Velshi and this is real money. This is real money and you are the most important part of the show. Tell us whats on your mind, ali velshi or facebook ali velshi. Fracking, hydraulic fracturing. Whatever you call it, its a billion dollar boom thats adding millions to state covers. Horizontal drilling and explosive charge creates holes in the rock then a combination of water, chemicals and sand is injected into the well at high pressure. Trapped air and gas is shot into the well and sent back to the surface. Mission accomplished. On the flip side environmentalists have called attention to side effects like earthquakes and contaminated water among other problems. But lets focus on the money. You might assume people who own manned where fracking is taking place are enjoying a financial windfall. But travel to north dakota and youll see thats not the case. Many owners received a rude awakening when they discovered, they didnt own what was under the ground and found an oil rig on their property like it or not. Like generations before him, Richard Jordan works a farm in can north dakota. But even though he has title to this land, he doesnt own all of it. He only has rights to the surface. Most of what Credit Credit was beneath was sold by the previous owner. Just so happens to sit atap top the bakken, with an estimated 118 billion of oil. But richard is just one of these thousand scaled split estate owners. The land is owned by one and the mineral rights are owned by another. Many when they go to buy a house, dont realize they might not be owning the oil and Gas Resources that they underthe land they are buying. In pennsylvania, roughly 40 of oil wills are located on split estates. Even recently in florida, where there hasnt been any oil and gas drilling that i know of, some are holding onto the mineral rights and then selling off these new suburban houses. And by law, mineral owners trump the rights of surface owners. Thats been a right designed for 100 years to encourage oil and dwhras exploration. Gas exploration. But that leaves why them open to can crb to speculators. Even build a rote ride on your property without your percentages. Then, one day in 2010, it happened. We heard from the mail carrier that there was a letter saying they were coming in to drill. In section 11. After acquiring mineral rights under the jorgensens land a an oil company moved in and began fracking. Richard expect it but thought he could prevent it. They make you an offer. If you dont like the offer you can stay them to court but you are not going to stop them from coming in. Despite effects on Property Value this well continues to extract tens of thousands of barrels of oil every year from atop richard and land. Natural gas is also burned off here. And while its not clear if this socalled flaring affects air quality, so much of this goes on in the baakken that it is adviseical in space. These have been going on for two years. We dont know what the effects are of these fumes. Since the well was put in the couple has complained of intermit ent are health problems. Burning eyes and sore throat and headaches. Land owners the have largely forfeited their right to the drilling. To sell their farm or keep their minerals when they sold their land. These are choices prior to the oil and gas industry coming along. But home buyers today should also take note. It is critically important to ask, do i get the mineral rights with this . Are the mineral rights quead cod with this property . You can negotiate to make sure that the rig is not set up in your backyard. Energy Companies Work with surface owners when building wells or setting up fracking sites. When they lease their minerals to the developer, then the developer has certain rights of access to go and retrieve those minerals and extract them, and you are required to compensation those land owners for the damage done. The company paid them 18,750, for the pad that took over part of their land. Thats according to Bank Statements that Al Jazeera America saw, and the company wouldnt verify the amount of the payments. But today richard and brenda say they receive an annual payment of 1250. So this is a free flowing Natural Spring thats been on your ranch for generations. This is how you water your cattle. Does it worry you . It makes us very nervous. We dont know what is going to happen if the water gets interrupted. The why animals have to drink every day. Land owners with little mineral rights have little or no recourse. Complicated process of figuring out who offenses what. This particular well there were 300 mineral owners. Nearly twothirds of the mineral owners in north dakota live out of state or even out of the country. In other words, most of the people who own oil and gas rights in north dakota dont live in north dakota, and far from how the environment is affected. Theyre not getting a check, theyre not having the roads torn up or flares burning all night or the drilling rigs right next to your house. And while Americas Energy boom brings new jobs to towns like williston and tyoga, it brings problems to those who are not able to cash in on that new found priority. David arioso, lrnlings, north Al Jazeera America, north dakota. Two states that know a thing or two about the recent energy boom. You said that the u. S. Is one of the two countries in the world that does the split estate rights, surface rights and mineral rights. How do other countries deal with this . Actually, the United States is one of the few countries that have private mineral rights at all. The majority of the world, the minerals are owned by individual governments. Not privately. Canada, australia, United States are the rare exception to where we even have private mineral rights. And then on top of that those rights can be split. The minute ral interests is what we refer to as the dominate estate. Dominant estate. Texas, oklahoma, colorado, pennsylvania, all of the largeproduce states have large split interest issues. On a fragment takings over the years. Are there any rights where the surface rights, any states where the surface rights are the dominant rights . Where you can say hold on we have to negotiate this or do Something Else . They wouldnt be the dominant states, there are states with a unified statement why they are not split. But any 00 they are split the dominant state is the minerals. That is the only way logically to get the minerals out of the ground. The idea is if you are goods to produce the if you are going to produce the minerals, you cant have land owners say, you cabinet drill on my land. A lot of associations you mention, issues on fracking, or the dust, those are nuisance issues and those could be handled separately from the surface damages. First of all surface owner can not prevent the well but they are entitled to be compensated. And what is your sense of how effectively that goes on . Because typically the stories that get onto the news are people that have developed Health Issues and generally provide documentation that theyve tried to get these things settle and there tends to be a lot of denial on behalf of the energy companies. Is that truly the case or is there occasions when this acts fearl . There is a struggle. In australia, we