That they were participating in were not participating in this antitrust sort of thing. Its also in a window into how it was operating. The new operating of the company, more open and transparent, that sort of thing. Steve jobs made an appearance through video deposition. He died six months after it was taken. It was controversial, apple tried to keep it out. It was a historic look at the company. What is your reaction to this decision . How much of a victory is it for apple . I think it was an important victory for apple. Whether or not they used commercial practices to exclude competitors so it could corner a market and maintain a monopoly position. The jury apparently found quickly and resoundingly that apple had not done so. I think its a big day for apple. What other legal challenges is apple facing down the line . What else is coming apples way . There was the ebook case that apple lost. It was brought by the United States department of justice after a bench trial. A judge in the Federal District in new york found that apple had coordinated a conspiracy among the Book Publishers to raise and fix the prices for ebooks. In that case, its being appealed to the second circuit. And the employee poaching case in which apple, google, adobe, and a number of others were accused of agreeing with one another not to compete against one another for engineers and other highlevel, hightech employees. This is not the last of their legal challenges. What is next for tim cook . He puts his stamp on the company. A lot of these cases, it was the underdog trying to make its name. It was the Worlds Largest company by market cap. Everything this company does will be under scrutiny. It will be looked at with suspicion by some folks and you see cook out there positioning to try to explain the company a little bit more. Any chance of an appeal in this particular case . I am sure the plaintiffs attorneys are looking for any and every possible angle. If they are wise, they will limit the challenges to their best arguments. If this is a new apple under tim cook, what is your advice in the new era about how to operate . What is right . What is wrong . The hallmark of antitrust liability is when a defendant or group of defendants used commercial practice is to try to hinder the competitors rather than improve their offense. Sometimes they conceal what they are doing rather than address some purported need. They will keep focus on improving their products. That is what antitrust laws are trying to accomplish. What is the very latest . It is really their only direct way to deal with consumers there. They dont have a store in russia so this is the way they really communicate facetoface with consumers. A sign of how tough it is where the ruble is dropping. How important is russia to apples business . Russias shipment last year were 1 globally. Not as big as china but really important as they try to grow in emerging markets such as brazil and russia. These are markets with increasing wealth. Important in that regard, but the bottom line, its not going to be the end of the world. The cfo earlier this year was suggesting the overall currency had headwinds they were facing in the fourth order. How damaging is this to apples business . This is the time when the six plus revealed earlier, this was the Holiday Season and we talked to one analyst saying that if youre going to pull back, you are facing a lot of uncertainty. Tmobile is allowing customers to rollover data. Is the latest marketing push to get subscribers from verizon and at t. They called it data stash and will let customers utilize unused data from prior months up to a year. Its part of the uncarrier strategy that includes phone financing, the removal of contract, and free music streaming. I spoke with john ledger and started by asking why he is making these changes. We are solving customer pain points. It they are not marketing programs. They are fundamental industry changes that are permanent. This is one of the most infuriating gigantic issues that customers have pointed out to me. 40,000 social media messages. At what its about, the paid customers that exist, 110 million of them have teacher phones or unlimited which leaves 120 Million People that have to purchase data. 90 of them have no idea or how much they need. What happens is the penalty of using too much. 1. 5 billion in overage penalties. We do none of that. And the rest of these people, they purchase an average between four gigabytes and five gigabytes of data and at the end of the month, three are unused. Thats about 12 a gigabyte. 15 billion a year. 50 billion a year. Its like if you went to the gas station and filled up your car and at the end of the month, they take back the gas you didnt use. That is why its a big issue. Very important to consumers. Since its the holidays, we will get everyone of our qualifying customers and new customers 10 gigabytes to start. A free gift. So, yes. Its called data stash and its a big deal. You personally need a lot of data because you are on twitter all the time but have you reached the end of the line when it comes to cutting prices . A lot of the uncarrier moves have involved price cuts. Actually, they havent. If you think about the moves, it was no contract. It doesnt have to do with price, its just freedom. Anytime upgrade. A totally different experience. International overages we eliminated, data roaming. I pointed out thats just a pile of money the big carriers were charging that were penalties. Those arent price moves. Music streaming, 70 million free songs a day is not about price. Nor is wifi calling unleashed. Its just changing the way the industry is. This 1. 