Reports are that he watched it those reports are that he watched it on television thought it was kind of cool to watch it and did not actually call for in and to the violence when he should have . That is another thing, and thirdly, tim, they will also be i am sure looking at the statements made by some. And i think we are now beginning to see the procession starts. Well done, barbara. Just talk us through. This is the start come as you say, did ceremonial procession for some some of the characters there. Democrat from maryland is going to be the lead impeachment manager. And presumably he is the one announcing the terms of the one announcing the terms of the impeachment to the senate. The procession youre seeing now is led by the sergeant in arms and the house clerk. Jamie raskin close behind. As well as the other impeachment managers who will serve as prosecuted. Yes, he is the one who will be reading the impeachment articles once they get to the senate. . ,. , . , senate. And professor, im not sure if you senate. But there are some of course who say that this might actually make politics even more toxic at a moment when there is such a Great Division. When there is such a Great Division division. Yes. I hear that argument division. Yes. I hear that argument but division. Yes. I hear that argument but its division. Yes. I hear that argument but its reallyl division. Yes. After november four that joe biden won the election and there joe biden won the election and there werent many members of there werent many members of the Republican Caucus that

It wasntjust that mr trump wasnt just that mr trump didnt wasntjust that mr trump didnt call for the end of violence but i live right outside washington and have seen outside washington and have seen many protests. And to watch seen many protests. And to watch on seen many protests. And to watch on television hours go by, hours watch on television hours go by, hours go by without a serious by, hours go by without a Serious Police presence was just Serious Police presence was just stunning. Because even on a regular just stunning. Because even on a regular day the security at the capital is quite tight. Theres the capital is quite tight. Theres a lot of questions as to how theres a lot of questions as to howjanuary six happened under to howjanuary six happened under donald trump to watch. And whether he was complicit, how much and whether he was complicit, how much he was complicit in. Because how much he was complicit in. Because it how much he was complicit in. Because it was such a spectacular breakdown of security with the United States congress crouching under their chairs, congress crouching under their chairs, hoping to make it through chairs, hoping to make it through the evening with their lives through the evening with their iives its through the evening with their lives. Its really astonishing. So given lives. Its really astonishing. The lead impeachment managerfor lead impeachment manager for the lead impeachment managerfor the house of representatives democrat from maryland reading a much longer charge than had been anticipated. We understood, my understanding was his was going to be on one simple charge of incitement to
insurrection. Barbara who is been watching and following all the developments there also watching with us professor kimberly wehle. Thank you for staying with us. Barbara, just your thoughts about that and indeed the detail with which jamie raskin went into the charge. Jamie raskin went into the charae. Jamie raskin went into the charae. ,. , jamie raskin went into the charae. ,. ,. , charge. Yes, that is the charge that we were charge. Yes, that is the charge that we were expecting. Charge. Yes, that is the charge that we were expecting. It charge. Yes, that is the charge that we were expecting. It is i that we were expecting. It is one charge, insurrection or incitement i should say to violence against the government. But he does not just the events on capitol hill the charge sites. It does do so. It says that his comments in the contacts at the time serve to encourage and spur lawlessness amongst his followers. It also talks about mr Trumps Campaign to mrTrumps Campaign to undermine the Election Results saying that they were fraudulent. Which he did over many weeks. And it mentions a particular incident in which he called up the secretary of
state of georgia and asked them to try to find votes to overturn the election in georgia. Which is an example that the managers are saying of him trying to subvert the election. There is one charge and the rest of it that you heard was the way that they came to the conclusion that this charge should be made. They are walking now back to the senate to the house of representatives. In the senate, very few republicans for this reading of the charge. Notably Mitch Mcconnell was there. Hes the top republican. Also mitt romney who you might remember did, the only republican who voted to impeach last time. He hasnt said is going to do at this time but he has kept open to the possibility. So that short ceremony is over and they are now heading back to the house of representatives. Professor wehle. The prosecution outlining its case, these senators, this jury,
