Optics of her private meeting this week willon accept whatever investigation about anys make chance of indictments in the clintonsillary private email. The story suggested that lynch would essentially move herself from the case. A firestorm. I was on morning t. V. News talking about this story, and i a word, contacted by a Justice Department official, who suggested that the times story was incorrect in at least one critical respect. This official said that lynch the right torving overrule what the Justice Department prosecutors and f. B. I. Recommended. That the probability of that happening was, according quote, very,ial, very low. And to make things a little more confusing, lynch appeared the aspen ideas festival in colorado where she expressed some regret about her chat with the former president. She also seemed to send mixed about her exact role in the ongoing investigation. Heres lynch suggesting that is like anygation other case and that her role has indeed in fact not changed. As ive always indicated, the matter is being handled by career agents and investigators of justice. Artment theyve had it since the beginning and they are acting independently. Law. Follow the they follow the facts. They will make recommendations thosehow to resolve what facts lead to. The recommendations will be supervisorscareer in the department of justice and in the f. B. I. And by the f. B. I. Director. The commons is process, they present it to me. And i fully expect to accept their recommendations. But when pressed in that conversation, lynch muddied the water a bit more by suggesting that she would defer to prosecutors and f. B. I. Investigators. While i dont have a role in those findings, in coming up or making findings those recommendations as to how to go forward, ill be briefed on it. Be accepting their recommendations. Ill be informed of those findings, as opposed to never reading them or never seeing them. But i will be accepting their recommendations and their plan for going forward. Now, mark, i was sitting next to you on morning t. V. And, of the times reported it. Then you spoke to d. O. J. And well, maybe there is a little wiggle room. Later in the day, no wiggle room. Confused. Is there any wiggle left . The proper way for her to exactlyhis would be what her aide told me. The way she said it, which is defer to the prosecutors, the career people and the f. B. I. , probably do what they do. In her judgment as attorney general, they made the wrong recommendation, to change it. Thats what she wants to do. This cover story about how this is some special plan for this procedure. S standard what shes doing, i think, is caving to the pressure, after the meeting with bill clinton, to pretend and try to have it both ways and say im just gonna recommendations. Its basically, look, she clearly made a mistake, he made a mistake. Look, Nothing Happened in that meeting. Purely social. My role as attorney general is i say. Ve final that is my job. In the overwhelming amount of i will go with my people. I will not interfere. Other case,ke any my role will not change in a 20minute meeting. The attorney general herself this event, on a couple of occasions, if you listen to her acting likehes shes going to rubberstamp this. Thats not her position. Beingk the way its reported by some organizations is ridiculous. She is trying to have it both ways. Shes doing it. But man its confusing and it only is situation. The if she gets a recommendation to indict, i assume shell let it go through. She gets a recommendation not to indict, i assume shell rubberstamp that as well. But at this point, shes leading people to believe that no one is in charge, except the career people, who are not being named. Theres no accountability. It is a problem. That thisstounding went down, the fact that were going to talk about clinton and his brand. Seems to be going off the rails a bit. But the fact that she was in even aseasy position, we talked about earlier, staff to staff. Itsy, president clinton, not appropriate. The judgment is astoundingly bad. If he had showed up in her said i want to come in for a meeting and say hi, i would have said no. I think the airplane confused them. Hearnt surprise you to that donald trump is jumping all over this latest development in the Loretta Lynchhillary story, while speaking at the western conservative summit out in denver this afternoon. The Presumptive Republican president ial nominee suggested clintonsmore to bill conversation with lynch than mere social matters. Thee just happened to be at airport at this time. Think of it. You know, when i first heard the story, i said, no, youre it. Ing, i dont believe i thought somebody was joking. But its not a joke. He really it think he really opened it up. A pandoras box and it shows whats going on. Happeningws whats with our laws and with our government. About golf and grandchildren i love my grandchildren so much. About them for more than nine or ten seconds, you know i love my grandchildren. I love, love, love, that one. And look at the beautiful i kids hese after that, what are you gonna say, right . So its a friday, a holiday