The government has won its legal battle to Stop Thousands of british citizens from bringing their foreign husbands or wives to live in the uk without a Minimum Income. For the last five years, the uk based spouse has had to prove they earn at least £18,600, for them to support their migrant spouse. That figure is £22,000 for couples with a child. But the Supreme Court also ruled that the rules, as they currently stand, are defective and need to be changed, because they do not take enough account of the welfare of children affected by them, and do not take all sources of earnings into consideration when calculating income. 0ur Correspondent Dominic Casciani is at the Supreme Court. It is not an entirely clear decision . No, it is very complicated. There is a belief that the couples have been degraded by this fear income rolling. The Supreme Court has in practice ruled in favour of the government. The judges said that imposing a Minimum Income threshold on british citizens wanting to bring in someone from home with the european union, is not breach of the fundamental human rates. But what they have said that the way the rules have been imposed thus far have been in fear in certain circumstances. The home 0ffice certain circumstances. Campaigners think we have fresh hope that they can challenge this once again. They said the need to be wider considerations about the assets belonging to the family. Perhaps taking into account whether the organ a property. Maybe for that they have other assets before they make a final ruling, with regard to allowing or denying entry. 0ne claimant in this case me the hilt, others will not. It is difficult to see really what the impact will be. Many people think this will be particularly ha rd many people think this will be particularly hard against people from poorer countries, such as the subcontinent. The home office say the court has endorsed as setting an Income Threshold which prevents a burden on the taxpayer. This is essential to building our immigration system. Lets speak to madeleine sumption, director of the Migration 0bservatory at the university of 0xford. The Legislation Stands but it will have to be looked at. What is your reaction to the ruling . Well, it is a mixed ruling. The basics of the policy will still be in place people will still need at least £18,600 in order to be able to bring a non eu spouse to the country. It is difficult to know exactly how much will change at the moment because what happens next is the government needs to draw up some new rules that address some of the concerns the Supreme Court had, particularly around couples with children, so when we see the content of those rules it will be possible to say a bit more about how many people might be affected, how many people who havent currently been able to bring their spouse to the uk would now be able to under the new policy. How many people can currently not bring a spouse many people can currently not bring a spouse to the uk because of this . We dont know exactly because we dont know how many people would have applied but dont apply because they are not eligible. We do know that around 40 of people working in the uk as employees, whether british citizens or not, currently dont earn enough to meet the Income Threshold. There is also a Government Income Impact Assessment from the time that the policy was brought in that suggests a reduction in the number of people eligible to come it would be up to about 17,000 800. It is very difficult to put a precise number on it but we know it is several thousand people every year. What is your view of the legislation way it has been used . I spoke to someone awhile ago who earn £60,000 but is a contract so the income doesnt actually count under this scheme so he is unable to bring his wife in. There are some very difficult questions about the implementation of the policy that the Supreme Court did look at. There isa the Supreme Court did look at. There is a resolute there is currently a relatively narrow interpretation of what income can count towards the threshold so example, if you have a couple where the woman is a british citizen and is not working and the husband has a high income but he is working abroad and doesnt yet work in the uk, with a guaranteed income here, the prospective incomes of the husband would not be included and thatis husband would not be included and that is quite a common case that you come across. I think over one of the Big Questions that people have about the threshold is the flexibility. There may be sources of income people have but they cannot use them to demonstrate that the earn enough under the policy. When you look at what the Supreme Court has said today, talking about the rights of children and the impact on children of the way that this legislation is currently implemented, potentially you could say therefore that if a family is split because of the rules but it means a child will not see the other parent then it should override the human rights, the human rights of a child should overcome the Income Threshold. Is that potentially going to be one way that this ruling could be interpreted . That essentially was the interpretation that the Supreme Court had, that the policy was based primarily on economic grounds, so the idea of the Income Threshold was that there should be reduced migration of people who might when they come to the uk end up being reliant on income related welfare benefits, tax credits for example. It didnt explicitly factor in what the interests of the child were and particularly its interests in living in the uk with both parents. That was the