president , you see them there exiting the federal courthouse. Anderson, at the courthouse there was a fight where the former president arguing they were covered by Attorney Client privilege and not allowed to provide testimony to this investigation. The Justice Department has been arguing that they are and the fact that they provided some of this testimony to the committee is helping that case. So today obviously we asked marc short what this was about and wouldnt answer the question but you can bet, anderson, this is an important fight and thing that really is going to have consequences in the coming weeks and months, as the Justice Department decides whether charges are coming from here. Carl, it took two years to unfold, 21 months since the insurrection. What do you expect today . What questions still need to be answered . The big question is, how, wide and deep is the consider to stop free elections in this and open and shut case that donald trump impeded that most basic element of our democracy, that he stood at the head of a conspiracy to undermine free elections in this country, that we are going to see today including a tiktok, parts of it that the committee has developed that on january 6th, the 1887 law that specifies you have to have the president of the United States elected on that day beginning at 1 00 p. By the congress, that law was impeded, trump identified the weak spot in American Democracy which is you impede that meeting, you dont let it happen and you have set the grounds for a revolution to impede the free election and thats what happened. All those witnesses, you saw come out of the courthouse and that evan was talking about a moment ago, they most of them are the conspirators with the president of the United States. Marc short by the way is not in that. I said not all of them. He was the one we were showing. He just happened to be the one that got followed by the cameras. John dean, no new Witnesses Today from what we understand. No live witnesses. We may see some witnesses we havent seen before on tape, pompeo or others. Were you also expecting to hear from all the members of the committee which always makes me pause because often whats been remarkable about this committee is how laser focused theyve been and only allowed one or two Committee Members to be the ones really asking the questions. I dont know if this has become like every other Committee Meeting where people want to make sound bite. I dont think so. I think what theyll do is laser focus, if you will, on different areas to make sure they show the full picture. Theyve clearly got a theme with the cheer and present danger thats very impactful. But as far as this effort, this effort to influence justice and the department of justice, i dont see that, thats what theyre doing. I think that justice goes down its own track. The Congressional Committee goes down its own track. It has a different aim. It has to impress the public, that there is a problem here, we need laws, so these are really different situations. Franklin, you at the atlantic profiled attorney general Merrick Garland. How do you think he is using the committee and moving forward. He watches these hearings. He said he was watching them in public and hes very adamant that he goes home and he recaps them all the time. So i do think hes paying attention and that cant help but influence the way he sees the Bigger Picture but i think john is correct. His investigation is moving on a separate track and very important to him in the way he thinks about his job and his responsibilities that in the end, hes not actually influenced by this but i think there is a Singer Gist Tick Relationship between the congressional investigation which has certain Subpoena Powers able to puncture certain privileges that the Justice Department cant puncture which is why theyre so keen to get hold of these transcripts then the Justice Department has its own Subpoena Powers and so what is striking to me is how after this thorough investigation where we have this abundance of evidence, Technology Permits to us see everything. We have all these Text Messages yet there are other technologies encrypted and the ability to hide is still there and so at the end of the day, were still left with dots that havent really been fully committed. Even though the most overt and obvious parts of the crime are just screamingly obvious and will be hammered home today. Do we know has the committee shared all of its information with the department of justice because early on it seemed like there was quibbling going back and forth or some sort of turf war. Im not entirely sure about that. I think that most i think some has been shared but not all all of is has been. Merrick garland, did you get a sense of a time line he has . I mean obviously theres a lot of work still to do. I think that theres a time line that exists where we know that if theres going to be an indictment against donald trump, that results in a trial of donald trump, before the next the turn of administration, it would have to come by late spring next year. Because theres this long delay between when a trial is scheduled and when it actually happens and if its a trial that related to something that chaim out of january 6th there is a massive amount of discovery. This is the most thorough investigation Merrick Garland says in the history of the Justice Department. So and a trial could take six months or so if it was about something as complicated as this. A perfect example of how these can go down different tracks is the watergate tapes. Those were discovered by congress and then they were not not yeah. We learned the January 6th Select Committee is about to share some compelling never before seen video of congressional leaders, democrats and republicans, after they were evacuated from the capitol during the riot. This hearing obviously comes at a Pivotal Moment in the investigation of donald trump and his efforts to overturn the 2020 election. Were getting new information about the Thinking Inside Trump world at this moment in the investigation of donald trump, Kristen Holmes has been digging in on that. What are they telling you. Reporter look, trump world is very slick. On one side you have donald trump himself and the aides, advisers and allies who dont have the same protections that the former president has so when it comes to former aides, allies and advisers, many are on edge ahead of the hearing. As kaitlin said a lot happened since the last hearing. Dozens of subpoenas went out to those in trump world for the department of justices own investigation into january 6th and many in trumps orbit believe those subpoenas stemmed from evidence that was presented at these televised hearings so hearing from a lot of people who are slightly worried about what might be revealed today. Whats the next shoe to drop . Another aide telling me if i appear in the background of some video does that mean the department of justice is going to come after me . So a lot of concern on that side and they will be watching very closely. Remember, many of them have turned over documents but still havent been interviewed by the department of justice and dont want to be. On the other side you have donald trump himself who is completely distracted by the number of federal, state investigations, court cases and im told hes absolutely fixated on that documents case out of maralago watching the back and forth closely Walking Around maralago lamenting hes being treated unfairly, raging he is not treated the same as other president s so hes distracted by what many believe are his very deep concerns over legal troubles, but, again, his aides, they will be watching closely to see how this might impact them as well. Oh, he absolutely is and the committee up until this point has masterfully laid out the case of every step of wrongdoing from the Pressure Campaign on mike pence to the fake elector schemes to being okay, frankly, with the fact that rioters who showed up being warned that they were planning to commit violence, that they may have had weapons on them and he himself wanted to go to the Capitol On January 6th. We dont know what is going to happen with the countless investigations into donald trump. But these Committee Hearings matter because its at court of public opinion. What did they know and what did they know it and the threat level. What was the threat level going into january 6th, were they communicating to the Vice President s team what they were seeing . Were they concerned about it . And then what was the exchange with sort of the National Security apparatus as well and what were they telling the u. S. Capitol police because usually theres a lot of coordination that happens in that in the leadup to it and so what did they know when and what did they do about it and as it was going on, as they were telling each other were seeing guns, were seeing this, this is real and its getting out of control what was the response to that . Were they communicating with people inside the white house . Who was involved in that and what was done and, you know, while he, donald trump, sat there and did nothing. Did nothing. Almost all of her testimony was about things she saw and witnessed, but one item was about a story she had been told by the then White House Deputy Chief Of Staff tony ornato, former secret Service Agent and ornato told Cassidy Hutchinson in front of another secret Service Agent about this incident where trump was lunging for the wheel of the president ial suv because he wanted to go to the capitol. Do you think were going to get corroboration from this all the Secret Service data that has been turned over to the committee because i found Cassidy Hutchinson very credible. My understanding is tony ornato refused to come forward and answer questions in an open hearing even though hes been on a Whispering Campaign ever since. But do you think well see corroboration . I am hopeful we will see corroboration of that because as someone who worked firsthand with cassidy and tony, i can attest to the fact they had a very close relationship at the white house. And they were friendly with each other so its not unsurprising to me that tony would share a story like that with cassidy and then on top of that i think the Secret Service Text Messages being deleted kind of lends credence to cassidys testimony that maybe there was some sort of coverup going on. A source in house gop leadership tells me they want to keep the message squarely focused on the economy and inflation and that todays hearing has not come up in some of their messaging and strategy meetings. They do can plans for a formal rebuttal and conducted their own investigation and their own report that is narrowly focused on the Security Failures that led to the breach but they are going to save that for whenever the select committee unveils their final report later this year. And additionally im told, jake, that the house gop twitter accounts that landed in hot water previously during some of these hearings are planning to dial down their tone today, so they have gotten in trouble previously for some tweets including one that was deleted attacking Sarah Matthews, a witness. So the game plan today is to lay low. Theyre trying to focus on economy and they are betting that republicans, voters across the country are going to care more about the economy than todays hearing, jake. John king. Im not saying its good for the country or longterm future of the party or principle to ignore facts but politically its smart for the republicans to go away. Its been hard to push back on whats been presented by the january 6th committee because its coming from trumps own aides including some who still work for him. Its coming from a bunch of republicans and its in some ways his own words and actions. Its been difficult for republicans to figure out how to launch a fullthroated defense of trump in light of the way that the evidence has been presented. But the messaging they dont have a lot of oopgs. Their messaging is so bizarre, though. Its not just a different message from the great communicator ronald reagan. Its a troll account. I mean, House Republican conference. They post memes of johnny depp. They talk about they praise kanye west just a couple of days before kanye west went on a antisemitic rant. They dont take it down. I dont know who it is for. It is for a whole segment. There is a whole segment of the Republican Base right now that is very, very online. They are all about just sticking it to the liberals online and thats who theyre speaking to. A lot of those people are trump people. Trump cultivated those people but thats what its all about. Not about policies or anything. Lets take a step back and talk about what well hear today in this hearing thats going to begin any minute. There is the chairman of the committee, Bennie Thompson. Democrat of mississippi as followed by i think liz cheney, the republican of wyoming, the vice chair of the committee stepping up. Were told theres a lot of these people are not going to be back in Congress Next year, stephanie, from florida, Adam Kinzinger from illinois not returning to congress and, jamie, i mean, this committee has not disappointed when it comes to new, shocking information. They have always underpromised and overdelivered and i think were going to see that again today with the secret Service Messages and also with this new behindthescenes video which i am told is stunning and, remember, its not just nancy pelosi and Chuck Schumer Behind The Scenes, its two republicans to the point of that republican twitter account, youre going to see Kevin Mccarthy. Lets listen in. The select committee to investigate the january 6th attack on the United States capitol will be in order. Without jokeobjection the chair ready to it in recess at any point. They will release Deposition Material presented during todays hearing. Good afternoon. And may god bless the United States of america. Four months ago, this committee started to present our findings to you, the American People. From the beginning, we understood that some people watching those proceedings would wrongly assume that the committees investigation was a partisan exercise. Thats why i asked those who were skeptical of our work to simply to listen, to listen to the evidence, to hear the testimony with an open mind and to let the facts speak for themselves before reaching any judgment. Over the course of these hearings, the evidence has proven that there were a multipart plan led by former President Donald Trump to overturn the 2020 election. Donald trump lost his bid for reelection as shown from the testimony of some of the president s closest allies and advisers, donald trump knew he lost. Despite this knowledge, donald trump went to court to contest the 2020 election and he lost in court. The Electoral College met and declared joe biden the winner, yet donald trump continued to pull out all the stops in his attempt to stay in power. What donald trump proceeded to do after the 2020 election is something no president has done before in our country, in a staggering betrayal of his oath, donald trump attempted a plan that led to an attack on a pillar of our democracy, its still hard to believe. But the facts and testimony are clear, consistent and undisputed. How do we know this . How have we been able to present such a clear picture of what took place . Because of the testimony weve heard and that weve had presented to you through these proceedings, because of the Documentary Evidence weve gathered and also made available directly to you, the American People, when you look back at what has come out through this committees work, the most striking fact is that all this evidence come almost entirely from republicans. The evidence that has emerged did not come from democrats or opponents of donald trump. Instead, look at who has written and testified and produced evidence. Who has that been . Aides who have Worked Loyally for donald trump for years. Republican State Officials and legislators, republican electors, the chairwoman of the Republican National committee. Political professionals who worked at the highest levels of the Trump Campaign. Trump appointees who served in the most senior positions in the Justice Department. President trumps staff and closest advisers in the white house. Members of President Trumps family. His own white House Counsel. Ive served in congress a long time. I can tell you its tough for any congressional investigation to obtain evidence like what weve received. Least of all such a detailed view into a president s inner circle. And i want to be clear, not all these witnesses were thrilled to talk to us. Some have put up quite a fight, but ultimately the vast majority cooperated with our investigation and what weve shown you over the last four months has been centered on the evidence, evidence that has come overwhelmingly from republican witnesses. So i say to you again as i did in june, this investigation is not about politics. Its not about party. Its about the facts, plain and simple and its about making sure our Government Functions under the rule of law as our constitution demands. Today, as in previous proceedings, my colleagues and i will present new evidence that includes new testimony from additional republicans who served in the Trump Administration never before seen footage of congressional leaders on january 6th working to coordinate the response to violence and ensure the peoples business went forward. New tears produced to the committee by the Secret Service. Details about the ongoing threat to American Democracy. Todays proceeding will also be grounded in the facts. But it wont look exactly like all our other hearings. Well also take a step back and look at the evidence in a broader context providing a summary of key facts weve uncovered. Facts relevant to former President Trumps State Of Mind about his motivation and about his intent. What did President Trump know . What was he told . What was his personal and substantial role in the multipart plan to overturn the election . For those of you who watched our prior hearings, some of this evidence will look familiar, for those of you tuning in for the first time, will summarize some of the most important facts and urge you to go online and watch our hearing in full. As one more difference about today, pursuant to the notice circulated prior to todays proceedings, we are convened today, not as a hearing, but as a formal Committee Business meeting so that in addition to presenting evidence, we can potentially hold a Committee Vote on further investigative action based upon that evidence. Before we get to that evidence, id recognize our distinguished vice chair, ms. Cheney of wyoming for any Opening Statements she cares to offer. Thank you very much, mr. Chairman. Much has happened since our last public hearing on july 21st. As the chairman mentioned we received new and voluminous documentation from the Secret Service which we continue to analyze. Weve received new Witness Testimony including about efforts to obstruct our investigation and conceal key facts. And according to public reporting the department of justice has been very active in pursuing many of the issues identified in our prior hearings. Our committee may ultimately decide to make a series of criminal referrals to the department of justice but we recognize that our role is not to make decisions regarding prosecution. The preamble to our constitution recites among its purposes to, quote, establish justice and our nations judiciary and u. S. Department of justice have that responsibility. A key element of this committees responsibility is to propose reforms to prevent january 6th from ever happening again. Weve already proposed and the house has now passed a bill to amend the Electoral Counteract to help ensure that no other future plots to overturn an election can succeed. And we will make further specific recommendations in our final report based in part on the evidence you will hear today. Our hearings last summer began with an outline of President Trumps multipart plan to overturn the 2020 president ial election. We then proceeded to demonstrate each of these elements in detail with more than 20 hours of evidence. Today we will see new evidence but as the chairman said we will also Symptom Thiez evidence youve seen before. The vast weight of evidence presented so far has shown us that the central cause of january 6th was one man, donald trump, who many others followed. None of this would have happened without him. He was personally and substantially involved in all of it. Exactly how did one man cause all of this . Today we will focus on President Trumps State Of Mind, his intent, his motivations and how he spurred others to do his bidding. And how another january 6th could happen again if we do not take necessary action to prevent it. As you view our evidence today, i would suggest a focus on the following points, first, as you will see, President Trump had a premeditated plan to declare that the election was fraudulent and stolen before