And this is news Dr with the very Stuart tonight a landmark legal ruling into whether parliament must have a say before official Breck's that talks begin is underway at the Supreme Court is a case essentially about process but process in the most fundamental constitutional sense about who has the power to do what Italy's prime minister is set to resign after the failed to win over voters in a referendum and one year on from the storm Desmond will find out if the areas affected have recovered or if for the full brunt of storms this means hundreds of people evacuated from their homes hundreds of thousands of pounds worth of damage caused. All of that between no and 631st the news from amendments Hulu Vanny thank you this Supreme Court has begun hearing a u.k. Government appeal against the ruling that it needs the approval of M.P.'s to begin banks it ministers argue they have historic powers to act without further permission from parliament later this week the court will also hear arguments in favor of the Scottish government having a say in the triggering of Article 50 political correspondent Nick here at least says the law to advocate will maintain wholly dude has a legal right to be involved in the process he'll argue that parliament needs to vote before article fair. They can be triggered that's because he says the constitutional arrangements which apply to Scotland make it clear that it's for parliament and not the government use executive power to make that decision but the u.k. Government disagrees they think the referendum result gives them the power to make that decision and later this afternoon Lord Keane who's advocate general the u.k. Government's man on Scots law will make that case in a Scottish context understood to be from Scotland has been stomped to death in Lapland the Santas a fatty team of Jorgen Aziz Christmas themed excursions to the northern finish region has confirmed a member of staff has died there and says it's working with the Finnish police in development authorities to support the investigation that is now under way the eldest son of a murdered 5 pensioner has told the court but his mother always spoke favorably of the woman accused of battering her to death with a ruling pen Sunder we had denies carrying out the attack on media logo in January this year claiming she was elsewhere and leaving at the time trial at the High Court in Edinburgh continues the prime minister of Italy materials he is formally tending his resignation to the country's president this afternoon he's standing after he was convincingly defeated in a referendum on constitutional reform opposition parties have called for an immediate general election politicians across Europe have expressed concern about the instability caused by the result but the market reaction has been largely neutral Fisheries Minister Fergus Ewing has told fisherman he's determined to protect e.u. Is not key to the sector's future success we're funding with regard to the catching sector emerged about one. 1st set of landing it's a very welcome if it's there of course we'll use it but the industry does not turn on incoming funding re industry terms of a sustainable nitrile resource and we're hoping the president will allow us considerably more sustainable natural resources properly managed by us so the European funding is welcome but if it projects are worth funding they'll be worth funding after breakfast as well the British Medical Association is calling on the Scottish government to ban smoking in vehicles completely it's welcoming a new law which has not come into force making it illegal to smoke in a car when children are present but Dr Peter Benny be any chairman for Scotland believes ministers should go even further the bill to protect youngsters from secondhand smoke was approved at Holyrood last year it was launched by the Liberal Democrat m.s.p. Jim Hume other countries in the world like or states of countries in the world in Australia and Canada the broil in the se legislation some years ago almost overnight there was a change in drivers behaviors and the very peak few people were actually fighting because they were we're off the dangers of fighting and they changed the behavior so that's what this is about and it's something we should celebrate 60000 children every week in Scotland will not be protected the former head of world football sent Blatter has lost his appeal at the court of arbitration for sports against a 6 year ban from football it was imposed by the ethics panel because of a so-called disloyal payment of more than $1500000.00 pines that Mr Potter made the secretary general of cast Matthew reap redeye thrilling the appeal of Mr Blatter has been dismissed Accordingly the decision rendered by the Fifa appeals committee in February of this year remains in force and Mr Blatter remain banned from taking part in any football related activity at national and international level for 6 years and must still pay a fine of $50000.00. Into the weather now a giant Clear start to the evening will see temperatures falling away sharply widely dying to minus the year around minus 6 and as low as minus 9 in some parts of Campion and the highlands are widespread frost to run to and some freezing fog patches in places sub easterly winds will freshen across the far side of the west bringing some effect by morning you're listening to b.b.c. Radio Scotland and supporting 8 minutes past 4 so the highest court in the u.k. Is hearing a landmark case to decide whether the government has to get parliament's approval to start the process of taking the u.k. Out of the European Union ministers want to avoid a vote by M.P.'s and of challenge to a High Court decision which said parliament must be consulted James e. D. Q.c. Set out the case for the u.k. Government he argued that the use of provocative powers by the government would be lawful in the circumstances without a parliamentary vote it is indeed the case that the progress of powers in question of ancient. What that implies we submit is a long standing well recognised set of laws can properly be recognised as both firmly established in our constitutional arrangements and as having real and continuing value in contribution to effective government well before the case got underway the president of the Supreme Court Lord Berger ordered that the personal details of many of the people involved shouldn't be published he said that decision had been made because of some of those involved receiving threats we've made this order largely because various individuals have received threats of serious violence unpleasant abuse in emails and other electronic communications. Threatening and abusing people because they are exercising their fundamental right to go to court undermines the rule of law anyone who communicates starts threats or abuse should be aware that there are legal powers designed to ensure that access to the courts is available to everybody. Well Martin I see is chair of the group lawyers for Britain which campaigned to leave the e.u. He said it was clear when the government put forward legislation for the referendum that the decision rested with the British people and he said Parliament would get to say later in the process what we're talking about here is simply triggering the decision to leave but we're not talking about subsequent footnotes like you go see a show like the changes in domestic law the bill would be needed later on to put into effect the need to go shopping to bring the European Union College of course has a full role was simply here talking about the decision to leave and triggering Article 50 is an inevitable consequence of the decision of the British people in the referendum well later in the week it'll also be argued the Scottish Parliament should have a say in the process Tobias law collectors and law at Edinburgh University he says the Scottish government could face significant hurdles in its case what the Lord Advocate needs to convince the Supreme Court off is not easy because 1st of all they will need to ensure that the High Court judgement is upheld if it isn't an astonished government's argument falls apart they will then have to argue that the serial convention which is a convention it's not laws and it is only politically binding can actually be decided on by a court which typically only decides a bad law and then they must convince the court that the Convention applies in the 1st place well hearings expected to last for days with the judgement Jew in the New Year professor of European Union Law Cambridge University Catherine Barnard says is the most important constitutional decision of a generation the whole bricks process has brought lawyers and politics of political scientists in very close proximity we are on the cusp of law and politics and I think this case is being heard absolutely rightly is being heard by the. Court it's not a case about trying to stop Rex It is a case essentially about process but process in the most fundamental constitutional sense about who has the power to do what Professor Katherine Barnard to move more in that story later in the program. Now Whirlpool has been accused of putting its customers in danger by feeling to fix faulty tumble dryer is a year after a safety issue was a dent a fight the brands affected include certain models of Hotpoint indices Prue line and Swan dryers which have been involved in a speech to fires the consumer watchdog which has been investigating how customers have been treated and it says the results are disappointing I heard more from which is Pete moody Oh it's incredibly disappointing one year on from the start of this scandal we've done more research at which to look at what well Paula doing for their customers with affected tumble dry is and our undercover investigation has found that affected customers are potentially being given inaccurate and dangerous advice by Whirlpool we found the process is still taking far too long with some customers being quoted 6 to 12 weeks just to get a customer identification number and that's why at which we think that Whirlpool can't be allowed to continue letting their customers down in this way they need to clean up their act and they need to sort out this mess yeah I mean one in 5 still waiting for the machine to be repaired or you don't just seems incredible doesn't it that people are waiting in this kind of way we've also found that those people who did get a replacement or repair to their dryer said that they were dispatched satisfied with how the money factor it handled the situation and then we have the situation with the coal centers as well we made $30.00 undercover calls to the whirlpool cool center to find out whether their advice was consistent and accurate and one of occasion a mystery shopper was told that their machine wasn't affected despite the fact that we provided the call center with a model number that we knew was affected and they were even told to throw away any letters they received about the safety notice in the rubbish and I just think that's really really disappointing and worrying advice given that we know that these machines are a fire risk and well pull needs to act. From this research and they need to sort out this mess yeah when you mentioned dangerous advice presumably any advice which puts somebodies mind at rest which is incorrect is dangerous in this case Absolutely and we've seen the investigation in recent weeks by London Fire Brigade You may have seen about the the big fire that happened in Shepherd's Bush which London Fire Brigade said was as a result of one of these tumble tumble dryer is catching fire and so we have to take this issue seriously it really is a potential risk to people's homes and that's why we think people should stop using these machines until they've been repaired or replaced so it's really worrying that when you call up the call center as are a 30 mystery shop as did to get such inconsistent and in accurate advice from the call centers What advice are people being given in terms of using them before they're fixed Well a lot of them are being told to just simply sit with a machine and watch it whilst it's being used and I think you know for most families out there who have very busy lives that just seems like advice that would be very difficult to follow and actually we just think that people should stop using these machines they are a fire risk they are dangerous as a result and people really do need to get them repaired or replaced so our advice to people would be I mean 1st and foremost find out if your machine is affected they will be hot point machines into sit one creator prone line tumble drives some models for me of those brands you can go on to the which website which dot co dot you can find out if your model is affected if it is register it with well pole so that you can start the process but in the meantime if you find out your machine is affected please stop using it until you get it repaired or replaced Do you have any idea at this point as to home many of them have gone and fire Well I mean that we don't need the individual investigations that have come to light we've heard stories of people across the country who have had fires as a result. Of course we had this big big blaze in Shepherd's Bush with many many people affected and so it really is a significant risk and we need to remember that there are millions of these machines out there around 5000000 affected machines according to World Poll we recognize that that's therefore going to take a long time to fix but I think as a result of that people need to be given better information about how long they'd going to need to wait to get to replace or repair and they need to be given consistent advice from well polls call center about what it is that they should do Pete's movie there from which. 