Welcome to bbc Newsroom Live. Builders could be banned from selling new houses as Leasehold Properties in england under proposals put forward by the government today. It comes after it emerged some Housing Developers have been selling the leasehold on to Investment Firms without always telling homeowners, leading to extra costs or rising charges. The government says there is a particular problem in the North West Of England where houses were being sold on leasehold although its not clear why. The communities secretary, sajid javid, has said enough is enough as he set out how he plans to tackle the issue. I think everyone understands when you buy a flat for example why its sold, these shared Common Spaces but were talking about houses that are being sold, thousands of them for no good reason and then once they are sold, the people that have purchased them are exposed to these ever increasing ground rents, it is not acceptable, its wrong, enough is enough. Were taking action. What support do you hope to be able to provide for those who are in a situation where they are trapped in a house they cant sell because of this . There are already cases, some Million People that have bought houses under those terms, we want to see through this consultation what we can do to help them, one thing that is already happening from the industry is that those responsible developers are already taking action and seeing what they can do but i want to go further, so we have ideas around improving their rights of redress, making sure they have more Consumer Protection but i also want to hear other peoples ideas. I dont have all the answers to this. Its a complex issue. There are people out there, particularly some of the people in these situations and i want to hear from them what they think we can do to really help them. Mps have described leaseholds as the ppi of the House Building industry. Some of the examples the government cited included a Homeowner Being charged £1,500 by the freeholding company to make a small change to their family home, a family home which is now impossible to sell because the ground rent is expected to hit £10,000 a year by 2060, and a homeowner who was told buying the lease would cost £2,000 but the bill came to £a0,000. According to the figures there are some 4 Million People living in properties where they own the least but not the freehold. The majority are in flats but at least a third of them are in houses, which is why the government wa nts to houses, which is why the government wants to do something about this and as we heard from those examples, it can be costly because when you buy a lease, you are buying the right to occu py lease, you are buying the right to occupy that lease, you are buying the right to t lease, you are buying the right to occupy that property for a set amount of time, 99 years to i99 yea rs. Amount of time, 99 years to i99 years. With a freehold, you dont own the ground the property is built on, and in blocks of flats that can be convenient because one company owns the land and individual people in the flats and the least to each flat, with a house, if you dont own the land on which the house is built, that leaves you open to whoever does own it putting up the ground rent. If you look at the least, it can be built in so it progressively goes up year on year oi progressively goes up year on year or decade on decade, but even simple modifications, the freeholder can say to anyone who owns the lease, go ahead and make those changes but you need permission to do that and we will charge you. I know people who live in Leasehold Houses who were told they were not allowed to put oui told they were not allowed to put our Satellite Tv Dish on their roofs because that was not what they wa nted because that was not what they wanted for the area, so this is why the government is trying to do something about it because of these costs a nd something about it because of these costs and restrictions. It can also be a problem if you come to sell the house because it can be a problem assigning the lease to somebody else and the freeholder can charge whatever they like for you to sell on the property. What about people who are in these situations . Sajid javid said they are looking at measures to help people who are in this situation as well as banning this situation as well as banning this practice. An number of House Builders have set up compensation schemes and he was going to look into ways people could seek redress from solicitors who did not spot the clause when they were going through the Conveyancing Process , going through the Conveyancing Process, and he said when you buy something you should be able to assume it belongs to you, you dont buy sausages only for the butcher to send you an annual invoice, you dont buy a bucket and spade and then be transferred at transfer of Ownership Rates when you hand it to your kids, so he said if you buy something you have the right to assume you own it. Listening to that is dudleyjoiner, the managing director of the leaseholder association, which represents owners of leasehold flats. We heard the government saying when you buy something you think it is yours. As the Secretary Of State has stressed the road, this focus is on Leasehold Houses, who sit on their own freehold land and there is no justification for selling them leasehold. With flats, as you point out they have to be sold leasehold because individual owners cannot collectively or individually owned the land it sits on, but the point i wa nt to the land it sits on, but the point i want to make here is that you dont buy a property, a house like you buy a loaf of bread. There is a process you go through that involves the person who was selling you the property, the developer or estate agent, who have responsibilities under Consumer Rights legislation because leases are consumer contracts, and then in the legal buying process, you have a solicitor ora buying process, you have a solicitor