election day, before he knew the Election Results. He made his stolen election claims on Election Night against the advice of his campaign without any evidence in hand. Then over the next two months he sought to find those who would help him invent and spread lies about the widespread fraud. Many of those who stepped forward to help including Rudy Giuliani knew they never had real evidence sufficient to change the Election Results and on the evening of january 5th they admitted they were still trying to find that phantom evidence. Of course, as a result of making intentionally false claims of Election Fraud, mr. Giulianis license to practice law has now been suspended. Second, please recognize that President Donald Trump was in a unique position, better informed about the absence of widespread Election Fraud than almost any other american. President trumps own Campaign Experts told him that there was no evidence to support his claims. His own Justice Department appointees investigated the Election Fraud claims and told him point blank they were false. In middecember 2020, President Trumps Senior Advisers told him the time had come to concede the election. Donald trump knew the courts had ruled against him. He had all of this information but still he made the conscious choice to claim fraudulently that the election was stolen. To pressure State Officials to change Election Results, to manufacture fake electoral slates, to attempt to corrupt our department of justice, to summon Tens Of Thousands of supporters to washington knowing that they were angry, knowing that some of them were armed, he sent them to the capitol. Then as the riot was underway, he incited his supporters to further violence by publicly condemning his Vice President. And then he refused for hours to disband his rioting supporters and instruct them to leave even when he was begged repeatedly to do so. None of this is normal or acceptable or lawful in our republic. Third, please consider today who had a hand in defeating President Trumps efforts to overturn the election. Vice president pence, bill barr, jeff rosen and others at the department of justice, state republican officials, white house staff who blocked proposals to mobilize the military to seize Voting Machines and run new elections, our Capitol Police, aided by the Metropolitan Police, other federal Law Enforcement and our National Guard who arrived later in the afternoon, all of these people had a hand in stopping donald trump. This leads us to a key question, why would americans assume that our constitution and our institutions in our republic are invulnerable to another attack . Why would we assume that those institutions will not falter next time . A key lesson of this investigation is this, our institutions only hold when men and women of good faith make them hold regardless of the political cost. We have no guarantee that these men and women will be in place next time. Any future president inclined to attempt what donald trump did in 2020 has now learned not to install people who could stand in the way. And also please consider this, the rulings of our courts are respected and obeyed because we as citizens pledge to accept and honor them. Most importantly, our president who has a constitutional obligation to faithfully execute the laws swears to accept them. What happens when the president disregards the courts rulings as illegitimate, when he disregards the rule of law . That, my fellow citizens, breaks our republic. Finally as you view the evidence today, also consider this, President Trump knew from unassailable sources that his Election Fraud claims were false. He admitted he had lost the election. He took actions consistent with that belief. Claims that President Trump actually thought the election was stolen are not supported by fact and are not a defense. There is no defense that donald trump was duped or irrational. No president can defy the rule of law and act this way in a constitutional republic, period. Mr. Chairman, our nations federal judges are sworn to do impartial justice, to preserve our constitution and preserve our union, dozens of these judges have been addressing january 6th cases and many have given us plain, unmistakable warnings about the direction of our republic. Let me read from one judges Statement Given at a recent sentencing hearing. Quote, high ranking members of congress and State Officials who know perfectly well the claim of fraud was and is untrue and that the election was legitimate are so afraid of losing their power they wont say so. It has to be crystal clear, that it is not patriotism, it is not standing up for america to stand up for one man who knows full well that he lost instead of the constitution he was trying to subvert. Mr. Chairman, the violence and lawlessness of january 6th was unjustifiable but our nation cannot only punish the foot soldiers who stormed our capitol. Those who planned to overturn our election and brought us to the point of violence must also be accountable. With every effort to excuse or justify the conduct of the former president , we chip away at the foundation of our republic. Indefensible conduct is defended, inexcusable conduct is excused. Without accountability, it all becomes normal and it will recur. So as we watch the evidence today, please consider where our nation is in its history. Consider whether we can survive for another 246 years. Most people in most places on earth have not been free. America is an exception and america continues only because we bind ourselves to our founders principles, to our constitution. We recognize that some principles must be beyond politics, inviolate and more important than any single american who has ever lived. Thank you, mr. Chairman. I yield back. Very shortly after the election, we began this meeting by returning to Election Night, november 3rd, 2020. As the chairman noted, weve previously presented testimony about how the Election Results were expected to come in that night in certain states, ballots cast by mail before election day would be counted only after the polls closed that evening. That meant that Election Results would not be known for some time. Although President Trumps Campaign Manager bill stepien, House Republican leader Kevin Mccarthy, and Jared Kushner had advised donald trump to encourage mailin voting by republicans, President Trump did not do so. Yeah, just remember generally, you know, you have people arguing that we had a very, very robust Get Out The Vote effort and that, you know, mailin ballots could be a good thing for us if we looked at it correctly. Theres one meeting that was had in particular, i invited Kevin Mccarthy to join the meeting. He being of like mind on the issue with me. In which we made our case for why we believed mailin balloting, mailin voting not to be a bad thing for his campaign, but, you know, the president s mind was made up. So it was expected before the election that the initial counts in some states, in other words, those votes Cast On Election Day would be more heavily republican and this would create the false perception of a lead for President Trump, a socalled red mirage but as the results of the Absentee Ballots that were later counted, there could be trends towards Vice President biden as those mailin ballots were counted. Now, on Election Night, Donald Trumps advisers specifically told him he didnt have a factual basis to declare victory. He should wait for the remaining ballots to be counted. Here is Campaign Manager bill stepien. It was far too early to be making any calls like that. Ballots, ballots were still being counted. Ballots were still going to be counted for days and it was far too early to be making any proclamation like that. I believe, my recommendation was to say that votes were still being counted, its too early to tell, too early to call the race. But President Trump did declare victory in the late hours of Election Night. Not only did he declare victory, he also called for the ongoing count of votes to just stop. Stopping the count would have violated both federal and state laws and also disenfranchised millions of voters who lawfully cast their vote. He called for that action anyway. Heres what he said. This is a fraud on the American Public. This is an embarrassment to our country. We were getting ready to win this election, frankly, we did win this election. We want all voting to stop. We now know more about President Trumps intention for Election Night, the evidence shows that his false Victory Speech was planned well in advance before any votes had been counted. It was a premeditated plan by the president to declare victory no matter what the actual result was. He made a plan to stay in office before election day. And the Vice President s staff was concerned with what donald trump might do on Election Night. They took steps to ensure that mr. Pence would not echo a false Victory Announcement from President Trump. Marc had indicated to me that there was a possibility that there would be a declaration of victory within the white house that some would push for and thats prior to their Election Results being known and that he was trying to figure out a way of avoiding the Vice President from being thrust into the position of needing to opine on that when he might not have sufficient information to do so. Now, following this conversation, mr. Jacob drafted a memo to there short which the select committee got from the National Archives. The memo was sent on november 3rd, election day, and advised it is essential that the Vice President not be perceived by the public as having decided questions concerning disputed electoral votes prior to the full development of all relevant facts. A few days before the election, mr. Trump also consulted with one of his outside advisers inside Activist Tom Fitten about the strategy for Election Night. The select committee got this preprepared statement from the National Archives. As you can see, the draft statement which was sent on october 31st declares we had an election today and i won and the fitten memo specifically indicates a plan that only the votes counted by the election day deadline and there is no election day deadline would matter. Everyone knew that Ballot Counting would lawfully continue past election day claiming that the counting on Election Night must stop before millions of votes were counted was as we now know a key part of President Trumps premeditated plan. On election day, just after 5 00 p. M. , mr. Fitton indicated hed spoken with the president about the statement sending a along again just talk to him about the draft below, again, this plan to keep to declare victory was in place before any of the results had been determined. In the course of our investigation, we also interviewed brad parscale, President Trumps former Campaign Manager. He told us he understood that President Trump planned as early as july that he would say he won the election even if he lost and just a few days before the election steve bannon, a former trump chief white house strategist and outside adviser to trump spoke to a group of his associates from china and said this. And what trump is going to do is declare victory. He will declare a victory and that doesnt mean hes at winner. Hes just going to say hes the winner. The democrats move of our people vote early that count. Theirs vote in mail and theyre going to have a natural disadvantage and trump is going to take advantage and thats our strategy. When you wake up wednesday morning, its going to be a firestorm. Also, if trump is losing by 10 or 11 00 at night its going to be even crazier. No, because im directing the attorney general to shut down all Ballot Places in all 50 states. Its going to be nuts. Hes not going out easy. If biden is winning, trump is going to do some crazy stuff. Mr. Bannon refused to testify. Hes been convicted of Criminal Contempt Of Congress and hes awaiting sentencing. But the evidence indicates that mr. Bannon had advanced knowledge of mr. Trumps intent to declare victory falsely on Election Night but also that mr. Bannon knew about mr. Trumps planning for january 6th. Heres what bannon said on january 5th. All hell is going to break loose tomorrow. Its all converging and now on the point of attack, right . The point of attack tomorrow. Ill tell you this, its not going to happen like you think its going to happen. Okay. Its going to be quite extraordinarily different and all i can say is strap in. You have made this happen and tomorrow its game day so strap in, lets get ready. Another close associate of donald trump apparently knew of mr. Trumps intentions as well. Roger stone is a political operative with a reputation for dirty tricks. In November 2019 he was convicted of lying to congress and other crimes and sentenced to more than three years in prison. Hes also a longtime adviser to President Trump and was in communication with President Trump throughout 2020. Mr. Trump pardoned roger stone on december 23rd, 2020. Now, recently the select committee got footage of mr. Stone before and after the election from danish filmmaker Christopher Gilbranson pursuant to a subpoena. Right before the election heres roger stone talking about what President Trump would do after the election. Lets just hope were celebrating. I suspect itll be i really do suspect itll be up in the air. When that happens the key thing to do is claim victory, possession is ninetenths of the law. Youre wrong. Lets get right to the violence. Its important. The select committee called mr. Stone as a witness but he invoked his Fifth Amendment right against selfincrimination. Do you believe the violence on january 6th was justified . On the advice of counsel i respectfully decline to answer your question on the basis of the Fifth Amendment. And mr. Stone, did you have any role in planning for the violence on january 6th . Once again, i will is assert my Fifth Amendment right to decline to answer your question. Although we dont yet have all the relevant records of roger stones communications, even stones own social media post acknowledge he spoke with Donald Trump On December 27th as preparations for january 6th were under way. In this post you can see how roger stone talked about his conversations with President Trump. He wrote, i also told the president exactly how he can appoint a Special Counsel with full subpoena power to ensure those who are attempting to steal the 2020 election through voter fraud are charged and convicted and to ensure donald trump continues as our president. As we know by now the idea for a Special Counsel was not just an idle suggestion, it was something President Trump had actually tried to do earlier that month. We know that roger stone was at the Willard Hotel on january 5th and 6th and we know from other Witness Testimony that President Trump asked his Chief Of Staff, mark meadows to speak with roger stone and general Michael Flynn that night. In addition to his connection to President Trump, roger stone maintained extensive, direct connections to two groups responsible for violently attacking the capitol. The oath keepers and the proud boys. Individuals from both of these organizations have been charged with a crime of Seditious Conspiracy. What is Seditious Conspiracy . It is a conspiracy to use violent force against the United States to oppose the Lawful Authority of the United States. Multiple associates from roger stone from both the oath keepers and proud boys have been charged with this crime. Close associates of roger stone including Joshua James Have pled guilty to this crime. We know that at least seven oath keepers who have been criminally charged provided personal security for roger stone or were seen with him on january 6th or in the weeks leading up to january 6th. For example, joshua james, the leader of the alabama oath keepers, provided security for roger stone and was with him on january 5th. This is the picture of the two together on january 5th. James entered the Capitol On January 6th. He assaulted a Police Officer. Earlier this year he pled guilty to Seditious Conspiracy and obstruction of congress. Another example is the married couple kelly and connie megs. Kelly megs was the leader of the florida chapter of the oath keepers. Both he and his wife provided security for roger stone and both are charged with leading a militarystyle stack attack of oath keepers attacking the Capitol On January 6th. Perhaps even more disturbing is roger stones Close Association with Enrique Tarrio, the National Chairman of the proud boys. Roger stones connection with Enrique Tarrio and the proud boys is well documented by Video Evidence, with phone records the select committee has obtained, tarrio along with other proud boys has been charged with multiple crimes, concerning the attack on January The 6th including Seditious Conspiracy. During the attack, tarrio sent a message to other proud boys claiming we did that. He also visited the white house on december 12th. Later that day he posted a disturbing video claiming accountability for the attack. This was apparently created prior to the attack. This big lie, President Trumps effort to convince americans that he had won the 2020 election began before the Election Results even came in. It was intentional, it was premeditated, it was not based on Election Results or any evidence of actual fraud affecting the results or any actual problems with Voting Machines. It was a plan concocted in advance to convince his supporters that he won and the people who seemingly knew about that plan in advance would ultimately play a significant role in the events of january 6th. Very shortly after the election the Trump Campaign recognized that they had likely lost the election and they informed donald trump of that fact. Even before the networks called the race for President Biden on november 7th, his chances of pulling out a victory were virtually nonexistent and President Trump knew it. Do you know if anybody ever told the president that he had lost and that there wasnt a chance of him winning . The i know that the president when the networks called it, of course, he was informed about the network decision. That afternoon at some point myself and a handful of other folks went over and sat down with the president and communicated that the odds of us prevailing and legal challenges were very small. You know, after the election as of november 7th, in your judgment, what were the chances of President Trump winning the election . After that point . Yes. None. At times President Trump acknowledged the reality of his loss. Although he publicly claimed that he had won the election, privately he admitted that joe biden would take over as president. Heres a few examples of that. So were in the oval and theres a discussion going on and the president says, i think it could have been pompeo but says words to the effect of, yeah, we lost, we need to let that issue go to the next guy, meaning President Biden. I remember maybe a week after the election was called, i popped into the oval just to like give the president the headlines and see how he was doing and he was looking at the tv and said, can you believe i lost to this fing guy. Marc raised it with me on the 18th. Driving back to the white house, said does the president really think he lost, and he said, a lot of times hell tell me that he lost but he wants to keep fighting it. He thinks there might be enough to overturn the election but pretty much acknowledged that hes lost. Knowing that he had lost and that he had only weeks left in office, President Trump rushed to complete his unfinished business. One key example is this, President Trump issued an order for largescale u. S. Troop withdrawals. He disregarded concerns about the consequences for fragile governments on the front lines of the fight against isis and al qaeda terrorists. Knowing he was leaving office, he acted immediately and signed this order on November 11th which would have required the immediate withdrawal of troops from somalia and afghanistan all to be complete before the Biden Inauguration on january 20th. As you watch these clips recall that general Keith Kellogg was the National Security adviser to the Vice President and had served as Chief Of Staff to the National Security council for President Trump and general milley was the chairman of the joint chiefs of staff at the pentagon. Are you familiar with a memo that the president reportedly signed on November 11th, 2020 ordering that troops be withdrawn from afghanistan and somalia. Yes. So, i think you might have seen some things where this memo or something from Johnny Mcatee to douglas mcgregor, it says, heres your task to get u. S. Forces out of out of somalia, get u. S. Forces out of afghanistan. When you first interviewed and met colonel douglas mcgregor, is it fair to say you discussed this decision of withdrawing from somalia and afghanistan . Correct. Yeah, im sure that was part of it, yeah. And that was the position that he was taking over there was Senior Adviser to the secretary of defense, is that correct . Yes. So on that same day, just