But first, more than 170 mps urged the government to stop a flight deporting 50 people to jamaica on tuesday until the review into the windrush scandal is published. A leaked draft of the windrush review said the government should consider ending the deportation of foreign born offenders who came to the uk as children. I say to the right honourable lady, and im sure that she is aware of this, that under the uk borders act 2007, a deportation order must be made in respect of foreign criminal activity sentences for a period of 12 months or more imprisoned. And therefore every person on this flight has been convicted of a serious offence and received custodial sentences of 12 months or more, which means under the act introduced by the Labour Government in 2007, mrspeaker, a deportation order must be made. At the end of that session, a labour mp rose to ask an urgent question on the matter. To ask the secretary of state as she leaves the chamber if she will make a statement on the suppression of the windrush learned review and its implications for the deportation flight that is to leave the country on wednesday. Will the minister admit that this flight will include people who were entitled to petition for nationality but could not access it because of complicated and expensive nationality procedures, for example one individual in the care system . Mobile access for citizenship only be made affordable and simple . Does he accept that many on this flight have a far stronger connection with britain than jamaica . Again well be clear that we have checked that there is no one on the flight who would be eligible for british citizenship or nationality. And again, we would not be able to deport them if they were. Shrill virtue signalling and faux outrage simply ignore the political and legal realities of this issue. My parents immigrated to the uk in the 1960s from commonwealth countries and they could have been caught up in the windrush issue,
thankfully they were not. But this is an issue for which the government has apologised and for which its taking remedial action. Can the minister confirm british citizenship is a privilege, not a right, and those Foreign National offenders who take. Abuse their time here need to face the full force of the law . The ministers tone and his response to this debate has been quite shameful. My constituent came here from jamaica when he was five years old. All of his family also live here. But he is set to be deported on this flight tomorrow having served a seven month custodial sentence in 2015. Now, given the leaked Lesson Learned review issues, is it not right for the minister and for the home secretary and for the government to actually take stock, hold this flight, just to make sure you do not inflict any further harm because youve made this mistake
previously when people were deported and they ended up dead . Yes, we want to make sure we prevent further harm and thats preventing further harm to future victims of crime that may be committed by the persistent or serious offenders who are on this flight. Parliament in 2007 passed legislation to require the government to deport those who were guilty of serious offences. In the circumstances, were the government not to do it, would my friend agree with the government itself will be liable to expert review equipment the reason for our concerns relate to our expectation that the independent review will say when it is published that those who came to this country as children should not be deported. And this flight should not go ahead before that review is officially published and its recommendations published in full. Surely he can see that that is the only way we will know that we have not deported our own citizens thank you, mr speaker. Again i repeat there is no british citizen on that flight

Now an emergency aid package has been made available by the government for those areas particularly in the north of england which have been hit by severe flooding in the wake of storm ciara. We are investing more than ever before in these defences in a £2. 6 billion programme up to 2021 to manage floods and coastal erosion risk. This will enable better protection of over 300,000 properties. I want to see ministers look afresh now at what can be done now that parliament has declared a climate emergency. A new plan for flooding should recognise the reality of the climate crisis, reverse the cuts to our front line services, invest in comprehensive flood prevention, promote land use change, encourage Habitat Restoration and acknowledge in the funding settlements for councils the higher risk in those areas who face flooding so often. I recognise that some new flood schemes have been delivered, but the list the secretary of state gave out is what she has done, not what she will do in response to this flooding. Will the minister now accept that a comprehensive plan for flooding is now needed . We must get councils clearing culverts and drains of leaves and clearing them out. And also does she agree when it comes to housing developments, we must stop this tarmacing and paving of our green fields which gives no space or no capacity for rain runoff when we have severe storms like these. Calderdale in west yorkshire
was among the areas worst hit. The absolute devastation across calderdale that for so many residents are in the same position again having flooded in 2015 on boxing day. To update the secretary of state, we are looking at 400 properties flooded, 400 businesses, eight schools, two care homes and two bridges which have sustained damage. Leeds in many ways saw a close escape yesterday but there remains a £23 million gap between what the government have committed to flood defences and what is needed to protect us against the floods we experienced just four years ago. Many of my constituents who were flooded over the weekend are some of the same people who were flooded in boxing day 2015, which really is completely unacceptable. Can she assure me that the Flood Defence Programme the government has in place will ensure that my constituents in shipley wont have to suffer
