Over the last few days we have seen some encouraging signs. In part because of the yesterdayle threat of u. S. Military action, as well as constructive talks that i had with president putin, the russian government has indicated a willingness to join with the International Community in pushing asaad to give up his chemical weapons. The syrian foreign minister says syria will sign the ban, and destroy its stock piles. We are ready to declare the location of the chemical weapons stop production, and show these facilities to the representatives of russia and the United Nations member states. Our commitment to the Russian Initiative aims to end the possession of all chemical weapons. U. S. Secretary of state will meet with the Russian Foreign minister on thursday. To talk about what to do next. But there are a few sticking points. Russia says first, the u. S. Should remove the threat of force. Obviously this all makes sense and can only work if we hear that the american side and all those who support the United States in this sense reject the use of force. The president made clear in this speech he isnt moving u. S. Navy destroyers currently off the coast of syria, and while meeting on tuesday, he specifically asked them to keep open the possibility of a strike, by delaying a vote, which would authorize they want, he says it is to give diplomacy a chance, critics say is because he doesnt have the votes. I think president obama has decided to slow this process down, because nothing is working the way i believe he and his advisors thought it would. The American People have heard the president , his top aids make the argument he repeated on tuesday. So far, the majority have told pollsters and politicians they dont want the u. S. Do intervene. They say they will reveal them. They say they will join the chemical weapons convention. Implicit to that is the destruction of their weapons. So the russians say look, this is progress. Lets not upset the apple cart after this point in time. Obviously, part of their calculation is that president obama domestically as wow were hearing is in a very weak position. He doesnt have the support, he may be looking for a way out. That is the russian card, if you like. What is crucial, clearly, is going to be the talks between already love and john kerry. Indeed, thank you for that. Lets move on to jackie in paris. No doubt this is a pretty tough resolution. France seems to be determined to punish president s asaad, even if theres no military intervention. Holding the regime responsible for it and having an implicit threat, that if they do not comply with the mechanisms put in place to control the chemical weapons then the option for military action would still remain. And you can see why, the russians wouldnt be happy with that kind of wording. Two french have indicated that they have some scope for flexibility, but only within certain limits. A spokesman said that its a very important that the principles and the objectives of the french resolution remain intact. Mainly to neutralize any possible future threat from the regime of using chemical weapons. But i think the french would see the flexibility that we have seen from the syrians in the last 24 hours as vindication of the tough stance they have set. Its obvious that when there is going to be a military strike, if it isnt credible then it is not effective, then i think it is quite significant that france has repeated on wednesday, that they are still determined to punish syria if syria doesnt comply, keeping the pressure on syria at this important stage. Jackie, thank you for that. Our diplomatic editor is at the u. N. In new york, james, clearly some tense negotiations going on. What are you hearing. The draft resolution is already one draft of it thats been written by french diplomates. We know they have been lee crazing very closely with their colleagues from the u. And the u. K. On this. We understand there will be more meetings before dawn here right now at the u. N. , but in the coming hours there will be more meetings on the text, also, i suspect, russia will be having meetings with other countries as well. About the russian plan on the way forward. I think they are getting everything in place, but as barnaby said, i think that big next step is the meeting taking place in geneva. It is worth remembering those two men have a good relationship, there may be a very tense relationship with president obama and president putin, and maybe some tense problems around the Security Council table, but we know that kerry and lavrov get on well. They have known each other fur a long time, and i think people are looking closely to see if those two men can do business together, and then after its been in geneva, after we find out what has happened it will come back here. If this idea is doing to go anywhere, the idea of hander over syrias chemical weapons it does have to be a formal mechanism, and that needs to be a Security Council resolution. Its just not clear what form that resolution would take, and if they can agree on a form for the resolution. Okay, james, just stand by with us for just a moment, because i waynt to bring in a report, which has just been released by the u. N. Human rights council, it is a report into syrias conflict. Here are some of the findings. It says. Government forces have murdered, tortures, rapes while trying to cap thursday territory. It also says that antigovernment armed pruitts also committed crimes including murder, torture, and hostage taking. That concludes theres no military solution to the conflict, so that war criminals must be proud to justice. James, a comprehensive and detailed report, but difficult to see what will come out of and it who will be held responsible. Yeah, this new report, i read it, and the shocking thing is when you read the detail in it. Of the offenses that are violations the breeches of international law, that are listed in this report. It is a grim catalog to read this, this covered just a three month period, these reports come out pretty