Its 5pm, our top story in a landmark case about freedom of expression, a high courtjudge has warned police against acting like the gestapo or the stasi when they investigate alleged hate messages on social media. Thejudge ruled that Humberside Police acted disproportionately when they turned up at harry millers place of work and told him that his tweets about tra nsgender people were a hate incident. The judge said the police visit had a potentially chilling effect, saying we have never lived in an orwellian society. Our legal correspondent, Clive Coleman was at the high court. Harry miller believes that a man cannot become a woman, and vice versa. And he tweets on gender identity issues, often using fairly crude and, some would feel, very offensive language. Now injanuary 2019, a trans woman complained about his tweets. Humberside police attended his place of work, eventually interviewing him over the phone and warned him that if he continued, he could be prosecuted. Now he judicially reviewed the guidance under which this incident was logged as a non crime hate incident, which can be turned up on certain background checks. Today, mrjustice knowles ruled that the guidance itself was lawful, but that the behaviour of Humberside Police was a disproportionate interference with his right to free speech. Outside court, harry miller was delighted. We have never had a gestapo or a stasi in great britain, but the actions of Humberside Police came way too close for comfort. This is a watershed moment for liberty. The police were wrong to visit my workplace, wrong to check my thinking, wrong in their attempt to force me the stone wall, and now the labour party trans right pledge. Well, many people will regard the very strong words from mrjustice knowles as a robust defence of freedom of speech, but that isnt the case, in particular with trans groups. Outside court, Helen Belcher from the Organisation Trans media watch gave her reaction. I think trans people will be worried that it could become open season on us, because the court didnt really define what the threshold for acceptable speech was. And i think it willjust reinforce an opinion that the courts dont really understand trans lives and arent there to protect trans people. The words of mrjustice knowles today to give real guidance to Police Forces about the tenor and kind of language that is permissible and commenting online on issues relating to minority groups. As i say, it will split people some will be very grateful for this judgement, feeling it allows them to speak freely, but theres no question others will be very upset and concerned about it, and this will be a very controversialjudgement. The number of cases in england is at its highest level in a decade and many universities and colleges have seen outbreaks. There were more than 5,000 Laboratory Confirmed cases of mumps last year almost five times the number seen in 2018. Last month alone, there were nearly three times as many cases as the previous january. Todays young adults were born in the late 90s and early 2000s and that was when the measles, mumps and rubella vaccination was incorrectly linked to autism, creating a panic amongst parents. Now, the link has been proved to be false, but many children missed out on their mmr jab. The cohort of young people who werent vaccinated are now at university, getting to know each other, sharing their bugs, and thats meant weve seen this huge increase in cases. Around half of mumps cases last year were amongst unvaccinated people, according to public Health England. But many, like flora, ben and ollie, did have the mmrjab and the follow up booster. And yet, they still got mumps. The challenge is that the mumps element of the vaccine isnt quite as effective as it is for measles and rubella. The more people that are vaccinated, the harder it is for the bugs to get around to be shared in the first place. So, even if you have had two mmr jabs, you could still potentially get mumps, partly because a lot of people didnt and, therefore, the virus is more prevalent. Precisely. Mumps typically passes with no lasting damage. Those who have had an mmr jab are less likely to suffer serious complications. On rare occasions, it can lead to hearing loss, viral meningitis, and infertility in men. Anyone unsure if theyve had an mmrjab or booster is advised to see a doctor. A new cabinet, borisjohnson would also like us to think its a new government. One different with the priorities from the previous conservative governments. We here to deliver this but make the peoples government has to get on with the delivery of its priorities. Boris johnsons new next door neighbour at number 11 downing st is a former investment banker rishi sunak, and he has to find the cash for number tens plans. This new cabinet member says appointing a chance or with dutch chancellor with a seat in yorkshire demonstrates a commitment to the modern england. Obviously we re to the modern england. Obviously were all very proud of ourselves up north, fighting that tory fight. To have rishi sunak up there will be a great asset. But rishi sunak, unlike his predecessor, has had to accept sharing his staff with number ten downing st. What was proposed and will now happen is that we bring together the back office teams that help to advise the Prime Minister at number ten and those that advise the chancellor. The metropolitan police says it investigated more than 350 suspects under the age 01 14 in connection with allegations of sexting or sending explicit pictures and videos of other children in the 18 months before august last year. The force says the problem is growing, and it has doubled the number of officers dealing with online Child Sexual Exploitation and abuse to 200. Our Home Affairs Correspondent tom symonds has more. Our children are online more, theyre all sending pictures constantly to each other and i think the by product of that is that theyre going to be sending these sorts of pictures. I think whats interesting about these figures, although thats quite a small figure in terms of the number of suspects, but this is a sort of offence that any of our children i think could commit at any time and probably through ignorance of what the law is and whats good for them. So its 353 suspects investigated during that time period of january 2017 to august 2019, but heres another figure. So there were 125,000 child abuse images detected and dealt with online last year and a third of them were thought to have been generated by the child themselves, so selfies. So its a big, big issue i think. Even if a child takes a picture of themselves, if its an explicit picture and sends it, they are committing an offence so that is the law and of course if somebody else sent the picture of somebody else, some other child, then