or a professional conveyancer who has advised you about the purchase, so questions have to be asked here, what has gone wrong with this process . What has gone wrong with this process . How wizard these individuals have got into this situation, find themselves owning a property with all these draconian clauses in leases which now prevent them from selling that property on . Do they have claims back against solicitors or the estate agent for not being transparent when they bought the property . And you are clear there have been abuses of the system . Clear there have been abuses of the system . Absolutely, the whole idea of leasehold if it is a 999 year lease and has a Peppercorn Rent or a small ground rent, no one would criticise that but what is happening here is that the lease terms are reduced down to 99 years, the annual ground rents are draconian, they are doubling every ten years or more so instead of paying hundreds of pounds you end up paying thousands and that cannot be right. So the government Planning A Ban on leasehold is on new build houses, what is your view on that . I think if that is the only way of curbing these abuses, then maybe that has to be necessary. It isa maybe that has to be necessary. It is a shame that the industry itself cannot discipline itself to prevent these practices without there being a formal ban but if thats what it ta kes, a formal ban but if thats what it takes, that is what it takes. It comes after they ended their legal battle to take him to the United States for treatment. In a statement, Great 0rmond Street Hospital, where charlie is on life support, said they recognised the agony, desolation and bravery of their decision. Caroline rigby reports. This photograph of charlie gard was released by his parents last night, just hours after they told the courts they now accepted their son should be allowed to die. Their fight to send charlie to the us For Experimental Treatment is over. Our son is an absolute warrior, and we could not be prouder of him, and we will miss him terribly. His body, Heart And Soul may soon be gone, but his spirit will live on for eternity, and he will make a difference to peoples lives for years to come. We will make sure of that. Charlie has been in Intensive Care since october. He has a rare inherited condition mitochondrial depletion syndrome. It means he cannot move, feed or breathe unaided. Charlies parents had wanted to send him for therapy in america, butjudges ruled he should be allowed to die after Great 0rmond Street Hospital argued the treatment was futile. The case came back to court when this american neurologist, michio hirano, claimed new evidence that his treatment could help. But that doctor has now told them its too late to treat charlie. A whole lot of time has been wasted. We are now injuly, and our poor boy has been left to just lie in hospitalfor months. Great 0rmond street insist earlier treatment would not have saved him. The hospital have praised the courage of his parents, saying the agony, desolation and bravery of their decision has humbled all who work there. His parents will now spend charlies last few days by his side. 0ur correspondent lisa hampele has been following the case and joins me now. What do we expect to happen next . His parents say they want to spend the maximum amount of time they can at his bedside. They have been doing this since last october, rushing out of court after each court case and going back to his bedside because each time they have been concerned that the court will decide he will have to go on to Palliative Care and that has happened. He went in two great 0rmond st hospital last 0ctober, he would have had his first birthday on the 4th Of August and we expect him to be moved to Palliative Care, his ventilation will be turned off, it is unlikely that will happen quickly, the staff will nurse his pa rents quickly, the staff will nurse his parents through this process. They did want to take him home and we dont know what will happen with that. A detailed statement from the hospital, talked us through that. Great 0rmond Street Hospital released a statement and they say the american doctor, they are accusing him of giving the parents false hope. He is the dot doctor at the beginning of this case, the doctor went to a small group of International Experts around the world and asked what they thought, each one came and examined charlie and said they didnt think this experimental therapy would work at the american therapist, professor who was also world renowned, said he thought he could help and that is why they wanted to take to america. He gave evidence to the initial hearing, to the European Court of human rights, to the Supreme Court and then we had this latest hearing because the parents said there was no evidence to say that he thought he could help charlie. Great 0rmond street have said that it was with increasing surprise and disappointment that they listen to his evidence in court. He had not only not visited a hospital and examined charlie, he had also not read charlies contemporaneous medical records were reviewed his Brain Imaging or read second opinions from the other experts who had examined him and he hadnt even read thejudges ruling in april, so the Hospital Site they are concerned to hear the professor in the witness box saying that he retains a financial interest in some of the treatment compounds he proposed to give charlie, so they say it is hoped that those like the professor who have provided opinions that have so sustained charlies parents, their hopes and thus protracted litigation with its many consequences, will also find much upon which they reflect. We havent got a response yet from the doctor and he is a world renowned expert but this is the statement from great 0rmond street. Thank you, lisa. What we need to do is make sure people are cared for in the right place for them, that may mean we need more beds in the care sector, we need to Work Together to look at