had a large nuisance case, the gas produced had high zero yen sulfide in it. Had Hydrogen Sulfide in it. They had a dairy farm, that suit went on for many, many years and we eventually had a jury trial out of it but it is a contentious issue on what damage is being caused. Those are nuisance issues, as far as drilling the actual well those are covered under statute and there is a process where they have to try to make settlement and if they cant make settlement for the use of the actual land to put the drill pad on then the land owner can take them to court. If its a split estate. If its not split estate as the article said youll negotiate that when you negotiate your lease. Is it a given when i buy property that id know if it was a split estate, that somebody already has sold the mineral rights . Not always. Sometimes you have to dig around. Whenever someone sells it they think they own more than they actually do. What you want to do is make sure you get a Warranty Deed that kind of says you say what you own is warranted, in oklahoma, where we have even smaller, the beginning patents were smaller so we have even more fragments, it is even more fractionalized than it is in north dakota. It is not common at all for multiple, multiple owners to own underneath the surface, it is very, very commons. Professor christine fritz, thank you so much for joining us. President obama had the youth vote, but young people were less enthusiastic the second time around. Many flocking to ron paul. Ali asked him why. The jobs, they know something is structurally wrong. While the son is a senator who may run for president in 2016, the father isnt exactly fading in the back ground. Ron paul is an outspoken libertarian. You can find his opinions on ronpaul. Com. Some of the content is free and some requires a are subscription that costs 9. 95 a month. Ali sat down with ron paul and asked him his appeal, young amog young people and college students. I was delighted with it. I took a position which was a libertarian position, which was, you have to be responsible for yourself. Most people paint young people as, theyre totally independent, whats the government going to do for them . And theres plenty of that. The students when you offered it up to them they were very open. But i think conditions have helped me on that. Not only was i firmly believing in what i was saying, and thats what theyre looking for, but theyre mrs. Seeing the failure of the system that theyre also seeing the failure of the system that and because of the crisis of the last six years, we know the debt the students are you know undergoing, they are getting out of college, theyre paying a lot of money, they owe this debt, they cant even get out of this debt like other people can get out. And the good jobs arent forthcoming. So they know theres something structurally wrong. So there is a good appeal to young people to say well maybe we have to h think about the whe system rather than just saying how can we patch this up . Allow can we get another appropriation . And generally i think its healthy that theyve lost a bit of confidence in government. Because overconfidence in government just means youre going to get more government and that of course isnt my answer. But this is an interest idea. Because a lot of those young people arent necessarily conservative in their approach to things. They worry about the government and they want some government leadership on the environment, sometimes interventionists something they think america should have a role in dealing with some of the people in the world and yet youre running against conservatives. The are how do you square all that . See im not convinced of that. Okay. Because i go with a very open mind and open approach, believing that the message of liberty is appealing across the board. And when you present it to them that youre not going to be judgmental, except one thing, we want our freedoms. But if you want to use your freedoms to do something i dont approve of because i come across as a very conservative person. But they dont see me as attacking their standards and what they want to do. Of course theres one rule. You cant take advantage of others. You cant cheat and you cant defraud people. And all of a sudden they see this as less threatening. So theoretically, you should have, as a libertarian, you should have as much appeal to liberals as to conservatives. Because liberals generally supposed to be, sometimes they come up short on defending Civil Liberties and at a thats sometimes a mixed back or antiwar, which i think is questionable too because its so mixed. But if theres a principle progressive, i feel excited working with them, dennis kosinich and why nader, they base their bleaches on some basic principles. So thats 80 think the message of liberty should be appeal across the board. Theres a quote that nixon made one time many, many years ago. He said were all cainsians n now, conservative credit republicans and liberal democrats, they are all can kanesians. They are only going to hear me if they are conservatives. It just wasnt that way. You were from an electability standpoint the most excelling are candidate, yet you hit a ceiling. Was that because of you, or because the country wasnt ready for that message . You were so compelling and in fact on a hot streak for awhile. Why does there seem to be a ceiling for alibertarian candidate . I dont believe there is. I believe for the coverage, some people dont understand it or are threatened by it. For instance when we were hitting the peak, i got 89 seconds in the whole debate. You have to question that. Families pay 230. Are ministry arranges payment. Here is where Health Care Sharing ministries differ from medical insurance. Ministries do not collect pool or invest money. Whether a member has a verified medical expense, mayor tan members send him a list of other members, who have been instructed to mail him their patrol share checks. For example, for roberts 36,000 brain surgery, members literally sent him checks. You wrote a check for that . To the hospital. Checks are sent directly household to household. Members send checks from household to household. Is it more efficient . Maybe not, but its supposed to Bring Health Care to believers of jesus. At least one Liberty Health share is not limited to christians. While were a spiritual based organization, we have chosen not to impose any faith requirements on our members. So we have crufnts and muslims and jews. Supporters say the system works because members have faith in each other and yet there are risks. It is buyer beware out there. Because they are not regulated by the state, they dont have to meet state standards particularly for solvency. If they go belly up, you could be liable for your medical claims. According to the alliance, ministries dont assume any liability for bills. Oversight by state insurance boards. Ministries offer assistants to members who have financial hardships but if someone doesnt pay their monthly share, there is no legal recourse. The member is simply assigned a new member whose payment may or may not arrive a month later. But that doesnt seem to be stopping people like robert, who has no interest in heat insurance.