major piece of the policy that the Supreme Court said they felt was not lawful. Thank you very much. She said there will be an extra £200 million made available this year, this would include Emergency Food and waterfor a Million People in somalia and Food Assistance for 500,000 people in south sudan. There will be also Emergency Health care and nutritional support for starving children in both countries. Britains leadership will basically mean we will be saving lives, bringing vital assistance to people in desperate need but also putting the call out to the International Community to get them to step up, to galvanise their support so that we can have a Strong International response to what quite frankly could be a devastating humanitarian crisis. As part of our disability works series Vishala Sri Pathma is visiting a Marks And Spencer depot in castle donington. When it opened in 2013, the company pledged to fill a lot of the positions with disabled staff. Vishala, what are Companies Like mark and spencer doing to help those with disabilities in the workplace . We are looking at what this company do to help get disabled workers into work. They run a Recruitment Programme that helps people overcome the challenges that they might face if they have a disability. Sophie brookes heads it up. We were talking earlier and you say that disabled workers bring a unique skill set to the office. Tell us more. People with disabilities are an amazing Talent Stream into our business. They not only diversify our Employment Base which we are always trying to do to do reflect a Diverse Customer base but they bring incredible gift and abilities into the workplace. So often the barrier is actually looking beyond their disability to their ability and seeing what they do and can bring to the workplace. They are also incredibly motivated. A lot of them have perhaps been overlooked or seen themselves at the bottom of the pile in terms of work for a number of yea rs in terms of work for a number of years and so when theyjoin us there is this real sense of motivation and commitment and dedication because they are just delighted that we have given them an opportunity to work in this way. So lots of companies sometimes worry about the costs when they are involved in hiring people with disabilities, is that a legitimate concern . Obviously there are legitimate concern . Obviously there a re costs involved, legitimate concern . Obviously there are costs involved, for example we have been worrying our programme running our programme for 13 years now, we launched in 2004, of course there are costs in the programme but there are costs in the programme but the benefits of the programme, the benefits of helping people who face barriers to work, we work with people who are at risk of homelessness, people disabilities, Single Parents and young people, and the benefits of seeing these guys coming to us and being trained and bloodied and getting new skills and then getting to work in our offices and Distribution Centres and our stores, the benefits far outweigh the potential costs involved in the programme. 0ften the potential costs involved in the programme. Often it is small and reasonable adjustments that people with disabilities actually need. A lot of people it is a bit of a mindset shift. A lot of people think that for someone with a disability they are in a wheelchair and that is not true, disabilities come in all shapes and sizes they can be visible or invisible and hidden, it is about the small and reasonable adjustments that we as a responsible employer can put in place to enable this individual to work with us. Just a quick word on confidence, something that comes up a lot when i work with people disabilities is the confidence to pursue a career, are you tackling that . This is one of the best out of the programme, one of these people come to us they are offered at rock bottom in confidence having been rejected an overlooked form a lot of employers and jobs and one of the greatestjoys is saying that confidence as zoom from day one until the end of their programme, and then when they started a job with us. We put them alongside buddies who are existing employees and it is a real source of confidence building, mentoring, training, coaching. Their confidence just source throughout the programme. Anything that drives positive change is great but from our perspective it is about putting people into a career rather than a job so the work that we do with employers is about helping them understand the benefits of employing disabled people and addressing the challenges of Building Confidence so that when we put people into a job with them they have the opportunity to prove themselves and really develop an incredible career with that organisation. As a starting point, yes, but there is more work to be done. When you look at the business benefits of hiring people with disabilities, what are they . Business benefits of hiring people with disabilities, what are they7m is quite simple. The people we work with have a real desire to work and prove themselves so if you can harness that loyalty that is the first point for me. We also know that disabled people take less time off sick and tend to be more loyal than a lot of other people so actually by investing the time up front to get that Recruitment Piece right you can actually save yourself significant amounts of time up front in recruiting the right staff but also having people who will stay with you and give you years of fantastic service. The cost of Essential Repairs to School Buildings in england has already reached almost Seven Billion pounds, according to the National Audit office. In a report published today, it warns that figure could double by 2020. But ministers have also spent money on creating places in new free schools, some of which are under subscribed. Jon ironmonger reports. Englands schools are in high demand. Places for 400,000 more pupils are needed by 2021, but safe, high quality buildings are hard to come by. Many schools are already in a sorry state. Most were built before the mid 1970s, meaning worn out walls and windows or faulty electrics are a common problem. It will cost an estimated £6. 