Radio Scotland You're listening to Good Morning Scotland 24 minutes to 9 Eyes so we will know the next state Tory leader and prime minister before lunchtime today so how is the rest of Europe viewing the prospect of a new incumbent at number 10 with the odds favoring Boris Johnson closing in what does that mean in terms of bricks and negotiations and the run up to the hollowing deadline we're joined now by Catherine Barnard who's professor of European Union law with the think tank the U.K. In a changing Europe Good morning to you good morning Catherine you've just returned from Luxembourg I believe has your What's the mood like over there looking forward to the announcement this morning I think the view is with quite a lot of caution and wariness certainly in amongst the E.U. Institutions they do remember Boris Johnson's time as a journalist in Brussels when some of the stories took on a fairly good here too and I think they are deeply concerned that said they know he's a man of charisma he can bring people with him and it may be that they do need some sort of reset as an excuse to have a really really good think about what an earth are going to do about the British problem yeah but nonetheless some of his comments in the past and even through the leadership campaign have been fairly controversial we had the E.U. Being blamed for E.U. Regulations and kippers recently comparing the E.U. Use. To those of hecklers you know what I mean what do people make of of the fact that he comes out with things like that and he is it seems on the verge of being Prime Minister I think there is deep concern and I think people on this side of the channel forget that people on the channel read the British press. Yes and watch the British news and they take it all very literally and date and so there is a real concern about who has been elected on the other hand they know that we need a new prime minister Boris Johnson is the man who will command as far as we can tell significant support among the conservative party and he's a man they're going to have to deal with so they can have to do a certain amount of swallowing of their concerns and just get on with doing some rigorous actions with and under all what is the what is your you know thinking on negotiations I mean how much room is there from a negotiation is there is there anything in which share you know the E.U. Might give some ground on well I think it if you remember interest amaze withdrawal deal that the article 50 agreement there were 3 big ticket items and there is very little wriggle room on at least 2 of them one is a citizens' rights on which actually both sides pretty much agree the 2nd is the money and the money actually is gone rather quietly member is going to be the big fight at the summer and in fact it wasn't and then the 3rd is an old man border which of course an old and a backstop not someone that's really going to be difficult to resolve however I think there is some wriggle room there about possibly having some sort of time limit on the backstop Yes It undermines the argument that it's an insurance policy we don't want. A time limit on your insurance policy but on the other hand if you had quite a long time limit 10 years I mean 10 years is a long time in politics the other possibility is whether some sort of more rebuffed exit close from the backstop because there is a paradox that there's an exit close from the E.U. Agreements as a whole that there is no exit closer in the backstop and so there might be a bit of margin for room there it may be that the E.U. Do dig their heels in but on the other hand Ireland. It's going to be almost as badly affected by G.O.P. Exit as the U.K. And so on and really I think is going to be the key player here and if they agree to some sort of shift in their position then it may be that the Brussels goes with them and I mean either way I mean the new prime minister is going to have to take on quite a I had a job in terms of repairing diplomatic relations in Europe surely. I think that's right but actually I don't think that will be his 1st line of it attacks I think the 1st line of attack will be indeed attack to show that we're not a nation to be messed with and so I think what you'll see is quite a lot more aggressive language quite a lot more talk about no deal because that's the way they are convinced that conservative part you convince they will get more concessions out of Brussels and there is not likely to achieve those concessions so some people say that the vote last week on the amendment to the Northern Ireland bill has actually hindered rather than helped the British cause if if you believe that because it's trying to go state a better deal because the E.U. Dominic Grieve is here with us Westminster is there any doubt that it will be Boris Johnson to believe that we have to wait and see what the result is you can never be certain of anything but on the face of it it seems very likely that Boris Johnson will get the leadership of the party and become prime minister tomorrow and other than him moving into don't excrete into Reason me moving out as far as Bracks that is concerned does anything change it doesn't change the problems facing a Prime Minister in relation to getting a satisfactory deal and taking us out of the E.U. . Changes that Boris Johnson like to reason appears to be willing to contemplate leaving with no deal of any kind of tool and says that he will do that on the 31st of October if he hasn't obtained a deal and that's a very high risk strategy because there are clearly a substantial number of conservative members of Parliament including myself for whom this is an acceptable proposal and if he persists with it and it becomes clear that that is the risk that he's prepared to run then I don't think is administration is going to survive just on the move we've heard from a power David cork and others saying that they will resign if you win I presume that they will be joining you in the back benches in this opposition so will vats faction of the Conservative Party feel and. I think that the results of last week's vote on the. Vote using the Northern Ireland bill to do it was a pretty clear sign of the sorts of numbers who are willing to rebel on this issue of course things may change he may be able to persuade people that he has a strategy which is viable and one of the problems is that the closer we get to the 31st of October the greater the risk that even if his administration were to full a month we might still have a crush outbreaks in the middle of a general election campaign so the tension is going to rise the closer we get to the 31st of October but all I would hope for is that he has listened or will be listening to the very clear messages that are coming across and he will desist from a policy that in my view is going to take him to catastrophe will he not be able to say that he has listened to the Tory membership they have listened to him talking about do or die leave me and they have backed him if you were ends up winning I think that's to misunderstand Democratic politics I have every respect for the Conservative Party membership but the total membership is not point to 5 percent of the electorate the numbers. You are probably going to vote for him again to be under naught point 2 of the electorate that cannot dictate what is in the national interest quite apart from anything else we don't get elected as conservative members of parliament without the support of many tens of thousands indeed millions of people who are not conservative party members and if you're going to mount a campaign or stop have a policy which is based on what a narrow section of your membership want and it is in fact at variance with what the national interest clearly requires you're going to run into trouble we mentioned there in the headlines as cross party group of M.P.'s and peers planning legal action in Edinburgh to back up that vote in parliament to prevent the Parliament being in essence closed to force through a new deal breaks given your legal background what are the chances of success here I'm not sure what the chance of success on that will be I wouldn't wish to hazard a guess I also think it's probably going to be unnecessary because the consequence of the vote in the north bill last week I think makes purgation as a tool for achieving a no deal Bracks against the wishes of a majority of the House of Commons not completely impossible but almost impossible thank you very much for speaking to us this morning the former attorney general the Conservative M.P.