that is also an offence. But the police look very carefully at whats happened in these circumstances, so is that a child sending a picture to another child . Do they know each other . Has the picture been forwarded on to a third party . That sort of thing, and they have something called outcome 21, which is an outcome they can use to effectively say there doesnt need to be a prosecution here, either because of the age of the child or because its simply not in the public interest. Now that does mean that nothing happens in terms of a criminal record but it does go on the police computer, and if somebody applies for vetting, that is also something that can be taken into account. The court of appeal has ruled that an estranged muslim couple, whod had an islamic wedding ceremony and had four children, cannot legally divorce because their marriage isnt recognised in law. An earlier ruling had accepted that their vows were similar to those of a british marriage contract. Dan johnson has been following proceedings. There is a degree of complication with all this, explain exactly whats happened here . It certainly isa whats happened here . It certainly is a complicated case, but let me try and outline the issues here. The background is that the couple essentially lived to all intents and purposes as a married couple for 18 yea rs. Purposes as a married couple for 18 years. They went through an islamic wedding ceremony in london in 1998 and refer to each other thereafter as husband and wife, their friends and relatives treated them as a married couple, they had four children and lived abroad for five yea rs children and lived abroad for five years in dubai where even the authorities regarded them as a married couple. But when their relationship broke down in 2016, thatis relationship broke down in 2016, that is when questions started to be asked about the status of their marriage. Because although it had been their intention from the outset to go through a civil ceremony in london as well, which would have established their marriage formally in english law, they never actually went through that ceremony. Now the case was that that had been their attention, they had been living as a married couple and therefore she should be entitled to the same Legal Protection and financial settlement that any spouse would have got out ofa wedding, that any spouse would have got out of a wedding, potentially half of her partners assets, even may be even more. At that ruling was overturned today by the appeal judges who said that the ceremony in 1998 did not create a marriage because it was a non qualifying ceremony. The parties were not marrying under the provisions of english law, thejudges marrying under the provisions of english law, the judges said the ceremony was not performed in a registered building, no certificates had been issued, no registrar was present. And further, judges say that they knew that ceremony had no legal effect and they would need to undertake another ceremony in order to be validly married. The significance, could this have a knock on impact for other couples who might be following this case . Indeed, theres been a lot of interest in the case, a lot of eagle eyes on thisjudgement interest in the case, a lot of eagle eyes on this judgement to see what impact it might have for other couples in a similar position. There are thought to be thousands of muslim couples who have gone through an islamic wedding but havent necessarily followed it up with a civil ceremony. Lawyers are saying this creates a precedent now where there may be thousands of particularly muslim women who face a relationship break up without any of the protection that they perhaps should have had. Now for this particular couple, things have been resolved and theyve worked out a settle m e nt resolved and theyve worked out a settlement between them, so this really has no bearing on their future. But the attorney general had pursued this appeal presumably because the government thinks it is important to restrict what is actually regarded formally as a marriage, and lots of old lawyers are keeping a close eye on this because they believe it could have a bearing on so many other couples. Option, thanks very much. Dan johnson. The government says its assessing a suspected cyber attack on Council Services in redcar and cleveland. Lets find out more from joe tidy. This is a result of people who live in that counciljurisdiction not having access for example to their online accounts. Explain exactly whats happened here . Saturday morning at 11am the council was hit with a cyber attack and they confirmed they are under a cyber attack right now, it is a an ongoing situation theyre dealing with. About 135,000 people who live there are off line, so you cant use the planning applications, you cant book things or check on details or anything like that. Its been gone for going on a week tomorrow. Not only that, all of the councils computers are down as well because hackers have somehow got across the entire network and taken it all off everything points to, according to Cyber Security experts, a Ransomware Attack thats where hackers gain access to a system and will encrypt the entire system, effectively locking the company or organisation out of that system until they are paid a ransom. We havent had that confirmed by the council or the authorities, they are keeping very tight lipped on this. They are even saying the nature of the cyber attack, but everything points to a ra nsomwa re attack, but everything points to a Ransomware Attack. Weve just heard from the Information Commissioners Office that says redcar and clevela nd office that says redcar and Cleveland Borough Council have made them aware of the incident and are keeping up. This is enough to make a significant because the Information Commissioners Office is responsible for monitoring any data taken from the council, or any data x will traded and stolen by potential hackers that could be sent information. X full treated. Its pointed towards no data being compromised, but they havent said whether the data has been encrypted which is effectively the same thing, meaning the data is out of the control of the council. Weve not heard anything back from the council today, we heard from them yesterday saying it was essentially a cyber incident they are dealing with, and the National Cybersecurity centre have sent a team up there to help the council recover. But all of this is costing the taxpayer a lot of money, the council tax paying residents of redcar and cleveland will be wanting to know whether or not this is a Ransomware Attack or whats been done about it. Because every hour the Council Spends on specialist Cyber Response teams is costing a lot of money. Clearly a lot still to emerge, thanks very much, joe.
