Radio Scotland and this is news Dr tonight with Laura Maxwell whom a court in Barcelona has acquitted 5 men of gang raping a 14 year old girl the men were convicted of a lesser charge of sexual abuse because lawyers argued the girl was so intoxicated that no violence was used the case has caused outrage among women's groups in Spain about the definition of rape under Spanish law well let's cross to Barcelona now and speak to the journalists Canal's Good afternoon Sara and just to be clear these men have been jailed It's just that they've been jailed for a lot less time than they would have done if they'd been convicted of the Spanish equivalent of rape exect. That's right they have been fed and between 10 and 12 years in prison however they are carriage of sexual abuse which is the lesser offense up off the pews Now if you'd like to take a look at the case that the case took place in a man there's no it is a parson up programs back in 2016 this group of young men took turns to rape the teenager and this happened during an outdoor Trink in session in an abandoned factory so back in July what happened victim testified that she was under the effect of alcohol and drugs she was unconscious most of the time and that she remembers only part of what happened that night however to Barcelona high court argued that you nor to come victim and of gang rape violence or intimidation it had to be proven and the fact that she doesn't remember then disease why they have been charged off of a lesser offense of abuse and the girl was unconscious which means that these men did not resort to violence or intimidation does what the high court is arguing and I suppose the issue here is that this case has quite a number of similarities to another gang attack in Pamplona which also made headlines like this exactly some people are calling these games as other than men but as a man of means. And it's a reference to this case it was the 1st of many cases that have graced controversy leading to protests and demonstrations across Spain and also fueling a feminist revolution the Wolfpack case in Pamplona saw 5 men convicted for sex really abusing a young woman and after a series of protests the Supreme Court finally converted the original verdict to rape and raced the prison sentences from 9 to 15 years so is there then a review currently taking place to look could what constitutes rape and consent to crack cross the country. Well as referring to the specific mandate as a case in the next days we will see if it's taken to higher courts such as the Catalan high court which is a previous step before going into the Supreme Court however these verdict has fueled. Another call from some sectors of the society for a change in the criminal coat these groups believe that the verdict reflects an outdated criminal code they state that it's time to change it so that it's understood that only a yes means yes and that consent must be given in a free and conscious and responsible manner however the political activity here in Spain has been slow there hasn't been progress whatsoever and we've got a we run up a general election taking place in a week. So we'll see if the if the government takes action after the elections in this regard well sort of reaction has there been from women's groups and campaigners x. Actually women's groups that just organisation on female judges the have specifically demanded teen just to the Spanish law once again because they already . Involved and then you're also attached to it's a Google product does that mean that people will know all the time where you are. Well in Syria I mean of course Google can already track a hold of your location to your phone use obviously when Google Maps and so on I mean I think one of the ways they will probably might want to marry information together will be with the Google Maps app which is of course hugely dominant in the map space and the Fitbit tracker and the 5th Ed and other wearables is trackers on their own already faced sort of a discussion a couple of years ago the Norwegian Consumer Council did this very wide ranging investigation into the terms and conditions of these devices and whether or not people who were strapping them to their wrist really knew what they were signing up for getting into and actually because of a lot of that investigation the terms and conditions of these devices including separate were changed to give users a little bit more chance to opt out of some of the more invasive tracking techniques but you know Google and fit that have that but it's come out with a statement today saying we take data protection and privacy very very seriously but we have been here before we heard from say Facebook in the whatsapp merger several years ago that they were not going to merge the data sets that were not going to merge the information between the 2 you know they the merger got approved by the powers that be in the various countries and they motivated they merge the data so you know I imagine we will see Google and Fitbit saying very clearly we're not going to use this data to track you we're not going to use this data that we get from the Fitbit to you know serve you as Or shall use stuff that you don't want to be sold and they would certainly be expected to acquire that sort of law but what happens further down the line is up to anyone's guess I mean it's an interesting time that they're doing that when we're hearing even in the Us Some people like Senator Elizabeth Warren saying we want to break up big check not consolidate it further into the hands of just the the duopoly as it's called and I still struggle to understand necessarily want to get cited this the news you say they want to move into the hardware market but if it does feels a bit old fashioned these days. Well it may be just an awful lot of people wear them an awful lot of people are using them I mean you know but in terms of the wearable health tech. I mean it's quite basic in comparison to whole lot of other ones. That lady so I mean and I think maybe by design because people want sort of simpler easier to use or you know it depending on the marketplace you're aiming for in terms of a little bit older people who are wearing seat belts as opposed to some other devices but you know this this is their 1st out I mean it's a very big brand recognition it's very well known you also have to look at the way in which these wearables are attaching themselves to other industries like the health insurance industry for example. Health insurance provider in the u.s.