weekend. So theres not many people around in the political world. But at the end of this week, meeting between bill clinton and Loretta Lynch, after what Loretta Lynch has done, how much worse off is Hillary Clinton politically, whether theres an indictment or not . This two base. R first, in terms that there are 100someodd days left in the election. One more day to frame her as isrustworthy, as clinton playing footsie, above the law. It still is not going to affect her. Theres no news today about hillary other than, you know what . One more time that clinton is trust wo trustworthy. If shes indicted, its game over. But at the end of the day, to still vote,g what is better for my same way ifthe donald trump said one more stupid mexican comment, that the mexican are attacking us. I think its a little worse do, because if theres no indictment i think both of that. Ect the thing is undermined now. The credibility. She does not get the same kind of health now, because people are going to say theres something messed up about that. Would have said that anyway. But now theres something to to, which is very specific. The meeting. No one is going to be able to prove if you think theres a way to it plays into trumps themes, that the clintons are corrupt, the Barack Obama Administration is corrupt. To pointow a big thing to. Theres now an event that point to thats tangible where they was cooked. Thing im going to go back and say one more thing. I dont think one vote is either way. If you think Hillary Clinton is untrustworthy, one more support point. You what if shes indicted . Completely different story. Why . A felony athats that point. Very different discussion. Heres the thing. Can minimum, it can rev up the Republican Base and thats not nothing. Again, i think it was one day of loss and beyond that, not that much. What does the story tell us about bill clintons ability to help and hurt mrs. Clinton in this campaign . He still has enormous capacity to hurt her. Hes mostly stayed below the radar. I have heard from so many thecrats, baffled, yes, attorney general probably should have barred him from the plane. Its hard to say no to a former wants to get on your plane to say hi. You can psychobabble and try to explanation. An at a minimum it shows he has termsore than a step in of his political judgment. I think hes lost a bunch of steps. You see him, everybody hes talked at he doesnt look as strong. Elderly, frail. He does not have that kind of his eye anymore. Theres something that trump has, the very thing that you dont like about him. Dont know whats coming next. Hes a little devilish. Hes vibrant. That gives him testosterone, power. Right now, clinton, its just gone from the eyes. Were seeing his behavior. And i hate to make age a statements agous but hes seeming like a bit of wacky uncle bill. Going to bee is not bill clinton. Its going to be barack obama. View was that bill wasnt going on this to try to influence the case. Guy. A social you know how many times hes been on a private plane . Im almost certain thats what its about. It points to two things. One, we already mentioned, hes lost a step. For aher, its been true long time. He doesnt travel with David Axelrod or somebody who is going to be thinking every step of the way, what are the politics of what were about to do . In this nonunion restaurant . Hes under a microscope now and that theyre going to think again about fever again of his think about every minute of his schedule. This guy can create a lot of negative news if he does the wrong thing. The greatest politician theoretically over the last 30, a guy who is going through his own legal battles. He hurt her. An unforced error. Its astounding that of ofrse, hillary was a part it. You know hillary was pulling her hair. What is he doing got on the plane. Have done it. The issue is, how does it impact the work that the department of justice does . Acause i think it has cast shadow over what it should not, over what it will not touch. Was the attorney general of the United States, Loretta Lynch, speaking at the aspen earlier today about that meeting with former president bill clinton. To you agree with me that the attorney general is trying to act as ifth ways, shes leaving this solely up to career people and the f. B. I. , but at the same time reserving the right, if she wants to, to overrule it . I am told, according to all of my reporting, that she is saying them. Ll not overrule shes taking herself out of it, and that she has to really appearancere is the of impropriety here. Theres the appearance that the case will be influenced everyoney, even though who knows her and has watched her over two terms as the says that in brooklyn she is absolutely impeccable in her integrity. Unfortunately, what happened on that plane has cast a shadow over it. And the people ive talked to, who are, you know, law professors and ethics experts inappropriatehly and really audacious of the president to have gotten on that plane. All right. I know that there are people at the Justice Department saying that. Suggested today, at times, she was fully out of it. I fullyalso said today, expect