But now a judge says he is inclined to release parts justifying the search of the former president s home. Today, the judge authorizing the search, ordered the doj to decide what it wants redacted. Hes giving the Justice Department one week. The affidavit spells out exactly what the fbi agents were looking for at maralago and why they needed to take such drastic and unprecedented action. Federal prosecutors say the release of the documents would jeopardize their ongoing investigation. But news organizations, including nbc news being are asking the judge to unseal it. Today in court, a lawyer for the media argued the search was one of the first in history. And there is tremendous. Federal prosecutors pushed back. They warned it would compromise futuresteps in the investigation and put witnesses in danger. A doj lawyer told the judge, this is a volatile situation, with respect to this particular search across the political specttrum. But certainly on one side in particular. Theres a real concern. Not just for the safety of these but the chill for those who may come forward and cooperate. Ultimately, the judge ruled it was very important for the public to have as much information as possible. Mark caputo was in West Palm Beach a short distance away from maralago. Hes now in miami. Give us a sense of the argument. You pretty had summed it up. What was remarkable to me, if you didnt know this was a former president , you would have thought they were talking about a mob boss. When you hear about the obstruction of justice, tampering with witness. Worries that Law Enforcement are going to be doxed and put at risk. Its remarkable stuff. Accurately said by both sides in the courtroom, that this is an unprecedented, unique situation. And this is a real moment in history. The doj now has one week to provide those redactions. What happens after that . The judge can decide what happens. Judge reinhartz. He knows what it in there. He also is former Law Enforcement himself. He is going to take the time read over it and decide okay. This should be in, this shouldnt be in, this should be out. If he thinks the doj did a good job, hell say that. Nbc is now reporting that there are discussions in trump world about potentially releasing that surveillancefootage of the search. What would that do for everyone. The reality is a lot of people say a lot of things in trump world. Until it actually gets done, im a little skeptical about exactly what says what in trump world. In fact, trump himself frequently changes his mind from one degree or another. After all, the former president said he wants the affidavit complete. But the reality is, there is a lot of stuff in there. Grand jury testimony, according to the prosecutors that probably arent going to reflect well on the former president. In fact, one of the reasons the search warrants got approved is that the judge essentially ruled, theres probable cause that the former president or people in this orbit had obstruction of justice and broken or violated other laws in regards to records maintenance. As to what the surveillance will show or what the affidavit really says, well, thats the difficulty of covering all of this in trump world in general. You never quite know until its black and white on a piece of paper. A whole lot to still learn, marc, thank you. Legal analysis from rebecca roiphe. Now shes a professor at new york law schools. Rebecca, thanks for being here. The fight now is going to be about these redactions. And the irony here is that donald trump and the media are basically arguing the same side of this, which is rare to see. They both want to see as much of this as possible. But the government is out there, saying theyre going to want more redaction. How does the judge balance those two . You know, its very difficult. And i think what hes doing here is the right thing, which is looking specifically at, you know, each sentence, and trying to figure out what is actually justified in terms of secrecy concerns as you said, about National Security, or that they see witnesses, or keeping future witnessesfrom coming forward. He wants everything release. And i think thats the right decision. The public has a right to know. But in this case in particular, its critical because this is so highprofile. And there has been so much discussion that has undermined the legitimacy of our criminal Justice System and the fbi itself. So the more that can be released that shows that this is a legitimate investigation, the better off we are, and the safer, i think, these agents are. You know, in the long run. How does it work behind the scenes . Do they actually go through these redactions, line by line, by the judge and the government on one side, saying youve got to block this name out . Okay well give you that one. But we have to have this one . Is that the deal . No. It normally would work that the doj was going to take this back like homework. Theyre going to go home and look at the affidavit and think internally about whether they have any justification for redacting. And if they do, they will redact it. And theyll have in their back pocket, the justification for that. Saying this needs to be out because of National Security implications. And preventing of chilling of future witnesses. So they have to justify each line. Theyll bring that to the judge. Then the judge will look at it and see whether or not he thinks the government has been too aggressive here. Even though the department of justice opposed this motion, i think it was probably expecting the judge to do just this and was prepared to go back and really think deeply about what part of this affidavit can be public. Because it, too, has an interest in protecting the legitimacy of this investigation. To a whole group of people looking at this, including house republicans, saying, you know, this is all a witch hunt. You know, the department of justice has been weaponized here. So this is, in a way, a response to that. And the department of justice doesnt have many ways of speaking. This is one of the few ways in which it can respond to those allegations. Lawyers for Judicial Watch who pushed for release, argued it has beenhandle differently. He said it is a main example of why this is different. Something they normally dont do. Are they making a fair point to this . Did the doj unleash the script. There have been so many doors that have been opened. Because i think when Merrick Garland said when he told the public, came forward and said, you know, were going to ask the court to release the actual warrant part. He said, were doing this in part because the subject of this search, the former president has made so many public statements that are just dominated so broadly, that, you know, hes giving us a sort of partial story. And its only, you know, it seems in the public interest, particularly here, where theres so much spin to give more information, rather than less. And i think its probably the same attitude. What is your best guess as far as how soon we can see the public documents . It depends, as your previous guest, marc caputo was saying fthe governments homework is an a plus. If the government comes in and the court says, i agree with all of the redactions, then we could see it that day. Which i think he has a week. But if the court wants to go over it with a finetoothed comb and second guess some of the governments assessments, it could take longer. Okay. Thank you, rebecca. Stay right there. Weisselberg has agreed to testify at the upcoming trial of former President Trumps company. In exchange for testimony, weisselberg will serve only five months in jail on Rikers Island and pay nearly 2 million in taxes. Prosecutors say weisselberg designed and ran a 15year tax scheme that gave himself and other executives, lavish, off thebooks perks. They say the guilty plea was one of the most difficult decisions of the cfos life. In a statement, he said, mr. Weisselberg decided to enter a plea of guilty today to put an end to this case and the years long legal and personal nightmares it has caused for him and his family. Rebecca, you used to work at the d. A. s office. Does five months seem right to you for this cooperation were seeing . You know, it seemed really low to me. It was the wanted sentence prior to the reporting that he was going to cooperate against the organization. But it does seem right to me, given the fact that he is pleading guilty, which, you know, relieves the government of having to prove his guilt beyond a reasonable doubt at trial. And he has the option to cooperate against them. Its hard for us to judge on the outside, until we see what that cooperation is, light rite . But explain this to me. If weisselberg was going to implicate the Trump Organization, how can he do that without implicating the man in charge, the man himself, donald trump. That that is an excellent question. Essentially, once weisselberg admits he has done what he has done, that dooms the company. Because if a high agent within a company commits a crime, and the crime, in turn, benefits the company, which is part of what he said in his plea statement, that is criminal liability for an organization. So how the organization, now that hes cooperating, escapes liability, is very hard to imagine. But that said, your second question is an interesting one. Because he has promised that hes going to testify truthfully. If he gets up there and the prosecution later determines that he was not truthful, they can revoke their promise of, you know, this fivemonth sentence. So the question is, can he testify truthfully and not implicate the former president . Now, i think he can thread that needle. He can thread that needle bay saying, look, i did these crimes. Im a high agent in the company. They were clearly designed to benefit the company, pervasive throughout the company, all of these things that will make it very clear that he was essentially conspiring with the organization to commit these crimes. However, he will have to say that trump somehow was not part of it. He didnt know about it. Hands off. He trusted me. Im a longterm adviser. That may seem implausible to some of us who have heard his statements how he knows what his m. O. Is. But as a legal matter before a jury, its not a crazy defense. Their job is to make sure they can sell that last eight months of supply that are either under construction or not started yet.
