The time is soon arriving where leaders are going to have to make difficult decisions. We are close to that time, if not at it. And i think we understand the circumstances within which we are working. Ambassador, leaders on all sides of these questions have void making these voide haved making these decisions. To operate in a way that does not blow out of the water what it is that secretary kerry has been trying to achieve. He Just Announced that he wants a Framework Agreement which to mean makes good sense. It follows the pattern that was followed in many camp david, you get a framework that serves as a negotiated treaty. And this is why secretary kerry is saying the time is now here when the leadership on both sides has to face up to the tough issues on the six or seven major questions he outlined, which i think is a good strategy and a solid one but not one that is guaranteed to produce success, that will require an enormous persuasive capacity, on the part of secretary kerry and president obama. It is not an easy issue to take on at the present time. Kerry has done it. The risks are high. But in my own view, if in fact this does not succeed, then kerry will have with president obama several alternatives. None of them very good. But certainly very important. One is, of course, to produce the u. S. Framework agreement, not one bargained between the two sides. Knowing what he knows now and knowing what he will know if this doesnt succeed. Another will be, take it to the u. N. Something that the u. S. Has rarely done if ever. But when it comes down to the wire, that may well have to be the possibility that is exploited. Before we pursue those options, i want to ask both you gentlemen, beginning with you, hussein ibish, priement netanyahu has made palestinian, a condition to peace. Obviously since 1981, palestinians have recognized the rights for israel to exist. Is this something they could accept or threaten to derail these talks . This is a very sensitive issue and it could derail the talks. Any of the very sensitive issues could. Its the question of the precise language. Netanyahus language, the nation state of the jewish people full stop. And that has too many definitive articles and too categorical. To fully embrace but it may be necessary even though youre right i mean this idea of israels jewish character however its defined being part of the israelipalestinian equation doesnt deal back any earlier than 2007 and really has only become a major issue in netanyahus second term, in the past few years, that seems like palestinians to have come out of the blue, as a hurdle and fifth final status issue. It still could be possible to find language at this stage that palestinians could live with recognizing israel is a jewish home land for or say recognizing israel as a jew esh homeland and for its citizens. Because there are really two issues that they worry about, they worry about the implication that it has for the full Citizenship Rights of palestinian citizens of israel. So language that refers to israel as a jewish home land and a state for all its citizens Something Like that could well be i think a big step in that direction and i think there are ways to parse this that are doable. Ambassador pickering, weve known for quite some time, some of the final status issues will be, the role jerusalem will play as capital of the israeli astate as wanted by the israelis, credit refugees that are outside the palestinian state. The essentially character of israel to be recognized as a jewish state would almost seem to oblige both parties to come to an agreement about a common narrative. And i wonder whether or not thats really possible or whether this is simply another you know, wrench being thrown into the works. This is kind of a roadblock. But i agree with hussein. I think that there are important things to consider here. One, each state of course has the right to describe itself as it sees fit, as long as it does not impose upon another state. Secondly, i would be loath to agree to israel as solely a jewish state. I would insist that it be democratic and that runs along the lines of husseins notion that it honest the rights honors the rights of all citizens. But it goes beyond that, rights that may not be included in a toonarrow definition. That is important. I think it is also significant that it needs to be reciprocal, that there has to be a palestinian state to be recognized and that bothsides should recognize each other as long as they dont seek by this mutual recognition to impose conditions on both sides. Yes, there are possibilities here, it would seem to me, and yes, they require a possibility to open ones heart to an agreement and not sit back and put demands on the table which seemingly solely seek to particularize one state and to characterize one state as having some exclusive rights or responsibilities without full consideration of the sovereignty and the interests of the second state. Well, that brings me to the next question, really, which is about the construction of new settlements. Israel has made a habit of announcing that it would be building new settlements after even during visits by senior american officials including Vice President biden. This week they have said that they are actually going to wait until secretary kerry is out of israel before they announce new settlement construction and they have also matched these settlement announcements with palestinian prisoner releases. To quote diana butto acknowledge, what confidence can i, diane , have that israel will evacuate israeli settlements when it comes to. Hussein, is there any confidence that israel will leave any part of the west bank . I dont think theres confidence. I think theres hope. And the hope resides mainly in an analysis of the l Israeli National interest. The question ultimately is what is israel going to do in the long run with these 4. 