When the senate comes back on tuesday, having been sworn in yesterday, taking the oath on the constitution to be impartial jurors, we know that Mitch Mcconnell has said he does not want to be impartial. That he will side with the white house and the specific issue that comes up almost immediately is whether there will be witnesses and documents at this trial. Mcconnell is doing his utmost to ensure that no one is heard, that there is no new evidence. But if four of the 53 republicans defy mcconnell, effectively defy the whip, that would produce a majority that would insist witnesses have to be heard, including for example former National Security adviser john bolton, and i think that would add to the drama of the trial and also change the political nature of it. How likely is it that we are going to see witnesses allowed in this, do you think . We dont know. It really comes down to whether that group of senators who have expressed concern, theyve included mitt romney, the 2012 republican nominee, theyve included Lamar Alexander of tennessee, Lisa Murkowski of alaska. Do they actually turn that concern into saying yes . To have a full trial, to have a proper trial . We must hear from the witnesses and i dont think even until that is held, we will know which way these key senators will go. You talked about the oath of impartiality being taken by all senators. How does that work with senators saying, we are going to Vote Along Party Lines . This senators havent actually declared they are going to Vote Along Party Lines. We have had the house which has voted which said, this is where we stand on impeachment, but most senators have said no, the key senator who has said he will not be impartial, in other words, that means nothing, is Mitch Mcconnell. And he was quite blatant about it. He said that in fact he saw his job as working alongside the white house to make sure that donald trump was not convicted and it was done as quickly as possible. And that means that rather than the constitutional requirements of the case, its mcconnells politics which is at the forefront of where we go next. What can they do in that case, in the face of such blatant admission . It comes down to the republicans. In other words, the rules of this trial are not the hard and fast rules we would have in the criminal court that we are used to. It is for senators to make it up for this particular case and although they are supposed to be guided by constitutional principles and practices, unless the republicans actually come out and say to Mitch Mcconnell, this really isnt the way to do things, he gets to effectively wield. He gets to be number one in that trial even if the chiefjusticejohn roberts is the one residing.