16 minutes past for the headlines the Supreme Court has begun heating a legal case that will decide whether M.P.'s must vote before the government can begin to withdraw from the e.u. a British woman working for a Christmas themed tour company has been stabbed to death in Lapland and the British Medical Association is calling on the Scottish government to ban smoking in vehicles completely Peterhead prison one camp Scotland's most notorious criminals under lock and key you have to understand that this place was trouble at all times and was even the scene of a siege which the a.c.s. Ended you were beaten hostage you're hungry to do research report. But remember that it's a museum the doors are very much open everything you left at the telephone was a present you're going to get there to the right of the story our story returns as Mark Stephen and former officers visit to look back at what it was like to work there during the move turbulent of leaves some person also should start the 1st day they would realize it was a job for their starts tomorrow at 130 on b.b.c. Radio Scotland. Now 6 new affordable homes have been officially opened today on the island of Hatteras the housing development and Haga Boston also includes a community center which has business units office and studio space and a performance Sadia all with a stunning view across to the side of town and say Well I spoke earlier to John McKeever director of operations at the Hebridean housing partnership who built the houses this 6 host develop and we have taken forward with in partnership with West harvest trust in particular. Which is supported financially as well by the cooler and by the Scottish government it's a mix of $32.00 bedroom houses and $33.00 bedroom houses and provide no opportunities for Father lease in the area to access the high quality housing on the opportunities to work and remain and the area which it might not otherwise have Hi How are you going to decide who actually gets these houses and the houses have just been allocated and they've all been allocated to people 'd living on what's going in the area so it's good to be able to retain population and what's quite a flood child community at the moment yeah hi big Our problem is affordable housing in the islands I think the biggest challenge facing the islands at the moment really is. The population and the ageing population. So I think it's important that developments like this you know provide opportunities for people to remain in the island and where that's also acute both to economic activity which is being taken forward on the site by the waste harvest trust themselves your home port and does it have these agencies and indeed the government involved the government of course has a commitment 250000 across Scotland Yes And I think that's a big challenge for the housing sector across Scotland. Certainly very important in the local context to you know how these resources come in and because it also delivers job locally but important to us working at partnerships with other local agencies to make the most of the opportunity so it's presented by the government's commitment to the 50000 you houses and to make sure that you know we deliver us much as possible of thought and. After this presumably it is something you want to be looking at doing more of in the future because obviously 6 Holmes is great but it doesn't go that far yes that's right and we do actually. We have well attended a good night for 50 houses and Stornoway later this week but we're also pushing opportunities right across the Island Sound and then as we're looking not trying to acquire a couple of sites at the moment and target John McKeever there from the Hebridean housing partnership. Now a former Marine has beaten a grueling insurance record by completing the Ramsey's round challenge in winter with a time of 23 hours and 6 minutes 12 faster than the previous 132 year old Donnie Campbell set out on Friday night in subzero temperatures I asked him what made him do that the Rams are going Kamber and 1978 when Charlie Ramsey was 1st person to ever run for Monroe's carrying starting from Quinn never you Fausto and doing Transformers right in the harbor at the finish times in mind it's almost 23 hours 50 minutes 24 minority was involved 90 calm and enough eyes and ears of a sense that's almost I never said I had some challenge and one me do you want to do this particular one I've never heard of the challenge until I think must invite 2012 Charlie Rams. Because by Ron joined by and has experience in what it was going from there a kind of planted the seed document is a. Great fun just like a really good challenge that because I do a lot of racing in the summer I run ultra modest and mainly on housing on trails and I've never really had the time in the summer so I would see people done in the one hour. And they'd been 6 went to the tents I noticed John Gay and. For teams only person to have a complete around you going on there 24 hours and he's done it in 20 feet a deed our. Idea came a day of Ok can I 1st complete around June went and secondly could I get closer could be a record that went to record. For the idea came and I must have been really tough to do it in winter What was the hardest thing about it all. Really challenging the darkness is Jalen ging to all hours of darkness the most challenging thing was actually snored on the 1st night so I start at 10 past 9 on the Friday night and by the time I reach the 1st summit starts snowing in the snow it's hard by for the odd minutes which meant the top all got a nice white covering of snow which was great for heating purposes but I was terrible on the 5th course on the fit you had and I have fools and an angel was lying on top so you weren't getting much crap from shares and I tried to make the specs like many competent not to name much difference either so on the steep descent I was losing a lot of time could barely stand up never mind will run down that more so yeah the trickiest thing is by the down the line is getting the weather window again conditions that means you actually complete their mind when you must be shattered I was in the side and I had them feel pretty bad I think my foot turned to go me bet considering everything I don't feel too bad this morning but inside and I felt that about home. I couldn't eat I just lay there lay in bed just feeling sorry for myself in punched in the record I was at NOCCA dot tired and not nauseous I just. I just wanted to sleep I was absolutely if you just said I couldn't really think of anything my phone was going crazy of congratulation days meshes I just then even look at anything and just go back to the hotel room and lay dying and kind of slept for but probably 3 or 4 hours name will cough and kind of felt a bit more human again and that's kind of when I started taking and that actually managed to achieve what I said today and yes still hasn't sunk in this morning been a bit overwhelming of all the meshes of so soft core and congratulations it's sad to do at Arsenal challenge and just kind of going to that crazy man. Donny Campbell there speaking to me airily or no Jimmy's here was today sport I was hoping to appoint him Cathro and Austin McPhee is the club's new coaching team following the departure of Robbie Neilson to m.k. Dons talks to place over the weekend with Cathro who's currently with English Championship leaders Newcastle United make fees also in contention for the role of performance director at the Scottish f.a. Meanwhile he has also spoken to Hearts and is we in his options well of Cathro as indeed the pointed hearts next head coach will be reunited with a familiar mentor at same castle as a reporter Alice the lemons explains as long as no unexpected hitches arise he will be the next head coach at Tynecastle he began his coaching career with his own set up in Dundee Videotron to the attention of Craig Levine no doubt it's a football at hospital the same manager have done the United the moved to United to work in the youth academy but he was involved in the development of players like Brian golden join Soutar who is also no top seed in what Frost pale as a coach one of the Scottish Football Associations performance schools before hooking up with a Portuguese coach by the name of Newell son 2 who we met on on a safety coaching course knew to come to Rio Avi as his assistant before the pier moved to Valencia in Spain following out Steve McClaren invited him to become his number 2 at Newcastle and then McClaren was subsequently signed Cathal was kept on as part ruffled beneath his coaching staff well that was a reporter Alice the lamb and you had there mention of Steve McClaren The former Newcastle United boss new in charge at Darby Kenzie MacLeod and describes ca through as a forward thinking coach and says he could thrive under the guidance of Craig Levine Yeah I mean he's young. He's very analytical engine every bright forward thinking. Can one of the modern coaches coming in and I think the key advantage you know is if and you will go into management eventually some station if it says the club then I can see that because Craig Levine was his mental from. Many years I think it could be good partnership. Managers need guidance and need mentors and you know what with the info for nearly a year and we you know re said this is an education for bigger things and he might get the opportunity will Celtic in Manchester ahead of their final Champions League Group fixture against Manchester City tomorrow evening the City striker said is available despite being handed a 4 game bond for a reckless red card tackle on Chelsea's double Louise and Saturday was a challenge which prompted a fractious finale to City's 31 defeat of what was boss Pep Guardiola though says he hasn't decided whether the striker will feature against Celtic will be changes tomorrow definitely because I'm so happy to give me an incentive people who deserve to play in them playing the last. Thinks the u.k. Government has a strong case because there's an important constitutional principle involved there are important legal questions involved and I think the divisional called got it wrong and obviously because it's appealing so does the government so they're quite right to to use on the good person says it's perfectly right for anyone who has a right of appeal to make use of that right and I think the government's right to. Take the go to the supreme take the case to the Supreme Court on Wednesday Scotland's top law officer the Lord Advocate will argue that Hollywood should be consulted on the triggering of Article 50 Secretary Michael Russell said leaving the e.u. Would have a profound impact on Scotland and he argued that the distinct Scottish legal system and constitutional traditions meant it was important the country had a say a British woman working for a son to Safari to a company has been stomped to death and not planned the 26 year old understood to be from Scotland was fined dead in the village of Catan and in Finland and Saturday the Finnish police have arrested a 36 year old man who thought to have been her boyfriend 28 year old man has appeared at Edinburgh's share of court charged with murder kit and Davis appeared in private and made no plea or declaration his appearance follows the discovery of a man's body in a fight in Scotland Street in Edinburgh's new town last Friday European politicians have reacted can lead to the outcome in the Italian referendum saying the result will not cause a crisis the prime minister materials he is standing down after he was convincingly defeated in the pool he called on reforming Constitution Done Abba hard reporters on his way into a meeting of Eurozone finance ministers in Brussels the e.u. Radio Scotland thanks Amanda No Judith Ralston is here with the