regularly, they are saying that they should be a resort to international justice, but again, we get back to the Security Council and the divisions around the Security Council table. I think this report is important, at a time when we have all this discussion about diplomacy, about doing something about chemical weapons in congress, you hear all the talk there should america go to war in syria, this report reminds everyone, the war is already going on in syria, it is raging in syria, and the levels of brutality are getting worse and worse. We have the organization, the opcw is in the hague, in the netherlands so we have a lot of expertise in this area. We have some institutions that can actually analyze chemical weapons, so we are always prepared to help the obcw and the National Inspectors if that is needed. So as diplomatic efforts are solved the Syrian Crisis go on, thousands of refugees continue to cross into neighboring countries. There are around 30,000 syrian children in the refugee camp in jordan. Only a third of them are getting any formal education. The school year has just started for syrian children the second largest refugee camp in the world. And although the school is full, fewer than half of the School Age Children are actually attending school. Many children here have to work to support their families. And in some rural areas of syria, it was already common especially for boys over the age of 14, to drop out of school to work. But some students still value getting an education, even while in exile. Education is important because we are going back to our country one day, and no one is going to rebuild syria but us. We are the generation that will hopefully rebuild syria. Three official schools here teaching the jordanian curriculum, but has more registered students than seats. Over the summer, a back to School Campaign based on the efforts of School Children and aid agencies encouraged more families to send their children to school. Some children are afraid of getting lost on the war to school, because the scamp is so big. Some have dropped out a long time ago, some have to work to support their families and transport watt tore their tents and others are afraid to be beaten by teachers. And some families dont send their children to school because that gives them a sense of permanency in the catch, that they dont want to feel. But more funding is needed to provide more syrian children with access to education, education is the least funded sector and the camp schools can only accommodate less than half of the number of School Age Children living here. Units have only received a third of the 34 million appeal to fund this years program. The most pressing need now is for 11 million to Fund Urgently needed school supplies, build new schools and train teachers. In some cases there might be donor fatigue, for now we have seen a very good donor response. But we are definitely worried for next year, for instance, we are not sure how the level of funding will be. The plight of these Syrian Refugees could be one that dragged on for a while. Thats why aid agencies feel funding education is important, to prevent the loss of a generation of young syrians. Four soldiers were killed, now reports of around 20 people perhaps more than 20 injured. And the two attack ebbs diesed and their body parts are being found on the scene now. Aside from the attack with the vehicles, rockets were also fighting in the area, and this is just part of the on going instability that we are seeing over the last few months. There is a large Egyptian ArmyCampaign Going on, the army says that it is targeting so called terrorists groups. Its has helicopters, carrying out air strikes in the area, and we are seeing these sorts of attacks carries out on military buildings, Police Buildings and check points as on on going scene at the sigh nigh. They are obviously taking advantage of the recent problems and instability in egypt, who are these groups what is it they want. Theres many different groups operating in the siania. Some are aligned to various groups. Some of them are aligned to al quaida. We had one group claim responsible the the attempted assassination on the interior minister, but its not been confirmed the f that down was responsible or not, but they certainly claimed responsible, that was a taking advantage of the instability. It has been a lowless place for a long time. The Central Security faces have had difficulty extending their control. Across that area, it has operated fairly independently the rest of egypt, but at the moment, the situation is highly unstable, and really seeing the military escalate its campaign there over the past couple of weeks. The army has surrounded the city to free up to 180 people taken hostage. They are being held by muslim separatist fighters. The stand off began on monday when the military arrests five of the groups armed members. Its been three days since fighting out in the Philippine Government forces and more in National Liberation front, the city remains in lock down, curfews are still imposed and the airport is still, in fact, closed. Other 180 civilians still remain hostage, by fighters in several villages here. Its become increasingly a humanitarian concern for several human rights observers and red cross volunteers as more and more families remain trapped in the area where fighting is concentrated. They are unable to get food and help, and its unknown what the situation is like in there. Now, im sure whether negotiations are even underway, monday afternoon the mlf made two demands, they will be able to do to the center of the town, and hoist their flag, who with the hostages without getting shot at with government forces. Now the liberation front signed a Peace Agreement in 1996 with the Philippine Government that was never fully implemented. Now say they they are against the on going peace talks with another break away group. The slammic front, they say these talks are not insulinnive and does represent the needs of the people in the philippines. It seems