Albert bowers and jessie cole also guilty of killing pc harper. This is them leaving their First Court Appearance a month after it happened. Bowers has a number of convictions, including for Sexual Assault and criminal damage. The police said all three made a conscious decision not to assist them with their investigation. During the trial, jurors were given special protection over fears associates of the teenagers had planned to intimidate them. Today pc harpers killers are due to be sentenced. I wonder if you just want to tell me how difficult it is at this moment in time, when one of your colleagues has been killed and your colleagues has been killed and you have been very close and understanding of colleagues of his and his family, as well. Absolutely. It has been a tough 12 months for the Thames Valley police and our collea g u es the Thames Valley police and our colleagues that have both worked with andrew but also the wider police family. It has been really, really tough and that stems from the investigators that have dedicated their time and efforts to try to get justice for the family and their wider police family, as well, and we mustnt forget Andrew Harpers family and especially lissie who has been through an awful lot in the last 12 months. What has support for them and those in the Thames Valley police looked like, what support has been needed . So support has come in a variety of forms and i must pay tribute to the force, who have been absolutely fantastic in supporting andrews colleagues, and all Police Officers that have been affected by this in ourforce. And the federation have also played their role in that, as well, and that continues today and will obviously continues today and will obviously continue well into the future. Lets look in more detail at the Legal Process here and speak to the criminal barrister, kitty colley. Lissie, pc harpers widow, has vowed to carry on fighting on behalf of andrew. What Legal Options are available . First of all, i express it is hard not to have the deepest sympathy for a Police Constable hi pics family and friends but there isa pics family and friends but there is a legal hill to climb to secure a retrial. There is no automatic appeal against a verdict delivered byajury appeal against a verdict delivered by a jury after a trial process and it is extremely rare for a verdict of not guilty to be set aside, whatever the strength of feeling there might be about the process which led thejury there might be about the process which led the jury to reach that decision. In 2003, the law reformed, thatis decision. In 2003, the law reformed, that is that law relating to double jeopardy, legal speak, that really means it is a principle preventing an acquitted person being tried a second time. As i said, the law reformed in 2003 by allowing retrial is in respect of a number of very serious offences and murder is one of them. Previously the law did not allow a person who had been acquitted for an offence to be retried a second time. But the circumstances are a limited and within a very strict Legal Framework. There are only really two possible routes to a retrial. The first is where a retrial can be ordered by the court of appeal and thatis ordered by the court of appeal and that is where an acquittal has been in court, but a fresh and compelling new evidence has subsequently come to light which indicates the acquitted person is in fact guilty. That evidence is deemed to be compelling if it is reliable and substantial and highly proves the prosecutions case that is indicative of guilt. It must be in the interest of guilt. It must be in the interest of justice to try that of guilt. It must be in the interest ofjustice to try that person again. Considerations would be given for example to whether that person can have a fair trial, particularly releva nt have a fair trial, particularly relevant in cases where there has been a lot of adverse publicity. This provision has been typically but rarely used in cases for example where a new evidence might include dna orfingerprint tests where a new evidence might include dna or fingerprint tests which link a person to a particular serious crime like murder, for example. Can i check one thing with you . His widow, lissie, has written a letter to the Prime Minister and as it stands some 300,000 people have signed a petition to have the verdict overturned. What is the releva nce verdict overturned. What is the relevance of that . Well, the government has no right to order a retrial and the government is separate from the independent judiciary and cannot of itself order a retrial and it will not override, im afraid, the legal principles that underpin any application to the court of appeal or indeed the high court of appeal or indeed the high court in this strict Legal Framework which would allow for a retrial to ta ke which would allow for a retrial to take place. Other examples have been where, for example, confession is made by an acquitted person subsequent to that trial and is allowed as fresh evidence. The second route available would be for the high court to order a retrial, where an acquittal is whats called tainted because of intimidation or interference with a witness or a juror. That is application by the prosecution and has been law since 1997. For that to happen, that person, that is the person who has intimidated or interfered with a juror or a witness, would have to be convicted of that offence and it also has to be shown that that intimidation or interference showed a real possibility that the jury we re a real possibility that the jury were in fact influenced by that. So there is a cause and effect. It is not automatic just because there is a cause and effect. It is not automaticjust because there has been interference or shown to be interference that there would have been a different verdict. There has to bea been a different verdict. More than four Million People across Northern England have been told to comply with new lockdown rules because of a rising number of coronavirus cases. Lets discuss this in more detail with the Health Secretary matt hancock, who joins us from our london newsroom. Matt hancock, thank you very much for your time. We have been explaining throughout the programme who is affected and how many are affected. Can you tell us how you came to this decision . What is the process involved for you to make that announcement yesterday evening . Did morning. We have been looking at the rate of transmission, the number of new cases right across the country and we had been working with parts of lancashire, West