so im clear, he responded back to you that they, meaning Dod Leadership was not going to do take any of those steps without an order . Without a directive, yeah. I explained in language that should be in the order while i was in the meeting with mcentee and this was my answer to him, i said, if you want this to happen or the president wants this to happen, hes got to write an order. So you never wrote it down in any capacity. I sketched on a piece of paper for him some key statements, you know, the president directs. You know, this is whats the right word boilerplate language. Who in the office drafted the order . It was myself and one of my assistants. Mcentee duly types it up, brings it into the president and the president signs it. Was it by auto pen or the president himself signing it . It was the president. And who obtained that signature . I did. It is odd, it is nonstandard. It is potentially dangerous, i personally thought it was militarily not feasible, nor wise. And i proceeded to tell the ppo and proceeded to Tell Macgregor that if i ever saw anything like that, um, i would do something physical because i felt that was was a tremendous disservice to the nation and, by the way, that was a very, very contested issue. There were people who did not agree with getting out of afghanistan. I appreciate their concern and immediate departure that that memo said would have been a catastrophic its the same thing for President Biden. It would have been a debacle. Keep in mind, the order was for an immediate withdrawal. It would have been catastrophic and yet President Trump signed the order. These are the highly consequential actions of a president who knows his term will shortly end. At the same time President Trump acknowledged pirately he lost the election he was hearing there was no evidence of fraud or irregularities sufficient to change the outcome. I remember, um, a call with mr. Meadows where mr. Meadows was asking me what i was finding and if i was finding anything and i remember sharing with him that we werent finding anything that would be sufficient to change the results in any of the key states. When was that conversation . Probably in november, mid to late november. I think it was before my child was born. And what was mr. Meadows reaction to that information . I believe the words he used were so theres no there there. It would be our job to track it down and come up dry because the allegation didnt prove to be true and wed have to, you know, relay the news that, yeah, that tip that someone told you about those votes or that fraud or, you know, nothing came of it. It would be our job as, you know, truth telling and, you know, not a fun job to be, you know its an easier job to be telling the president about, you know, wild allegations, its a harder job to tell him on the back end, yeah, that was the truth. What was generally discussed on that topic was whether the fraud, abuse or irregularities if aggregated and read most favorably to the campaign would be Outcome Determinative and i think everyones assessment in the room at least among the staff, marc short, myself and greg jacob was it was not sufficient to be Outcome Determinative. Look, its the right of any candidate to litigate genuine election disputes. Nobody argues that but President Trumps litigation was completely unsuccessful. And our past hearings we told you the committee had identified a total of 62 election lawsuits filed by the Trump Campaign and its allies between november 4th and january 6th of 2021. Those cases resulted in 61 losses and only a single victory which did not affect the outcome for any candidate. The claims were not supported by any sufficient evidence of fraud or irregularities. In fact, they were baseless as judges repeatedly recognized. In none of these 62 cases was President Trump able to establish any viable claims of Election Fraud sufficient to overturn the results of the election. In those hearings we shared with you the words used by judges around the country in rejecting the Trump Campaigns claims. Its Strong Language criticizing the lack of evidentiary support for the claims of Election Fraud in those lawsuit, for example, a federal Appeals Court in pennsylvania wrote, quote, charges require specific allegations and proof. We have neither here. A federal judge in wisconsin wrote, quote, the court has allowed the former president the chance to make his case, and he has lost on the merits. Another judge in michigan called the claim, quote, nothing but speculation and conjecture that votes for President Trump were destroyed, discarded or switched to votes for Vice President biden. A federal judge in michigan sanctioned nine attorneys including Sidney Powell for making frivolous allegations in an Election Fraud case describing the case as a historic and profound abuse of the judicial process. Recently a group of distinguished republican election lawyer, former judges and elected officials issued a report confirming the findings of the courts. In their report entitled lost, not stolen, these prominent republicans analyzed each election challenge and concluded this, donald trump and his supporters have failed to present evidence of fraud or inaccurate results significant enough to invalidate the results of the 2020 president ial election. On December 11th trumps allies lost a lawsuit in the u. S. Supreme court that he regarded as his last chance at success in the courts. A newly obtained secret Service Message from that day shows how angry President Trump was about the outcome, quote, just fyi, potus is pissed. Breaking news, Supreme Court denied his lawsuit. He is livid now. Cassidy hutchinson, an aide to Chief Of Staff mark meadows was present for that conversation and described it in this way. This is the day that the Supreme Court had rejected that case. We were in the white house residence at a christmas reception. And as we were walking back from the christmas reception that evening, the president was walking out of the oval office. We crossed paths in the rose garden colonnade. The president was fired up about the Supreme Court decision and so, you know, i was standing next to mr. Meadows, i stepped back so i was probably two, three feet cattycorner or diagonal from him. The president just raging about the decision and how its wrong and why didnt we make more calls and just his typical anger, outbursts at this decision and the president said, he so he had said something to the effect of, i dont want people to know we lost, mark. This is embarrassing. Figure it out. We need to figure it out. I dont want people to know we lost. Our country is a country of laws where every person including the president must follow the law and respect the judgment of our courts. President trumps closest advisers held that view both then and now. Well, do you believe the president should abide by the rulings of the courts . Oh, yes, we should all comply with the law at all times to the best of our ability. Every one of us. So once the courts had ruled and the Electoral College had met, the election was over in your view . Yes, i think ive said previously that when the Vice President made the certification and the litigation was complete, it was complete. When the Electoral College met on the 14th . Yes, as of december 14th, is that right . I think thats the right date, yes. I assume, pat, you would agree the president is obligated to abide by the rulings of the courts . Of course. And i assume you also everybody is obligated to abide by the rulings of the courts. And i assume you also would agree the president has a particular obligation to take care that the laws be faithfully executed . That is one of the obligations, correct. Do you believe the president is obligated to abide by the rulings of the court . I do. By mid december of 2020, President Trumps senior staff were attempting to persuade him to concede the election outcome. But if your question is did i believe he should concede the election at a point in time, yes, i did. December 14th was the day the state certified the votes and sent them to congress. In my view that was the end of the matter. I didnt see i thought this would lead inexplorablely to a new administration. I told him my personal viewpoint was that the Electoral College had met, which is the system that our country is set under to elect a president and Vice President , and i believed at that point that the means for him to pursue litigation was probably closed. And do you recall what his response, if any was . He disagreed. Secretary of labor, gene scalia, the son of late Justice Scalia visited President Trump in mid december and explained the situation clearly. And so i had put a call into the president , i might have called on the 13th. We spoke, i believe, on the 14th, in which i conveyed to him that i thought that it was time for him to acknowledge that President Biden had prevailed in the election. But i communicated to the president that when that Legal Process is exhausted and when the electors have voted that thats the point at which that outcome needs to be expected. I told him that i did believe, yes, that once those Legal Processes were run, if fraud had not been established, that had affected the outcome of the election then unfortunately i believe that what had to be done was concede the outcome. Not only did the courts reject President Trumps fraud and other allegations, his department of justice appointees, including Jeffrey Rosen and Richard Donoghue did as well. President trump knew the truth. He heard what all his experts and senior staff were telling him. He knew he had lost the election but he made the deliberate choice to ignore the courts, to ignore the Justice Department, to ignore his campaign leadership, to ignore Senior Advisers and to pursue a completely unlawful effort to overturn the election. His intent was plain. Ignore the rule of law and stay in power. Mr. Chairman, i yield back. Gentleman yields back, the chair recognizes, the gentlewoman from virginia, ms. Luria. Thank you, mr. Chairman. Mid december was a turning point. President trump made a decision, a choice, to ignore the courts and his advisers and to push forward to overturn the election. His efforts to overturn the election were not random or disconnected, rather they were part of a coordinated multipart plan to ensure that he stayed in power. Donald trump was the driver behind each part of this plan. He was personally and directly involved. Of course a key element of the plan was continuing to convince tens of millions of americans that he did not, in fact, lose. Again, he did this even though his own Campaign Advisers and his Justice Department officials told him his claims of fraud were wrong. In this video youll see that even when top Law Enforcement officials told the president his Election Fraud claims were false, he still repeated the claims in the days and weeks that followed. Sometimes even the very next day. I specifically raised the dominion Voting Machines which i found to be among the most disturbing allegations, disturbing in the sense that i saw absolutely zero basis for the allegations, i told him that it was crazy stuff, and they were wasting their time on that. And it was doing a grave disservice to the country. We have a company thats very suspect. Its name is dominion, with a turn of a dial, or the change of a chip, you could press a button for trump and the vote goes to biden. What kind of a system is this . We definitely talked about county again. That was sort of done at that point because the hand recount had been done and all that, but we cited back to that to say, you know, this is an example of what people are telling you and whats being filed in some of these Court Filings that are just not supported by the evidence. And this is the problem, a problem that people keep telling you these things and they turn out not to be true. In addition, there is the highly troubling matter of dominion voting systems. In one michigan county alone, 6,000 votes were switched from trump to biden and the same systems are used in the majority of states in our country. I went into this and would, you know, tell him how crazy some of these allegations were, and how ridiculous some of them were, im talking about some of them like, you know, more votes, more absentee votes were cast in pennsylvania than there were Absentee Ballots. Stuff like that was easy to blow up. There was never an indication of interest in what the actual facts were. There were more votes than there were voters. Think of that. You had more votes than you had voters. Thats an easy one to figure. And by the thousands. Then he raised the big vote dump, as he called it, in detroit, and that, you know, he said people saw boxes coming into the counting station at all hours of the morning. I said, mr. President , there are 630 precincts in detroit, and unlike elsewhere in the state, they centralize the counting process, so theyre not counted in each precinct, theyre moved to counting stations and so the normal process would involve boxes coming in at all different hours. This is michigan. At 6 31 in the morning, a vote dump of 149,772 votes came in. Unexpectedly. With regard to georgia, we looked at the tape, we interviewed the witnesses. There is no suitcase. The president kept fix sating on this suitcase that had fraudulent ballot, and the suitcase was rolled out from under the table. There is no suitcase. You can watch the video over and over, theres a wheeled bin where they carry the ballots and thats how they move ballots around the facility. Theres nothing suspicious about that at all. Election officials pull boxes, democrats, and suitcases of ballots out from under a table. You all saw it on television, totally fraudulent. This happened over and over again. And our committees report will document it. Purposeful lies, made in public directly at odds with what donald trump knew from unassailable sources, the Justice Departments own investigations, and his own campaign. Donald trump maliciously repeated this nonsense to a wide audience over and over again. His intent was to deceive. President trumps plan also involved trying to coerce Government Officials to change the election outcome in the st states he lost. He personally reached out to numerous State Officials and pressured them to take unlawful steps to alter the Election Results in those states. These actions taken directly by the president himself made it clear what his intentions were, to prevent the orderly transfer of power. We all recall, for example, President Trumps tape recorded call with georgia Secretary Of State brad raffensperger, at the time this call occurred, President Trump had already been told repeatedly by the u. S. Justice department, by his campaign, and by his advisers that his allegations of fraud in georgia were false. Look all i want to do is this, i just want to find 11,780 votes, which is one more than we have because we won the state. Look, we need only 11,000 votes. We have far more than that as it stands right now. Well have more and more. What are we going to do here, folks, i only need 11,000 votes. Fellows, i need 11,000 votes, give me a break. I just want to find 11,780 votes. Thats an extraordinary demand by the president , especially since he already knew from the Justice Department there was no genuine basis for this request. No one could think it would be legal for the Secretary Of State to simply find the votes the president needed in order to win. Secretary raffensperger told the president the truth, that he lost the election in georgia, but President Trump did not accept that answer. Instead, he suggested that secretary raffensperger himself might be prosecuted. Thats the thing, you know, thats a criminal thats a criminal offense, and, you know, you cant let that happen. Thats a big risk to you and to ryan. Your lawyer. Thats a big risk. We know that President TrumpS White House advisers reacted negatively. Immediately after the call, Cassidy Hutchinson had a conversation with Chief Of Staff mark meadows. You cant possibly pull this off. That call was crazy, and he looked at me and started shaking his head, no, kass, he knows its over. He knows he lost. Theres good options out there. Were going to keep trying. This call and other related activity is now the focus of an ongoing criminal investigation in fulton county, georgia. And georgia is not the only state where President Trump tried to pressure State Officials to change the results. He also attempted to pressure State Officials in arizona, pennsylvania, and michigan to change the results in those states as well. While President Trump was pressuring State Officials, he was also trying to use the department of justice to change the election result. His top officials told him that there was no evidence to support his claims of fraud, but he didnt care. As he told them, justice say the election was corrupt and leave the rest to me and the republican congressmen. When these officials would not do what he said, President Trump embarked in an effort to install jeff clark as acting attorney general solely because he would do what others in the department would not do. We know that trump was doing so for a specific purpose. So clark could corruptly employ the Justice Departments authority to help persuade the states to flip electoral votes. For example, when Richard Donoghue and jeff rosen both appointed by President Trump learned of mr. Clarks proposal, heres why they said they forcefully rejected it. And i recall toward the end saying, what youre proposing is nothingless than the United States Justice Department meddling in the outcome of a president ial election but more importantly this was not based on fact. This was actually contrary to the facts as developed by Department Investigations over the last several weeks and months. So i responded to that and for the department to insert itself into the political process this way i think would have had grave consequences for the country. It may very well have spiralled us into a constitutional crisis. We know from our investigation that President Trump offered jeff clark the position of acting attorney general. And that jeff clark had decided to accept it. The only reason this ultimately did not happen is that the white House Counsel and a number of Justice Department officials confronted the president in the oval office and threatened mass resignations. And then i said something to the effect of youre going to have a huge personnel blowout within hours because youre going to have all kinds of problems with resignations and other issues, and thats not going to be in anyones interest. The president ultimately relented, only because the entire leadership of the department of justice as well as his white House Counsel threatened to resign. Mr. Chairman, i yield back. President trumps efforts to unlawfully overturn the results of the 2020 election were not limited to the big lie and pressuring State Officials and the department of justice officials. Another key part of the president s effort was a scheme to assemble fake electors to cast false electoral votes in the states that President Trump lost. This was something done not only with the president s knowledge but also with his direct participation. Ron na mcdaniel, chair of the Republican National committee testified before this committee that President Trump and his attorney dr. John eastman called her and asked her to arrange for the fake electors to meet and rehearse the process of casting their fake votes. When i received the call, again, i dont remember the exact date, it was from the white house switchboard, and it was President Trump who had contacted me. And did President Trump have anyone else on the line with him . He introduced me to a gentleman named john eastman, so i vaguely remember him mentioning that he was a professor and then essentially he turned the call over to mr. Eastman who then proceeded to talk about the importance of the rnc helping the campaign gather these contingent electors in case any of the legal challenges that were ongoing changed the result of any of the dates. These fake electors were ultimately part of the president s plan to replace genuine biden electors with trump electors on january 6th. As part of this plan, the false electoral slates were sent to the National Archives and to the capitol. The fake electors plan was also tied to another plan, the coercive Pressure Campaign to make Vice President mike pence reject or refuse to count certain biden electoral votes so that President Donald Trump would quote win reelection instead. Here is what Vice President pence has said about this scheme. President trump said i had the right to overturn the election. President trump is wrong. I had no right to overturn the election. The presidency belongs to the American People, and the American People alone, and frankly, there is no idea more unamerican than the notion that any one person could choose the american president. Make no mistake, President Trump knew that what he was demanding Vice President pence do was illegal. He