to be what the founder is trying to say is that no matter what kind of peace government the Philippine Group will have, this does not mean an end to the rebellion, and militarization here. Now Oil Giant Shell has begun talks with a Nigerian Community on compensation and clean up. Five years ago one of the pipelines burst, twice, and spilled thousands of barrels of oil into fishing ponds. More from podo in river state. Christian shows us the damage caused to his fish pond. They were destroyed when a poorly maintained pipelined owned by the Oil Company Shell burst twice in 2008. Thousands of barrels of oil gushed into the pond. I discovered all the pond was covered with oil. I see the fish trying to escape for life, but it was dark, and when i saw the money that had been put in, and the level in fact i nearly fainted. Our livelihood is totally destroyed. For me to survive now, it is just by the grace, i who used to give to others is now the common beggar. Shell admit it caused the damage, the company has agreed to pay compensation and clean up the area. But it disputes how serious the damage is, that disagreement could effect how much compensation it ultimately pays. Shell says around 4,000 barrels of oil were spilled here. But victims say it was much higher around 500,000 barrels. Getting shell to agree to pay any compensation is a legal victory for the people. The victims had to take shelter in the u. K. To get the company to accept responsibility. The Nigerian Government is now enacting a haw that would help victims get justice. We havent had a frame work clearly stating what is their responsibility of the responsible party, what they have spilled. In fact, i can tell you it has been very economical to spill as many barrels of oil that you like in nigeria. Christian hopes the new law will hold Oil Companies accountable when oil spills occur, but he is still very concerned about shells activities in the region. I believe that shell wants to wipe away people of this area. That is so that they can have their way. The god of the land, and the almighty god, who placed us here, would never have them escape all they have done. I know that shell has started negotiations with the community, as i understand it, the main dispute between the two sides is exactly how much damage and how much financial loss has been caused. Is that the case . Yes, thats quite true. The main dispute is the very fact that for so long, for many years after the spill, shell has yet to actually compensate the community for the impacts on the livelihood of the people. And that is the crux of the matter. The time it took for them to actually come to the negotiation table, its completely unacceptable. This wouldnt happen in other countries. So what are villages hoping to get in terms of compensation . How much do they want. Its difficult to put figures to this, but we are hoping that they will get quite substantial sum of money to compensate them for the loss of livelihood. The environmental damage on their members of the community is devastating. Its been devastating. These people are fisherman, and its actually not very very easy to measure in terms of financial terms. How much it has you know, effected the people in the community, and more over, there are al the health impacts. The Health Consequences from the effects of the environmental degradation. So you put all that together, maybe no amount of money cannot really compensate the people. Shell, of course, doesnt deny that its responsible for some of the oil spills, but it says a loss of the oil spills have been caused by thieves or militants tapping into the pipeline to steal the crude oil, it says it is not responsible for all of it, how do you react to that. Well, there is some element of truth into that. The fact that the two initial spills were caused by equipment failure, and shell accepted liability for that. However, it is also threw there has been incidents of bunkering activities and some refineries in the communities after the nil spill. So probably at this stage, the responsibilities are shared, however, the environment is completely completely devastated. And to make matters worse, as we speak, even today, there are still more spills occurring in this community which we find completely unacceptable. No, they dont. In fact you can see this tug of war going on between the u. S. And russia right now. Russia had the upper hand after john kerry came out with his proposal, but do you see the french and the u. S. Looking at a resolution. I think what we are going to see the putting conditions in there that cant be met. Like agreeing to never strike. We will see if the diplomatic way works and if it doesnt. I love that you call it john kerrys proposal, because its being presented as an accidental path to diplomacy. Whether or not he meant it as a proposal or not, i think we are stuck with it. And i think the Obama Administration has had to adjust. I think russia jumped out there and got the upper hand, and now we are seeing posturing. The serious situation, you can see it is part of a bigger context, involved russia, iran, the u. S. The western allies. Just how important do you think this meeting is going to be . Well, i think they are going to talk, i think russia doesnt want to appear to be selling out syria, so they are doing to try to put what they consider be realistic conditions. My guess is that the United States wont p able to agree to that, and so we will be back in a couple of weeks. Do you think russia will put its own resolution forward . They might. I think what is going to happen, though, is i think the west is going to put a resolution forward, and then force russias hand in the United Nations. To just say you know, you dont want this, you put all these conditions on it, and that will free the Obama Administration up to take the leadership again. Whether it be to strike militarily, or take another approach. But they kind of feel like they are they have been overrun a little bit. So i think you will see posturing to get back in control.