to accept their recommendation. And a senior Justice Department official said to me today she reserves the right, with a very it. Probability, to overrule theyre saying that, i think, to give her a little bit of an out. Told definitively that she is not going to take part in this case. Thought in fact, even she says she can take part in decisions leading up to the final decision, that the final the whole ball game. Its whether or not youre going to indict. And that that will be left to prosecutors, that she Uncertain Terms she cannot recommend, if they indictment. That was already going to be a very high threshold, because the appropriate rule of thumb is you dont indict anyone if you dont convict. Can and it would be a real stretch convict jury in d. C. To Hillary Clinton on a case if given howcted, vigorous the argument would be in her defense that she didnt not or that it was mishandling. They have to establish that they mishandled classified information, not intent, by the way. Simply that they mishandled classified information. Ifeven if this airplanegate did not happen, this is not a petraeus situation. This is someone who is running for president. If the department of justice comes forward and says we are her, shes not even in a position to overturn it, because by definition, shes point. D at that first of all, if there is a recommendation to indict, and it, you to overrule think that would be a secret for minute . The f. B. I. Director would have resigned. Such highheld in regard. Our colleague, joe scarborough, has been saying that for a while hes absolutely right. I dont think she had any real option. And the unfortunate part, to the legal experts, is that this is a career herself, until, you know, she took this job. She was known as one of the best business. S in the she has wisdom o that cannot be used in this case. Recusingnot formally herself. Shes just accepting reality. One is this is standard procedure. As you just said, she couldnt possibly overrule a decision not to indict or it leak and hed quit. I will say again the standard to haveuld be for her not done anything. Her hand was forced by bill clinton, right . Exactly. Otherwise, this wouldnt be happening. Wed love you to address what we were talking about, which is, with bill clinton . Well. Thats not whole story. Look, he is the smoozer in chief. Is a man who went up to ted cruz on the tarmac who months he saw the secret Service Details all talk amongst themselves obviously. Theyre going to be notified when someone else is arriving at withame location, people guns, and that theres another detail arriving. They work together. You know what these private strips are like. You know what the plane looked like. One of a bluey and white gulf streams, so it clearly identifiable as someone of cabinet rank. Said, oh, shes coming. The detail. So he waited for her. And then got on board the plane clintondo you think the campaign thinks about what happened this week . Oh, my god. Look at the facts. In cincinnati. I was there. Incredible event. Elizabeth warren literally embracing her. Next tuesday shes going to be forcely riding on air one, im told. Thats not quite decided but riding with the president of the United States possibly and then to a rally and then whatever events they do, in the critical state of north carolina. Man whofriday, the wanted to run and has always sibling rival is going to be embracing her in scranton, place. Th in pennsylvania, which we have just put on the battleground map at nbc into the tossup now. Pennsylvaniar is so important that scranton is the heart of the guntoting, you know, trump trade deal hating constituency. Its not philadelphia. And so that is the best place that joe biden could be with her. And thats the place where her dad was born and where they had a family cabin on a lake when she was a child. Its the perfect week, if they could deal with bernie sanders, completely perfect. But the warren thing kind of obviates that problem to a certain degree. Now shes got this. And the f. B. I. Hanging over her head. Andrea, i talked this morning and you were disagreeing with me my feeling is this is more same. As long as shes not indicted, this is part of the bigger narrative here. Is old news, this a complete nonevent. But you disagree with that . Think that what i was trying to say is that there still is the character issue, the trust issue. She wouldnt have been addressing it in chicago last monday, saying i know some trust me, if she wasnt anticipating another email. The and the deposition this week, her thann closer to anyone, other than the immediate family. And so theres a lot out there. Uncertainty. Of and she has to deal with that and donald trump, at some point, focus and we expect hes going to do some damage. Andrea, in the end, Loretta Lynch, again, i think is ofuggling with the sort mentality of a career prosecutor. But dealing with the highest moment i thinkal shes ever dealt with. Absolutely. Sense of thee any pace of the investigation . Theres all sorts of talk about when her interview is, about left to do. Ve seems to me were getting close enough to the convention and