weather forecast it's been a fairly cold days only in Glasgow Yes I think temperatures actually struggled in Glasgow to even get to freezing. Many parts are actually the same and they're called dry conditions stay with us as we head through the evening temperatures already falling we sharply widely down to minus the to minus 6 Celsius and as low as minus 9 some parts of Grampian the Highlands so that of course leads to a widespread Frost some freezing fog parties will be formed once again but across the west and all staying rela Buffy's into night and similarly across Shetland south easterly winds will freshen across the far south west bringing some thicker cloud into here by dawn tomorrow morning so for the most part tomorrow is another very cold start with some freezing fog around once again and that widespread frost but a dry start with early sunshine for many so that collide in the Southwest Herald to change it will slowly extend north and eastward bringing with it some mist a little cloud and Hill for within it is also introducing milder air so that combination of the mild there on the called ground leading to these rather murky conditions will see the 1st signs of some rain into the west coast during the afternoon but for daylight hours I think much of Scotland stays dry the best the sunshine across the north and indeed the north last feeding well too it will feel cool the with these murky conditions moving in daytime highs for around about 4 or 5 Celsius around 68 and cool Still it is over by even time temperatures will rise will see things becoming noticeably milder rain crossing the country during tomorrow night then Wednesday it's a fairly cloudy day with our rigs have been particularly across western is and that is persist most persistent over the Northwest Highlands lighter patch here in the east with actually some brightness and sunshine for North Sea Coastal is we could see highs believe it or not a 15 Celsius for money and Aberdeen shirt by Wednesday as your forecast. News dried on b.b.c. Radio Scotland. No for 5 months Britain's vote to leave the European Union has been shrouded in uncertainty the shuttle is for the formal process to begin in 3 months but as issues heard at the Supreme Court does the Bracks it debate from the other side of the North Sea for business in the other member states Britain's exit could be an opportunity in France there's an attempt to draw it to tease away from the U.K.'s finance sector but for many firms and their workers it's a threat how are they preparing and what outcome do they want from negotiations between Europe's governments business and economy editor Douglas Fraser reports from Belgium. This is the Flemish factory between Brussels and the English Channel coast of Smit staircases. A festival for the fire that is fine so we can pound made it more difficult to make in euros and sell it starting the prices look likely to rise next year by years of trading with Britain such as Thomas are diverging regulation would make the trading challenge even steeper Peter Castro is managing director of its British subsidiary. If it was down to hard rock says and it goes all the way to import taxes and together combined with very low exchange rate it could mean that we it's very difficult to sell what we what we make. Belgium isn't just the seat of your government it's also a big hub for trade and here the 4th again this is where Honda brings cars built in Britain and they're distributed from here right across the European Union just across the road here a very large factory where they make a Volvo cars and many of these cars will be going to the United Kingdom it's claimed by Brick City years that the European Union's big companies led by German carmakers will demand their governments retain open markets because they have complex supply chains and to sell competitively in Britain so Britain has been leaning on companies to make that point to politicians in European capitals and yes business here wants or close relationship with the u.k. But not at any price business Europe is the umbrella group representing corporations across the continent with the c.b.i. As its British member Marcus bearer is director general we want to maintain as close as an economic relationship with the United Kingdom as possible and we do not want to citizens and the companies to pay the price for this political decision but at the same time we are also very clear that we do not want to do it at the expense of the integrity of the single market so no special treatment once you open this door there might be many member states coming with possible exception requests and in the end you might end up with Suisse Cheez Whiz more holes than cheese trade unions are aligned with the bosses on break said but with concerns that breaks it could bring job losses and that Britain will want to undermine workers conditions for maximum hours to health and safety look at decent teen. He is secretary general of the European Trade Union Confederation He's been watching Britain's tactics since the vote in June and if years they could lead to a vicious spiral where everyone loses at the really beginning of the process after the referendum the u.k. Government I mean to play member states of the European Union against each other but fortunately according to the rules this is not possible and we will see it of we'll be single negotiators if there is no positive outcome out of the negotiation the risk of having a fragment that situation and then some some kind of that was spiralling themself and with local officials is very high this is something we would like to avoid this being the consensus I find in Brussels is that there is little desire to punish Britain for rejecting the club and the break to tears for belittling its ideals but there is a determination to ensure that the terms on which it trades with Europe in future leave it no better off as a result of leaving the club Fabienne zoo league is chief executive of the European Policy Center and an advisor on breaks it to the Scottish government if there's a hole that there's a division within the $27.00 about Single Market access to what kind of conditions you have to fulfil together I would say that is a very slim hope indeed that's our business and economy editor Douglas Fraser reporting from Belgium. Now e.u. Leaders of play don't fears that Italy's referendum yesterday which the government lost is the beginning of a new crisis for the eurozone the Italian prime minister material Renzi had proposed changes which he said would cut bureaucracy and make Italy more competitive but the vote was widely seen as a chance to register discontent with his government Mr Renzi has now announced he will resign throwing I mean they need the no campaign has won in a very clear manner Congratulations to the leader of the no campaign that we have tried but we haven't succeeded wants him congratulating Betty Greil comedian turned political leader Well a new campaign capitalized on a sluggish economy the issue of migrants and a white sense of anti establishment feeling the likes of we have been doing recently in Britain France and America here is a senior and young man who is on economy it is a tremendous revolution and I hope people come in they'll be normal text normal stealing honesty will come back into fashion at the heart of the market Ok this is a dream. But what does his 5 Star Movement stand for and what does the future hold for the country will professional model is an expert on Italian politics at the University of Naples Good evening. To you at that sounded like like a big dream there are you know home real is it likely to be well actually I mean it's just works to follow you know that. Good feature of serenity but reality is going to be pretty different. What do you expect to happen no. Well there as being the risk nation for the prime minister and the and that it is going to be a new government I think in a rather short span of time and the problem of this go to man is going to be pretty much in continuing the with what a wrenching 6 activists being doing in the last 3 years it's been a very lengthy and stable government by China standards and one should not forget that while on one side Brant has suffered quite a defeat 40 to 60 in the referendum that still needs to tell the over 13000000 votes which have cited by the Premier and with an aide by China standards that's and I'm president the number of people standing by just one leader and the spotty one on the other side we haven't that you know quite a confusion all in a radio values anti establishment and center right and left of the take a left I mean there is a whole number of products which share just about anything but they all position to 20 sous anything lately to change. Well the changes are in the in the fact that there is going to be a new premier and of course there is going to be a lot of pressure for elections the sooner the better which I think it's not going to be the case it will definitely move towards the end of the legislature the natural end of that age the nature which is going to be by summer $218.00 and meanwhile it is going to be time to make for a new electoral law which is badly needed because the Senate has not been abolished I mean a reform but it's still there so that is at least this basic required and which is going to take knowing each other and party politics quite a bit of time so basically it's an anti establishment vote that we're not entirely sure what we're going to get in the end. It is it isn't like that and of course on one side you know one might wonder why did Raincy call for this referendum in the 1st place but it is also true that he was trying to get somewhat out of the traps of the Tri-Polar system you see Nick said we have a situation now we have 3 polls at the center right at the. Democratic Party and then the Grillo entire 7 ish meant which are just about the equivalent in the polls so it is almost impossible to make any sort of a majority with 3 poles of one 3rd of the electorate so he tried to make this referendum as a way to force the electorate into one side or the other and he lost that as you would say lost of ran by this just one 1st Randall that looked pretty lengthy confrontation so basically if you're going to get more stable government it'll take what constitutional change instead. I don't think so there is not going to be any harder constitutional reform I think of the next 20 years I mean after after this camp which has been reported we should not forget from a wide majority in the Parliament after once it became a good turn for the electorate to many of the parties which are for it in the parliament for this reform decided to go against Ranchi So which is typical of a child and trust for me so you know like going back for one place to the other and so I did not expect any marriage or attempt to constitutional reforms in the Syria true we have only to wait and see if any alternative comes from this while every of our parties which is not probably going to be the case all is right she's going to be wrenched out in its place maybe after one year or so of that's a stepping back for a white professor America thank you very much for speaking to us. Good lines 14 minutes to 5 the legal challenge over the u.k. Radio Scotland. No shouldn't be will become the 1st Japanese prime minister to visit Powell harbor the scene of his country's surprise attack on the United States today in the 2nd World War this symbolic gesture follows President Barack Obama's trip in May to Hiroshima which was devastated in 1945 by an American nuclear bomb well asked Richard Lloyd Parry Asia editor for The Times in Tokyo how historic this visit will be just so that you can say it is it's the 1st time any prime minister has been to pro Harper and you know I think up until very clear years ago it would have been hard to imagine it was as. It was called at the time an infamous attack feelings remained very small on the American side until very recently so it shows how far the 2 countries a common relationship what's brought about that change well. Is in many ways controversial and unpopular with some people at home although he still convincingly wins elections but he does very well on the international stage he's very well traveled he's visited more countries and met more leaders and then the other Japanese prime minister before he makes a point of you know going out of his way to be a diplomat as well as a national leader for Japan and you know Japan has always got on very well with the United States certainly So you know the comfort of the president elect comes in that's been the case so it's not a surprise I think they probably the key thing is that a few months ago 6 months ago Barack Obama became the 1st u.s. President to visit Hiroshima