prosecution outlining its case, these senators, thisjury, the trial takes place there. What are the chances do you think of getting the two thirds majority needs to push through it with impeachment the second time . Thats really hard to say. At this thats really hard to say. At this moment it looks quite unlikely this moment it looks quite unlikely of course. Tenant republicans actually voted to impeach. The impeachment process impeach. The impeachment process is the equivalent of like process is the equivalent of like a process is the equivalent of like a grandjury process is the equivalent of like a grand jury indictment. In like a grand jury indictment. In these like a grand jury indictment. In these senators are the jurors in these senators are the jurors. But watching a represented raskin a couple of things represented raskin a couple of thingsjumped out at me, one is the last thingsjumped out at me, one is the last impeachment, the art equipment was wait a minute what equipment was wait a minute what happened with ukraine wasnt what happened with ukraine wasnt bribery so it doesnt count wasnt bribery so it doesnt count for wasnt bribery so it doesnt count for removal. Here are representative raskin mentioned both the representative raskin mentioned both the 14th amendment ban on insurrection and the take care clause insurrection and the take care clause. There are two parts of the constitution itself that they the constitution itself that they are claiming he violated. The second argument was that we have an the second argument was that we have an election coming and the election have an election coming and the election is have an election coming and the election is how we decide whether president s should stay or go whether president s should stay or go. And of course we sought
their or go. And of course we sought their second impeachment about their second impeachment about the legitimacy or the false claims the legitimacy or the false claims of illegitimacy around those claims of illegitimacy around those elections. When i look at this and those elections. When i look at this and i those elections. When i look at this and i see, i envision the actual this and i see, i envision the actual trial. This and i see, i envision the actualtrial. I this and i see, i envision the actual trial. I think there will actual trial. I think there will be actual trial. I think there will be witnesses. Raskin is a tawyer~ will be witnesses. Raskin is a lawyer. They will call witnesses and they will have documents. Now Mitch Mcconnell cant block that. This puts republicans in a very uncomfortable position to vote against uncomfortable position to vote against the sword, a band for future against the sword, a band for future office. There arent any facts future office. There arent any facts to future office. There arent any facts to support that position. There facts to support that position. There is facts to support that position. There is no law to support this position there is no law to support this position for top and there isnt position for top and there isnt this position for top and there isnt this kind of procedural argument that way, we should ust argument that way, we should just let argument that way, we should just iet it argument that way, we should just let it resolve the election. A result reaction in favour election. A result reaction in favour of election. A result reaction in favour ofjoe biden. And many republicans still took the position that biden was an illegitimate president notwithstanding widespread facts notwithstanding widespread facts and certifications from all 50 facts and certifications from all 50 states. Its, it will be very all 50 states. Its, it will be very interesting politically how very interesting politically how they can actually come out when how they can actually come out when they have to vote on it,
how when they have to vote on it, how they when they have to vote on it, how they can stand and excuse a vote how they can stand and excuse a vote for how they can stand and excuse a vote for not how they can stand and excuse a vote for not keeping him out of the presidency in 2025. The presidency in 2025. Yeah and 75 million the presidency in 2025. Yeah and 75 million republicans i and 75 million republicans voted for him in the last election. People forget of course because that was a huge number. In terms of witnesses, wouldnt potentially be donald trump who was called as well or his lawyer would just be for him . I his lawyer would ust be for him . ~. His lawyer would ust be for him . ~ him . I think as your correspondent him . I think as your correspondent indicated they are three aspects of this. One is what are three aspects of this. One is what actually happened was that we is what actually happened was that we all saw with her what happened on the day. But the real question is Donald Trumps culpability. There are three pieces culpability. There are three pieces of that. One is what did he know pieces of that. One is what did he know going up to the six . And he know going up to the six . And we he know going up to the six . And we are hearing more and more and we are hearing more and more this and we are hearing more and more this drip, drip, drip of intelligence at the fbi worn the day intelligence at the fbi worn the day before that there werent the day before that there werent members of congress that wanted reinforcements. Law enforcement and were denied in advance enforcement and were denied in advance from the department of