7 billion to fix major defects like these. The National Audit office says the bill could grow sharply. As well as repairs to existing schools, the government is planning to open 500 new free schools over the next five years. But auditors said that a lack of suitable land meant large sums were being paid to secure sites and they raised concerns that in some cases the programme had created places where they werent needed. Well, what happened is the jury had been out for one day effectively, they went out about this time yesterday, the judge telling them as they send them out, to take their time and not to rush to verdict but to be fair. The evidence against ian stewart was pretty overwhelming. There were all sorts of things that he was just unable to explain, despite the long and convoluted and frankly implausible story that he tried to spin when he was in the witness box. For an example, traces of the Sleeping Drug Zopiclone that have been described to him were found in his body when a postmortem examination was carried out, and yet thejury had been examination was carried out, and yet the jury had been told repeatedly that there was lots of evidence that she had been confused and wondering why she felt so drowsy in the days and weeks before her death. She had complained to her mother about it and complain to friends about it and she had been looking on her own ipad, googling why she might be tired. The story from ian stewart was that he had she had seen the zopiclone because had had trouble sleeping she said she would use and taken it from them but i am sure the jury taken it from them but i am sure the jury would ask themselves why if she knew she was taking Sleeping Tablets would she have been trying to work out why she was so tired. All sorts of Little Things like that that in his story just of Little Things like that that in his storyjust add up. He created this elaborate lie, that two man, shady Business Associates of her ex husband, had come to abduct her from the house that they shared in royston and had told him that he mustnt tell the police. That is why he said he didnt inform the police immediately that she had gone missing and that was why he said he didnt tell the police about them because they had told him that he mustnt tell the police about their existence but it was all obviously lies. Why did they abduct her and then bring her back to the house to dispose of her body instead of burying her perhaps in a shallow grave . So many things didnt add up and he had so many difficulties trying to explain away all the evidence against him, but in the end it was just overwhelming and the jury it was just overwhelming and the jury saw through his lies and convicted him. Tell us more about what you learned about helen bailey during the Court Hearings because, by all a bright, loving woman, who described him as her happy ending. Absolutely, helen bailey was clearly a very, very well liked woman. She was somebody who had reached out to a lot of people. When she was believed herself, when her first husband died tragically in an accident while abroad she was somebody who had created a blog all about her grief and through it, i think, had given a lot of comfort to other people in similar positions. 0ne other people in similar positions. One of the tragedies of this is that she only met ian stewart through a bereavement website, set up to help grieving widows and widowers come to terms with their loss and certainly friends of hers who had given evidence had described in very moving terms in court how in ian stewart, who she referred to as the gorgeous, grey haired widower, she felt she had met her soul mate, she felt she had met her soul mate, she felt she had met her soul mate, she felt she had met someone with whom she could build a new life after the death of her husband. Of course one of the tragedies of this case is how she was absolutely deceived in this and how what she thought was a Bright Future together was simply him plotting on getting his hands on herfortune, on him plotting on getting his hands on her fortune, on her him plotting on getting his hands on herfortune, on her muddy, driving planning to kill her. It was a very challenging enquiry and it was initially reported as a missing person and the lies and deceit that ian stewart offered during the course of our investigation really did hamper us but i am very proud of the work that my team have done to eventually find helen and sadly find that she had died but to be able to return her to her family, that she had died but to be able to return her to herfamily, and i am particularly proud of the investigation that we put together and the eventual conviction of ian stewart. Why are you now re examining Diane Stewart 5 death . She died of natural scores is in 2010 and it would only be right and proper that we at what those causes might be. She did die seven years ago, there was no suggestion that she died of anything other than Natural Causes that, of course it will be part of our enquiries moving forward from this conviction.