dont doif they something quick, theyre going to have to hold this over until after the election, which is controversy in and of itself. Absolutely. You should know there is some reporting that that f. B. I. Interview is this weekend. At her home. Right. That theyre being very cagey about it. Deadlinee we past the where or when is the deadline where they cant do anything because its too close to election day . I feel like were there. Well, i think that theres another argument for getting it way. F the if its not to indict, even though its going to cause a storm among those who think, you guilty, guilty, said donald trump today. I think in august, they can do something. It gets into september and october, its too close. Back withhat happened weinberger and that whole issue in 1992, when, on the weekend election, the special weinbergerwent after on iran contra, all of that . Yes. So donny, if its true and my reporting matches this, that while some people in trump world, including trump, are christie and gingrich, that others are strongly urging other options, including pence. That say about the state of the search . I think at the very least, a littlets to throw nugget out there for the conservative base and say were talking to him. Guy. Is cruzs number two i still think it comes back to christie. The more i think about it, a, you double down instead of doing a brand extension, which a be, go core brand and say, you know what . Inre pugnacious, outsiders, your face. Its the equivalent of goodlooking two southern guys. So you have one face of the brand. Gingrich would be a devastating mistake. Gets to be good cop. He got an attack dog. In trump does not have to be the mud all the time and act more president ial. The more i think about it, the time goes by, i think christie is the choice. I thought christie for a while. Got the feel of mccains search in 2008 in the following sense. That maybeported theyd move the timetable up and announce it soon, next week, week after. The theyre just now asking mike pence to be vetted and just now pence. With mike this stuff should all be done by now. If theyre expanding the search the dynamic that is big is that trump was fine with the small list. Were saying to him, theres nobody on this list who you should pick. Getting recommendations from rice and haley and other were not being closely looked at. Fullyds someone who as is vetted, who actually is qualified to be president. A good mike pence is choice but hes just meeting with the guy . Yeah. I think theres never been a less important choice for Vice President. Youre either voting for donald trump or youre not. The trump camp, word coming that maybe the person that trump really, really wants kasich. Of course, he thinks he can deliver ohio. What are you hearing . Yes. Beens exactly what weve hearing for a while now. You mentioned pence a little bit earlier. Just doesnt it just doesnt ring right with what weve been hearing from the trump, now for a couple of weeks. As you know, theres one person is gonna ultimately make that decision, and until he does, its a lot of speculation. The folks that trump has been talking to about this, hes had stars in his eyes over kasich, which sort of sounds odd, given their combative relationship on the trail and particularly kasichs reluctance indication that hed even consider the position. Has the experience in washington, which trump has told a qualitycally is that is the top quality hes a vice for in president ial candidate and also high on trumps list is kasichs ability to bring votes in ohio, well, nohat you know republicans won without. Differently,ear kasich has been at the top of the list, from what were hearing. Mike, its funny, because the earliest person i ever talk to about,in trump word early, well before he won the nomination, was kasich. Very was said to be attracted to the notion, for all the reasons you said. Given that, weve come full circle now. Is there any indication that trump himself or any emissary has reached out to try to make the relationship solid enough to even put it in play . Well, we understand that hes tried to go around and tried to get into kasichs world. Shut down at every turn. And kasich himself, as recently ago, is justek refusing to even consider this publicly. Thatmaybe thats something even, you know trump a keyons himself as such negotiator. Maybe trump is even more attracted to that as a negotiating tactic. But by all accounts, the kasich an inchavent given yet. I want to shift gears to the convention. Probably fill up every night with who we think the democrats are going to put up. To see on stage there . That is going to be a very good question. We know some of the entertainment around the trump Trump Convention now, bands like journey we are being brought in. One of the interesting things bands, this those entertainment, is being used to draw donors, to try to bring s into cleveland. Reluctant to come to the convention are being dangled gin upge passes to interest in the convention. Youve got to get journey to up the convention, youve got problems. Journey in cleveland. Thats a problem. Staff departures today, not