Welcome to closing bell. Were here at the New York Stock Exchange, where it looks like another photo finish if history is to be made in the stock market. We know historys about to be made there in vatican city. Right now the dows up 4. 5 points. History being made on several fronts. Im sue herrera. Maria bartiromo will be right back tomorrow. And at any moment, well find who the new pope is. Less than an hour ago, that white smoke billowed high above st. Peters square, signaling the cardinals had chosen the new pontiff. Well keep these dramatic pictures for you throughout the hour, until we see the new pope, learn his identity, the new name that he has chosen. We promise you, you will not miss a thing. And as cnbc, only we can do it here, were also going to stay on top of the days business and market action. An up day so far, and any up day for the dow would mean nine consecutive positive days. That hasnt happened in more than 16 years. It would also mark the seventh straight alltime high for the dow. And remember, yesterday, we didnt know which way we were going to close until moments after the closing bell at 4 00 p. M. Eastern. So stay with us to see if history is made here on wall street. Heres how we stand right now. The Dow Jones Industrial average opened lower this morning, despite the better than expected retail sales figures. The high of the day, we were up 22 points on the industrial average, and now, as we said, we have a gain of about seven points right now. Nasdaq and the s p holding on as well right now. Thats right. Well see whether or not they can pull it out. In todays closing bell exchange, we have cnbc. Coms jeff cox and our own Rick Santelli joining us as well today. And i assume were going to see those gentleman at any moment here. Larry glazer, im going to start with you. You feel this market is priced for perfection right now, is that right . Youre a little nervous. That is right. I am a little bit nervous. I think its healthy to be a little bit nervous. Not only when we look at the vix, not just because we dont see the volume showing conviction and buying in this market, but also, bill, this has been the passover rally. This has been a rally, not just seasonally because of passover, but also it has largely passed over most retail investors. And also, it has passed over large segments of the population, small businesses. So we see, we need to see a different type of to see more conviction in this market. Let me just point something out very quickly, sue. Im just being told we may hear from House Speaker boehner as well. Were in a matrix of news, here, folks, all of a sudden. Speaker boehner at the white house, meeting with the president on the budget issues, as they try to hammer something out, the day after paul ryan came out with his budget blueprint. So we may hear from him as well, in addition finding out who the new pope is. Lets go back to our market discussion. Larry, you heard what ed just said. It sounds like you disagree with that. You think theres some value in this market. Absolutely. I love the way larry put it. The passover rally. But one of the things that larry said is spoton. In terms of technical evaluation, were probably getting up against a resistance level, where we might not see us break through that, so we could start to see the market come back down a little bit in the short run. But you said, not a lot of value. Baa that is exactly the point. There is a lot of value in this market. I actually think stocks are very inexpensive relative to expected earnings. When you look at stock prices, you look at it from a fundamental evaluation or a technical evaluation. Fundamentally, stocks are cheap Interest Rates are low, and theres no reason for this market to pull back, except for technical reasons. If youre just joining us, were waiting for the appearance of the new pope, who we learned during the last hour was elected during the conclave there in vatican city. Were also waiting for House Speaker john boehner to ae merge from the white house after meeting with the president on the budget issues. So welcome to news central here. Jeff cox, despite those stronger than expected retail sales, you still feel that the economic emperor has no clothes. Why. Well, a couple of reasons, bill, one of them being, to add to what larry said before, wheres dr. Copper in all of this . We always look to copper to confirm these kind of rallies and economic growth. Copper prices are sliding down about 10 just over the last month, over 5 over the last month. So thats got me concerned. I will always tell you, yes, on the surface, retail Sales Numbers look very good this morning and the market is not rallying. I will tell you that the day that this bull market rally ends is when it can no longer go up on good news, because thats how it always works. You know, Rick Santelli, can you address the issue of lack of rotation on a large scale out of bonds and into equities, especially when we see historic highs not only in the Dow Jones Industrial average, but in the broaderbased markets as well. You would think that would start that rotation out of bonds, but so far, not in a meaningful way. You know, the reason the parking lot for treasuries or safe harbor