But not everyone in his party agrees, and there are fresh divisions in labour tonight. Jeremy corbyn has of course demanded that his mps vote with the government in favour of triggering article 50. But some who represent pro remain constituencies are flatly opposing the bill. There are reports that dozens of labour mps could defy mr corbyn on yet another key issue. Of course, its possible to honour the result of the referendum and stay within the Single Market place and even if you think there will be an exit from the Single Market place, it is madness in diplomatic negotiating terms to abandon that position now. You can come out of the eu and still remain in the Single Market. You want another referendum . I think people should have a direct say. I deign think it is good enough for the Prime Minister to sit in number ten and determine the shape of brexit. And that is precisely what she has done. So you are saying that the british people need to vote ain . That the british people need to vote again . I think they were failed last year by politicians, and i include myself in that, for the debate which preceded the referendum, though i do think that is the reality of coming out of the European Union emerges, weve already heard businesses like hsbc, lloyds of london, toyota, saying that they are reviewing their operations in the uk, that i think it is right that the british people have the ability to determine our economic future. I think liberals and democrats have to be worried about anybody that President Trump will put on the court because that person is going to very likely rule on important issues in the way that liberals and democrats will not like. That is interesting. Mightnt he be a so called swing and i mean that in the best possible sense, we know justices do not always act according to type, anthony kennedy, a Reagan Appointee and he is seen as the main swing it justice, he appointee and he is seen as the main swing itjustice, he comes rule in a liberal or conservative way. Could neil gorsuch be such a man . The republican legal establishment has gone to Great Lengths over the last 30 years to make sure that does not happen any more and that is one of the reasons why the pics are coming from the courts of appeal is like neil gorsuch, or you can see over a long period of time how he has ruled ina lot long period of time how he has ruled in a lot of cases and have a great degree of confidence that he is not likely to change his fundamental outlook. Could he be more conservative than anthony skilling. For principled reasons, because of his commitment to other reasons, he could across the aisle and the width liberals on some issues, he had some quirky views as well. It is possible that neil gorsuch would do the same. He has some of the same commitments to how you interpret statutes and how you interpret the constitution that could lead him down the same path. I am interested in you as a Supreme Court practitioner, someone who has dealt cases in front of the court, how will you tailor your submission, taylor at your address to the court. Do you focus on those justices who you think might swing your way or is there a general appeal to all of them . In your way or is there a general appealto all of them . In most your way or is there a general appeal to all of them . In most cases in the Supreme Court are not decided 54, in the Supreme Court are not decided 5 4, they are not buy clothes and an argument that is good for the liberal justices argument that is good for the liberaljustices might argument that is good for the liberal justices might also argument that is good for the liberaljustices might also do the conservative justices. You would be afful not to recognise that someone like Justice Kennedy will be the deciding vote and to think about what is important to him and tailor your argument is the degree to him. Differentjudges have different ideas about how fast and how aggressively the court should move on certain issues, the chief justices, conservative in the way of not wanting them to move too fast, we will see where neil gorsuch will end up in that spectrum as well. Anotherjudge has been on the court for several years now and there is going to be at some point potentially over the next four years and if he gets re election, eight yea rs, and if he gets re election, eight years, and other vacancy. Is this a chord that you believe is going to be firmly entrenched on the conservative side for many years to come potentially . Certainly, if President Trump gets to replace one of the liberals, we will have a solid five vote conservative bloc, the oldest of whom is 68 right now and that block could be together for 15 or 20 years controlling the court.
