Here in the Scottish Borders they have cancelled all School Transport for the day, at the heart and half thousand miles of road down here, much of those are auroral and the council do not want to Ta Ke Auroral and the council do not want to take any risks on some of those more minor roads. When i was in pentonville for example before i came here we were locked up 23 hours a day. Im saying we were literally treated like animals. Im saying we had to ask for toilet paper, we had to ask for the basic common decency, know what im saying . So coming here now, it looks like a completely different prison, especially at 0nley. There are bits of downs but you can work around those. I firmly believe if you give someone a chance to change, they will change. In her first prisons and courts bill, the relatively newjustice Secretary Liz Truss wants to have it written into law that it is her duty to rehabilitate prisoners and notjust to house them. As were seeing fewer people committing a crime for the first time, which is good news, more of the crime in our society is committed by people who have already been in prison. So we really need to deal with this issue which has been a problem going on for decades. The prisons and courts bill will also bring in new laws allowing Mobile Phone Companies to help the Prison Service to detect and intercept devices being used behind bars. Daniel sandford, bbc news in 0nley prison. Another aspect of this bill is the man to man the Cross Examination of victims by abusers in Family Courts. With me is our Legal Correspondent clive coleman. You were saying earlier that a quarter of victims in Domestic Abuse cases are questions directly by abusers in Family Courts which is quite an incredible situation. That is research that comes from the charity womens aid, that 25 figure isa charity womens aid, that 25 figure is a very high figure. There is a real anomaly here because in a criminal case and that cannot directly cross examine the alleged victim of the abuse, it is banned in the criminal courts but it is being allowed in the Family Courts so i thinkjust about everyone thinks thatis thinkjust about everyone thinks that is not a good idea. There has been pressure on thejustice secretary by the most in the country, sirjames munday, who has made it very clear over a number of yea rs made it very clear over a number of years his views on this. This has been exacerbated by reductions in legal aid hasnt it . There has been a perfect storm here, in 2013 the government made a big raid on the legal aid budget and removed Something Like £270 million from public funding, legal aid Funding Forfamily Public funding, legal aid funding for family cases and as a result of that no surprises the number of people who litigated themselves, located in person, grew and so what you have in many cases is the alleged abuser who is conducting the case himself, generally himself, and there is Provision Forjudges to step in at the moment and carry out the Cross Examination. But that often doesnt happen. And now in this bill the practice whereby an abuser is allowed to do that, the judge has the power to appoint a legally lawyer to do that Cross Examination on behalf of the person concerned. How quickly will this change come into the Family Courts . We do not have a specific timetable but there is a real sense of urgency, thejustice secretary commissioned an urgent review into this and i know she has made her views very clear. She wanted to happen as soon as possible. Another aspect you want to draw attention to is the plan to extend the use of virtual hearings. This is the Direction Of Travel for the court system, some people would say it is almost an historical accident that we have been dragging people to court for every single healing for the last 200 years or so and it is inevitable that this will happen. The government are investing Something Like £1 billion in digitising the courts and modernising them and another of hearings, Bill Applications and other healings are hearings they say can be done virtually. They can be done by phone, in some instances or they can be done by video, were going to see more and more of those. One other interesting thing if i can mention is one of the radical things in this bill is that victims in criminal cases can have the Cross Examination done before the trial. There have been highlights that have been very promising. This means the victim in the criminal case need not go to the court the trial at all. Big changes. Thank you. It is interesting, the split. The generations who did not know the conflict and the other half. What sucks is that there is so much to be proud of in Northern Ireland. People can be grateful of what we have done. But we have an executive marked by scandal and crisis and falling apart consistently. With me is andrew neilson, director of campaigns at the Howard League for penal reform. Thank you very much for coming along to talk to us. Its always been an aspiration that prisoners should experience rehabilitation during their time experience rehabilitation during theirtime in experience rehabilitation during their time injail, not experience rehabilitation during theirtime injail, notjust punishment, but in practice, we know from many people who work in the Prison Service that that doesnt a lwa ys Prison Service that that doesnt always happen. Do you think that enshrining this in law will change that . That would be the governments hope and it certainly welcome that theyve done so but its not so Ground Breaking in that weve had successive governments publish papers on prisons, often entitled punish and reform. So its been recognised as a purpose of prison for many years. Whether enshrining it in legislation will actually change what happens on the ground in prison is the big question. What is there, as far as you are aware, to back this up, to allow this to happen . They are looking at all sorts of new performance measurements, at League Tables will prisons, at asking the inspectorate to inspect on Prison Leadership as well as all the other things that they look at. The Secretary Of State will be given a duty of care to respond when they find serious failings. It sounds like it is all very nice but in the end we have prisons which are pretty much in meltdown at the moment. We had more suicides behind bars last year than any other year on record. We have had multiple disturbances, Prison Officers striking, overcrowding drugs and violence all on the rise. Is there any more money to back all of this up, more staff, as it seems to me that when you are talking about something that is apparently Ground Breaking, the biggest change ina Ground Breaking, the biggest change in a generation, you will need more money to do that. There is a short term injection in cash to look at recruitment and retention of Prison Officers, because that has been a big issue, but long term Good Ministry ofjustice continues to seek year on year budget cuts and its hard to square what the government wants to see from prisons without looking at the size of the Prison Population and demand on prisons, because that is of saving money. How are you going to be monitoring this . How will you look for signs of change . We will see it in the Inspection Reports and ourselves when we going to presence. We will be looking carefully at the detail because the double, as always, is