which of course was another very historic moment he gave a very powerful speech that about the importance of peace he didn't touch apologize for the American Trucking the Tommy bomb but he you know certainly came across very sympathetically and it went down very well in Japan and although no one is saying so I think we can assume that this is the crypt the quid pro quo u.s. President went to Hiroshima about his had now the Japanese prime minister will do the same in Kohala and want to be expecting Shinzo Abbey to do when he gets there we haven't really had any details yet you know he'll no doubt visit the site the various memorials that that will be shown round you know there'll be some attention given as there was with Obama in Hiroshima to the body language will the power he's had how to eat with the pow this kind of thing there are people in Japan who you know who will feel uncomfortable at the idea of of. Japanese leader bowing his head like that but really to go on is not all that many now I think most people would be quite happy with the idea you mentioned that there had been this reply between Shinzo up and but AK Obama and how is Japan reacting to Donald Trump . Well I think like much of the rest of the world with bafflement certain amount of alarm and really just a sense that they have to wait and see I mean during his campaign among many other things Mr Trump said that he didn't like the way that some Japan sold all its cars in the United States but didn't buy as many American cars he said that Japan ought to pay more for its defense to the u.s. Military just stationed in Japan and he even suggested that Japan want to maybe think about getting its own nuclear weapons and with even just half of those things come to pass then Japan would be transformed so you know it may or may not come to that but people here are certainly watching and waiting rather anxiously as the Asia editor for The Times in Tokyo Richard Lloyd Parry. There's been a debate for years about the welfare of chickens involved in egg production whether free range is better than birds kept in sheds and whether again it makes a difference but what about the health impact in humans Well scientists at Reading University have discovered there is an impact on how much vitamin d. Is in the Ulick I've been speaking to Professor Ian Givens who carried out the research we were interested in that imagery and I think many people know that having not become very interesting in the sense that a lot more people now have a committee about them of the committee status than was thought and. There are not many diet resources in the most of it and it's only the spin assume that we produce enough of it from being out in the sunshine. Not to be the case and more think that more people working in drawers and with more use of sunscreens when people are in bright sunshine it means that we have to be much more interested in in the dietary sources that today. We have the thought that that egg. Which are a reasonably good source of it and not many good sources of sources. We have the thought that perhaps eggs were produced from birds when I was Dawes that we have some exposure to Sunshine mines have high have it in the eggs that were produced didn't go outdoors. So that's what we did but we have to remember this was a retail study so it was based on purchases purchases of eggs from Sears or supermarkets for over a quarter of a 5 month period and so we were entirely reliant on the label x said but we thought that was sensible because that's what will guide. The public buying the eggs so that's what we did and what did you find then Intel we little different categories Yeah we were Gannett feedings and shed yeah we looked at the 3 times as you say eggs from birds or windows all the time which would be cages or whatever. And free range organic and of course we understand anyway that organic systems include. Birds happen to happen to be free range as well so what we found was that there was a significantly higher. In the eggs both from the organic and the free range compared with birds to indorse and their Gannicus were better than the feed into very very marginally we actually looked to different forms of it as the sever forms of the most common one. As for Timothy 3 the free range and organic were identical in terms of the $23.00 we also looked at the $25.00 hydroxy d 3 which is the form of it and these are the liver produces from the 3. Which occurs naturally in foods like eggs and indeed you're right in that case the organic was higher than the other 2 we don't know why that is and I think we have to bear in mind this is a relatively small study and I think you know if that's if that's a real effect then we would probably need a bit more evidence for it but we did find that what you said is correct so what conclusions can you draw mean do we know that if we eat foods that have these vitamins and then we absorb them to we do we haven't specifically looked at x. But I think best in all that we do know to be almost certain that we would absorb them from eggs and so would these differences then be significant if you were consuming eggs regularly Well they are significant statistically I think it is a question whether or not there would be nutritionally significant if I just give you an example of what I mean one egg yolk from from the from either the outdoor or for the for the organic would contain about 2 micrograms of it and. Now the current recommendations is that we should be consuming about 10 micrograms per day soon see that would represent about a 5th of of the total but nevertheless it would be consistently more than it would be if you consumed x. Windows. But I think you've got to bear in mind that it's still a relatively small contribution to the overall dairy requirement if you like Professor Ian given there from Reading University. A new bandage has been developed by scientists from the University of Bath which turns color when the wood becomes infected clinical trials are underway using samples from birds patients from 4 u.k. Hospitals it's not the color changing bandage will provide an error warning this infection is developing and will lead to better treatment for patients Dr Amber young from Bristol Royal Hospital is leading the trial Good evening hello nice to talk to you nice don't you too thanks for joining us just tell us a bit more than about how the bandage works of course so one of the biggest problems with patients with Burns is knowing if they have a real wind infection it sounds strange but we actually cannot diagnose this at the bedside what we have to do at the moment a patient comes back with the temperature for example we have to take their dressing off which disrupts the healing process we have to check whether the bacteria under the dressing sending samples off taking the test and actually using antibiotics before we know if they have a wind infection and we generally don't know that for a couple of days when the tests come back so this dressing has a very clever technology that allows you to tell by a color change in the bandage whether there is a true wound infection a real clinical weaned infection at the point that it happens and so how does that technology work is fast making my clever scientific colleagues at the University of Barth make Nonna capsules tiny tiny little vessels fractions of a millimeter imbedded into addressing that have pores in the best Sickles that is sensitive to the toxins of bacteria that causes the pores of the vessel to open and let out what's inside the best which in this situation is a dye a yellow dye so when the toxins hit the vessel in the dressing the dressing releases it's dye in turns yellow and so has the trials been going so far well we only started last month but we've got a number of patients already everyone is very excited about it it's funded by the Medical Research Council and over the next 18 months or so we hope to test the sensitivity and the specificity of the dressing and get it through to for. Imagine a couple of years so this could be one of these things that you actually see and use pretty soon compared with an awful lot of these medical trials that seem to years to develop we very much hope so because as a doctor I worry about it every day at the Children's Hospital I worry about whether patients have an infection I know that I'm over using antibiotics so this would be a real help so just how much of a threat then is infection in a burns unit it's a very it's a very big risk but the worry is that that although diagnosing infection is important we also want to know those patients who don't have infection where the bandage won't change color and in those patients we won't take these antibiotics we won't get them up a man fairly to hospital and they want to carry test on them so the negative is just as important to us as a positive and is it possible that in future the bandage will be able to detect which bacteria is there yes that's a good question that's what we hope there are some common bacteria that we see commonly but it would be very helpful to know exactly which bacteria that is and be specific about the antibiotics so we can get targeted health care Ok Well thank you very much indeed for speaking to us that's Dr Amber young there from Bristol Royal Hospital who's leading that trial just a word about programs to come here and b.b.c. So it was able to tell anybody about what was happening to know not at the time and not for 10 years and fight he says he finally told his then wife and parents in 1993. Before going to the police as it happened to Stevenson died in 2004 but the Police Scotland confirmed that investigations were done in the ninety's and to Mr Stevenson and fair was were passed to the procurator fiscal and peace is that he was told that Stephenson was initially arrested but he didn't hear any more about it from the police he says he believes he never Stevenson as faced trial for the allegations that he made and were waiting for details on this from the crown but be says he did try to raise the alarm with the Scottish Football Association since this was after all on an essay fee match official as well as a youth team coach who worked with clubs across the central belt including the very well known east of Craig's in the East based in the East End of Glasgow and fearlessly united in peacefully and peace says he was invited to a meeting at the n.s.a. And indeed grateful to Peter Hans for for having the the guts and the bravery to come forward that Mr Reagan was also pains to try and reassure parents who send their children to football every weekend that they're safe it today operates as 0 tolerance policy towards any sort of child abuse and the various procedures policies and directives are in place to prevent anything like Peace story ever happening today Mark Daly thank you for that and you can see more of Mark's story in Reporting Scotland and Scotland 2016 this evening I. Know the u.k. Government should be allowed to trigger Article 50 starting the formal process of leaving the e.u. That's the argument top lawyers have been making this afternoon in the Supreme Court in London the court seating an appeal against a decision last month that the Westminster Parliament needs to vote before Article 50 can be invoked in a sign of the tensions around the case the head of the Supreme Court said some of those involved in the case had been threatened with violence well today is the 1st of 4 days of legal argument political correspondent Nick Eardley is following proceedings in London so Nick perhaps you could sum up the government's. Argument and well various all of the u.k. Leaves the e.u. Not if it does it's a process question and in its simplest form the u.k. Government is arguing that its ministers can use executive power what's being referred to in this case is the royal prerogative to trigger Article 50 that the referendum gives it the right to start this process based on the will of the people of the u.k. Lawyers for the u.k. Government of Spain to be arguing that the ability of the government to make decisions on treaties and international context is crucial for the good running off government they say this context the decision to trigger Article 50 is an all vs example of where it can be used now as you said in the start the debate here is over what role parliament should play whether it needs to be consulted whether it needs to vote the u.k. Government is saying today that when the Westminster Parliament decided to hold the e.u. Referendum in the 1st place it knew that the result would be ordered by the government they would have to take these steps like training Article 50 to start the process of leaving the European Union here's the here's Jeremy right who's the u.k. Government's attorney general it is the logical