super senior level people but people who the Trump Campaign just hired. Whats the dynamic where people are coming for a cup of coffee, in the campaign . Growing pains or a systemic problem . What yourt depends on view of the Trump Campaign is. If its something thats only going to begin after the it antion, id call growing pain. But given that were a year into systemic. It seems you mentioned earlier, your question about only being interested in pence now. Aligns withink that some of the problems theyre having on staff, some of the folks who have left recently and of the folks who are there, we understand, have had trouble getting paid. Some lowerlevel staffers, similar to the positions that today, havent heard from their superiors or who they believe are their direct reports if not months. This is not good news for the campaign, whether you believe this is a growing pain or not. Mike, really appreciate it. Thank you, man. On paper, worked on capitol hill. Governor of the state. Strong with conservatives. Pence this late in the process, do you think . Well, from what i have wasned, that pence interested in having this conversation at a time when his be reelected as governor is tight, that this could be something that also the state of india, because we indian, indiana,e know because we know donald trump innched the nomination indiana. Ive learned that pence will be traveling to meet with donald trump. A private meeting, a conversation. And pence was very careful to thursday,esterday, that he had not spoken to the candidate since the primary had happened. So now thats going to change. Campaign does acknowledge that he accepted this invitation. They qualified it, saying this those conversations with national leaders, but it certainly goes more deeply than that. I think pence does offer donald trump the keys to a few key constituencies. Social conservatives, he speaks their language, has credibility there. Way around capitol hill. And he could be that kind of a theson if he were to be running mate and they were to win. Its those kind of things that help. Hes also pretty good on camera, pretty comfortable in his message. Could probably play the role of look strong, reassuring get in the way, in a very contentious campaign. I agree with everything you said, but katie, i dont know time you spent with mike pence, but i know you know him well enough, which is he doesnt seem to me like Donald Trumps kind of guy. Doesnt seem theyre going to chemistry. Of what do you think about that . Well, he adds what he needs, he adds factors that would have people take him seriously in washington. Im sorry. Mic check behind me. Its getting in my ear. Panacheoesnt have the that Newt Gingrich or Chris Christie has. Those are personalities that tends to move closer towards. And thats why they have been so so far on the campaign trail. So mike pence, while he has legislative experience, hes got an ease on camera, a discipline desperatelytrump needs and that he would give him credibility in washington, hes not necessarily the type of that normally gels with donald trump. Were going to see how their meeting goes over the weekend whether they find some Common Ground and are able to move forward together. But pence right now is certainly not high on the donald trump likability list, i guess. Is that a donald trump im going to predict that away from the meeting incredulous. Expecte, what can we from our good friend, mr. Trump today . Verye going to see the disciplined, prompterreading president ial trump or are we off the see him going rails on bill clintons journey on the airplane . Well, we already saw him speak. He finished about a couple of hours ago, an hour and a half or westernere at the conservative summit. There were teleprompters there. Out, he did not use teleprompters. He was reading from notes and he tends to ramble. You can see he wasnt quite as disciplined or concise as he has been. He did go off a little bit on bill clinton meeting with Loretta Lynch. That totallyhing plays into Donald Trumps narrative, that the clintons are themselves and that they are doing a shady back dealings, they are not doing it for the 34er7 american people. When talking about the lynch they said they were talking about golf and their grandkids. Then donald trump went on a bit tangent about how he loved his grandkids but could only 10 seconds,hem for trying to sow the seeds of doubt voters minds that that is all that the two were actually talking about. Kelly in the scheme of things, and youve covered some of these before, is it safe for trump to be casting a ballot for new options this close to the convention . Well, i think one of the perhaps pluses for a figure like is apence is maybe this signal to the social and christian conservatives that thatd trump understands there is a gap there and that he needs to be attentive to the they want to see happen. Part of what weve got to expect bringt trump is trying to people together and quiet some of that delegate soulsearching before the convention. Ultimately, the pick will have to be someone hes comfortable with. Reallye of these names arent that new to us. I