that so people who do not need to be in an expensive hospital bed are in a less expensive but good place for a less expensive but good place for a dent in a care home when that is appropriate for their needs. The independent Police ComplaintsCommission Found there we re Complaints Commission found there were six Fatal Police Shootings, the highest in 12 years. Lets talk to our home affairs correspondent, danny shaw. Talk us through these figures. These are Fatal Police Shootings in england and wales, the figure was six at the end of march and that is the highest total since the ipcc was formed in 2004 but you have to remember you are talking about low numbers, ones and twos, a handful, so people should not get carried away and suggest there is a major new trend but the last couple of years, the year before, there we re of years, the year before, there were three deaths, and the total in three years surpasses the previous six years, so im sure its something that Police Forces will be looking at but when you look at the six tests, they are spread across six tests, they are spread across six different forces so there is no obvious one force were deaths are concentrated, and you have to put it into the context of the number of authorised Firearms Operations carried out each year. There were 1400 700 in which officers were called out, and out of those there we re called out, and out of those there were six deaths so that figure has to be put into context. In terms of Road Traffic Incidents involving the police, i think what will concern the police and the ipcc is the number of deaths resulting from pursuit. There were 28 deaths resulting from Police Pursuits, where a police car is chasing a suspect vehicle and as a result, either people in that car or passengers or pedestrians, passers by, are killed as a result. That is up by, are killed as a result. That is up from 13 test the Previous Year and it is the highest number ever recorded and that will be a cause for concern. What are the ipc saying about this increase . In terms of Police Pursuit, they say the increase is noticeable and they are now going to do some work with the Police Chiefs council to see if is some problem here or wider trend that needs addressing. Up to 150 people held a vigil outside a Police Station in east london last night in protest over the death of a young black man. There has been anger in the local community following the death of 20 year old Rashan Charles in the early hours of saturday morning. A small number of people threw bottles and sticks at police after the vigil, but no officers were injured. Keith doyle reports. What do we want . Claire scott bought a Leasehold Property In Bolton and had a lot of problems when she came to sell the house. Thank you forjoining us. First of all, what was the situation when you came to sell . Yes, we were looking to sell last summer. The house buyers were pretty much moved in and had organised for builders to come and do work. They had ordered furniture but unfortunately on the day they went to exchange contracts, the solicitors had not read the lease until that day and to cut a very long story short they said the solicitors advise them that under no certain terms could they recommend buying our house because of the owner is lease. Because we pay ground rent of £295 per year and it doubles every ten years. By 2060 it will get to £10,000 per year ground rent. Their solicitor said the house could not be saleable. We would have Mortgage Lending Problems and the cost of the ground rent was extremely prohibitive. So they said not to buy the house and the sale fell through. Unfortunately we had completed on next house days before because we were so certain the sale was going through. It has left us in a dire financial situation where we own two properties, we have to rent the existing one out, and it is a Taylor Wimpey building. We enquired about buying the freehold and to ask that question alone is £108 because Taylor Wimpey sold it to another company, Adriatic Land and they want £40,000 for the freehold. I have neighbours who would even like to do modifications and are racking up significant costs just to ask permission to make modifications to their home which they believe they own but they do not properly. What are you going to do now . It is a horrendous situation you are put in. A lot of people will be staggered the ground rent is going to rise to £10,000 by 2060. Gather macro at the at the moment we are hoping the government will continue to put pressure on the Home Builders. Government will continue to put pressure on the homebuilders. Sajid javid was very documentary about Taylor Wimpey because they put forward proposals to help people like me who are in this problem. The issueis like me who are in this problem. The issue is all they are proposing is to switch to another lease, and rpi lease. We would still have to ask permission to do things to our homes and we hope the government are proposing to ban it entirely because it should not exist. The rpi lease will put us in no better a Position Andi will put us in no better a position and i still cannot sell my home because people know they should be getting a freehold and not leasehold home. It is the most vulnerable in society who buy Leasehold Properties, flats and things like that, either Retirement Home side of things, of first time buyers. Neither of whom are in really a position to necessarily really a position to necessarily really appreciate what they are being sold. Especially when the information is available so late in the process. I think we heard claire say that her buyers were not made aware of the lease until the day of exchange. Ridiculous. How can you make a decision on whether you wish to purchase a property when you do not even know about the lease . The government are talking about an outright ban. Is that something you would agree on when it comes to houses . I think in most cases there is absolutely no need for a house