securities around the globe like boones remains full, its not because investors are stupid. Investors just have a trust issue. And the more retailminded the investor is, of course, the bigger the trust issue is. You just heard jeff cox. He said, we didnt get a big rally on retail sales. The reason is is because weve had a rally for a lot of other reasons and it gets very hard to divine, are we at 1,456 is because 60 is good economy, 40 is the fed . Theres no way to know. It makes it very difficult to try to ascertain value. But the one thing that i can tell you is that we had a good auction today, immediately dropped close to 2 . So theres a lot of things that treasuries pay just as much attention to as retail sales, auctions are one of them. And today we found investors were so enamored with tens that dealers ended up with about 22 of the auction. Thats a real small amount. Rick, just to elaborate on my point about one second, guys. Ive got to point something out, on the right side of the screen, as we watch that balcony there at st. Peters square, we noticed that the lights went on in that room there, so we are assuming that means this could happen any moment. In fact, were starting to see shadows now, as they get ready to move the curtains, open the door, and bring the new pope out. And as you can imagine, there are crowds, hundreds of thousands gathered in st. Peters square, on a period of time, where it has been raining virtually nonstop all week, in rome. There in the vatican city. But it has not put a damper on those pilgrims, who have made their pilgrimage there, as always happens, when a new pope is to be elected during the conclave. And you know, there was a cheer down here on the floor of the New York Stock Exchange when they saw that white billowing smoke. The new pope will be the 266th pontiff. We think he was elected on the fifth ballot. Thats the speculation, anyway. We certainly dont know that. We saw four black smokes before that. So you would think it would be the fifth, but its a highly secretive process, obviously. And it will be fascinating to see what name the new pope chooses. Let me bring one of the italians on the panel here. Bob pisani, as we wait for the pope, its one of those things where the markets continue to trade, but the traders are keeping an eye on Something Else here, arent they . We may hit nine days in a row on the dow. Hasnt been done in 16 years. I dont know if the pope will put us over the top, but john boehner may put us over the top. Its a trnd thats been going on for a while. Were up 9 on the year on the s p. And generally taking money out of some of those emerging market stocks. Chinas been down a lot recently, concerns about slowing the economy down a little bit, concerns about real estate. If you really want to see something thats very interesting, the china group has been down since the beginning of february. Jeff, by the way, was talking about copper. One of the reasons that copper has been weak is because the Chinese Market hasnt been that strong. And if you just joined us, if you just joined us, bob was mentioning that we may hear from Speaker Boehner, emerging from the white house after meeting with the president on the budget, discussions that are going on. And you know, it could swing both ways. If he says something conciliatory, that would be deemed very positive on wall street. But if he says that theyre not making any progress, that would work the other way. Again, we look at those pictures of the hopefuls, of the pilgrims, of those who have made their way to vatican city to get their first glimpse of the new pope, as hes introduced to the world. And even if youre not a catholic, sue, and you are. Im not, but im a big student of church history, this is a very exciting moment. Its a very emotional moment, being a lifelong catholic, a very devout catholic, its a very emotional moment. And i am fascinated to see what name the new pope takes, when they bring him out there and he makes his blessing to the city and to the world. And i just was very interested at how many people down here responded the same way i did, when i saw that white smoke. And even covering it as a reporter, i was just, i was thrilled. I mentioned that there was more energy when the white smoke appeared, there was more energy on the floor here than there was last week, on the first day that the dow hit its alltime high. That unloved rally that weve been talking about. This is certainly a story thats captivated the world, of course, with the resignation, a couple months ago, of Pope Benedict, as he went off to his retirement. An unprecedented retirement for a pope. And now we wait for word of who this new pope will be. The frontrunners, as we know, the cardinal from milan, the cardinal from brazil, and some time today, weve been hearing the possibility that the cardinal from canada, marc ouellet, might be a compromise candidate to come in here. You wonder, the politics that will be involved. You get a reformer, do you get somebody who represents where the greatest growth in the church is these days, either south america or in africa, or do you get someone who is more traditionalist, the way benedict was, and get the cardinal from milan to step