was informed of this repeatedly and specifically on january 4th. Even his lawyer, john eastman, admitted in front of President Trump that this plan would break the law by violating the electoral count act. On the morning of january 6th President Trump called the Vice President from the oval office and demanded that he overturn the results of the election. Numerous witnesses told the select committee about the invective that President Trump leveled at his own Vice President. And the word that she relayed that the president called the Vice President , i apologize for being impolite, but do you remember what she said her father called him . The p word. But Vice President pence didnt waiver, even when his own life was endangered by President Trump and the rioters at the Capitol On January 6th, as youll see in more detail later. A federal judge concluded based on this and other evidence that President Trumps Pressure Campaign against the Vice President likely violated multiple criminal statutes. In the end, all of these people, department of justice officials, state elections officials, his own Vice President stood strong in the face of President Trumps immense pressure. But as we now know President Trump had already summoned Tens Of Thousands of his supporters in washington on january 6th to take back their country. On december 19th, President Trump first told his supporters to come to washington. In this and numerous other tweets, he fraudulently and repeatedly promoted january 6th as the day americans could come and change the election outcome. For weeks, President Trump worked with others to plan the rally. Intending all along that he would send an assembled crowd of angry supporters to the capitol after his speech on the ellipse on january 6th. We obtained a text message that one rally organizer sent on january 4th. In part it reads that quote potus is going to have us march there, the capitol, and potus is going to just call for it unexpectedly. Again, each of these examples, the big lie, the Pressure Campaigns against State Officials, the Pressure Campaign against the department of justice, and his Vice President , the fake electors summoning the mob, all of this demonstrates President Trumps personal and substantial role in the plot to overturn the election. In our past hearings you have seen direct evidence that President Trump sent a crowd of his supporters to the Capitol On January 6th knowing they were armed and angry. This was the last most desperate and dangerous prong of his plan the joint session and prevent the orderly transition of power. On the morning of the 6th, the Secret Service was at the ellipse screening the members of the crowd as they entered the rally site, and they noticed something significant about the crowd, Tens Of Thousands of people were outside the rally site but did not want to go through the magnetometers, the metal detectors, used to screen for dangerous weapons. Since the last hearings, the select committee has received greater cooperation from the Secret Service, nevertheless, the Secret Service Text Messages from this period were erased in the days and months following the attack on the capitol, even though documents and materials related to january 6th had already been requested by the department of justice and congress. But we were able to obtain nearly 1 million emails, recordings, and electronic records from the Secret Service. Over the month of august, the select committee began its review of hundreds of thousands of pages and multiple hours of that material providing substantial new evidence about what happened on january 6th and the days leading up to it. In advance of the ellipse speech, in advance of the march to the capitol. The committee has shown evidence that President Trump was aware of the risk of violence, the fbi, u. S. Capitol police, Metropolitan Police and other agencies all gathered and disseminated intelligence suggesting the possibility of violence at the capitol prior to the riot. Were now going to show you just a sample of the evidence we have received. Days before january 6th, the president s Senior Advisers at the department of justice and fbi, for example, received an intelligence summary that included material indicating that certain people traveling to washington were making plans to attack the capitol. This summary noted online calls to occupy federal buildings. Rhetoric about invading the capitol building. And plans to arm themselves and to engage in Political Violence at the event. Other agencies were also hearing predictions suggesting possible violence at the capitol. On a call of President TrumpS White House National Security staff in early january 2021, deputy secretary of defense david in order warned that the capitol would be the target of the attack. General mark milley describing deputy secretary norquists warning. During these calls, i remember hindsight because he was almost like clairvoyant, norquist says the greatest threat is a direct attack on the capitol. Ill never foerget it. The Secret Service on december 24th, with the heading, armed and ready, mr. President. According to the intelligence multiple users online were targeting members of congress instructing others to march into the chambers on january 6th and make sure they know who to fear. In this report received on december 26th, a secret Service Field office relayed a tip that had been received by the fbi. According to the source of the tip, the proud boys planned to march armed into d. C. They think they will have a large enough group to march into d. C. Armed, the source reported and will outnumber the police so they cant be stopped. The source went on to say their plan is to literally kill people. Please, please take this tip seriously and investigate further. The source also made clear that the proud boys had detailed their plans on multiple web sites like the donald. Win. Lets pause here. The Secret Service had advance information more than ten days beforehand regarding the proud boys planning for january 6th. We know now of course that the proud boys and others did lead the assault on our capitol building. On december 31st, agents circulated intelligence reports that President Trump supporters have proposed a movement to occupy capitol hill. In particular, they flagged spikes in violent hash tags like we are the storm, 1776 rebel, and occupy capitols. On january 5th, the Secret Service open source flagged a media account that threatened to bring a sniper rifle to the rally. And a handgun and rifle with the caption sunday, gun day, january 6th will be wild. On the evening of january 5th, the Secret Service learned right wing groups with armed Quick Reaction forces ready to deploy on january 6th. Groups like the oath keepers were standing by at the ready should potus request insistence, by invoking the insurrection act agents were informed. As we know now, the oath keepers did play a specific role on january 6th and had stashed weapons in virginia for further violence that evening. Also on that day, the Secret Service was raiding its security precautions for the president s speech at the ellipse the next day. A secret Service Deputy chief instructed agents to add certain objects to the list of items that would be prohibited at the rally site, including ballistic vests and ballistic helmets. By the morning of january 6th, it was clear that the Secret Service anticipated violence. It felt like the calm before the storm. One agent predicted in an Intelligence Division chat group. Another remarked how agents were watching the crazies on live stream. By 9 09 that morning. The Secret Service could also see that many rally goers were assembled outside the security perimeter. One agent emailed possibly because they have stuff that couldnt come through would probably be an issue with this crowd, just a thought. By 9 30 that morning, agents reported more than 25,000 people outside the rally site. An hour later, the Secret Service reported that the crowd was on the mall watching but not in line. The head of the president S Secret Service protective detail, robert engel, was specifically aware of the large crowds outside the mag magnetometers, he passed information to tony ornado who worked for mark meadows. The documents obtained by the Secret Service made clear that the crowd outside the magnetometers were armed and the agents knew it. Take a look at what they were seeing and hearing on the ground. One report from the rally site at 7 58 a. M. Said some members are wearing ballistic armor, carrying Radio Equipment and Military Grade Backpacks. Another from 9 30 a. M. Said there were possibly oc spray, meaning pepper spray and or plastic riot shields. At 11 23 a. M. , agents also reported possible armed individuals. One with a glock, one with a rifle. Over the next hour, agents reported possible man with a gun reported. Confirmed pistol on hip located in a tree, and one detained at 14th and i street northwest, individual had an Assault Rifle on his person. Minutes before President Trump began his speech, members of the federal protective service, an agency tasked with protecting federal buildings were alerted about an arrest of a protester with a gun on his waistband. And during this speech, the weapons related arrests continued. At 12 13 p. M. , United States park Police Arrested a man with a rifle in front of the world war ii memorial. These agents remarked on the number of weapons that had been seized that day, speculating that the situation could get worse. With so many weapons found so far, you wonder how many are unknown one agent wrote at 12 36 a. M. , could be sporty after dark. At 12 47, another agent responded, no doubt. The people at the ellipse said they are moving to the capitol after the potus speech. As the documents we received made clear, the Secret Service was aware of weapons possessed by those gathered at rallies in d. C. As early as the evening before. Take this document, for instance, which details multiple arrests in the crowds demonstrating on january 5th. Those arrests were for weapons offenses, hand guns, high capacity feeding devices, ammunition. What the Secret Service saw on the 6th was entirely consistent with the violent rhetoric circulating in the days before the joint session on pro trump web sites. At times amplified by the president s own advisers. On one of these sites, as youve heard, one of thosef was called the donald. Win. A text message that jason miller, a senior dmucommunicati adviser sent to mark meadows, i got the base fired up, he wrote, in all caps. He sent a link to this page on the donald. Win. The linked web page had comments about the joint session of congress on january 6th. Take a look at some of those comments. Gallows dont require electricity. If the filthy comemy maggots try to push their fraud through, there will be hell to pay. Our lawmakers in congress can leave one of two ways, one, in a body bag, two, after rightfully certifying trump the winner. Mr. Miller claimed that he had no idea about the hundreds of comments like these in the link that he sent to mark meadows. If i had seen Something Like that, i probably would have flipped it to someone at if i had something of that nature, i would have said we have to flag this for Secret Service or something of that nature. Trump administration was aware of this type of violent rhetoric prior to january 6th. In fact, as we have seen the Secret Service and other agencies knew of the prospect of violence well in advance of the president s speech at the ellipse. Despite this, certain white house and Secret Service witnesses previously testified that they had received no intelligence about violence that could have potentially threatened any of the protects on january 6th, including the Vice President. Evidence strongly suggests that this testimony is not credible and the committee is reviewing additional material from the Secret Service and other sources. The Secret Service was monitoring this kind of Online Activity and was sharing and receiving the results of that effort. They worked closely with other agencies, sharing intelligence about the joint session of congress derived from social media and other sources. The same day jason miller sent his text message, agents received reports about a spike in activity on another platform called parlor. This was december 30th. In this email, an agent received a report noting a lot of violent rhetoric on parlor directed at Government People and entities, including Secret Service protectees, one of these was Vice President pence. Perhaps the primary target of President Trumps Pressure Campaign in the days leading up to january 6th. The day before the joint session on january 5th, Secret Service was aware of increased chatter focused on Vice President pence. In particular, whether he would do what President Trump wanted him to do. Reverse the results of the election in the joint session the next day, january 6th. On the morning of the 6th, agents received alerts of online threats that Vice President pence would be quote a dead man walking if he doesnt do the right thing. Another agent reported quote i saw several other alerts saying they will storm the capitol if he doesnt do the right thing. But the anger reflected in these postings was obvious the man at the center of the storm on january 6th. President trump. On the evening of january 5th, President Trump gathered a few of his communications staffers in the oval office. The door was open. Allowing the president and others assembled there to hear the sounds of the crowd gathered at Freedom Plaza just a few blocks from the white house. President trump could tell that his supporters were riled up. Here again is judd deer, a Deputy White House press secretary describing the president s reaction. He fairly quickly moved to how fired up the crowd is. Or was going to be. And what did he say about it . Just that they were fired up, they were angry. They feel like the election had been stolen, that the election was rigged, that he went on and on about that. Yes, the president knew the crowd was angry because he had stoked that anger. He knew that they believed the election had been rigged and stolen because he had told them falsely that it had been rigged and stolen, and by the time he incited that angry mob to march on the capitol, he knew they were armed and dangerous. They are skipping the invitation. They are going straight to subpoena. Do they think that he will comply, no. But they are setting down for the record, for history, that they want him to testify. If donald trump doesnt comply with the subpoena first of all, if you were his lawyer, which would be an interesting thing. Id probably get fired. I assume his lawyers will want him to not comply. They will make up a letter, youre politicizing this, took too much time. The risk is so grave to incriminate himself. But also dont want him to take the fifth. You dont want to embarrass him like that. Look, its not going to be enforced. As a practical matter they dont have the time to enforce it. Even though he absolutely has no privilege here, the d. C. Circuit and Supreme Court found that when they allowed the National Archives to produce executive materials to this committee. And hes a private citizen. He could be in theory compelled. They could refer, make a criminal referral like they did with meadows and others, but none of that is going to happen. This is about laying a marker. This is about and triggering a response. Hes going to Say Something. He responded yesterday to his being ordered to be deposed in the eugene carol case and things that undercut his defense in that case. Theyre seeking a response, and laying down a marker. So if he doesnt comply, which i assume he wont, do you think that Merrick Garland will not then refer that to the or not Merrick Garland, will the hearing, the committee refer to Justice Department to say go after him for not complying. They could. They could. I mean, theyve done it for mark meadows, and they did it for steve bannon. The doj only has acted on steve bannon, that would be a whole other level, presumably, and george, as the lawyer here, correct me if im wrong, if youre doj, you want to keep your eye on the ball, and that ball is the case that theyre building separately, separate from what would effectively be contempt of congress here. They need to keep it simple. To me this is an exclamation point on the big theme of the hearings. This is all about trump. Everything we have heard today is about his knowledge of what was going to transpire. And the committee from the beginning, especially congresswoman, vice carry woman cheney have tried to crack the code, if you will, break the spell of trump over his supporters. Donald trump portrays himself as strong and strength, and he fears nothing. While he did take the fifth when the new York State Attorney general tried to depose him. We gave him a chance, we wanted him to come in and tell his side of the story. Theyre trying to make the case that trump is oz. He presents himself as all powerful but when you look, its a little guy behind a curtain trying to pull a machine to have a front on people. I think its an entirely possible that this is going to prompt some sort of unhinged rant on truth social, maybe even an appearance on one of his favorite channels where everything he says goes unchecked. Just like george said, that is clearly part of the goal here. In addition to just laying down a marker for history. To trigger him. To trigger him, and its not just a political poke in the eye, its potentially a legal strategy, because if he responds officially in a way that the doj could use, thats a win legally. Doj chose not to charge two other people, mark meadows, and dan scavino. As a practical matter, i think its unlikely we see this sent over to doj. The reason why, theres no time. None of the things were accomplished in a 26day period of the Midterm Elections, youre talking about bannon had that referral on the 14th, the 21st, he was indicted on November 12th we know that the power balance shifts, this committee will be good nighted. But remember, they also have a track record. The maralago document issue is instructive here. A subpoena is for testimony, and for documents at times, and we already know the track record says he doesnt hand things over, he fights it for over 18 months on things that dont even belong to him. This is the talking point theyre trying to undermine. Theres a little bit of theater going on here, after all, a lot of theater going on, after all, this public vote, which i assume will be unanimous because theyve talked about it before, will come after hours and hours of a hearing in which they made the case they believe that donald trump intentionally not based on Election Results, but tried to overturn an election and they have given you chapter and versus, and theyre saying the American Public, its time to hear from him. People may look at this and say why are they doing this. Time and again, they pointed to the fact he is central in the role of everything theyre investigating. Thats what theyre doing today by painting this broad picture of all of this testimony from ivanka trump to testimony we have not seen before from Cassidy Hutchinson when they testified. I have reached out to trumps world to ask what his response is to this plan by the committee. They have not responded yet. He is all but certain to fight this, and time will be on his side because if things go the way they look like they are going, and in three months, the committee has been disbanded by a republican majority, that works in his favor. I think it makes sense why the committee is doing this. They have interviewed a thousand witnesses, they have subpoenaed other people, spoken to other people. Of course, why would they not speak to the person at the center of it, is the argument hes making. You heard congresswoman liz cheney say todays hearing will be about, and folkicusing on dod trumps State Of Mind. The lawyer went were going to be talking around the State Of Mind. We know the direct evidence, not what people are saying about the talking around. You got to get it from the proverbial horses mouth. His talking point has been to this date. Youre talking about a witch hunt, all of these things. This is a time of put up or shut up. Put up the talking point, you dont have to shut up mr. President , you can speak right now, and if he does not do so or if he invites the Fifth Amendment and other things, that is problematic. Thats exactly right. This move of issuing a subpoena will give the committee a rhetorical talking point, and thats important. Thats not unimportant, and they will essentially blunt what has been trumps defense, and his defenders, this is one sided, nobody has a chance to tell their story. The committee will say, we asked you, commanded you with the subpoena, and you fought it. Look at the context in which this is coming. Trump has been furious in the past few weeks over all of the investigations, this is often a way hes described. Especially so lately with the maralago investigation. He is set to be deposed in