Now what happens in the passage of time that I've been talking about is that we get now to a situation where we have 2 different types of court an inquest where a jury listening to 2 years of evidence decides on the balance of probabilities that is a lesser test than in a criminal court where it's beyond reasonable doubt how do we have the trials soon after holes where it happened the time the trial then it would have been much easier to have argued the case beyond reasonable doubt once the passage of time has happened once the whole process of being infected by that that did did that which he has a dilatory a so fact are beyond reasonable doubt However having said that on the balance of probabilities in the inquests in that situation it was clear that the police had failed obviously they couldn't name any individual but what they could say that it was a systemic failure in policing there were 15 different commentaries made by the inquest Yury on that unlawfully killed verdict there were also another tan commentaries on all the other organizations that were involved now of course they can't name individuals but we all know that they would that would have been directed in their minds towards individuals they were against organization so those 2 issues one the fact that you don't name individuals an inquest and 2nd that it's on the balance of probabilities. Plays against one person being prosecuted and it having to be beyond reasonable doubt. It's very interesting to me that there were 23 of I remember rightly referrals for the Crown Prosecution Service they do their job properly. I think that one of the great that you've hit the nail on the head one of the most significant issues for me in this case that so much money so much time so much suffering by the bereaved and survivors have happened as a consequence of the new investigations that have lost that lasted 5 to 6 years and still ongoing now in that situation the Crown Prosecution Service has to make a decision on who will or will not be will not be pressured the recommendation as you've put it where there are 23 people should have been prosecuted for some aspect relating to or we can assume that the majority of that would have been to the events on the day in other words to have culpability for what happened on the day and the decision was taken by the Crown Prosecution Service of the d.p.p. That there would only be 6 prosecutions that was dropped to 5 or Norman better than was moved out of the frame and all of the 5 remaining 3 are related to the review and alteration of police statements after the event so the other 2 are related to the event of the day itself one of which was a safety issue in terms of the club secretary So in terms of the actual potential for criminal prosecution it comes down to one man now. That one man should have been prosecuted and it's no question about that for his part his potential part in the disaster but what is of real significance is the number of those who also had a part in the disaster who were not prosecuted where the file was given after the after those 5 years of investigations the filing was given to the prosecution office and the decision was taken not to prosecute and on the day in Warrington I sat there with the families and I came out and there was some hope that this prosecution of David Duncan field would bring a form of justice to the case at that time I remember being interviewed and stating categorically that I considered what we just witness was a failure in the system a failure that where you have recommendations for prosecution and they're not taken up and of course that's all done behind closed doors we don't know the names we don't know exactly who they were we can only make assumptions and of course the other issue is that in terms of prosecuting agencies it was decided at that time that none of the agencies involved from the football club right across the board. In those circumstances I think that the families and the survivors would have been insulted if the charges have been in any way less than they were having said that once you have a charge of that severity then we can see that the.