into that position. Given the fractures that are in the church right now, they also need someone who is charismatic, who can reach out and help grow the Church Domestic iicly here in the chur, because people have left the church, they disagree with the church, they disagree obviously strongly with some of the scandals that have occurred in the church in the past. So this is a very crucial choice for the future of the church. And in addition to that, it really has to be a man who can reach out to all parts of the world, to unite and to help grow the church. Because we have only seen growth in emerging markets and latin america. Yes. And of course, talking about charisma, Mary Thompsons with us. Shes been following us all along. There was talk that maybe youd get a cardinal, tim dolan, the head of the new york diocese, who would do that. Oh, are you going to go to boehner guys or are we going to go to the pope . House Speaker Boehner is speaking. Lets keep an eye on the pope on the right. This is going to be tight. Balancing the budget. What do we do to get our economy moving again . Republicans want to balance the budget. The president doesnt. Republicans want to solve our longterm debt problem, the president doesnt. We want to unlock our energy resources, to put more americans back to work, the president doesnt. But having said that, today was a good start. And i hope that these kinds of discussions can continue, even though we have very real differences, our job is to find common ground, to do the work the American People sent us here to do. All right, now we see the new pope, as he emerges, we wait for what youre going to get here first is the cardinal deacon, who is [ speaking latin ] if youre just joining us. We have a new pope. It is the argentinian, the first in history, latin america pope, Jorge Bergoglio and he has chosen name francesco. So theyre going with the Growth Strategy in this case. Looking to a part of the world where there is growth in the church. Fascinating. It really is fascinating. You wonder if this is a compromise candidate. Its not the milanese. Its not the canadian. Even the brazilian they talked about, Mary Thompson standing by there. Shes been covering this us for us. You wonder the think of the cardinals as they go with the argentinian. Reporter a couple of interesting points here. He certainly wasnt among the frontrunners that had been talked about earlier. That being said, he is the first noneuropean pope since 741. The last time there was a noneuropean pope was gregory iii. He was of syria. This is the first noneuropean pope since 741. Just a couple of other tidbits about him. He is a cardinal, of course, hes the archbishop of buenos aires. Hes also older, 76 years old. Hes older than the frontrunners that a number of people were talking about earlier today. Were learn more about him going forward, but again, Jorge Mario Bergoglio is taking the name frances i, himself a reformer about a millennium or so ago. Very important to the changes that we saw in the church when frances of the cici initiated a great deal of changes within the catholic church. Mary, you know, there was some debate early on, basically about whether or not they were going to go with a younger candidate for, who would be the pope for a longer period of time, which would give him the chance to rebuild the church, to grow the church, to set out his mission and complete his mission. Yet the other side of the coin was, that they wanted an older pope that had more pastoral experience, and also, more global experience. So to bills point, i wonder if they compromised a little bit on the age issue, in order to get the growth side of the equation. It could certainly be one of the reasons. Of course, you know, we will see, in the coming hours, im sure well hear more and more about what happened. But heres just a couple of pieces of information. Im struck, im getting some information on him as we go. There is a description of him, saying he is a man of great simplicity, who can often be found walking the streets of buenos aires to meet and talk with his people. In conversation, Cardinal Bergoglio is critical of the political and economic corruption of argentinas elite. So, again, appears to be someone who has a political bent as well, but obviously a very humble bent. One of the other frontrunners, Cardinal Omalley of boston, someone who was named as a possible american pope, maybe a long shot, but again someone who was named or he is of a franciscan order and similar things were said about him. His humbleness was one of the more important traits, and now, we will now come to know this of pope frances i. Once again, the cardinals defy all the media hype, all the expectations, the beliefs that they would need some charismatic figure to lead the church through the beginning stages of the 21st century. Maybe some reforms. Maybe cleaning up the vatican. And in the end, they choose a 76yearold man of humble beginnings, who walks the streets of buenos aires to be the new pope. That may go to the charismatic argument, though. That he can appeal to a wide swath and group of people, and whos used to dealing with people. He is not one of those pontiffs who had been, that did not have