5 Million People and the territory they reside in . And facing an International Consensus and the great body of International Law that calls for two state solution plus the National Interest of their great patron and friend, us, the United States, it does seem to push very strongly in the direction of a twostate solution. But confidence might be overstated because i think theres a great fear that the current Israeli Government and priemenPrime Minister netanyahud prefer to drag this out. There is an interest of kerry to break that and get to another stage so thats very important. The thing about settlements and the their linkage with the prirs ner issue, Prime Minister netanyahu you just heard him complaining about the way palestinians blomed the priz centerprisoners home. It releases prisoners that it regards as terrorists and murderers in order precisely to facilitate additional settlement construction which really does seem you know to be a very strange an immoral and political logic if you will. To do something that they think is immoral in order to do something that is also self destructive to themselves and makes the problem worse. The second thing is theres settlement construction and theres settlement construction. Not all construction is equal. Some settlement construction doesnt change the strategic equation or changes it very little. Because its in areas that almost everyone agrees including palestinians will be part of a land swap. Other settlement is provocative and some, makes drawing the border much, much more difficult in certain why areas of ewan and harmona and parts of garsas acres ofon and things like that, does change the underlying dynamics. So wed have to see again here what exactly is being proposed and finally also whether its fulfilled, lots of settlement projects are announced again and again and again. And are never completed especially due to american pressure. And so thats another factor to be considered. Gentlemen, ambassador thomas pickering, hussein ibish, senior fellow on the american palestine, thank you for joings us. Thank you. Edward snowden to end his compile in russia and return to the u. S. Snowden a plea bargain or some cienlt of clemency that would allow him to return home and face at least substantially reduced punishment in light of his role as a whistle blower. But in calling for clemency for snowden, the times went against many elected leaders starting with president obama. I dont think mr. Snowden was a patriot. Hes a trait. The disclosure of this information puts americans at risk. It shows our adversaries what our capabilities are. And its a giant violation of the law. I dont think he meets the Legal Definition of being a traitor according to our constitution but he certainly has done a very, very bad thing. He has disclosed programs that make it easier for terrorists overseas and the first people who are going to feel that damage are our soldiers in afghanistan. The strength of leaking that, yes, that would be a prosecutable offense. And i think he should be prosecuted. He had an opportunity, if what he was was a whistle blower to pick up the phone and call the house intelligence committee, the Senate Intelligence committee, now hes done this enormous disservice to our country. And i i think answer is no clemency. Our belief last always been that he should return to the United States and face and face justice. Karen if i could begin with you, would you support some kind of clemency for Edward Snowden . I would. I dont think this is a hard call. I think what this man has done is to make this country have a discussion that it needed to have. And it couldnt have because so much of what is being considered was secret. Whether or not that actually harmed us in a National Security standpoint, whether our adversaries have information that they can use, as far as the release of the information, there is no doubt that he released classified information and that is a violation of federal law. Anyone putting their neck on the line, cia, fbi, any foreign personnel and of course our military personnel because tactics, techniques and procedures are things we always try okeep secret. I think one of the reasons the times is willing to come out on a limb is what he didnt release. He has an awful lot of information that he has chosen not to release. Yet. Yet. But he hasnt shown any sign of threatening to, he hasnt bargained with it as far as we know. If he were to agree not to release the rest of the information there are suggestions that he would in fact be granted clemency. That would be his leverage towards leniency. I can see looked at the information, he worked for this company as a contractor, he saw the broad scope of what the nsa was doing and he saw there was a problem. A federal judge kind of corroborated his opinion some manner, and to have that he said i think unconstitutional. Thats fine to say that, now lets look at that. If Edward Snowden had like nancy pelosi had gone to congress or feinstein said gone to the Senate Foreign relations committee, and rebuffed, then i can see going to a reporter, and then after going to a reporter id say going to a foreign country. But starting out in a foreign country, whether hes releasing it piece by piece or whether hes threatening to release more, he went to china or to russia. I think the take away as is this is a country particularly under president obama that is not kind to whistle blowers, doesnt want to call them whistle blowers, wants to call them leakers. When it does their own reporting on the Senate Select committee on torture, it doesnt get released. I can see this is a dampening effect. Maybe this was his option he choice because he thought it was the only option that would get a voice for him. It may very well be. Is this the only option he could have taken . That is my question, because this goes beyond releasing information or telling us theres a problem. The situation where we are now where he is silting in russia in compile, there is a question of exile, he has blown a whistle on government. Should he have to submit to that same government to determine his punishment . He is in exile, he can stay away as long as he wants. There isnt any shoulda, woulda, coulda. I need we think we have to have a conversation as to whether the ends justify the means. Did nsa surveillance keep us safer to the extent that it was used . We still dont have the answer to that question. I think the answer