They had spotted the bodies earlier but werent able to get inside the vessel. Now the currents around the vessel are still very strong, very treacherous water, very difficult for the waters, and also, visibility remains very, very poor indeed. But they are slowly making headway, although the man in charge of the operation says this could all go on for weeks if not months. In the meantime they have now put a net, some netting around the vessel, to prevent bodies drifting away. Families of the missing have also been asked to submit dna samples because theyre going to need that in order to identify perhaps further bodies that they find in the future. So thats another grim moment for the families. Their anguish of course has been compounded by the fact that its emerged that the third mate who was actually at the helm of the vessel was very inexperienced and really had never navigated in these challenging waters before. She has told the investigators that she thought the ship was reacting strangely in relation to the steering. Investigators wonder whether she perhaps turned the ship too strongly, which caused the containers to move which caused the vessel to lose its balance. The captain of course has been arrested. Hes been charged along with two crew members. Investigators will want to question him about why he was not on the bridge at the time of the accident. It merely determines a forum for pursuing a claim and arbitration is a straightforward and efficient way to resolve such disputes. Arbitration may offer advantages over traditional courtroom litigation. For instance it is process can also be quick which could avoid years of courtroom backup and bureaucracy. But by going to arbitration, theres no courtroom scenario and no chance of winning over a sympathetic jury. The appeals process is also almost impossible. Because if they can prohibit class action lawsuits that can be very, very costly thats a win for them, in terms of limiting their financial exposure. But as a consumer of course im very concerned. Because how often are we combing through websites and reading the fine prints . That doesnt fine print . That doesnt happen very much. Im concerned about that consumer who downloads a coupon and who is giving up so many rights for what may be a 50 cent or dollar coupon. If you subscribe to newsletters from General Mills, if you are a part of their Online Community any kind of benefit no matter how small would in effect prevent you from filing a lawsuit, correct . There are a lot of interesting questions that are raised and the first one is when you enter into a contract with General Mills and if you read their new policy it sounds like just buying a box of cereal puts you in a contractual with them. Which General Mills denies. They say thats not what they mean. But when you read what the policy says, thats what it sounds like. Already you have to be a little alarmed, they have one thing in their policy and they are saying you should interpret it not what they say. Theres concern when you enter into a contract and if the Court Decides you have entered into a contract what the terms are, are they reasonable. This is very, very murky ground. Reva, im wondering if we are reaching a point assuming General Mills, if you buy a product from them if we are approaching that day if you do buy a product from a company you play not be able to sue them as you thought you could. I dont thinkist an issue of suing them. Its the forum. Forced arbitration is about the forum. Youre not giving up your right to file a claim against them, youre giving up your right to go into a court of law, to have a jury hear your case, or to appeal it. I wouldnt be surpriseas you said that Companies Continue to push the envelope and see how far they can go. Now again as a consumer we have to be very concerned about this because no one is going to be going into a Grocery Store or on a website, being able to interpret what can be ambiguous legal terms. Weve heard from many, many lawyers on this issue and if you talk to ten lawyers you might get ten different opinions. Talk about the consumer that doesnt have a legal background trying to make sense of this. Reva we play be approaching the day when buying a product prevents you from these class action lawsuits in a court of law. Do you think we are approaching that . I think were getting suspiciously close to that and i think the Supreme Court in its decision in at t in 2011 and another very important decision in 2013 has emboldened companies, caused them to believe that they can get very close to causing consumers to give up many rights, five years ago, ten years ago would have been unheard of. We are going osee a backlash, advocacy groups, saying wait a minute, this isnt fair, theres something wrong in the bargaining power, youre a big company, im a little consumer. Its not fair to give up so much for so little. The concern is this is not fair to consumers. The companies disagree, they say arbitration is quick, efficient, easy, and at times rules reumed in their favor. Where times ruled in their favor. They wouldnt have a clause saying its binding arbitration, then consumers would ask for it or agree to it. In the long run its usually more favorable to the companies. There are certainly times when arbitration is an efficient way to handle disputes. But to bind consumers in all cases to arbitration is where it gets problematic. Do you think its going ohold . Its actually hard to say. The Supreme Court everything thats said is absolutely true, the Supreme Court rolled back the ability of class actions. However, some states like new york are much more protective of consumers and their legislation. A consumer contract that has a clause in new york state is not enforceable. Now whether thats preempted by the federal arbitration act has not been really tested in court so theres some question about whether that in the long term would hold. But i do