pastoral experience, although its not extensive, from what we know. He did have some. Some of the eligible candidates, who we had understood, were more vatican oriented. Had come from the european countries, and did not have as much experience running a church on a local level, which apparently that is very important. We know you tuned in to get business news, you can get it from the ticker there and ill just point out, we are watching a market that is very unchanged right now, after stronger than expected retail Sales Numbers out this morning. The dow is down a point right now. Any positive close will mean that you get a new alltime high for the dow. And there we are getting our first glimpse now, apparently, of the new pope, of frances i, as he prepares to emerge to the balcony. Mary, come on in. Im sorry, mary. Go ahead. Reporter i just wanted to say. He is, i think, as i understand it, hes the only jesuit cardinal to vote in this conclave. Indeed, theres been a reluctance to name jesuits, a society of jesus, to the papal throne, so to speak, but, again, some more on the cardinal. He was known or basically said to be the runnerup to benedict xvi in the last conclave. Really . Thats interesting. Reporter and was supposedly supported by some liberals among the cardinals who wanted a less narrow focus on theological doctrine, and orthodoxy. Again, it was probably thought he was too old, but, again, as you have mentioned, and as we have mentioned, this is a bit of a surprise. He was not one of the cardinals that we expected, again, to be a frontrunner for the papacy. But, again, here he is. There he is. And here we go. A moment we will all remember. The 76yearold cardinal from buenos aires, who offered the traditional blessing of the faithful and, Mary Thompson, i dont speak italian, i dont think you do either, but you dont have to to see a man, the body language showed a man whos already pretty comfortable in his new position. He certainly is. You know, he is also a pope of firsts. Pope francis i, taking the name, im assuming, of st. Francis of assisi. Cardinal bergoglio is from argentina. The first noneuropean pope since 741. Hes also the first jesuit. He has a degree in chemistry. But what hes known for in argentina is basically his very humble ways. He basically does not embrace the trappings that come with being an archbishop, preferring to live simply. But he also has, evidently, a powerful intellect, and he was indeed, according to some, the second runner up to pope ben dick in the last conclave, again, before Pope Benedict was elected. He spoke longer, mary, than previous pontiffs have. And i was a little, at first, when i saw him, he looked very somber, and im sure the weight of the office and the weight of that position must be very heavy on his shoulders. But i really was very pleased to see how relaxed he seemed to be as he responded to the crowd, and how he thought several times, added to his remarks, even though i didnt understand all of them in italian, i picked up a few words. But there was a genuine warmth from him at the end of his address to the people. And i think the words that he chose, lets walk together in the church of rome, i think thats very important for a church around the globe that has felt very fractured. Well, i think the people who gather in that square, thats certainly, those are words that they want to hear. Just to give you a little bit more color about what pope francis said to the crowd, he said, lets pray for each other and the entire world. He said, theres great brotherhood in the world, and now will be fruitful for the eadvantae evangelizization of this entire city, meaning rome. He said, lets start working together and walking together. His words striking a very positive chord among the crowd. He asked them to pray so that god prays for him, and during this time that they responded in kind. He also led them in the lords prayer. The crowd Still Standing there, after about a five tigo eightminute address by the pontiff, to the crowd that has been gathered for well over an hour. We saw the white smoke go up at about 2 06 eastern time today, that was about an hour and a half ago. Mary, great job. Thanks very, very much. Herbalife in the news, moving on news that our own scott wapner announced last night. The National Consumer news urging the fcc to investigate herbalife as a potential pyramid scheme. Ackerman is pleased by this news. For its part, herbalife firing back, telling the journal if anything, persian square should be investigated by the appropriate authorities. Josh, thanks very much. With that information in hand, the very facts some smart investors still hold opposite sides of the herbalife trade. Buy it, hold it, sell it . What do you do with herbalife. On the technical side, its rich ross. On the fundamental side, its herb greenberg, whos been covering this story very extensively all along. Rich, lets talk about the chart first. What do you make of it . Would you buy it here . Ill tell you, bill, as a technician, my job is to separate the stock from the stock chart. This is a stock chart that i want to buy. When we pull up that chart, you see the stock, that 200day moving average, coursing through the chart. Thats been