to be leasehold. If there is a shared amenities, for example on a gated estate, where you need to have a collection of maintenance charges, contributions from everybody on the estate, there is an argument perhaps it should be leasehold but why does it should be leasehold but why does it have to be a short lease and why does it have to have ground rent . For the last 200 years ground rent is set as low as a pack of corn. Why does there need to be a lease term at all . You have commonhold, another form of ownership, where the owners of the units over the shared land, as well. So there is no freehold to impose ridiculous charges. Really good to talk to. There are dozens of Community Pubs, run and owned by local shareholders where they not only pull the pints but also call the shots. John maguire reports. The government says there is a particular problem in the North West Of England where houses were being sold on leasehold, although its not clear why. I think everyone understands when you buy a flat for example why its sold on leasehold, it has to be shared Common Spaces, but were talking about houses that are being sold on leasehold, thousands of them for no good reason and then once they are sold, the people that have purchased them are exposed to these ever increasing ground rents, it is not acceptable, its wrong, enough is enough. Were taking action. What support do you hope to be able to provide for those who are in a situation where they are trapped in a house they cant sell because of this . There are already cases, some Million People that have bought houses under those kinds of terms, we want to see through this consultation what we can do to help them, one thing that is already happening from the industry is that those responsible developers are already taking action and seeing what they can do but i want to go but i want to go further, so we set out ideas around improving their rights of redress, making sure they have more Consumer Protection but i also want to hear other peoples ideas. I dont have all the answers to this. Its a complex issue. There are people out there, particularly some of the people in these situations and i want to hear from them what they think we can do to really help them. Mps have described leaseholds as the ppi of the House Building industry. Some of the examples the government cited included being charged £1,500 by the freeholding company to make a small change to the family home. A house which is now impossible to sell because the ground rent is expected to hit £10,000 a year by 2060. And the homeowner who was told buying the lease would cost £2,000 but the bill came to £40,000. Earlier ben bland, from the bbcs business unit, explained more about how leases and freeholds work. There are some 4 Million People living in properties where they own the lease but not the freehold. The majority are in flats but at least a third of them are in houses, which is why the government wants to do something about this and as we heard from those examples, it can be costly because when you buy a lease, you are buying the right to occupy that property for a set amount of time, 99 years to 999 years. With a freehold, you dont own the ground the property is built on, and in blocks of flats that can be convenient because one company owns the land and individual people own the flats and the lease to each flat, but with a house, if you dont own the land on which the house is built, that leaves you open to whoever does own it putting up the ground rent. If you look at the lease, it can be built in so it progressively goes up year on year or decade on decade, but even simple modifications, the freeholder can say to anyone who owns the lease, go ahead and make those changes but you need permission to do that and we will charge you. I know people who live in Leasehold Houses who were told they were not allowed to put a Satellite Tv Dish on their roofs because that was not what they wanted for the area, so this is why the government is trying to do something about it because of these costs and restrictions. It can also be a problem if you come to sell the house because it can be a problem assigning the lease to somebody else and the freeholder can charge whatever they like for you to sell on the property. That can hold up sales and cause people problems. What about people who are in these situations . Sajid javid said they are looking at measures to help people who are in this situation as well as banning this practice. A number of House Builders have set up compensation schemes and he was going to look into ways people could seek redress from solicitors who did not spot the clause when they were going through the Conveyancing Process, and he said when you buy something you should be able to assume it belongs to you you dont buy sausages only for the butcher to send you an annual invoice, you dont buy a bucket and spade and then be charged a transfer of Ownership Fee when you hand it to your kids, so he said if you buy something you have the right to assume you own it. Lets talk now to martin boiled from the leaseholders partnership. You have been working with mps and you think this has been a problem for a long time. The problem started growing in 2006 and has got bigger and bigger. We heard crazy examples like a ground rent of £10,000 a year by2060, like a ground rent of £10,000 a year by 2060, you had somebody who couldnt change their carpet. We are aware of some leases where you have to ask permission to change the carpet and ask permission per room. These Government Proposals are mainly affecting new build homes in england that you think the problem is with existing homes. The government has made clear that in the consultation it will look at limiting the help to buy scheme which will limit the developers ability to sell Leasehold HomesGoing Forward but we estimate there are 100,000 homes affected by adverse Lease Conditions which may now become difficult to sell. You talk about that, the