is, theres no way to prove it. There isnt but we do know of several plots that have been disrupted, whether its the underwear bomber in 2009 or many others that were not tied to nsa surveillance as the linchpin. The International Committee of the red cross put out a statement yesterday, saying the nile river is lined with thousands of people looking to cross as they flee violence. The i. Crc is providing basic kits to 30,000 displaced people, and surgical kits to hospitals that provide Emergency Medical Care to hundreds of thousands of people. Just how bad is the situation in south sudan . The situation is terrible. Simply put. South sudan, which is just recently come out of nearly 21 years of conflict, it is in a dire situation. It couldnt have been more dire, with close to 200,000 people who got displaced and about 75,000 people seeking refuge in the u. N. Campuses. It is, it is an extremely dire situation and at the International Federation of the red cross and red crescent our secretary general has instructed our offices to provide every possible south sudan red cross which recently became part of the red cross red crescent movement, to make sure they have all the help, all the capacities, an the necessities, but south sudan is a major challenge right now. There is proof that they have been targeted for their ethnic ethnicities. High level agreement and there was strong agreement, you know different parties really coming together, what should have simultaneously happened was to look at this Community Level peace engagement, Community Dialogue and our secretary general mr. Galetta, yo is very clear, you have to bring the major stakeholders to these conflicts to the tabling. Because keep in mind, these conflicts are not recent, they are deep rooted, primarily, a competition for resources so you know while you have to have the high level dialogue taking place between the political leaders, at the same time, it is critical to get the community elders, the tribal elders, the religious leaders who play a very, very important role, take the example of torrit, it is because of the tribal elders who have kept the calm, the peace between the different tribes who are there. You have nuer and dinkas there too. I am hoping that the addis abbaba talks come to quick fruition. Combined by the fact that the logistics in south sudan are very, very difficult. Ive lived there for a year and a half during the height of the conflict where he saw similar war unravel between former Vice President machar and the other sierd. As soon as we can put an end to the conflict and deal with the issues, there has to be a comprehensive strategy by the International Community that while we are looking at the highlevel dialogue we have to look at what can be done to ensure that the local communities, that the differences between the tribes is actually brought together to look at a Strategic Vision of what the new sudan is going to look like. And i think that is where the real you know energy needs to be devoted. In your view what is it going to take to get both sides to this conflict to agree to a peaceful resolution and to lay down arms . I think egad and the leadership of ethiopia and kenya are doing a great job. This is an african problem, it needs an african solution. What the International Community is doing is allowing the leadership to take charge. And work with their interlocutors to take charge in south sudan. Clearly im quite confident that if these parties that have been brought together, the fact that these discussions have started taking place in adis abbaba, that we will find a quick resolution to this. Because after all, for mr. Riek machar and salva kiir, they also need to be sensitive to the reality that after 21 years of war, there are a lot of psychologically scarred young people who have become adult. It is a very young country. You have to address the needs. You have to look at issues of inequality. You have to look at issues of inquit. Inequity. Access to advancement of the Human Development of south sudan. I think thats where they kind of got left out of the development curve. They need the peace development, i think that itself will allow opportunities of uniting these different tribes. In the short time we have left, obviously there is a the political track taking place in adis abbaba, the situation is dire for those people there. How difficult is it proving to be able to get food, water and medical care to the people who are displaceor the people who in fact are fleeing for their lives . I would best describe south sudan as a diabolical trinity where nature and diseases have been overwhelming. Having lived there, i know, you know, from diseases to incliment diseases to diarrheal diseases, the third part is the Human Element and that has been tragic is this innate nature of warfare which has been going on for so long. So i think you know this is what that needs to be really addressed, this is at the root of it. There are major logistical challenges. Most of the paved roads are in and around juba. When i went there in the year 2000, 2001 i mean 70 of the population didnt even have clothes there. So it is kind of held back from the development of it and i think there needs to be the energy and the motivation of the International Community to make sure that the youngest nation in the world is a successful young nation. Because this opportunity will not come again and we should not allow south sudan to slip down where weve kind of brought it to. So i think we also have a collective responsibility to see this nation succeed. Siddharth chatterjee. Thank you for coming on to discuss this very important conflict. Thank you. The unverified claim that rebel soldiers are marching on the capitol just as cease fire efforts get underway. Do you think there is any credibility in those reports . I think there very likely is. Phillip aguirre, the spokesman for south sudans army, has indicated that the rebel forces have actually moved 13 miles south of bor which is 125 miles north of juba the capitol. If there is a confrontation between the spla and the Rebel Movement on that road, it will be very bloody. It will ensure that