5 billion dollars of overages, we did not do that. If you can buy five gigabytes of data, it should be yours. Its not all this crap thats going on. Our amount of q3 into q4, you dont hear me whining. Those guys make so much money, its disgusting. Something that youve been talking a lot about is net neutrality. How do you differ from at t and verizon . I prefer to call them moe and larry. As opposed to at t and verizon. Tmobile, we are fully supportive of an open and free internet. And i think, i would assume we all agree on that. The conversation that takes place has more got to do with how. Obviously, anybody thats into innovation is concerned about regulation. I am pretty sure none of us disagree with the free and open internet as a pinnacle component. I expect tmobile to be more on the side of where consumers think on that topic. You sent stockings filled with coal to your competition . That was last years vine video. We are working on this years. I am curious, what is on your christmas list this year . It is pretty clear that if you have to define who has been naughty and who has been nice, im really not on santas list of nice. Im just hoping for a little bit of rest, time with my daughters. Security problems continue to pile up at sony. Exemployees filed suit at Sony Pictures for failing to protect their data, calling the latest breach and epic nightmare best suited to a cinematic thriller. Just the first of what could be many legal headaches for the company. Bloomberg news has learned that sony was warned that hackers infiltrated their network. The hackers were stealing gigabytes of data. Bloomberg news Cyber Security reporter from washington dc, this gets better and better. And worse and worse for sony. What did sony know . They were losing gigabytes of data weekly. Every several days or so, the hackers were taking gigabytes of data through a hole in the network. They ran across a bunch of data that raised concerns. They sent it for analysis. They said theyve got a huge hole in your network and you need to fix it as soon as possible. What we are seeing is a pattern of factors that go back to the 2011 breach. They never got a hold of it in terms of controlling the problem until you get to the point of this latest bridge. Sonyplate playstation was preached by what appears to be a separate group. They were investigating that particular breach. Once they learned all of this data was being stolen so quickly, what did they do and what didnt they do . We dont really have a clear sense of what sony did. They have a culture of problems. They wanted to get a handle on the problems after the 2011 breach. They tried to pass the holes around. What appears to have happened is they didnt go much beyond that. The Homeland Security that was supposed to help them do this left two months before the breach happened. The of people of the personnel, it happened years after the 2011 breach. It never really got a hold on what was happening. Michael, what do you think . What are we going to learn about sony tomorrow . What secrets to they have left . The accounts have taken a tremendous amount of data and they are just trickling it out, taking advantage of the way the media works so that each new deluge of data creates a series of stories. Its probably more effective than if they just let this out at once. It does not show really any signs of stopping. It is really a nightmare. They really do want to do damage for the company and have figured out a very effective way to do it. They are doing a fascinating story. Wonderful job of covering the story. The movie pass ceo and cofounder stacy spikes with us from new york. How exactly is this going to work act oh how did you come up with this particular pricing and structure . Sure. The way it works is we already have a 2d plan in the marketplace. This is a premium product that is one step above the 2d 3d imax, any type of premium. It is layered on top. There is a price point. Who are these people that can go to the movies even three or four times a month and make this worth it to them . The average person that signs up usually goes at least one to two times a month. When you think of oscar season and holidays when people get time off, believe it or not, they can get to the movies pretty often if they want. 40 Million People go to the movies almost every weekend. Nielsen has released data showing younger moviegoers, they are dropping. 15 fewer went to the movies in the first nine months of this year. Are these 12 to 24yearolds really the audience youre targeting . 18 to 34, we are actually attracting the younger demo. They are growing up with subscription models and they like accessbased economies versus a payperview economy. We find that that is more tractive to this service. I was looking at movie pass options near our office. There are, i believe, three different options in the San Francisco area. How does this Partnership Help you expand . Right now in more than 90 of all theaters nationwide including alaska and hawaii, its a pretty substantial footprint. We will increase that even more. Pretty much wherever you are you will be able to go to movies using movie pass. What kind of challenges have you run into when it comes to working with studios in particular . Everyone has been wonderful. Weve had no challenges whatsoever. I think there is an education to anything thats new and different. What is exciting when somebody joins movie pass, they increase their moviegoing by 60 . If you take 18 to 34, increased 16 , you start to get an exciting story. Are your theaters going to be showing the interview . This movie that has caused so many headaches. I assume if it gets shown in theaters that people will be able to go. I assume so. What kind of Customer Service headaches will we see . They know what these companies are in for. The Online Customer service is helping retailers this Holiday Season. Thanks for joining us. I have been remarkably surprised. But i started early. So what are the Biggest Challenges retailers are running into . They are running into so many challenges. Most of the business in the Holiday Season. That if there is one piece of advice i would give, it would be, dont be a scrooge to employees. There is a direct correlation to Employee Satisfaction and Customer Satisfaction. Keep your Customer Service