think theres a new urgency inside the campaign. Dwindling. And there are big steps, as you know. Thats a vetting process is behind the scenes private. But intrusive and really time in terms of the legal team and those who willingly allow themselves to be vetted. Chance for trump to build these personal relationships that he needs to build on that, with someone like pence, who he has met with privately before but youve got wanted thatt trump endorsement before the indiana primary and he didnt get it. Hard feelings lingering from that . Maybe thats something well be able to measure out of this. Reporting from that meeting was that trump left the meeting with an expectation wouldnt go things the way they did. Kelly is a frequent guest on this program. She has Just Announced today as advisor to donald trump. She is a longtime advisor to mike pence. Extent that the trump command is now discussing the relative merits of pence, theres someone around the table who is a big supporter of mike pence. I think trump would trust kellys advice on that. To weigh in onou the personnel stuff. The departures today. The massive hiring theyre doing, is this just what happens when you try to hire in a hurry, or is there some dysfunction that is potentially a bigger problem . Note. Quick Kevin Mccallum who resigned was a former staffer of gingrichs. Is some crossover. Theres questions about whether he might be going back to gingrich. But sources tell us, nbc news, disagreements more internally about how things were going. That onceved lewandowski left that things would sort of even out in the campaign. That totally has that hasnt entirely happened so far. Missinges seem to be a element in the chain of command, and a missing element in terms directives on a daytoday basis. Thats why you saw these resignations. Mccallum only came on to this Campaign Officially about a week and a half ago. Quicks is a very departure. The campaign is trying to staff up. Thoseey made announcements today. Ive spoken to the r. N. C. And the r. N. C. Says they are working expand their staff and they have been somewhat successful with it. Is not Trump Campaign like any other campaign. And its not one that has an ease of leadership that you would see in what would be a president ial campaign, somebody like mitt romney or president obama or campaign. Ry clintons there is a certain element of unpredictability because the himself is often very unpredictable. Going against his advisors wishes. So its not entirely clear what the daytoday can be inside the campaign. Are hearinghat we led to the resignation of kevin calum. Its embarrassing for the for somebody to quit a week and a half after they started. Kushnerep hearing that has a bigger and bigger role. Expect were going to see a loot more of this chaos. Is that fair to say . Say. Think thats fair to kushner is trusted because hes ivankas husband. The kids are advisors and theyre trying to get their their influence as much as they can, but theyre not seasoned politicians. Know moreothers who about is the daytoday process of campaigning. Paul is one of those people. Weve seen that donald trump is not entirely comfortable with him. Conferences, hes thrown him under the bus, saying misquoted, when he says things that are contrary to what donald trump would say. Lewandowski was so good at, very adamant about not boss, whereashis paul will give interviews and he believes donald trump will be backing off of the muslim ban or says if they female Vice President ial candidate, then it would be pandering. Turning now to the Supreme Court. Big opinions this week on some big cases. Involving such issues as abortion, affirmative action, corruption public and immigration, all just in the last few weeks. Here with us now to talk about the courts sweeping overviews, our Supreme Court reporter. The big, what are lessons about this current 44 53 divide that we see on this court missing a member . Thate of the lessons is Anthony Kennedy is still in charge, at least in a significant portion of cases. He made the difference in the case. On he made the difference in the affirmative action case. In both of those, there were that he might go the other way, based on what he had done in the past, particularly action. Mative he voted to uphold the university of texass admission possibility. Had never before voted to uphold a racebased program. He frankly contradicted things he had said before. Thatficant, but it shows at least for now, he still is a very, very important member of this court. In the cases that are lining for next session, if we dont see a justice confirmed anytime what are the ones where implications to be im of that . Theyre trying to avoid cases like that. If i told you what the best case next term, you might start yawning. Excitingly not a very term. That said, very often what the its best casesdd later in the term. The court could take up the plant. Ower there are certainly plenty of voting issues that the court could take up. You could see a divided court. It could make a huge difference as to whether Merrick Garland is confirmed as the next justice or somebody else joins the court.