the lawsuit about defamation. Hes got all of these issues facing him. Its been a real problem for him lately as he has been talking with his attorneys. He has been specially fuming over this. This subpoena were expecting come from the january 6th committee will add to that. And this is historic, right, i mean, it is, and its also a way for the committee to say for history, we have done our job here. Because we have spent months and months talking about this president , trying to engineer a coup. And the question is how can you not reach out to donald trump. How could you have ended these hearings, and again, they may not end today, they may continue, but how do you do this without asking him, and for people who are watching today, i think theyll want to answer that question and say, we did. We are. Would there have been a legal reason for them to have done this earlier . To have a better chance to actually get it. If the committee was serious about forcing donald trump to testify, they would have done it eight months ago, a year ago when they were formed and now here we are with the election just weeks away and the change over in Congress Just months away. As laura said, the committee is not going to have time as a practical matter, either to go into court to try to get a judge to force donald trump to testify or to go through the whole contempt process, send it over to doj and prosecute. To be fair, if this person is the pseudo target, as in youre the person, initially today, this is the person personally and substantially involved, the way you have to confine that person into a corner is to have all the corroboration in advance to be able to call bs. If you do it initially, youre going to not have you might have one bite at the apple. One bite at the apple, and the apple might have to come after you have tried every piece of fruit to confirm where the worm is. Theyre telling you its here. And he knew that they were going to the capitol. Is the time for the ellipse rally approached, an email was circulated among intelligence officials, including secret Service Intelligence official, attaching communications among rally goers that specifically contemplated violence. What is clear from this record is that the white house had more than enough warning to warrant stopping any plan for an ellipse rally and certainly for stopping any march to the capitol. But despite awareness of the potential for violence, and weapons, donald trump instructed the angry crowd, some of whom were armed to march to the capitol. As my colleague mr. Schiff just described, the Secret Service reported that thousands in the crowd near the Washington Monument would not enter the rally area because magnetometers used in screening attendees wouldnt detect any prohibited items they carried. Mr. Trump knew this. HiS Secret Service had told him about it that morning. Even in spite of these warnings, Cassidy Hutchinson overheard the president say this shortly before he took stage. He wants it full and he was angry we werent letting people through the meggs with weapons. I was in the vicinity of a conversation where i over heard the president Say Something to the effect of i dont effing care that they dont have weapons. Theyre not here to hurt me, take the effing meggs away, let the people in, take the effing meggs away. When he went on stage, President Trump himself asked Law Enforcement to let his supporters in the rally site. Id love to have those Tens Of Thousands of people would be allowed the military, the Secret Service, and we want to thank you and the police, Law Enforcement, youre doing a great job. Lets pause at this point to consider President Trumps State Of Mind, his motivation at this moment. By that point, it was known to Secret Service that members of the crowd were armed, President Trump had been told, and there was no doubt that President Trump knew whaet he was going t do. Sending an angry mob, a number of whom were clad in Tactical Gear and military garb, armed with various weapons to the capitol. Theres no scenario where that action is beneign, and theres o scenario where an american president should have engaged in that conduct. It did not matter whether President Trump believed the election had been stolen or not, this could not be justified on any basis for any reason. You may also recall testimony from our summer hearings regarding mr. Trumps efforts to lead the mob to the capitol himself, and his angry altercation in the president ial suv when the Secret Service told him it was far too dangerous for him to go. As we detailed in testimony from the Metropolitan Police and white house personnel during our july 21st hearing, information about the altercation was widely known. So widely known that one former white house employee with National Security responsibilities explained that this information was, in fact, water cooler talk in the white house complex. As that professional told us, they remember hearing in the days after january 6th how angry the president was when he was in the limo that afternoon. That professional also testified that they were specifically informed of the president s irate behavior in the suv by mr. Ornado, in mr. Ornados office. It was mr. Engel with mr. Ornado in that office. They expressed to me that the president was irate, you know, on the drive up. Mr. Engel did not deny the fact that the president was irate. That of course corresponds closely with the testimony you saw this summer from Cassidy Hutchinson, a metropolitan Police Officer who was in the motorcade and from multiple sources. Additionally after concluding its review of the voluminous additional secret Service Communications from january 5th and january 6th, the committee will be recalling witnesses and conducting further investigative depositions based on that material. Following that activity, we will provide even greater detail in our final report. And i will also note this, the committee is reviewing testimony regarding potential obstruction about advice given not to tell the committee about this specific topic. We will address this matter in our report. We also want to remind you now of how Security Professionals working in the white house complex and who reported to National Security officials responded when they learned that mr. Trump intended to lead the mob to the capitol. To be completely honest, we were all in a state of shock. Because why . Because it just one, i think the actual physical feasibility of doing it, and then also we all knew what that meant, that this was no longer a rally, that this was going to move to Something Else if he physically walked to the capitol. I dont know if you want to use the word insurrection, coup, whatever. We all knew this would move from a normal, democratic, you know, public event into Something Else. Why were we alarmed . Right. The president wanted to lead Tens Of Thousands of people to the capitol. I think that was enough grounds for us to be alarmed. President trump was still considering traveling to the capitol even after returning to the white house. He knew well before 2 00 that a violent riot was ongoing at the capitol. His motorcade was held on west executive avenue outside the white house because he still wanted to join the crowd. Heres kailee mcenany describing an exchange she had with the president as soon as he arrived back at the white house. So to the best of my recollection, i recall him being wanting to saying that he wanted to physically walk and be apart of the march, and then saying that he would if he needed to, rather be right in the president ial limo. From the Secret Service, the select committee is also obtained important new evidence on this issue. It shows how frantic this hour must have been for the Secret Service scrambling to get the president of the United States to back down from a dangerous and reckless decision that put people in harms way. Take a look at the secret Service Email from 1 19 p. M. On january th 6th. The man that President Trump got out of the president ial vehicle to the white house. As soon as the president left his motorcade, leadership from the Secret Service contacted bobby engel, the lead agent and warned him that they were, quote, concerned about an otr, an off the record movement to the capitol. The people sworn to protect the safety of the president of the United States and who routinely put themselves in harms way were convinced that this was a bad idea. Secret Service Documents also reveal how agents were poised to take President Trump to the capitol later that afternoon. Agents were instructed to don their protective gear and prepare for a movement. A few minutes later, they were told the president would leave for the capitol in two hours. It wasnt until 1 55 p. M. , the president s lead secret Service Agent told them to stand down. Were not doing an otr to the capitol. By then, rioters had breached the capitol and were violently attacking the efforts of the brave men and women in Law Enforcement trying to resist the mob. President trump may not have gone to the Capitol On January 6th, but what he did from the white house cannot be justified. While congressional leaders, both democrats and republicans, worked with Vice President pence to try and address the violence, President Trump refused urgent pleas for help from nearly everyone around him. What he did do only made the situation worse. Mr. Chairman, i yield back. The gentleman yields back. The chair recognizes the gentleman from maryland, mr. R raskin for an opening statement. Uthank you, mr. Chairman. The president was telling the rioters to fight like hell at the time the first wave of rioters first breached barricades defending the capitol. Secret Service Documents we recently received give a timeline of precisely what the white house knew and when. At 1 19, the president s Emergency Operations center sent an email to National Security, Secret Service, and National Advisers to the president and Vice President informing them that, quote, hundreds of Trump Supporters stormed through metal barricades at the back of the building about 1 00 p. M. Wednesday running past security ga guards and breaking fences. When the president returned to the white house around 1 20, he entered the oval office and was told right then about the onset of violence at the capitol. From that point until approximately 4 00 p. M. Over the next two hours and 40 minutes, the president stayed in the white house dining room attached to the oval office and watched this unprecedented assault take place at the capitol. We have testimony from several members of the president S White House staff establishing that President Trump refused from his closest advisers and family members, to tell his supporters to stand down and leave the capitol. Heres the testimony of President Trumps white House Counsel, Pat Cipollone. I cant talk about conversations with the president , but i can generically say that i said, you know, people need to be told there needs to be a public announcement, fast, that they need to leave the capitol. And could you let us know approximately when you said that . Approximately when . Almost immediately after i found out people were getting into the capitol or approaching the capitol in a way that was was violent. You on the staff did not want people to leave the capitol. On the staff . In the white house. I cant think of anybody, you know, on that day who didnt want people to get out of the the capitol once the violence started, no. I mean what about the president . Yeah. Well, she said the staff. So i answered. I said in the white house. Oh, im sorry. I apologize. I thought you said who else on the staff. I cant reveal communications, but obviously i think, you know, yeah. Mr. Cipollones testimony is corroborated by multiple other Staff Members like Cassidy Hutchinson. Here she is describing what she heard from mark meadows. He had said something to the effect of, you know, you heard him, pat. He doesnt want to do anything more. He doesnt think theyre doing anything wrong. The former white house employee with National Security duties similarly recalled an exchange between mr. Cipollone and Eric Herschmann about President Trumps inaction on the mob assault under way at the capitol. Mr. Herschman said something to mr. Cipollone. He seemed to relay that, you know, the president didnt want anything done. Throughout this period, some of the president s most important political allies, family members, and senior staff all begged him to tell his supporters to disperse and go home. They included sean hannity, laura ingraham, and other allies at fox news. His son, donald trump jr. , the House Minority leader, Kevin Mccarthy. Others in congress and officials in the cabinet and executive branch, all of them made appeals to donald trump which he rejected and he ignored. The select committee interviewed several people who were in the dining room with trump that afternoon and every single one of these witnesses told us that he was watching the violent battles rage on television. He did not call his secretary of defense or the National Guard, the chief of the Capitol Police or the chief of the Metropolitan Police department. And to your knowledge, was the president in that private dining room the whole time that the attack on the capitol was going on or did he ever go to the oval office, to the white house situation room . Anywhere else . To the best of my recollection, he was always in the dinening room. What did he say to mr. M meadows . What do you remember . I think he was watching the tv. Do you know whether he was watching tv in the dining room when you talked to him on january 6th . Its my understanding he was watching television. When you were in the dining room and the discussions and the thought was, the capitol was visible on the screen on the television . Yes. The president watched the bloody attack unfold on fox news from his dining room. Members of congress and other Government Officials stepped into the gigantic Leadership Void created by the president s chilling and steadied passivity that day. What you are about to see is previously unseen footage of congressional leaders, both republicans and democrats as they were taken to a secure location during the riot. Youll see how everyone involved was working actively to stop the violence, to get federal Law Enforcement deployed to the scene, to put down the violence and secure the capitol complex. Not just democrats like Speaker Nancy Pelosi and house majorities, but republicans like Vice President pence, Senate Majority leader Mitch Mcconnell, whip john thune. They all did what President Trump was not doing, what he simply refuse to do. Take a listen. Were starting to get surrounded. Theyre taking the north side. Were not going to be able to hold. The door has been breached. People are gaining access into the capitol. We have got to get finish the proceedings. [ crowd chanting ] senator schumer said secure the location, and theyre locked down in the senate. There has to be some way we can maintain the sense that people have that there is some security or some confidence that government can function, and that you can elect the president of the United States. Do we go back into session . We did go back into session, but now apparently everybody on the floor is putting on their gas masks to prepare for a breach. Im trying to get more information. Theyre putting on their tear gas masks. House members, were walking over now through the tunnels. Bring her out here. Im going to call up the secretary. We have some senators who are still in their hideaways that need massive personnel now. Can you get the marilyn National Guard to come too . I have something to say, mr. Secretary. Im going to call the mayor of washington, d. C. Right now and see what other outreach he has to other departments and what has been mentioned. Officer down. Get him up. Get him up. Get him up. Governor, i dont know if you have been approached about the virginia National Guard. Mr. Hoyer was speaking to governor hogan, but i still think you probably need the okay of the federal government in order to come into another jurisdiction. Thank you. Oh my gosh. Theyre just breaking windows. Theyre doing all kinds of its really they said somebody was shot. Its just horrendous and all after the instigation of the president of the United States. Okay. I just talked to governor northam, and what he said is they sent 200 state police and a unit of the National Guard. Theyre breaking windows and going in, obviously ransacking our offices and all of that. Thats nothing. The concern we have about personal harm safety. Personal safety is just it transcends everything, but the fact is on any given day, theyre breaking the law in many different ways. Quite frankly much of it at the instigation of the president of the United States, and now could at least somebody why dont you get the president to tell them to leave the capitol, mr. Attorney general, and your Law Enforcement responsibility . A Public Statement they should all leave. [ crowd chanting usa ] we need the mayor now. Okay. We have this. Andrew is there. Other military places. I dont want to speak for leadership. Thats going to be thats responsible for executing this. Let me say you cant get people there and you make the plan. Im trying to figure out how we can get this job done today. We talked about it earlier. This happened earlier, and so we want to expedite this and hopefully they can confine it to just one complaint, arizona, and then we could vote and that would be, you know, then just move forward with the rest of the state. Override this because the capitol is not doing okay. What we were being told very directly is going to take days for the capitol to be okay again. Weve got a very bad report about the condition of the capitol, and its now a security standpoint making sure everybody is able to be safe, and how long would that take. I got off the phone with the Vice President. I got off the phone with the Vice President elect. What we left the conversation with because he said, he had the impression from mitch that mitch wants to get everybody back to do this. Yes. I said, were getting a counterpoint that could take time to clean up poopoo a theyre making in the capitol, literally and figuratively in the capitol that may take days to get back. Im in the capitol building. I im literally standing with the u. S. Capitol police. Can you inform me what you hear through official channels . Well inform you that theres information that they believe that the house and the senate will be able to be done in roughly an hour. Good news. Thank you very much. Good news. In this video you just saw senator Chuck Schumer urging acting attorney general jeff rosen to get President Trump to call off the rioters. Of course, acting ag rosen did take action, as did many other officials, but congressional leadership recognized on a bipartisan basis was that donald trump was the only person who could get the mob to end its violent siege of the congress, leave the capitol, and go home. Heres senator mcconnell speaking after january 6th about how President Trump banded his duties and failed to do his job. It was obvious that only President Trump could end this. He was the only one. Who could. Former aides publicly begged him to do so. Loyal allies frantically called the administration. The president did not act swiftly. He did not do his job. He didnt take steps so federal law could be faithicalliffully d and order restored. No. In the midst of this violent chaos, Kevin Mccarthy implored donald trump to tell his supporters and the mob to leave the capitol, and when that didnt work, mccarthy called trumps Adult Children to try to get them to intercede with trump to try the get trump to call off the insurrectionary violence. This is what he told Jimmy Herrera butler about his conversation with trump during the violence. Another witness Mick Mulvaney has also come forward and corroborated this shocking account. I asked Kevin Mccarthy who is a republican leader about this, and he said he called donald he finally got through to donald trump, and he said, you have got to get on tv. Youve got to get on twitter. Youve got to call these people off. Do you know what the president said to him . This is as its happening. He said, well, kevin, these a arent my people. These are antifa. He said, no, theyre your people and they came through my Office Windows and my staff is running for cover and you need to call them off. The response to kevin was chilling. He said, well, kevin, i guess theyre just more upset about the election than you are. Youve seen widespread reports of Kevin Mccarthy and the president having a swearing conversation. Thats when the swearing went because the president was basically saying, no. Im okay with this. I had a conversation at some point in the day or week after the riot with Kevin Mccarthy. It was very similar to what jamie had, the conversation she had retold about how he called and asked the president to get them to stop, something along the lines of, you know, maybe these people are just more angry