conclusion of a process in which Parliament has been fully and consciously involved a process in which prominent resolve to put a clear and decisive question about our nation's future to the British people and in which parliament expected the government to act on the answer. That's the skeleton case that Jeremy Wright was putting Airlie on the government's top q.c. a Man code James e the was a law the softer it and times he faced quite intense and quite prolonged questioning from the 11 justices who said the P.M.'s Supreme Court is the 1st time today that they're all sitting together they were questioning things that whether the argument the government had previously. We've been able to change the rules of e.u. Membership maybe they should be able to decide to leave completely he's going to be finishing off the argument to morrow and there's might be more intense questioning of any of the counter-argument yet not yet today's been dominated by as I say the u.k. Government's case to continue tomorrow morning to we do know however the bones of the main argument of those who are arguing against the government they've already made submissions to the core laning them essentially their case would be that because e.u. Membership gives people Saturday right which were created by parliament which exist in legislation they can only be removed by parliament and through another vote of parliament creating new legislation or or scrapping the previous legislation triggering Article 50 b.c. Will start the process of removing those rights so parliament needs to vote safely and that's the argument the one member of Mitchell case in the High Court that's the one the government the u.k. Government is appealing against that is also the a Scottish element here when do we expect to hear the arguments and Holyrood will that is that is judged to be had later in the week the Scottish government's top law officer that's the Lord Advocate James Wu has been allowed to intervene in this case and he'll argue that because leaving the e.u. Will have an effect on devolved areas the Holy Writ should have a say as well as the Westminster government there's a process already where Westminster can so with Holyrood what it wants to and act legislation which impacts a devolved in devolved areas he wants that to happen here to more Whately he will say that Scotland's constitutional arrangements mean that parliament not the crowd or the government using powers which of come from the crowd can make the decision the u.k. Government will argue that the royal product of carrots as much for Scotland as it does the. Yes to the u.k. And it rejects the idea Holy Writ needs to be consulted firstly because foreign affairs are tied to Westminster the Scottish Parliament has no power over them but also says look there's no law before the court here so it's not really up to the justices to pass judgment on whether or not there needs to be kids St from Holy Writ complicated by a portent legal argument we'll hear more about that side of things I think a way to stay Nick thank you very much Nick Eardley at Westminster. No new scientific study has filled a 25000000 year gap in the study of dinosaurs thanks to some 4 legged Scottish fossils is found 5 new dinosaurs and bits of 7 more well the findings have just been published in the journal Nature ecology and evolution and our Science Correspondent Catherine Donalds here to tell us more so what's it all about well it all kicked off will even before I was born actually 358000000 years ago and that's when the bit of the earth's crust that was going to Scotland was bashing into what is no England or Wales it's one called what's called the late Devonian period and it ended with a global mass extinction as one of 5 such mass where he posts of species that Planet Earth has seen so far it was a key moment in evolution of life on off the 1st 4 legged creatures called to trip ords who really began to appear but there's been a gap in the fossil record of drop off or mentioned 25000000 years now in geological time it's a bit like a coffee break. But it's it's it's a huge gap in our knowledge and afterwards tetrapods stopped looking quite so much like fish and felt like a bit more like the teachers of today to being scientists in the name for what they don't know the pedia that the missing piece is called rumors gap and it's been a priority for us to fill it so who's been doing this study was the lead from Cambridge University and it's good contributions from researchers across the u.k. Not least national museums of Scotland the British Geological Survey in Edinburgh and interestingly the authors acknowledge the failings of the late Stan woods now he was a largely self-taught fossil hunter Hitam his enthusiasm into business Mr Woods fossils on the low Mr Wood died 4 years ago in fact the journalist who was noticed on Stan the fossil Monnet lovely man he died a few years ago the business is still very much on the go is a many ways this these finds it a memorial to his walk and so where do they find these fossils Willy's hole but it was near term site and Benteke sure there are a few other sites in the area as well like Bournemouth Coldstream North Benteke even as far away as the bottom in the heads of area but that's the main one and a bike 350 odd 1000000 years ago these are places that are right on the margin between London water just to the point where Skolem is effectively ceasing to be a bit of sea bed and had become. Rather more interesting to me but it was it was a marshy during dry spells even saw her underwater during weight peat it so I'm salute leap frame places for little things that look quite a lot like them for begins to be I'm just living on those margins so what do the fossils then tell us well that a search for a safe and 5 new dinosaur species helping fill that goal brought a GAAP rumors going up the gap in our knowledge of evolution and these species are pretty vast pond 2 of the species allium Fabian's But the other 3 are quite different kinds of early for footed creatures now why not suggest as it was a fairly heavily branching of the. Report tree if you like that the types of 4 legged animals between unfit be ans and were called. The dinosaurs that gave rise to reptiles birds and mammals in addition to that the team of 10 different fragments of what maybe 7 more Scottish famous or species so not particularly big and it was some consisting largely of bits of Joel and teeth and towards and things about but we think we've killed off a model theory which is that the gap in the record was caused by a little number of creatures speaking about it because of low oxygen levels on half the research of say what they have Luke taught looking at the charcoal of the fossilized charcoal of phone that these oxygen levels were just fine Oh obviously a very long time ago why is this is significant no they are scientists might not give us that we just have to know stuff like this because it's one of the things that makes us human the other things that make it important there are those on the I mentioned but like I said they evolved become reptiles birds and mammals models as you may have noticed of what we are as new on the oh it's no odds so in Scotland meet the ancestors thank you very much indeed that's our science correspondent kind of MacDonald. Now the u.k. Has bought the capsule in which Tim peak travelled into space and then returned to Earth the spacecraft will be puta on display in the Science Museum in London early in the New Year Here's our science correspondent pal of gosh almost a year ago tempi set off for his mission to the International Space Station now the Soyuz capsule that took him into space and return him to Earth has been bought by the Science Museum Britain's 1st astronaut Helen Sharman said that the spacecraft was an important part of the nation's space history I think it's a tremendous thing to be able to have tens capsule not just a Soyuz capsule but it's 10 rooms and the fact that we know that our rest know it was actually inside it physically he sweated inside that thing he looked outside of that window and he saw with it like reentering the earth that misfit it really provides I think with that. Link and to our own astronauts the science museum hopes that the display will inspire those that see it especially children many of whom might wish to follow in Tim Peaks footsteps into space science correspondent. Back down to earth and here's Jimmy of the sport ice very much funny in Cathro as a forward thinking analytical coach according to the Darby county manager Steve McClaren Cathro who worked under McClaren at Newcastle United as Hearts top candidate that replace their departed head coach Robbie Neilson with talks held over the weekend and at just 30 years old McClaren says Cathal will need the right guidance at Tynecastle very difficult to dinner 30 most definitely and I can admit when I do get 4041 without good people around me and mentors and experience and as long as I think this is all with managers and owners get the right people around them the right club. As a fee chief executive Stewart Regan says he's sickened by the allegations and is encouraging victims of abuse in football to come forward lawyers for the u.k. Government are trying to persuade the Supreme Court that ministers have the right to start the process of leaving the e.u. Without a vote in parliament that follows a previous ruling at the High Court that M.P.'s shoed vote 1st then right to ports at the start of the hearing the president of the Supreme Court Lord Neuberger said the 11 justices were only concerned with legal issues not wider political questions surrounding the U.K.'s departure from the e.u. This case is about the process of leaving and whether the government is trying to act on lawfully last month the high court ruled that parliamentary consent was needed before negotiations could begin but on the 1st day of this 4 day appeal the government's lawyers insisted ministers did have the protective powers to make or unmake treaties and that includes the right to trigger Article 50 of the Lisbon Treaty James e d Q c said Parliament could have chosen to restrict ministers power to act on the referendum result but did not a British woman working for a son Safadi to accompany has been stomped to death in Lapland the 26 year old understood to be from Scotland was fined dead in the village of Catan and Finland on Saturday the finished piece of arrested a 36 year old man who's thought to have been her boyfriend a man has been killed after being hit and crushed by a dumper truck in Edinburgh he was not done just before 10 o'clock this morning at an industrial site in Dryden Street Health and Safety Executive is being informed the trial of a woman accused of birthing an 82 year old Fife grandmother to death with the ruling pin has begun at the High Court in Edinburgh Sandra we are denies murdering Mary look at the pensioners who are men January this year Stephen Gordon reports the 1st witness in the trial he said he often spoke to his mother about Sandra we're a neighbor who helped made a Loki look after her cat at Christmas shortly before the 82 year old was found dead in her leave. Radio Scotland news no let's find out what the weather has in store Here's Kirsty McDonald thank you very much Friday will a very cool the evening and night to come once again with a widespread sharp frost and some phasing fog patches temperatures widely dropping to between minus 3 and minus 6 Celsius with the laws of Ireland minus 10 perhaps even minus 11 Celsius in some sheltered rural parts of the North indeed already minus 7 Celsius across the hotter Shetland will be somewhat cloudy here with a few showers continuing and side of the easterly winds will freshen across the far south waist during the night with more in the way of cloud coming in here preventing the temperatures from falling below around 4 Celsius tomorrow then dawns on a cold frosty note for most with some freezing fog patches it will however become cloudy for most during the day with some hill for some mist there will be some sunshine in the north all. Which will gradually cloud over here to during the afternoon rain will also move into western coastal areas and will spread north and east getting to morrow evening that rain will be accompanied by strengthening southerly winds touching gale force along exposed parts of the west coast eventually tomorrow temperatures will reach around 10 or 11 Celsius along the west coast struggling the way across the Highlands especially until later in the day tomorrow night's there will be further rain and strong winds across the Northwest especially and a much milder night to come to morrow night than of late Wednesday some light rain and drizzle across the north and west much of the east and the