think this is the kind of issue that legislators at both the state level and the federal level might really want to get ahold of. That if there is a sense that a company a company like General Mills has gone too far, that in election season consumers could get behind. Its lard for consumers to figure out whats exactly allowed and what is not. An example i have heard is if i find glass in my cereal box, this is getting a lot of attention. In theory if i got a coupon from the cereal make are i would not be able to sue over Something Like that. Is that accurate . Well again you would be able to file a claim. What you wouldnt be able to do is have a jury trial. And lets talk about why jury trials is so important. Because a lot of these cases go you before juries go before juries and juries have an emotional response at a that is often missing when you go in front of a single arbitrator. In these forced arbitrations you are giving up your right to binding arbitration, so you eat a piece of glass in your cheer cheerios, you are going to miss out on the opportunity to go in front of a jury of your peers, make a case and get larger damages than you otherwise would get in a singleperson arbitration. Its a very sensational claim. Many scholars disagree. Do you disagree with what she said . I do disagree with what had he said, i think its worrisome. Whether courts arent efficient be or receive verdicts we dont agree with, in the long run the ability for the courts to be there as a back stop for consumers, puts pressure for companies to do good for us, give us a safe product. And when only arbitration is available, it may be that the companies are a little too relaxed sometimes. I got say back to that glass example, that gets so many peoples attention. Its so outrage us to think that i might not sue in a class action setting if i find something clearly wrong with the product. For congress to amend the federal arbitration act would really be the best bet. With the Current Congress im not thinking thats really likely. But if its an issue that is something that people care about, if they dont care about it, you dont know what could happen. But in other states, they could be more protective of consumers as you are suggesting. Reva, the cell phone industry, where do you see this going . Could you see other companies imreation this as well . Intreasing thi intraisings quell . The real issue here is consumers. You know, you have to take more time, you have to read these sometimes limpy contracts, you have to understand. Because most of the time theres an optout provision. Even on the General Mills website you can opt out. Therefore saying to General Mills no, i dont agree to submit to binding arbitration by downloading this coupon or by subscribing to your newsletter. And consumers have to be aware of that, that they do have the right to opt out of whatever this contractual forced arbitration is. You got read about it to know that. You got to know what youre talking about and thats not a lot of comfort to a lot of people here. Youve got to read the fine print and opt out of this. It was pretty complicated. Figure out how to opt out was pretty complicated. They backed out, not on facebook is enough. Yes, theres a group of writers from different locations, different continents like salmon rushde and others, they have all read one another but i dont think we can speak of a direct influence. I think it is most of a question of shared affinities, of these writers who recognize them in each others words and in each others worlds. In 2009 there was a poll of 25 International Writers that was reported on the guardian, the british newspaper, in which they are werwere asked to describe te novel that shaped world literature. And 100 years of solitude was the novel. How did it do that . One thing it initiated this style that became magic realism after Garcia Marquez, l although he rarely referred to it as such by name. He taught western readers how to read of alternative worlds or alternative histories. That caught on even in United States, france, germany spain, especially in those areas of the world where morallives peripheral to the west at that time and perhaps moralist prifeperipheral to the world. The biggest misconception may be that he was first and foremost, a political writer, but ill have to give it to you in one word, love. Well, im not sure that yeah, in the sense that if you believe in postmodernism and postmodernism is this jaded attitude about everything, in that sense yes yes, it was dari. But there was a moment where we call a neosentimental novel began to pick up after the 60s and 70s. And yeah, i suppose it was new at the time and i had to do with two things, i dont want to be cynical here, but it had to do that marketing was very important after the boom in the 1960s in latin american literature, love was a big subject the land was a large female readership available more and more so, which explains the rise of female novelists, beginning with the rise o of isabel allende. It went beyond literature, he felt a calling to give back to society and push literature and journalism forward. How do you go about accomplishing that . And i think when you say giving back to society, i would like to mention that one of the aspects of Garcia Marquez that is not usually highlighted is that he was a mentor for younger generations of Latin Americans and especially for emerging latin american script writers of tv and movies, you know in 1985 in december of 85 he founded this International School of tv and film in cuba. He provided his own funds for it. And he gave a lot of workshops there to teach emerging beginning latin American Writers from all over the continent how to write good stories for tv and film. And he men toward. Mentored these people. In columbia in 1984, he set up the foundation of new journalism, the revive the whole notion of writing for newspapers and journals.