about this than you are, and theyre more upset. I had a conversation similar to that with kevin a week after the riot. We know how Kevin Mccarthy described President Trumps conduct both in public and in pri private. The president bears wednesdays attack on congress by mob rioters. He should have immediately denounced the mob when he saw what was unfolding. These facts require immediate action for President Trump. Accept his share of responsibility. Quell the grueling unrest and make sure president elect biden is able to successfully begin his term, but let me be very clear to all of you and be very clear to the president. He bears responsibility for his words and actions. No, ifs, ands or buts. I asked him personally today, does he hold any responsibility for what happened . He told me he does have some responsibility for what happened, and we need to acknowledge that. 2 24 p. M. , knowing the deadly rye why the was now bearing down on his own Vice President , President Trump composed and sent a tweet attacking Vice President pence accusing him of cowardice for not unilaterally rejecting votes for joe biden and simply handing trump the presidency. The impact of that tweet was foreseeable and predictable. It further inflamed the mob which was chanting hang mike pence and proslvoked them to ev greater violence. This deliberate decision further enraged the mob against Vice President pence. It cannot be justified by anything that President Trump might have thought about the election. The tweet came precisely at the time penceS Secret Service detail was most seriously concerned for the vice prts physical safety. Weve obtained new documents from the Secret Service, realtime chats that underscore the threat they knew the Vice President would be facing because of the president s escalating incitement of the mob. After trumps tweet, one agent in the Secret Services Intelligence Division immediately warned potus just tweeted about pence. Probably not going to be good for pence. Another agent reported the dramatic impact of trumps antipence tweet on his followers. Potus said he lacked courage. Over 24,000 likes in under two minutes. Employees at twitter were nervously monitoring the situation. They knew certain twitter users were rioting at the capitol and tweeting about it at the same time. As the afternoon progressed, the company detected a surge in violent hashtags on the forum including lines of lethal incitement like, execute mike pence. Listen to this former twitter employee, who first came to the committee anonymously, but agreed to be named because she wants to speak out about the magnitude of the threats facing our people. You were also seeing at the time that was threatening towards the Vice President , hangmikepence. They were calling for his execution. Literally. Yes. After and in response to this tweet too because i think as many of Donald Trumps tweets did, it again, fanned the flames and it was individuals who were already constructing gallows, who were already willing to want to execute and looking for someone to be killed. Now the individual was calling upon them to begin the coup and is now pointing the finger at another individual. While theyre threatening to do this. Heres a small sample of the reactions that President Trumps fan the flames tweet provoked among capitol rioters in realtime. What percentage of the power has gone to the capitol . 100 . It has spread like wildfire. They have betrayed us, and everybody is marching on the capitol. In case you havent heard yet. What happened . We keep hearing that mike pence has screwed us. I keep hearing the word that mike pence has screwed us. Between 2 30 and 2 35, within ten minutes of President Trumps tweet, thousands of rioters overran the line, and the m Metropolitan Police force was holding on the capitol. This is first time that a security line like that had ever been broken. President trumps conduct that day was so shameful and so outrageous that it prompted num numerous mens of the staff and other employees to resign. Youve heard deputy National Security adviser Matt Pottinger and White House Press secretary Sarah Matthews explain why they felt compelled to resign on that day. Weve spoken to more highranking officials like the envoy to Northern Ireland and Chief Of Staff Mick Mulvaney who resigned after the 6th in protest of trumps misconduct and disassociate themselves from his role and violence. Take a look at what they had to say. I was stunned by the violence, and i was stunned by the president s apparent indifference to the violence. I thought, he failed at doing that. He failed at a critical time to be the sort of leader that the nation needed. I think the events at the capitol however they occurred were shocking, and it was something that as i mentioned in my statement that i could not put aside. At a particular point, the events were such that it was impossible for me to continue given my personal values and my philosophy. I came as an immigrant to this country. I believe in this country. I believe in a peaceful transfer of power. I believe in democracy, and so i was it was a decision that i made on my own. When security began the arrive at the capitol and the tide turned against the insur insurrection, the president finally gave his belated instruction at 4 17 p. M. After hours of rioting and serious injuries by our Law Enforcement officers, the crowd began to disperse. Listen to what they said as they decided to leave the capitol. We are listening to the president s message. Donald trump wants everybody to go home. Thats over. He says go home. They know were here. Donald trump has asked us to go home. Finally at 6 01 donald trump tweeted again not to condemn the violence in any way, but to excuse and glorify it. He made it clear that he considered the violence perfectly foreseeable and predictable. Check it out. These are the things and events that happen when a sacred landslide election victory is stripped away from straight pat patriots who have been badly, unfairly treated for so long. These are the things that happen, he said. Giving the whole game away. He was telling us that the Vice President , the congress, and all the injured and wounded cops some of whom are with us today got what was coming to us. According to trump, january 6th should not be a day that lives in shame and infamy in our history, but rather in glory. Remember this day forever, he wrote proudly, as if he were talking about dday or the battle of yorktown. Trump did nothing to stop the deadly violence for obvious reasons. He thought it was all justified. He incited it and he supported it. Would it have been possible at any moment for the president to walk down to the podium in the Briefing Room and talk to the nation at any time between when you first game him the information at 2 00 and 4 17 when he made the statement . Would that have been possible . Would that have been possible . Yes. Yes, it would have been possible. If the president wanted to address the American People, he could have been on camera almost instantly and conversely the White House Press corps has offices that are located direct lip behind the Briefing Room, and so if he had wanted to make an address from the oval office, we could have assembled the White House Press corps probably in a matter of minutes to get them into the oval for him to do an ofncamera address. Mr. Chairman, nothing in law or fact could justify the president s failure to act. And i assume you also would agree the president has a particular obligation to take care that the laws be faithfully executed . That is one of the president s obligations, correct. Mr. Chairman, in numerous places, our constitution strongly opposes insurrection and rebellion. Article 1 gives congress the power to call forth the militia to suppress insurrections. Section 3 of the 14th amendment disqualified from holding federal and state office, anyone who has sworn an oath to defend the constitution, but betrays it by engaging in insurrection or rebellion. It was president lincoln at the start of the civil war in 1861 who best explained why democracy rejects insurrection. Insurrection he said, is a war upon the first principle of popular government, the rights of the people. American democracy belongs to all the American People, not to a single man. Thank you, mr. We asked them what they hoped to see the committee accomplish. Over the course of our investigation, officer ganel wanted to know why the rioters were made to believe that the election process was rigged. Officer fanone asked us to look into the actions that resulted in the days after the events. Officer hodges was concerned about whether anyone in power had a role. Officer dunn put it simply. Get to the bottom of what happened. Weve worked for more than a year to get those answers. Weve conducted more than a thousand interviews and depositions. We received and reviewed hundreds of thousands of pages of documents. Thanks to the tireless work of our members and investigators, weve left we have left no doubt, none, that donald trump led an effort to upend American Democracy that directly resulted in the violence of january 6th. He tried to take away the voice of the American People in choosing their president and replace the will of the voters with his will to remain in power. He is the one person at the center of the story of what happened on january 6th. So we want to hear from him. The committee needs to do everything in our power to tell the most complete story possible and provide recommendations to help ensure nothing like january 6th ever happens again. We need to be fair and thorough and gain a full context of the evidence weve obtained, but the need for this committee to hear from donald trump goes beyond our factfinding. This is a question about accountability to the American People. He must be accountable. He is required to answer for his actions. He is required to answer to those Police Officers who put their lives and bodies on the line to defend our democracy. Hes required to answer to those millions of americans whose votes he wanted to throw out as part of his scheme to remain in power, and whatever is under way to ensure this accountability in the law, this committee will demand full accounting to every american person of the events of january 6th. So it is our obligation to seek Donald Trumps testimony. Theres precedent in American History to congress to compel the testimony of a president. There is also precedent for president s to provide testimony and Documentary Evidence to congressional investigators. We also recognize that a subpoena of a former president is an extraordinary action. Thats why we want to take this step in full view of the American People, especially because the subject matter at issue is so important to the American People, the stakes are so high, for our future of our democracy, and so i recognize the vice chair, ms. Here is john eastman, fraudulently instructing angry protesters that the Vice President could change the election joutcome on january 6t. He acknowledged later that same day in writing that donald trump knew what he was attempting was illegal. Here is john eastman testifying before our committee. So is your position that you can discuss the direct conversations you have of the United States, but not those same conversations with this committee . Yep. Other witnesses have also gone to enormous lengths to avoid testifying about their dealings with donald trump. Steve bannon has been tried and convicted by a jury of his peers for contempt of congress. He is scheduled to be sentenced for this crime later this month. Criminal proceedings regarding Peter Navarro continues. Mark meadows, Donald Trumps former Chief Of Staff has refused to testify based upon executive privilege. The committees litigation with him continues. Mr. Chairman, at some point the department of justice may well unearth the fact that these and other witnesses are currently concealing, but our duty today is to our country and our children, and our constitution. We are obligated to seek answers directly from the man who set this all in motion, and every american is entitled to those answers so we can act now to protect our republic. Without objection, the committee stands adjourned. And there you have it. A moment in history. Nine aye votes, zero no votes. The committee has now just decided unanimously to subpoena donald j. Trump for both testimony and documents relating to the attempt to overturn the election. It is a theatrical display in a way. They could have Just Announced it in a press release, but they wanted this moment recorded before everyone in history. Very strong statements from the members, particularly from the vice chair, congresswoman liz cheney who literally has sacrificed her political career to try to get to the bottom of what happened on january 6th, and hold donald trump accountable. One of the things that was so interesting i think was they talked about and liz cheney talked about there would likely be criminal referrals for another day, not for today of multiple individuals she said, and then she gave a hint as to who those individuals were, who would be criminally referred to the Justice Department. The report is they do expect to have criminal referrals. Plural. Yeah. Plural. They do expect it to be a unanimous vote by the committee, but what we saw here today was liz cheney really lay out donald trump and i use the word coconspirators. Roger stone, Michael Flynn, john eastman, jeff clark, steve ba bannon, Peter Navarro, and mark meadows the former Chief Of Staff whos refused to testify. Thats what they have been leading to, but over and over again today, we heard the most important thing. All roads lead to donald trump. These people were in effect, shes saying doing his bidding. They were part of the group. Also the drama of that ending there. The climax of all of these hearings with the vote to subpoena the man that they over and over have argued for testimony and evidence was the reason for the insurrection, the reason for the attack on the capitol, and the last thing they do is vote unanimously, gavel. K k out. Out. Its lights out. Theyre obviously going to have a final report, but when it comes to the public testimony, that was clearly intentional the way that they did that. Youve heard the chairman Bennie Thompson saying this was about accountability. The accountability that trump has to the American People for what happened on january 6th for his actions after the election for the way in which he was an integral part at the heart of everything that transpired over those those days. The committee wants to be clear that trump actually owes answers, and i think this is this is the, you know, we hear a lot from trump on truth social and there are all these rantings, but hes never been really subject to real questioning on what has been laid out over these last few months, and i do think that it would be revelatory if we were to hear from him. We probably wont, but i do think it would be revelatory. I think the American People are owed that, and theyre owed, i think, more than just the spin we have been getting from the various social media accounts. Its a very serious thing. Its not just about partisan politics and i think thats one of the points that the committee is trying to make here is he has an opportunity to come clean about his version of events, and he just wont do it. I think we know he wont do it. Could i just add two words . Hear from him, quote, under oath. We hear from him all the time. The point is under oath. And john king, one of the most devastating parts of the hearing today leading to this, its not unprecedented, but shocking move by congress, a bold move by congress by the committee to subpoena President Trump or former President Trump for documents and testimony, the violence, the incitement, the determination of individuals to come to the capitol and kill people laid at the floor of the president of the United States. And the compelling testimony again, not from the media, not from democrats, not from what trump calls republicans in name only, liz cheney and Adam Kinzinger, but his own people. His own aides in the white house, his own Secret Service detail, his own pentagon, and intelligence agencies as they watched the crowds in the days before january 6th. Youre a broken record of course, but there are people who think this is a fabrication and donald trump did nothing wrong, and those people did nothing wrong because they were under that spell. It was his people. They were armed and they were talking about going to the capitol, and then with Kevin Mccarthy, hours later donald trump says its antifa. He knows better. Mike pompeo said he was among the people who told the president this was over. We all know its over. He knew it was over. He continued to challenge the election. He knew about the potential of violence and he continued to support what was happening. It was like everybody in the Fire Department telling the chief the town is on fire, and the chief going, cool, lets go watch television. I think its also worth pointing out that he unlike Richard Nixon for example, has an entire right wing maga media ecosystem. Right. And on capitol hill who share his lies, whether they believe them or not. More likely financial and political incentive to continue it. Yeah. Theres an entire channel there are several channels that all they do is spew Donald Trumps lies. Thats also part of the spellbinding nature of it all. George, do you think donald trump has any legal exposure here . Yes, it has an enormous amount of legal exposure, and all of this, all of that evidence, all of that pointing at trump, it was a dramatic and as you say, a theatrical moment. It was this moment of sha kus, and you have to come to us to testify and he wont do it, and they highlighted the fact he wont do it by noting that so many around him took the Fifth Amendment or otherwise avoided testimony and thats what hes going to do here obviously, but it really puts it to him, and why cant he answer . Why cant he answer directly . Why cant he answer under oath . And he wont, and thats thats the gauntlet. Anderson . Jake, thanks very much. You saw in the majority of the hearing several minutes of neverbeforeseen video that was taken inside essentially what was a bunker. It was actually fort mcnair which was previously reported. Weve never seen images from inside the place where members of congress were evacuated to while the capitol was under attack. They played several minutes of it. We have obtained the nearly all of the video that was turned over to the committee. They had more than 40 minutes of material to choose from. They only played a few minutes. I want to show you a minute or so of what they played earlier. We have got to get to finish the proceedings. There has to be some way we can maintain the sense that people have that there is some security or some confidence, that government can function, and that you can elect the president of the United States. Did we go back into session . We did go back into session, but now apparently everybody on the floor is putting on their gas masks to prepare for a breach. Im trying to get more information. Theyre putting on their tear gas masks. Can you believe this . No, i cant. Oh my gosh. Theyre just breaking windows. Theyre doing all all kinds of its really they said somebody was shot. Its just horrendous, and all at the instigation of the president of the United States. Now as i mentioned, we just showed you about a minute or so clip. They showed probably a few more minutes during the Committee Hearing today. Ive actually seen the entire 40plus minutes of video which was provided to the committee, most of it was provided to the committee and were going to be airing most of that tonight on my program at 8 00 p. M. Tonight, and were going to be airing other footage that has never been seen before that was taken in Speaker Pelosis office while the before the attack began, and also as the speaker, her family, her staff watched the mob approach the capitol, ultimately leading to their evacuation, and also video of their return to capitol hill after the it was secured. The video was taken by Alexander Pelosi who is a very respected documentary remaker. Shes the daughter of Speaker Pelosi. She was there that day with members of her own family taking to be part of her and to watch the transfer of power, and she started to record and obviously once this turned into an attack on the capitol, she continued to roll with her cameras as she followed her mother to the to the evacuation point. So its really a remarkable piece of just history that has been cap chured that has never before been seen. You only saw a little glimpse of it. Well show you nearly the entire thing tonight at 8 00 p. M. , but its really i mean, when i saw this video, its it is obviously its extraordinary. You see members of congress, republicans and democrats, at fort mcnair huddled together trying to figure out what they can do to keep these proceedings going. We see much more than we ever knew before about their