Central Belt will be dry the best of the brightness for the East Coast and Monday and a very mild on Wednesday with temperatures reaching double figures highs of possibly 15 Celsius in the ne. News dry on b.b.c. Radio Scotland though the Fisheries Minister says he's determined to get the very best outcome from bricks at negotiations for Scottish fisherman Fergus Ewing was tooting Peterhead fish market this morning fishermen voted heavily to leave the e.u. In June's referendum but there's some nervousness about the impact it will have on seafood markets from Peterhead Stephen Duff reports a Peterhead fish market this morning Bush going at the seams according to one regular 6 Chinese ng I'm told and 7 fires effects are finishing our show after the weekend funding cut their 50 you have made it out of a Among the buyers and sellers and sign your take about what leaving the you will be. I think is nervous because there is no plan how are we going to protect our fishing stocks against a European fleet with no vested interest in the future of an industry is really bright but the government hard to get the best deal possible so never snus from the fish markets. About the impact on their markets seafood exports are worth around $400000000.00 pounds a year to the Scottish economy but those who catch the fish see leaving the e.u. Is an opportunity Betty Armstrong's chief executive of the Scottish fisherman's Federation right now more than half of the fish and shellfish which leave our waters leave India in. The u.k. But nobody else does that that is is a great distortion of the Common Fisheries policy will be free of fair use using the Fisheries Minister was a visitor to Peter had this morning bucking the Scottish white vote to remain fishing communities in the northeast to leave the e.u. Mr Ewing is promising to be a champion for the industry of course we understand and I fully understand that Scottish fisherman voted with the majority to leave but my job is to get the very best outcome for the fishing industry and that's why I work extremely closely with the fishing Representatives and that's why I've asked Andrea lead some of the u.k. Minister and George Eustace the fishing minister to provide a cast iron assurance that they will not treat away the control over Scotland's fishing stocks. Because Red Fish Market is due to be expanded $5000000.00 pounds of the funding is coming from the unit piñon there. Stephen Duff reporting from the Peter head. No row has broken no to Strathclyde University after the group which opposes abortion was refused a quest to be officially recognized by the students association this is a ition says it deny that a quest for affiliation because of the group's views but that's led to concerned that the right to free speech is being denied Well for more I'm joined by reporter Andrew black so just run us through the background to where I know platforming is is is a big thing at the moment you hear a lot of baited essentially is the practice of not engaging in not engaging with someone you views which are judged to be extreme but as you were just just seeing there that has led some opponents to argue that that particular pulse infringes on rights to freedom of speech and wants Eirik stream their views are they today's story is another further example of that and just to give you a bit about grains this group which is pro-life or on 3 abortion her whoever you want to put it a group of students a software university wanted to go for official affiliated status with the students association and that gives them a certain extra rights that normal groups don't have like they get access to every means to all debates that the student union they get access to potential access to funding to go away and attend conferences and that kind of thing but so what has happened here is a descriptor plight for affiliation on the students association of Strath claves denied that because it has a long standing policy against officially recognizing this particular group because they regard it as being anti choice and they say that directly in itself contravene the associations longstanding equal rights policy but Jimmy McGowan who is a law student at Strathclyde the news part of this pro-choice group says that surely this decision is exactly what is happening is that equal rights are being contravenes and Hugh. Say he had to see to me when I spoke to my earlier on we believe that the right to life is important but some literally also we should have the right to express it you know democracy and lines and too long the right to life and the right expression but particularly so because both freedom of expression and if Ethen it an unreasonable idea is for just an society we can address and say you know how strong are the better Q let you know and talk about it challenge it and that's exactly what's happening here this is not just the case of the universities the case and for this university or the pro-life case in general there's just this and it's very common theme Unfortunately society of censorship so what's the Student Association saying well these associations say that actually even though the have passed this this blanket ban on unteach ois groups is the call it's not she set in stone and they are she say that is open to the students to change the polls if they want to see the most important. Thing they do is that they give students the the final say on whether or not they want to change policy and I spoke to the student president of Strathclyde Raj Gerry are generally are on a new set up surely that say if you want to if they want to to descript crudes hold a referendum amongst the student body and that was no easier than ever to do so because the requirements to to do Sue had been relaxed Here's what he had to say earlier on if. In this instance if it is society they can go on to democratically change their policies and they can do that in fact. They can go to a referendum process Richford then actually mean that all students will decide what the policies are in fact recently to our recent referendum our number of student signatures that I required in order to trigger a referendum has been reduced from 500 to 200 so now you know after a trigger a referendum so that it can get all of the students views on what the union should believe. Well it was that the student president struck the clay there and I think new platform is an issue is probably here to stay at the moment as happened to several other universities in the u.k. You might remember that recently Cardiff University students tried to ban the feminist you mean Grier from speaking there because they judged her to have made comments which were offensive to transsexual people and in the us it's become a big thing adjourning the Trump era as well because of people being given platforms to talk about views that certain people think are extreme and that will probably continue as an issue I think I think is here to stay but something that definitely the the debate over where whether earing controversial views is impinging on freedom of speech I think that to be will continue Andrew Black thank you for that. The floods across the u.k. This time last year were the most extreme on record an expert's report has been published to coincide with the 1st anniversary of storm Desmond when exceptional rainfall affected parts of the u.k. It is in the borders were particularly badly affected our Reporter Cameron Buttle joins us now from our Selkirk studio it was her it wasn't it that bore the brunt of storm Desmond there aside the flood alarms are sounded yet to get in the night before storm Desmond hit one year ago today they've been hit before in the town many times the river T.V.'s runs right through the center and people live and work just yards from the banks of the river Scottish Borders kinds of say the up to 80 millimeters of rain fell on that day on this day last year there were nearly $100.00 flood warnings in the area some of them severe meaning a threat to life nearly 9000 sandbags were deployed overnight 600 people were evacuated from 300 homes on duty that night was Kevin Sewell who is from the emergency planning unit of Scottish Borders council he told me that they were expecting bad weather that night but not flooding they were braced for the winter storm Well that and they were. Spectating snow and cold weather that bill of course all supplies and fight would end in dated by water plants had to change dramatically speedy and $40.00 to $80.00 millimeters of rain over the borders equates to about 3 inches most of it fell on the west the borders and a lot of it directed they never teach it to hoist. We had to Vikki Hawick. Newcastle turn the same evening so a lot of people were displaced the damage was contained because we had people in place at the time to manage the flood response and to get people's houses we know this is one of the worst storms on record that any surprise to you having been at the the forefront of it on the night well as very much so because we were surprised how much fail and hope rapidly we had to respond I sat in the control room at 2 o'clock in the morning and at the call of resources from the for the next point of whatever resources increased on the one point but 200 Council staff were dealing with storm Desmond and Cameron that are still some people in recovering some of the worst damage was in the juke Street area at the time a huge chunk of dough disappeared into the water you might remember the pictures from that river a duchy risen by up to 3 meters on that location and on the corner of that juke Street area was grim web photography you can just see his science for his business there still behind the repair work which is being carried out there one year on huge amount of work still to be done and for Graeme weapon self as business continues to suffer the costs in just moving premises. You know that's been a huge and you know quite unexpected from a business and then on top of that you know the fact that we've got the building that we can bring tear down in the workplace. The cost has been astronomical actually this year and it's really been very hard very difficult year for me the big question that we don't know is you know are we going to another for the sheer route or you say to still closed you know it's a year on it's still facing a property because we can't rent to. And yet you know we could have another flood this year and really we're just no further forward with it and what about the plans for the new flood prevention scheme where are we with that there are plans for a 36000000 pounds scheme for some money has been spent already on shorting up the banks and putting. Cubs' of it a 1000000 pounds but the people in that area are still very concerned about it falling again before the new defenses are in place here in Selcuk for example a new flood prevention scheme costing more than 30000000 pounds is nearly completed when Storm Desmond hit here last year it was only half built but the council says it still saved more than 600 homes from flooding. The current best estimate is 5 years the council and the planners say it simply takes that long. Kemah rebuttal thank you very much indeed. Time No 12 minutes to 6 the headlines a former youth football coach has been accused of a series of child sex offenses in Scotland according to a b.b.c. Scotland investigation. A British woman working for a Christmas themed tour company has been stabbed to death in Lapland and the Supreme Court has begun hitting a legal case that will decide whether M.P.'s must vote before the government can begin to withdraw from the e.u. a Travel update now here's Emma Cameron Friday Glasgow's London Road is so close by an accident between land just 3 streets and Anson state roads works on the Glasgow m. 73 are causing queues heading signs at the moment from Junction to be listened to 1 May fail and similarly very sluggish from Junction 11 Queens the 3 to palest and runs of 15 minutes holds up on the site by and m. 74 from May be filled with congestion back to junction 2 a fillers and roads and as a brother works at the cames cross roads are causing lengthy delays on all approaches and sticking with getting reports that temporary lights are causing delays on. One Scotland. No they are the son of murdered Fife pensioner maybe Lugaid has told a court that his mother always spoke favorably of the woman accused of killing her son Joe we're denies carrying out the attack in January this year Steven golden was at the High Court in Edinburgh and joins us now says David what happened today in court you have already admitted he was an 82 year old grandmother who was found dead in our own home in Leven in Fife in January of this year or today was the 1st day of the murder trial and the Judy heard from all 3 of her children