fighting does not stop. And it will almost certainly collapse the talks that are currently about to get underway, three weeks after the events that precipitated those sections. Those talks seem to have been delayed, were not exactly sure why. You are suggesting that if there is a major confrontation between the spla and this Rebel Movement that could put pain to any prospect for a peaceful settlement in the near future. We need to remember that this is not an easily expandable time line that were dealing with. The chief humanitarian official in south sudan, said that while there are more than 200,000 people instantly displaced, today, that could easily rise to 400,000 within the pace of a few days. A few days. This is moving too slowlily egad mechanism is not sufficient to the task at hand i dont belie believe. In uganda seems to be going rogue, in his participation in enforcing egads deadline for a cease fire seems to be deeply counterproductive. Well, the ugandan president has said that east african nations will go after the rebel leader if he rejects the cease fire offer. Is that realistic or is it just for show . You have suggested tonight that the number of displaced people could easily double within days or even hours. If the two sides sit down in ethiopia, where do you see the conflict heads from here . Are you more hopeful do you think than you were a few days ago . No, i must say i am not. There is a kind of dilatory behavior in addis that makes no sense in light of the urgency on the ground. If were having a doubling of displaced persons and those people are in many cases without any humanitarian resources. U. S. Aid came out today and said that 76,000 of them are in a town 30 miles to the west of bor. At a u. N. Compound that has absolutely no capacity. No humanitarian capacity. People are Drinking Water straight from the nile which, in that region, is almost guaranteed to start an epidemic of watery diarrhea. This is a situation that is getting so much worse, so much faster. The message i think from toby lancer the u. N. Humanitarian coordinator today is this is urgent, this is urgent, this is more urgent than you realize and that would be my message on the basis of what im seeing. And that urgency is not reflected in what were seeing in addis ababa, and is not helped from threats from museveny, an able to bring pressure to bear on riek machar. The former secretary of clergy for the archdiocese of philadelphia, was convicted for felony child endangerment for transferring an accused priest to a new parish where he later raped another child. Barbara blaine, founder and director of snap, the Survivor Network of those abused by breess. The floinl endangerment law only applied them in direct supervision of children. The law was changed in 2007 to include anyone who supervises abusers. As well as those who commit the abuse. Is lynn being released on a technicality or does this follow the spirit of the law . It seems pretty clear that monsignor lynn knowingly left children in positions where they would be harmed by knowingly transferring predator priests to parishes without warning the families, without warning parents, and without, he refused to turn over the information about crimes to police. And even lied about it to parishioners and families. So those facts came out in the trial. This ruling by the superior court, as you know, is going to be appealed to the Supreme Court of the state, and we believe then that the proper finding will be made. What does it say to the victims of these crimes when the first u. S. Church official to be held responsible for taking part in what has grown to become clearly a massive coverup, in the scandal, is released . You know, its to be honest with you, we were shocked that finally, one prosecutor was willing to go out on a limb and actually prosecute some of these enablers. We know by the bishops own numbers, that they have revealed that less than 2 of the priests who raped and sodomized and sexually violated us ever served a day in jail. So the Church Officials successfully covered up 98 . So we thought it really remarkable that finally, someone who enabled these crimes was being held accountable. And thats the first time anyone has been. But i think its really telling that even now, that archbishop shapoo and other officials in the archdiocese of philadelphia are encircling monsignor lynn. They paid i his bail. Assuming they was wrongfully convicted if he did get off its a technicality. No one is disputing the facts of what monsignor lynn engaged in. We should say that we reached out to the arch di archdiocese f philadelphia, they declined to participate. But going forth, if his release is upheld, is there any chance do you think of bringing new or different charges against lynn . Would there be a possibility even of a prosecution . Im not sure what other possibilities are out there. But this is what i do know. As long as victims remain silent that these sex crimes go on. And thats why as painful as it is we encourage anyone with information whether they witness, suspect or experience these sex crimes, they should report what information they have to the police, not to the Church Officials. Now, monsignor lynn remains a priest in good standing. Its not clear what happens to him now that he is out on bail. He apparently has gone to some of his family. What do you do if he is appointed to another diocese or to another position within the archdiocese of philadelphia or elsewhere within the Catholic Church in the u. S . Well obviously, i think if he is allowed to be find another position in ministry in the Catholic Church it shows that Church Officials really condone this type of behavior. That they would allow someone whos been caught doing this to continue. And we believe that its only a sign of a larger problem within the church. I mean were sitting here today, theres another there is a bishop, a bishop of kansas city, missouri, bishop finn was found guilty of endangering children, and hes still in his position as bishop. No ones removed him. We know that tomorrow the archdiocese of st. Louis the archbishop is to turn over information, hes been ordered by a judge.