attempts, their discussions about moving the entire congress to a location to actually continue the vote and then deciding, no. It has to take place at capitol hill. You see on the phone, senator schumer, senator pelosi. You see Speaker Pelosi talking twice with Vice President mike pence, expressing concern for his safety, discussing plans to try to make sure that this this attack does not succeed in the sense of stopping the certification of the vote. You see senator schumer arguing with and demanding the acting attorney general tell the president of the United States to make some sort of a statement. The acting attorney general who at that point had lost favor of the president , attorney general rosen, essentially avoids schumer trying to get him to do this. Well show all of that to you. Im just stunned by the historic importance of these images and that they are just now coming out. Was it striking to you, anderson, that it seemed to be these people in congress were trying to get the security that should have been sent there originally by the president of the United States, and that they had spoken to mike pence more than the president had . They are clearly they are calling up, you know, people at the pentagon. They were calling up governors. Yeah. In maryland, and virginia. Speaker pelosi talks about calling up the mayor of d. C. They are trying to get whatever military or Police Assets to be brought to bear as possible knowing, and theyre also hearing stories of was there a hold on getting the d. C. National guard there . They called the defense secretary to or the acting secretary of denfense to try to understand if there was a hold in place. He tells them theres not, but he had to get permission of the chain of command. It is its just extraordinary when the first time i saw these images, i just you feel like you are youre witnessing history, and we think we have seen so much of this event. We feel like weve seen all these images. You have not seen the Behind The Scenes of what is happening like were going to show you tonight. It pushes back also on what weve heard from so many republicans saying that theyre pointing the finger at emppelos saying she didnt act, and if they dont disband the committee as it is now, theyll change it to what happened with Law Enforcement that day. To see pelosi calling and schumer calling people and Steve Scalise is in the room with her. You see mccarthy. Mitch mcconnell. Mcconnell at one point. Sidney hoyer. Some of them are with them in the huddle. Some of them arent as engaged and are probably making phone calls of their own, but i mean, you can judge for yourself in the 40plus minutes of video that you will see tonight who was doing what. What you dont see in these scenes which was the striking part, not one of these people was the commander in chief. Were seeing these video images after having seen the testimony that the president of the United States was alone in a room, the Chief Of Staff flipping through his phone. Are people attacking the capitol . Just the state of dismissive nature compared to the Frenetic Energy to try to keep people safe. Pelosi in that conversation, shes calling governors. Shes trying to get anyone to district of colombia to help. Shes saying, imagine this was the pentagon or the white house as if, you know, you have to remind them, capitol, you know, the capitol is, you know, the third branch of government. That clip of chris miller who was at the pentagon at the time wasnt saying, yes, we will help you right away. Yes, we see this. Were monitoring this. He was kind of speaking in circles trying to answer to her about executing certain things. He didnt have a clear answer. He didnt have permission necessarily. And i think you hear some of that frustration in a lot of these phone calls that will play tonight. Well hear more fully. Im wondering on a human level, anderson, the speakers daughter was there and filming this, but my understanding is other family members including grandchildren were there. How does that play on the tapes and what did you get out of that . There is a i believe both of her grandchildren were there. Theres one image if my memory serves me correct of actually one of the grandkids watching out the window of Speaker Pelosis office as thousands of people are approaching the capitol, and i believe in one of the shots that was shown in there, you see one of the grandkids in a theater at fort mcnair. So its obviously it is, you know, this was not how they expected the day to go obviously. Their entire family was there to witness this historic event. Turned into a very different kind of historic event. In the clips on your show, are we going to hear more from the responses of people . Do something about this. Lets talk more about this new subpoena going to donald trump for documents and testimony, and the new evidence that donald trump had a premeditated plan to declare victory, regardless of the actual Election Results. Were joined by olivia troy who served as an adviser to Vice President mike pence, Sarah Matthews, a former deputy who testified before the select de committee. We saw a lot of testimony today, a lot of evidence that donald trump, the plan all along as far back as the summer of 2020 was, well, no matter what happens, trumps going to go out there and declare victory one way or another. Had you ever heard anything about that when you were in the white house . I dont think i had ever heard there was a plan for him to declare victory. I wasnt privy to those conversations, but i think there was a lot of evidence of him kind of saying that mailin voting would be fraudulent. That was something that the campaign was pushing and that the white house was pushing, you know, in the summer leading up to the election. So i do think that he was building that case come november if he did lose that he he did lose because he wanted a scapegoat if he did lost. As opposed to people having a president they didnt want to be in the white house any. Olivia, testimony from multiple, multiple white house officials knew that trump knew he lost the election. Take a listen. So were in the oval office and there is a discussion going on. And the president says it could have been pompeo, but he says words to the effect of yeah, we lost. We need to let that issue go to the next guy, meaning President Biden. I remember maybe a week after the election was called, i popped into the oval just to like give the president the headlines and see how he was doing. And he was looking at the tv and he said can you believe i lost to this fing guy. Mike was with me on the 18th. On the motorcade drive back to the white house, i said does the president really think that he lost . And he says a lot of times hell tell me that he lost, but he wants to keep fighting it. He thinks there might be enough to overturn the election. He pretty much has acknowledged that he lost. What do you think . Look, i think this is a very dangerous scenario that they lead out. Honestly, it brought back some memories to sarahs point of the previous summer. I had a conversation with someone on mike pences staff talking about what happens if he doesnt leave if he loses. And i have to tell you, it was kind of jarring to watch this today, know about the memo that greg jacob, pences counsel wrote prior to the election and where they were preparing and saying hey, make sure that pence is careful that he doesnt go along with a victory call by trump. You got to be careful with that. And looking forward at the extent of this, that trump is fully aware of this. Also, ive got to say for someone who worked in counterterrorism for so long, the sort of acts that trump was trying to take in the immediate after that, knowing he lost in the withdrawal from somalia, that was frightening he was going to take such rash actions. I think it speaks to what the future for this country would look like if twrumrump comes ba into the office or someone like him, where they undermine our democracy and the rash actions they can take like this. The video played from inside the capitol as leaders reacted to the insurrection in realtime, including your former boss mike pence. In your view well, here it is, some of the video. You think trump advocated his responsibility, olivia . Yeah, absolutely. There is the entire leadership trying to do everything they can in this moment to figure out how they get through this situation. Mike pence is taking leadership, ownership of the situation, knowing there is a person sitting in the oval office who is just behaving complete dereliction of duty and doing nothing, nothing to stop this situation. And sarah, there is a new Secret Service Text Messages revealed today that show a number of agents spotted numerous guns in the crowd the morning of january 6th before donald trump was set to speak, which squares with Cassidy Hutchinsons testimony that trump had been told that a number of people couldnt get in because the magnetometers were keeping them out. Thats just shocking and upsetting. Were honestly lucky that more people didnt die that day when you think about it. No, youre absolutely right. And he can try to claim that he was unaware that the people in the crowd were armed, but were talking about the president of the United States. Of course theyre going raise Something Like that to him. So he cant claim that he didnt know that. And now that were seeing Secret Service was well aware, that corroborates Cassidy Hutchinsons testimony. And i also think something really alarming revealed from the secret messages, they were well aware there could be violence. I think it was up to ten days in advance leading up to the rally. So they knew that there could be violence happening. And you would think that they would warn the president of Something Like that. Yeah. Its shocking that more was not done given that information. Personal safety is to just transcends everything. But the fact is on any given day, theyre breaking the law in many different ways. And quite frankly, much of it at the instigation of the president of the United States. And now if he could at least somebody why dont you get the president to tell them to leave the capitol, mr. How soon in the future can you have the place evacuated, pulled together and cleaned out . I dont want to speak for the leadership thats going to be responsible for executing the operation. So im not going to say that because theyre being on the ground and theyre just pretend for a moment this was the pentagon or the white house or some other entity that was under siege. And let me say you can logistically get people there as you make the plan. Were trying to figure out how we can get this job done today. We talked to mitch about it earlier. He is not in the room right now, but he was with us earlier and said we want to expedite this and hopefully they could confine it to just one complaint, arizona, and then we could vote and it would be just move forward with the rest of the state. The overriding wish is to do it at the capitol. What we are being told very directly is its going to take days for the capitol to be okay again. Weve gotten a very bad report about the condition of the house floor with defecation and all that kind of thing as well. I dont think that thats hard to clean up, but i do think it is more from a security standpoint of making sure that everybody is out of the building, and how long will that take. I just got off with the Vice President elect. What we left the conversation with, because he said he had the impression from mitch that mitch wants everybody back to do it there. Yes. I said were getting a counterpoint it could take time to clean up the poohpooh that theyre making all over literally and figuratively in the capitol and it may take days to get back. The capitol building, im literally standing with the chief of police of the u. S. Capitol police. He just informed me what you will hear through official channels. You know, its so interesting about that is that for months, the lame attempt at deflecting, john king, by House Republicans who dont want to talk about what donald trump did and dont want to talk about the role that their own lies about the election did will say well, where was nancy pelosi . What was she doing . Why wasnt she doing enough . Nancy pelosi was on the phone trying to get the National Guard and the pentagon on the case. We saw it right there. You saw it right there. You saw the Vice President , her calling the democratic governor of virginia, steny hoyer calling his home state of maryland. You see other democrats and republicans standing by being looped in on the conversation, including Steve Scalise, the number one in house Mitch Mcconnell. All there. What name did you never hear . The president of the United States, the person who has the most power, the most authority to move rocks, bridges, stones, troops, everything he has to do to make things happen. You never hear his name. Now to the pelosi point you make, there are legitimate questions about like 9 11. What about january 4th and 5th . Everybody in washington, the police agencies, the intelligence agencies, the Trump Administration, the Secret Service had this information. The pentagon had this information, and the congressional leadership on a bipartisan basis, should they have done more . Should they have anticipated the violence . Thats a legitimate question. But in terms of nancy pelosi taking charge that day or nancy pelosi being awol that day, your eyes dont lie. You see it right there. Lets bring in john miller, former National Security official, now our National Security expert. John, watching this National Security event play out, what are your thoughts, especially after todays hearing . Well, i mean, i want to pick up on john kings question which is were looking at the leadership of congress hidden away at fort mcnair, trying to get control from a military base. The irony there is they managed to get congress to the military, but they couldnt get the military to congress. We know that on january 3rd, the Capitol Polices intelligence arm issued a memorandum that said Trump Supporters will look at january 6th, three days from the writing of that memo, as their last chance to overturn the election. The striking line from that memo is unlike Previous Post election protests, the targets of the proTrump Supporters are not necessarily the counterprotesters as they were previously, but Rather Congress itself is the target. They talked about militia members and armed people, White Supremacists being there and creating what they called a significant threat to the public and to police and Law Enforcement. Steve sund, the chief of the Capitol Police, met with the sergeant of arms of both houses, said he wanted the National Guard in advance. And what came back is well, they dont like the optics of it. So i think that they knew what they knew, and political decision overrode what Law Enforcement clearly needed as was proven. Jamie gangel . Can i talk to that a little bit . I actually spoke to nancy pelosi in the days leading up to january 6th and asked her, because we were hearing from members of congress they were worried about this. Sure. And i am told that she went to the Capitol Hill Police leadership sergeant of arms. Im also told by multiple republican senators who spoke directly to Mitch Mcconnell and also expressed their concern about it, that both Mitch Mcconnell, republican. Nancy pelosi, a democrat, went to the top security people at the Capitol Hill Police, and that they were assured that everything would be okay. Was that because they had never had Something Like this happen before . They didnt believe it . I think thats still unclear. But they were assured that it would be okay. Just to be clear, there is nothing quite like this that had ever happened before. Right. But there had been violent, deadly attacks on the capitol before. Puerto rican terrorists in 1954 and 1998 i think a gunman shot a couple of capitol Police Officers. Even after this there have been a couple of Violent Attacks by disturbed individuals. Listen, after 9 11, the key takeaway was failure of imagination. Right. And this is a different version of that. There is a reason why the Law Enforcement officials, the top ones that john miller was just talking about at the Capitol Police and also the sergeants of arms were gone after this. There is a reason for it. Because it was a massive failure. The question of the exact conversations, your reporting is fascinating. But there are some conversations in reporting that everybody is going to have to continue to do, particularly in light of what we just saw for the first time today in the hearing, which are all those remarkable texts and emails from the Secret Service. Secret service, the Law Enforcement Agency Responsible for protecting the president. Why wasnt there a communication or was there between the Secret Service and people in the capitol if they knew that this was going to happen . This is the thing also that sticks with me. Dana, exactly what you just said. What was laid out today was a lot of evidence all the way back into december there was information coming directly to the Secret Service about the threats that were out there. The day of january 6th, starting at around 7 00 in the morning, they were seeing people armed in the streets. They were noting how violent and chaotic things were about to become. And yet in spite of that, it does not seem that there was really any effort made in that intervening time. Trump is now facing a subpoena issued by the january 6th House Select Committee, capping its final hearing before the Midterm Election was a unanimous vote, 90 to compel trump to testify and produce documents as todays hearing was playing out, the u. S. Supreme court was also delivering some bad news to mr. Trump. The justices rejected his request that they intervene in the legal battle hes in with the department of justice over those classified documents that the fbi seized from maralago. Lets bring in our Supreme Court analyst and cnn senior justice correspondent evan perez. Tell us about this setback. Sure. It was another setback for the president in another venue. The president had gone to the Supreme Court, asking to block an 11th circuit order that had said that the Justice Department did not have to turn over to a special master about 100 documents marked classified from that maralago raid back in august. The Justice Department said this documents relate to National Security. They should not be turned over to the special master. They should not be reviewed by him. And trump had tried to get the Supreme Court to intervene. And i have to tell you, jake, it just shows how thin his grounds were that the justices rejected it without any noted dissent in a onesentence order. Not a single justice breck off to write any kind of caveat. And the truth was that the former president had no legal grounds to say while this special master is reviewing these documents, he should also have accessed these special classified ones. You know this arises from the department of Justice Department attempt to look at whether the former president had unlawfully retained documents from the white house and could possibly have obstructed justice. This was an intermediate action, and the Supreme Court at this point said not part of it. Dont want to intervene. And the only thing i would say is predictable right now, jake, its not the last time that trump has gone to the Supreme Court, and well probably see it down the road too, given what happened today. Oh, im sure. And evan, what does this mean for the broader investigation by the fbi and the Justice Department about those classified documents that trump improperly took to maralago . Well, it means full speed ahead pour the Justice Department prosecutors, jake. It means, again, the fact that the Appeals Court had already given them the permission to continue to do their investigation, that already started. We know that witnesses have been going back to the grand jury, talking to the fbi. There has been a lot of investigative activity. And as joan points out, jake, talking to people in trump world, there was a feeling that this was a very narrow appeal that trump and his legal team was making, perhaps to test the ground for what they expect is going to be a full appeal at some point when they try to challenge whatever it is the Justice Department tries to do here at the end of this investigation. So they were testing the grounds to see where they stand with the justices. For now, it looks like theyre not willing to intervene at this stage, which is still an investigation. No charges have been brought. Its very unusual for judges to be intervening in this. So thats the reason why perhaps the Supreme Court decided to stay out for now. And lets get more on trumps legal battles now with former u. S. Attorney and cnn legal analyst Preet Bharara and fr frank ford and Carl Bernstein. Preet, let me start with you. Whats your reaction to issuing subpoenas for testimony and documents . Its a strong move. It hasnt happened much. Its happened before