in the detail. There is a risk that these the tables simply measure how bad things are. We know things are bad. There are various people here with different types of disability. Peter, you are the Workshop Manager here. Give me some idea of the kind of disability is the star power. There are a whole variety of disabilities. Principally we are set for blind and visually impaired but as times have continued, we have a chap who is profoundly deaf, people with learning difficulties, a spectrum of disabilities. There are power tools here and big machines. From a health and safety point of view, how difficult is it running a factory with people who have a range of disabilities . We are of course very conscious of health and safety here. Its a case of being careful. We never put anyone on the soul with a visual impairment. Talking of power tools, we have a chap who makes the mattresses who has been here 40 years who makes the who is blind. They all work with power tools but they are trained and safety conscious. We have an Outside Agency who comes in and gives us refreshers on anything outdated. We are very conscious of it. Thomas, you have only been here one year, not 40 yea rs. They will never throw you in on a job that they dont think youre capable of. Do you think perhaps in other places they look at what you cant do rather than what you can do . Yes, definitely. Iwould cant do rather than what you can do . Yes, definitely. I would say a lot ofjobs i have been for, i havent got it because they think, he cant do this. Theres a lot he may be couldnt do all he couldnt help with this and he wouldnt be an addition to the company or whatever. This is a very busy factory as you can see and the product is a truly commercial product. It may be a charity but they do compete in the marketplace. Who knows what Highland Blindcraft might be doing in 20,30 or 40 years down the line. There are bits of downs but you can work around those. I firmly believe if you give someone a chance to change, they will change. In her first prisons and courts bill, the relatively newjustice Secretary Liz Truss wants to have it written into law that it is her duty to rehabilitate prisoners and notjust to house them. As were seeing fewer people committing a crime for the first time, which is good news, more of the crime in our society is committed by people who have already been in prison. So we really need to deal with this issue which has been a problem going on for decades. The prisons and courts bill will also bring in new laws allowing Mobile Phone Companies to help the Prison Service to detect and intercept devices being used behind bars. Are you saying that we can confidently say that there is any link between these figures in a reaction to brexit given that the few months i think that the period these figures, as our current proposed referendum . Motorists with 12 points can appeal to a Magistrates Court like this one and claim that a driving ban would deliver exceptional hardship on their lives, meaning they would lose a job or be unable to care for a family member. There is no definition in law as to what exceptional hardship means so one magistrate may decide if a driving ban would cause someone to lose theirjob, that is exceptional hardship. Another magistrate may decide it isnt. Every ban is considered on a case by case basis. The government says the vast majority of drivers with 12 points are automatically disqualified and only in exceptional circumstances can judges decide not to issue a ban. The fact remains, though, that there are drivers who have continually broken the law who are still on our roads. David rhodes, bbc news, bradford. M can vary from case to case. It may be loss of employment but loss of employment per se would not constitute exceptional hardship if a example a person lived at home with his parents, attlee would still have food on his plate and a roof over his head. If the attendant consequences of loss of employment would mean you cant pay your bills, provide for yourfamily, would mean you cant pay your bills, provide for your family, your life. Part, courts would look at that situation far more so pathetically, particularly if you have innocent members affected such as family members. So you are looking at a subjective issue . Absolutely. Each case is looked at on its merits. We had a case recently where hardship to the nhs was found to be exceptional hardship. It is notjust on the driver. You have represented a number of well known and Celebrity Clients and one approach you have taken is to get a number of Court Summonses to one date so the court he is just summonses to one date so the court he isjust one summonses to one date so the court he is just one argument on exceptional hardship. Is that correct . That doesnt relate to Celebrity Clients. I should make it clear that as far as they Celebrity Client is concerned it is very hard for them to ever argue exceptional hardship because normally they have the means to employ a driver. But if someone has several offences and all those offences are put both for one court at the same time and exceptional hardship has not been argued in the three years preceding, it is perfectly permissible for the court to decide if there is exceptional hardship on the basis of probabilities not to disqualify. That really is a loophole though, isnt it, as if someone has committed an offence several times, to try to argue that this is one case of exceptional hardship, clearly the law is allowing them, defence lawyers, to get away with it. The law has been in place since 1988 and it hasnt been changed. It is within the confines of the law, within the confines of the legislation. I think what parliament originally intended was people who commit red relatively trivial offences on numerous occasions to be afforded one more chance. I would agree with you. I dont think it fell within parliaments agree with you. I dont think it fell within pa rliaments initial intention to allow people to commit several offences and then have all those matters pull together and be dealt with before one court but the legislation permits it and if parliament wants to change it, then it needs to do so. Can you honestly say that in all fairness that the law is working . Because it seems to be allowing people who have committed multiple driving offences to perhaps argue exceptional hardship and thats not fair on law abiding drivers, is it . |j hardship and thats not fair on lawabiding drivers, is it . Ithink to a nswer lawabiding drivers, is it . Ithink to answer your question the law is working. There are millions and millions and millions of people who drive motor cars and we have a tiny percentage of those who have managed to establish exceptional hardship. We dont want people to lose their houses, careers, lively heads for what is a relatively trivial offence. We have one or two peculiar situations such as the one in West Yorkshire weather person has 64 points on his licence and that sours the legal position which actually works quite sensibly and quite well. Ajudge or magistrates works quite sensibly and quite well. A judge or magistrates will determine every case on its merits and if they say yes, in these particular circumstances we do not think it is appropriate to disqualify a person, then in my view, the law is working correctly. 0k, very interesting to talk to you.
