The brothers looked like they had control of 3 companies they each separately had the room and one but they looked like they controlled together George Simpson wanted $700000.00 points per cent his company here radius architectural roofing and developments limited and he had that cash in a company that it looks like he controlled the morays shifts No remember if it could be sure that he simply brought his money back to the u.k. Then tax would be payable so George Simpson's company borrowed the money instead mark or is a tax Q Say we asked them what the purpose of these so-called loans are at all and fares a liability to repay. On the documentation which I've seen today that it's just difficult to ascertain where the liability to repay arises and where when you look at this really under the skin of this do you think these are commercial loans instantly and my opinion I think that it may be difficult to justify that these are commercial goals to a tax to get why. Because the parties are related the loan agreements are somewhat uncertain. And the all in all of this running circumstance are of a looked out and it seems to me that they the whole transaction just may or may not pass muster when it comes to a hearing before it actually will we asked Mr Simpson f. The story we're looking at involving the Simpson brothers is that they were receiving rent from a public health trust for a property in a spell fast and the Health Trust told us that their lease was with Russell sim since May is still its limited company the health trust paid $50000.00 points a year to a property consultant in Belfast but actually lot rent money was being sent by the property consultants to a 3rd party offshore company so-called rent factoring was used in this kid is not factoring conserve an important commercial purpose of a landlord would rather have rent up front rather than wit for it and risk the tenant the faulting the landlord that's a factoring company collect and keep all of the rent in return for a lump sum up front for example if you were the landlord of a property and renting it for 10000 points a year over 10 years the total you should get over the 10 years is $100000.00 points so you might be prepared to use a rent factoring agent so that you get it he thought and in your hand right now here's q.c. Markhor explaining rent factoring in the George and Russell Simpson guess. Their average tax regime of this nature of 5 difficult to justify because the relevant rents for payable and paid by public authorities they were what some have called Blue Chip results and there doesn't appear to me to be any requirement for a factory agreement. And then pay the food rid of tax in the u.k. Or you wouldn't set up a scheme to actually pay more than you would pay with. Would defy the logic of all types of games so the logic of this game is to move the money to the Russians and avoid paying sometimes the logic of the scheme seems to be that money can be moved firms can be moved from Northern Ireland into various mission companies with a consequent reduction in liability for tax is there any reason why anyone particularly with rental income from a government body would enter into this arrangement I have never come across a factoring arrangement in relation to rent from a government body. Never never and for many years 37 years. So. It's unusual. How do you think. They would not like to be defending this tax tribunal it may well be that the taxpayers will be successful but. I would not likely defending that actually. Focus on what's going on here so this is rental money being paid by the Northern Ireland health service for a property. But the money is being sent offshore to. Seems the purpose was to avoid paying tax the Simpson brothers didn't address any of the questions we put to them about this offshore rental scheme regarding their use of a company their lawyer said Our client is a respected businessman in Northern Ireland he has created employment and has contributed millions of pines to the local economy over many years this scheme was set up in good faith on a b s is of professional tax advice a number of years ago the aim of the scheme was to lawfully minimise the tax payable and maximize the benefits of those savings for our clients senior employees the scheme is created entirely in accordance with the law and the u.k. Tax authorities have filled visibility of this process our client will of course pay whatever taxes deemed appropriate though due to changes in the tax laws since the scheme was set up it is unlikely there will be any benefit to our client he completely denies any allegations of wrongdoing.