her eldest son Ronald will be he was the 1st to take to the witness stand and he said that he often spoke to his mother about Sandra we're the next door neighbor who is accused of her murder he said that those conversations were always favorable that Sandra we are her to help her with our messages and the last Christmas the family had bought Sandor we are a bottle of whiskey for looking after her caught Eva's asked about about his mother more generally 82 years old but he said she was an independent woman that she enjoyed going to the panto in Edinburgh for example with her friends but that aside from ability problems there was concern among the family about how she was managing financially he spoke about a journey that he'd taken with his mother last Christmas down to his home in Yorkshire and he described are becoming distressed that when she noticed when she got there that 2 of the Christmas cards that she'd taken containing money had gone missing now Mr Libby's other son dead occlude he was asked about his mother's mental state he said that she was fine the only thing that seemed to diminish was that she was forgetting where money was he said that she thought she was going down because the money wasn't where she thought it was another Judy also heard from media Logan's daughter Cottle Robertson she emigrated to Australia 30 years ago last year though she'd come back to to leave and she described becoming involved in a search for a wallet inside her mother's home that will it continue 200 pounds now. Roberson said that she went out for around an hour and when she came back Sandra Weir was in the house the wallet had been fined but the money was gone in a chandelier denies murdering Mary Loki by battering her to death with a ruling Pen she's large to a special defense of alibi claiming that at the time of the attack she was elsewhere and leave and she also denies attempting to defeat the ends of justice but cleaning up blood and discarding clothes and she's nice stealing money and jewelry from a low key and fraudulent way using her bank card the trial of the High Court in Edinburgh continues Stephen Gordon thank you. No new laws come into force in Scotland today which makes it illegal to smoke in a car if there's a child under the age of 18 in the vehicle it's been welcomed by health campaigners the doctors organization the b.m.a. Says is a good 1st step towards their name of banning all smoking in cars but critics point out that in England and Wales which has had similar legislation for a year or so there have only been a handful of prosecutions and smokers groups say the law is unnecessary Hugh Williams reports from Edinburgh the change in the loris being promoted with radio and television adverse from the 5th of December smoking in a vehicle with anyone under 18 is against the law children from Royal Mile primary in Edinburgh drafted in to promote the new law welcome the change my grandpa used to smoke and I didn't really like a kid my dad smokes outside. He keeps far away from me. Our. You know like the smoke going in your throat. And yet like have a cigarette or something like you know money you just put it down smokes comes from up from every Leonore's me I can't get rid of it the Scottish government says Lorre is all about changing the way we behave Public Health Minister 18 Campbell children don't choose to smoke so this is about making sure the adults have that responsibility in the understand. That they have to shift their behavior to ensure that children can go on and have a healthier happier life there's been a welcome for the legislation from doctors like Steven Turner at Aberdeen's Children's Hospital children who are exposed to cigarette smoke a much more likely to have conditions affecting the chest such as asthma young babies getting chest infections up in cold this weekend I've seen an awful lot of babies with chest infections and a good proportion of those have not been cool by smoking but as smoking has made the virus more effective in causing us to test infection but Assistant Chief Constable Bernard takings from Police Scotland says their priorities remain the main causes of fatal collisions on the road what he calls the big full use of foreign St TNG seatbelts and drink drive even and that's what we called simply. The officers who will use up discretion and deal with any cases that we come across on but for me the priority is actually reducing people killed in the road smokers groups like telling parents what to do is unnecessary Simon cluck from Forrest they don't need to be told how to bring up their own children or how to behave around other people's children they can make those decisions for themselves they can use their common sense and then the vast majority of cases that's exactly what they do we've already banned smoking in public places some will wonder if the ultimate aim is to ban all smoking in cars Hugh Williams reporting there from Edinburgh. Now the Italian prime minister material Renzi stepping down the saf to noon keeping to his word that he'd quit if he lost a referendum to change the Italian constitution 35000000 people voted over plans to reduce the power of the Italian Senate with 60 percent voting nor will many see it's a populist revolt against the establishment are you that reporter Gavin Levy is in Rome so why did he actually stand down at the end of the day. I think you have reached him so you know I think he said it as much in his own words there's a camera less quality to it that he would resign if he wouldn't get these changes through and he had to keep to his word it an hour after the polls came out the exit poll to stay before the result was officially confirmed he knew it 60 percent was a result in the end as you say against this constitutional reform and he's well I'm standing underneath his office right now in Rome between have a pantheon in the coliseum and in the next 30 minutes at the moment he's inside his cabinet he's expected to go to speak to the president to formally resign now my understanding is he will may not go tonight he's going to be asked to stay on for a week to see through the budget reform package that he was planning to bring through so that when a new prime minister comes in if they can find one from the same party he doesn't have to stop with a new budget given the amount of all the problems in Italy and elsewhere in Europe right now it gives time to prepare and and come up with a new plan so will the new prime minister inevitably be from that party and do the have enough of a mandate no to rule. Well that's the 1st option you know they are the largest party so therefore they still do have a mandate it there are questions that the of legitimacy which the 5 Star Movement to this. Party led by a former comedian but a good lawyer are saying that there should be elections next year much much sooner than in the 40 months time that are planned that they believe they can govern it's they claim a lot of people who are voting no we're anti establishment and wanted to see a new wave come in from the way I see it I've gone from polling station to polling station in Rome yesterday a lot of people were unhappy that they felt they'd given materials the chance to come in is this this outsider the member of Florence or to claim that he hadn't walked the halls of Rome therefore he wasn't contaminated by power and wanted big change but they felt in the 2 and a half years that he's been leading a lot of people said the economy was too stagnant jobs were hardly there 40 percent youth unemployment and wages had to increase and they were the main factors rather than anti You sentiment so I think it's more nuanced than that so there must be big fears know about the state of the Italian economy in the week this vote. I think it's interesting when you listen to the like Franklin Merkel the German chancellor her reaction today the same with junk of European Commission saying that they believe was is bad news they are sad to see but I already go because he had he was one of the few that still had real visions for the e.u. Of the self socialist left that he was a firm committed federalist as well as a tally and leader that's something that other leaders within the e.u. Are getting far more to catering toward a domestic audience at the same time there they say they believe things are calm in Italy I think the biggest issue the bank to watch is mounted here the reason is this bank needs to find 500000000000 we within 2 weeks of real recapitalization So investors have to put up the money but if you've got no prime minister of a country if you've got a short term vision for where to go next it's going to spook the fish in terms of investments abuts wide approach the president is meeting tonight to try to sort out a new leader within the next few days and just briefly then is this part of the going to see movement is there the vote for breaks that and Trump. That gets to the heart of this I think this is what Marie Le Pen in France the to follow right lead this what's Niger Ferrars lead the breaks it movement for a lot of the No campaigners are saying this is a domino of anti you feeling the e.u. For example didn't come up in the referendum in a lot of people but I've spoken to a snapshot have said that this was very much about the constitution that they were saying that they want to go with it with a new anti establishment party but they felt the Constitution wasn't broad enough so I think it is too too simplistic to perhaps look at the papers this morning it is more nuanced than that Gavin thank you very much i Reporter Gavin Lee in real. Now let's go back to I mean story tonight the Supreme Court has begun heating a momentous legal case that will decide whether M.P.'s need to give their approval before the government can begin to withdraw from the e.u. In a previous ruling the high court decided that M.P.'s had to be consulted a decision which is now being appealed by the u.k. Government meanwhile the s.n.p. And the conservatives have treated blows over what's best for Scotland's future with Ruth Davidson set to give a speech tonight with a call to avoid a divisive Breck's it well our political editor Bryan Taylor joins me now so Brian what are we expecting a roof Davidson to say when she delivers this lecture she's arguing for an easing of tension very 1st of all within the u.k. Between remain as and leave as she says the should recognise that each other had a coherent point to that the leave argument. Won but that doesn't mean that those who are retained concern should be dismissed and ignored and on the other hand it doesn't mean they should be any attempt to undermine that but then she she takes that further and sais that once that u.k. Unity has been restored the United Kingdom should still she says be a force for good in the world and the the global community arguing that the global google group community is now watching to see how Britain comports itself now that is is leading to some controversy tonight to say to say the least 1st of all critics say it's a bit rich of the Conservative leader to talk about easing the tension when the referendum was caused by guess what a former u.k. Conservative leader of the also argue that group Davison is setting aside or sidelining Scotland's interests Scotland's distinctive interests is up in the s.n.p. But specter of with regard to a possible. Continuing links with the European single market route Davidson is adamant that is not the case but she puts the the Scottish interests within the context of maintaining a u.k. Deal with the the European Union post Rex and you know we had some. Strong words over the weekend didn't leave Nicholas sturgeon accusing Ruth Davidson of selling out so she was accusing him of selling out we also had Alec salmon the former I sent p. Leader saying that they could be a concert hall crisis as a result of the decisions taken by the Supreme Court and that would be quote an extremely good thing for Scotland and that it would allow Scotland to bargain and secure secure interests critics pouncing upon the Vatican the s.n.p. Appointed a comment by Adam Tomkins on on our sister program Good Morning Scotland suggesting that it was not the the best deal for Scotland that was the objective it had to be the best deal for the whole of United Kingdom a lot of fair that is within a context of of arguing for a u.k. Deal so you have almost what you're having there is that these comments are resulting from a different interpretation of mandate you have those who support the union understandably from their perspective saying this is about a u.k. Mandate you have those who are nationalists like Alexander the Nicholas 1000 saying no the people of Scotland have spoken and that mandate must be respected and we also have the u.k. Government that peel as we