Yorkshire and Greater Manchester over the last few weeks. We had talked on this programme about the measures that had been taken, for instance in blackburn, in bradford and in oldham. It is increasingly clear that the rate of transmission, the number of new cases was going up and not just number of new cases was going up and notjust in their specific areas that we had been working with, but across the board in the areas affected. And the other piece of information that we found is that most of the transmission was happening between households visiting each other and people visiting each other and people visiting relatives and friends and so we had taken this action which i appreciate is very significant for those involved but it is more targeted than the previous action that we tick bite across the board because it is specifically about saying to people, unfortunately that they cannot meet another household indoors or in the garden in order to try to control the spread of the virus. We took right across. It was very virus. We took right across. It was very much in response to the data. Our whole approach is to keep people safe and keep the virus down while allowing as much freedom as possible. So we have not put in restrictions on travel or on work but we are taking this action as we sat out last night. We will go through in some detail some specifics. As we set out. When you say this is based on households visiting each other, relatives and family and friends, how do you know that . We know that from the Contact Tracing information. Whenever someone tests positive, the vast majority of them we managed to speak to. We ask who they had been in contact with and that has shown the vast majority of people who have the virus are from people, other than people in their own household, of course, who have to sell isolate anyway, is from households visiting and then visiting friends and relatives. Those are bigger than the number of contacts that people have say at work or visiting shops and that means because we have that information from the nhs test and trace system, it means we are able to ta ke trace system, it means we are able to take this action which is more targeted at controlling the spread of the virus. I totally understand the impact that it has and, in a way, one of the terrible things about this virus is that it thrives on the sort of social contact that makes life worth living. That is a serious problem with the virus but we are able to make this more targeted intervention. Isay targeted, it is obviously over quite a wide area and it has a big impact on people involved. Some of the questions coming in are, why can you then meet to matter if i cannot meet friends and family in my garden, for example, why can i see friends or family ina example, why can i see friends or family in a pub . You can go to the pub with members of your own household. It is inevitable that when people do go to the pub, even if you are a household, there will be another household you have arranged to see. They will be there, socially distance. Meeting someone from another household in hospitality or a restaurant is against the guidance, for exactly the reason i set out. You can go to a resta u ra nt the reason i set out. You can go to a restaurant or pub with people in your own household all the support bubble of where people have a support bubble with a single household. Is all a support bubble. It is about trying to stop the spread of one household to another which is at the heart of the increase we have seen across this area. We have said two households can meet at a social distance in a public place outdoors because evidence is outdoor transmission is much lower. So a pub garden is fine . An outdoor public place is fine, so, like a park, for instance. What about a pub garden . Not in hospitality, no. In parks there is much more space. That is interesting. We have been reporting it could be the hottest day of the year to date is that you are familiar with the pictures we have shown, the media has shown of bournemouth a few months ago when it was really warm. Today potentially crowds gathering again. How is that deemed ok when you cannot have someone that perhaps you trust sitting in your garden with you . One of the sad things about the virus is that it does tend to spread from household to household, from close contact. And so, even if it is somebody that you trust, people get this virus and can spread it before they know they have it. U nfortu nately, they know they have it. Unfortunately, that is one of the ways in which it spreads. We know that being outside is safer than inside and so, for instance, people going to the park where there is more space and where you can socially distance, that is one of the lower risk places where households can meet up. They should still stay socially distance. In a way there is a broader message for all of us that the socially distancing rules are here for a reason and it is because we want to keep the virus down and stop the spread of it. It is so important that people follow the social distancing rules. I know they have been down for a long time and i know that people are yearning to see others but these rules are important because they help to stop the spread of the virus and keep us all safe. You have made that clear. In one of your tweets, you said, the reason for this lockdown, this localised lockdown, is due to household gathering. We have discussed that here. And not abiding by social distancing rules. Yes. If, to take see parks in these areas where people are not abiding by social distancing rules, and that is a possibility, a very real possibility, a very real possibility, what is the next step . Dashif possibility, what is the next step . Dash if uc parks. If uc parks. do not want to have to take any further steps. Meeting at a social distance in parks is ok. We saw for instance, a few weeks ago. That is not what i was asking. Socially distancing is ok, that is what we have been told to do. He said because people had not been abiding by socially distancing rules. What is the next step . I will give you an example. Paul has said, isnt it necessary to take these doesnt then need to take these actions finally that the government has naively and dangerously over estimated that common sense of the english people . A lot of sacrifice brought rates down. Firm and clear rules are needed. One of the good things about this terrible epidemic is that people have, on the whole, very largely, followed social distancing rules. My message is that people need to keep doing that. We need to do that right across
