Before this search warrant was unsealed or was reported in the news, it was believed that the search warrant related really just to the taking and the retention of official documents that should instead have gone to the National Archives. With todays disclosures, it serves clear the search warrant was predicated among other things also on the concealment or retention of National Security documents, which carries heavier penalties than, of course, is a much more serious crime. So the agent would have had to sign, to swear to under oath, an affidavit with the factual basises for believing that these documents existed, that they were to be found on the premises, and that they violated several statutes that are listed on the face of the search warrant. And a judge, an independent magistrate judge, agreed with that and issued the warrant. So yes, these are very serious violations that are alleged here the warrant mentioned National Defense information, so what does that tell us about what gave the fbi and the attorney general urgency to act here, and whether they were looking for anything specific . All that we know from the face of the documents that were released from their four corners is that some of the documents relate to National Security. I heard your introduction, i understand the president , former president , some of his allies are already trying preemptively to frame some sort of a defense of, you know, that he declassified them. Whether or not he can wave a magic wand and do so is a significant question, but i think its a red herring in any event. For a number of reasons, including that only one of those statutes relates to National Security violations. The others really are obstruction of an official federal proceeding and just the retention of official documents. But even the National Security statute that is claimed to have been violated doesnt have anything to do necessarily with the classified documents the espionage act was enacted well before the modern classification system came around does this tell you there will be charges not necessarily ill say in my long experience within the department of justice and also defending cases brought by the department of justice, yes, there usually is a near perfect correlation between execution of a search warrant and the bringing of charges. Its the same standard of proof for each its probable cause, and thats it so necessarily, this means that at least a neutral third party found there was probable cause and a grand jury likely would too. However, ordinarily what i would say is that statute is used to charge folks who are actually trying to hide documents or change or alter documents in order to impede a federal investigation. Thats how i charge the statute when i was a prosecutor. Thats how i have seen it in private practice they may be taking a broader reading here, focused primarily on just getting the documents back we dont know, but its very interesting. Theres also been a lot of ink spilled and air time spent on the issue of the espionage act. Tell us how broad that is and what we can actually deduce from that a great question because that is a very broad statute. It does not necessarily mean that the doj thinks that the former president engaged in anything resembling espionage as we usually know it what it means is that they believe that he mishandled and was and had taken and hidden sensitive defense documents, classified documents thats what this is really about. And what we, i think, Going Forward, what we dont know is whether theres even another factor here involving obstruction. We also dont know whether or not they intend to charge or whether their focus was solely on securing the classified material it adds to the computations of how many irons in the fire doj has when it comes to the former president there were questions prior to today as to whether this search could have also involved the january 6th investigation. Can we rule that out now it doesnt appear to be connected to the january 6th investigation. Or investigation of fake electors or anything else. This appears to be focused on this National Security issue regarding these documents. Which ironically, may be a stronger legal case than some of the other legal issues that are surrounding the january 6th committee. And what might he have on the president of france . Thats an excellent question. That maybe is better asked to somebody who has seen the classified material regarding that, but i will just say, it will be very difficult for him to go into my area of expertise, very difficult for him to explain to a jury why he needs to have the folders on the president of france and why he needs to have potential nuclear information, top secret information, when hes no longer president. That was a time that americans thought that perhaps our democracy might be in danger here so what we have heard from President Biden in recent months is that he feels this could be a similar moment so what, mikchmichael, is th valve that releases some of that pressure thats a really good way of putting it i think what the valve is that people feel that our system works. And from President Bidens point of view, hes passed a number of laws in the last week and last number of months that address basic issues of climate and economy and taxes. If people feel that a president is accomplishing something, that will help go a long way. There are those who are casting doubt upon the rule of law, threats against the fbi and the doj.