this fate yet again . Well, im afraid there can be no absolute guarantees on flooding. But what i can assure him is the government is determined to press on with its major investment in our flood defences to better protect thousands of homes and businesses across the country and certainly one of the things we will do as a result of whats happened over the weekend is a fresh look to make sure that Everything Possible is being done to keep those flood defence projects on track for delivery. The security minister has given a preview of emergency laws to block the automatic Early Release of convicted terrorists who were believed to pose threats to the public. This government will be introducing emergency legislation in parliament tomorrow. It will end the automatic Early Release of terrorist offenders without there first being a thorough Risk Assessment done by the parole board. Those considered still a threat to Public Safety will be forced to spend the rest of their time in prison. These changes will mean around 50 terrorist prisoners already serving effective sentences will see their automatic release halted. We will not hesitate to take Decisive Action to ensure we do all we can to protect the public and keep our streets safe. Can my right honourable friend update the house on the steps his department is taking to ensure those who are released from prison at the end of terrorism related offences faced the most stringent monitoring and reporting requirements . Absolutely, mr speaker. I am pleased to say to my honourable friend that last week we are considering with the new legislation is requiring additional reassurance when terrorist offenders are released from prison. There are measures available, including stringent conditions to impose licence periods, notification requirements for terrorist offences, which only last year the government has already strengthened. Serious Crime Prevention orders extended to terrorist offenders last year, they provide the police with the strength and powers to manage terrorists along with terrorism prevention and investigation measures. As i say, we will continue to review everything to make sure we do everything we can to keep the public safe. Another talking point at Home Office Questions was the governments proposed New Australia style point based immigration system. I would like to ask the minister to provide some clarification regarding the proposed immigration system it is been called australian styled, but be aware that the australian system is actually a permissive system designed to encourage migration and as a hostile environment rages on, surely this is not what the government aims to do. Raise migration. So will the minister clarify what exactly the system is and confirm if this government will scrap the net migration target, which was dreamt up without evidence and has never once been met. I thank the honourable lady for her question and she will note that the hostile environment as she called it dates back to previous governments. The point of this system, mr speaker, is that we want a simpler, faster, firmer, better system, one that fulfills our promises to the people where we seize that once in a Generation Opportunity to take
back control of our borders and end free movement, which i appreciate members on the opposite side of the house simply do not want. We will restore democratic control over immigration that is effectively what the british people voted for. Mr speaker, its important to remember that it actually was a Labour Government that introduced a points based system but it is also important to remember that many workers that we need in this country cannot come in under an immigration cap of £30,000 and the home secretary has looked into this for some professions. Will she make sure that we look at that to make sure that we get the workers that we need . I think it is important, mr speaker, that there will be immigration legislation that will come forth before this house in due course with regards to the Labour Market and also the skills that this country needs. The decisions made around the points based system will be based upon the needs and the skills that this country requires and i think that is incredibly important so that no member is deceived under that
and recognises that we do need good people with skills that can come to our economy and also skills that can enable and facilitate growth in our economy and also encouraging the best and the brightest to come to this country, notjust from the eu but outside of the eu. The scheme expenditure bill continue to make its way through parliament. No amount of money can repair the suffering some have experienced and the injustice and therefore, this is a vital and important step in righting the wrong. But there still many issues to be addressed. The windrush Compensation Scheme was formally lodged on the 3rd of april 2019. And it was designed to ensure a full and proper compensation to be met. The scheme rightly includes personal
apologies to each person issued with the award of compensation and most importantly, it allows those who suffered to avoid court proceedings. 0n the side of the house, will not be opposing this is a money bill, it is necessary that some legislation be passed to the windrush victims or some portions of them can receive some long overdue compensation. However, inadequate. We do not oppose the payment of compensation, but through our experiences with our own constituents, we are completely opposed to the way this government is going about it and it is shoddy, it is inefficient and it adds insult to injury. The government is examining how it can prevent illegal so called grey charter flights as part of a view of private aviation. The review follows the deaths of the cardiff city footballer sala and his pilot last year. What is the government doing to crack down on grey charter flights . That is a problem in the air industry. They are air taxis and their being used by footballers, by celebrities, by people to bypass the system and to get from a to b with privacy. It is a problem that they are unlicensed, unregulated and they related to clamp down. 0ne lesson comes from this unfortunate tragedy that is we need to be more and more stringent on our people travelling around in unlicensed aircraft. The noble lord is completely right and we share his concerns around grey charters and it is illegal
to operate a commercial flight without an operating licence and without a certificate overseen by the caa. The department for transport as a result of these concerns has commenced an independent review of the safety of general aviation and the work that is undergoing as part of that review is to look at illegal charters and consider what steps can be taken in order to prevent them. Planes from overseas do not need to be reregistered for use in the uk. 0ur Safety Standards are higher than many other countries people who own plaes in britain take advantage of this loophole and i aske the noble lady, the minister, and review that she referred to, will that include looking at the registration of planes kept
in the uk because not only does it potentially cause safety problems, but it also reduces the amount of money to the exchequer. As im sure she is aware, the first report that was issued by the aaib looks at the fact that this was a uk aircraft which is operating between the uk and france and it wouldve been subject to the requirements of the federal Aviation Authority under oversight by the caa. But she raises important points, and i will take and i will take that back to the team to see whether they were included into the review. Emilio sulla had amounts of Carbon Monoxide in his body significantly high to cause unconsciousness. One could infer that the pilot also lost consciousness although his body has not been retrieved. That would suggest that the worthiness of the aircraft was absolutely appalling. What plans are there to make sure that the aircraft taking off
or landing in the uk at any airport has the equivalent of an mot certificate at least .