mentioned in the lead into the Supreme Court over breaks that what exactly is at stake here for the Scottish and for the u.k. Government for 1st of all for the u.k. It is the case that it would it would certainly put a challenge to the U.K.'s triggering let's be clear the neither side neither the apparently appellants the u.k. Government nor Jamila the at the initial position on the others that back her view that the should be a parliamentary view neither of them is saying that Bracks it should be stopped they are sticks up being the people have spoken the saying that should be a parliamentary trigger I was struck by James e. Q.c. Speaking about half of the u.k. Government in the court today saying no he said the principle of Jewell isn't that it's up to the u.k. Government to sustain maintain and ultimately result from international treaties and it's up to parliament to legislate for the domestic consequences of that it struck me that could be transferred into a Scottish context by saying Well many of those domestic consequences. It will be for Hollywood to decide on the devolved powers so is it not and we might expect a lot advocate to make this point later in the week is it not for Hollywood to to follow that legislative route again the u.k. Government will say it's up to the u.k. Government to pursue treaties it's up to Parliament or indeed perhaps parliaments to legislate that after right until our political editor thank you. No the authorities in Oakland California say the number of people known to have died in a fire at a warehouse party in Friday night has risen to 36 the county sheriff spokes women Modeste since our last update we have located and recovered 36 victims of the 3611 have been positively identified and their family members have been appropriately notified Well our correspondent Peter Bowes joins us know from elite Peter we also have a warning don't we the number of casualties could rice something they still expect the number as you say to rise and also they've been saying all along since also in the early hours a Saturday morning that this would take time the nature of this building and how it was being used the fact that it was essentially artists in there with their little makeshift studios and a lot of artists materials a lot of stuff in there the staircase was made of 2 wooden pallets there was only one way out as far as those people on the 1st floor the upper floor were concerned so it's been a very difficult process actually getting in there and there's still a lot of the building that still has to be searched you know the building is in quite a dangerous state no 2 isn't it you know very dangerous because the roof for its part of the roof collapsed during the fire which made it all the more dangerous for those people in the building and that's probably why many of those people died on the upper folks they simply were trapped in the and there was no way to get out and now with the operation that that is continuing today what 2 days more than 2 days since this happened has to still that I mean really book it by book at they're going through this building with all the debris trying to get it out examining what they can find and tragically still finding bodies do they know how it started yet no they don't they don't know how it started and it is I suppose looking on easy to see why a fire should spread so quickly in those circumstances but what actually started the fire that is still part of. The investigation Yeah there must be questions about the way which the the fire spread so quickly through this building Oh there are lots and lots of questions being asked and there is the possibility somewhere down the road of criminal action lawsuits against the owners of the property we know know that the investigation into the state of the building had been going on before this fire the authorities had been alerted by rubbish being left outside the building allegations of illegal construction inside the building so the authorities were aware that this was a potentially dangerous building that tragically they didn't get to it in time and so yes lots of questions I'm to many different parties Peter Bowes in any Thank you for that. Scottish woman working for the tour company offering sun to fatties in Lapland has been stabbed to death her boyfriend's been arrested and as a police custody following a manhunt north of the Arctic Circle Tran son travel who operate the Christmas themed excursion see they're deeply saddened to confirm a member of their team had been killed Well David McDougal's a journalist based in Finland and joins us now from health sinky So David just tell us about this idea which this woman is working. This is one of the most remote parts of Europe it's thousands of square miles of forest of fell concrete covered in snow at this time of year where the temperature dips to minus $32.00 in the winter to give you an idea of how North and how remote it is the next time there's a sunrise there is in January the 6th next year so it's technically the sun doesn't come above the horizon but it is still quite light up you know up there quite a number of times with all the snow it does make it kind of amplifies the lights was not pitch black but this time of year especially there's a big influx of charter flights particularly from the u.k. Also from Germany and Japan and people can go out for a day or 2 days and get in it sort of Lapland wilderness experience you husky sled ride. To feed the reindeer you kind of cook a sausage over an open fire. And. That's what the woman who was murdered the Scottish woman she was doing there a seasonal workers many seasonal workers go between now and and February and March next year and they're working in the tourist industry in Lapland giving a sense of the wilderness survival and we believe that her boyfriend who's been arrested had fled the seed that's right but according to police it was quite a fantastic experience he apparently fled on a husky husky sled and was pursued by the Finnish police and also Swedish border police as well on schema Beals on a helicopter the fundamental couple of hours later suffering from hypothermia the temperature as a set dropped down to minus 30 on the weekend he's now in custody in Albany I mean that's the largest city and in Finnish Lapland it's right on the Arctic Circle and he could be police say he could be. The even sentenced as Airlie as Biden state. Thank you very much indeed for that update does David McDougall there in Helsinki. No people in a wheelchair tone have broken the world record for staging the biggest Nativity plea more than 1200 residents signed up to police shepherds angels wise men apparently the sheer numbers of actors required in traditional The tippity outfits sparked a total white shortage of bed sheets a crisis only averted when a local launderette stepped in ritual rose from the Swindon based Bible Society organized the event and joins me know so Rachel Where did you get this idea well I was at a manual I live in Carmen and we were at the annual lights and firework display last year and we had a little small Nativity and it was lovely and I just kind of thought you know what this town can do better than this so I said to one of the ladies that works and event accounts I said why don't we just try and get everyone in town dressed up as a nativity character and have a life Nativity and just get back to the true meaning of Christmas the council bless them were just totally up for it so we worked together all through this year and we got in touch the Guinness World Records and we said has anyone done this and they said yep the people of Utah are the figure is 1039 so that made me think right we're going to be Yanks. As they always do their performance was yes it was amazing Ours was just it was that kind of very British kind of performance the Americans had got all singing all dancing immaculate costumes what we thought was was just wonderful We had a little kids age 4 with tea towels on their heads we had no not so elderly people you know quite a few in wheelchairs that were dressed stopping costume and people the lady in the local launderette I just said I think people will turn up on the night and have not really read the kind of in. Mation probably and will say oh can I come in and obviously the Guinness World Record said no they must be dressed in costume so that alone I ran around town and a local pub by heart they just brought they made just I didn't ask them off their own boats they made 240 cos James was so when the numbers were looking a bit dodgy we were up to I knew we were up to about 80900 and I just thought I cannot bear to lose this you know down to about the last 20 people so like a kind of screaming banshee Iran right now even it's not going on people's doors saying to them you know we're going to break the Guinness World Records your sheets will make all the difference and then we had a kind of a system this impromptu system outside the pub where people would cut up the sheets give people sort of head scarves give them belts to put around so that you know they looked like sort of proper costumes and we were like get on in there quick quick I don't think the poor in this world record managed seen anything like it he did. More than 1200 people took part you know you get a percentage of the tones population is that I think I think gosh not so I think about 7 or about 17000 so you know it's pretty it's pretty good so it was an audience live to see it there was well that was the other thing because the green where we did the Nativity was not was about a 5 minute walk from the town center where the lights get switched on so there were 5000 people in the town center and we'd put up a big screen so that the people in the town center could see what was happening at the Nativity to give them the opportunity to say to watch even though they weren't taking part are you going to do it again next year somebody asked me that the other day and I said Don't you know that people who row in the Oxford and Cambridge Boat Race it takes 5 years off their life I said Saturday night took at least 10 of mine and frankly I was rather sweet on the. No but it was fun while it lasted it was great fun it was great fun and just a huge thanks to you know all the people of karma came together in the town council and just that way is the Bible so I say got a chance to people to kind of link with their with you know what we think you know the true story of the Nativity and the story of Jesus' birth which you know often gets lost in our consumer consumer world so that was really I was really good for us to Rachel thank you very much indeed enjoy the rest Rachael runs there from the Swindon based Bible Society no brain burn it can tell us the theme of tonight's get on well something I think we could all probably do with time a year and as the songs that gave us ends then energy boost it could be one of those could we sing along feel good tunes the moment here you start to pick up it could be a can of upbeat dance thing that you always fall back on maybe it's on an exercise playlist when you go at the Jam or maybe it's just something that so for life you can't help but get caught up in it the songs that give you the energy boost stand on the text to name 5 and we're going to start with some T.-Rex excellent news thank you Brian Bennett there with gadgets or no Jamie can tell us what's coming up in the sport yes indeed Darby came to Boston McClaren says even Cathal could thrive as Hart said coach if he's given the right guidance at Tynecastle hearts are keen to appoint Catherine who's currently counsel United and Austin McPhee as the club's new coaching team talks of to complete with both men this weekend or Cathal worked under Steve McClaren at Newcastle and the former England boss says if he's appointed hearts that of football Craig Levine will be key Yeah I mean he's young. He's very analytical is very bright forward thinking. Can one of the modern coaches coming in and I think the key advantage you know is if and you will go into management eventually some station if it says the club then I can see that because Craig Levine was his mentor for many years I think it could be a good partnership. Young managers need guidance and need mentors and you know what with the info for nearly a year and we know we said this is an education for bigger things and he might get the opportunity to Manchester City and Chelsea have been charged by the Football Association for failing to control their players cheat in the Premier League game on Saturday the charge follows the mass brawl in the 95th minute of the game at the ad stadium which Chelsea won by 3 goals to one city had forward sends you a feel their fan and the new was sent off with a go at all issued a 4 game bond to d.