in american politics and wars between the branches. So its not unprecedented, but its a pretty bold step. I think its largely symbolic, for a number of reasons. Donald trump is never going to appear before that committee. That committee will probably be disbanded if the political pundits are right and the house is lost and goes to the republicans in the house. Were already on the eve of the election. Its only a few days left. It takes some time, as we learned with respect to other witnesses to enforce a subpoena. It took them months and months to get a criminal referral for contempt of congress to the Justice Department for them to make the decision to indict. And all of that still doesnt get Steve Bannons testimony before that committee. So its a bold step. I think they want it to end dramatically with the last investigative hearing. They did that. They didnt have to wait until the end. Excuse me. But i dont think it will amount to getting his testimony in any way, shape or form. John dean, if they really wanted to bring donald trump in for testimony, should they not have done this sooner . I think preet is right, that theyre not going to get him. Its not likely he is going to come forward voluntarily, and your questions suggests something they might have considered if they really wanted him, was to start much earlier on this, because he is going to litigate it. His standard playbook is to delay and see what happens and divert. So i dont think they wanted him that badly. But they did make an appropriate closing for their presentation today. Frank, do you think that attorney general Merrick Garland, if donald trump defies the subpoena and Congress Holds him in contempt, those are two ifs, but if that were to happen and they referred it to the Justice Department, do you think attorney general Merrick Garland would pursue a criminal case against donald trump . I mean, obviously there is precedent for the Justice Department pursuing contempt cases. We have the steve bannon and mark meadows examples. But i think given the timeline that preet has just described and that john has just described, that there is really no reasonable expectation that he is going to appear before this committee. I dont know if the committee will necessarily force the issue in that way. And Merrick Garland obviously has his hands full with these other investigations going on. I dont really know that this is something that he would relish pursuing in addition to maralago and the other january 6th investigations. Carl bernstein, the third most senior House Republican, Elise Stefanik of new york tweeted that the committee is nothing more than partisan sham. What can the committee accomplish if Donald Trumps grip on House Republicans remains this strong . Well, there is also the senate, and there is also we got to see what happens in the election. But lets look at what was said there. The idea that this is a partisan witch hunt or something, lets look at liz cheneys role. And this is next to the Army Mccarthy hearings, the watergate hearings, this is one of the three great congressional investigations and hearings of our time. What has happened . Look at that footage that we saw, the lead speaking bipartisan, the leaders of the house and senate faced really with the actions of a mad king, gathered together at an army fort to try and make sure that American Democracy lives. And they do it. We watched them in realtime. So to say that this is a partisan exercise, given the voluminous open and shut amount of information about Donald Trumps criminality, his responsibility for this insurrection, his actually being a seditious president of the United States, unlike any in our history, this is an extraordinary moment. We all ought to step back and consider. And preet, as far as the maralago documents are concerned, these classified documents, now that the u. S. Supreme court has refused to intervene, despite Donald Trumps request, what does that mean for that investigation and any potential prosecution against donald trump for that . Yeah, so its confusing because there is a lot of litigation going on in different forms. There is the florida court, the district court, the Supreme Court, an a judge in the Eastern District of new york. The bottom line is with respect to all these litigations, the way theyve been fashioned so far, they dont have a lot of effect except it might delay a little bit the main question i think youre getting at, which is when will the department of justice make a decision to proceed or not to proceed with criminal charges against donald trump with respect to the mishandling of those documents . This litigation is about who gets to review, for what purpose. Its not about and its not on the table with respect to some of these things that the department of justice cant continue its investigation. Its Going Forward. It might be delayed a little bit until they can make an assessment with National Security assessment and a criminal Law Enforcement assessment. But its happening one way or another. And by happening, i dont mean a charge. But decision about a charge will be squarely placed on the desk of Merrick Garland, and hell have to decide. Frank foer, what do you think hell decide . I think its interesting to contrast the Justice Department investigation has been conducting which has been very circumspect, especially in contrast to the congressional investigation. And then there is the maralago investigation, which is a much more cut and dry case where youve seen that once garland and the Justice Department has engaged, its been incredibly aggressive, and its moved forward in a relatively expeditious way. I dont know if Merrick Garland knows the timing of when hell move or if hes even made a decision in his own head if he is going to go all the way and issue an indictment, but there is a certain logic that events start to have, and there is a momentum that the process starts to have. You have to say at this point, there is momentum. And the logic is unfolding. The january 6th House Select Committee has to decide now how hard it is going to fight in order to get Donald Trumps testimony, if as we suspect he refuses to comply with the subpoena that the panel voted to issue today. Lets bring in cnns sara murray on capitol hill. She spoke with the chairman of the House Select Committee, congressman been any thompson, democrat of mississippi, a short while ago. Sara, what did chairman thompson have to say about the next steps after this vote . Well, jake, look. We wanted to talk to him about whether they were still going to try to talk to mike pence, and frankly, why donald trump would want to come before this committee when see still facing scrutiny by the Justice Department. Take a listen to what the chairman told us. Well, we have collected enough evidence that former Vice President pence did his job. We now need to hear from the president. What we presented today clearly shows the president s cupability in what occurred on january 6th. So if he wants to clear the record, he will have an opportunity to do it. If he knows your work is going to end at the end of the year and he is also under criminal investigation, why would he come here and talk to the panel . Well, ask donald trump. Ask donald trump. Both he and jamie raskin who we also talked to when he was leaving the committee were more wishy washi on whether they were willing to fight this subpoena out in court. And jake, as you and the other panelists have noted, Donald Trumps constant strategy is to delay, delay, delay. We dont expect it to be any different when it comes to this. We did hear from Committee Members, they really think donald trump should come up here and clear his name. Jake . All right, sara murray, thank you so much. We are joined by a member of the January 6th Select Committee, the one that sara described as wishywashy on whether they were going fight this, jamie raskin, democrat of maryland. How much of this is setting a marker were inviting him to tell his story, were inviting him to give his side, and how much of this is no, we really think that we can get him to testify . Oh, more than a thousand americans have come forward to testify. I know. Including lots of people in his administration, Cabinet Officials. There have been of course he should. Of course he should. Im not disputing that. He is not going to. Put hit the way. If you interviewed 100 people on the street and said theyre accusing you of trying to overthrow your own government, overthrow president ial election, and they deny it, well, would you come forward and testify . I think that they would. But even if he thinks that it was a righteous manifestation of protrump sentiment, then he should come forward. If he really wants to be the mussolini of a mass right wing populous movement to attack the constitutional order, he should come forward and explain that. It seems like hes got lots of time to go on tv and to speak in mass audiences. Why doesnt he have time to do what every other american pretty much weve invited to do which is come forward and tell what they know about this assault on American Democracy. He just posted on truth social, his social media site ill just paraphrase. If youre so interested in having him testify, why not invite me months ago. Thats what he said. Well, i invited him more than a year ago to come testify in his impeachment trial. And it took him less time to say he would not come than it took him to respond to our Police Officers getting hit over the head steel pipes and confederate battle flags. So he already turned that down. But this is an opportunity for him to come forward and tell the truth. And, you know, that is everybodys responsibility. Seven former president s have come forward to testify in American History. Two of them by subpoena. Right. John quincy adams, john tyler did it. And there is nothing really extraordinary about a former president coming forward to testify. Bill clinton was called before the independent council. Ken starr, henry nixon, harry truman, i know, there is a long list. Why not start this process a few months ago . Why not . Look, if we started a few months ago, everybody would say youre calling him in before youve done the investigation. Those are all the wrong questions. The right question is why doesnt donald trump want to come forward and answer questions about exactly what he was doing that day . We saw Speaker Pelosi, we saw senator mcconnell, we saw a number of political leaders scrambling to get Law Enforcement to come and rescue the Police Forces at the capitol, to try to defend the house and the senate which had been driven out of our chambers, to defend Donald Trumps Vice President. We saw them doing that. And all that we have from witnesses is that donald trump was sitting in the white house dining room. We dont know exactly what he was eating, but he was there for several hours watching these events on tv. And wed like him to explain what did he have in mind there and why didnt he call the secretary of defense, why didnt he call the head of the National Guard, why didnt he call the chief of the d. C. Police, why didnt he call the mayor of the district of columbia or any of those congressional leaders who were desperately trying to get military reinforcements to defend our institutions. Circumstances there a deadline for him to respond to the subpoena . Well, the subpoena has not been issued yet. What just happened was we voted 90 on a bipartisan unanimous basis in the committee to authorize and to direct the chair of our committee to go forward and to issue a subpoena. That subpoena will have specific dates for when documents are expected from the former president and when we expect him to come and show up. And, remember, steve bannon is one of a handful of people who just blew us off, and he has been convicted for contempt of congress. So if he does not comply with the subpoena, which i think is a Fair Assessment of whats likely to happen, will the select Committee Bring it up for a vote whether or not to criminally refer him to the Justice Department for refusing to comply . I mean, youre 12 hypothetical steps ahead of me there. I think its a pretty good prediction. Im not nostradamus, but i think its likely here. We havent even seen the subpoena yet. Im not sure its drawn up yet. But it will be coming in a matter of days. What documents do you want the see, hypothetically . There is a whole list of documents. Remember, weve spoken to more than a thousand witnesses. Weve seen hundreds of thousands of documents. And, you know we know that donald trump is pretty good at possessing documents and being a caretaker for them. So he may still have some documents that are relevant to our investigation. The chairman of the committee Bennie Thompson told me right at this table a few months ago that there would be evidence of direct links between the people carrying out the violence, the far right militia, oath keepers, proud boys, charged with Seditious Conspiracy, some of them have pleaded guilty, and the trump orbit. We know that there are relationships, Michael Flynn and roger stone. Yeah. But there isnt there hasnt been presented any evidence of direct coordination. There just hasnt. Now im not saying that it didnt happen. There is a lot of circumstantial. There is a lot of circumstantial evidence. Yes. But its also worth pointing out that stone and bannon and all the people with knowledge potentially of whether or not there is any direct correlation or coordination, they have all refused to comply. Theyve either asserted the Fifth Amendment, their privilege against selfincrimination because they think it will expose them to criminal prosecution, or theyve blown us off, as bannon did at his own legal peril. Thats one of the reasons we need to talk to donald trump. There is tons of circumstantial evidence, including the things that trump does publicly, including saying to the proud boys at the first president ial debate of 2020, stand back and stand by. Right. Which was kind of like the message he sent to russia about hillarys emails. Russia, if youre listening, find her emails. Sometimes his unlawful orders are issued in plain sight. How republican Elise Stefanik, the number three republican in the house said that, quote, this is not oversight, its political revenge because its likely, she says, that trump will be running against joe biden in 2024. A trump spokesman called the hearing today partisan theatrics. Whats your response . Well, if its partisan theater, or if its partisan revenge, its from the Republican Party because the overwhelming number of our witnesses have been Donald Trumps own political lieutenants, his cabinet secretaries, people like Cassidy Hutchinson who spent years working for donald trump, but basically, these people are saying that they didnt sign up for insurrection and coup and destruction of the american form of government. Thats what it means to them to be republicans. And they dont have a right to write liz cheney and Adam Kinzinger and mitt romney and the 17 representatives and senators in the Republican Party who voted for impeachment or conviction or who are participating in this process out of the Republican Party. Those people are real republicans too. This is a completely bipartisan effort that were engaged in. And if its partisan, its because its overwhelmingly republican. But the democrats have been working real hard on it too. You mean partisan in terms of the witnesses . The witnesses that have come forward. So just two more questions. The vice chair liz cheney suggested that there would be in all likelihood criminal referrals having to do with individuals, having to do with obstruction of justice. And she seemed to suggest stone, bannon, et cetera would be among those. When will a decision be made about those criminal referrals . Well we have a Little Committee which im leading looking into that question right now about criminal referrals. And how we would do it, and how we would set it forth. There are not explicit statutory mechanisms for doing that. And so we want to proceed with some care and some thoughtfulness about how we do it. I think the media was a little bit confused because there is a statutory mechanism for referring someone for contempt of congress. That exists. But if Congress Comes into possession of other evidence of crimes being committed, we have to figure out the right way of turning that over and making that referral happen. Lastly, the vice chair of the committee, liz cheney, told me, and im paraphrasing, but she basically told me she thinks donald trump broke the law. And she has suggested that if there is a vote to criminally refer the matter from the committee to the department of justice, that it would be a unanimous vote. Well, i think weve already committed ourselves on that. In the john eastman litigation in california, in the California District Court under judge carter, we we submitted a pleading saying that we thought that federal crimes had been committed. Right. And judge carter adopted that and said he thought it was more likely than not. He thought it was likely that President Trump had engaged in federal crimes. I mean, what are all of these people being charged with . Well, conspiracy to interfere with a federal proceeding. The joint session of the congress on january 6th to count Electoral College votes and to cute the peaceful transfer of power is a federal proceeding. A lot of these people are being charged with or have already plead guilty to Seditious Conspiracy. Right. Seditious conspiracy is conspiracy to overthrow the government of the United States or its laws and to put down the government of the United States. And so all of these things are very much in play. All right. After the election im guessing is when those meetings will take place, or any announcements or decisions, after the election. Yeah, stay tuned for that. They were at fort mcnair. It was extraordinary video in a hearing packed with new evidence. Joining us now to discuss, three officers who were injured defending the u. S. Capitol on january 6th. Former d. C. Metropolitan Police Officer michael fanone. Current d. C. Police officer daniel hodges. And Capitol Police sergeant aquilino gonel. Mike, let me start with you. The shocking video of nancy pelosi and others who evacuated the capitol at fort mcnair, you can see them on the video, pleading for help, calling governors, calling the pentagon, calling pence. You were fighting the fight all three of you at that moment. And your brothers and sisters in blue. What was it like watching that . The congressional leaders pleading for help, to help you. I mean, it was infuriating. You know, here we are, here are these members who clearly understood the urgency and were outraged by what was happening that day. And you know, now like 19 months later very few of our elected leaders, specifically republicans, see any urgency or outrage as to the president s actions and those that continue to support him. Yeah. I mean, it made my blood boil. So officer hodges, the Committee Also shared these new evidence from that day, january 6th itself, messages between two secret Service Agents about the growing threat. Lets listen in. With so many weapons found so far you wonder how many are unknown, one agent wrote at 12 36 p. M. Could be sporty after dark. At 12 47 p. M. Another agent responded, no doubt. The people at the ellipse said theyre moving to the capitol after the potus speech. So thats before the violence. Did any of that information from the Secret Service get to you officers on the ground, that there were guns and people coming to the capitol . We didnt receive any specific intelligence, you know, the rankandfile officers, as to whether they had weapons. We had our strong feelings to that effect. And you know, we saw the people Walking Around with the tactical vests and Tactical Gear, all that good stuff. But that alone isnt enough to stop someone and search them. So we just had to, you know, be vigilant and identify weapons when we could and make reports so that they could be investigated. It just seems like a huge failure in communication between Law Enforcement agencies. We didnt get those either. You didnt get it either at the Capitol Police. No. No, sir. And just like mike was saying, when those leaders were holed up in that room we were fighting for our lives. Right. And the only reason why they got to those rooms for safety was because what we were doing. And its amazing that some of them, just like mike mentioned in his book, i run into one of them and he turned his back. In in the elevator just me and him. He turned his back on you. He didnt even say thank you, how are you doing, im sorry. Nothing. Who was it . He mentioned in his book. Who was it . I dont remember which ill get tell me, what does it matter . He turned his back. Lets say hes from indiana. From indiana. That doesnt narrow it down. Anyway. So but its very shameful the way we were treated. Even the walking down the hallways of the capitol, they turn, look different way or pretend that theyre doing something to that effect.