reps happy. Keep them excited. You can see that directly in your Customer Satisfaction data. It is typical things. They dont feel empowered, they dont have transparency. Be proactive in your Customer Service. Put the information out there up front. They can service themselves and thats the best way to help a customer. We help our customers be proactive. We help them fill out knowledge bases, and we help them be super reactive. Whether that be through email, telephone, or through channels. Chat everything. I have done a little shopping in physical Retail Stores and im shocked they are not crowded. Sales online are just so good. What sort of trends are you seeing when it comes to online versus brickandmortar . We know everything is going online. As consumers, we like the convenience of being able to shop and have it delivered the next day. It sets a high bar for anybody that wants to sell. They are doing an amazing job and having an excellent Customer Experience online. It sets a very high bar. The physical shops are nice. It provides a defense experience and we get a real feel for the product we cant get online. The you advise retailers to offer different experiences in stores than online . I went to a store thinking i might get Something Better here but it was worse. I thought, i could sit at home. A lot of businesses has seen the opportunity to give a special experiences in the store. The apple store is a great example. Apple made the physical stores a thing you can do. The expert experience, its a great idea. Thats how we see the future and thats what our customers are telling us. Customer service has to be part of the product experience. They are better than your website. Customer service is right there. You came out with a new book about how you turned a boring idea into big business. I dont think this conversation has been boring. But really, we are talking about Customer Service. What is the main take away here . I am from denmark and came to San Francisco five years ago. Everyone wants to be you. In may, we had almost 50,000 customers a day, almost 800 employees. Its just been fantastic. And building all of this has been such a privilege. How do you do it . How do you sell this idea of improving Customer Service . We all know that we want good relationships. Its very deep and that is what we are seeking for. We want Real Relationships with people around us and businesses around us and the communities we are in. Google news is closing its virtual door in spain today. The shutdown comes ahead of the spanish law requiring Spanish Publishers to charge for every snippet of article that it sees and displays online. Activist spanish newspapers and publicist organization spent months advocating the law and are now opposed to the shutdown fearing it could hurt publishers bottom line. More on the closing of google news in spain, joining from brussels is benoit keane and adam shirk. I will start with you. It is kind of a mess. What went wrong here. Why were the newspapers advocating for this and change their mind . Nothing has really changed. With the newspapers have always looked for is a fair deal from google and google services. They said the publishers said that they did not get a fair deal for what they are providing. All the journalists did a huge amount of work. Google is benefiting from the use of their service. This should be reflected in appropriate copyright law. And the google taxes a total misnomer. What is happening here is the same way that i hope one day something theyre are paying for, publishers are looking for a fair deal. Google has refused to come to the table to negotiate on what price it is willing to pay. It has claimed it would make no money out of the Google News Service and walked away, cutting off these publishers completely from the internet and the global media market. The new law requires publishers to show even the smallest snippet. They show no ads and make no revenue. This approach is simply unsustainable. Google says we dont make money off of google news. Adam, you have done research as to how important google news is. What have you found . How much traffic does it drive to spanish media . Search engine traffic and traffic from google news is still a tremendous opportunity in terms of visibility and overall traffic. On average, anywhere from 20 to 40 of news sites and total traffic coming from search. Within that, its a good 15 or 20 or more coming from google news. The numbers tend to be a little bit smaller. Those Spanish Publishers in the top 10 or 11, they are looking at 5 , 10 , or 15 . What are the implications of this happening in spain . I understand there has been a similar situation going on in germany. Is there a precedent being set here . The publishers obtained it, and the difference between the german act and the spanish act from what i can see is that it was an option for the content holders to provide the content for free. Again, when push came to shove, the german publishers tried to get paid for their valuable journalistic content and were told, if you dont follow the google way, you will be cut off. The result is last october and november, the german publishers caved to googles demands. Although reluctantly. They feared what happened if they did not comply. Youre seeing the situation in spain. Something that we will continue to follow although parliament calls for google to unbundle its services. The headaches not ending in europe anytime soon. What do advertisers tell you about what they want . When it comes to the u. S. Market versus the Chinese Market . When it comes to Companies Like facebook, baidu, and ali baba. The u. S. Is a very mature market. We have really been doing this for a while. Advertisers try new things. Look at facebook and what they did with ads. There are other kinds of ads that google has done. When you look across the world, there are other advertisers emulating this. It grows a lot in china. But still, some interesting things happening in china.