of england is at particular problem. The biggest concentration of Leasehold Houses is in the north west but it spreads across to the north east and the whole country, there are Leasehold Houses being sold in london and exeter and almost everywhere. Yes, it is a misconception to suggest Leasehold Houses will be cheaper than freehold, they are often more expensive but if you are on the hill to buy scheme, though our time restrictions and you may be constrained to use the developers solicitor and the value, you may even be told which Mortgage Company to use. It is quite complex but this isa to use. It is quite complex but this is a system that some unscrupulous people are abusing to make money, especially from people who do not really understand the full details of these leases and ground rent arrangements. Absolutely because the freehold are set to these sites is sold on, there is plenty of evidence that many of these companies are offshore, there is a lack of transparency as to who owns them, they are entitled to put up the prices so we are seeing developers assure the prospective purchaser it will cost 2000 or £4000 to buy the freehold and then when they come to bet, suddenly it is 20,000 or £40,000. These are Fatal Police Shootings in england and wales, the figure was six at the end of march and that is the highest total since the ipcc was formed in 2004 but you have to remember you are talking about low numbers, ones and twos, a handful, so people should not get carried away and suggest there is a major new trend but the last couple of years, the year before, there were three deaths, and the total in three years surpasses the previous six years, so im sure its something that Police Forces will be looking at but when you look at the six deaths, they are spread across six different forces so there is no obvious one force where deaths are concentrated, and you have to put it into the context of the number of authorised Firearms Operations carried out each year. There were 14,700 in which officers were called out, many of them involving armed response vehicles, and out of those there were six deaths so that figure has to be put into context. In terms of Road Traffic Incidents involving the police, i think what will concern the police and the ipcc is the number of deaths resulting from pursuit. There were 28 deaths resulting from Police Pursuits, where a police car is chasing a suspect vehicle and as a result, either people in that car or passengers or pedestrians, passers by, are killed as a result. That is up from 13 deaths the Previous Year and it is the highest number in 11 years and that will be a cause for concern. What are the ipc saying about this increase . In terms of Police Pursuit, they say the increase is noticeable and they are now going to do some work with the Police Chiefs council to see if there is some problem here or wider trend that needs addressing. The hospital have praised the courage of his parents, saying the agony, desolation and bravery of their decision has humbled all who work there. But unfortunately the day they went to exchange contracts, the solicitors had not read the lease until that day. To cut a long story short they contacted us and said the solicitors advise them that they could not buy the house because of the owner is lease. We pay ground rent of £295 per year and it doubles every ten yea rs per year and it doubles every ten years so it would get to £10,000 per years so it would get to £10,000 per yearin years so it would get to £10,000 per year in ground rent by 2060. They said the house was not saleable and we would have Mortgage Lending Problems at the cost of the ground rent was very prohibitive so said not to buy the house. It then fell through and unfortunately we had completed on our next house days before because we were so certain the house sale was going through. It has left us in a dire financial situation where we own two properties, we have two rents the existing one out. It is a Taylor Wimpey building. We asked about buying the freehold and to ask the question alone is £108 because they sold it to another company, Adriatic Land and they want £40,000 to buy the freehold. I have neighbours that wa nts to the freehold. I have neighbours that wants to do modifications and they are racking up significant bills just to ask permission to make modifications to their home that they believe they own but we do not own properly. Those who work with abuse survivors say every headline has an impact. Coverage over the last few years has already caused more people to seek help. It was really difficult, because it was exhausting. It became relentless. You couldnt get away from it. It would be in the local papers, it would be on the local news and the wider news. Across australia, nearly 2,000 figures from the Catholic Church have been accused of abuse. A four year Royal Commission enquiry has helped to break the silence. It has also made the head of ballarats Catholic College speak out, giving a formal apology to the victims and striking the names of convicted abusers from its walls. Theres no question that as a church weve got an enormous amount of work to do to build trust with victims and survivors in the wider community, but also within the catholic community, i think, as well. The beer and the banter is in full flow in holbrook. It was closed down two years ago and marked to be demolished and replaced with housing. And then some locals got together to save it. As the project gathered pace, builders, structural engineers, and carpenters from the village, they were all getting together to help. There are now 51 Community Pubs across the uk, though the first one opened more than 20 years ago. The start up costs for a pub is around £350,000. The average investment is around £1,000. Much of the rest of the money is raised through mortgages and loans. But for those at holbrook, the survival of the pub may be desirable, but is it viable . Weve got 250 people investing.