defence advance from the department of defence without larry hogan, government of maryland asked to have the government of maryland asked to have the National Guard of maryland go to the capital and was told maryland go to the capital and was told no bite Donald Trumps hand picked secretary of hand picked secretary of defence hand picked secretary of defence without remember, he let go defence without remember, he let go the acting one in december and what this person in. December and what this person in which december and what this person in. Which at the time seem realty in. Which at the time seem really odd because he was a lame really odd because he was a lame duck president. Then there will be lame duck president. Then there will be what happened afterward late night afterwards . What was his frame, state of mind . He did come his frame, state of mind . He did come out and have hardly said did come out and have hardly said go did come out and have hardly said go home. But he didnt use the ievers said go home. But he didnt use the levers of authority he has for the the levers of authority he has for the military and Law Enforcement to protect the lockdown the capital in that moment. I think its the whole story moment. I think its the whole story. Frankly, we dont know whats story. Frankly, we dont know whats going to happen between now and whats going to happen between now and that. The fbi is rounding up lower level defendant and charging them. Of course. Defendant and charging them. Of course, some of these people that course, some of these people that were course, some of these people that were of former Trump Supporters as they listen, we did this supporters as they listen, we did this because the president asked did this because the president asked us did this because the president asked us to. So there are at least asked us to. So there are at least from some of the insurrections point of view
yes. Insurrections point of view yes. He insurrections point of view yes, he did insight because that yes, he did insight because that was yes, he did insight because that was my understanding. The way prosecutors build their cases way prosecutors build their cases they get criminal defendants and lower rungs to sort of defendants and lower rungs to sort of testify or offer evidence in exchange for a lesser evidence in exchange for a lesser sentence. My guess is the fbi lesser sentence. My guess is the fbi and the members of the house. Mr biden hasjust spoken and he said he thinks impeachment has to happen or the trial has to happen but he said he doesnt think 17
republican senators will vote to convict trump. There is that scepticism already. Which i think has been widely echoed in other reports as well. It is different than the first impeachment in that you do have in the house tent republicans voting for impeachment. You do have senators not lining up strictly behind mr trump as they did before. As we know jurors are politicians. And they are looking at the political landscape. And the grassroots of the party is very strongly behind mr trump. And there has been action taken or at least talked about in the grass roots officials in the states to punish those who voted for impeachment. They have their eye very firmly on that. Threats are being challenged. In the primaries for example, threats of censure votes and that sort of thing. The question is, many of them may want to step back from mr trump and what he means for the party and what his grip on the party and what his grip on the
party is. But voting for impeachment might not do that. It might split the party instead. I think thats the concern. And they might suffer politically. That is all something that they have to think about as they decide how they are going to vote. One of they are going to vote. One of the approaches has been to talk about the procedure rather than the substance. More and more we are hearing from republican senators that its unconstitutional to try a president after hes no longer in office. Carefully spoke to that earlier, there are legal arguments on both sides. Although the weight of opinion is that it is constitutional. The constitution doesnt actually direct addresses directly from that that is one way for republicans to take a more procedural objection to attach and then substantively. You mentioned before thejurors are witnesses. The they were there during the attack on the capitol building. It was very traumatic them. An actual fact, some of the republicans are voting in the house said they didnt know if mr trump had
legally incited the mob. But what they thought was that he had not called it off. And that was enough for a couple of them at least one i remember it maybe two to say i had to vote for vote for impeachment for that reason. I think that will also be a big part of the evidence that the democrats bring. Evidence that the democrats brini. ,. , evidence that the democrats brini. , bring. And isnt there a danger that that sort of detracts from the whole impeachment process . Because its not going to actually have any effect. Itjust going to be played out publicly as some sort of performance rather than actually bringing about any sort of, legal change. First, im not sure sort of, legal change.