a ceiling for the past year. The stock has lost half its value. But now this symmetrical triangle has taken shape, volatility has contracted. The stock is coiling for a big move up. We think youll break through that 200 day at 45, and hit our measured upside target of 55. You buy it right her. So youd buy it, herb . I guess you would . Well, rich is talking technicals and anything is possible on technicals, with any stock, especially this one. I come back to the bigger issue weve been talking about since we did our documentary, selling the american dream, and that is, you can look at the stock, you can look at the numbers, you can look at all of these things is and none of it really matters until there is some clearance, if there were to be some investigation by any sort of regulat regulator, whether or not this company has some significant issues, as to their business model. But herb, i think that you will agree, that if this is a real stock, then its real cheap. 8 1 2 times forward earnings. We have a peg of 0. 5. And we have a 3 dividend yield. This is a stock, 38 short interest, thats 32 million of 85 million outstanding that need to be bought back. He who sells what isnt his must buy it or goes to prison. What youre talking about is something that could take quite a while to figure out. In between here and there, you may hear at some point that, say, their attorney general investigation, say theres an fcc investigation. Say the fcc decides to get involved, and that just spreads this out. Between, by the way, between here and there, guys like you can have a field day. And i want to point something out. You said something very interesting, which is, the fundamentals of this company do, indeed, generally look good. Thats why when you get beneath the surface, its such a fascinating story. And when you really take the time to look. And ive said this so many times on cnbc. This is a highly nuanced story, requires a ton of research to really even really understand what the issues are. Well, our focus has been on the religious capital of the world with the new pope unveiled, but now were back to the financial capital. Bob pisani, do you think were going to get a new high . The trend is certainly in that direction. Since the beginning of march, were up another 3 , and almost every day, we close right near the highs. In other words, we tend to start low, and for the last eight, nine days, we end near the highs. And a tenth day, in 17 years. Yes, were already transportation is just confirming this. I keep saying, we keep getting singles every day. Theres no big rally that takes us to the new highs. But thats enough for us to keep moving up to new highs every single day spop the data slowly keeping getting better. Overseas, in china, you notice, moneys been out of china. The markets there have been moving down. The markets in the u. S. Have been moving up. And most of the other emerging markets have had a little trouble since the beginning of february. Clearly, everybody believes u. S. Economy slowly getting better. Best place to put money, maybe lighten up on some of the emerging market stocks. Commodity stocks were a little bit on the downside. Here, Home Building stocks, aerobased stocks, u. S. Companies on the upside here. Weve got a ninepoint gain. Any gain, new high. The s p still ten points away. Thats not going to happen here. Well see how it plays out. Obviously, the big openended question is the sequester. Whats going to happen . And also, how are consumers going to react to increased taxes. So were really watching out on all these economic numbers for q2. You also watch that, but im looking up at the transports that are up 102 points. 102 points. Which would confirm the move were seeing to new alltime highs right now on the dow. The only things that concerns me is youre not seeing this explosion in volume at these new highs. Now, the s p hasnt done it yet. Maybe if we get through the s p, all of a sudden therell be this exposure. You dont feel it yet, but that being said, its still making a new high, right . Exactly. At least the dow is. S p is still not. If we get a budget agreement, im really talking pie in the sky here. But they are talking, at least. If we get a budget agreement, that would have to help the market too, i think. And we would probably advise our s p estimate. So what would it take . 10 . You could move it higher. Exactly. Because, ultimately, wed start seeing the earnings and see the multiple expansions. Right now, were still trading at 15, 16 times forward earnings overall for the s p. If we see that resolve, we could see some more multiple expansion and maybe even see 15 by the end. But todays report is a perfect example. Im not really sure of that retail sales number, which blew the roof off the house, at least if you believe it. Everyone thought it would be lower. So to your point, are people getti getting comfortable with taxes . I really think if you talk about the stability in the housing market, people are now, theyre spending money and renovating or updating or redoing their kitchens, because they feel better that the house is not going to get out of value anymore, and at least if they spend the money, theyre going to add to the value.
